<congress display="yes">116th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 3503</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To authorize the Secretary of Veterans Affairs to treat certain programs of education converted to distance learning by reason of emergencies and health-related situations in the same manner as programs of education pursued at educational institutions, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H68D9F23AA0B04817865802EB648D040A"><section section-type="section-one" id="H21A79E16ECF24639920394F10AB5F687" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Continuation of Department of Veterans Affairs educational assistance benefits for certain programs of education converted to distance learning by reason of emergencies and health-related situations</header><subsection id="HDF11461FB98445D8AEF76EF2C0851D5F" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the case of a program of education approved by a State approving agency, or the Secretary of Veterans Affairs when acting in the role of a State approving agency, that is converted from being offered on-site at an educational institution to being offered by distance learning by reason of an emergency or health-related situation, as determined by the Secretary, the Secretary may continue to provide educational assistance under the laws administered by the Secretary without regard to such conversion, including with respect to paying any—</text><paragraph id="HF999F30D0BAC4D9EAE4355404A8D93F7" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">monthly housing stipends under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/33">chapter 33</external-xref> of title 38, United States Code; or</text></paragraph><paragraph id="H4748CAE7BF854C8CAD651EFC511586B7" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">payments or subsistence allowances under chapters 30, 31, 32, and 35 of such title and chapters 1606 and 1607 of title 10, United States Code.</text></paragraph></subsection><subsection id="H22C77AE160D8461F8234E032D710D6F1" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability period</header><text display-inline="yes-display-inline">Subsection (a) shall apply during the period beginning on March 1, 2020, and ending on December 21, 2020.</text></subsection><subsection id="H8AB805FA4EFF4C1085F1CE5569F45061" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HB03596C9E2AE4A0BA9B257659FFAF706" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Educational institution</header><text display-inline="yes-display-inline">The term <term>educational institution</term> has the meaning given that term in section 3452 of title 38, United States Code, and includes an institution of higher learning (as defined in such section).</text></paragraph><paragraph id="H184FC8E1B6354B9C9DCF2EEBDD35636D" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Program of education</header><text display-inline="yes-display-inline">The term <term>program of education</term> has the meaning given that term in section 3002 of title 38, United States Code. </text></paragraph><paragraph id="HAE9B94CA820C41FAA19F57110D8929C3" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">State approving agency</header><text display-inline="yes-display-inline">The term <term>State approving agency</term> has the meaning given that term in section 3671 of title 38, United States Code.</text></paragraph></subsection></section><section id="id041dc400e87145c3ac2377d285c42060" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Emergency designations</header><subsection id="id5fd8ef97b16d42d38af2f6f950c9b738" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">This Act is designated as an emergency requirement pursuant to section 4(g) of the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/933">2 U.S.C. 933(g)</external-xref>).</text></subsection><subsection id="id558238e4f760461d9fd7b10605ef6f0b" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Designation in Senate</header><text display-inline="yes-display-inline">In the Senate, this Act is designated as an emergency requirement pursuant to section 4112(a) of H. Con.
