which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Policy and Conservation Act to modify the definition of water heater under energy conservation standards, and for other purposes.</official-title></form><legis-body><section id="iddeda866c24404d01abcef25017128571" section-type="section-one"><enum>1.</enum><header>Water heaters</header><subsection id="id381b911a2124431ebd6733aa527d1786"><enum>(a)</enum><header>Definition of water heater</header><text>Section 321 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6291">42 U.S.C. 6291</external-xref>) is amended by striking paragraph (27) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id998ca5a900904f54a60011c2f0fd318a"><paragraph id="id9c20f165151740a69dd55f3fc1b895e2"><enum>(27)</enum><header>Water heater</header><subparagraph id="ida45b1d02ff7f4603a07922d9245aadf2"><enum>(A)</enum><header>In general</header><text>The term <term>water heater</term> means a product that utilizes oil, gas, or electricity to heat potable water for use outside the heater on demand, including—</text><clause id="idfd88710ee2e0476c9ec46ddc50c210cb"><enum>(i)</enum><text>storage type units that heat and store water at a thermostatically controlled temperature, including—</text><subclause id="ide35ece24ec5e42eca3abdaca3d24ec2b"><enum>(I)</enum><text>gas storage water heaters with an input of 75,000 Btu per hour or less, including heat pump type units that meet the current and voltage limits under clause (iii);</text></subclause><subclause id="id358717a7ec7b44e2a33d50f2df7c3bd1"><enum>(II)</enum><text>oil storage water heaters with an input of 105,000 Btu per hour or less; and</text></subclause><subclause id="idc46c1b7b0f3a4d659341d312ce80b035"><enum>(III)</enum><text>electric storage water heaters with an input of 12 kilowatts or less, including heat pump type units that meet the current and voltage limits under clause (iii);</text></subclause></clause><clause id="idfcb2921991fa4359a51d5bddb2f90679"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idd5f7975cb9da46469d6f84a780f58578"><enum>(I)</enum><text>instantaneous type units that heat water but contain not more than 1 gallon of water per 4,000 Btu per hour of input; and</text></subclause><subclause id="idf775035f0f06411a9d40fcefec143e52" indent="up1"><enum>(II)</enum><text>in the case of—</text><item id="ida58be7627d8e4f3782c35b260d75fba6"><enum>(aa)</enum><text>gas instantaneous water heaters, have an input of 200,000 Btu per hour or less and are designed and marketed to provide outlet hot water at a thermostatically controlled temperature of less than 180 degrees Fahrenheit;</text></item><item id="idae044ad07dfd4a9bbaf4e253f163d2ac"><enum>(bb)</enum><text>oil instantaneous water heaters, have an input of 210,000 Btu per hour or less; and</text></item><item id="id58ba67c76b7c4a2f899e493e10dd9ec5"><enum>(cc)</enum><text>electric instantaneous water heaters, have an input of 12 kilowatts or less;</text></item></subclause></clause><clause id="idb2bd1bfda33e4988a913ef38583c3106"><enum>(iii)</enum><text>heat pump type units (including add-on heat pumps, integrated heat pumps with storage, split-system heat pumps that consist of a separate heat pump and storage tank that are designed and marketed to operate together, and all ancillary equipment, such as fans, storage tanks, pumps, electric resistance heating elements, or controls necessary for the device to perform its function) that—</text><subclause id="id181f35bc85fd4d31af8e8063494dadf9"><enum>(I)</enum><text>have a maximum current rating of 24 amperes at a voltage not greater than 250 volts; and</text></subclause><subclause id="id74a56d5a282e4df4a0e8664645b63c37"><enum>(II)</enum><text>are designed to transfer thermal energy from 1 temperature level to a different temperature level for the purpose of heating water;</text></subclause></clause><clause id="idb72a57399a6849df9562eab331314d0a"><enum>(iv)</enum><text>solar thermal-assisted electric storage units; and</text></clause><clause id="id9a3fc5f076fc4a49ab642e81c5f0c401"><enum>(v)</enum><text>solar thermal-assisted fossil fuel storage units.</text></clause></subparagraph><subparagraph id="id0ad986606b05459bad378621517f1e7b"><enum>(B)</enum><header>Exclusions</header><text>Unless otherwise determined by the Secretary under section 325(e)(7)(B), the term <term>water heater</term> does not include—</text><clause id="id169a3dab6e3a466db99fb63765a41e58"><enum>(i)</enum><text>electric storage type units described in subparagraph (A)(i)(III) that—</text><subclause id="id0ac4dc80b0e2425bb73b04582a8cd0b1"><enum>(I)</enum><text>are designed and marketed exclusively for commercial building applications; and</text></subclause><subclause id="id07f7b9cc04ce43c1ae8eebd3db2693ea"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id789f5a6fea6f42a180e3e730d2056d60"><enum>(aa)</enum><text>are designed, constructed, inspected, tested, and stamped in accordance with Section IV, Part HLW, or Section X of the Boiler and Pressure Vessel Code promulgated by the American Society of Mechanical Engineers;</text></item><item id="id06c449ecd1e449a297ae9c142fec9d48" indent="up1"><enum>(bb)</enum><text>exclusively use 3-phase electricity, are designed and marketed to provide outlet hot water at a thermostatically controlled temperature of 180 degrees Fahrenheit or greater, and operate only at rated voltages of not less than 208 volts; or</text></item><item id="id18c61503e1364fdd8d0f032f942dea81" indent="up1"><enum>(cc)</enum><text>exclusively use single-phase electricity, are designed and marketed to provide outlet hot water at a thermostatically controlled temperature of 180 degrees Fahrenheit or greater, and operate only at a rated voltage of 277 volts; or</text></item></subclause></clause><clause id="id74df9c623ae244f3888aa3945eb9fd7c"><enum>(ii)</enum><text>gas storage type units described in subparagraph (A)(i)(I) that—</text><subclause id="ida958ce6c37f745abb1ada06c0048d048"><enum>(I)</enum><text>are designed and marketed exclusively for commercial building applications; and</text></subclause><subclause id="id06159d98cc7347858c1f1606edfed54e"><enum>(II)</enum><text>are designed, constructed, inspected, tested, and stamped in accordance with Section IV, Part HLW, of the Boiler and Pressure Vessel Code promulgated by the American Society of Mechanical Engineers.</text></subclause></clause></subparagraph><subparagraph id="id8fc0bb9e79b64ab8a10a8cd767d067fc"><enum>(C)</enum><header>Multi-input electric storage water heater</header><text>The term <term>multi-input electric storage water heater</term> means a product that—</text><clause id="id862cdd1ab067422ba75b850dd1364747"><enum>(i)</enum><text>is not a heat pump type unit described in subparagraph (A)(iii); and</text></clause><clause id="id2c0aa9fcc1e7499284e5e076dc4d30ae"><enum>(ii)</enum><text>is designed, marketed, or shipped from the manufacturer with a capability of operating or being configured to operate at inputs greater than, equal to, or below 12 kilowatts.</text></clause></subparagraph><subparagraph id="idb066b849cd9944cf9b64c89cd8beef7c"><enum>(D)</enum><header>Solar thermal-assisted electric storage unit</header><text>The term <term>solar thermal-assisted electric storage unit</term> means a unit that—</text><clause id="id0460b569486546e3bfdb023c2f3c9ad7"><enum>(i)</enum><text>has an input of 12 kilowatts or less;</text></clause><clause id="id62d69562ac5945d08dd77c47df3cd7b5"><enum>(ii)</enum><text>has at least 2 dedicated ports in addition to the ports used for introduction and delivery of potable water for the supply and return of water or a heat transfer fluid heated externally by solar panels;</text></clause><clause id="id7a554c365fe94478b0f9bc9b524cc401"><enum>(iii)</enum><text>does not have electric resistance heating elements located in the lower half of the storage tank;</text></clause><clause id="id2b484a9aa5a04ac9b3a65a9d42580057"><enum>(iv)</enum><text>has the temperature sensing device that controls the auxiliary electric heat source located in the upper half of the storage tank; and</text></clause><clause id="id81f7dda1c7cb4a948dffb4adb524c375"><enum>(v)</enum><text>has a ratio of less than 0.70 for the proportion that the certified first hour rating bears to the nominal volume of the storage tank.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id9ed9bcf142e04e6d8ef21cb4ff2b605e"><enum>(b)</enum><header>Standards for water heaters</header><text>Section 325(e) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6295">42 U.S.C. 6295(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idaa531e91d12942b89e1576f2e2a9c427"><paragraph id="ida055f466005c4ee7a5c5bf8be271c5da"><enum>(7)</enum><header>Exempted water heaters</header><subparagraph id="id2ab3384c95394d62b55c60adfd7cd952"><enum>(A)</enum><header>Definition of exempted water heater</header><text>In this paragraph, the term <term>exempted water heater</term> means a water heater described in section 321(27)(B).</text></subparagraph><subparagraph id="id21efacfa6d57489fa638b1de9d6df7d1"><enum>(B)</enum><header>Monitoring of shipments</header><clause id="id62e2338146c44c519191d40e64d664a9"><enum>(i)</enum><header>Submission of data</header><text>Not later than 90 days after the date of enactment of this paragraph, and not later than May 1 of each year thereafter, the Secretary shall require each manufacturer of water heaters to report to the Secretary the quantity of exempted water heaters, in each category of exempted water heaters, that the manufacturer shipped in the preceding calendar year.</text></clause><clause id="idbe77ee7ab38f4778ac3fa75564d0073c"><enum>(ii)</enum><header>Confidentiality requirements</header><text>The Secretary shall treat shipment data reported by manufacturers under clause (i) as confidential business information subject to appropriate confidential data safeguards.</text></clause><clause id="id9879437ee3f94f17b419bf2e3d60ad5d"><enum>(iii)</enum><header>Publication</header><subclause id="ided700fea4eb3461a84b30dcb05736cf4"><enum>(I)</enum><header>Baseline shipment data</header><text>Not later than 120 days after the date of enactment of this paragraph, the Secretary shall publish an analysis of the data collected under clause (i) for public comment, subject to applicable confidentiality safeguards, which shall serve as the baseline data for the analysis described in subclause (II)(bb).</text></subclause><subclause id="id8706ce3e53cf4501b0477df512c007e4"><enum>(II)</enum><header>Percentage growth from baseline</header><text>Not later than June 1 of each year after the year in which the Secretary publishes data under subclause (I), the Secretary shall publish—</text><item id="id331499f678724265a159fbc55025df5a"><enum>(aa)</enum><text>an analysis of the data collected under clause (i) for public comment, subject to applicable confidentiality safeguards;</text></item><item id="id4a39c87308ba4db3936bd914afae368d"><enum>(bb)</enum><text>the percentage growth in the number of shipments within each category of exempted water heater relative to the baseline data described in subclause (I); and</text></item><item id="id0380c220f350469f9e8a970e47113397"><enum>(cc)</enum><text>the determination of the Secretary as to whether the number of shipments for any category of exempted water heater have increased by more than 25 percent compared to the baseline data for that category.</text></item></subclause></clause></subparagraph><subparagraph id="id6ba6cc40207b41518c11bebb5e3478a5"><enum>(C)</enum><header>Inclusion of exempted water heaters</header><clause id="id1cc101cf5b00478b900b5a15b08886e6"><enum>(i)</enum><header>In general</header><text>The Secretary shall, by regulation, revise the definition of water heater under section 321(27) to include an exempted water heater under subparagraph (A) of that section if the Secretary makes an affirmative determination under subparagraph (B)(iii)(II)(cc) for that category of exempted water heater.</text></clause><clause id="idd6dd8d6ab7994dc4bb90a4a36b0d7894"><enum>(ii)</enum><header>Energy conservation standards</header><text>Any category of exempted water heater included in the definition of water heater under clause (i) shall be required to meet the energy conservation standards applicable to an electric or gas storage type water heater under this part.</text></clause><clause id="idf08deb77e27a4918adbef0ec6ccb1552"><enum>(iii)</enum><header>Effective date</header><text>For any category of exempted water heater, the Secretary shall carry out clause (i), and require compliance under clause (ii), not later than 1 year after the date on which the Secretary makes the affirmative determination described in clause (i) for that category.</text></clause></subparagraph></paragraph><paragraph id="id5F272215AA774B19AA1EE059C56A1702"><enum>(8)</enum><header>Standards for multi-input electric storage water heaters</header><text>A multi-input electric storage water heater shall be subject to the test procedures, energy conservation standards, labeling (if applicable), and certification requirements—</text><subparagraph id="idC1F5CD074BC14A9A8D81A43B9103562C"><enum>(A)</enum><text>for electric storage water heaters under this part; and</text></subparagraph><subparagraph id="id92957c800a764a4c82296483540101c6"><enum>(B)</enum><text>for storage water heaters under part C. </text></subparagraph></paragraph><paragraph id="id799befe1c46b4f01acdaa0123cd39711"><enum>(9)</enum><header>Technology-neutral electric storage water heater standards</header><text>Notwithstanding any other provision of this Act, the Secretary may not create separate product classes for heat pump water heaters and other electric storage water heaters.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id17f18e06e23d4b559f1bfe400270a946"><enum>(c)</enum><header>Definition of commercial water heater</header><text>Section 340 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6311">42 U.S.C. 6311</external-xref>) is amended by striking paragraph (12) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5f30973fed9748428aaf0a1cbdb22685"><paragraph id="idc7249f404d9e4f1aa03026799957faf4"><enum>(12)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id936362a1ea2142aca764daef122dd765"><enum>(A)</enum><header>Storage water heater</header><clause id="ide7dcb2b6964246638b172d5f5a3dd24c" indent="up1"><enum>(i)</enum><header>In general</header><text>The term <term>storage water heater</term> means a water heater that—</text><subclause id="idc84c29d427ad4029b9b3c51889244f82"><enum>(I)</enum><text>heats and stores water within an appliance at a thermostatically controlled temperature for delivery on demand; and</text></subclause><subclause id="id1831351f65f64f8eadfbbc8e2cd708ff"><enum>(II)</enum><text>is not a water heater described in section 321(27)(A).</text></subclause></clause><clause id="idf0ebb8a3b8d444778697cb9d8cec8b01" indent="up1"><enum>(ii)</enum><header>Exclusion</header><text>The term <term>storage water heater</term> does not include a unit with an input rating of 4,000 Btu per hour or more per gallon of stored water.</text></clause></subparagraph><subparagraph id="idbe9d2556e5404f159d8eb5558c01b26d" indent="up1"><enum>(B)</enum><header>Instantaneous water heater</header><text>The term <term>instantaneous water heater</term> means a water heater that—</text><clause id="id2d9d60d73dd64cc79bcfd21604e6d2be"><enum>(i)</enum><text>has an input rating of at least 4,000 Btu per hour per gallon of stored water; and</text></clause><clause id="id03cf4eb39bad483499d2a7a9747afda1"><enum>(ii)</enum><text>is not a water heater described in section 321(27)(A).</text></clause></subparagraph><subparagraph id="idf2da584bd6cb4b6398c68e284af6eb7e" indent="up1"><enum>(C)</enum><header>Unfired hot water storage tank</header><text>The term <term>unfired hot water storage tank</term> means a tank used to store water that is heated externally.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8eb08dad2de04989b0e65fa280a806f5"><enum>(d)</enum><header>Labeling requirements</header><text>Section 344 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6315">42 U.S.C. 6315</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide484e39e5d6c46bea18d4632d5749b08"><subsection id="id8140a314771542d8b728f748e25bb8bb"><enum>(l)</enum><header>Labels for certain commercial water heaters</header><paragraph id="id2cda29f20a6a4485b95cd6a8aa886ff8"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of this section, water heaters described in section 321(27)(B) shall be required to bear a permanent label, applied at the point of manufacture, that, subject to paragraph (3), satisfies the requirements described in paragraph (2).</text></paragraph><paragraph id="id6c34ca251bdc4d18b6817a8e89305e50"><enum>(2)</enum><header>Requirements</header><text>A label required under paragraph (1) shall—</text><subparagraph id="idc93973eb3bb14cd2b27dd341d96db423"><enum>(A)</enum><text>be made of material not adversely affected by water;</text></subparagraph><subparagraph id="idf8f2dd8f464f40feb461d251b71ba5e2"><enum>(B)</enum><text>be attached by means of nonwater-soluble adhesive; and</text></subparagraph><subparagraph id="id210e3a2d370d4cd28422c47d899d2d60"><enum>(C)</enum><text>bear the following notice printed in 16.5 point Arial Narrow Bold font: <quote>IMPORTANT INFORMATION: Exclusively intended for commercial installations. This model is not certified by the U.S. Department of Energy as a residential water heater. This model does not have a certified First Hour or UEF rating.</quote>.</text></subparagraph></paragraph><paragraph id="id9a58194e92614ff696e9201fe42d2c0f"><enum>(3)</enum><header>Revision upon petition</header><text>On receipt of a petition by an interested party, the Secretary may conduct a rulemaking to revise the scope and requirements of the label required under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idca09424be9d648668ed8862aece023fe"><enum>(e)</enum><header>Effective date</header><text>This section and the amendments made by this section shall take effect 180 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
