which was read twice and referred to the <committee-name committee-id="SSJU00" added-display-style="italic" deleted-display-style="strikethrough">Committee on the Judiciary</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>July 20, 2020</action-date><action-desc>Reported by <sponsor name-id="S293">Mr. Graham</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To establish a National Commission on Online Child Sexual Exploitation Prevention, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eliminating Abusive and Rampant Neglect of Interactive Technologies Act of 2020</short-title></quote> or the <quote><short-title>EARN IT Act of 2020</short-title></quote>.</text></section><section id="id7B851967F0C045C49EAE3785B76270FF" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idB0B1509810804271AEEAACBE0012435E"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the National Commission on Online Child Sexual Exploitation Prevention.</text></paragraph><paragraph id="id476F289703FF4DF8BA6D8A2DB55B706E"><enum>(2)</enum><header>Interactive computer service</header><text>The term <term>interactive computer service</term> has the meaning given the term in section 230(f)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)(2)</external-xref>).</text></paragraph></section><section id="idEDF0ED72ABE24C88BCF20DB02B90F8FB" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>3.</enum><header>National Commission on Online Child Sexual Exploitation Prevention</header><subsection id="idC9571C09A015488E96CE62E8D7D1F9E7"><enum>(a)</enum><header>Establishment</header><text>There is established a National Commission on Online Child Sexual Exploitation Prevention.</text></subsection><subsection id="idaab840b714df48f1bea8769744ce1bca"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Commission is to develop recommended best practices that providers of interactive computer services may choose to implement to prevent, reduce, and respond to the online sexual exploitation of children, including the enticement, grooming, sex trafficking, and sexual abuse of children and the proliferation of online child sexual abuse material.</text></subsection><subsection id="id17046E5CD7DC4B778E1DAE0E859F890C"><enum>(c)</enum><header>Membership</header><paragraph id="id3302B5FF8472496F964F1063A62DDFAF"><enum>(1)</enum><header>Composition</header><subparagraph id="id5066542633494F2CA9591B9967C039C5"><enum>(A)</enum><header>In general</header><text>The Commission shall be composed of 19 members.</text></subparagraph><subparagraph id="idD81E57EB175E4263AA93DD2756CBE9A7"><enum>(B)</enum><header>Agency heads</header><text>The following Federal officials shall serve as members of the Commission:</text><clause id="id67B3A95AA832483E9B49EB0474315F35"><enum>(i)</enum><text>The Attorney General or his or her representative.</text></clause><clause id="id50957B0A4FC24F729BAC84D54726B2D8"><enum>(ii)</enum><text>The Secretary of Homeland Security or his or her representative.</text></clause><clause id="id7E484297509141248A347FE82B23D97E"><enum>(iii)</enum><text>The Chairman of the Federal Trade Commission or his or her representative.</text></clause></subparagraph><subparagraph id="id98293f82990140819096e173ceae4311"><enum>(C)</enum><header>Other members</header><text>Of the remaining 16 members of the Commission—</text><clause id="id7847218025694376aa57f60d9f2482a9"><enum>(i)</enum><text>4 shall be appointed by the majority leader of the Senate, of whom—</text><subclause id="idF808243A1CE24957AFA649644C64435B"><enum>(I)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(A);</text></subclause><subclause id="idD0CAA2074DDC4150A074CDC6C6B505E5"><enum>(II)</enum><text>1 shall have the qualifications required under paragraph (2)(B);</text></subclause><subclause id="id7C94AAFDADF7493F840B9F2D5B9ED25A"><enum>(III)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(C); and</text></subclause><subclause id="idAF52D8BA88804DB0A010F52A3EFDF729"><enum>(IV)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(D);</text></subclause></clause><clause id="id19e1a56d3ec8400f90d9e0fc4c9f0e5e"><enum>(ii)</enum><text>4 shall be appointed by the minority leader of the Senate, of whom—</text><subclause id="idF912640D807946B4B5A41C340BFFF153"><enum>(I)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(A);</text></subclause><subclause id="idB76D6385D1774B46928FBFD2A9B14882"><enum>(II)</enum><text>1 shall have the qualifications required under paragraph (2)(B);</text></subclause><subclause id="id1537E4F4571041839F85BEEB8CEE66DB"><enum>(III)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(C); and</text></subclause><subclause id="idADDEABC3642D44658ED6044C5730DF55" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(D);</text></subclause></clause><clause id="id8f9922bb329e495fa9d07804f25b396d"><enum>(iii)</enum><text>4 shall be appointed by the Speaker of the House of Representatives, of whom—</text><subclause id="idF0FA1D5CA2A649D69A9EF00F7D6075F8"><enum>(I)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(A);</text></subclause><subclause id="id5F4A424318114F8ABB144A24EBCD80AF"><enum>(II)</enum><text>1 shall have the qualifications required under paragraph (2)(B);</text></subclause><subclause id="id3D0AA90CE97C4F10AB54BB5617C4C8CB"><enum>(III)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(C); and</text></subclause><subclause id="idA5E61445DDB842FA9484CA42EC5C6B0A" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(D); and</text></subclause></clause><clause id="id19d4d27f7ed74b24baf53b816bd8fb3c"><enum>(iv)</enum><text>4 shall be appointed by the minority leader of the House of Representatives, of whom—</text><subclause id="idF532C6D0ED064FF8BCFB11D5C563B67D"><enum>(I)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(A);</text></subclause><subclause id="id27D9D1F1A67843D6BFFFE8D3F2D0E6BC"><enum>(II)</enum><text>1 shall have the qualifications required under paragraph (2)(B);</text></subclause><subclause id="idD0E5585C339245AFAFF1ACE7309EDE00"><enum>(III)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(C); and</text></subclause><subclause id="idADC99E384A27446C8BA7D147BA44F104" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(D).</text></subclause></clause></subparagraph></paragraph><paragraph id="iddf947fef29d447c89e79eae37535a1c4"><enum>(2)</enum><header>Qualifications</header><text>Of the 16 members of the Commission appointed under paragraph (1)(C)—</text><subparagraph id="id1ca4ebf525d54760bd4c1a63c80b34d8"><enum>(A)</enum><text>4 shall have current experience in investigating online child sexual exploitation crimes, of whom—</text><clause id="idf5402026a2c04ade8490c511cfd61a31"><enum>(i)</enum><text>2 shall have such experience in a law enforcement capacity; and</text></clause><clause id="id745d22b2d3ac43cdb113cd4737223be7"><enum>(ii)</enum><text>2 shall have such experience in a prosecutorial capacity;</text></clause></subparagraph><subparagraph id="id68b3b8be3e0c48f5880bdb085fc65492"><enum>(B)</enum><text>4 shall be survivors of online child sexual exploitation, or have current experience in providing services for victims of online child sexual exploitation in a non-governmental capacity;</text></subparagraph><subparagraph id="idFB8FB837C1BF439D9489AF1D49B666EB"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="idAC9CDF26931C44F9A64E215311828D7A"><enum>(i)</enum><text>2 shall have current experience in matters related to constitutional law, consumer protection, or privacy; and</text></clause><clause id="id5676f5a3d94842189f60d1b8b2c5764f" indent="up1"><enum>(ii)</enum><text>2 shall have current experience in computer science or software engineering related to matters of cryptography, data security, or artificial intelligence in a non-governmental capacity; and</text></clause></subparagraph><subparagraph id="idc69be967a4504a5bb8c1294938b08460"><enum>(D)</enum><text>4 shall be individuals who each currently work for an interactive computer service that is unrelated to each other interactive computer service represented under this subparagraph, representing diverse types of businesses and areas of professional expertise, of whom—</text><clause id="idd526e3dc8ea444be8730ac4e40621c95"><enum>(i)</enum><text>2 shall have current experience in addressing online child sexual exploitation and promoting child safety at an interactive computer service with not less than 30,000,000 registered monthly users in the United States; and</text></clause><clause id="id18f3bb7036a64c63badf200d5eaf057e"><enum>(ii)</enum><text>2 shall have current experience in addressing online child sexual exploitation and promoting child safety at an interactive computer service with less than 10,000,000 registered monthly users in the United States.</text></clause></subparagraph></paragraph><paragraph id="idB5FCC44368994BDF9A095C3C5261A8AE"><enum>(3)</enum><header>Date</header><text>The initial appointments of members to the Commission under paragraph (1)(C) shall be made not later than 90 days after the date of enactment of this Act.</text></paragraph></subsection><subsection id="id0541BC6C52514ABF98C3504F96DC75F0"><enum>(d)</enum><header>Period of appointment; vacancies</header><paragraph id="idA3BDDAE885CC44A69022C5FDBB7CAFED"><enum>(1)</enum><header>Period of appointment</header><text>A member of the Commission shall be appointed for a term of 5 years.</text></paragraph><paragraph id="idF9BFE72406894EB9B7EAC5BF44A345D5"><enum>(2)</enum><header>Vacancies</header><subparagraph id="idB9B7655C8E24433695364E5B95B92C4B"><enum>(A)</enum><header>Effect on Commission</header><text>Any vacancy in the Commission shall not affect the powers of the Commission.</text></subparagraph><subparagraph id="idE7B66A8188AB46EDA9594F81EF057AA4"><enum>(B)</enum><header>Filling of vacancies</header><text>A vacancy in the Commission shall be filled in the same manner as the original appointment under subsection (c)(1).</text></subparagraph></paragraph></subsection><subsection id="id693C3CED8AD94B37AFE52D29C4BB8854"><enum>(e)</enum><header>Initial meeting</header><text>The Commission shall hold the first meeting of the Commission not later than 60 days after the date on which a majority of the members of the Commission have been appointed.</text></subsection><subsection id="id7EBC60CE247F4485B798B451199EF589"><enum>(f)</enum><header>Chairperson</header><text>The Attorney General or his or her representative shall serve as the Chairperson of the Commission.</text></subsection><subsection id="id628EAC17286C4CB2B5DDB0532215CB86"><enum>(g)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number of members may hold a meeting.</text></subsection><subsection id="idC841A4C7E9784B1EA92C04D08A7CB4EA"><enum>(h)</enum><header>Meetings</header><text>The Commission shall meet at the call of the Chairperson.</text></subsection><subsection id="id03d154b2462a4ab2aa4f9895978a4b93"><enum>(i)</enum><header>Authority of Commission</header><text>The Commission may, for the purpose of carrying out this section and section 4, hold such hearings, sit and act at such times and places, take such testimony, and receive such evidence as the Commission considers appropriate.</text></subsection><subsection id="id972c13c81fdd4de9a3ff0c37b2638261"><enum>(j)</enum><header>Information from Federal agencies</header><paragraph id="id252D29ACE9714F299D4EFED84090C2B3"><enum>(1)</enum><header>In general</header><text>The Commission may secure directly from any Federal department or agency such information as the Commission considers necessary to carry out this section and section 4.</text></paragraph><paragraph id="idB15565337FA64423B0B101C6BE162C7B"><enum>(2)</enum><header>Furnishing information</header><text>Upon request of the Chairperson of the Commission for information under paragraph (1), the head of a Federal department or agency shall furnish the information to the Commission, unless the information is subject to an active investigation or otherwise privileged or confidential.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8AB9CAB7544542CBBCD32562861B7980"><enum>(k)</enum><header>Travel expenses</header><text>A member of the Commission shall serve without compensation, but shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the home or regular places of business of the member in the performance of services for the Commission.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6F3B48CD142C4685BBFC471A6A68188A"><enum>(l)</enum><header>Duration</header><text>Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission.</text></subsection></section><section id="idCDF8A3E86C504C05A22B89865E331612" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>4.</enum><header>Duties of the Commission</header><subsection id="idA5494802452446B2B2CAA28E63724711"><enum>(a)</enum><header>Recommended best practices</header><paragraph id="id1BEA08999CF34849ABCD1AF70C30CB55"><enum>(1)</enum><header>Initial recommendations</header><subparagraph id="id29332d8bcecb4737bdc7059ff7289d61"><enum>(A)</enum><header>In general</header><text>Not later than 18 months after the date on which a majority of the members of the Commission required to be appointed under section 3(c)(1)(C) have been so appointed, the Commission shall develop and submit to the Attorney General recommended best practices that providers of interactive computer services may choose to engage in to prevent, reduce, and respond to the online sexual exploitation of children, including the enticement, grooming, sex trafficking, and sexual abuse of children and the proliferation of online child sexual abuse material.</text></subparagraph><subparagraph id="id0beb4d18c4ac484098d04662e67b41ec"><enum>(B)</enum><header>Requirements</header><clause id="id46BA154DB1F941398F28DFEBDC90FADF"><enum>(i)</enum><header>Alternative best practices</header><text>The best practices required to be developed and submitted under subparagraph (A) shall include alternatives that take into consideration—</text><subclause id="id43ae531d695a422cbc3f04fff4fd2a6d"><enum>(I)</enum><text>the size, type of product, and business model of a provider of an interactive computer service;</text></subclause><subclause id="id374a84501388474b8449614a2169a1f5"><enum>(II)</enum><text>whether an interactive computer service—</text><item id="id05F45F11061245B28FA5F9299B425DED"><enum>(aa)</enum><text>is made available to the public;</text></item><item id="id710EB37BB3614100B20EEA45530EFB4B"><enum>(bb)</enum><text>is primarily responsible for the transmission and storage of information on behalf of other interactive computer services; or</text></item><item id="idb885ef342def442cbf5d8016f4215ea9"><enum>(cc)</enum><text>provides the capability to transmit data to and receive data from all or substantially all internet endpoints on behalf of a consumer; and</text></item></subclause><subclause id="idf0fcb9f272dc423f81be0d5fd339cf8d"><enum>(III)</enum><text>whether a type of product, business model, product design, or other factors related to the provision of an interactive computer service could make a product or service susceptible to the use and facilitation of online child sexual exploitation.</text></subclause></clause><clause id="id6a4bf8ffd0fa4f0990be8c7428220f55"><enum>(ii)</enum><header>Scope</header><text>Notwithstanding paragraph (3), the alternatives described in clause (i) of this subparagraph may exclude certain matters required to be addressed under paragraph (3), as the Commission determines appropriate based on the nature of particular products or services or other factors relevant to the purposes of this Act.</text></clause></subparagraph></paragraph><paragraph id="id6A30F32DBA8A4001B68BDEC0F255CF87"><enum>(2)</enum><header>Support requirement</header><text>The Commission may only recommend the best practices under paragraph (1) if not fewer than 14 members of the Commission support the best practices.</text></paragraph><paragraph id="idBB03B14D635B499E8D80CC13EA32847C"><enum>(3)</enum><header>Matters addressed</header><text>The matters addressed by the recommended best practices developed and submitted by the Commission under paragraph (1) shall include—</text><subparagraph id="id7514d65b0d3141ed9a019e919a09a160"><enum>(A)</enum><text>preventing, identifying, disrupting, and reporting child sexual exploitation;</text></subparagraph><subparagraph id="id2a1585a7383740e29caf7fc61ed14721"><enum>(B)</enum><text>coordinating with non-profit organizations and other providers of interactive computer services to preserve, remove from view, and report child sexual exploitation;</text></subparagraph><subparagraph id="id0a0821a850254782bbcb83a10b6715bc"><enum>(C)</enum><text>retaining child sexual exploitation content and related user identification and location data;</text></subparagraph><subparagraph id="ida4fdb213b16c4d4fb6578bfac2dd3435"><enum>(D)</enum><text>receiving and triaging reports of child sexual exploitation by users of interactive computer services, including self-reporting;</text></subparagraph><subparagraph id="idc324e76cf55945ab8fd5ff416b6d6f6b"><enum>(E)</enum><text>implementing a standard rating and categorization system to identify the type and severity of child sexual abuse material;</text></subparagraph><subparagraph id="id8b18982ba22848a9a6bac901f6114d0a"><enum>(F)</enum><text>training and supporting content moderators who review child sexual exploitation content for the purposes of preventing and disrupting online child sexual exploitation;</text></subparagraph><subparagraph id="id9dd4e8589863419c95a1bdf8a35b1409"><enum>(G)</enum><text>preparing and issuing transparency reports, including disclosures in terms of service, relating to identifying, categorizing, and reporting child sexual exploitation and efforts to prevent and disrupt online child sexual exploitation;</text></subparagraph><subparagraph id="id7e727160dc7d46e5b7aab44f52b52f52"><enum>(H)</enum><text>coordinating with voluntary initiatives offered among and to providers of interactive computer services relating to identifying, categorizing, and reporting child sexual exploitation;</text></subparagraph><subparagraph id="ide2467743742d485f9f4c5f7e2d60f52a"><enum>(I)</enum><text>employing age rating and age gating systems to reduce child sexual exploitation;</text></subparagraph><subparagraph id="id1e78eeca33494026baf07ed8f46acc34"><enum>(J)</enum><text>offering parental control products that enable customers to limit the types of websites, social media platforms, and internet content that are accessible to children; and</text></subparagraph><subparagraph id="id5d49f864c0ce43eda82e7d18a912de88"><enum>(K)</enum><text>contractual and operational practices to ensure third parties, contractors, and affiliates comply with the best practices.</text></subparagraph></paragraph><paragraph id="id34276145f1e94ec481e045b7bae2a3a0"><enum>(4)</enum><header>Relevant considerations</header><text>In developing best practices under paragraph (1), the Commission shall consider—</text><subparagraph id="ida2e6b370e4bb4f8c83f4e0a5c9554a98"><enum>(A)</enum><text>the cost and technical limitations of implementing the best practices;</text></subparagraph><subparagraph id="iddcafdc3557d04ba8a3615aedc11d4209"><enum>(B)</enum><text>the impact on competition, product and service quality, data security, and privacy;</text></subparagraph><subparagraph id="id3356ce55e6734719b79a0a55035ebc90"><enum>(C)</enum><text>the impact on the ability of law enforcement agencies to investigate and prosecute child sexual exploitation and rescue victims; and</text></subparagraph><subparagraph id="id3a0606afd97d4d26968903b53c462a9a"><enum>(D)</enum><text>the current state of technology.</text></subparagraph></paragraph><paragraph id="idBE0033EC28C447B3ABD12BA643D651E2"><enum>(5)</enum><header>Periodic updates</header><text>Not less frequently than once every 5 years, the Commission shall update and resubmit to the Attorney General recommended best practices under paragraph (1).</text></paragraph><paragraph id="id6483cb039ba84b75960d5cfccdd5f04d"><enum>(6)</enum><header>Resubmission after denial or failure to approve</header><subparagraph id="idD82EA708D91B42BBBB4F902DF4166591"><enum>(A)</enum><header>In general</header><text>If, with respect to recommended best practices submitted under paragraph (1), the best practices are denied under subsection (b)(1)(A) or a bill that contains the best practices is not enacted under the expedited procedures under subsection (c), the Commission may resubmit recommended best practices to the Attorney General until the applicable deadline.</text></subparagraph><subparagraph id="idF4A712E541554B77BD4E3736AD06EA3F"><enum>(B)</enum><header>Applicable deadline</header><clause id="idA67CDCDB8DAC4DE391CF6356EA366DE8"><enum>(i)</enum><header>Initial best practices</header><text>For purposes of subparagraph (A), in the case of resubmission of initial recommended best practices that were submitted under paragraph (1) before any bill that contains best practices has been enacted under the expedited procedures under subsection (c), the applicable deadline is the later of—</text><subclause id="id7DEC6F5D104E46428D9E44CFEEC43A3F"><enum>(I)</enum><text>the deadline described in paragraph (1)(A) of this subsection; or</text></subclause><subclause id="idD0EF939D4CE34D22B9B29A65CDD2EA08" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>the date that is 60 days after, as applicable—</text><item commented="no" display-inline="no-display-inline" id="idABA98B138C4147638E58C1411D3777BA"><enum>(aa)</enum><text>the date of the denial; or</text></item><item commented="no" display-inline="no-display-inline" id="idFA6BEDC4AF9A41FFA1888318BA9B2923"><enum>(bb)</enum><text>the last day on which a bill containing the best practices could have been enacted under the expedited procedures under subsection (c).</text></item></subclause></clause><clause id="idB5CC940E4FD74F54B1BA3170390EF027"><enum>(ii)</enum><header>Updated best practices</header><text>For purposes of subparagraph (A), in the case of resubmission of updated recommended best practices that were submitted under paragraph (1) in accordance with paragraph (5), the applicable deadline is the later of—</text><subclause id="id0219CA3A02F643028CE649D469464765"><enum>(I)</enum><text>the deadline described in paragraph (5); or</text></subclause><subclause id="id7796C2D23F264880B0F82FCE4537FCA1" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>the date that is 60 days after, as applicable—</text><item commented="no" display-inline="no-display-inline" id="idF7787B282FBF494DBAE4B3457CD5F53C"><enum>(aa)</enum><text>the date of the denial; or</text></item><item commented="no" display-inline="no-display-inline" id="idA452DB4FF7FF4332ADC91438B9F77820"><enum>(bb)</enum><text>the last day on which a bill containing the best practices could have been enacted under the expedited procedures under subsection (c).</text></item></subclause></clause></subparagraph></paragraph></subsection><subsection id="id84B0A635B185457895065CEEFE2FA38C"><enum>(b)</enum><header>Publication of best practices</header><paragraph id="id4122d56b43554b419245997e4219eeab"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date on which the Commission submits recommended best practices under subsection (a), including updated recommended best practices under paragraph (5) of that subsection, the Attorney General, upon agreement with the Secretary of Homeland Security and the Chairman of the Federal Trade Commission, shall—</text><subparagraph id="idFFB28BECB7B24BC185C250319FE9A9F6"><enum>(A)</enum><text>approve or deny the recommended best practices; and</text></subparagraph><subparagraph id="id8fa1efb3ce17450f9559126be208638c"><enum>(B)</enum><text>if approved—</text><clause id="idbee26a3fa30e4eaf8ec0da33cf5e6dc1"><enum>(i)</enum><text>publish the recommended best practices on the website of the Department of Justice and in the Federal Register; and</text></clause><clause id="id48158D8B60AF4E36AA300FF71B5C08FF"><enum>(ii)</enum><text>submit the recommended best practices to Congress, including to—</text><subclause id="idb8261072edac4649ad34ce805f377d10"><enum>(I)</enum><text>the Committee on the Judiciary and the Committee on Commerce, Science, and Transportation of the Senate; and</text></subclause><subclause id="id4c6c8b2d8da043b5a8eb07c8a26ae78b" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>the Committee on the Judiciary and the Committee on Energy and Commerce of the House of Representatives.</text></subclause></clause></subparagraph></paragraph><paragraph id="idd4a24de9216a47e88ae8c86501d92c7c"><enum>(2)</enum><header>Considerations</header><text>In determining whether to approve or deny recommended best practices under paragraph (1), the Attorney General shall consider—</text><subparagraph id="idA46DE1D525C5422F84315AE2179A7436"><enum>(A)</enum><text>the purpose of the Commission, as set forth in section 3(b); and</text></subparagraph><subparagraph id="id9EB514B1A96D4230AF456D77346121A0"><enum>(B)</enum><text>the relevant considerations set forth in subsection (a)(4) of this section.</text></subparagraph></paragraph><paragraph id="id555B8E607409482C948D97F4631A6D06" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Written findings</header><text>Any denial of the recommended best practices by the Attorney General under paragraph (1) shall be accompanied by public written findings setting forth the basis for, and reasons supporting, the denial.</text></paragraph></subsection><subsection id="id7ed9347ddbb84f4cab9896bd067d2632"><enum>(c)</enum><header>Congressional approval</header><paragraph id="ide3c2a6aae1734ede9e9ad13b0834ee9e"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>covered bill</term> means a bill that—</text><subparagraph id="id5D150F88891D4E85A3E0B71797C75AC9"><enum>(A)</enum><text>contains only the recommended best practices that have been submitted to Congress under subsection (b), in their entirety; and</text></subparagraph><subparagraph id="idCA09B226B26747E5AD9746008B8973CF"><enum>(B)</enum><text>is introduced under paragraph (3) of this subsection.</text></subparagraph></paragraph><paragraph id="idBC7678B175234BFBAC3C10F18B4902F8"><enum>(2)</enum><header>Rules of House of Representatives and Senate</header><text>This subsection is enacted by Congress—</text><subparagraph id="idec6524a284de42f78323b693cf5e0fe3"><enum>(A)</enum><text>as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and as such is deemed a part of the rules of each House, respectively, but applicable only with respect to the procedure to be followed in that House in the case of a covered bill, and it supersedes other rules only to the extent that it is inconsistent with such rules; and</text></subparagraph><subparagraph id="id724f6888d248444486767d82d9023076"><enum>(B)</enum><text>with full recognition of the constitutional right of either House to change the rules (so far as relating to the procedure of that House) in the same manner, and to the same extent, as in the case of any other rule of that House.</text></subparagraph></paragraph><paragraph id="idba90327252d0483fad619638b0b1e469"><enum>(3)</enum><header>Introduction</header><subparagraph id="id6747CE850D8944D1AECED9533218B2AF"><enum>(A)</enum><header>In general</header><text>On the day on which recommended best practices are submitted to Congress under subsection (b), a covered bill containing those best practices shall be introduced—</text><clause id="idAF4BF1A5CB7F47738072FCE0F16E96E9"><enum>(i)</enum><text>in the Senate by—</text><subclause id="id69FE78F73EEB4331968581C752530616"><enum>(I)</enum><text>the majority leader of the Senate, for himself or herself and the minority leader of the Senate; or</text></subclause><subclause id="idD39717D4C2A2430681980B866432D9D5"><enum>(II)</enum><text>Members of the Senate designated by the majority leader and minority leader of the Senate; and</text></subclause></clause><clause id="idEDB059FDC2F0411B837340E2B1CA2541"><enum>(ii)</enum><text>in the House of Representatives by—</text><subclause id="id969287AF87F840CABD0C0526860A1AAC"><enum>(I)</enum><text>the majority leader of the House of Representatives, for himself or herself and the minority leader of the House of the House of Representatives; or</text></subclause><subclause id="id245F7DCEE6CA4E60B4DE6A63564209C3"><enum>(II)</enum><text>Members of the House of Representatives designated by the majority leader and minority leader of the House of the House of Representatives.</text></subclause></clause></subparagraph><subparagraph id="id95F2266D1B174EE9A07E0A6704C0731F"><enum>(B)</enum><header>Not in session</header><text>If either House is not in session on the day on which recommended best practices are submitted to Congress under subsection (b), a covered bill containing the best practices shall be introduced in that House, as provided in subparagraph (A), on the first day thereafter on which that House is in session.</text></subparagraph><subparagraph id="id1FD245F188E74B488DF57CD750E05024"><enum>(C)</enum><header>Referral</header><text>A covered bill introduced under this paragraph shall be referred by the Presiding Officers of the respective Houses to the appropriate committee, or, in the case of a bill containing provisions within the jurisdiction of 2 or more committees, jointly to such committees for consideration of those provisions within their respective jurisdictions.</text></subparagraph></paragraph><paragraph id="idbb84a5e3dfce440aa76181326267655e"><enum>(4)</enum><header>Fast track consideration in House of Representatives</header><subparagraph id="id7b15217325784bea98599d2822e97e78"><enum>(A)</enum><header>Reporting and discharge</header><text>Any committee of the House of Representatives to which a covered bill is referred shall report it to the House not later than 45 calendar days after the date of introduction under paragraph (3). If a committee fails to report the covered bill within that period, the committee shall be discharged from further consideration of the covered bill and the covered bill shall be referred to the appropriate calendar.</text></subparagraph><subparagraph id="id97615e0458ff4018ac7a578f6bced12d"><enum>(B)</enum><header>Proceeding to consideration</header><text>After each committee authorized to consider a covered bill reports it to the House or has been discharged from its consideration, it shall be in order, not later than 60 calendar days after the date of introduction under paragraph (3), to move to proceed to consider the covered bill in the House. All points of order against the motion are waived. Such a motion shall not be in order after the House has disposed of a motion to proceed on the covered bill. The previous question shall be considered as ordered on the motion to its adoption without intervening motion. The motion shall not be debatable. A motion to reconsider the vote by which the motion is disposed of shall not be in order.</text></subparagraph><subparagraph id="id9c1b89db2434463b9d78e10cdaf10407"><enum>(C)</enum><header>Consideration</header><text>The covered bill shall be considered as read. All points of order against the covered bill and against its consideration are waived. The previous question shall be considered as ordered on the covered bill to its passage without intervening motion except 10 hours of debate equally divided and controlled by the proponent and an opponent. A motion to reconsider the vote on passage of the covered bill shall not be in order.</text></subparagraph></paragraph><paragraph id="idf0349167c9d149fab8959a08442c2b63"><enum>(5)</enum><header>Fast track consideration in Senate</header><subparagraph id="idcceaf06a5da44b2690030a3ec73acf0e"><enum>(A)</enum><header>Reporting and discharge</header><text>Any committee of the Senate to which a covered bill is referred shall report it to the Senate not later than 45 calendar days after the date of introduction under paragraph (3). If a committee fails to report the covered bill within that period, the committee shall be discharged from further consideration of the covered bill and the covered bill shall be referred to the appropriate calendar.</text></subparagraph><subparagraph id="idec2d97e467324d929a47731bfa6373f4"><enum>(B)</enum><header>Placement on calendar</header><text>After each committee authorized to consider a covered bill reports it to the Senate or has been discharged from its consideration, it shall be in order, not later than 60 calendar days after the date of introduction under paragraph (3) of this subsection, to place the covered bill on the calendar.</text></subparagraph><subparagraph id="idf354ec0645794a6e90c96339010513f8"><enum>(C)</enum><header>Floor consideration</header><clause id="id3c6c7321402d4e91bf124e03edb1039d"><enum>(i)</enum><header>In general</header><text>Notwithstanding Rule XXII of the Standing Rules of the Senate, it is in order at any time during the period beginning on the 60th day after the date on which the covered bill was introduced under paragraph (3) and ending on the 65th day after the date on which the covered bill was introduced under that paragraph (even though a previous motion to the same effect has been disagreed to) to move to proceed to the consideration of the covered bill, and all points of order against the covered bill (and against consideration of the covered bill) are waived. The motion to proceed is not debatable. The motion is not subject to a motion to postpone. A motion to reconsider the vote by which the motion is agreed to or disagreed to shall not be in order. If a motion to proceed to the consideration of the covered bill is agreed to, the covered bill shall remain the unfinished business until disposed of.</text></clause><clause id="id1a12c5781a9843e8b46871b9ca0ac703"><enum>(ii)</enum><header>Debate</header><text>Debate on the covered bill, and on all debatable motions and appeals in connection therewith, shall be limited to not more than 10 hours, which shall be divided equally between the majority and minority leaders or their designees. A motion further to limit debate is in order and not debatable. An amendment to, or a motion to postpone, or a motion to proceed to the consideration of other business, or a motion to recommit the covered bill is not in order.</text></clause><clause id="id1c2de14d38a24145b72371d843c40faa"><enum>(iii)</enum><header>Vote on passage</header><text>The vote on passage shall occur immediately following the conclusion of the debate on a covered bill, and a single quorum call at the conclusion of the debate if requested in accordance with the rules of the Senate.</text></clause><clause id="id0f05848c98a54b4690c219d268a83351"><enum>(iv)</enum><header>Rulings of the chair on procedure</header><text>Appeals from the decisions of the Chair relating to the application of the rules of the Senate, as the case may be, to the procedure relating to a covered bill shall be decided without debate.</text></clause></subparagraph></paragraph><paragraph id="idb89492ec363d4b1cac9bbbdb22cd63a9"><enum>(6)</enum><header>Rules relating to Senate and House of Representatives</header><subparagraph id="id429fa1a2f3f64a8a9dba09c3e1cfb2b2"><enum>(A)</enum><header>Coordination with action by other House</header><text>If, before the passage by one House of a covered bill of that House, that House receives from the other House a covered bill, then the following procedures shall apply:</text><clause id="id6dce1aa62756442785491a3b036f5694"><enum>(i)</enum><text>The covered bill of the other House shall not be referred to a committee.</text></clause><clause id="idbf5334d35f7e4430b191dedfdaefc653"><enum>(ii)</enum><text>With respect to a covered bill of the House receiving the bill—</text><subclause id="id490ed1427e5246a59e76ad8e7091b92f"><enum>(I)</enum><text>the procedure in that House shall be the same as if no covered bill had been received from the other House; but</text></subclause><subclause id="id55f481d151a143809181f16cbdb65a84"><enum>(II)</enum><text>the vote on passage shall be on the covered bill of the other House.</text></subclause></clause></subparagraph><subparagraph id="id8e43730348e34d6e9549a7499490de4d"><enum>(B)</enum><header>Treatment of covered bill of other House</header><text>If one House fails to introduce or consider a covered bill under this section, the covered bill of the other House shall be entitled to expedited floor procedures under this section.</text></subparagraph><subparagraph id="id99fe7de6adb24f9dada7705f1033c6b6"><enum>(C)</enum><header>Treatment of companion measures</header><text>If, following passage of the covered bill in the Senate, the Senate then receives the companion measure from the House of Representatives, the companion measure shall not be debatable.</text></subparagraph></paragraph></subsection><subsection id="id476ea140f2cf4d1ab4f9aee58f610246"><enum>(d)</enum><header>Certification of best practices</header><text>Not later than 1 year after the date on which a bill that contains recommended best practices submitted to Congress under subsection (b) is enacted under the expedited procedures under subsection (c), and annually thereafter, an officer of a provider of an interactive computer service may submit a written certification to the Attorney General stating that the provider—</text><paragraph id="ida52b39c3684646249c80c6e57a22c1ba"><enum>(1)</enum><text>has conducted a thorough review of the implementation and operation of the best practices; and</text></paragraph><paragraph id="idbf8a175657fd42f6bbb7ee7516ab25d6"><enum>(2)</enum><text>has a reasonable basis to conclude that review does not reveal any material non-compliance with the requirements of the best practices.</text></paragraph></subsection><subsection id="id99baa06571a64dd49ed6ecf71561bf7f"><enum>(e)</enum><header>Publication of certified interactive computer service providers</header><text>The Attorney General shall maintain on the website of the Department of Justice a public list of each provider of an interactive computer service for which a certification has been submitted under subsection (d).</text></subsection><subsection id="id829723C2D3BD429DB6620D9F4BB0477D"><enum>(f)</enum><header>Civil investigative demands</header><paragraph id="id0d1d011a5a664fd4aac735ac5be828d2"><enum>(1)</enum><header>Issuance; service; production of material; testimony</header><subparagraph id="idd67378b8d6ff420d9701b6a4a63e4cbb"><enum>(A)</enum><header>In general</header><text>Whenever the Attorney General has reason to believe that an officer of a provider of an interactive computer service has filed a false certification under subsection (d), the Attorney General may issue in writing, and cause to be served upon the provider, a civil investigative demand requiring the provider to—</text><clause id="idA4D50D7FD32F4777922D8BD7985D6D95"><enum>(i)</enum><text>produce any documentary material relevant to such certification for inspection and copying;</text></clause><clause id="id0B336D3990A2445298B3D43C912BD447"><enum>(ii)</enum><text>answer in writing written interrogatories with respect to such documentary material;</text></clause><clause id="id8AD9043E363442EEA37A4776E6A89EF1"><enum>(iii)</enum><text>give oral testimony concerning such documentary material; or</text></clause><clause id="id55EB2DE6B29B4EB8BEA930BBBD6BEBD3"><enum>(iv)</enum><text>furnish any combination of such material, answers, or testimony.</text></clause></subparagraph><subparagraph id="id379341FB058C42CD9844BFE62550F2B0"><enum>(B)</enum><header>Service</header><text>If a civil investigative demand issued under subparagraph (A) is an express demand for any product of discovery, the Attorney General shall—</text><clause id="id3D96FF65115E42D091E023A758D38159"><enum>(i)</enum><text>cause to be served, in any manner authorized under section 3733 of title 31, United States Code, a copy of the demand upon the person from whom the discovery was obtained; and</text></clause><clause id="idEE3C9217804F45289C03B40327CA3069"><enum>(ii)</enum><text>notify the person to whom the demand is issued of the date on which the copy was served.</text></clause></subparagraph></paragraph><paragraph id="id0c43b1d2de2b4528976f0c79493328ee"><enum>(2)</enum><header>Contents; return date for demand for product of discovery</header><subparagraph id="id35ABFD70D1784369A82DF0B9BBFA3BA5"><enum>(A)</enum><header>In general</header><text>Each civil investigative demand issued under paragraph (1) shall—</text><clause id="id8322991131f445f5998547dff859b9af"><enum>(i)</enum><text>state the nature of the Attorney General’s belief that a false certification has been filed under subsection (d);</text></clause><clause id="id655b46a15079492bb7566c074a2314b6"><enum>(ii)</enum><text>if the demand is for production of documentary material—</text><subclause id="id60478a1ddbe14dcba17f85db91a7ef43"><enum>(I)</enum><text>describe the class or classes of documentary material to be produced thereunder with such definiteness and certainty as to permit such material to be fairly identified;</text></subclause><subclause id="id7db6ccd2c92e40329a2fbef29de963cd"><enum>(II)</enum><text>prescribe a return date or dates that will provide a reasonable period of time within which the material so demanded may be assembled and made available for inspection and copying; and</text></subclause><subclause id="idb8adea5ffab6408a8e5cc6bee4b80708"><enum>(III)</enum><text>identify the custodian to whom the material shall be made available;</text></subclause></clause><clause id="idce004062e2494d0b89e6dcd6fa7addbc"><enum>(iii)</enum><text>if the demand is for answers to written interrogatories—</text><subclause id="id02480db22ea645e7abf5580369cf0b4d"><enum>(I)</enum><text>propound with definiteness and certainty the written interrogatories to be answered;</text></subclause><subclause id="id6e1461e5ba9641cba124db44b9ad4f53"><enum>(II)</enum><text>prescribe a date or dates at which time answers to written interrogatories shall be submitted; and</text></subclause><subclause id="idc10d863ed22e45928d85b43c204dc409"><enum>(III)</enum><text>identify the custodian to whom the answers shall be submitted; and</text></subclause></clause><clause id="id5c2da0999ac7499f80e5697a35d10ee6"><enum>(iv)</enum><text>if the demand is for the giving of oral testimony—</text><subclause id="idb8408d9e9492440c8bc6a92c4293d3fd"><enum>(I)</enum><text>prescribe a date, time, and place at which oral testimony shall be commenced; and</text></subclause><subclause id="id658adbbea47e4b74a232da06ef97b9bf"><enum>(II)</enum><text>identify—</text><item id="id98596B8E91BC4BB18C36303A50BE9604"><enum>(aa)</enum><text>an investigator who shall conduct the examination; and</text></item><item id="id5A171EC185D24D0C889EAF3AE4D43A4C"><enum>(bb)</enum><text>the custodian to whom the transcript of the examination shall be submitted.</text></item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id20a7d7e343fb4ed29f11344852426396"><enum>(B)</enum><header>Return date for product of discovery</header><text>Any civil investigative demand issued under paragraph (1) that is an express demand for any product of discovery shall not be returned or returnable until 20 days after a copy of the demand has been served upon the person from whom the discovery was obtained.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDD21FB72DE95496EAC0EA3BFD81E0AF1"><enum>(3)</enum><header>Applicability of other provisions</header><subparagraph commented="no" display-inline="no-display-inline" id="idECF20A7AEF364CA58A3C2170BDE76B63"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), subsections (b) through (l) of section 3733 of title 31, United States Code, shall apply with respect to a civil investigative demand issued under paragraph (1) of this subsection in the same manner as those subsections apply to a civil investigative demand issued under subsection (a) of such section 3733.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3CB2F1642F8940FD8857C6F7DE6CCC10"><enum>(B)</enum><header>False claims references</header><text>For purposes of subparagraph (A), a reference in section 3733 of title 31, United States Code, to—</text><clause id="idd545e70b6acf40118b04ba6a91a0d248"><enum>(i)</enum><text>a violation of a false claims law shall be deemed to be a reference to the filing of a false certification under subsection (d) of this section;</text></clause><clause id="id8519c5e37e764dda8c22e5a9b20de011"><enum>(ii)</enum><text>a false claims law investigation shall be deemed to be a reference to an inquiry into whether any person is or has been engaged in filing a false certification under subsection (d) of this section; and</text></clause><clause id="id005129196dfa464794c9e326e84650ee"><enum>(iii)</enum><text>a false claims law investigator shall be deemed to be a reference to—</text><subclause id="id629A216C1A9B46BAB57B2CED12DDCB1C"><enum>(I)</enum><text>any attorney or investigator employed by the Department of Justice who is charged with the duty of enforcing or carrying into effect this section; or</text></subclause><subclause id="idE1517209188C4E9FB2A749F1825B3A20"><enum>(II)</enum><text>any officer or employee of the United States acting under the direction and supervision of an attorney or investigator described in subclause (I) in connection with an inquiry into whether any person is or has been engaged in filing a false certification under subsection (d) of this section.</text></subclause></clause></subparagraph></paragraph></subsection></section><section id="idC03B3892664B439384DC9E7266ABBB0E" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>5.</enum><header>Enforcement</header><subsection id="id8A3036506E4C4FE8B6E4F0B914756A86"><enum>(a)</enum><header>Offense</header><text>It shall be unlawful for an officer of a provider of an interactive computer service to knowingly submit a written certification under section 4(d) that contains a false statement.</text></subsection><subsection id="idBF5062BC39C84638B57A27C270D3B7A4"><enum>(b)</enum><header>Criminal penalties</header><text>Any person who violates subsection (a) shall be fined in accordance with title 18, United States Code, imprisoned for not more than 2 years, or both.</text></subsection></section><section id="id883AC49B6FE14C7C97A761CA519C386C" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>6.</enum><header>Earning immunity</header><subsection id="idE79C21ACA3B943C5AEFA7E8647DDAFFD"><enum>(a)</enum><header>In general</header><text>Section 230(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFCA61755305E42878F01DB88FF12A9F9" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><paragraph id="id168ff6ff7c544a42a6ca531d15b7ab10"><enum>(6)</enum><header>No effect on child sexual exploitation law</header><subparagraph id="idA5E8B6813C634BF1A44BA41BD2ECD387"><enum>(A)</enum><header>Liability of providers of interactive computer service</header><text>Nothing in this section (other than subsection (c)(2)(A)) shall be construed to impair or limit—</text><clause id="id8da1eb0c4d914f19b5c0c62a6452e62d"><enum>(i)</enum><text>any claim in a civil action brought against a provider of an interactive computer service under section 2255 of title 18, United States Code, if the conduct underlying the claim—</text><subclause id="id3A9F755CC6B6457BBFB097A43B6840AE"><enum>(I)</enum><text>constitutes a violation of section 2252 or section 2252A of that title; or</text></subclause><subclause id="id1F102267C47E40CBB280271476B43843"><enum>(II)</enum><text>is considered a violation of section 2252 or section 2252A of that title by operation of subsection (a)(2) of such section 2255;</text></subclause></clause><clause id="id75a863e66b8143baadf365dee4b5fb4e"><enum>(ii)</enum><text>any charge in a criminal prosecution brought against a provider of an interactive computer service under State law if the conduct underlying the charge would constitute a violation of section 2252 or section 2252A of title 18, United States Code; or</text></clause><clause id="id89bc15ccd741423f8b3fcc2d5c5ead45"><enum>(iii)</enum><text>any claim in a civil action brought against a provider of an interactive computer service under State law if the conduct underlying the claim—</text><subclause id="idA80B2F24DCFF4B13A5C4DC6E0FF2636E"><enum>(I)</enum><text>would constitute a violation of section 2252 or section 2252A of title 18, United States Code; or</text></subclause><subclause id="id0DC986A21F7E4C3EBE09B9B7924ECC2F"><enum>(II)</enum><text>would be considered a violation of section 2252 or section 2252A of title 18, United States Code, for purposes of subsection (a)(1) of section 2255 of that title, by operation of subsection (a)(2) of such section 2255.</text></subclause></clause></subparagraph><subparagraph id="idbcc0ec931a1f465aad0627fc392a3949"><enum>(B)</enum><header>Safe harbor</header><text>Subparagraph (A) shall not apply to a claim in a civil action or charge in a State criminal prosecution brought against a provider of an interactive computer service if—</text><clause id="id2367eef261ba4f419b3b5718cd091386"><enum>(i)</enum><text>an officer of the provider has elected to certify to the Attorney General under section 4(d) of the <short-title>Eliminating Abusive and Rampant Neglect of Interactive Technologies Act of 2020</short-title> that the provider has implemented, and is in compliance with, the child sexual exploitation prevention best practices contained in a law enacted under the expedited procedures under section 4(c) of such Act and such certification was in force at the time of any alleged acts or omissions that are the subject of a claim in a civil action or charge in a State criminal prosecution brought against such provider; or</text></clause><clause id="id57febb33ef7f43b581499ea74c6b8f92"><enum>(ii)</enum><text>the provider has implemented reasonable measures relating to the matters described in section 4(a)(3) of the <short-title>Eliminating Abusive and Rampant Neglect of Interactive Technologies Act of 2020</short-title>, subject to the exceptions authorized under section 4(a)(1)(B)(ii) of that Act, to prevent the use of the interactive computer service for the exploitation of minors.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id57C68D56207A44D99AD6A3CCE30E5D49"><enum>(b)</enum><header>Mens rea for civil suits</header><text>Section 2255 of title 18, United States Code, is amended—</text><paragraph id="id927FA5568ACF44DF8B1DC706D5DDE529"><enum>(1)</enum><text>by redesignating subsection (a) as paragraph (1) and adjusting the margin accordingly;</text></paragraph><paragraph id="id76E4280B4E5D49AAB548EFD5D1C55919"><enum>(2)</enum><text>by inserting before paragraph (1), as so designated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE02835ED4C474B04A68DCB3FB64E133A" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><subsection id="id48198E70241B41E6B81BBDFF047DC03A"><enum>(a)</enum><header>Right of action</header></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id0FC6038C994F4FA880049E070241E792"><enum>(3)</enum><text>in subsection (a), as so designated, by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id059F52E2BAFB4749A41F9638DDF06F25" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><paragraph id="id3747ADD651154D2B8C0BFE1667765242"><enum>(2)</enum><header>Civil remedy for certain activities relating to material involving the sexual exploitation of minors</header><text>Conduct by a provider of an interactive computer service (as defined in section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>)) that would violate section 2252 or section 2252A if that section were applied by substituting <quote>recklessly</quote> for <quote>knowingly</quote> each place that term appears shall be considered a violation of section 2252 or section 2252A for purposes of paragraph (1) of this subsection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idfa0adf60be5148bc930ad69e080154d5"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall—</text><paragraph id="idaf725f59e46a45d29b01f647271a86c0"><enum>(1)</enum><text>take effect on the earlier of—</text><subparagraph id="id8f7734d545bf4d7d9a0b284dd408df2f"><enum>(A)</enum><text>the date that is 1 year after the date on which a bill that contains best practices submitted under section 4(b) is enacted under the expedited procedures under section 4(c); or</text></subparagraph><subparagraph id="id99e305ed6ffc42d4977cce6f68aa8edd"><enum>(B)</enum><text>the date that is 4 years after the date of enactment of this Act; and</text></subparagraph></paragraph><paragraph id="id62456e0ce84e4d9781744041b2d93203"><enum>(2)</enum><text>only apply to a claim in a civil action or charge in a criminal prosecution brought against a provider of an interactive computer service if the alleged acts or omissions occurred after the effective date described in paragraph (1).</text></paragraph></subsection></section><section id="id3d18d33ea69d481eb1b04759c06d097c" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>7.</enum><header>Use of term <quote>child sexual abuse material</quote></header><subsection id="id966667AAE88A4594AF9D6020AA31047B"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the term <term>child sexual abuse material</term> has the same legal meaning as the term <term>child pornography</term>, as that term was used in Federal statutes and case law before the date of enactment of this Act.</text></subsection><subsection id="id5a6ede4b281040df8ba1a0e0ed4d31e1"><enum>(b)</enum><header>Amendments</header><paragraph id="id1DD9E9758BC044399C74606C40DD11F2"><enum>(1)</enum><header>Title 5, United States Code</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/65">Chapter 65</external-xref> of title 5, United States Code, is amended—</text><subparagraph id="id65AA0480BEED4148AFCE5D4E3D341747"><enum>(A)</enum><text display-inline="yes-display-inline">in section 6502(a)(2)(B), by striking <quote>child pornography</quote> and inserting <quote>child sexual abuse material</quote>; the online sexual exploitation of children.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause id="id818D5B919F37485FA1F937CE87E2EBF1"><enum>(ii)</enum><text>in paragraph (2)—</text><subclause id="id1FAE793CCAC24B11BA8D6BFAEBE55B86"><enum>(I)</enum><text>by inserting <quote>(A)</quote> after <quote>CyberTipline</quote>.</text></subparagraph></paragraph></section><section id="iddcf0aa6eaad44257ae3abffc78d92a04" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>9.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall be construed to require a provider of an interactive computer service to search, screen, or scan for instances of online child sexual exploitation.</text></section><section id="id69D741F7F6624674BB17DD3391170BF5" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>10.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out this Act.</text></section><section id="id15740B9FC86D474AA914881D6FCD399E" changed="deleted" reported-display-style="strikethrough" committee-id="SSJU00"><enum>11.</enum><header>Severability</header><text display-inline="no-display-inline"> If any provision of this Act or any amendment made by this Act, or any application of such provision or amendment to any person or circumstance, is held to be unconstitutional, the remainder of the provisions of this Act and the amendments made by this Act, and the application of the provision or amendment to any other person or circumstance, shall not be affected.</text></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="idbbfb854b-87cf-4489-9d22-abe8d04ae61c" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eliminating Abusive and Rampant Neglect of Interactive Technologies Act of 2020</short-title></quote> or the <quote><short-title>EARN IT Act of 2020</short-title></quote>.</text></section><section id="id622a4934-1c45-4320-b369-f1bec1e0172a" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id45a7bfff-ebf9-4e7f-b741-efaac1afeba6"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the National Commission on Online Child Sexual Exploitation Prevention.</text></paragraph><paragraph id="id5968d884-6a41-4d1e-815e-4d2c1578a5ea"><enum>(2)</enum><header>Interactive computer service</header><text>The term <term>interactive computer service</term> has the meaning given the term in section 230(f)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)(2)</external-xref>).</text></paragraph></section><section id="id52aba31a-2e7d-4732-bb5d-af2f10e7f4e3" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>3.</enum><header>National Commission on Online Child Sexual Exploitation Prevention</header><subsection id="id2ce7ed39-2504-4d9b-a4fd-52e2da437c96"><enum>(a)</enum><header>Establishment</header><text>There is established a National Commission on Online Child Sexual Exploitation Prevention.</text></subsection><subsection id="idcedeaeae-2c95-40a0-aacf-d4f17f3a7c7d"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Commission is to develop recommended best practices that providers of interactive computer services may choose to implement to prevent, reduce, and respond to the online sexual exploitation of children, including the enticement, grooming, sex trafficking, and sexual abuse of children and the proliferation of online child sexual abuse material.</text></subsection><subsection id="idde9386d0-36ea-45de-8e18-43c057398cdb"><enum>(c)</enum><header>Membership</header><paragraph id="id89be9062-6b5b-4989-bacb-8800b23d3b4d"><enum>(1)</enum><header>Composition</header><subparagraph id="idb4f4946a-efc6-4d5b-bf18-ee80c2f53087"><enum>(A)</enum><header>In general</header><text>The Commission shall be composed of 19 members.</text></subparagraph><subparagraph id="idc43de653-4fe1-48df-b34b-6e1497fb6617"><enum>(B)</enum><header>Agency heads</header><text>The following Federal officials shall serve as members of the Commission:</text><clause id="id08bc0d3c-72fb-45df-99f0-5f7fe2a46ebb"><enum>(i)</enum><text>The Attorney General or his or her representative.</text></clause><clause id="id7134c019-10cd-4edd-a824-baa8c79ae161"><enum>(ii)</enum><text>The Secretary of Homeland Security or his or her representative.</text></clause><clause id="id0b00527b-c0c1-4b2b-8b8c-a52a739af667"><enum>(iii)</enum><text>The Chairman of the Federal Trade Commission or his or her representative.</text></clause></subparagraph><subparagraph id="id19b89524-e993-4944-aab7-c3fc164150ad"><enum>(C)</enum><header>Other members</header><text>Of the remaining 16 members of the Commission—</text><clause id="id5c56f2ac-163e-4b3d-ae61-179467b66127"><enum>(i)</enum><text>4 shall be appointed by the majority leader of the Senate, of whom—</text><subclause id="idde12eb03-0ece-487b-84db-fc73fe36e35e"><enum>(I)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(A);</text></subclause><subclause id="ide51b8a6e-841a-46db-bfdf-79b2286e55ad"><enum>(II)</enum><text>1 shall have the qualifications required under paragraph (2)(B);</text></subclause><subclause id="id9b4b537a-b6f9-495e-8971-d08e9a392e29"><enum>(III)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(C); and</text></subclause><subclause id="idb26e745e-18bf-4919-bb20-973f0e6e63e6"><enum>(IV)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(D);</text></subclause></clause><clause id="id033c2db9-8b6f-42f3-90c2-78947a236b86"><enum>(ii)</enum><text>4 shall be appointed by the minority leader of the Senate, of whom—</text><subclause id="id37c8c833-44af-40f3-b420-6039bf9ab4f0"><enum>(I)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(A);</text></subclause><subclause id="id3f77c613-32fb-4348-91e4-c4cb9ddd308a"><enum>(II)</enum><text>1 shall have the qualifications required under paragraph (2)(B);</text></subclause><subclause id="id3b9d30f6-abed-4bb7-b58c-b10932776997"><enum>(III)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(C); and</text></subclause><subclause id="ideb856b59-ace5-46c9-81b1-d56cf27520f5" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(D);</text></subclause></clause><clause id="idd948a994-a416-4644-8dc2-76ac7c267d80"><enum>(iii)</enum><text>4 shall be appointed by the Speaker of the House of Representatives, of whom—</text><subclause id="id5704e010-38a4-42fc-bbce-473bbc3ff263"><enum>(I)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(A);</text></subclause><subclause id="id6af124d3-dfd3-4827-8a08-8e167620b89c"><enum>(II)</enum><text>1 shall have the qualifications required under paragraph (2)(B);</text></subclause><subclause id="idefd34a9d-8ca9-4c06-af7f-e459a46558c9"><enum>(III)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(C); and</text></subclause><subclause id="idc2e8ea3b-c33a-4abd-bff1-0cd341dc6dba" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(D); and</text></subclause></clause><clause id="id1fb75706-3511-40e6-a7a7-ccc5627c4cf3"><enum>(iv)</enum><text>4 shall be appointed by the minority leader of the House of Representatives, of whom—</text><subclause id="id3fe2340b-a915-452c-9d4a-eb1cef42bba9"><enum>(I)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(A);</text></subclause><subclause id="id520bbc70-32de-449b-9bfb-8f1d02d367bf"><enum>(II)</enum><text>1 shall have the qualifications required under paragraph (2)(B);</text></subclause><subclause id="id894b4282-30b6-4aa9-a64a-ad9297245340"><enum>(III)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(C); and</text></subclause><subclause id="idd18d114b-11b8-4419-ac26-9d810ed1e228" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text>1 shall have the qualifications required under clause (i) or (ii) of paragraph (2)(D).</text></subclause></clause></subparagraph></paragraph><paragraph id="id4881cbcd-1fd3-4979-9205-a60fdf16d090"><enum>(2)</enum><header>Qualifications</header><text>Of the 16 members of the Commission appointed under paragraph (1)(C)—</text><subparagraph id="ide7e44a83-7b7a-46eb-aba9-cef71ed21a4f"><enum>(A)</enum><text>4 shall have current experience in investigating online child sexual exploitation crimes, of whom—</text><clause id="id13433a65-9cc5-444b-8530-2350e18ab7ee"><enum>(i)</enum><text>2 shall have such experience in a law enforcement capacity; and</text></clause><clause id="ide5ef7962-6cce-40fd-8a9f-2bc49e60e226"><enum>(ii)</enum><text>2 shall have such experience in a prosecutorial capacity;</text></clause></subparagraph><subparagraph id="idba64a99c-3ab3-463c-8348-035fa314ca43"><enum>(B)</enum><text>4 shall be survivors of online child sexual exploitation, or have current experience in providing services for victims of online child sexual exploitation in a non-governmental capacity;</text></subparagraph><subparagraph id="iddc1f1f74-07bf-4b65-a564-f5df4c3c16b8"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id77263b46-9f8b-401b-ba07-f5ef1074affa"><enum>(i)</enum><text>2 shall have current experience in matters related to consumer protection, civil liberties, civil rights, or privacy; and</text></clause><clause id="idc95b31f8-184f-4871-b93c-6aaf68f1cf2f" indent="up1"><enum>(ii)</enum><text>2 shall have current experience in computer science or software engineering related to matters of cryptography, data security, or artificial intelligence in a non-governmental capacity; and</text></clause></subparagraph><subparagraph id="idb4609a56-a8e5-4850-9ba8-ee2bf3b267d4"><enum>(D)</enum><text>4 shall be individuals who each currently work for an interactive computer service that is unrelated to each other interactive computer service represented under this subparagraph, representing diverse types of businesses and areas of professional expertise, of whom—</text><clause id="id71a2ae05-2f76-45db-aebc-f2f96d73813c"><enum>(i)</enum><text>2 shall have current experience in addressing online child sexual exploitation and promoting child safety at an interactive computer service with not less than 30,000,000 monthly users in the United States; and</text></clause><clause id="id945b1b26-e666-4a1e-bec7-4b9dd5fe7ca5"><enum>(ii)</enum><text>2 shall have current experience in addressing online child sexual exploitation and promoting child safety at an interactive computer service with less than 10,000,000 monthly users in the United States.</text></clause></subparagraph></paragraph><paragraph id="idfa62526d-02f9-4ff9-8c01-65db4040606c"><enum>(3)</enum><header>Date</header><text>The initial appointments of members to the Commission under paragraph (1)(C) shall be made not later than 90 days after the date of enactment of this Act.</text></paragraph></subsection><subsection id="id199c5238-79f9-4a76-a711-42c747af3373"><enum>(d)</enum><header>Period of appointment; vacancies</header><paragraph id="id679497ed-ab80-4999-a57a-0d0171f852b2"><enum>(1)</enum><header>Period of appointment</header><text>A member of the Commission shall be appointed for a term of 5 years.</text></paragraph><paragraph id="ida7905a5e-7868-4a1d-ba15-ad3f6646ae12"><enum>(2)</enum><header>Vacancies</header><subparagraph id="idc0875233-e550-44ae-8c3e-bec85587d8a3"><enum>(A)</enum><header>Effect on Commission</header><text>Any vacancy in the Commission shall not affect the powers of the Commission.</text></subparagraph><subparagraph id="ida0d11fc9-baac-4df9-b189-7260d3c32203"><enum>(B)</enum><header>Filling of vacancies</header><text>A vacancy in the Commission shall be filled in the same manner as the original appointment under subsection (c)(1).</text></subparagraph></paragraph></subsection><subsection id="idf8ebabf3-b96a-4d7f-891c-48cd9c2a0d37"><enum>(e)</enum><header>Initial meeting</header><text>The Commission shall hold the first meeting of the Commission not later than 60 days after the date on which a majority of the members of the Commission have been appointed.</text></subsection><subsection id="id09f3cdce-8c29-4567-80c8-f8de59c41f36"><enum>(f)</enum><header>Chairperson</header><text>The Attorney General or his or her representative shall serve as the Chairperson of the Commission.</text></subsection><subsection id="id95de7698-7378-48b1-a390-dc13b8702eb4"><enum>(g)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number of members may hold a meeting.</text></subsection><subsection id="idf8afa821-bc72-4086-8633-8e135b755961"><enum>(h)</enum><header>Meetings</header><text>The Commission shall meet at the call of the Chairperson.</text></subsection><subsection id="idf3c9f63a-6940-4281-b64c-b765c073e00f"><enum>(i)</enum><header>Authority of Commission</header><text>The Commission may, for the purpose of carrying out this section and section 4, hold such hearings, sit and act at such times and places, take such testimony, and receive such evidence as the Commission considers appropriate.</text></subsection><subsection id="id4691d461-a509-42c5-b789-e8c2961e6a11"><enum>(j)</enum><header>Information from Federal agencies</header><paragraph id="id81ae1537-b274-4b82-aea6-20f37cc989ed"><enum>(1)</enum><header>In general</header><text>The Commission may secure directly from any Federal department or agency such information as the Commission considers necessary to carry out this section and section 4.</text></paragraph><paragraph id="id584ee815-2ecf-4011-b276-a762ff4fb0ff"><enum>(2)</enum><header>Furnishing information</header><text>Upon request of the Chairperson of the Commission for information under paragraph (1), the head of a Federal department or agency shall furnish the information to the Commission, unless the information is subject to an active investigation or otherwise privileged or confidential.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd82840cc-0380-455d-aa1e-854597837f3a"><enum>(k)</enum><header>Travel expenses</header><text>A member of the Commission shall serve without compensation, but shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the home or regular places of business of the member in the performance of services for the Commission.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id420296b4-2dc3-4e3d-9d3a-e567d1c4df7d"><enum>(l)</enum><header>Duration</header><text>Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission.</text></subsection></section><section id="id0f7a18e1-32e8-497d-b368-c37678a3cb84" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>4.</enum><header>Duties of the Commission</header><subsection id="ide7db6c0b-784f-496f-ad36-b56c30c0e7b1"><enum>(a)</enum><header>Recommended best practices</header><paragraph id="idbd04cef8-08e4-42e8-a1a1-1d0e3274b22c"><enum>(1)</enum><header>Initial recommendations</header><subparagraph id="id5b9c4519-a82a-4d7e-b1e1-e0bcce2fbe7d"><enum>(A)</enum><header>In general</header><text>Not later than 18 months after the date on which a majority of the members of the Commission required to be appointed under section 3(c)(1)(C) have been so appointed, the Commission shall develop and submit to the Attorney General recommended best practices that providers of interactive computer services may choose to engage in to prevent, reduce, and respond to the online sexual exploitation of children, including the enticement, grooming, sex trafficking, and sexual abuse of children and the proliferation of online child sexual abuse material.</text></subparagraph><subparagraph id="id7b912d17-d96a-451a-a7cc-d020ea7cd6ee"><enum>(B)</enum><header>Requirements</header><clause id="id482a73b0-9330-4565-a877-d656ce95c577"><enum>(i)</enum><header>Alternative best practices</header><text>The best practices required to be developed and submitted under subparagraph (A) shall include alternatives that take into consideration—</text><subclause id="idf882a2cb-c11e-4917-85b3-207a29744536"><enum>(I)</enum><text>the size, type of product, and business model of a provider of an interactive computer service;</text></subclause><subclause id="id5c52878c-39fe-4dfa-9759-3a6fcb3011ea"><enum>(II)</enum><text>whether an interactive computer service—</text><item id="id26414086-8405-445c-8fba-1b04b50a68d4"><enum>(aa)</enum><text>is made available to the public;</text></item><item id="id910b48e14a8b4c68aa47756b735e9049"><enum>(bb)</enum><text>is primarily responsible for hosting, storage, display, and retrieval of information on behalf of third parties, including providers of other interactive computer services; or</text></item><item id="idfe686a14-5b4d-41ec-9f45-faf73c225736"><enum>(cc)</enum><text>provides the capability to transmit data to and receive data from all or substantially all internet endpoints on behalf of a consumer; and</text></item></subclause><subclause id="id0ad3987d-b9d4-417f-ba54-fc1965af5f97"><enum>(III)</enum><text>whether a type of product, business model, product design, or other factors related to the provision of an interactive computer service could make a product or service susceptible to the use and facilitation of online child sexual exploitation.</text></subclause></clause><clause id="id7892f850-9df3-4306-86a4-968bcffd7440"><enum>(ii)</enum><header>Scope</header><text>Notwithstanding paragraph (3), the alternatives described in clause (i) of this subparagraph may exclude certain matters required to be addressed under paragraph (3), as the Commission determines appropriate based on the nature of particular products or services, the factors described in such clause (i), or other factors relevant to the purposes of this Act.</text></clause></subparagraph></paragraph><paragraph id="ide6732644-df71-4194-9f15-b6af16c716c2"><enum>(2)</enum><header>Support requirement</header><text>The Commission may only recommend the best practices under paragraph (1) if not fewer than 14 members of the Commission support the best practices.</text></paragraph><paragraph id="id1cf297ee-c737-442c-9fa0-1cecaf4c6112"><enum>(3)</enum><header>Matters addressed</header><text>The matters addressed by the recommended best practices developed and submitted by the Commission under paragraph (1) shall include—</text><subparagraph id="id293a7ddc-0a9c-4c64-b965-5d8e2ce022c0"><enum>(A)</enum><text>preventing, identifying, disrupting, and reporting online child sexual exploitation;</text></subparagraph><subparagraph id="id104ae892-710c-42d5-bf74-c2bb33e23033"><enum>(B)</enum><text>coordinating with non-profit organizations and other providers of interactive computer services to preserve, remove from view, and report online child sexual exploitation;</text></subparagraph><subparagraph id="id6f303930-579b-40e0-8753-52ec39825354"><enum>(C)</enum><text>retaining child sexual exploitation content and related user identification and location data;</text></subparagraph><subparagraph id="ida72b0ddb-1e79-4eef-871f-185f1d0a1d0f"><enum>(D)</enum><text>receiving and triaging reports of online child sexual exploitation by users of interactive computer services, including self-reporting;</text></subparagraph><subparagraph id="ida08eed5e-c626-41c4-8f7c-4b113f116357"><enum>(E)</enum><text>implementing a standard rating and categorization system to identify the type and severity of child sexual abuse material;</text></subparagraph><subparagraph id="id5fd50477-088b-4184-8d1b-5083042fddc8"><enum>(F)</enum><text>training and supporting content moderators who review child sexual exploitation content for the purposes of preventing and disrupting online child sexual exploitation;</text></subparagraph><subparagraph id="id12892336-f929-4bd2-90e2-6889b7b2b8e1"><enum>(G)</enum><text>preparing and issuing transparency reports, including disclosures in terms of service, relating to identifying, categorizing, and reporting online child sexual exploitation and efforts to prevent and disrupt online child sexual exploitation;</text></subparagraph><subparagraph id="iddef831dd-f636-49d1-b441-f99eed5e5794"><enum>(H)</enum><text>coordinating with voluntary initiatives offered among and to providers of interactive computer services relating to identifying, categorizing, and reporting online child sexual exploitation;</text></subparagraph><subparagraph id="idf86fecef-19f4-4c24-bb55-d6adcdfa7fc3"><enum>(I)</enum><text>employing age rating and age gating systems to reduce online child sexual exploitation;</text></subparagraph><subparagraph id="id49232224-3626-4eeb-90e7-907c4920c95a"><enum>(J)</enum><text>offering parental control products that enable customers to limit the types of websites, social media platforms, and internet content that are accessible to children; and</text></subparagraph><subparagraph id="idf55d52bb-61e7-497b-95f1-a9553af9d768"><enum>(K)</enum><text>contractual and operational practices to ensure third parties, contractors, and affiliates comply with the best practices.</text></subparagraph></paragraph><paragraph id="id018ab090-0083-41db-8328-430829f71863"><enum>(4)</enum><header>Relevant considerations</header><text>In developing best practices under paragraph (1), the Commission shall consider—</text><subparagraph id="id77679c2b-2856-4e6f-910b-b7cf782385f4"><enum>(A)</enum><text>the cost and technical limitations of implementing the best practices;</text></subparagraph><subparagraph id="id70f4dd40-958d-4fed-8b97-fbfb432b2f9d"><enum>(B)</enum><text>the impact on competition, product and service quality, data security, and privacy;</text></subparagraph><subparagraph id="idf6b24c9b-6c0d-47f7-9200-643cfff20ba2"><enum>(C)</enum><text>the impact on the ability of law enforcement agencies to investigate and prosecute child sexual exploitation and rescue victims; and</text></subparagraph><subparagraph id="id197afe02-1710-4ba4-af1d-5af95ecc3c4a"><enum>(D)</enum><text>the current state of technology.</text></subparagraph></paragraph><paragraph id="ide7c24d82-18b7-4b8c-a563-94c9e9d26bba"><enum>(5)</enum><header>Periodic updates</header><text>Not less frequently than once every 5 years, the Commission shall update and resubmit to the Attorney General recommended best practices under paragraph (1).</text></paragraph></subsection><subsection id="id5e5dc9cc-c013-4c75-8933-676bfa322d29"><enum>(b)</enum><header>Publication of best practices</header><text>Not later than 30 days after the date on which the Commission submits recommended best practices under subsection (a), including updated recommended best practices under paragraph (5) of that subsection, the Attorney General shall publish the recommended best practices on the website of the Department of Justice and in the Federal Register.</text></subsection></section><section id="id762b3f8f-afdf-49d7-bcf0-5b6a95d6afa6" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>5.</enum><header>Protecting victims of online child sexual abuse</header><text display-inline="no-display-inline"> Section 230(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(e)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id7c260d15-5eb2-4ab8-9796-3b2892bfc75a" changed="added" reported-display-style="italic" committee-id="SSJU00"><paragraph id="id18d8db2e-94ff-41fe-b686-b1905f8620c1"><enum>(6)</enum><header>No effect on child sexual exploitation law</header><text>Nothing in this section (other than subsection (c)(2)(A)) shall be construed to impair or limit—</text><subparagraph id="id8a9d642b-815f-4a04-a803-c3e6e827326c"><enum>(A)</enum><text>any claim in a civil action brought against a provider of an interactive computer service under section 2255 of title 18, United States Code, if the conduct underlying the claim constitutes a violation of section 2252 or section 2252A of that title; </text></subparagraph><subparagraph id="id60c16a49-bea9-4317-8531-794bd61d12d1"><enum>(B)</enum><text>any charge in a criminal prosecution brought against a provider of an interactive computer service under State law regarding the advertisement, promotion, presentation, distribution, or solicitation of child sexual abuse material, as defined in section 2256(8) of title 18, United States Code; or </text></subparagraph><subparagraph id="id292c8861-0988-487d-aece-055c7414b424"><enum>(C)</enum><text>any claim in a civil action brought against a provider of an interactive computer service under State law regarding the advertisement, promotion, presentation, distribution, or solicitation of child sexual abuse material, as defined in section 2256(8) of title 18, United States Code.</text></subparagraph></paragraph><paragraph id="id64b93b3a1a2546a291369bc03bf8ad53"><enum>(7)</enum><header>Cybersecurity protections do not give rise to liability</header><text>Notwithstanding paragraph (6), a provider of an interactive computer service shall not be deemed to be in violation of section 2252 or 2252A of title 18, United States Code, for the purposes of subparagraph (A) of such paragraph (6), and shall not otherwise be subject to any charge in a criminal prosecution under State law under subparagraph (B) of such paragraph (6), or any claim in a civil action under State law under subparagraph (C) of such paragraph (6), because the provider—</text><subparagraph id="id4BD2E99D35DB416490100EB91F0A4710"><enum>(A)</enum><text>utilizes full end-to-end encrypted messaging services, device encryption, or other encryption services;</text></subparagraph><subparagraph id="id4dacbb16bac042a39c261f2a2b531e06"><enum>(B)</enum><text>does not possess the information necessary to decrypt a communication; or</text></subparagraph><subparagraph id="id2C140922BBF94602BA2FD7042832D9C7"><enum>(C)</enum><text>fails to take an action that would otherwise undermine the ability of the provider to offer full end-to-end encrypted messaging services, device encryption, or other encryption services.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idb768d9ce-5e4f-4cc3-98d3-833bf59ed6de" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>6.</enum><header>Use of term <quote>child sexual abuse material</quote></header><subsection id="idee7aa098-8c84-47d2-b928-5f91469e5e9c"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the term <term>child sexual abuse material</term> has the same legal meaning as the term <term>child pornography</term>, as that term was used in Federal statutes and case law before the date of enactment of this Act.</text></subsection><subsection id="id9a7f04c8-91b4-4084-adde-a1083be7cc79"><enum>(b)</enum><header>Amendments</header><paragraph id="id74553a91-0089-4190-aab1-f6097f7c8f24"><enum>(1)</enum><header>Title 5, United States Code</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/65">Chapter 65</external-xref> of title 5, United States Code, is amended—</text><subparagraph id="id5eead8c8-acf5-493c-8947-3e3bd0d8b4ef"><enum>(A)</enum><text display-inline="yes-display-inline">in section 6502(a)(2)(B), by striking <quote>child pornography</quote> and inserting <quote>child sexual abuse material</quote>; and</text></subparagraph><subparagraph id="id83b70050-f33b-44d8-804d-85067daa887b"><enum>(B)</enum><text display-inline="yes-display-inline">in section 6504(c)(2)(F), by striking <quote>child pornography</quote> and inserting <quote>child sexual abuse material</quote>.</text></subparagraph></paragraph><paragraph id="id651cb7ed-bb76-4eea-a07f-63947d269674"><enum>(2)</enum><header>Homeland Security Act of 2002</header><text display-inline="yes-display-inline">The Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref> et seq.) is amended—</text><subparagraph id="id23fd90a2-650c-4a11-9e12-12ac46d17f21"><enum>(A)</enum><text display-inline="yes-display-inline">in section 307(b)(3)(D) (<external-xref legal-doc="usc" parsable-cite="usc/6/187">6 U.S.C. 187(b)(3)(D)</external-xref>), by striking <quote>child pornography</quote> and inserting <quote>child sexual abuse material</quote>; and</text></subparagraph><subparagraph id="ida08d1cb5-09b3-41be-8a3d-cbcd285c8843"><enum>(B)</enum><text display-inline="yes-display-inline">in section 890A (<external-xref legal-doc="usc" parsable-cite="usc/6/473">6 U.S.C. 473</external-xref>)—</text><clause id="idf331f2b8-37d1-46a2-b4a9-de28c1746608"><enum>(i)</enum><text>in subsection (b)(2)(A)(ii), by striking <quote>child pornography</quote> and inserting <quote>child sexual abuse material</quote>;  for which any person can be charged with a criminal offense.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idf28f350e-f553-4b42-b7f0-6e936f69817f" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>7.</enum><header>Modernizing the CyberTipline</header><subsection id="idB515F6794ABF41D4B5129161E6EC24A7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States Code, is amended—</text><paragraph id="idf07ef8e9-a763-4ea0-a1c6-3981345865a9"><enum>(1)</enum><text>in section 2258A—</text><subparagraph id="id374c2d9c-3870-414f-a2ef-6ca7c547121c"><enum>(A)</enum><text>in subsection (a)—</text><clause id="id1ce91f37-9c2d-4518-906c-60cf171e7185"><enum>(i)</enum><text>in paragraph (1)(B)(ii), by inserting after <quote>facts or circumstances</quote> the following: <quote>, including any available facts or circumstances sufficient to identify and locate each minor and each involved individual,</quote>; and</text></clause><clause id="id07ed76ba-46c7-4325-a823-798a0407dcff"><enum>(ii)</enum><text> in paragraph (2)(A)—</text><subclause id="id2419ce45-ebc0-4515-8aa3-39f164cd773a"><enum>(I)</enum><text>by inserting <quote>1591 (if the violation involves a minor),</quote> before <quote>2251,</quote>; and</text></subclause><subclause id="idc7fd9e86-234d-4b4e-b063-cfb9d1921774"><enum>(II)</enum><text> by striking <quote>or 2260</quote> and inserting <quote>2260, or 2422(b)</quote>;</text></subclause></clause></subparagraph><subparagraph id="id550b1670-8465-4059-a90e-4951070da6a4"><enum>(B)</enum><text>in subsection (b)—</text><clause id="id0c5b7d8a-f347-4c44-8651-26b408045285"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="id1d1e3caf-8fec-472d-a4db-1eb6738b6b8b"><enum>(I)</enum><text>by inserting <quote>or location</quote> after <quote>identity</quote>; and</text></subclause><subclause id="idef07c4d2-0e91-41a4-b799-7e4b28b44978"><enum>(II)</enum><text>by striking <quote>other identifying information,</quote> and inserting <quote>other information which may identify or locate the involved individual,</quote>;</text></subclause></clause><clause id="ida4cfb396-78b7-4342-bab3-ff4223c84923"><enum>(ii)</enum><text>by redesignating paragraphs (2) through (5) as paragraphs (3) through (6), respectively;</text></clause><clause id="id7df12831-9e40-4cc7-b295-6ea7a0eaf9be"><enum>(iii)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8f5578e7-e750-46a7-a429-e98915a733ea" changed="added" reported-display-style="italic" committee-id="SSJU00"><paragraph id="id322db3bc-19ff-44e1-ab93-9d89e5d25309"><enum>(2)</enum><header>Information about the involved minor</header><text>Information relating to the identity or location of any involved minor, which may, to the extent reasonably practicable, include the electronic mail address, Internet Protocol address, uniform resource locator, or any other information which may identify or locate any involved minor, including self-reported identifying information.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idf4bcfec9-7c32-4700-bbc9-647a6f6d6e08"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb2e0888c-560e-40ea-a0a5-b23ba96ad504" changed="added" reported-display-style="italic" committee-id="SSJU00"><paragraph id="id494fb287-1022-46eb-a083-37617557748c"><enum>(7)</enum><header>Formatting of reports</header><text>When in its discretion a provider voluntarily includes any content described in this subsection in a report to the CyberTipline, the provider shall use best efforts to ensure that the report conforms with the structure of the CyberTipline.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id764409cb-f45d-4d44-af9d-f39751a5485c"><enum>(C)</enum><text>in subsection (d)(5)(B)—</text><clause id="id030dcaba-3398-4e8f-9ffc-c09f850758ec"><enum>(i)</enum><text>in clause (i), by striking <quote>forwarded</quote> and inserting <quote>made available</quote>; and</text></clause><clause id="id72a51e5b-dd0b-4a5b-a757-e1e395d03cd4"><enum>(ii)</enum><text>in clause (ii), by striking <quote>forwarded</quote> and inserting <quote>made available</quote>;</text></clause></subparagraph></paragraph><paragraph id="id312c857f-ad0c-4683-8f1b-8e5987b112ff"><enum>(2)</enum><text>in section 2258B—</text><subparagraph id="idE2FAB045BE3D4710BF8E70041C5797F4"><enum>(A)</enum><text>in subsection (a)—</text><clause id="iddd913206-37eb-40f4-9ea5-5b2a73cd699e"><enum>(i)</enum><text>by striking <quote>arising from the performance</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id60d2ec1b-0008-45f3-9634-5e711f83a31e" changed="added" reported-display-style="italic" committee-id="SSJU00"><text>, may not be brought in any Federal or State court if the claim or charge is directly attributable to—</text><paragraph id="id115015c9-6153-4e80-ae2c-8167c01479d4"><enum>(1)</enum><text>the performance</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="idb47f2348-3a5f-4dd0-b80a-a1f7903be582"><enum>(ii)</enum><text>in paragraph (1), as so designated, by striking <quote>may not be brought in any Federal or State court.</quote> and inserting a semicolon; or</text></paragraph><paragraph id="id88f3ee8a-fde3-4143-a250-79048928240c"><enum>(3)</enum><text>research voluntarily undertaken by the provider or domain name registrar using any material being preserved under section 2258A(h), if the research is only for the purpose of—</text><subparagraph id="idbf04a8c7-3526-4fed-92eb-ef33d42dd0db"><enum>(A)</enum><text>improving or facilitating reporting under this section, section 2258A, or section 2258C; or</text></subparagraph><subparagraph id="id89f296ac-81b2-4415-ad9a-5ee303b9cdc1"><enum>(B)</enum><text>stopping the online sexual exploitation of children.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id9A432B990D2043AB8B0EC4CB59821B78"><enum>(B)</enum><text>in subsection (b)(2)(C)—</text><clause id="id2e3aee99c4f647a3b7353db931f62cfc"><enum>(i)</enum><text>by striking <quote>the performance of</quote>;</text></clause><clause id="idcd42ddee788244458ffe3cdf77e5c639"><enum>(ii)</enum><text>by inserting <quote>described in or performed</quote> after <quote>function</quote>; and</text></clause><clause id="idf23fc981bc0d419c92295d90794448f1"><enum>(iii)</enum><text>by striking <quote>this section, sections</quote> and inserting <quote>this section or section</quote>; and</text></clause></subparagraph></paragraph><paragraph id="id4b566eb5-3463-40ed-ae55-862c77ce8210"><enum>(3)</enum><text>in section 2258C—</text><subparagraph id="idcc4f3020-815c-4b8f-97f1-dc273a668fcd"><enum>(A)</enum><text>in the section heading, by striking <quote><header-in-text style="USC" level="section">the CyberTipline</header-in-text></quote> and inserting <quote><header-in-text style="USC" level="section">NCMEC</header-in-text></quote>;</text></subparagraph><subparagraph id="id0bfadc72-1e69-44ad-a4e4-e602435270cd"><enum>(B)</enum><text>in subsection (a)—</text><clause id="idd1385d04-1230-45ab-8a76-bc95f45c6a2c"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="id77f9b88e-57b8-4917-8033-a17d018903ea"><enum>(I)</enum><text>by striking <quote>NCMEC</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id132888e1-b8f8-4eb3-8a7f-b13f3c5c7349" changed="added" reported-display-style="italic" committee-id="SSJU00"><subparagraph id="id4eb2625f-9645-4157-a9df-a80e55123175"><enum>(A)</enum><header>Provision to providers</header><text>NCMEC</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause><subclause id="id75e5cd18-6388-471f-9005-26239f3e9d07"><enum>(II)</enum><text>in subparagraph (A), as so designated, by inserting <quote>or submission to the child victim identification program described in section 404(b)(1)(K)(ii) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11293">34 U.S.C. 11293(b)(1)(K)(ii)</external-xref>)</quote> after <quote>CyberTipline report</quote>; and</text></subclause><subclause id="idf1911230-dfa6-4c65-804c-2815f88bbb8e"><enum>(III)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id759d6b28-56a8-476f-8f65-2d6ffcf9c5dc" changed="added" reported-display-style="italic" committee-id="SSJU00"><subparagraph id="idb2a60b1e-6da9-45fb-a103-6645b277029e"><enum>(B)</enum><header>Provision to non-profit entities</header><text>NCMEC may provide hash values or similar technical identifiers associated with visual depictions provided in a CyberTipline report or submission to the child victim identification program described in section 404(b)(1)(K)(ii) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11293">34 U.S.C. 11293(b)(1)(K)(ii)</external-xref>) to a non-profit entity for the sole and exclusive purpose of preventing and curtailing the online sexual exploitation of children.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause id="idf7c60cd4-54fd-4fa5-81aa-bdbbc8ecf48f"><enum>(ii)</enum><text>in paragraph (2)—</text><subclause id="id98fa308b-5e12-4fc8-a5e9-c42eee8416cd"><enum>(I)</enum><text>by inserting <quote>(A)</quote> after <quote>(1)</quote>;</text></subclause><subclause id="idb2a3bcf9-b105-4c74-b4f2-ca81a1d5c74a"><enum>(II)</enum><text>by inserting <quote>or submission to the child victim identification program described in section 404(b)(1)(K)(ii) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11293">34 U.S.C. 11293(b)(1)(K)(ii)</external-xref>)</quote> after <quote>CyberTipline report</quote>; and</text></subclause><subclause id="id46fad76a-e28e-4d43-b22c-1bf6b60c6179"><enum>(III)</enum><text>by adding at the end the following: <quote>The elements authorized under paragraph (1)(B) shall be limited to hash values or similar technical identifiers associated with visual depictions provided in a CyberTipline report or submission to the child victim identification program described in section 404(b)(1)(K)(ii) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11293">34 U.S.C. 11293(b)(1)(K)(ii)</external-xref>).</quote>; and</text></subclause></clause></subparagraph><subparagraph id="ide1a18d3d-0888-47f8-a82d-13cf5508209b" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>in subsection (d), by inserting <quote>or to the child victim identification program described in section 404(b)(1)(K)(ii) of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11293">34 U.S.C. 11293(b)(1)(K)(ii)</external-xref>)</quote> after <quote>CyberTipline</quote>.</text></subparagraph></paragraph></subsection><subsection id="id66201B8FFEE74BF8A1E39A9CC4467B78"><enum>(b)</enum><header>Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">chapter 110</external-xref> of title 18, United States Code, is amended by striking the item relating to section 2258C (as amended by section 6(c)(1)(B) of this Act) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idED46E8F91CD344ED969E42B4D4C76E84" style="OLC" changed="added" reported-display-style="italic" committee-id="SSJU00"><toc changed="added" reported-display-style="italic" committee-id="SSJU00"><toc-entry bold="off" level="section">2258C. Use to combat child sexual abuse material of technical elements relating to reports made to NCMEC.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id1c2786c7c68e402d9c3a885c94628fcf" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>8.</enum><header>Eliminating network distribution of child exploitation</header><text display-inline="no-display-inline">Section 2258A(h) of title 18, United States Code, is amended—</text><paragraph id="id173143d6b9024f6b8de26731dd644f7e"><enum>(1)</enum><text>in paragraph (1), by striking <quote>90 days</quote> and inserting <quote>180 days</quote>; and</text></paragraph><paragraph id="id26cb30586a374f9c87f5f6781ec7e8fa"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc8319d0825ab4fd5bdbbe1be0f8fd917" changed="added" reported-display-style="italic" committee-id="SSJU00"><paragraph id="id951b8761a31f42bda1827cd298c7f982"><enum>(5)</enum><header>Extension of preservation</header><text>A provider of a report to the CyberTipline may voluntarily preserve the contents provided in the report (including any comingled content described in paragraph (2)) for longer than 180 days after the submission to the CyberTipline for the purpose of reducing the proliferation of online child sexual exploitation or preventing the online sexual exploitation of children.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id0945776c69984f4198ab4eeb66c9f6d5" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>9.</enum><header>IT solutions relating to combating online child exploitation</header><text display-inline="no-display-inline">Title IV of the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/34/11291">34 U.S.C. 11291</external-xref> et seq.) is amended—</text><paragraph id="idB64F3B452AD04FE584D4EC2D4A31B665"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 409 (<external-xref legal-doc="usc" parsable-cite="usc/34/11297">34 U.S.C. 11297</external-xref>) as section 410; and</text></paragraph><paragraph id="id8DF18E705D8C407F90EC39DA77813EAD"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 408 (<external-xref legal-doc="usc" parsable-cite="usc/34/11296">34 U.S.C. 11296</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idef98b820f4724e23bef8c0b8ea962bfb" changed="added" reported-display-style="italic" committee-id="SSJU00"><section id="idd17b83cb7d8d4716ac4ff29f73ca7bc2"><enum>409.</enum><header>IT solutions relating to combating online child exploitation</header><subsection id="id4a6f7b37f17b48ad8b89fe71ec5edc74"><enum>(a)</enum><header>Development of IT solutions</header><text>The Administrator shall enable the development of information technology solutions and the creation and acquisition of innovative tools to implement updates, improvements, and modernization needed to enhance efforts to combat online child exploitation in order to ensure that consistent, actionable information is provided to law enforcement agencies, including Internet Crimes Against Children (commonly known as <quote>ICAC</quote>) task forces.</text></subsection><subsection id="id604230fe105e4c399acd3813f9f42602"><enum>(b)</enum><header>Consultation with partners</header><text>In developing the information technology solutions under subsection (a), the Administrator shall solicit input from all partners in the effort to combat online child exploitation, including the Center, ICAC task forces, the Federal Bureau of Investigation, the Department of Homeland Security, U.S. Immigration and Customs Enforcement, Homeland Security Investigations, and the United States Marshals Service.</text></subsection><subsection id="id84c5adf5a09b4564bba2fabfa3671e73"><enum>(c)</enum><header>Funding</header><text>Each fiscal year, the Administrator shall carry out this section using not less than $1,000,000 of the amounts made available to carry out this title for that fiscal year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="ide860e5ab-6a1e-4130-8c19-a077b6db3d19" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>10.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out this Act.</text></section><section id="id3dd1d017d26a4a6590bd6507cbe13494" changed="added" reported-display-style="italic" committee-id="SSJU00"><enum>11.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or any amendment made by this Act, or any application of such provision or amendment to any person or circumstance, is held to be unconstitutional, the remainder of the provisions of this Act and the amendments made by this Act, and the application of the provision or amendment to any other person or circumstance, shall not be affected.</text></section></legis-body><endorsement><action-date>July 20, 2020</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
