 law enforcement agencies</header><subsection id="idA28FD0848733464D8A8EB591984EE1B2"><enum>(a)</enum><header>Additional limitations</header><paragraph id="id08919406954349469933E77F35933EC8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2576a of title 10, United States Code, is amended—</text><subparagraph id="id812187f5d6f742e58a5975ff0e2148b0"><enum>(A)</enum><text>in subsection (a)—</text><clause id="idD15B7B56262A486F9840E7FAF5393933"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="idBE78391BE96046FBAF6C571DF604603D"><enum>(I)</enum><text>in the matter preceding subparagraph (A), by striking <quote>subsection (b)</quote> and inserting <quote>the provisions of this section</quote>; and</text></subclause><subclause id="idED743AC1451344E1AA35DFB70753D2A3"><enum>(II)</enum><text>in subparagraph (A), by striking <quote>, including counter-drug and counterterrorism activities</quote>; and</text></subclause></clause><clause id="id6530A6938EC946E194AE52DA2C81B7CA"><enum>(ii)</enum><text>in paragraph (2), by striking <quote>and the Director of National Drug Control Policy</quote>;</text></clause></subparagraph><subparagraph id="idD62A3E22313A4B54ABB0A9D6E6D29E66"><enum>(B)</enum><text>in subsection (b)—</text><clause id="id4756a51d591f4ea98bb64b388354f68b"><enum>(i)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></clause><clause id="id2cc43481d95942c88f2457f587952882"><enum>(ii)</enum><text>in paragraph (6), by striking the period and inserting a semicolon; and</text></clause><clause id="id40a0192d5aca47f19466195d37fa5271"><enum>(iii)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD7FD9A43650C44909259851EBDE55A18"><paragraph id="id6add521537644d1394bca1a338600d3b" commented="no"><enum>(7)</enum><text>the recipient certifies to the Department of Defense that it has the personnel and technical capacity, including training, to operate the property; and </text></paragraph><paragraph id="id666cf822748f460187d2bc0516516c58"><enum>(8)</enum><text>the recipient certifies to the Department of Defense that if the recipient determines that the property is surplus to the needs of the recipient, the recipient will return the property to the Department of Defense.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id590fb370841844f5bfdbb59185084ee7"><enum>(C)</enum><text>by striking subsections (d), (e), and (f); and</text></subparagraph><subparagraph id="id1c74d54f791042269528cc74a5594f3d"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id65039A92087F48B1B93979C7940FE83F"><subsection id="id714EC5AE1D774DDC8F2A18B055762182"><enum>(d)</enum><header>Limitations on transfers</header><text>The Secretary of Defense may not transfer under this section any property as follows:</text><paragraph id="idddfdd18aa46d4d118530f71192bb0273"><enum>(1)</enum><text>Weapons, weapon parts, and weapon components, including camouflage and deception equipment, and optical sights.</text></paragraph><paragraph id="idA4BD741CFA4C42048ECD3E873BD7304B"><enum>(2)</enum><text>Weapon system specific vehicular accessories.</text></paragraph><paragraph id="id784D5FF48CB8425FB555840D4557FC56"><enum>(3)</enum><text>Demolition materials.</text></paragraph><paragraph id="id387D0617F18D41048059BA15F5EF454C"><enum>(4)</enum><text>Explosive ordinance.</text></paragraph><paragraph id="idD1A7E222F3EF4F10974BBBDE01D1FCB3"><enum>(5)</enum><text>Night vision equipment.</text></paragraph><paragraph id="id51E37CC3861E4FB8B43F020025A11F2D"><enum>(6)</enum><text>Tactical clothing, including uniform clothing and footwear items, special purpose clothing items, and specialized flight clothing and accessories.</text></paragraph><paragraph id="idB8B7CD9D18BB4EFAB97D99A167C69F38"><enum>(7)</enum><text>Drones.</text></paragraph><paragraph id="id7CE26AC862D942218EEC32AEA354A159"><enum>(8)</enum><text>Combat, assault, and tactical vehicles, including Mine-Resistant Ambush Protected (MRAP) vehicles.</text></paragraph><paragraph id="idAD1F0A3E76DB4087958A971625E37B72"><enum>(9)</enum><text>Training aids and devices.</text></paragraph><paragraph id="id80D4E7BFA6124BBCA34870E05A3D204D"><enum>(10)</enum><text>Firearms of .50 caliber or higher, ammunition of .50 caliber or higher, grenade launchers, flash grenades, and bayonets.</text></paragraph></subsection><subsection id="id4AA8D1F0A2C0451B9CF40BD4D7EA696C"><enum>(e)</enum><header>Approval by law required for transfer of property not previously transferrable</header><paragraph commented="no" display-inline="yes-display-inline" id="id20AF29AACD0F45B882DE254B737DCB9E"><enum>(1)</enum><text>In the event the Secretary of Defense proposes to make available for transfer under this section any property of the Department of Defense not previously made available for transfer under this section, the Secretary shall submit to the appropriate committees of Congress a report setting forth the following:</text><subparagraph id="idE66BA09CF1A240E589313B01E51F21B1" indent="up1"><enum>(A)</enum><text>A description of the property proposed to be made available for transfer.</text></subparagraph><subparagraph id="id68DE3EE8C0AE43F5A3A7B96F16B14BFE" indent="up1"><enum>(B)</enum><text>A description of the conditions, if any, to be imposed on use of the property after transfer.</text></subparagraph><subparagraph id="idFEA3E3818D8E4BC4AD57E4913317CC21" indent="up1"><enum>(C)</enum><text>A certification that transfer of the property would not violate a provision of this section or any other provision of law.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5D374AFE5EA0468BA4CB949A9598AEA3" indent="up1"><enum>(2)</enum><text>The Secretary may not transfer any property covered by a report under this subsection unless authorized by a law enacted by Congress after the date of the receipt of the report by Congress.</text></paragraph></subsection><subsection id="idF2348E041AAC4B20BC8AB8EAABA1B386"><enum>(f)</enum><header>Annual certification accounting for transferred property</header><paragraph commented="no" display-inline="yes-display-inline" id="id25CF991126D24696AFAE160CE39349C6"><enum>(1)</enum><text>The Secretary of Defense shall submit to the appropriate committees of Congress each year a certification in writing that each recipient to which the Secretary has transferred property under this section during the preceding fiscal year—</text><subparagraph id="id4644492258c342f08e3fa4ae5835f054" indent="up1"><enum>(A)</enum><text>has provided to the Secretary documentation accounting for all property the Secretary has previously transferred to such recipient under this section; and</text></subparagraph><subparagraph id="id323cf59e1183441ead762a9030256543" indent="up1"><enum>(B)</enum><text>has complied with paragraphs (7) and (8) of subsection (b) with respect to the property so transferred during such fiscal year.</text></subparagraph></paragraph><paragraph id="idcbed7e9886c848ebbb7247aae044b1d8" indent="up1"><enum>(2)</enum><text>If the Secretary cannot provide a certification under paragraph (1) for a recipient, the Secretary may not transfer additional property to such recipient under this section, effective as of the date on which the Secretary would otherwise make the certification under this subsection, and such recipient shall be suspended or terminated from further receipt of property under this section.</text></paragraph></subsection><subsection id="H4F54BAA39B864CED9DC5288C209112AE"><enum>(g)</enum><header>Conditions for extension of program</header><text>Notwithstanding any other provision of law, amounts authorized to be appropriated or otherwise made available for any fiscal year may not be obligated or expended to carry out this section unless the Secretary submits to the appropriate committees of Congress a certification that for the preceding fiscal year that—</text><paragraph id="HA40B3B0D69684FF5BBDE018A74E6D5B9"><enum>(1)</enum><text display-inline="yes-display-inline">each recipient agency that has received property under this section has—</text><subparagraph id="H629C6BDCEC5E4D5897A927791657D67A"><enum>(A)</enum><text>demonstrated 100 percent accountability for all such property, in accordance with paragraph (2) or (3), as applicable; or</text></subparagraph><subparagraph id="H90EAF002ED24418F938ED0D24A733F37"><enum>(B)</enum><text>been suspended or terminated from the program pursuant to paragraph (4);</text></subparagraph></paragraph><paragraph id="H3075F3AEC5B0478DBCB99B264E613F28"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to each non-Federal agency that has received property under this section, the State Coordinator responsible for each such agency has verified that the State Coordinator or an agent of the State Coordinator has conducted an in-person inventory of the property transferred to the agency and that 100 percent of such property was accounted for during the inventory or that the agency has been suspended or terminated from the program pursuant to paragraph (4);</text></paragraph><paragraph id="H0955F03DE2F04102B2574A327669C2A3"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to each Federal agency that has received property under this section, the Secretary of Defense or an agent of the Secretary has conducted an in-person inventory of the property transferred to the agency and that 100 percent of such property was accounted for during the inventory or that the agency has been suspended or terminated from the program pursuant to paragraph (4);</text></paragraph><paragraph id="H2F5498B1E7324D2B8E43F49533D071B3"><enum>(4)</enum><text>the eligibility of any agency that has received property under this section for which 100 percent of the equipment was not accounted for during an inventory described in paragraph (2) or (3), as applicable, to receive property transferred under this section has been suspended or terminated;</text></paragraph><paragraph id="H06C91128FC8E4842B0F3E6C4D33DD10A"><enum>(5)</enum><text>each State Coordinator has certified, for each non-Federal agency located in the State for which the State Coordinator is responsible that—</text><subparagraph id="HA76E417FD1244C54B2FE2CB819CAB12B"><enum>(A)</enum><text>the agency has complied with all requirements under this section; or</text></subparagraph><subparagraph id="H318F4A8043574D0FBFC0A197CA416194"><enum>(B)</enum><text>the eligibility of the agency to receive property transferred under this section has been suspended or terminated; and</text></subparagraph></paragraph><paragraph id="H9A6668B5F15B4F669173A7D4BCA5FF42"><enum>(6)</enum><text>the Secretary of Defense has certified, for each Federal agency that has received property under this section that—</text><subparagraph id="H73A61C158B414E1CB6AD757CE145FDFD"><enum>(A)</enum><text>the agency has complied with all requirements under this section; or</text></subparagraph><subparagraph id="H940B0DB4C639475B857BF0519BBED0DA"><enum>(B)</enum><text display-inline="yes-display-inline">the eligibility of the agency to receive property transferred under this section has been suspended or terminated.</text></subparagraph></paragraph></subsection><subsection id="id0481abae7b7c43a8a9a9b3905d850ceb"><enum>(h)</enum><header>Website</header><text>The Defense Logistics Agency shall maintain, and update on a quarterly basis, an internet website on which the following information shall be made publicly available in a searchable format:</text><paragraph id="id04f9a435a8434d1ea068223774d6cd4d"><enum>(1)</enum><text>A description of each transfer made under this section, including transfers made before the date of the enactment of the Stop Militarizing Law Enforcement Act, set forth by State, county, and recipient agency, and including item name, item type, item model, and quantity.</text></paragraph><paragraph id="idbbb73bc1e1a24f33a5d5b09cadccb11f"><enum>(2)</enum><text>A list of all property transferred under this section that is not accounted for by the Defense Logistics Agency, including—</text><subparagraph id="idE4D064B90B79462BA94A628EBF326128"><enum>(A)</enum><text>the name of the State, county, and recipient agency;</text></subparagraph><subparagraph id="id57676A4993AC41CFAE936F1BEDC6068F"><enum>(B)</enum><text>the item name, item type, and item model;</text></subparagraph><subparagraph id="idFE68B3DEBBC24ED29A4DB2589CC02C4A"><enum>(C)</enum><text>the date on which such property became unaccounted for by the Defense Logistics Agency; and</text></subparagraph><subparagraph id="idE2D15450ED7B43D8BAEA9BEC0E35FF0C"><enum>(D)</enum><text>the current status of such item.</text></subparagraph></paragraph><paragraph id="idb8483436368f4b23ab3b44200b29af4c"><enum>(3)</enum><text>A list of each agency suspended or terminated from further receipt of property under this section, including State, county, and agency, and the reason for and duration of such suspension or termination.</text></paragraph></subsection><subsection id="idAB038539FD704D04BE289C562B99B153"><enum>(i)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id820EFA7C03E7497FA88769DAC7C0BB29"><enum>(1)</enum><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="idE78EC862AF094624936DF3D85AD26EC5"><enum>(A)</enum><text>the Committee on Armed Services and the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph><subparagraph id="id981746E64A5F439497925E2484A36DDC"><enum>(B)</enum><text>the Committee on Armed Services and the Committee on Oversight and Government Reform of the House of Representatives.</text></subparagraph></paragraph><paragraph id="idB827149478624AEA904F611767B9B0B7"><enum>(2)</enum><text>The term <term>agent of a State Coordinator</term> means any individual to whom a State Coordinator formally delegates responsibilities for the duties of the State Coordinator to conduct inventories described in subsection (g)(2).</text></paragraph><paragraph id="idB8E4FCEB72FC41219DBD004C649E57C4"><enum>(3)</enum><text>The term <term>controlled property</term> means any item assigned a demilitarization code of B, C, D, E, G, or Q under Department of Defense Manual 4160.21–M, <quote>Defense Materiel Disposition Manual</quote>, or any successor document. </text></paragraph><paragraph id="id7138D58235474DFE8A14D2EF02935944"><enum>(4)</enum><text>The term <term>State Coordinator</term>, with respect to a State, means the individual appointed by the governor of the State to maintain property accountability records and oversee property use by the State.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id322D96353A1843949F7140D58E2E0883"><enum>(2)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on the date of the enactment of this Act.</text></paragraph></subsection><subsection id="idF54817DCF9B740289235F10B18582148"><enum>(b)</enum><header>Return of property to Department of Defense</header><text>Not later than one year after the date of the enactment of this Act, each Federal or State agency to which property described by subsection (d) of section 2576a of title 10, United States Code (as added by subsection (a)(1) of this section), was transferred before the date of the enactment of this Act shall return such property to the Defense Logistics Agency on behalf of the Department of Defense.</text></subsection></section><section id="id79D6025BE8A34483930687DFC90F562C"><enum>3.</enum><header>Use of Department of Homeland Security preparedness grant funds</header><subsection id="id56B053C734664958A8B8ABD4E7E76427"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idA55C5089750F49D89550D960B7BAFFAC"><enum>(1)</enum><text>the term <term>Agency</term> means the Federal Emergency Management Agency; and</text></paragraph><paragraph id="idF6D3C7F297E340CDA5F6435DD6690536"><enum>(2)</enum><text>the term <term>preparedness grant program</term> includes—</text><subparagraph id="idD9E6E0A98BBA494BBC800D83E8EA4A8A"><enum>(A)</enum><text>the Urban Area Security Initiative authorized under section 2003 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/604">6 U.S.C. 604</external-xref>);</text></subparagraph><subparagraph id="id8EF185D78D9C4AD3979F96A8C02D0E14"><enum>(B)</enum><text>the State Homeland Security Grant Program authorized under section 2004 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/605">6 U.S.C. 605</external-xref>);</text></subparagraph><subparagraph id="id4d535a9001b441d290461e037a99c6a8"><enum>(C)</enum><text>the Port Security Grant Program authorized under section 70107 of title 46, United States Code; and</text></subparagraph><subparagraph id="idC1B5FEA0E4C44023A76550699E8CBADA"><enum>(D)</enum><text>any other non-disaster preparedness grant program of the Agency.</text></subparagraph></paragraph></subsection><subsection id="id0D5517A5CDDD413197B162E975851D92"><enum>(b)</enum><header>Limitation</header><text>The Agency may not permit awards under a preparedness grant program to be used to buy, maintain, or alter—</text><paragraph id="id1D124320C6DF4B72BA81070BB8B1318F"><enum>(1)</enum><text>explosive entry equipment;</text></paragraph><paragraph id="id03781D3E3F8B406BBA20A90F65A2E6C3"><enum>(2)</enum><text>canines (other than bomb-sniffing canines for agencies with certified bomb technicians or for use in search and rescue operations);</text></paragraph><paragraph id="idBC53E3B9E1094D4A8B9596D16BD29060"><enum>(3)</enum><text>tactical or armored vehicles;</text></paragraph><paragraph id="id7112AD13ED2E45CF8F15431D150E3D8C"><enum>(4)</enum><text>long-range hailing and warning devices;</text></paragraph><paragraph id="idB493243D9B6B49EBA20119C44B643DC1"><enum>(5)</enum><text>tactical entry equipment (other than for use by specialized teams such as Accredited Bomb Squads, Tactical Entry, or Special Weapons and Tactics (SWAT) Teams); or</text></paragraph><paragraph id="id8befb338039d4a7b814365ff41899d57"><enum>(6)</enum><text>firearms of .50 caliber or higher, ammunition of .50 caliber or higher, grenade launchers, flash grenades, or bayonets.</text></paragraph></subsection><subsection id="id42EB8B96F4E046518F2EB7AB38FF3018"><enum>(c)</enum><header>Review of prior receipt of property before award</header><text>In making an award under a preparedness grant program, the Agency shall—</text><paragraph id="idB748DBBA108D401A89D2029FC80C035F"><enum>(1)</enum><text>determine whether the awardee has already received, and still retains, property from the Department of Defense pursuant to section 2576a of title 10, United States Code, including through review of the website maintained by the Defense Logistics Agency pursuant to subsection (h) of such section (as added by section 2(a)(1) of this Act);</text></paragraph><paragraph id="id91439F7194F848D1B26070F34254921B"><enum>(2)</enum><text>require that the award may not be used by the awardee to procure or obtain property determined to be retained by the awardee pursuant to paragraph (1); and</text></paragraph><paragraph id="id5fa3aec1399e4968bb64d0d9a0109e2e"><enum>(3)</enum><text>require that the award only be used to procure or obtain property in accordance with use restrictions contained within the Agency’s State and Local Preparedness Grant Programs’ Authorized Equipment List.</text></paragraph></subsection><subsection id="idED973F30E4FC4D7693763D85D9C3C271"><enum>(d)</enum><header>Use of grant program funds for required return of property to DoD</header><text>Notwithstanding any other provision of law, the use of funds by a State or local agency to return to the Department of Defense property transferred to such State or local agency pursuant to section 2676a of title 10, United States Code, as such return is required by section 2(b) of this Act, shall be an allowable use of preparedness grant program funds by such agency.</text></subsection><subsection id="idD56815B1C92A47BF9B9594EAE2AC3EE0"><enum>(e)</enum><header>Accountability measures</header><paragraph id="id435C7470A08B41289A49D3A4EDE0A37A"><enum>(1)</enum><header>Audit of use of preparedness grant funds</header><text>Not later than one year after the date of the enactment of this Act, the Comptroller General of the United States shall conduct an audit covering the period of fiscal year 2010 through the current fiscal year on the use of preparedness grant program funds. The audit shall assess how funds have been used to procure equipment, how the equipment has been used, and whether the grant awards have furthered the Agency’s goal of improving the preparedness of State and local communities.</text></paragraph><paragraph id="id3B31471E47D04A9287ECEA74F0E159D8"><enum>(2)</enum><header>Annual accounting of use of award funds</header><text>Not later than one year after the date of the enactment of this Act, the Agency shall develop and implement a system of accounting on an annual basis how preparedness grant program funds have been used to procure equipment, how the equipment has been used, whether grantees have complied with restrictions on the use of equipment contained with the Authorized Equipment List, and whether the awards have furthered the Agency’s goal of enhancing the capabilities of State agencies to prevent, deter, respond to, and recover from terrorist attacks, major disasters, and other emergencies.</text></paragraph></subsection></section><section id="id16B4F96C2BBD4A44B297717C97770CE7"><enum>4.</enum><header>Use of Edward Byrne Memorial Justice Assistance Grant funds</header><subsection id="idF7AC56BBA21B483B9C8239D697A02E1E"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">Section 501(d) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10152">34 U.S.C. 10152(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1100A471CEE342599A50EE50EE7A2D32"><paragraph id="id328CC888FB0E492A836C50F3EA35B70D"><enum>(3)</enum><text>The purchase, maintenance, alteration, or operation of—</text><subparagraph id="id5534657D9FAB43CEAC357BD8B786FF00"><enum>(A)</enum><text>lethal weapons; or</text></subparagraph><subparagraph id="idFDD45AC50C124B0E9C22010008D01CD8"><enum>(B)</enum><text>less-lethal weapons.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id1BD3BC593B63435BA4891BDAAA24976E"><enum>(b)</enum><header>Use of grant funds for required return of property to DoD</header><text>Notwithstanding any other provision of law, the use of funds by a State agency or unit of local government to return to the Department of Defense property transferred to such agency or unit of local government pursuant to section 2676a of title 10, United States Code, as such return is required by section 2(b) of this Act, shall be an allowable use of grant amounts under the Edward Byrne Memorial Justice Assistance Grant Program.</text></subsection></section><section id="id2126ABA5ECA842CB87D25BA1F1292529"><enum>5.</enum><header>Comptroller General report</header><subsection id="id7AE62EE6E7C94CB7B6CE91CF7F00EBD2"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, and annually thereafter, the Comptroller General of the United States shall submit to Congress a report on Federal agencies, including offices of Inspector General for Federal agencies, that have specialized units that receive special tactical or military-style training or use hard-plated body armor, shields, or helmets and that respond to high-risk situations that fall outside the capabilities of regular law enforcement officers, including any special weapons and tactics (SWAT) team, tactical response teams, special events teams, special response teams, or active shooter teams.</text></subsection><subsection id="idC6859221D1BE4505B2521FFEB01E4457"><enum>(b)</enum><header>Elements</header><text>The report required under subsection (a) shall include the following elements:</text><paragraph id="id6fa056fb234c469c9c651a1af89937df"><enum>(1)</enum><text>A description of each specialized unit described under such subsection.</text></paragraph><paragraph id="id2651b6c514594a2788502006661548e0"><enum>(2)</enum><text>A description of the training and weapons of each such unit.</text></paragraph><paragraph id="id43b79cee883d41ba99a6e40364b3e3a1"><enum>(3)</enum><text>The criteria for activating each such unit and how often each such unit was activated for each year of the previous ten years.</text></paragraph><paragraph id="id1de075dcd14b4703af8c32a20ca84a31"><enum>(4)</enum><text>An estimate of the annual cost of equipping and operating each such unit.</text></paragraph><paragraph id="id2ae26dce78d04871bf5a92f3069a7444"><enum>(5)</enum><text>Any other information that is relevant to understanding the usefulness and justification for the units.</text></paragraph></subsection></section></legis-body></bill>
