<distribution-code display="yes">II</distribution-code><congress>116th CONGRESS</congress><session>2d Session</session><legis-num>S. 3775</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20200520">May 20, 2020</action-date><action-desc><sponsor name-id="S380">Mr. Peters</sponsor> (for himself and <cosponsor name-id="S374">Mr. Cotton</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a United States-Israel Operations-Technology Working Group, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>United States-Israel Military Capability Act of 2020</short-title></quote>.</text></section><section id="id8fe19a6787884f7e8ad75706e651e41d"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="id08e3c180fb7d4b8d8574743ab80e9084"><enum>(1)</enum><text>The United States confronts an intense military technology competition with the People's Republic of China and the Russian Federation that may determine whether the United States can effectively deter and defeat adversaries in the future.</text></paragraph><paragraph id="idacd7dbfe189a4c089ccadc54707c9340"><enum>(2)</enum><text>On July 11, 2019, Chairman of the Joint Chiefs of Staff General Mark Milley said, <quote>China is improving their military very, very rapidly in space, air, cyber, maritime, land domains, et cetera.</quote>. Noting the rapid technology development by the People's Republic of China, General Milley warned that the United States must ensure <quote>that we do not lose our advantages that we have relative to other countries, specifically relative to China.</quote>.</text></paragraph><paragraph id="id8e45a5e3f8294bf9ab81309cc4faff18"><enum>(3)</enum><text>The People's Republic of China and the Russian Federation have already developed or fielded some capabilities in areas such as hypersonics and artificial intelligence that are superior to those of the United States.</text></paragraph><paragraph id="id9f0c464bc2df4292bf3032714f19edc6"><enum>(4)</enum><text>A closer and more systematic early cooperative research and development effort with select allies may help the United States more quickly and inexpensively restore and sustain military supremacy in critical military capabilities.</text></paragraph><paragraph id="id38892b78b0444940be567aa0a38e1412"><enum>(5)</enum><text>The innovative and agile defense technology sector of Israel and the status of Israel as one of the closest and most reliable allies of the United States make Israel an ideal candidate for a more systematic and institutionalized partnership with the United States focused on early cooperative research and development.</text></paragraph><paragraph id="id02c65c566fdc4b07a14e8b0ced7f5a6e"><enum>(6)</enum><text>The defense innovation sector of Israel is a global leader in many of the technologies important to Department of Defense modernization efforts.</text></paragraph><paragraph id="id6e570594d23641f79ad3bee1570cb33d"><enum>(7)</enum><text>Despite many laudable ongoing defense partnership efforts between the United States and Israel, dangerous United States military capability gaps continue to emerge that a more systematic and institutionalized United States-Israel early cooperative research and development program could have prevented.</text></paragraph><paragraph id="idc8e2fec32a604c62a678bd7ed5293b8d"><enum>(8)</enum><text>Such a program would allow the United States to benefit from the innovation agility and sense of urgency of Israel, and Israel would benefit from the economy of scale of the United States. Such a program could be carefully designed to reduce the time and cost associated with research and development, assiduously avoiding anything that would slow down or constrain the research and development of either country.</text></paragraph><paragraph id="idfb5ae88ce2534fadad190899d5c75038"><enum>(9)</enum><text>Belatedly acquiring already produced equipment or weapons from Israel to fill a United States capability gap is not a substitute for a systematic program that prevents the capability gap from emerging in the first place.</text></paragraph><paragraph id="idbb10fc9467324de29c9d327836de8357"><enum>(10)</enum><text>On March 4, 2020, Secretary of Defense Mark Esper said, <quote>We have a very good innovative base, [the Israelis] have a very good innovative base. And I think the more we can cooperate together as allies and partners to come up with common solutions, the better.</quote>. Secretary Esper continued, <quote>so I think if there are ways to improve that, we should pursue it.</quote>.</text></paragraph></section><section id="id04287c9567e3415bb4e83ed7d9397922"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="idf3aa4a77f6ce47368f965a678d93716d"><enum>(1)</enum><text>the United States Government has a responsibility to undertake all reasonable measures to ensure that members of the Armed Forces never confront a more technologically advanced foe; and</text></paragraph><paragraph id="idd2079d5c87f0481881dca4956ef36e4d"><enum>(2)</enum><text>building on positive ongoing efforts, the United States and Israel should further institutionalize and strengthen their defense innovation partnership by establishing a United States-Israel Operations-Technology Working Group to identify and expeditiously field capabilities that the military forces of both countries need to deter and defeat respective adversaries.</text></paragraph></section><section id="id7d2fbf729892406e86e7e41aa0573c36"><enum>4.</enum><header>United States-Israel Operations-Technology Working Group</header><subsection id="id0a49e3f867cd4501bd8df37fe7d1616d"><enum>(a)</enum><header>In general</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary of Defense, with the concurrence of the Minister of Defense of Israel and in consultation with the Secretary of State and the Director of National Intelligence, shall establish a United States-Israel Operations-Technology Working Group (in this Act referred to as the <quote>Working Group</quote>) for the following purposes:</text><paragraph id="id9719bef802834819aadd43b6e325e3ad"><enum>(1)</enum><text>To provide a standing forum for the United States and Israel to systematically share intelligence-informed military capability requirements.</text></paragraph><paragraph id="id9710758f354a4565a953ae1c40276b2e"><enum>(2)</enum><text>To identify military capability requirements common to both the Department of Defense and the Ministry of Defense of Israel.</text></paragraph><paragraph id="idd88da6e988fc4363ab96908e59a86df1"><enum>(3)</enum><text>To assist defense suppliers in the United States and Israel with efforts to expeditiously gain government approval to conduct joint science, technology, research, development, test, evaluation, and production efforts.</text></paragraph><paragraph id="idc51136d41f1d4a1990adcbd2a568d644"><enum>(4)</enum><text>To develop, as feasible and advisable, combined United States-Israel plans to research, develop, procure, and field weapons systems and military capabilities as quickly and economically as possible to meet common capability requirements of the Department of Defense and the Ministry of Defense of Israel.</text></paragraph></subsection><subsection id="idc7f704192b964f7e98ff28725d291721"><enum>(b)</enum><header>Working Group leadership</header><paragraph id="id3fa8d685bf344c158c669a41cbc9e9d1"><enum>(1)</enum><header>United States leadership</header><text>With respect to the United States, the Working Group shall be headed by the Under Secretary of Defense for Research and Engineering and the Director of the Joint Staff, with the active support of the Director of the Bureau of Political Military Affairs of the Department of State and the Director of National Intelligence.</text></paragraph><paragraph id="idfc1c1201caf34c16ac8b685186904b0e"><enum>(2)</enum><header>Israel leadership</header><text>The Secretary of Defense shall invite the Government of Israel to designate the head of the appropriate office or offices to head the Working Group with respect to Israel.</text></paragraph></subsection><subsection id="id3f7a258fe18a4bf1a0587ebc7db2ddec"><enum>(c)</enum><header>Working Group membership</header><paragraph id="id39e36b6eb1654677a51a3c0cc6db225c"><enum>(1)</enum><header>United States membership</header><text>The Secretary of Defense, the Secretary of State, and the Director of National Intelligence shall each designate one or more individuals to serve as members of the Working Group.</text><subparagraph id="id911cb03fdfa34acb8652595faa08cecc"><enum>(A)</enum><header>Mandatory United States members</header><text>The membership of the Working Group shall consist of, at a minimum, representatives from—</text><clause id="id35f4c0c3da2a46528aa6aa763d1d27df"><enum>(i)</enum><text>the Office of the Secretary of Defense;</text></clause><clause id="ideae0c92bbcb849b1a053951181b5cafd"><enum>(ii)</enum><text>the Joint Staff;</text></clause><clause id="id7d2805c8a5534cfaa598de569a2c7995"><enum>(iii)</enum><text>each of the military departments (including, as appropriate, subordinate entities such as Army Futures Command and research laboratories);</text></clause><clause id="id4d81e1bad9c644b899a46d0c90da508a"><enum>(iv)</enum><text>the defense agencies (including the Defense Advanced Research Projects Agency, the Defense Intelligence Agency, and the Defense Security Cooperation Agency);</text></clause><clause id="ide087a13ee9784d0dab6625c7e49bf740"><enum>(v)</enum><text>United States Central Command;</text></clause><clause id="id032B6805C44B41FEAFF9DF7DE37E5C92"><enum>(vi)</enum><text>United States European Command;</text></clause><clause id="id5F6FF4974B6A4502BA46964D1BE9F9B9"><enum>(vii)</enum><text>United States Indo-Pacific Command;</text></clause><clause id="id685975dc25b6459db194713f32dd2e1e"><enum>(viii)</enum><text>the Department of State; and</text></clause><clause id="id64c2ba1244e04d37937105c214e4d4c8"><enum>(ix)</enum><text>the intelligence community.</text></clause></subparagraph><subparagraph id="id54217215459d400098543e422b352e23"><enum>(B)</enum><header>Rule of construction</header><text>Nothing in this paragraph shall be construed as limiting the ability of the Secretary of Defense, the Secretary of State, or the Director of National Intelligence to add members to the Working Group as considered appropriate.</text></subparagraph></paragraph><paragraph id="id20becda222914d31a8f2129e3a4b9e72"><enum>(2)</enum><header>Israel membership</header><text>The Secretary of Defense, the Secretary of State, and the Director of National Intelligence shall invite their counterparts in the Government of Israel to designate individuals from the Government of Israel to serve as members of the Working Group.</text></paragraph><paragraph id="id421a6941d9754683aa3ca36b25e17f85"><enum>(3)</enum><header>Representation of defense industry</header><subparagraph id="id63717DBEA4704BC6A09A42336EE85838"><enum>(A)</enum><header>In general</header><text>The Working Group may incorporate recommendations from the defense industries of the United States and Israel with respect to combined science and technology efforts and combined research, development, test, and evaluation efforts. </text></subparagraph><subparagraph id="id90F49CF6D8B34D288B78090AD9D35E05"><enum>(B)</enum><header>Inclusion in Working Group</header><text>The membership of the Working Group may include, as appropriate, members of the defense industries of the United States and Israel. </text></subparagraph></paragraph></subsection><subsection id="id8bef045882a040978cffdf939fcba5ed"><enum>(d)</enum><header>Existing efforts</header><paragraph id="id8166DDC0417F4A6D9D2374E909AB3AC8"><enum>(1)</enum><header>In general</header><text>The Secretary of Defense, the Secretary of State, and the Director of National Intelligence shall jointly determine the most efficient and effective means to integrate the Working Group into existing United States science and technology efforts and research, development, test, and evaluation efforts with Israel. </text></paragraph><paragraph id="id7B87BD7B5E0A437F9FD23571A1DFAC08"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this Act shall be construed as requiring the termination of any existing United States defense activity, group, program, or partnership with Israel.</text></paragraph></subsection><subsection id="idd6fec8dbb226404ea451d76872da2f46"><enum>(e)</enum><header>Memorandum of understanding</header><paragraph id="id7B3227318E9E4A0491693D866CCBD13A"><enum>(1)</enum><header>In general</header><text>The Secretary of Defense shall, with the concurrence of the Minister of Defense of Israel, establish a memorandum of understanding between the United States and Israel establishing the United States-Israel Operations Technology Working Group. </text></paragraph><paragraph id="idF6A6AFB7471749FA8D005EB5BA6B630F"><enum>(2)</enum><header>Matters to be included</header><text>The memorandum of understanding under paragraph (1) shall set forth—</text><subparagraph id="id15039B2C85E640D8BEA1A9F90F8E8F88"><enum>(A)</enum><text>the purposes of the Working Group, consistent with subsection (a);</text></subparagraph><subparagraph id="id3377130C451F4087A42702D447808D3C"><enum>(B)</enum><text>the membership of the Working Group, consistent with subsection (c); and</text></subparagraph><subparagraph id="idF1E2B481670840FC8DDB52334B51AEEF"><enum>(C)</enum><text>any other matter considered appropriate.</text></subparagraph></paragraph></subsection><subsection id="idf384c8af00d545a89d327d0ad890135a"><enum>(f)</enum><header>Reports</header><paragraph id="idbb6cfc85c573424faa29f063562dec96"><enum>(1)</enum><header>Initial report</header><subparagraph id="id3e7c16b1b6ec43eeaf0bbf4a7062ae7d"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Defense, in coordination with the Secretary of State and the Director of National Intelligence, shall submit to the appropriate committees of Congress an initial report on the Working Group.</text></subparagraph><subparagraph id="idb06cd0d3972b4300b15781d01ef52954"><enum>(B)</enum><header>Elements</header><text>The report required by subparagraph (A) shall include the following:</text><clause id="id1f398a34f1534cccaa753f8f723f3ea8"><enum>(i)</enum><text>The finalized memorandum of understanding under subsection (e).</text></clause><clause id="id72c1dcd2e7db4e21aa5753c0c86536e4"><enum>(ii)</enum><text>The name of each individual of the Government of the United States and of the Government of Israel designated to lead the Working Group.</text></clause><clause id="iddb8d9aa8af68496daae33801fdfebc5d"><enum>(iii)</enum><text>The name of each member of the Working Group designated under paragraph (1) or (2) of subsection (c).</text></clause><clause id="id34a0d969b46f4d4b8dbc92001fb3d545"><enum>(iv)</enum><text>A description of the manner in which the Working Group is anticipated to complement and augment existing science and technology efforts and research, development, test, and evaluation efforts with Israel.</text></clause><clause id="id9606825abee044a9a06f811380bf0936"><enum>(v)</enum><text>A schedule for Working Group meetings.</text></clause><clause id="id674d81bbf03b44819b15f96a86049f76"><enum>(vi)</enum><text>A description of key metrics and milestones for the Working Group.</text></clause><clause id="idf92025bd919b4516b422ed003fc7a5ee"><enum>(vii)</enum><text>A description of any authority or authorization of appropriations required for the Working Group to carry out the purposes described in subsection (a).</text></clause></subparagraph><subparagraph id="id4c6a40417b594175baa6cf395768c43e"><enum>(C)</enum><header>Form</header><text>The report required by subparagraph (A) shall be submitted in unclassified form, but may include a classified annex.</text></subparagraph></paragraph><paragraph id="idd5e7c924a5124ef188693e89751ce67d"><enum>(2)</enum><header>Annual report</header><subparagraph id="iddee96a3ec93440ffb132cfc481ca4b2f"><enum>(A)</enum><header>In general</header><text>Not later than March 15 of each year following the submittal of the report required by paragraph (1), the Secretary of Defense, in coordination with the Secretary of State and the Director of National Intelligence, shall submit to the appropriate committees of Congress a report on the activities of the Working Group during the preceding calendar year.</text></subparagraph><subparagraph id="id16d6ff4512fe4181a71a1548cb403a71"><enum>(B)</enum><header>Elements</header><text>The report required by subparagraph (A) shall include the following:</text><clause id="id0610a01313bb4617a3d286eb10e8d553"><enum>(i)</enum><text>A summary of the performance of the Working Group relative to—</text><subclause id="idB786DAF36B0341BA80173EB8CBBABB04"><enum>(I)</enum><text>with respect to the first annual report under this paragraph, the metrics and milestones described in the initial report in accordance with in paragraph (1)(B)(vi); or</text></subclause><subclause id="id08103EDAAC164D91AA71D43C0422F234"><enum>(II)</enum><text>with respect to each subsequent annual report under this paragraph, the metrics and milestones described in the preceding annual report under clause (viii).</text></subclause></clause><clause id="iddd7081a41b954d00801f87feff8b4e5d"><enum>(ii)</enum><text>A description of military capabilities needed by both the United States and Israel.</text></clause><clause id="id4cdf950bc6544a71ba61a3fc553a0c18"><enum>(iii)</enum><text>A description of any United States, or any United States-Israel, science and technology efforts, or research, development, test, and evaluation efforts, associated with the military capabilities described under clause (ii) carried out during the reporting period.</text></clause><clause id="id46ceda8422dd4bb2bdc7dcaaba11ead5"><enum>(iv)</enum><text>A description of any obstacle or challenge associated with an effort described in clause (iii) and the plan of the Working Group to address such obstacle or challenge.</text></clause><clause id="id1f2cf5036ebe410a92f0c394d78a25d8"><enum>(v)</enum><text>A description of any request to the Working Group made by a United States or Israel defense supplier for combined science and technology efforts or combined research, development, test, and evaluation efforts, including—</text><subclause id="idAAB0C43F050A426892E54414918E733E"><enum>(I)</enum><text>the date on which the request was received;</text></subclause><subclause id="idAC88D1DFBB2F4CB6A59405D67440B905"><enum>(II)</enum><text>the efforts made by the Working Group to expeditiously address the request; and</text></subclause><subclause id="id49AC730DCCAA4173994545718FC65F5E"><enum>(III)</enum><text>the status of any decision associated with the request.</text></subclause></clause><clause id="idc823ee45c388485b9f402c8f7313afff"><enum>(vi)</enum><text>A description of the efforts of the Working Group to prevent the People's Republic of China or the Russian Federation from obtaining intellectual property or military technology associated with combined United States and Israel science and technology efforts and research, development, test, and evaluation efforts.</text></clause><clause id="id024c768a41ae45b2a46e5b41183d07cf"><enum>(vii)</enum><text>A description of any science and technology effort, or research, development, test, or evaluation effort, facilitated by the Working Group, including efforts that result in a United States or Israel program of record.</text></clause><clause id="id7131cc3986af4dbe836496fdbecbe4bb"><enum>(viii)</enum><text>A description of metrics and milestones for the Working Group for the following calendar year.</text></clause></subparagraph><subparagraph id="id4e8b806eda6b4c4982e4f843dd4e5310"><enum>(C)</enum><header>Form</header><text>The report required by subparagraph (A) shall be submitted in unclassified form and shall include a classified annex in which the elements required under clauses (ii) and (vi) of subparagraph (B) shall be addressed.</text></subparagraph></paragraph><paragraph id="id9f10f3c7b86044c7aa25e59297b8242b"><enum>(3)</enum><header>Appropriate committees of Congress defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>appropriate committees of Congress</term> means—</text><subparagraph id="idf3de55f526fe4890bbfb55d1dfc26644"><enum>(A)</enum><text>the Committee on Armed Services, the Committee on Foreign Relations, and the Select Committee on Intelligence of the Senate; and</text></subparagraph><subparagraph id="id47bd571b86e6413294d5dd1cf9a2ccee"><enum>(B)</enum><text>the Committee on Armed Services, the Committee on Foreign Affairs, and the Permanent Select Committee on Intelligence of the House of Representatives. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
