which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Elder Abuse Prevention and Prosecution Act to improve the prevention of elder abuse and exploitation of individuals with Alzheimer's disease and related dementias. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Alzheimer's Awareness to Prevent Elder Abuse Act</short-title></quote>.</text></section><section id="id5AD599A436FD4DC18F82B6CC9D92D5BD"><enum>2.</enum><header>Addressing Alzheimer's disease in best practices</header><subsection id="idC62F4294B77D4AE1BE586C469DCBD313"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 101(b) of the Elder Abuse Prevention and Prosecution Act (<external-xref legal-doc="usc" parsable-cite="usc/34/21711">34 U.S.C. 21711(b)</external-xref>) is amended—</text><paragraph id="id215027A6E71D4D3180D588F4871E21F1"><enum>(1)</enum><text>by redesignating subparagraphs (A), (B), and (C) of paragraph (2) as clauses (i), (ii), and (iii), respectively, and adjusting the margin accordingly; </text></paragraph><paragraph id="id519387893C624DF795E06EB055B93268"><enum>(2)</enum><text>by redesignating paragraphs (1), (2), and (3) as subparagraphs (A), (B), and (C), respectively, and adjusting the margin accordingly; </text></paragraph><paragraph id="id6D0CD148FBA24081B9DA7149E9FB7223"><enum>(3)</enum><text>by striking <quote>Not later than</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id79F8F7CD8647415AA564261426DA9D8E"><paragraph id="id3EE9E953DD9549EBAFDA95D2B8038107"><enum>(1)</enum><header>In general</header><text>Not later than</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id22DB5D5EA67D4EE3977C7588CA82F78A"><enum>(4)</enum><text>in paragraph (1)(B), as so redesignated—</text><subparagraph id="id79D852BB988C4D20A3088655FFF57C57"><enum>(A)</enum><text>in clause (ii), by inserting <quote>, including witnesses who have Alzheimer’s disease and related dementias</quote> after <quote>other legal issues</quote>; and</text></subparagraph><subparagraph id="id4A7E6F3C41484958A4AB2B82EB4698C8"><enum>(B)</enum><text>in clause (iii), by striking <quote>elder abuse cases,</quote> and inserting <quote>elder abuse cases (including victims and witnesses who have Alzheimer’s disease and related dementias),</quote>; and </text></subparagraph></paragraph><paragraph id="idADA686182A9E44408C93AD0CBFE3BD04"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id67480A1C52FB4AFB9D88A3478476AA3E"><paragraph id="id18562BC21BAF4DEE970DE6E9053F8BE0"><enum>(2)</enum><header>Training materials</header><subparagraph id="idB2C57F415FAC46DBB18284819643A94D"><enum>(A)</enum><header>In general</header><text>In creating or compiling replication guides and training materials under paragraph (1)(B), the Elder Justice Coordinator shall consult with the Secretary of Health and Human Services, State, local, and Tribal adult protective services, aging, social, and human services agencies, Federal, State, local, and Tribal law enforcement agencies, and nationally recognized nonprofit associations with relevant expertise, as appropriate.</text></subparagraph><subparagraph id="idAE58D439FFA948EF8B25F55416A3A926"><enum>(B)</enum><header>Updating</header><text>The Elder Justice Coordinator shall—</text><clause id="id2BBA06C1795F4F598E0C7F2B2163EFE0"><enum>(i)</enum><text>review the best practices identified and replication guides and training materials created or compiled under paragraph (1)(B) to determine if the replication guides or training materials require updating; and</text></clause><clause id="id95E8572BAFC242C6A1D7B3186D73BAB9"><enum>(ii)</enum><text>perform any necessary updating of the replication guides or training materials.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idEC7C5C58B6A44FB1B6E3D9D58EB3213E"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall—</text><paragraph id="id53F3F7A80FA44D71B1E7BE99414F4FCD"><enum>(1)</enum><text>take effect on the date of enactment of this Act; and</text></paragraph><paragraph id="id8522FD9AB6994A099A35A98FD4CA2FA7"><enum>(2)</enum><text>apply on and after the date that is 1 year after the date of enactment of this Act.</text></paragraph></subsection></section><section id="id37A2F06E1B8B4B7BA2A76C78D0B94906"><enum>3.</enum><header>Report on outreach</header><subsection id="id75268F536AB94029966A9F2247F33D70"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 101(c)(2) of the Elder Abuse Prevention and Prosecution Act (<external-xref legal-doc="usc" parsable-cite="usc/34/21711">34 U.S.C. 21711(c)(2)</external-xref>) is amended—</text><paragraph id="id6838F2FA6B6F4E668EA01A7C285445E9"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A) through (D) as clauses (i) through (iv), respectively, and adjusting the margin accordingly; </text></paragraph><paragraph id="id1FA4DAC247694FC183C05CB3009A09C5"><enum>(2)</enum><text>by striking <quote>a report detailing</quote> and inserting the following: “a report—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id46A512C2342F456A9B6EA5DDDE8391FF"><subparagraph id="id36BEE4CD29014F84BCE348BEB548C1E9"><enum>(A)</enum><text>detailing</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idBB271E55418042A9BF1B6775C5FD4E13"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id13F59165BF414115A5DEE1FE4888A35C"><subparagraph id="id62531D577BAD4C5C8ED86A4E67A80C0B"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to the report by the Attorney General, including a link to the publicly available best practices identified under subsection (b)(1)(B) and the replication guides and training materials created or compiled under such subsection.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idC4A7B16192F840AEB670D60CB8616B9A"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall apply with respect to the report under section 101(c)(2) of the Elder Abuse Prevention and Prosecution Act (<external-xref legal-doc="usc" parsable-cite="usc/34/21711">34 U.S.C. 21711(c)(2)</external-xref>) submitted during the second year beginning after the date of enactment of this Act, and each year thereafter.</text></subsection></section></legis-body></bill>
