			 facilities the 35-mile rule for designating critical access hospitals
			 under the Medicare program. </official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H64B4371D773B4F6C92875C5FE4D2292E" style="OLC">
 <section id="H4796A8DB9E1F4D12B764C9EBB1C3EBFB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Hospital Closure Relief Act of 2019</short-title></quote>.</text> </section><section id="HFE66815548B2465D81178B605B909245"><enum>2.</enum><header>Restoring State authority to waive the 35-mile rule for certain Medicare critical access hospital designations</header><text display-inline="no-display-inline">Section 1820 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-4">42 U.S.C. 1395i–4</external-xref>) is amended—</text>
 <paragraph id="HB46D731D4B4A4BD091F5F75663C5A748"><enum>(1)</enum><text>in subsection (c)(2)—</text> <subparagraph id="HB63310AFBC7E4DC59964E474986AFB8B"><enum>(A)</enum><text>in subparagraph (B)(i)—</text>
 <clause id="HBAC3FC2EC67941B08CA0DD3D0EADBC02"><enum>(i)</enum><text>in subclause (I), by striking at the end <quote>or</quote>;</text> </clause><clause id="HA1694699F90E4BCEA636577755557B63"><enum>(ii)</enum><text>in subclause (II), by inserting at the end <quote>or</quote>; and</text>
 </clause><clause id="H57B6305E27EB49558EC11B89DDBD779C"><enum>(iii)</enum><text>by adding at the end the following new subclause:</text> <quoted-block display-inline="no-display-inline" id="HD84FB30051EA4BBFA38B743C70C4B6CC" style="OLC"> <subclause id="HFCF169FF812743B491F64AAD33E364FC"><enum>(III)</enum><text display-inline="yes-display-inline">subject to subparagraph (G), is a hospital described in subparagraph (F) and is certified on or after the date of the enactment of the Rural Hospital Closure Relief Act of 2019 by the State as being a necessary provider of health care services to residents in the area;</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="H3587BD556AFD4D9C9D1648D8EF3AFFBC"><enum>(B)</enum><text>by adding at the end the following new subparagraphs:</text> <quoted-block display-inline="no-display-inline" id="H3CE8CA36D10541EF8275566FF0D07364" style="OLC"> <subparagraph id="HBFA9B82ED7B94003BCD4EA562CC6E5C6"><enum>(F)</enum><header>Hospital described</header><text display-inline="yes-display-inline">For purposes of subparagraph (B)(i)(III), a hospital described in this subparagraph is a hospital that—</text>
 <clause id="H9C36DDF6B87F4B41B446AB761FD89E26"><enum>(i)</enum><text display-inline="yes-display-inline">is a sole community hospital (as defined in section 1886(d)(5)(D)(iii)), a medicare dependent, small rural hospital (as defined in section 1886(d)(5)(G)(iv)), a low-volume hospital that in 2019 receives a payment adjustment under section 1886(d)(12), or a subsection (d) hospital (as defined in section 1886(d)(1)(B)) that has fewer than 50 beds;</text>
 </clause><clause id="id99f18ef515484da6a2d91c23267b2629"><enum>(ii)</enum><text>is located in a rural area, as defined by the Secretary, based on the most recent rural urban commuting area code (or its successor criteria) as set forth by the Office of Management and Budget;</text>
 </clause><clause id="HB2B22A76C0C34BEF846ACAE56978F139"><enum>(iii)</enum><text>as determined by the Secretary, serves a patient population—</text> <subclause id="HDABC3C4AA4F6465391C1B11DF90D7182"><enum>(I)</enum><text display-inline="yes-display-inline">with a high percentage, relative to the national or statewide average, of individuals with income that is below 150 percent of the poverty line;</text>
 </subclause><subclause id="H94731B5DB08F4B52B249D61236C2011A"><enum>(II)</enum><text>in a health professional shortage area (as defined in section 332(a)(1)(A) of the Public Health Service Act); or</text>
 </subclause><subclause id="H2969C41098CB4D988D77B89ABCAE1FD4"><enum>(III)</enum><text>that represents a high proportion, relative to the national or statewide average, of individuals entitled to part A or enrolled under part B of this title or enrolled under a State plan under title XIX;</text>
 </subclause></clause><clause id="id140b5587948b4e3abfa535e6f893527c"><enum>(iv)</enum><text>has demonstrated to the Secretary, at such time and in such manner as the Secretary determines appropriate, two consecutive years of financial losses preceding the date of certification described in subparagraph (B)(i)(III); and</text>
 </clause><clause id="idC299A98B03044CFC9563400EE61DC70D"><enum>(v)</enum><text>submits to the Secretary, at such time and in such manner as the Secretary may require, an attestation that the Secretary determines to be satisfactory, outlining the good governance qualifications and strategic plan for multi-year financial solvency of the hospital.</text>
							</clause></subparagraph><subparagraph id="H69EF04C5E09E43B89E5BEAA1D8843393"><enum>(G)</enum><header>Limitation on certain designations</header>
 <clause id="H6F742900BA474B8F9A9B962925EC5EE7"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may not under subsection (e) certify pursuant to a certification by a State under subsection (c)(2)(B)(i)(III)—</text>
 <subclause id="HDBF50AE327364DA0B7B9CCEDF80D9FA7"><enum>(I)</enum><text>more than a total of 200 facilities as critical access hospitals; and</text> </subclause><subclause id="H5738F39BF8974270988619146A0F52D4"><enum>(II)</enum><text display-inline="yes-display-inline">subject to clause (ii), within any one State, more than 15 facilities as critical access hospitals.</text>
 </subclause></clause><clause id="H7F30E4B7A24A41499CAC3D3F4246D8BB"><enum>(ii)</enum><header>State petition</header><text display-inline="yes-display-inline">The Secretary may apply, with respect to a State, the limitation under clause (i)(II) by substituting a number that is greater than the number specified in such clause if the State petitions the Secretary, in accordance with a process established by the Secretary, to increase such number.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H6A11F1C48CE04C98B896B69866663685"><enum>(2)</enum><text>in subsection (e), by inserting <quote>, subject to subsection (c)(2)(G),</quote> after <quote>The Secretary shall</quote>.</text></paragraph></section></legis-body></bill>
