Stafford Disaster Relief and Emergency Assistance Act to allow the Administrator of the Federal Emergency Management Agency to provide capitalization grants to States to establish revolving funds to provide hazard mitigation assistance to reduce risks from disasters and natural hazards, and other related environmental harm. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="id720b6841f0964208aea3d1aa32e37563" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding Tomorrow through Ongoing Risk Mitigation Act</short-title></quote> or the <quote><short-title>STORM Act</short-title></quote>.</text></section><section id="id5b6d74793f8748518bf8ddd5ea6e5287" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Grants to entities for establishment of hazard mitigation revolving loan funds</header><text display-inline="no-display-inline">Title II of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5131">42 U.S.C. 5131</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc2342c2914b84642bf8e980a711e5930"><section id="id4732d4a9e0874e6881bd6ca356032b06" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>205.</enum><header display-inline="yes-display-inline">Grants to entities for establishment of hazard mitigation revolving loan funds</header><subsection id="idf61798dad38044588a0e495d37a947a7" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">General authority</header><paragraph id="id31ad1d7c633e4a72ae167bc989b5dd2d" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator may enter into agreements with eligible entities to make capitalization grants to such entities for the establishment of hazard mitigation revolving loan funds (referred to in this section as <quote>entity loan funds</quote>) for providing funding assistance to local governments to carry out eligible projects under this section to reduce disaster risks for homeowners, businesses, nonprofit organizations, and communities in order to decrease— </text><subparagraph id="ide575d938e09a472ba4930d14d550a50a" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the loss of life and property;</text></subparagraph><subparagraph id="idf445f8bdfd1e41cfa3be19b0f14a1fc3" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the cost of insurance; and</text></subparagraph><subparagraph id="id27f867114e2c4a67866c86b276c38693" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">Federal disaster payments.</text></subparagraph></paragraph><paragraph id="id4c78f1d01eb04c81ad4d1a76b11741bf" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Agreements</header><text display-inline="yes-display-inline">Any agreement entered into under this section shall require the participating entity to— </text><subparagraph id="id5525589179384e04bae560bce36def7c" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">comply with the requirements of this section; and </text></subparagraph><subparagraph id="id55c5004cae54419b96f7eb3960c72af0" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">use accounting, audit, and fiscal procedures conforming to generally accepted accounting standards. </text></subparagraph></paragraph></subsection><subsection id="idd98819e1fbda4a0daf07f005ba04350f" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Application</header><paragraph id="id1f906e0aa6d642d7820a85fd7ab024db" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To be eligible to receive a capitalization grant under this section, an eligible entity shall submit to the Administrator an application that includes the following: </text><subparagraph id="id64beb1831a514741b9fff7d8578138c0" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Project proposals comprised of local government hazard mitigation projects, on the condition that the entity provides public notice not less than 6 weeks prior to the submission of an application. </text></subparagraph><subparagraph id="idbabfe22427e5416a8b8697eb145302bc" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">An assessment of recurring major disaster vulnerabilities impacting the entity that demonstrates a risk to life and property. </text></subparagraph><subparagraph id="id20a33285e8b54a56b598763610d316e2" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">A description of how the hazard mitigation plan of the entity has or has not taken the vulnerabilities described in subparagraph (B) into account. </text></subparagraph><subparagraph id="id533eab9ef2db49d0a59a843b75d3e24f" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">A description about how the projects described in subparagraph (A) could conform with the hazard mitigation plan of the entity and of the unit of local government. </text></subparagraph><subparagraph id="id964d7b2960ed4c749e76497a85adcce9" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">A proposal of the systematic and regional approach to achieve resilience in a vulnerable area, including impacts to river basins, river corridors, watersheds, estuaries, bays, coastal regions, micro-basins, micro-watersheds, ecosystems, and areas at risk of earthquakes, tsunamis, droughts, severe storms, and wildfires, including the wildland-urban interface. </text></subparagraph></paragraph><paragraph id="id44cfbfe4002043439e46d8ac6c7e854a" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Technical assistance</header><text display-inline="yes-display-inline">The Administrator shall provide technical assistance to eligible entities for applications under this section. </text></paragraph></subsection><subsection id="id629b6e17e775450ebb45c4e4e52ae3c3" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Entity loan fund</header><paragraph id="id693791347c7a4f578592c82c8669af37" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment of fund</header><text display-inline="yes-display-inline">An entity that receives a capitalization grant under this section shall establish an entity loan fund that complies with the requirements of this subsection. </text></paragraph><paragraph id="id9954efec614c4e93823ec6cb647569a7" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Fund management</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), entity loan funds shall— </text><subparagraph id="idd0179eccbfb4487ebd463158cef4ab8a" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">be administered by the agency responsible for emergency management; and </text></subparagraph><subparagraph id="ida328bb77e19a47a79a643a8f10dcfa49" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">include only—</text><clause id="id70d1acd35d9f4695941065d456e6bf84" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">funds provided by a capitalization grant under this section; </text></clause><clause id="idd96ec3bc90f24d2398f37359be131bd6" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">repayments of loans under this section to the entity loan fund; and </text></clause><clause id="id64bae9f58e8649129f0f6881913402cb" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">interest earned on amounts in the entity loan fund. </text></clause></subparagraph></paragraph><paragraph id="id40a763ab66584d3daf4918b0f149021c" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">A participating entity may combine the financial administration of the entity loan fund of such entity with the financial administration of any other revolving fund established by such entity if the Administrator determines that— </text><subparagraph id="id467b3cae98f34d158d49e9c59a95a8d0" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the capitalization grant, entity share, repayments of loans, and interest earned on amounts in the entity loan fund are accounted for separately from other amounts in the revolving fund; and </text></subparagraph><subparagraph id="idd60701ba535e43e6a05e48085a5d3961" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the authority to establish assistance priorities and carry out oversight activities remains in the control of the entity agency responsible for emergency management. </text></subparagraph></paragraph><paragraph id="idfb2c473d256c40b6b96a84b34c55dcd1" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Entity share of funds</header><subparagraph id="ide819fd5c94ad43c2a01fb51d8c897017" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On or before the date on which a participating entity receives a capitalization grant under this section, the entity shall deposit into the entity loan fund of such entity, an amount equal to not less than 10 percent of the amount of the capitalization grant. </text></subparagraph><subparagraph id="idb96ace9e5fbe404a8172a83255c26cbb" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Reduced grant</header><text display-inline="yes-display-inline">If, with respect to a capitalization grant under this section, a participating entity deposits in the entity loan fund of the entity an amount that is less than 10 percent of the total amount of the capitalization grant that the participating entity would otherwise receive, the Administrator shall reduce the amount of the capitalization grant received by the entity to the amount that is 10 times the amount so deposited. </text></subparagraph></paragraph></subsection><subsection id="id40f5499ed51f45bba0e8a2a17b6d9df9" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Apportionment</header><paragraph id="id3bc97ff8ec094e6ca4e7a61ca54d1aab" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided by this subsection, the Administrator shall apportion funds made available to carry out this section to entities that have entered into an agreement under subsection (a)(2) in amounts as determined by the Administrator. </text></paragraph><paragraph id="idfe7dabd9243e468d9f0dcb9470c3362a" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Reservation of funds</header><text display-inline="yes-display-inline">The Administrator shall reserve not more than 2.5 percent of the amount made available to carry out this section for the Federal Emergency Management Agency for— </text><subparagraph id="id4bacc0eb9fdf4ba3a5a0bbdfa7638752" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">administrative costs incurred in carrying out this section; </text></subparagraph><subparagraph id="id8bb5b742662a45fc94d00420ed4fff78" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">providing technical assistance to participating entities under subsection (b)(2); and </text></subparagraph><subparagraph id="id41bb463a2521463184efff6cab95ffea" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">capitalization grants to insular areas under paragraph (4). </text></subparagraph></paragraph><paragraph id="id91e2d0fc68bf4b57bb481262c995b03a" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">In the apportionment of capitalization grants under this subsection, the Administrator shall give priority to entity applications under subsection (b) that— </text><subparagraph id="id1e5e638327db498cb9c7e05a9ee54a97" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">propose projects increasing resilience and reducing risk of harm to natural and built infrastructure; </text></subparagraph><subparagraph id="id41bf635cca384c9eafef2bacfd03a476" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">involve a partnership between two or more eligible entities to carry out a project or similar projects; </text></subparagraph><subparagraph id="id1d1b2267ea074f9eb0dd881301b9764d" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">take into account regional impacts of hazards on river basins, river corridors, micro-watersheds, macro-watersheds, estuaries, lakes, bays, and coastal regions and areas at risk of earthquakes, tsunamis, droughts, severe storms, and wildfires, including the wildland-urban interface; or </text></subparagraph><subparagraph id="idc4cbbd22d7d442839e72211b13ec3c03" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">propose projects for the resilience of major economic sectors or critical national infrastructure, including ports, global commodity supply chain assets (located within an entity or within the jurisdiction of local governments, insular areas, and Indian tribal governments), power and water production and distribution centers, and bridges and waterways essential to interstate commerce. </text></subparagraph></paragraph><paragraph id="id94891312407a4566a79bf31a47553319" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Insular areas</header><subparagraph id="idecfa3f455e704029a0920b1fce8c0e6a" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Apportionment</header><text display-inline="yes-display-inline">From any amount remaining of funds reserved under paragraph (2), the Administrator may enter into agreements to provide capitalization grants to insular areas. </text></subparagraph><subparagraph id="idb3b8fd1581764c5a880206c5ccecca6d" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">An insular area receiving a capitalization grant under this section shall comply with the requirements of this section as applied to participating entities. </text></subparagraph></paragraph></subsection><subsection id="id6d6135d2adfb4d77ba93446d77e3fe6e" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Environmental review of revolving loan fund projects</header><text display-inline="yes-display-inline">The Administrator may delegate to a participating entity all of the responsibilities for environmental review, decision making, and action pursuant to the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.), and other applicable Federal environmental laws including the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) and the National Historic Preservation Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/54/300101">54 U.S.C. 300101</external-xref> et seq.) that would apply to the Administrator were the Administrator to undertake projects under this section as Federal projects so long as the participating entity carries out such responsibilities in the same manner and subject to the same requirements as if the Administrator carried out such responsibilities. </text></subsection><subsection id="id87f0333254104a2ca92eeb093865266f" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Use of funds</header><paragraph id="ida846459a551942dea6808a60282ed4cd" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Types of assistance</header><text display-inline="yes-display-inline">Amounts deposited in an entity loan fund, including loan repayments and interest earned on such amounts, may be used— </text><subparagraph id="id72ec6aff80b742078778e48f8bc5da87" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to make loans, on the condition that—</text><clause id="id98eb0fb5abd94384beb65f2c91c0b2b4" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">such loans are made at an interest rate of not more than 1 percent; </text></clause><clause id="id68c114af9dd64561b1e81c79d77ca79a" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">annual principal and interest payments will commence not later than 1 year after completion of any project and all loans made under this subparagraph will be fully amortized— </text><subclause id="id2720cb574d97498c96c1f0f92b3b7f87" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">not later than 20 years after the date on which the project is completed; or </text></subclause><subclause id="id52406591f0db4a8d9e7f5a817289b522" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">for projects in a low-income geographic area, not later than 30 years after the date on which the project is completed and not longer than the expected design life of the project; </text></subclause></clause><clause id="id27a278644b824fc2b3fb17b9a85548f2" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">the loan recipient of a loan under this subparagraph establishes a dedicated source of revenue for repayment of the loan; </text></clause><clause id="id83c1f0488eaf4c5c997c5fd74baeeda1" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">the loan recipient of a loan under this subparagraph has a hazard mitigation plan that has been approved by the Administrator; and </text></clause><clause id="id78ebeda3697e4d799ceabc8a41ce5326" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">the entity loan fund will be credited with all payments of principal and interest on all loans made under this subparagraph; </text></clause></subparagraph><subparagraph id="id7b32633cadb2463690de4344a89beb67" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">for mitigation efforts, in addition to mitigation planning under section 322 not to exceed 10 percent of the capitalization grants made to the participating entity in a fiscal year; </text></subparagraph><subparagraph id="idfd54771cff1e4669b030c4a7fab61543" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">for the reasonable costs of administering the fund and conducting activities under this section, except that such amounts shall not exceed $100,000 per year, 2 percent of the capitalization grants made to the participating entity in a fiscal year, or 1 percent of the value of the entity loan fund, whichever amount is greatest, plus the amount of any fees collected by the entity for such purpose regardless of the source; and </text></subparagraph><subparagraph id="id6391a001fd714f33a92debaf51b5a4dc" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">to earn interest on the entity loan fund.</text></subparagraph></paragraph><paragraph id="id19a740cd410944af8e8e2a431e2989ba" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Prohibition on determination that loan is a duplication</header><text display-inline="yes-display-inline">In carrying out this section, the Administrator may not determine that a loan is a duplication of assistance or programs under this Act. </text></paragraph><paragraph id="id37f90cce819e499d8ec9557bbaa71f4a" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Projects and activities eligible for assistance</header><text display-inline="yes-display-inline">Except as provided in this subsection, a participating entity may use funds in the entity loan fund to provide financial assistance for projects or activities that mitigate the impacts of natural hazards including— </text><subparagraph id="id33e2de0c2ec841d39291ed4a8740c1c0" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">drought and prolonged episodes of intense heat; </text></subparagraph><subparagraph id="idfecf0711243b4ae99f6765710a6e6b74" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">severe storms, including hurricanes, tornados, wind storms, cyclones, and severe winter storms; </text></subparagraph><subparagraph id="id801354288163494ca4a9cc155db8d29f" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">wildfires;</text></subparagraph><subparagraph id="iddb681b86e440457091c69e5884fe42db" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">earthquakes;</text></subparagraph><subparagraph id="id44750f86bc4946e59287616ad860a674" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">flooding, including the construction, repair, or replacement of a non-Federal levee or other flood control structure, provided that the Administrator, in consultation with the Army Corps of Engineers (if appropriate), requires an eligible entity to determine that such levee or structure is designed, constructed, and maintained in accordance with sound engineering practices and standards equivalent to the purpose for which such levee or structure is intended;</text></subparagraph><subparagraph id="ide4853ece9e2e430d97681716033953db" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">shoreline erosion;</text></subparagraph><subparagraph id="id6caf3bb1dea640079aee49d546a53367" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">high water levels; and</text></subparagraph><subparagraph id="id0e49adc568a643cd8c561fc8069a10fd" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">storm surges.</text></subparagraph></paragraph><paragraph id="id7e9dc8122c8346e88b62bcf8df40d92e" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Zoning and land use planning changes</header><text display-inline="yes-display-inline">A participating entity may use not more than 10 percent of a capitalization grant under this section to enable units of local government to implement zoning and land use planning changes focused on— </text><subparagraph id="idaadc929761d6448eb37694b8c3cea1b0" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the development and improvement of zoning and land use codes that incentivize and encourage low-impact development, resilient wildland-urban interface land management and development, natural infrastructure, green stormwater management, conservation areas adjacent to floodplains, implementation of watershed or greenway master plans, and reconnection of floodplains; </text></subparagraph><subparagraph id="ide96466b49a4e4daf96719fb3b83681c1" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the study and creation of agricultural risk compensation districts where there is a desire to remove or set-back levees protecting highly developed agricultural land to mitigate for flooding, allowing agricultural producers to receive compensation for assuming greater flood risk that would alleviate flood exposure to population centers and areas with critical national infrastructure; </text></subparagraph><subparagraph id="id1a56ab7f2afe4eeca1bd11b246ec4a11" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the study and creation of land use incentives that reward developers for greater reliance on low impact development stormwater best management practices, exchange density increases for increased open space and improvement of neighborhood catch basins to mitigate urban flooding, reward developers for including and augmenting natural infrastructure adjacent to and around building projects without reliance on increased sprawl, and reward developers for addressing wildfire ignition; and </text></subparagraph><subparagraph id="idc00d9450a5cb40cbb306b721cf0bb1c1" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the study and creation of an erosion response plan that accommodates river, lake, forest, plains, and ocean shoreline retreating or bluff stabilization due to increased flooding and disaster impacts. </text></subparagraph></paragraph><paragraph id="id4334a09fedd0485fa885ad2a99cdd54b" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Establishing and carrying out building code enforcement</header><text display-inline="yes-display-inline">A participating entity may use capitalization grants under this section to enable units of local government to establish and carry out the latest published editions of relevant building codes, specifications, and standards for the purpose of protecting the health, safety, and general welfare of the building's users against disasters and natural hazards. </text></paragraph><paragraph id="ida47b8b9233e64919893e3fffb7bb6616" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Administrative and technical costs</header><text display-inline="yes-display-inline">For each fiscal year, a participating entity may use the amount described in paragraph (1)(C) to— </text><subparagraph id="idb2fed85551764b9dbeda038230cd88d1" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">pay the reasonable costs of administering the programs under this section, including the cost of establishing an entity loan fund; and </text></subparagraph><subparagraph id="id3f442b3838164bdfa3515352c1127ea6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">provide technical assistance to recipients of financial assistance from the entity loan fund, on the condition that such technical assistance does not exceed 5 percent of the capitalization grant made to such entity. </text></subparagraph></paragraph><paragraph id="id82e3c29949de480c9b1235229c481760" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Limitation for single projects</header><text display-inline="yes-display-inline">A participating entity may not provide an amount equal to or more than $5,000,000 to a single hazard mitigation project. </text></paragraph><paragraph id="id03925f2ba0d84c4eabf64872ee33de49" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">For fiscal year 2022 and each fiscal year thereafter, the requirements of subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code, shall apply to the construction of projects carried out in whole or in part with assistance made available by an entity loan fund authorized by this section.</text></paragraph></subsection><subsection id="id708060c59a344cc587b9bc2aa839d2de" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Intended use plans</header><paragraph id="id63669c3b385d4b1a9df56ae9a1098adb" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">After providing for public comment and review, and consultation with appropriate government agencies of the State or Indian tribal government, Federal agencies, and interest groups, each participating entity shall annually prepare and submit to the Administrator a plan identifying the intended uses of the entity loan fund. </text></paragraph><paragraph id="id2eb33c3bbde246a4939219ae05f1fae8" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Contents of plan</header><text display-inline="yes-display-inline">An entity intended use plan prepared under paragraph (1) shall include— </text><subparagraph id="ide50ec74c385c43afa10592900db84df6" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the integration of entity planning efforts, including entity hazard mitigation plans and other programs and initiatives relating to mitigation of major disasters carried out by such entity; </text></subparagraph><subparagraph id="idf94057a2e1224a50b155e65892fb6772" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">an explanation of the mitigation and resiliency benefits the entity intends to achieve by— </text><clause id="idb9f1930af42344ee83e20d3c1d168cf0" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">reducing future damage and loss associated with hazards; </text></clause><clause id="idb234182f0f1a454b9f1bc296d393ec12" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">reducing the number of severe repetitive loss structures and repetitive loss structures in the entity; </text></clause><clause id="ida488502ccc6148af93e9f1ee0d45e9c4" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">decreasing the number of insurance claims in the entity from injuries resulting from major disasters or other natural hazards; and </text></clause><clause id="idc50122d591fa44488e141f3678552c37" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">increasing the rating under the community rating system under section 1315(b) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4022">42 U.S.C. 4022(b)</external-xref>) for communities in the entity; </text></clause></subparagraph><subparagraph id="id3afcd1a6dbb949b6be3c03cef6fabc61" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">information on the availability of, and application process for, financial assistance from the entity loan fund of such entity; </text></subparagraph><subparagraph id="ided1a0b7ce3f94222b3fe739c01c95053" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the criteria and methods established for the distribution of funds; </text></subparagraph><subparagraph id="id68fb45f8613343c783180156c7ddb613" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the amount of financial assistance that the entity anticipates apportioning; </text></subparagraph><subparagraph id="id8c86c289bc2b42fc869d97da7c876e95" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">the expected terms of the assistance provided from the entity loan fund; and </text></subparagraph><subparagraph id="id222de5d4b51a4c37a43d6f02632d0595" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">a description of the financial status of the entity loan fund, including short-term and long-term goals for the fund. </text></subparagraph></paragraph></subsection><subsection id="id73a52e8bcdf24db28625d23abd1315c7" commented="no" display-inline="no-display-inline"><enum>(h)</enum><header display-inline="yes-display-inline">Audits, reports, publications, and oversight</header><paragraph id="id742ddbea6b124414a3fc55744537e642" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Biennial entity audit and report</header><text display-inline="yes-display-inline">Beginning not later than the last day of the second fiscal year after the receipt of payments under this section, and biennially thereafter, any participating entity shall— </text><subparagraph id="id86131b9be7af4142b50a839de8df8040" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">conduct an audit of the entity loan fund established under subsection (c); and </text></subparagraph><subparagraph id="id7d2b879323b54948baa69b351f8e0d11" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">provide to the Administrator a report including— </text><clause id="id91e3cc996ca14be48f47622e67207f1d" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the result of any such audit; and</text></clause><clause id="id67b1ab9bd8ea4ca68aff3deebbc83aeb" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a review of the effectiveness of the entity loan fund of the entity with respect to meeting the goals and intended benefits described in the intended use plan submitted by the entity under subsection (g). </text></clause></subparagraph></paragraph><paragraph id="idfaff1411c451467baf8a0de1b9add273" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Publication</header><text display-inline="yes-display-inline">A participating entity shall publish and periodically update information about all projects receiving funding from the entity loan fund of such entity, including— </text><subparagraph id="idedea6a9fe31a44f5afa8108c7291a108" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the location of the project;</text></subparagraph><subparagraph id="id2355fae45cec4ac2baa636a75f2a89d3" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the type and amount of assistance provided from the entity loan fund; </text></subparagraph><subparagraph id="id9cf1c62a092f411dabc75d089757b983" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the expected funding schedule; and</text></subparagraph><subparagraph id="ide6886b12e5c44154999034f19a5da25b" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the anticipated date of completion of the project. </text></subparagraph></paragraph><paragraph id="id18dd365055fa4e62993e1d095d95e0c6" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Oversight</header><subparagraph id="id5d98a1a5ce84428e94862ad5afbadb08" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall, at least every 4 years, conduct reviews and audits as may be determined necessary or appropriate by the Administrator to carry out the objectives of this section and determine the effectiveness of the fund in reducing natural hazard risk. </text></subparagraph><subparagraph id="id00ad47ef10984616bda6e30ce6e80c76" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">GAO requirements</header><text display-inline="yes-display-inline">A participating entity shall conduct audits under paragraph (1) in accordance with the auditing procedures of the Government Accountability Office, including generally accepted government auditing standards. </text></subparagraph><subparagraph id="id3b397ffab7df481c9f553aad49cc242a" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Recommendations by administrator</header><text display-inline="yes-display-inline">The Administrator may at any time make recommendations for or require specific changes to an entity loan fund in order to improve the effectiveness of the fund. </text></subparagraph></paragraph></subsection><subsection id="idceb0d7a106f1447da5d06ea86d874c1f" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Regulations or guidance</header><text display-inline="yes-display-inline">The Administrator shall issue such regulations or guidance as are necessary to— </text><paragraph id="idEDF742A830FC46F293D455B4043A0D3D" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that each participating entity uses funds as efficiently as possible; </text></paragraph><paragraph id="id0cb1f14239994358a81cef0b8f671d8b" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">reduce waste, fraud, and abuse to the maximum extent possible; and </text></paragraph><paragraph id="idda16a7867b72422f86b24c3ff9828548" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">require any party that receives funds directly or indirectly under this section, including a participating entity and a recipient of amounts from an entity loan fund, to use procedures with respect to the management of the funds that conform to generally accepted accounting standards. </text></paragraph></subsection><subsection id="id61273a02fc2b48e3a114c4dfd68bd4fa" commented="no" display-inline="no-display-inline"><enum>(j)</enum><header display-inline="yes-display-inline">Waiver authority</header><text display-inline="yes-display-inline">Until such time as the Administrator issues final regulations to implement this section, the Administrator may—</text><paragraph id="iddf2bb7404c7e4cfd83b184725cf02ed7" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">waive notice and comment rulemaking, if the Administrator determines the waiver is necessary to expeditiously implement this section; and</text></paragraph><paragraph id="idb8ee30e6dda44a49980952616a7183d1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">provide capitalization grants under this section as a pilot program.</text></paragraph></subsection><subsection id="id396fd5b1242d411398eb74726b779518" commented="no" display-inline="no-display-inline"><enum>(k)</enum><header display-inline="yes-display-inline">Liability protections</header><text display-inline="yes-display-inline">The Agency shall not be liable for any claim based on the exercise or performance of, or the failure to exercise or perform, a discretionary function or duty by the Agency, or an employee of the Agency in carrying out this section. </text></subsection><subsection id="id1fef2978184e4550bba4761de15cf89c" commented="no" display-inline="no-display-inline"><enum>(l)</enum><header display-inline="yes-display-inline">GAO Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the first entity loan fund is established under subsection (c), the Comptroller General of the United States shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that examines—</text><paragraph id="idef8eac2f9f834e72988fb78ff965cf81" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the appropriateness of regulations and guidance issued by the Administrator for the program, including any oversight of the program;</text></paragraph><paragraph id="id62f6bc45e5104b1b8ea4690913cd1ab3" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the number of the entity loan funds established, the projects funded from such entity loan funds, and the extent to which projects funded by the loan funds adhere to any applicable hazard mitigation plans;</text></paragraph><paragraph id="id3859bb0412ef41b1bb5286ae7e857d7c" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the effectiveness of the entity loan funds to lower disaster related costs; and</text></paragraph><paragraph id="idaa78cf731a8e4e7c857607f9616161a3" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">recommendations for improving the administration of entity loan funds. </text></paragraph></subsection><subsection id="idc923da6f4d164f68b53e777c4f08f7b0" commented="no" display-inline="no-display-inline"><enum>(m)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section, the following definitions apply: </text><paragraph id="id1b67c595e1dd415eab725fff2accc624" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency. </text></paragraph><paragraph id="id52045378911a4c5a85cb728949733135" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Agency</header><text display-inline="yes-display-inline">The term <term>Agency</term> means the Federal Emergency Management Agency. </text></paragraph><paragraph id="id08026aa2203d47199790f595604f1d33" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="idf942e1ac00924979aa0a44188045177a" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a State; or</text></subparagraph><subparagraph id="id40d5da554e234dd0bb0f8d083a790c61" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">an Indian tribal government that has received a major disaster declaration during the 5-year period ending on the date of enactment of the <short-title>STORM Act</short-title>. </text></subparagraph></paragraph><paragraph id="id015f31b30877488c971c81884b13ee57" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Hazard mitigation plan</header><text display-inline="yes-display-inline">The term <term>hazard mitigation plan</term> means a mitigation plan submitted under section 322. </text></paragraph><paragraph id="idb7070709569b4189bffacc453862fb78" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Insular area</header><text display-inline="yes-display-inline">The term <term>insular area</term> means Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and the United States Virgin Islands. </text></paragraph><paragraph id="id0286d5b2ba97473587dafdd8efeb6f04" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Low-income geographic area</header><text display-inline="yes-display-inline">The term <term>low-income geographic area</term> means an area described in paragraph (1) or (2) of section 301(a) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3161">42 U.S.C. 3161(a)</external-xref>). </text></paragraph><paragraph id="id47db1bc142fa4688a62221d8ee3f54b4" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Participating entity</header><text display-inline="yes-display-inline">The term <term>participating entity</term> means an eligible entity that has entered into an agreement under this section. </text></paragraph><paragraph id="id3777b11aa7ba43638320d0005bd97094" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Repetitive loss structure</header><text display-inline="yes-display-inline">The term <term>repetitive loss structure</term> has the meaning given the term in section 1370 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4121">42 U.S.C. 4121</external-xref>). </text></paragraph><paragraph id="idb2d4844ab70e44eebaef1d3fdf59bb1a" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">Severe repetitive loss structure</header><text display-inline="yes-display-inline">The term <term>severe repetitive loss structure</term> has the meaning given the term in section 1366(h) of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4104c">42 U.S.C. 4104c(h)</external-xref>). </text></paragraph><paragraph id="id337d1508857f457fafda66c0d5d03bdc" commented="no" display-inline="no-display-inline"><enum>(10)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means any State of the United States, the District of Columbia, and Puerto Rico. </text></paragraph><paragraph id="id6b77f412e108437abbf1994f06073d84" commented="no" display-inline="no-display-inline"><enum>(11)</enum><header display-inline="yes-display-inline">Wildland-urban interface</header><text display-inline="yes-display-inline">The term <term>wildland-urban interface</term> has the meaning given the term in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>).</text></paragraph></subsection><subsection id="id3c3b566e029c44ddb7389e0a6f817034" commented="no" display-inline="no-display-inline"><enum>(n)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated $100,000,000 for each of fiscal years 2022 through 2023 to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
