			 concessions on certain land managed by the Bureau of Land Management.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="HCD02D5AF72C04D6EBF05E61F18DAAB79" style="OLC">
 <section id="H3B31BB819DB2468991D427AAA69EBDAA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>RPPA Commercial Recreation Concessions Pilot Program Act of 2019</short-title></quote>.</text> </section><section id="H91AB899B247D43E68B0A180A2A669954"><enum>2.</enum><header>Commercial recreation concessions pilot program</header><text display-inline="no-display-inline">The Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (44 Stat. 741, chapter 578; <external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869</external-xref> et seq.), is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HBE6DB018CF914437AD8CA9F817ABDF1D" style="OLC">
				<section id="H8DC3C8C3A4A04813966C60B47C1E9345"><enum>7.</enum><header>Commercial recreation concessions pilot program</header>
 <subsection id="HAAC48CCC28F5456FB3A646468B8C1145"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of this Act (including any regulations under this Act), not later than 90 days after the date of enactment of this section, the Secretary shall establish a pilot program to authorize commercial recreation concessions on land patented or leased under this Act.</text>
					</subsection><subsection id="H59D9AF0D063840508BBEB836587E251D"><enum>(b)</enum><header>Concessions agreements</header>
 <paragraph id="H9A13B5E83EE44F7FA8BF78D09212F51C"><enum>(1)</enum><header>In general</header><text>In carrying out the pilot program established under subsection (a), the Secretary shall enter into not more than 10 agreements with parties to whom the land described in subsection (a) has been patented or leased for the establishment of commercial recreation concessions on the land covered by the agreement.</text>
						</paragraph><paragraph id="HFEA82BE08F1B4295B474FAD550BDF26F"><enum>(2)</enum><header>Term</header>
 <subparagraph id="H23D4CD0568FD41678340AA571206F508"><enum>(A)</enum><header>In general</header><text>An agreement entered into under paragraph (1) shall be for a period that is consistent with the period of time required to amortize the capital investment made under the agreement but in any case not longer than 20 years.</text>
 </subparagraph><subparagraph id="H783A9F0BE8864B7C9F7A2ADF26522FB5"><enum>(B)</enum><header>Extension</header><text>On a finding of satisfactory performance, the Secretary may extend the term of an agreement for 1 additional period equal in length to the initial term.</text>
							</subparagraph></paragraph><paragraph id="HA5F14EF27176453DA63AB1C5D2D02672"><enum>(3)</enum><header>Third-party agreements</header>
 <subparagraph id="HA891AD3A0D734B48BCEF68840E6BBA67"><enum>(A)</enum><header>In general</header><text>A party to an agreement entered into under paragraph (1) may enter into agreements with third parties for the establishment of commercial recreation concessions pursuant to the agreement entered into under paragraph (1).</text>
 </subparagraph><subparagraph id="HA0E6C77BAD9E40E4BFE8C37F100EFD18"><enum>(B)</enum><header>Term</header><text>An agreement entered into under subparagraph (A) shall not be for a period that is longer than the term of the agreement entered into under paragraph (1).</text>
 </subparagraph></paragraph></subsection><subsection id="H77689762AEEA4CD8BA5E1FE29C0CB4B6"><enum>(c)</enum><header>Use of funds</header><text>A party to an agreement entered into under subsection (b)(1) shall not be required to use revenue collected pursuant to the commercial recreation concessions on the land covered by the agreement.</text>
 </subsection><subsection commented="no" id="H581014260D96457D8E29735E1FA6EAF1"><enum>(d)</enum><header>Authorized activities</header><text>For the term of an agreement entered into under subsection (b)(1), with respect to land covered by the agreement, any activity defined as permissible under parts 2920 and 2930 of title 43, Code of Federal Regulations (or successor regulations), shall be permissible.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="HF1522E71D0504372A621FC3A3E5F899F"><enum>(e)</enum><header>Effect</header><text>The establishment of commercial recreation concessions under subsection (b) shall not be considered to be a change in use for purposes of this Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
