which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Native American Languages Act to ensure the survival and continuing vitality of Native American languages, and for other purposes. </official-title></form><legis-body><section id="id1B57CB18EE094971AB0249A2F45CC079" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Durbin Feeling Native American Languages Act of 2020</short-title></quote>.</text></section><section id="id7B05D3AF2DAF4B42BDD11BCB2828C4AD"><enum>2.</enum><header>Ensuring the survival and continuing vitality of Native American languages</header><subsection id="id4A89A1999970401EB8E090192ADF3985"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 106 of the Native American Languages Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2905">25 U.S.C. 2905</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7cfa89798f0d4c61a478b776048cbfc1"><subsection id="id0e0ec0f96fe94a2ab6b10a209713f13a"><enum>(c)</enum><header>Evaluation; report</header><text>Not later than 1 year after the date of enactment of this subsection, the President shall—</text><paragraph id="idD6C17004ABDA452B8E5C415A08FFBC87"><enum>(1)</enum><text>require the heads of the various Federal departments, agencies, and instrumentalities to carry out an evaluation described in subsection (a)(1); and</text></paragraph><paragraph id="idB52C7BEC415443F4B95DCCA7793221E8"><enum>(2)</enum><text>submit to Congress a report that describes—</text><subparagraph id="id54a09cd91850485091d4d3cd83d1f48b"><enum>(A)</enum><text>the results of the evaluations; and</text></subparagraph><subparagraph id="id8df7c410d8c243bf8ec615fddf34c9f3"><enum>(B)</enum><text>the recommendations of the Secretary of the Interior, the Secretary of Health and Human Services, and the Secretary of Education, after consultation with Indian tribes, traditional leaders, and representatives of Native American language communities, for amendments to Federal laws that are needed—</text><clause id="idee5aa4a6dc004df2b79b9034039f40bc"><enum>(i)</enum><text>to bring the Federal laws into compliance with this Act;</text></clause><clause id="id3e9dca90307e45e29712c9438bb0dc8d"><enum>(ii)</enum><text>to improve interagency coordination for purposes of supporting revitalization, maintenance, and use of Native American languages; and</text></clause><clause id="id00479ba797dc4d388bad4cc32f7ef1b4"><enum>(iii)</enum><text>to reduce duplication, inefficiencies, and barriers Native American language communities face in accessing Federal programs to support efforts to revitalize, maintain, or increase the use of Native American languages.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0FA2A61B58D34A8A860FE974A23B4851"><enum>(b)</enum><header>Survey on Native American languages</header><text>The Native American Languages Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2901">25 U.S.C. 2901</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3F9F8A58DA6C4A5A823EC6610B3F665F"><section id="id5DB87B717CC34877921D6473A0F19F2A"><enum>108.</enum><header>Survey on Native American languages</header><subsection id="id68425706f5a747ca965f744238a8df9e"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this section, and every 5 years thereafter, the Secretary of Health and Human Services, acting through the Commissioner of the Administration for Native Americans (referred to in this section as the <term>Secretary</term>), shall undertake a survey of the use of Native American languages in the United States. </text></subsection><subsection id="idb2666edcf0cf42d6bd67680714adc123"><enum>(b)</enum><header>Updates</header><text>Prior to conducting each subsequent survey after the initial survey under subsection (a), the Secretary shall update the survey in accordance with this section.</text></subsection><subsection id="idB27B4D008AE345A093459DC81CC093D0"><enum>(c)</enum><header>Consultation required</header><text>The Secretary shall design the initial survey under subsection (a) and each updated survey under subsection (b)—</text><paragraph id="id758B4EF3B4FA4F9BA0DC727313CCB62E"><enum>(1)</enum><text>in consultation with Indian tribes; and </text></paragraph><paragraph id="id49F10DA0F6A542EE9D976BDE860AAC5E"><enum>(2)</enum><text>after considering feedback received from Native American language speakers and experts.</text></paragraph></subsection><subsection id="idabf3534aaaaf4abba6691881f87cd200"><enum>(d)</enum><header>Contents</header><text>Each survey under subsection (a) shall solicit—</text><paragraph id="idE8B7F421A5304E478F0BDAA480DC5F50"><enum>(1)</enum><text>information on which Native American languages are currently spoken;</text></paragraph><paragraph id="id56568803F8B647E8B2BB23355591432D"><enum>(2)</enum><text>estimates of the number of speakers of each Native American language;</text></paragraph><paragraph id="id4FF4F959479F49E0A822DF83C73CC0A7"><enum>(3)</enum><text>any language usage statistics or information that the Secretary, in consultation with Indian tribes and Native American language speakers and experts, determines to be relevant and appropriate;</text></paragraph><paragraph id="id64050FE4650E49B4B94179C123EAD116"><enum>(4)</enum><text>information on Native American language maintenance and revitalization projects and practices that are currently being carried out;</text></paragraph><paragraph id="id26AA15794B264851BF3A8A0ECE0B7C11"><enum>(5)</enum><text>information on any unmet Native American language resource needs of Indian tribes and Native American language communities; and </text></paragraph><paragraph id="idD9D1F0906457483A9B62F61C22B2608F"><enum>(6)</enum><text>any other information that the Secretary, in consultation with Indian tribes and Native American language speakers and experts, determines to be necessary.</text></paragraph></subsection><subsection id="idad77dda5f43449dc9dc654793af5cf38"><enum>(e)</enum><header>Outreach and engagement</header><paragraph id="idb91388c9da12439b80f0b19b7b9a5598"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out outreach and engagement activities to provide Indian tribes, Native language communities, and the public information about—</text><subparagraph id="id14aa2b1969f04c038390a40f5e6826f7"><enum>(A)</enum><text>opportunities to provide input on the development and design of each survey under subsection (a), including information on the consultations required under subsection (c); </text></subparagraph><subparagraph id="id9d7be1e54b194606a2d20c401b368a2f"><enum>(B)</enum><text>the goals and purpose of the surveys conducted under subsection (a); and</text></subparagraph><subparagraph id="id7b76884d3a464f838493a4ef50ab4d9f"><enum>(C)</enum><text>the benefits and importance of participation in surveys under subsection (a).</text></subparagraph></paragraph><paragraph id="idc13afd8fbc734c2ba848aba8f862cc2f"><enum>(2)</enum><header>Grants, contracts, and cooperative agreements authorized</header><text>The Secretary may carry out the outreach and engagement activities required under paragraph (1)—</text><subparagraph id="idDA93B5BA67CE4AF883B27F4FF4695865"><enum>(A)</enum><text>directly; or</text></subparagraph><subparagraph id="idD4C0BE2764124D37A1EBEE3810650564"><enum>(B)</enum><text>through grants to, or contracts or cooperative agreements with—</text><clause id="idc8a4d9ab3d4546c5b98bb481f99050d1"><enum>(i)</enum><text>Indian tribes;</text></clause><clause id="idb6cd2321fa0e4973b609491926918556"><enum>(ii)</enum><text>tribal organizations; and</text></clause><clause id="idda744e66df2b4ff3bdacb3dac43a18a6"><enum>(iii)</enum><text>nonprofit organizations that work with Indian tribes, Native American language programs, and Native American language communities. </text></clause></subparagraph></paragraph></subsection><subsection id="id8F7C5CE2DEEE45B998D362673D110C6A"><enum>(f)</enum><header>Limitation</header><text>Nothing in this section requires an Indian tribe, Native American language community, or Native American language speaker—</text><paragraph id="id2D04D5127D4A4145AD91A17472250960"><enum>(1)</enum><text>to participate in a survey under subsection (a); or </text></paragraph><paragraph id="id8B6ED97C61744C36BDF4B9BB3E623BBD"><enum>(2)</enum><text>to provide specific or culturally sensitive information in completing such a survey.</text></paragraph></subsection><subsection id="id3d5f2eb53928486390dd4d22fe5e993f"><enum>(g)</enum><header>Availability of survey materials and findings</header><paragraph id="idF7ACCB66F8B8434F87BF5D707CBEFDDB"><enum>(1)</enum><header>In general</header><text>Not later than 270 days after the date of enactment of this section, and prior to conducting each survey under subsection (a), the Secretary shall submit to the Committee on Indian Affairs of the Senate and the Committee on Natural Resources of the House of Representatives, and make publicly available, a description of—</text><subparagraph id="idE893B0B1953842BD9F40E5FA60F331B0"><enum>(A)</enum><text>the feedback received under subsection (c) on the design of the survey;</text></subparagraph><subparagraph id="id68516AB7486A4FFCA46ABEF588099FEC"><enum>(B)</enum><text>the form and content of the survey;</text></subparagraph><subparagraph id="id954492926B2E4F918F55837F69940DBD"><enum>(C)</enum><text> the plan for deploying the survey to ensure a robust response; and </text></subparagraph><subparagraph id="id2C48883C8CAA47858B45CF891E07166D"><enum>(D)</enum><text>how the Secretary will ensure any survey enumeration efforts are culturally informed and appropriate. </text></subparagraph></paragraph><paragraph id="idB5F6DF1F5C2C4112A129D0327608E0EF"><enum>(2)</enum><header>Results</header><text>Not later than 90 days after the date on which each survey under subsection (a) is completed, the Secretary shall submit to the Committee on Indian Affairs of the Senate and the Committee on Natural Resources of the House of Representatives, and make publicly available, the results of the survey.</text></paragraph></subsection><subsection id="id341a080e11c740afaff32bee2f492097"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $1,500,000 for each fiscal year—</text><paragraph id="id95A5324B4307421882EB5380329535D7"><enum>(1)</enum><text>preceding a fiscal year during which a survey under subsection (a) is conducted; and </text></paragraph><paragraph id="idDFE01C13A37B4C40A90F9C280CDE0DB6"><enum>(2)</enum><text>during which a survey under that subsection is conducted.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
