<congress display="yes">116th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 3587</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To require the Secretary of Veterans Affairs to conduct a study on the accessibility of websites of the Department of Veterans Affairs to individuals with disabilities, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE81DA67C0C064CD69292CFB5B9694897"><section id="H9D715B47D9E146CFAA31F551D59197F1" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Veterans Affairs Website Accessibility Act of 2019</short-title></quote>.</text></section><section id="H4F879D672C3542BFABDE843E8FEA4D56" section-type="subsequent-section" commented="no" display-inline="no-display-inline"><enum>2.</enum><header display-inline="yes-display-inline">Study on the accessibility of websites of the Department of Veterans Affairs to individuals with disabilities</header><subsection id="H93E1E561C3B14E8DA92163123882FE27" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Study</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall conduct a study of all websites of the Department of Veterans Affairs to determine whether such websites are accessible to individuals with disabilities in accordance with section 508 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794d">29 U.S.C. 794d</external-xref>).</text></subsection><subsection id="H95E56EA524924F2DA8C68F010BF911B1" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 90 days after completing the study under subsection (a), the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on such study.</text></subsection><subsection id="id0F586D862C6F4310BF622513DEF746AE" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The report required by subsection (b) shall include the following:</text><paragraph id="H2483D303761648D593F68C1911D9D45C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">A list of each website described in subsection (a) that is not accessible to individuals with disabilities in accordance with section 508 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794d">29 U.S.C. 794d</external-xref>).</text></paragraph><paragraph id="id16CAE479437B4F8BA4AC0E6A3CBC5D13" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">For each website identified in the list under paragraph (1)—</text><subparagraph id="idD51997527D0A4E818E5DB402EB394DC0" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the plan of the Secretary to bring the website into compliance with the requirements of section 508 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794d">29 U.S.C. 794d</external-xref>); and</text></subparagraph><subparagraph id="idDDDC9493C5D340968CE89BF1611CA342" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a description of the barriers to bringing the website into compliance with the requirements of such section, including any barriers relating to vacant positions at the Department of Veterans Affairs.</text></subparagraph></paragraph></subsection><subsection id="id354CC8BF3A3449BABD77DF25E0E84894" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Website defined</header><text display-inline="yes-display-inline">In this section, the term <term>website</term> includes the following:</text><paragraph id="id9E80689508F547F5900F6A24FC63B8C4" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">A file attached to a website.</text></paragraph><paragraph id="idD70CDB98A9D540B1937316D97A7C447D" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">A web-based application.</text></paragraph><paragraph id="idBCA9BDD5B837426E8BF6E4B65AA95327" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">A kiosk at a medical facility of the Department of Veterans Affairs, the use of which is required to check in for scheduled appointments.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20200326" legis-day="20200325" chamber="Senate">Passed the Senate March 26 (legislative day, March 25), 2020.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
