which was read twice and placed on the calendar</action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize the United States Grain Standards Act, and for other purposes.</official-title></form><legis-body><section id="id63E79035549D427CA0682571C541E21E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States Grain Standards Reauthorization Act of 2020</short-title></quote>.</text></section><section id="id051bc1d201ea48838b9ef23d6290330e"><enum>2.</enum><header>Notification of discontinuance of services by State agencies</header><text display-inline="no-display-inline">Section 7 of the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/79">7 U.S.C. 79</external-xref>) is amended—</text><paragraph id="id166A431479424036A6584AB99A9D79E1"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (e)(2)(C)(i), by inserting <quote>and affected customers or applicants for service of official inspection or weighing services provided by the State agency</quote> after <quote>notify the Secretary</quote>; and</text></paragraph><paragraph id="idE935CFB0C58B4CB4A5C34E29CB2ECFB7"><enum>(2)</enum><text>in subsection (j)(5), in the first sentence, by striking <quote>2020</quote> and inserting <quote>2025</quote>.</text></paragraph></section><section id="idCAC6D1F1C2BB4586B736B95ED46AF2D3"><enum>3.</enum><header>Weighing authority</header><text display-inline="no-display-inline">Section 7A(l)(4) of the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/79a">7 U.S.C. 79a(l)(4)</external-xref>) is amended in the first sentence by striking <quote>2020</quote> and inserting <quote>2025</quote>. </text></section><section commented="no" display-inline="no-display-inline" id="P5FE439984A23D9DE768EA0AE819174A"><enum>4.</enum><header display-inline="yes-display-inline">Limitation on administrative and supervisory costs</header><text display-inline="no-display-inline">Section 7D of the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/79d">7 U.S.C. 79d</external-xref>) is amended by striking <quote>2020</quote> and inserting <quote>2025</quote>. </text></section><section id="idfbfa488ec9ac48e6b4897d83432ccb1e"><enum>5.</enum><header>Reporting requirements</header><text display-inline="no-display-inline">Section 17B of the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/87f-2">7 U.S.C. 87f–2</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF75ED14A9AA7428CA348B55F49D8E41E"><subsection id="id2790ba13b7d54ba89c3adbf133bd1b1f"><enum>(d)</enum><header>Enhancement of current reporting</header><paragraph id="id2A15FB715A3A4C7995B73CAA367649C8"><enum>(1)</enum><header>Increased frequency of inspection program data reporting</header><subparagraph id="idFC8A2A8D275E47449CBE772DF8EDA775"><enum>(A)</enum><header>In general</header><text>Beginning not later than 1 year after the date of enactment of this subsection, the Secretary shall publish quarterly reports describing data from the tests and inspections for intrinsic quality factors (including protein, oil, and starch) and food safety factors, as reported, in the aggregate, for fiscal years 2014 through 2018 in the tables in section V (relating to providing official grain inspection and weighing services) of the 2016 through 2018 annual reports to Congress by the Federal Grain Inspection Service. </text></subparagraph><subparagraph id="id2CE08A2C97BE469C9EEF69D6AFA3EF6D"><enum>(B)</enum><header>Delineation</header><text>The data from the tests and inspections under subparagraph (A) shall be delineated to reflect whether the tests and inspections were requested of or performed by—</text><clause id="id821D9841F1044774AD76027809E51AE1"><enum>(i)</enum><text>the Secretary; or</text></clause><clause id="idAE6C95267C534C73B2460390D273987E"><enum>(ii)</enum><text>a State agency delegated authority under section 7 or 7A or an official agency.</text></clause></subparagraph></paragraph><paragraph id="id9EB210FDD0414285B38B198884692A88"><enum>(2)</enum><header>Exceptions and waivers</header><text>Beginning not later than 1 year after the date of enactment of this subsection, the Secretary shall publish quarterly reports describing—</text><subparagraph id="idbbbb5abbb03049c79accc7abe00ab4b8"><enum>(A)</enum><text>the number of exceptions requested under section 7(f)(2)(B);</text></subparagraph><subparagraph id="idd7ac3f1f859846c6b71dde3fc86d7cc8"><enum>(B)</enum><text>the number of exceptions granted under section 7(f)(2)(B);</text></subparagraph><subparagraph commented="no" id="idf40d07e7733f48378d83e7a628c43245"><enum>(C)</enum><text>the number of waivers requested under section 5(a)(1); and</text></subparagraph><subparagraph id="idbb2874835eab4a3f862f4dd1a7f5fdbc" commented="no"><enum>(D)</enum><text>the number of waivers granted under section 5(a)(1).</text></subparagraph></paragraph></subsection><subsection id="idF37BF7255B934C0791B7DBEBA04641C6"><enum>(e)</enum><header>Additional reporting; consultation</header><text>The Secretary may, to the extent determined appropriate by the Secretary, in consultation with State agencies delegated authority under sections 7 and 7A, official agencies, and the grain industries described in the second sentence of section 21(a), publish— </text><paragraph id="id6779d2767f984e81a666b74207e6ffc2"><enum>(1)</enum><text>data relating to testing for other intrinsic quality or food safety factors; and</text></paragraph><paragraph id="id04857c06f02b4613ae68734d1bac2846"><enum>(2)</enum><text>other data collected from inspection and weighing activities conducted under this Act. </text></paragraph></subsection><subsection id="idD5E5B4AAE8E2453889DF7955A2074BF8" commented="no"><enum>(f)</enum><header>Protection of confidential business information</header><text>Any trade secrets or information described in section 552(b)(4) of title 5, United States Code, that is provided to or collected by the Secretary in carrying out subsection (d) or (e) shall not be included in a report under subsection (d) or (e) or otherwise publicly disclosed.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idCD59DF37125146B79039B0D9F72AD1D2"><enum>6.</enum><header>Appropriations</header><text display-inline="no-display-inline">Section 19 of the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/87h">7 U.S.C. 87h</external-xref>) is amended—</text><paragraph id="id6051FDF1CA0D4572B3140226C725CCCC"><enum>(1)</enum><text>by striking the section heading and designation and all that follows through <quote>There are hereby</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFE6170D11DE141D3B5ED5A7F49EF4441"><section id="id65F455170787410587234007563F144B"><enum>19.</enum><header>Funding</header><subsection id="id80E86F9B091649DD801ACB4C2A871588"><enum>(a)</enum><header>Authorization of appropriations</header><text>There are</text></subsection></section><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id2378AFAE318C465BBDBE35CCE2B1F739"><enum>(2)</enum><text>in subsection (a) (as so designated), by striking <quote>2020</quote> and inserting <quote>2025</quote>; and</text></paragraph><paragraph id="id304D0915576743D6925099FF538879B2"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id705056BE23BA495DBB15D61DBB841D7F"><subsection id="idB8D073527A0948C2A009073D3764D077"><enum>(b)</enum><header>Limitations on uses of user fees</header><paragraph id="id3FF1C1E5512148949B95BAAA2B9A17AA"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="idEC3A2E64787744BC804D6088742F5168"><enum>(A)</enum><header>Official inspection or weighing service</header><text>The term <term>official inspection or weighing service</term> means official inspection, official weighing, supervision of weighing, supervision of agency personnel, supervision of the field office personnel of the Secretary, testing of equipment or instruments, other services, or registration, the cost to the Secretary of which is authorized to be covered by the collection of a user fee pursuant to section 7, 7A, 7B, 16, or 17A, as applicable.</text></subparagraph><subparagraph id="id8D92E36983EC41288A73F35532B6E199"><enum>(B)</enum><header>User fee</header><text>The term <term>user fee</term> means a fee collected by the Secretary under section 7, 7A, 7B, 16, or 17A.</text></subparagraph></paragraph><paragraph id="idE8E1B497E2DD49CFAAB0FEB73C539A3E"><enum>(2)</enum><header>Requirement</header><text>A user fee—</text><subparagraph id="id74CCA5A397F343398349C4C2469A9423"><enum>(A)</enum><text>shall be used solely to cover—</text><clause id="id86EF2C10FF8E4FE8B624DE901F287324"><enum>(i)</enum><text>the cost to the Secretary for carrying out official inspection or weighing services; and</text></clause><clause id="id4B85B862117F4136BF31EC301D73BB9C"><enum>(ii)</enum><text>administrative costs to the Secretary directly relating to official inspection or weighing services; and</text></clause></subparagraph><subparagraph id="idCE87B3E7F5D34CE29050768C6E3C8C80" commented="no"><enum>(B)</enum><text>shall not be used for—</text><clause id="id4D8C2759285044C3950CAEA3F6B2474C" commented="no"><enum>(i)</enum><text>activities relating to the development or maintenance of grain standards; or</text></clause><clause id="idAD2935D4EB6D4B2EB3FC22DFB913E285" commented="no"><enum>(ii)</enum><text>any other activity that is not directly related to the performance of official inspection or weighing services.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idc020f973a63546d891652e3a39910041"><enum>7.</enum><header>Advisory committee</header><text display-inline="no-display-inline">Section 21 of the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/87j">7 U.S.C. 87j</external-xref>) is amended—</text><paragraph id="id3C54D0112173470BB42A5CEC76AEE285"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), in the last sentence, by striking <quote>successive terms</quote> and inserting <quote>successively for more than 2 terms</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="P120F514843094EF09657588D29CC522"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e), by striking <quote>2020</quote> and inserting <quote>2025</quote>. </text></paragraph></section><section id="id6AEBE9129F5E43E5A1412097055F1E3B"><enum>8.</enum><header>Review of geographic boundaries for official agencies</header><subsection id="id26f1713acf474f30aa23214689975ddc"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idDDD249BD100B40C697E1332D598F7A92"><enum>(1)</enum><header>Grain handling facility</header><text>The term <term>grain handling facility</term> means a grain elevator, warehouse, or other storage or handling facility.</text></paragraph><paragraph id="id083A0A39D1424E8C88C159CF988DC725"><enum>(2)</enum><header>Official agency geographic area</header><text>The term <term>official agency geographic area</term> means a geographic area for an official agency, as defined by the Secretary under section 7(f)(2)(A) or 7A(i)(2)(A) of the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/79">7 U.S.C. 79(f)(2)(A)</external-xref>, 79a(i)(2)(A)). </text></paragraph><paragraph id="idB4F7610E9EEA4F69AC0C6E4F258FB24D"><enum>(3)</enum><header>United States Grain Standards Act terms</header><text>The terms <term>grain</term>, <term>official agency</term>, <term>official inspection</term>, <term>officially inspected</term>, <term>official weighing</term>, <term>supervision of weighing</term>, and <term>Secretary</term> have the meanings given the terms in section 3 of the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/75">7 U.S.C. 75</external-xref>).</text></paragraph></subsection><subsection id="idba5b39e4d27247daba54b6a5ac7f026e"><enum>(b)</enum><header>Review</header><paragraph id="idCCF4F46E3CFE4CF7B4AF5E19E550A051"><enum>(1)</enum><header>In general</header><text>The Secretary shall conduct a comprehensive nationwide review of the official agency geographic areas.</text></paragraph><paragraph id="id9A3712EC837241A7874D0990722B387E"><enum>(2)</enum><header>Considerations</header><text>In conducting the review under paragraph (1), the Secretary shall take into consideration—</text><subparagraph id="iddfd8eaea341440b096e73a4ab3034015"><enum>(A)</enum><text>the number of grain handling facilities, both within the official agency geographic areas and in areas that are not official agency geographic areas, that currently use, or, during the 5-year period preceding the date of submission of the report under subsection (c), received service from, an official agency that provides official inspection, official weighing, supervision of weighing, or other services under the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/71">7 U.S.C. 71</external-xref> et seq.);</text></subparagraph><subparagraph id="ide281f6a24d9b4e3ab8745b8ba52651d6"><enum>(B)</enum><text>the volume of grain for which official agencies provide services at grain handling facilities within the official agency geographic areas;</text></subparagraph><subparagraph id="idff21eb7004144b08b007e4299ee9243b"><enum>(C)</enum><text>the number of official inspections of vessels and other carriers within the official agency geographic areas;</text></subparagraph><subparagraph id="id2f3d8d04fa8949d3bfa2631b227cd154"><enum>(D)</enum><text>other related services performed by official agencies at grain handling facilities within the official agency geographic areas;</text></subparagraph><subparagraph id="id8ce7371f345746e89ebb180f7fb43860"><enum>(E)</enum><text>the timeliness, accuracy, and appropriateness of services performed by official agencies at grain handling facilities within the official agency geographic areas;</text></subparagraph><subparagraph id="idda086cccdde64f53a7c6a5ec0bd4353d"><enum>(F)</enum><text>fees charged by official agencies for services performed under the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/71">7 U.S.C. 71</external-xref> et seq.), including grading, weighing, sampling, stowage examination, and certification; and</text></subparagraph><subparagraph id="id1a0bd6824167454daa679ed6e21b10e4"><enum>(G)</enum><text>any implications of modifications to the official agency geographic areas on enhancing official inspection, official weighing, and supervision of weighing in the domestic market.</text></subparagraph></paragraph></subsection><subsection id="id5d085d690f124684b4b1ee87a1701ba4" commented="no"><enum>(c)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report containing—</text><paragraph id="idACEE606BE1A84EEFA7DA0B343B65147E" commented="no"><enum>(1)</enum><text>the results of the review completed under subsection (b); and </text></paragraph><paragraph id="id19C96B5963E04E6489A96C664609E730" commented="no"><enum>(2)</enum><text>any recommendations with respect to those results that the Secretary determines appropriate.</text></paragraph></subsection></section><section id="id33075342F39C4389B9C45D43857EAEC7" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>9.</enum><header>Technical correction</header><text display-inline="no-display-inline">Section 4(a)(1) of the United States Grain Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/7/76">7 U.S.C. 76(a)(1)</external-xref>) is amended by striking <quote>soybeans mixed</quote> and inserting <quote>soybeans, mixed</quote>.</text></section></legis-body><endorsement><action-date>June 24, 2020</action-date><action-desc>Read twice and placed on the calendar</action-desc></endorsement></bill>
