which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Servicemembers Civil Relief Act to extend lease protections for servicemembers under stop movement orders in response to a local, national, or global emergency, and for other purposes.</official-title></form><legis-body><section id="idEAECD93AF03F49D5AD0A89C3550621C0" section-type="section-one"><enum>1.</enum><header>Extension of lease protections for servicemembers under stop movement orders in response to local, national, or global emergency</header><subsection id="id676E4716E0D447908292EA70C0B3D96B"><enum>(a)</enum><header>Termination</header><text>Subsection (a)(1) of section 305 of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc" parsable-cite="usc/50/3955">50 U.S.C. 3955</external-xref>) is amended—</text><paragraph id="id530F539271854FF39B39E8A71CEAA286"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph><paragraph id="id05944FAC4C4745B1BD6A4FE586D7C861"><enum>(2)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="idAA68F262C3EB479FACE3D48CDDF692AF"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFD7AFAB585B942488757559BE6B12324"><subparagraph id="idFE8AF4AB6552493986D15E483D7D5545"><enum>(C)</enum><text>the date of the lessee's stop movement order described in paragraph (1)(C) or (2)(C) of subsection (b), as the case may be.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idE26734DFC4C44B16809BD600CED676B3"><enum>(b)</enum><header>Covered leases</header><paragraph id="id055C3B02A5854D9E827616BF31747C71"><enum>(1)</enum><header>Leases of premises</header><text display-inline="yes-display-inline">Paragraph (1) of subsection (b) of such section is amended—</text><subparagraph id="id7AAFE2F54F8C46AFAD81286327EBC73E"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id0E54B36B724F4A7AAC7C6787A40FC539"><enum>(B)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="idCB024C4FBCC84CE192D0D3EBE68AEB16"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBD0CC71E165F45AFA963AC8579F098C8"><subparagraph id="id88A8293F842E4FE88F983FE61B563E21"><enum>(C)</enum><text>the servicemember, while in military service—</text><clause id="id7E383AF369724BEBB6285FF7C08C0E58"><enum>(i)</enum><text>executes a lease upon receipt of military orders for a permanent change of station or to deploy with a military unit, or as an individual in support of a military operation, for a period of not less than 90 days; and</text></clause><clause id="idFA4CED948A2743AFB1CAEC88B94DB47F"><enum>(ii)</enum><text>thereafter receives a stop movement order issued by the Secretary of Defense in response to a local, national, or global emergency, effective for an indefinite period or for a period of not less than 30 days, which prevents the servicemember or servicemember's dependents from occupying the lease for a residential, professional, business, agricultural, or similar purpose.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA7D2AEDDA33247A88472DAB164DDEE22"><enum>(2)</enum><header>Leases of motor vehicles</header><text>Paragraph (2) of such subsection is amended—</text><subparagraph id="idEC9BDB244F39417499FC703B3B3901A4"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id3B90469B2EDC4DE8B1EA19BBA363E9B3"><enum>(B)</enum><text>in subparagraph (B)(ii), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="id266B216BD9E54EC39D2442BBFE03039F"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4C476988005141B496C4C0513E7D949D"><subparagraph id="id18B82569B406425DAAA14FE1AAFC12D0"><enum>(C)</enum><text>the servicemember, while in military service—</text><clause id="id55AE0F63A1A941F9A9BFAB5ACA1F9714"><enum>(i)</enum><text>executes a lease upon receipt of military orders described in subparagraph (B); and</text></clause><clause id="id3FD51D34931042B6ACB2044874E576EA"><enum>(ii)</enum><text>thereafter receives a stop movement order issued by the Secretary of Defense in response to a local, national, or global emergency, effective for an indefinite period or for a period of not less than 30 days, which prevents the servicemember, or the servicemember's dependents, from using the vehicle for personal or business transportation.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id1E9B541379A74D75B72823D9A5A7D859"><enum>(c)</enum><header>Effective date of termination</header><text>Paragraph (1) of subsection (d) of such section is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC97D187A09A04E4B8F29742FCF33A3B9"><paragraph commented="no" display-inline="no-display-inline" id="IDD76CBC7D75E245348CECF4B413E3377A"><enum>(1)</enum><header>Lease of premises</header><subparagraph commented="no" display-inline="no-display-inline" id="id0F340FF1EE5240C2988418CA8C1CC155"><enum>(A)</enum><header>Entrance to military service, permanent change of station, or deployment</header><text>In the case of a lease described in subparagraph (A) or (B) of subsection (b)(1) that provides for monthly payment of rent, termination of the lease under subsection (a) is effective 30 days after the first date on which the next rental payment is due and payable after the date on which the notice under subsection (c) is delivered. In the case of any other lease described in subparagraphs (A) and (B) of subsection (b)(1) termination of the lease under subsection (a) is effective on the last day of the month following the month in which the notice is delivered.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id474A5F0C0798475483F6C8E0F3DE628E"><enum>(B)</enum><header>Stop movement orders</header><text>In the case of a lease described in subsection (b)(1)(C), termination of the lease under subsection (a) is effective on the date on which the requirements of subsection (c) are met for such termination.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idD734B9C3DE6C4432B5C3ADA29DFDC987"><enum>(d)</enum><header>Technical correction</header><text>Subsection (i) is amended, in the matter before paragraph (1), by inserting <quote>In this section:</quote> after <quote><header-in-text style="OLC" level="subsection">Definitions</header-in-text>.—</quote>.</text></subsection><subsection id="id351D366A7CEF42BE89D4207B0C1A7207"><enum>(e)</enum><header>Retroactive application</header><text>The amendments made by this section shall apply to stop movement orders issued on or after March 1, 2020.</text></subsection></section></legis-body></bill>
