<distribution-code display="yes">II</distribution-code><congress>116th CONGRESS</congress><session>2d Session</session><legis-num>S. 4075</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20200625">June 25, 2020</action-date><action-desc><sponsor name-id="S372">Mrs. Capito</sponsor> (for herself and <cosponsor name-id="S308">Mr. Cardin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Works and Economic Development Act of 1965 to provide for the release of certain Federal interests in connection with certain grants under that Act, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reinvigorating Lending for the Future Act</short-title></quote> or the <quote><short-title>RLF Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id742B228A6E274FC1AC1FD94A8FE92B74"><enum>2.</enum><header>Release of certain interests</header><text display-inline="no-display-inline">Section 601(d)(2) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3211">42 U.S.C. 3211(d)(2)</external-xref>) is amended—</text><paragraph id="id3905FD2DB7DA489C82878EAF32F6273F"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the paragraph designation and heading and all that follows through <quote>The Secretary may</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8E3DE5AF61034964BC0D73F6571278D7"><paragraph id="idC8B3E4BE51B741A4927ED30BBA5541B5"><enum>(2)</enum><header>Release</header><subparagraph id="idA863C5D4FE74405EB93CA1869114017B"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Secretary may</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="ida85721ee34084e6a8fa2114cf7153d08"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF37395017566408BA2E09C60472257FF"><subparagraph id="id6BF69CA27B834B479B4A2EC426095B56"><enum>(B)</enum><header>Certain releases</header><clause id="id7425dc8b9cfc454f8f8f31227beb3b2c"><enum>(i)</enum><header>In general</header><text>On written request from a recipient of a grant under section 209(d), the Secretary shall release, in accordance with this subparagraph, any Federal interest in connection with the grant, if—</text><subclause id="id23a0545208fc4b2490dde089fe06a536"><enum>(I)</enum><text>the request is made not less than 7 years after the final disbursement of the original grant;</text></subclause><subclause id="idE9F0C320A7E440DEB85DF5D60BF2D524"><enum>(II)</enum><text>the recipient has complied with the terms and conditions of the grant to the satisfaction of the Secretary;</text></subclause><subclause id="id1b9a504a5fcc4abc966748ca95682dba"><enum>(III)</enum><text>any proceeds realized from the grant will be used for 1 or more activities that continue to carry out the economic development purposes of this Act; and</text></subclause><subclause id="id1298C34320C04C749FCC18C782744AFD"><enum>(IV)</enum><text>the recipient includes in the written request a description of how the recipient will use the proceeds of the grant in accordance with subclause (III).</text></subclause></clause><clause id="id20812606b5f340938cf25aa7ce5eec9a"><enum>(ii)</enum><header>Deadline</header><subclause id="idA280C367F38F40139C1B4ABFE8BD8315"><enum>(I)</enum><header>In general</header><text>Except as provided in subclause (II), the Secretary shall complete all closeout actions for the grant by not later than 180 days after receipt and acceptance of the written request under clause (i).</text></subclause><subclause id="id51E0CC564D7F4F1CA6B463A6505751B1"><enum>(II)</enum><header>Extension</header><text>The Secretary may extend a deadline under subclause (I) by an additional 180 days if the Secretary determines the extension to be necessary.</text></subclause></clause><clause id="id029D6F38849E494DAD83DCD1C8480E1E"><enum>(iii)</enum><header>Savings provision</header><text>Section 602 shall continue to apply to a project assisted with a grant under section 209(d) regardless of whether the Secretary releases a Federal interest under clause (i).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
