Dingell, Jr. Conservation, Management, and Recreation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/742b">16 U.S.C. 742b</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/116/9">Public Law 116–9</external-xref>) is amended—</text><paragraph id="HEF1FBF8913F14FED89AFCCB3A0B40E56" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text><clause id="H4FCD3BBEBF054FA98C00CD3C8C952010" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Board</header><text display-inline="yes-display-inline">The term <term>Board</term> means the Reducing Human-Predator Conflict Technology Advisory Board established by subparagraph (C)(i).</text></clause><clause id="HE6AB0299C5174179B45BD92B2023382D" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Prize competition</header><text display-inline="yes-display-inline">The term <term>prize competition</term> means the Theodore Roosevelt Genius Prize for reducing human-predator conflict established under subparagraph (B).</text></clause></subparagraph><subparagraph id="H7B056BD831C9453694BCBA9B490E9C99" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the <short-title>America's Conservation Enhancement Act</short-title>, the Secretary shall establish under section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3719">15 U.S.C. 3719</external-xref>) a prize competition, to be known as the <quote>Theodore Roosevelt Genius Prize for reducing human-predator conflict</quote>—</text><clause id="H5E3CF6D7F8204CF6AD1B45A364E8EED7" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">to encourage technological innovation with the potential to advance the mission of the United States Fish and Wildlife Service with respect to reducing the frequency of human-predator conflict using nonlethal means; and</text></clause><clause id="H5193E8E214E34840864DFB25C7D3B4C1" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">to award 1 or more prizes annually for a technological advancement that promotes reducing human-predator conflict using nonlethal means, which may include the application and monitoring of tagging technologies.</text></clause></subparagraph><subparagraph id="HEF50B5A684854CF89A3DA61443AB80DD" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Advisory board</header><clause id="H385B8292700E44C1A16D7F8932898DF3" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established an advisory board, to be known as the <quote>Reducing Human-Predator Conflict Technology Advisory Board</quote>.</text></clause><clause id="H9EF2B690266D42DA9334ADA6A6AE311E" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Board shall be composed of not fewer than 9 members appointed by the Secretary, who shall provide expertise in—</text><subclause id="H09227E6C3AA544F98C6C89D9288DC78D" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">predator-human interactions;</text></subclause><subclause id="H6EDDACA922054D54980B87D26A0F02CE" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the habitats of large predators;</text></subclause><subclause id="HBAB6E1C426124AE1B3416404EDAA6EC0" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">biology;</text></subclause><subclause id="H8B4A54B0B1854443BF7627220EBBE896" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text display-inline="yes-display-inline">technology development;</text></subclause><subclause id="HF3F825E399FC47CA9D57F7B1C001E62C" commented="no" display-inline="no-display-inline"><enum>(V)</enum><text display-inline="yes-display-inline">engineering;</text></subclause><subclause id="HC1D681A10E0D4A379E1D07D24C566ECC" commented="no" display-inline="no-display-inline"><enum>(VI)</enum><text display-inline="yes-display-inline">economics;</text></subclause><subclause id="HD15066BE01F14D638B9986C3C11007F8" commented="no" display-inline="no-display-inline"><enum>(VII)</enum><text display-inline="yes-display-inline">business development and management; and</text></subclause><subclause id="HC360B195F8094255B90AD4E2A05DBF5E" commented="no" display-inline="no-display-inline"><enum>(VIII)</enum><text display-inline="yes-display-inline">any other discipline, as the Secretary determines to be necessary to achieve the purposes of this paragraph.</text></subclause></clause><clause id="H7438894CD0C1414DB08F1597D778D92C" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">Subject to clause (iv), with respect to the prize competition, the Board shall—</text><subclause id="HD1163190DF724899AC201009013E8A78" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">select a topic;</text></subclause><subclause id="H4A0952AB64DB42C696F7C8D0E0DAD425" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">issue a problem statement;</text></subclause><subclause id="H97E04527FA2E42F6B6C35BC52B6451E1" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">advise the Secretary regarding any opportunity for technological innovation to reduce human-predator conflict using nonlethal means; and</text></subclause><subclause id="H3580FF4F11844D8C98A103BBA19928DB" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text display-inline="yes-display-inline">advise winners of the prize competition regarding opportunities to pilot and implement winning technologies in relevant fields, including in partnership with conservation organizations, Federal or State agencies, federally recognized Indian Tribes, private entities, and research institutions with expertise or interest relating to reducing human-predator conflict using nonlethal means.</text></subclause></clause><clause id="H2A37C8405E014253AB9BE53A859CDA12" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In selecting a topic and issuing a problem statement for the prize competition under subclauses (I) and (II) of clause (iii), respectively, the Board shall consult widely with Federal and non-Federal stakeholders, including—</text><subclause id="HFEEC929949804272AA6FA556687CF6DE" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">1 or more Federal agencies with jurisdiction over the management of native wildlife species at risk due to conflict with human activities;</text></subclause><subclause id="HA051BBB8B40A4366B8EA2D026E6737F5" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">1 or more State agencies with jurisdiction over the management of native wildlife species at risk due to conflict with human activities;</text></subclause><subclause id="HC40D75AD4DAC4371B37F9F597C41AD37" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">1 or more State, regional, or local wildlife organizations, the mission of which relates to the management of native wildlife species at risk due to conflict with human activities; and</text></subclause><subclause id="H87FC240696DD4C088B41E96CCA2F93F6" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text display-inline="yes-display-inline">1 or more wildlife conservation groups, technology companies, research institutions, institutions of higher education, industry associations, or individual stakeholders with an interest in the management of native wildlife species at risk due to conflict with human activities.</text></subclause></clause><clause id="H0AB6BC0E0E7448F7BC9436D91917638C" commented="no" display-inline="no-display-inline"><enum>(v)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The Board shall comply with all requirements under paragraph (8)(A).</text></clause></subparagraph><subparagraph id="H454A8F9A87564ED2AEF05BB5D8E6CCF6" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Agreement with National Fish and Wildlife Foundation</header><clause id="H30509743CD354749BA149392884353FD" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall offer to enter into an agreement under which the National Fish and Wildlife Foundation shall administer the prize competition.</text></clause><clause id="HBCA0CA08391F45E4BDB78E31251E804C" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">An agreement entered into under clause (i) shall comply with all requirements under paragraph (8)(B).</text></clause></subparagraph><subparagraph id="H99C3F74F58734C97AB4F4DB7C43122D1" commented="no" display-inline="no-display-inline"><enum>(E)</enum><header display-inline="yes-display-inline">Judges</header><clause id="H522242324BC44FDD9E33E084BBA29926" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">Appointment</header><text display-inline="yes-display-inline">The Secretary shall appoint not fewer than 3 judges who shall, except as provided in clause (ii), select the 1 or more annual winners of the prize competition.</text></clause><clause id="HC9B81376637D4AC6BFF440CAA55D5514" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Determination by Secretary</header><text display-inline="yes-display-inline">The judges appointed under clause (i) shall not select any annual winner of the prize competition if the Secretary makes a determination that, in any fiscal year, none of the technological advancements entered into the prize competition merits an award.</text></clause></subparagraph><subparagraph id="HDDF393BE0BB549958092E073BD8E0DA8" commented="no" display-inline="no-display-inline"><enum>(F)</enum><header display-inline="yes-display-inline">Consultation with National Oceanic and Atmospheric Administration</header><text display-inline="yes-display-inline">The Secretary shall consult with the Secretary of Commerce, acting through the Administrator of the National Oceanic and Atmospheric Administration, in the case of a cash prize awarded under the prize competition for a technology that addresses conflict between humans and marine predators under the jurisdiction of the Secretary of Commerce, acting through the Administrator of the National Oceanic and Atmospheric Administration.</text></subparagraph><subparagraph id="H3F3CC94A2849499D8AC3811B64F9A310" commented="no" display-inline="no-display-inline"><enum>(G)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">Not later than 60 days after the date on which a cash prize is awarded under this paragraph, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Natural Resources of the House of Representatives a report on the prize competition that includes—</text><clause id="HF16428BC468D435FA8969BC4AB1F4AEB" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">a statement by the Board that describes the activities carried out by the Board relating to the duties described in subparagraph (C)(iii);</text></clause><clause id="H9604703EC75D419DBB058CF4D833C5AC" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">if the Secretary has entered into an agreement under subparagraph (D)(i), a statement by the National Fish and Wildlife Foundation that describes the activities carried out by the National Fish and Wildlife Foundation relating to the duties described in paragraph (8)(B); and</text></clause><clause id="H5C3F694BFB3847899CCFDB71635B3C0C" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">a statement by 1 or more of the judges appointed under subparagraph (E) that explains the basis on which the winner of the cash prize was selected.</text></clause></subparagraph><subparagraph id="HAED8DC2847444E60A8F1AB16205391D8" commented="no" display-inline="no-display-inline"><enum>(H)</enum><header display-inline="yes-display-inline">Termination of authority</header><text display-inline="yes-display-inline">The Board and all authority provided under this paragraph shall terminate on December 31, 2023.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H853BBEAD3B6A464F9687909BF89E55E8" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">in paragraph (8) (as redesignated)—</text><subparagraph id="HC3D35D57F2B94D60B56CA2AA8910E2F1" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>or (6)(C)(i)</quote> and inserting <quote>(6)(C)(i), or (7)(C)(i)</quote>; and</text></subparagraph><subparagraph id="H8B11EA6A4CDD40D2B0F1BB312547E5DE" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text><clause id="H7298D463CC0E41659ABC9041EEE4B6CC" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>or (6)(D)(i)</quote> and inserting <quote>(6)(D)(i), or (7)(D)(i)</quote>; and</text></clause><clause id="H4CCE238F959246BFBA44433A69FE671C" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">in clause (i)(VII), by striking <quote>and (6)(E)</quote> and inserting <quote>(6)(E), and (7)(E)</quote>.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3CA6B54B1D8F4C22BFF66383D5AC1EDA"><enum>(b)</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that data collected from the tagging of predators can inform innovative management of those predators and innovative education activities to minimize human-predator conflict.</text></subsection></section><section id="H3B71B22FE07647F2A13EF49E77728A5A" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Losses of livestock due to depredation by federally protected species</header><subsection id="H16D4CDADB9364A218E8A11F0DACFEA0E" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H6AAC347CC3144A6FACD6436F20267510" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Depredation</header><subparagraph id="H03487C13C0C74904AF6774AE1A79694E" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>depredation</term> means actual death, injury, or destruction of livestock that is caused by a federally protected species.</text></subparagraph><subparagraph id="HF1AF6E44E4D845439185A78DF707F665" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Exclusions</header><text display-inline="yes-display-inline">The term <term>depredation</term> does not include damage to real or personal property other than livestock, including—</text><clause id="HEFB5A1D1A34A41519931D0C5C7A736F9" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">damage to—</text><subclause id="H8FCB586E2CF440FF96C9DEC66F2E8260" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">other animals;</text></subclause><subclause id="H11008F881BF440D797AF42AE2BCC51F3" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">vegetation;</text></subclause><subclause id="H608CB701B6644BA7BB27B9A99A99117B" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">motor vehicles; or</text></subclause><subclause id="H21A09DE07D104FC68C92ECBBC3E29E18" commented="no" display-inline="no-display-inline"><enum>(IV)</enum><text display-inline="yes-display-inline">structures;</text></subclause></clause><clause id="H27003A451BD141BE9AFE6F8640BC6E10" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">diseases;</text></clause><clause id="H4F238226AC1743438B3D6356912DCF72" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">lost profits; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H9721ACF6906B4AEBA99D3C0AFCD34593"><enum>(iv)</enum><text display-inline="yes-display-inline">consequential damages.</text></clause></subparagraph></paragraph><paragraph id="H0F5ADE0593304999A029A5C3CCEC2BEB" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Federally protected species</header><text display-inline="yes-display-inline">The term <term>federally protected species</term> means a species that is or previously was protected under—</text><subparagraph id="H057846BFF02545AC8F61A6D0CF60882F" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Act of June 8, 1940 (commonly known as the <quote>Bald and Golden Eagle Protection Act</quote>) (54 Stat. 250, chapter 278; <external-xref legal-doc="usc" parsable-cite="usc/16/668">16 U.S.C. 668</external-xref> et seq.);</text></subparagraph><subparagraph id="H4C64352083D44240B6DCEC26A1F70B1A" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.); or</text></subparagraph><subparagraph id="HE7B185F18E6244F987C248489494D090" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703</external-xref> et seq.).</text></subparagraph></paragraph><paragraph id="H32A9B39C3D804005896350AD386A5346" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given to the term <quote>Indian tribe</quote> in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="H34CC5F5072D9435CBFDD21D84380A8E6" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Livestock</header><subparagraph id="HF41C2D7FC95D4D11B820ADE4AF68CB76" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>livestock</term> means horses, mules and asses, rabbits, llamas, cattle, bison, swine, sheep, goats, poultry, bees, honey and beehives, or any other display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusion</header><text display-inline="yes-display-inline">The term <term>livestock</term> includes guard animals actively engaged in the protection of livestock described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="HFC005B5C6A80405D876BC9DD739CE350" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the grant program established under subsection (b)(1).</text></paragraph><paragraph id="H36C58B08D4CF448BAC3B0C1CC41EE462" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Secretaries</header><text display-inline="yes-display-inline">The term <term>Secretaries</term> means—</text><subparagraph id="H36719212ABA342988E3DE50DAE3A19E5" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service; and</text></subparagraph><subparagraph id="H784A7CD1659648C8A07C8C5BC95F9AE6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture, acting through the Administrator of the Animal and Plant Health Inspection Service.</text></subparagraph></paragraph></subsection><subsection id="HFA27C7C675AB49D8974776C900D3197F" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Grant program for losses of livestock due to depredation by federally protected species</header><paragraph id="HDE25BA8E8BD94F42AB82AAB183EE591E" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretaries shall establish a program to provide grants to States and Indian Tribes to supplement amounts provided by States, Indian Tribes, or State agencies under 1 or more programs established by the States and Indian Tribes (including programs established after the date of enactment of this Act)—</text><subparagraph id="H82AF931B40EB42E99F192A4C4121FE94" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to assist livestock producers in carrying out—</text><clause id="H66848AA42A0F456897ED37F24F5B8543" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">proactive and nonlethal activities to reduce the risk of livestock loss due to depredation by federally protected species occurring on—</text><subclause id="HE71335C3F7F34AC294EA1F2F94233400" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">Federal, State, or private land within the applicable State; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H07FDCCC4E29549719D2114EBDDA2E696"><enum>(II)</enum><text display-inline="yes-display-inline">land owned by, or held in trust for the benefit of, the applicable Indian Tribe; and</text></subclause></clause><clause id="H0905DFF89C45411DB96A8CFBD5F8BF78" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">research relating to the activities described in clause (i); and</text></clause></subparagraph><subparagraph id="HC7D47D3FD547429A8B94675CCEA22277" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to compensate livestock producers for livestock losses due to depredation by federally protected species occurring on—</text><clause id="H2CB6B9244D47420FA282071BC5851D94" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">Federal, State, or private land within the applicable State; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HD23E85651C854D4D8FDE722325FFB7C1"><enum>(ii)</enum><text display-inline="yes-display-inline">land owned by, or held in trust for the benefit of, the applicable Indian Tribe.</text></clause></subparagraph></paragraph><paragraph id="H1FE18A3586FA4DEEBBA6777DC205FADE" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Allocation of funding</header><subparagraph id="HD646DEC81BE24B6CA65639B7F84DD1D6" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Reports to the Secretaries</header><text display-inline="yes-display-inline">Not later than September 30 of each year, a State or Indian Tribe desiring to receive a grant under the program shall submit to the Secretaries a report describing, for the 1-year period ending on that September 30, the losses of livestock due to depredation by federally protected species occurring on—</text><clause id="H52172187472742DD8A6AA0644C19B2CA" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">Federal, State, or private land within the applicable State; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HA3B0DEAFC6D448E6814CEE0B97C87467"><enum>(ii)</enum><text display-inline="yes-display-inline">land owned by, or held in trust for the benefit of, the applicable Indian Tribe.</text></clause></subparagraph><subparagraph id="H425F974C850E4B5B938A065F76306A31" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Allocation</header><text display-inline="yes-display-inline">The Secretaries shall allocate available funding to carry out this Act among States and Indian Tribes for a 1-year period ending on September 30 based on the losses described in the reports submitted for the previous 1-year period ending on September 30 under subparagraph (A).</text></subparagraph></paragraph><paragraph id="HCF4DDE34548E4965BBAB385CD11CB15F" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Eligibility</header><text display-inline="yes-display-inline">To be eligible to receive a grant under paragraph (1), a State or Indian Tribe shall—</text><subparagraph id="HE9F11FA8D2EB4C9D957AFB37B9196522" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">designate an appropriate agency of the State or Indian Tribe to administer the 1 or more programs supplemented by the grant funds;</text></subparagraph><subparagraph id="HD24A3BB34009472B974440AC821F7C3F" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">establish 1 or more accounts to receive grant funds;</text></subparagraph><subparagraph id="H6F453DB5680F4677B2EEA842A6964B76" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">maintain files of all claims received and paid under grant-funded programs, including supporting documentation; and</text></subparagraph><subparagraph id="HFFFB118D50A14E6FAF2668267440F77F" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">submit to the Secretaries—</text><clause id="HF2CDDAB056464DF6A86F54CD96D5EC9B" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">annual reports that include—</text><subclause id="H36B2A284A884485999E25F0C1259CB2A" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">a summary of claims and expenditures under the program during the year; and</text></subclause><subclause id="HCA5BC633C41643FBABF528D0669F0596" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">a description of any action taken on the claims; and</text></subclause></clause><clause id="H16F0811567844ED9A5A06059DE1C79CF" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">such other reports as the Secretaries may require to assist the Secretaries in determining the effectiveness of assisted activities under this section.</text></clause></subparagraph></paragraph></subsection><subsection id="H4E728ABC36C544198A349ACD5710996E" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text><paragraph id="H9C1948014F204732AF022334392DF1D1" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">no State or Indian Tribe is required to participate in the program; and</text></paragraph><paragraph id="H2A20A076B7B742C6B8685551F36BF28E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the program supplements, and does not replace or supplant, any State compensation programs for depredation.</text></paragraph></subsection><subsection id="H942BE40ED1DB4D439DA3BBEDFE294884" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $15,000,000 for each of fiscal years 2021 through 2025, of which—</text><paragraph id="H642AEA20DB2840A2B192728FFE72AD74" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">$5,000,000 shall be used to provide grants for the purposes described in subsection (b)(1)(A); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE40D182F4A06417897F1F7B48F37940A"><enum>(2)</enum><text display-inline="yes-display-inline">$10,000,000 shall be used to provide grants for the purpose described in subsection (b)(1)(B).</text></paragraph></subsection></section><section commented="no" id="HD5CCD5BB12AE47A39E3ABCBCE2C4BECC" section-type="subsequent-section" display-inline="no-display-inline"><enum>103.</enum><header display-inline="yes-display-inline">Depredation permits for black vultures and common ravens</header><subsection commented="no" id="H7CD094ACBB0F450895D9267F34346964" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service (referred to in this section as the <term>Secretary</term>), may issue depredation permits to livestock producers authorizing takings of black vultures or common ravens otherwise prohibited by Federal law to prevent those vultures or common ravens from taking livestock during the calving season or lambing season.</text></subsection><subsection commented="no" id="H5727D6124AE34781980C836DF5C0C20A" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Limited to affected States or regions</header><text display-inline="yes-display-inline">The Secretary may issue permits under subsection (a) only to livestock producers in States and regions in which livestock producers are affected or have been affected in the previous year by black vultures or common ravens, as determined by Secretary.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HFE2998CBB43649C2921FDFED2C1B911B"><enum>(c)</enum><header display-inline="yes-display-inline">Reporting</header><text display-inline="yes-display-inline">The Secretary shall require, as a condition of a permit under subsection (a), that the permit holder shall report to the appropriate enforcement agencies the takings of black vultures or common ravens pursuant to the permit.</text></subsection></section><section id="HABF462BFCFAD4CAB8DCAC848275E698C" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Chronic Wasting Disease Task Force</header><subsection id="HDB277B9278914E0994CFD754C5DF34E8" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HB9E6D4DDD3FA49F18845B20DB32E1A92" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Cervid</header><text display-inline="yes-display-inline">The term <term>cervid</term> means any species within the family Cervidae.</text></paragraph><paragraph id="HB1EDC95B5A6748BFA6175356A1EA4029" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Chronic wasting disease</header><text display-inline="yes-display-inline">The term <term>chronic wasting disease</term> means the animal disease afflicting deer, elk, and moose populations that—</text><subparagraph id="HC8DAABC31D544104B3E06C967CAA950C" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">is a transmissible disease of the nervous system resulting in distinctive lesions in the brain; and</text></subparagraph><subparagraph id="HF41F3F07187F426298BF78FA3FFA7F11" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">belongs to the group of diseases known as transmissible spongiform encephalopathies, which group includes scrapie, bovine spongiform encephalopathy, and Creutzfeldt-Jakob disease.</text></subparagraph></paragraph><paragraph id="HD1C9F021762C437F9C3EE8B8B0C25E9D" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Secretaries</header><text display-inline="yes-display-inline">The term <quote>Secretaries</quote> means the Secretary of Agriculture, acting through the Administrator of the Animal and Plant Health Inspection Service, and the Secretary of the Interior, acting through the Director of the United States Geological Survey and the Director of the United States Fish and Wildlife Service, acting jointly.</text></paragraph></subsection><subsection id="H2988218C41ED4D1CA84373C268DED3C4" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><paragraph id="H8C433013C09F4D4F8BCED20CA571A434" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretaries shall establish within the United States Fish and Wildlife Service a task force, to be known as the <quote>Chronic Wasting Disease Task Force</quote> (referred to in this subsection as the <term>Task Force</term>) after the completion of the study required by subsection (c).</text></paragraph><paragraph id="H70EB656DE8744875B6A975F6DC5CDFA3" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Task Force shall—</text><subparagraph id="H3008A7E3666644F884E5379D6C2B75D7" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">collaborate with foreign governments to share research, coordinate efforts, and discuss best management practices to reduce, minimize, prevent, or eliminate chronic wasting disease in the United States;</text></subparagraph><subparagraph id="HC594E95F7E45426590B2CACD7401D8AB" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">develop recommendations, including recommendations based on findings of the study conducted under subsection (c), and a set of best practices regarding—</text><clause id="H6E7520BFEF2E4FA597B0C7F72BB3F8E9" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the interstate coordination of practices to prevent the new introduction of chronic wasting disease;</text></clause><clause id="HB3400970DDAE4526A8A85B955CBE6894" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the prioritization and coordination of the future study of chronic wasting disease, based on evolving research needs;</text></clause><clause id="HC927C5F73B8D4C95869E5CE19E9C0C60" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">ways to leverage the collective resources of Federal, State, and local agencies, Indian Tribes, and foreign governments, and resources from private, nongovernmental entities, to address chronic wasting disease in the United States and along the borders of the United States; and</text></clause><clause id="H2CFD6E77DEC4443FA9F91ADCC7026D54" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">any other area where containment or management efforts relating to chronic wasting disease may differ across jurisdictions; and</text></clause></subparagraph><subparagraph id="HC9A6F0146A6644F7A0C6F451123FA417" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">develop, from the recommendations developed under subparagraph (B), an action plan that gives States, the Federal Government, Indian Tribes, and the farmed cervid industry specific recommendations to ensure consistent and coordinated management and focused, prioritized research to stop the spread of and mitigate the impacts of chronic wasting disease.</text></subparagraph></paragraph><paragraph id="H8FD8BD48BD084E0D9DC6CFF989698D50" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Membership</header><subparagraph id="HEA64C72133344F6AB4277354BE357443" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Task Force shall be composed of—</text><clause id="H62459C51D00C4CFDA7A13D2DCB9E11FE" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">1 representative of the United States Fish and Wildlife Service with experience in chronic wasting disease, to be appointed by the Secretary of the Interior (referred to in this subsection as the <term>Secretary</term>);</text></clause><clause id="H118EEAB4800B425AA8073E9E5107199B" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">1 representative of the United States Geological Survey;</text></clause><clause id="H4A4D041AA9C247519E88FDC517341E0B" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">2 representatives of the Department of Agriculture with experience in chronic wasting disease, to be appointed by the Secretary of Agriculture—</text><subclause id="HB13E4984BD384E37A6AD005AA89FEA02" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">1 of whom shall have expertise in cervid health research; and</text></subclause><subclause id="H00503403F5184A1DA8EEE6F45FF7EB8B" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">1 of whom shall have expertise in wildlife management;</text></subclause></clause><clause id="H7C0F0BE265F742049EEC51567BF45834" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">in the case of each State in which chronic wasting disease among elk, mule deer, white-tailed deer, or moose has been reported to the appropriate State agency, not more than 2 representatives, to be nominated by the Governor of the State—</text><subclause id="H9620CF39AA614015A7D69AD21BE23CE4" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">not more than 1 of whom shall be a representative of the State agency with jurisdiction over wildlife management or wildlife disease in the State; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H022419A3009A4658B168F8793972F31E"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of a State with a farmed cervid program or economy, not more than 1 of whom shall be a representative of the State agency with jurisdiction over farmed cervid regulation in the State;</text></subclause></clause><clause id="H4FA662C897444B0CA8E635DBE6C785E2" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">in the case of each State in which chronic wasting disease among elk, mule deer, white-tailed deer, or moose has not been documented, but that has carried out measures to prevent the introduction of chronic wasting disease among those species, not more than 2 representatives, to be nominated by the Governor of the State;</text></clause><clause id="HC1E93A96972840D38B1640C18570A566" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text display-inline="yes-display-inline">not more than 2 representatives from an Indian Tribe or Tribal organization chosen in a process determined, in consultation with Indian Tribes, by the Secretary; and</text></clause><clause id="H7E88BAA50388417F8F1D1E60AA6B270E" commented="no" display-inline="no-display-inline"><enum>(vii)</enum><text display-inline="yes-display-inline">not more than 5 nongovernmental members with relevant expertise appointed, after the date on which the members are first appointed under clauses (i) through (vi), by a majority vote of the State representatives appointed under clause (iv).</text></clause></subparagraph><subparagraph id="HE51D811253DD438DB217D5AE39C1F006" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Effect</header><text display-inline="yes-display-inline">Nothing in this paragraph requires a State to participate in the Task Force.</text></subparagraph></paragraph><paragraph id="HC87CD791EB9D4D48AC2DC08160804D8D" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Co-chairs</header><text display-inline="yes-display-inline">The Co-Chairs of the Task Force shall be—</text><subparagraph id="H90111E900D4D4FCEA0578A5FEEE5EB51" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Federal representative described in paragraph (3)(A)(i);</text></subparagraph><subparagraph id="H777FF1248AFE4F7D8753C977B1A50084" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">1 of the Federal representatives described in paragraph (3)(A)(iii); and</text></subparagraph><subparagraph id="HF20A886E6E874D288C01617420F6BD0F" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">1 State representative appointed under paragraph (3)(A)(iv), to be selected by a majority vote of those State representatives.</text></subparagraph></paragraph><paragraph id="H2880FED1C47649218C159354783995C6" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Date of initial appointment</header><subparagraph id="H0C3F728E31ED493C995EA16B71A1C01C" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The members of the Task Force shall be appointed not later than 180 days after the date on which the study is completed under subsection (c).</text></subparagraph><subparagraph id="HF4EB9858576F49B1808D2DA1CE4E080D" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Notification</header><text display-inline="yes-display-inline">On appointment of the members of the Task Force, the Co-Chairs of the Task Force shall notify the Chairs and Ranking Members of the Committees on Environment and Public Works and Agriculture, Nutrition, and Forestry of the Senate and Natural Resources and Agriculture of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H4898529966C64DEEB6634045A435D697" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Vacancies</header><text display-inline="yes-display-inline">Any vacancy in the members appointed to the Task Force—</text><subparagraph id="H01457AE248F745E8957201480AAB8BE5" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">shall not affect the power or duty of the Task Force; and</text></subparagraph><subparagraph id="H089CF58D33174C3BBCCF9B5FBBFA3F6B" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">shall be filled not later than 30 days after the date of the vacancy.</text></subparagraph></paragraph><paragraph id="H6F9E8FE8ED91405791DFEC220B46C308" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Meetings</header><text display-inline="yes-display-inline">The Task Force shall convene—</text><subparagraph id="H411443E7C1424F67BE306E40085D0E99" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">not less frequently than twice each year; and</text></subparagraph><subparagraph id="H001364CE2F5E4FD39A8FEE73C8F5A9E9" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text technology.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCF0A6A4961F64C1FB66A6D454E31D060"><enum>(8)</enum><header display-inline="yes-display-inline">Interstate action plan</header><subparagraph commented="no" display-inline="no-display-inline" id="H9FBC848959F4441BBFD30F8BE43630DB"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the members of the Task Force are appointed, the Task Force shall submit to the Secretaries, and the heads of the State agencies with jurisdiction over wildlife disease and farmed cervid regulation of each State with a representative on the Task Force, the interstate action plan developed by the Task Force under paragraph (2)(C).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFABE184668044796B63816A3F15BE3C7"><enum>(B)</enum><header display-inline="yes-display-inline">Cooperative agreements</header><clause commented="no" display-inline="no-display-inline" id="HF65767F653FB4A7781383898055DB446"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To the maximum extent practicable, the Secretaries, any other applicable Federal agency, and each applicable State may enter into a cooperative agreement to fund necessary actions under the interstate action plan submitted under subparagraph (A).</text></clause><clause commented="no" display-inline="no-display-inline" id="H13350E89C59E469E84FBEB79C42415CF"><enum>(ii)</enum><header display-inline="yes-display-inline">Target date</header><text display-inline="yes-display-inline">The Secretaries shall make the best effort of the Secretaries to enter into any cooperative agreement under clause (i) not later than 180 days after the date of submission of the interstate action plan under subparagraph (A).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H37BE934339B648AB95D389B7DACBD9EC"><enum>(C)</enum><header display-inline="yes-display-inline">Matching funds</header><clause commented="no" display-inline="no-display-inline" id="H19EC624DBE3A4D9EAE815F37F6160842"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to clause (ii), for each fiscal year, the Secretaries may provide funds to carry out an interstate action plan through a cooperative agreement under subparagraph (B) in the amount of funds provided by the applicable States.</text></clause><clause commented="no" display-inline="no-display-inline" id="HACC4F8FC9BDD4AEAB7A73BEA4E2A0713"><enum>(ii)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The amount provided by the United States Fish and Wildlife Service under clause (i) for a fiscal year shall be not greater than $5,000,000.</text></clause></subparagraph></paragraph><paragraph id="HBD821634D23044F6AB6D87A340AA2D96" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">Not later than September 30 of the first full fiscal year after the date on which the first members of the Task Force are appointed, and each September 30 thereafter, the Task Force shall submit to the Secretaries, and the heads of the State agencies with jurisdiction over wildlife disease and farmed cervid regulation of each State with a representatives on the Task Force, a report describing—</text><subparagraph id="H5D06047037E44193BCF0739B0B8C37F8" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">progress on the implementation of actions identified in the interstate action plan submitted under paragraph (8)(A), including the efficacy of funding under the cooperative agreement entered into under paragraph (8)(B);</text></subparagraph><subparagraph id="H5706B4B705BF403AB887F799D8B97E86" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">updated resource requirements that are needed to reduce and eliminate chronic wasting disease in the United States;</text></subparagraph><subparagraph id="H09D34B23120743808DC31A3F40AF01AB" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">any relevant updates to the recommended best management practices included in the interstate action plan submitted under paragraph (8)(B) to reduce or eliminate chronic wasting disease;</text></subparagraph><subparagraph id="HF47A1173AE8A43D2A9C7D59D2C376447" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">new research findings and emerging research needs relating to chronic wasting disease; and</text></subparagraph><subparagraph id="H361BB9533BE94F78A6B7F4646F277761" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">any other relevant information.</text></subparagraph></paragraph></subsection><subsection id="H8506EBF182F24DD19343E2B2F0AE69A5" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Chronic wasting disease transmission in cervidae resource study</header><paragraph id="HCD64D3839539490BBDE955922FFCDA63" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of Academy</header><text display-inline="yes-display-inline">In this subsection, the term <term>Academy</term> means the National Academy of Sciences.</text></paragraph><paragraph id="H24DBBE86247343AEA1A85142A61C2996" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Study</header><subparagraph id="H2F1E6ED8459247DBAD60A59A3F33BF69" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretaries shall enter into an arrangement with the Academy under which the Academy shall conduct, and submit to the Secretaries a report describing the findings of, a special resource study to identify the predominant pathways and mechanisms of the transmission of chronic wasting disease in wild, captive, and farmed populations of cervids in the United States.</text></subparagraph><subparagraph id="H29D20DC8FF0745FCB3A26FA3783F5FBD" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The arrangement under subparagraph (A) shall provide that the actual expenses incurred by the Academy in conducting the study under subparagraph (A) shall be paid by the Secretaries, subject to the availability of appropriations.</text></subparagraph></paragraph><paragraph id="H6EE563F3C3704EEEAC8708204733052D" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Contents of the study</header><text display-inline="yes-display-inline">The study under paragraph (2) shall—</text><subparagraph id="HE8F627A066F046A0B959D15B4E486E93" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to wild, captive, and farmed populations of cervids in the United States, identify—</text><clause id="HE6A0BED023BD482FB6BE73788699C81D" commented="no" display-inline="no-display-inline"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="HF7058B059ED949EC83CED9FE3A23BB82"><enum>(I)</enum><text display-inline="yes-display-inline">to the extent possible, the pathways and mechanisms for the transmission of chronic wasting disease within live cervid populations and cervid products, which may include pathways and mechanisms for transmission from Canada;</text></subclause><subclause id="H361A15799E42446497F845C90A1BEC1B" indent="up1" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the infection rates for each pathway and mechanism identified under subclause (I); and</text></subclause><subclause id="H10904028EED54C5FBBC1C440E84A26F3" indent="up1" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">the relative frequency of transmission of each pathway and mechanism identified under subclause (I);</text></subclause></clause><clause id="HD952CA01DCFE4306B9B7DCDBF5AB3504" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HB7F493C9BF8643D4B443722274CC2738"><enum>(I)</enum><text display-inline="yes-display-inline">anthropogenic and environmental factors contributing to new chronic wasting disease emergence events;</text></subclause><subclause id="HE1FBB9D58DD1428792625DA79BF4DF78" indent="up1" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the development of geographical areas with increased chronic wasting disease prevalence; and</text></subclause><subclause id="H72C00C5F5D9A4FB5B53C610D6A3722CE" indent="up1" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">the overall geographical patterns of chronic wasting disease distribution;</text></subclause></clause><clause id="HFAF900D8AE5C496E8F4E272DBC0F1C0E" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">significant gaps in current scientific knowledge regarding the transmission pathways and mechanisms identified under clause (i)(I) and potential prevention, detection, and control methods identified under clause (v);</text></clause><clause id="H4DED12A43F284253817AE5D12DFED493" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">for prioritization the scientific research projects that will address the knowledge gaps identified under clause (iii), based on the likelihood that a project will contribute significantly to the prevention or control of chronic wasting disease; and</text></clause><clause id="HEA51A66EC93743159004CB9378FF4E5F" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">potential prevention, detection, or control measures, practices, or technologies to be used to mitigate the transmission and spread of chronic wasting disease in wild, captive, and farmed populations of cervids in the United States;</text></clause></subparagraph><subparagraph id="HBEFDFC666A4841099BFA06D4C17257A3" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">assess the effectiveness of the potential prevention, detection, or control measures, practices, or technologies identified under subparagraph (A)(v); and</text></subparagraph><subparagraph id="H1AB0A585EC524405B0B79B20C0ACA9F3" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">review and compare science-based best practices, standards, and guidance regarding the prevention, detection, and management of chronic wasting disease in wild, captive, and farmed populations of cervids in the United States that have been developed by—</text><clause id="HF934CB8053894A70A9C6002E50B1B167" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the National Chronic Wasting Disease Herd Certification Program of the Animal and Plant Health Inspection Service;</text></clause><clause id="HFC37B7EF37214FC5B67EE87D69E02B4E" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the National Wildlife Research Center of the Animal and Plant Health Inspection Service;</text></clause><clause id="H985B41EF5A0D49FBAD543CD478D34C08" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">the United States Geological Survey;</text></clause><clause commented="no" display-inline="no-display-inline" id="H3BE2C9968A4842FEBCFF70A1AC1BE2B0"><enum>(iv)</enum><text display-inline="yes-display-inline">State wildlife and agricultural agencies, in the case of practices, standards, and guidance that provide practical, science-based recommendations to State and Federal agencies for minimizing or eliminating the risk of transmission of chronic wasting disease in the United States; and</text></clause><clause id="HAE06A01E3DD54550BCE859A1ACB97FE2" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">industry or academia, in the case of any published guidance on practices that provide practical, science-based recommendations to cervid producers for minimizing or eliminating the risk of transmission of chronic wasting disease within or between herds.</text></clause></subparagraph></paragraph><paragraph id="H06F050E52DF8445DB1C208E40969A92C" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Deadline</header><text display-inline="yes-display-inline">The study under paragraph (2) shall be completed not later than 180 days after the date on which funds are first made available for the study.</text></paragraph><paragraph id="H6D3E07557397464E97B0E60E5F7C88B6" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Data sharing</header><text display-inline="yes-display-inline">The Secretaries shall share with the Academy, as necessary to conduct the study under paragraph (2), subject to the avoidance of a violation of a privacy or confidentiality requirement and the protection of confidential or privileged commercial, financial, or proprietary information, data and access to databases and research information on chronic wasting disease under the jurisdiction of—</text><subparagraph id="H052A74E95FC84BF58528B401A28E55EF" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Animal and Plant Health Inspection Service; and</text></subparagraph><subparagraph id="H3C3D532111FA495C83E515CC02CC3211" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the United States Geological Survey.</text></subparagraph></paragraph><paragraph id="HF13E6BCA77B94091B1668A9296A60D0A" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 60 days after the date of completion of the study, the Secretaries shall submit to the Committee on Agriculture, Nutrition, and Forestry, the Committee on Energy and Natural Resources, and the Committee on Environment and Public Works of the Senate and the Committee on Agriculture and the Committee on Natural Resources of the House of Representatives a report that describes—</text><subparagraph id="H0019DFF773E149F2879ABB2D2C387697" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the findings of the study; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6A9C87A7322B4D58B359296609BA3977"><enum>(B)</enum><text display-inline="yes-display-inline">any conclusions and recommendations that the Secretaries determine to be appropriate.</text></subparagraph></paragraph></subsection><subsection id="HC0AC790F9F5144258613A61F4CE1A9A0" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section—</text><paragraph id="HA1D1829F3F0443729374A2598F34C381" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">for the period of fiscal years 2021 through 2025, $5,000,000 to the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service, to carry out administrative activities under subsection (b);</text></paragraph><paragraph id="H5BCFAD7E4C1E4C03A36514C3A015D8F0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">for fiscal year 2021, $1,200,000 to the Secretary of the Interior, acting through the Director of the United States Geological Survey, to carry out activities to fund research under subsection (c); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9A580644396D4EF6857F17FE29156BA5"><enum>(3)</enum><text display-inline="yes-display-inline">for fiscal year 2021, $1,200,000 to the Secretary of Agriculture, acting through the Administrator of the Animal and Plant Health Inspection Service, to carry out activities to fund research under subsection (c).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HD8E798A176FD4E7FB7EC8211AA5B8FC0" section-type="subsequent-section"><enum>105.</enum><header display-inline="yes-display-inline">Invasive species</header><text display-inline="no-display-inline">Section 10 of the Fish and Wildlife Coordination Act (<external-xref legal-doc="usc" parsable-cite="usc/16/666c-1">16 U.S.C. 666c–1</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H39978B764F7343F3B46D8293DB24AD4E"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(2)—</text><subparagraph commented="no" display-inline="no-display-inline" amended by striking <quote>not to exceed—</quote> in the matter preceding paragraph (1) and all that follows through paragraph (5) and inserting <quote>not to exceed $60,000,000 for each of fiscal id="H530D75C44916454A93E0E5289B283F0A" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text the Foundation in a lump sum without regard to when the expenses for which the amounts are used are incurred.</text></subparagraph><subparagraph id="HD262F7DFAF8F4A3B867474208425A6EB" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Management fees</header><text display-inline="yes-display-inline">The Foundation may assess and collect fees for the management of amounts received under this paragraph.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H2BDDF833B156448DBA0682A5A84CCFA2" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><clause display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In entering into contracts, agreements, or other partnerships pursuant to this Act, a Federal department, agency, or instrumentality shall have discretion to waive any competitive process applicable to the department, agency, or instrumentality for entering into contracts, agreements, or partnerships with the Foundation if the purpose of the waiver is—</text><clause id="H532984724DFE4CD3AFC62FC1A3B80841" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">to address an environmental emergency resulting from a natural or other disaster; or</text></clause><clause id="HD9D1FA045334478B9480AEE338363403" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">as determined by the head of the applicable Federal department, agency, or instrumentality, to reduce administrative expenses and expedite the conservation and management of fish, wildlife, plants, and other natural resources.</text></clause></subparagraph><subparagraph id="H4BFA35AC816E4BA2B32A399E1AA2A31F" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">The Foundation shall include in the annual report submitted under section 7(b) a description of any use of the authority under subparagraph (A) by a Federal department, agency, or instrumentality in that fiscal year.</text></subparagraph></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3180ED245E21459FAA10EF33E0DAA4B7" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H75A9A7F8BCE84143B537D762E7E455B9" style="OLC"><subsection id="HD172E235321544A6BF2A8D934CFF8D0E" commented="no" display-inline="yes-display-inline">Any gifts, devises, or bequests of amounts or other property, or any other amounts or other property, transferred to, deposited with, or otherwise in the possession of the Foundation pursuant to this Act, may be made available by the Foundation to Federal departments, agencies, or instrumentalities and may be accepted and expended (or the disposition of the amounts or property directed), without further appropriation, by those Federal departments, agencies, or instrumentalities, subject to the condition that the amounts or property be used for purposes that further the conservation and management of fish, wildlife, plants, and other natural resources.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H262AB36DBBB046398BD6259274A08733"><enum>(d)</enum><header display-inline="yes-display-inline">Limitation on authority</header><text display-inline="yes-display-inline">Section 11 of the National Fish and Wildlife Foundation Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3710">16 U.S.C. 3710</external-xref>) is amended by inserting <quote>exclusive</quote> before <quote>authority</quote>.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="HB90DECA9426248B6B083D34BB0DBC6B6" section-type="subsequent-section"><enum>108.</enum><header display-inline="yes-display-inline">Modification of definition of sport fishing equipment under Toxic Substances Control display-inline="yes-display-inline">During the 5-year period beginning on the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall not take any action to regulate the lead content of sport fishing equipment or sport fishing equipment components under the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Chesapeake Executive Council</header><text display-inline="yes-display-inline">The term <term>Chesapeake Executive Council</term> means the council comprised of—</text><subparagraph id="HB5149D332F95479DAA00A73C6A220BEB" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Governors of each of the States of Delaware, Maryland, New York, Pennsylvania, Virginia, and West Virginia;</text></subparagraph><subparagraph id="HB51DE88B22F54C5380FCBDCC21ACF4C7" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Mayor of the District of Columbia;</text></subparagraph><subparagraph id="H0DD398CDD2AD4EFCBA488CAB872A5327" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the Chair of the Chesapeake Bay Commission; and</text></subparagraph><subparagraph id="H4294FEA61E374EA2960804A6A28A260C" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the Administrator of the Environmental Protection Agency.</text></subparagraph></paragraph><paragraph id="H26D7082C80F24B83B694419329F06D25" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Chesapeake WILD program</header><text display-inline="yes-display-inline">The term <term>Chesapeake WILD program</term> means the nonregulatory program established by the Secretary under subsection (b)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4FDA40C6ED1D428583ED6FDF8BCBC069"><enum>(6)</enum><header display-inline="yes-display-inline">Grant program</header><text display-inline="yes-display-inline">The term <term>grant program</term> means the Chesapeake Watershed Investments for Landscape Defense grant program established by the Secretary under subsection (c)(1).</text></paragraph><paragraph id="HC2B7B70E3CCD414EAAAD6BF03E2BF7D1" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Restoration and protection activity</header><text display-inline="yes-display-inline">The term <term>restoration and protection activity</term> means an activity carried out for the conservation, stewardship, and enhancement of habitat for fish and wildlife—</text><subparagraph id="H6C4E242AB3224BB68C67E2D98C9ABE0A" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to preserve and improve ecosystems and ecological processes on which the fish and wildlife depend; and</text></subparagraph><subparagraph id="H2779FDE6AB4A48CB82A322174BD827A1" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">for use and enjoyment by the public.</text></subparagraph></paragraph><paragraph id="HAB686AA91F7E446FBA42B6A60D78BC4F" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service.</text></paragraph></subsection><subsection id="H45F9F2A823D24550851050705FAD3C1A" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Program establishment</header><paragraph id="H3179B788B541418E82A28660DF81EC6D" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a nonregulatory program, to be known as the <quote>Chesapeake Watershed Investments for Landscape Defense program</quote>.</text></paragraph><paragraph id="H686CC6DDB26A4A7D96DC92BE563D9756" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of the Chesapeake WILD program are—</text><subparagraph id="H6EDCD4726FBD4F3A9A0685FC84E75212" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">coordinating restoration and protection activities among Federal, State, local, and regional entities and conservation partners throughout the Chesapeake Bay watershed;</text></subparagraph><subparagraph id="HF160A7A3F2714EA8BDC573FDDD8C051F" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">engaging other agencies and organizations to build a broader range of partner support, capacity, and potential funding for projects in the Chesapeake Bay watershed;</text></subparagraph><subparagraph id="H688F0253A5DF46FD8C564461DCE2AD54" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">carrying out coordinated restoration and protection activities, and providing for technical assistance, throughout the Chesapeake Bay watershed—</text><clause id="H38A629DA873B49F6AD1755AF37D1140A" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">to sustain and enhance restoration and protection activities;</text></clause><clause id="H95EB055260D64775BE071590C10232C0" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">to improve and maintain water quality to support fish and wildlife, habitats of fish and wildlife, and drinking water for people;</text></clause><clause id="H39199F946B2945F8989A168C12239877" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">to sustain and enhance water management for volume and flood damage mitigation improvements to benefit fish and wildlife habitat;</text></clause><clause id="HB53F3C72DA2746458B6EED1A48280022" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">to improve opportunities for public access and recreation in the Chesapeake Bay watershed consistent with the ecological needs of fish and wildlife habitat;</text></clause><clause id="HCF32F52B08514A449793FCE9B1A207A0" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">to facilitate strategic planning to maximize the resilience of natural ecosystems and habitats under changing watershed conditions;</text></clause><clause id="H26554A7CA3DE4AFE950E7059CC33F9F8" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text display-inline="yes-display-inline">to engage the public through outreach, education, and citizen involvement to increase capacity and support for coordinated restoration and protection activities in the Chesapeake Bay watershed;</text></clause><clause id="H33505E9DDD2B4AD2BDD061AF0E66D904" commented="no" display-inline="no-display-inline"><enum>(vii)</enum><text display-inline="yes-display-inline">to sustain and enhance vulnerable communities and fish and wildlife habitat;</text></clause><clause id="HBE071990268B45508B06B44CF027CE6B" commented="no" display-inline="no-display-inline"><enum>(viii)</enum><text display-inline="yes-display-inline">to conserve and restore fish, wildlife, and plant corridors; and</text></clause><clause id="H5407DB16BAD04D0BA656C69A379449AA" commented="no" display-inline="no-display-inline"><enum>(ix)</enum><text display-inline="yes-display-inline">to increase scientific capacity to support the planning, monitoring, and research activities necessary to carry out coordinated restoration and protection activities.</text></clause></subparagraph></paragraph><paragraph id="H4C9523884657433EBE6F24669B4EFE70" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">In carrying out the Chesapeake WILD program, the Secretary shall—</text><subparagraph id="H1D8608C15BDC45A0B50BCAE68CD93EE3" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">draw on existing plans for the Chesapeake Bay watershed, or portions of the Chesapeake Bay watershed, including the Chesapeake Bay agreements, and work in consultation with applicable management entities, including Chesapeake Bay program partners, such as the Federal Government, State and local governments, the Chesapeake Bay Commission, and other regional organizations, as appropriate, to identify, prioritize, and implement restoration and protection activities within the Chesapeake Bay watershed;</text></subparagraph><subparagraph id="H935189ABD7104A949610E0A89CA30CF4" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">adopt a Chesapeake Bay watershed-wide strategy that—</text><clause id="H43CAF95B80724CD4AD06923F852341A4" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">supports the implementation of a shared set of science-based restoration and protection activities developed in accordance with subparagraph (A); and</text></clause><clause id="H1477302176FF4D7A807D2113814A1F67" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">targets cost-effective projects with measurable results; and</text></clause></subparagraph><subparagraph id="H19FAB4AFC2D040EEB2C0B9D7E9F1863A" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">establish the grant program in accordance with subsection (c).</text></subparagraph></paragraph><paragraph id="H36A0C6A1CD8242C2BA7F0696055DDDB8" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">In establishing the Chesapeake WILD program, the Secretary shall consult, as appropriate, with—</text><subparagraph id="HC18D5D6C507D4FCEB296FA301006F424" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the heads of Federal agencies, including—</text><clause id="H5BA25B4FCD8647EA997291286826CB8A" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the Administrator of the Environmental Protection Agency;</text></clause><clause id="HAFC4601A079045AA9B2E6432EE7372FF" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the Administrator of the National Oceanic and Atmospheric Administration;</text></clause><clause id="HF713BC949E0543F5A67069A60751E8B9" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">the Chief of the Natural Resources Conservation Service;</text></clause><clause id="H76A104423ECD42E7A5D5559A87ED31D5" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">the Chief of Engineers;</text></clause><clause id="H93C9C95988304F7685691B60858DB2AA" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">the Director of the United States Geological Survey;</text></clause><clause id="H6F4155E5570F4D039D23AAE330F5B7DC" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text display-inline="yes-display-inline">the Secretary of Transportation;</text></clause><clause id="H5A717B0D20CD4034AF7A7C8E0D1AD01A" commented="no" display-inline="no-display-inline"><enum>(vii)</enum><text display-inline="yes-display-inline">the Chief of the Forest Service; and</text></clause><clause id="H75CB1F4601904DC2B730E070E001C2A5" commented="no" display-inline="no-display-inline"><enum>(viii)</enum><text display-inline="yes-display-inline">the head of any other applicable agency;</text></clause></subparagraph><subparagraph id="HFFA276923DF841999DAF9D3DBF7414BC" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Governors of each of the States of Delaware, Maryland, New York, Pennsylvania, Virginia, and West Virginia and the Mayor of the District of Columbia;</text></subparagraph><subparagraph id="H654671803D9F4C4AB03E67B05E2ACA99" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">fish and wildlife joint venture partnerships; and</text></subparagraph><subparagraph id="H36A4535AD6264E26B08B4582BA5C8D65" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">other public agencies and organizations with authority for the planning and implementation of conservation strategies in the Chesapeake Bay watershed.</text></subparagraph></paragraph></subsection><subsection id="H471294D4B20F462FB1E2608B28DA6BD6" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Grants and technical assistance</header><paragraph id="H5E716956005E45F3A34B0FCB8C701E85" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Chesapeake Wild grant program</header><text display-inline="yes-display-inline">To the extent that funds are made available to carry out this subsection, the Secretary shall establish and carry out, as part of the Chesapeake WILD program, a voluntary grant and technical assistance program, to be known as the <quote>Chesapeake Watershed Investments for Landscape Defense grant program</quote>, to provide competitive matching grants of varying amounts and technical assistance to eligible entities described in paragraph (2) to carry out activities described in subsection (b)(2).</text></paragraph><paragraph id="HE7E7E9879C234F1F8756EE6CD9B5FF02" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible entities</header><text display-inline="yes-display-inline">The following entities are eligible to receive a grant and technical assistance under the grant program:</text><subparagraph id="HC9DFAD156A1E4680AF14A61548381947" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">A State.</text></subparagraph><subparagraph id="H7D94C6C273E54AEABB82E68609FEC2F9" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">The District of Columbia.</text></subparagraph><subparagraph id="HFC125C6484F241AAB3E779DB69AA7051" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">A unit of local government.</text></subparagraph><subparagraph id="H54282CF8317F4369B892A5C6D6531F4C" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">A nonprofit organization.</text></subparagraph><subparagraph id="H0816DD84B0B143D2AB1BD15DD52F95C8" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">An institution of higher education as such term is defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></subparagraph><subparagraph id="H683986B95B3B425E8910BC1B031769C7" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">Any other entity that the Secretary determines to be appropriate in accordance with the criteria established under paragraph (3).</text></subparagraph></paragraph><paragraph id="HEF8BCFDB53BB4AD89DBB7CC88FC5E026" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Criteria</header><text display-inline="yes-display-inline">The Secretary, in consultation with officials and entities described in subsection (b)(4), shall establish criteria for the grant program to help ensure that activities funded under this subsection—</text><subparagraph id="HB62F0456631746DFBEAE1C02BBC8B365" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">accomplish 1 or more of the purposes described in subsection (b)(2); and</text></subparagraph><subparagraph id="H2FC091EBD1F34FD7A1C6E44528D4ABEC" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">advance the implementation of priority actions or needs identified in the Chesapeake Bay watershed-wide strategy adopted under subsection (b)(3)(B).</text></subparagraph></paragraph><paragraph id="H17A517A32D6C4557AE2FF608E150D0E3" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Cost sharing</header><subparagraph id="H9FB4EF175799469FA790826EDA4B4BC4" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Department of the Interior share</header><text display-inline="yes-display-inline">The Department of the Interior share of the cost of a project funded under the grant program shall not exceed 50 percent of the total cost of the project, as determined by the Secretary.</text></subparagraph><subparagraph id="HD823116F665B4AAA8823F6AA7FB2EDC3" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Non-Department of the Interior share</header><clause id="H857AE828287349298782BB2ED9D09D82" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The non-Department of the Interior share of the cost of a project funded under the grant program may be provided in cash or in the form of an in-kind contribution of services or materials.</text></clause><clause id="HA39C49A98A134BF7A2B40FA5D9C3D65B" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Other Federal funding</header><text display-inline="yes-display-inline">Non-Department of the Interior Federal funds may be used for not more than 25 percent of the total cost of a project funded under the grant program.</text></clause></subparagraph></paragraph><paragraph id="H448FB76B35C843E6857DDF65789849C3" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">The Secretary may enter into an agreement to manage the grant program with an organization that offers grant management services.</text></paragraph></subsection><subsection id="H660974F546234AA6AECD3A1AACE1DCBB" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Reporting</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, and annually thereafter, the Secretary shall submit to Congress a report describing the implementation of this section, including a description of each project that has received funding under this section.</text></subsection><subsection id="HBB51598335DD484FB716B1700A321EA5" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><paragraph id="H96CE595015FB4014ACFAC56819F7D1A9" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $15,000,000 for each of fiscal years 2021 through 2025.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H890AD84F09FF4476BC57CAC4FCC1C02C"><enum>(2)</enum><header display-inline="yes-display-inline">Supplement, not supplant</header><text display-inline="yes-display-inline">Funds made available under paragraph (1) shall supplement, and not supplant, funding for other activities conducted by the Secretary in the Chesapeake Bay watershed.</text></paragraph></subsection></section><enum>II</enum><header display-inline="yes-display-inline">National Fish Habitat Conservation Through Partnerships</header><section id="H1EA73F4E095D4B27B167A0CB533F399E" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="no-display-inline">The purpose of this title is to encourage partnerships among public agencies and other interested persons to promote fish conservation—</text><paragraph id="H6B0AB6CC25784EBD81A0B13FE1745C4C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">to achieve measurable habitat conservation results through strategic actions of Fish Habitat Partnerships that lead to better fish habitat conditions and increased fishing opportunities by—</text><subparagraph id="H148F160159804D60925AD04F8FE21F2F" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">improving ecological conditions;</text></subparagraph><subparagraph id="HFD2104F2EE1F44CD92E8E94D8F87C855" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">restoring natural processes; or</text></subparagraph><subparagraph id="H38FC8133F22249A9874DA3C3F8A9727F" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">preventing the decline of intact and healthy systems;</text></subparagraph></paragraph><paragraph id="H7807FD2B7FE747BFA37C91BA6098D4A7" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">to establish a consensus set of national conservation strategies as a framework to guide future actions and investment by Fish Habitat Partnerships;</text></paragraph><paragraph id="H9F63B6C7676047DA9521D3643B12FD48" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">to broaden the community of support for fish habitat conservation by—</text><subparagraph id="H58FC90798D05451BB8C10628268E4445" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">increasing fishing opportunities;</text></subparagraph><subparagraph id="H4EE407FB31AF4A229CCAF529330F7343" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">fostering the participation of local communities, especially young people in local communities, in conservation activities; and</text></subparagraph><subparagraph id="H7A53902096DA43EEABFE63FEB911BB31" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">raising public awareness of the role healthy fish habitat play in the quality of life and economic well-being of local communities;</text></subparagraph></paragraph><paragraph id="H1637BC16B0BD45E78C573BF96F65DDE1" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">to fill gaps in the National Fish Habitat Assessment and the associated database of the National Fish Habitat Assessment—</text><subparagraph id="HC9596CD599BD4E8593536F4158EFBE58" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to empower strategic conservation actions supported by broadly available scientific information; and</text></subparagraph><subparagraph id="H1DDA6FBEF348471EB343BBB831D617C6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to integrate socioeconomic data in the analysis to improve the lives of humans in a manner consistent with fish habitat conservation goals; and</text></subparagraph></paragraph><paragraph id="HB8FFB73CCB98461B94D884E7AF3EE9B9" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">to communicate to the public and conservation partners—</text><subparagraph id="H90FC4614F6EF4D7A8ABF7E884DBC28B8" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the conservation outcomes produced collectively by Fish Habitat Partnerships; and</text></subparagraph><subparagraph id="HA6C6B1F5A76E4C85B445FB70ACEDD105" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">new opportunities and voluntary approaches for conserving fish habitat.</text></subparagraph></paragraph></section><section id="H5CC31B24D87249A59BCD340039097BF7" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="HDF0362D525BB4830B3C3D3A11C33E23B" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text><subparagraph id="H9A7CE3CE0E854A298122B664C28D1312" commented="no" display-inline="yes-display-inline">The term <term>real property interest</term> means an ownership interest in—</text><subparagraph id="HF66A413583AD43BEA625B6A6A1501513" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">land; or</text></subparagraph><subparagraph id="HBBFACF2AABAA48E898C30F535B32903E" commented="no" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the fish and wildlife agency of a State; and</text></subparagraph><subparagraph id="H65B9236BC7F54C0A9653DD2881F99A38" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">any department or division of a department or agency of a State that manages in the public trust the inland or marine fishery resources of the State or sustains the habitat for those fishery resources pursuant to State law or the constitution of the State.</text></subparagraph></paragraph></section><section id="HF9A05EF30EA64E71A82DA6DD568F2D65" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">National Fish Habitat Board</header><subsection id="H1B13E543F52540A58459BDD592747B9D" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><paragraph id="H9680494ABCB74860A46AAB5F91FBCD46" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Fish Habitat Board</header><text display-inline="yes-display-inline">There is established a board, to be known as the <quote>National Fish Habitat Board</quote>, whose duties are—</text><subparagraph id="H5CE23C38AE1945D78F886AF5AECB1570" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to promote, oversee, and coordinate the implementation of this title;</text></subparagraph><subparagraph id="H2FC1075104074A58860239197E3187EF" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to establish national goals and priorities for fish habitat conservation;</text></subparagraph><subparagraph id="H996E811B1C664961A08936B1374676F9" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">to recommend to Congress entities for designation as Partnerships; and</text></subparagraph><subparagraph id="HDB8E9FBF2BAF4BF9A86321669EAA2696" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">to review and make recommendations regarding fish habitat conservation projects.</text></subparagraph></paragraph><paragraph id="H62491FD2A4534F97801A1D18D8CCCAB0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Membership</header><text display-inline="yes-display-inline">The Board shall be composed of 26 members, of whom—</text><subparagraph id="H4473E800903A4B5DA8E6250F55FC0066" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">1 shall be a representative of the Department of the Interior;</text></subparagraph><subparagraph id="H39C2EBF09917435EAC73F420E497214A" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">1 shall be a representative of the United States Geological Survey;</text></subparagraph><subparagraph id="H190C73E3E83849CAA6F52867D902CF6F" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">1 shall be a representative of the Department of Commerce;</text></subparagraph><subparagraph id="HAE324F5412C54FAD848129E597E1B20B" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">1 shall be a representative of the Department of Agriculture;</text></subparagraph><subparagraph id="H44F38E357B07456EBF96A02025D7CE7D" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">1 shall be a representative of the Association of Fish and Wildlife Agencies;</text></subparagraph><subparagraph id="HAFECAEDAF9A549AFB1F3BCF275C745DB" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">4 shall be representatives of State agencies, 1 of whom shall be nominated by a regional association of fish and wildlife agencies from each of the Northeast, Southeast, Midwest, and Western regions of the United States;</text></subparagraph><subparagraph id="H61E1713E2E0C4DC99595E07D219946FF" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">2 shall be representatives of either—</text><clause id="H1153C521B4E5458EA5E76CB7E26E609B" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">Indian Tribes in the State of Alaska; or</text></clause><clause id="HB84CBFE2881C4C8D80E344A89B721532" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">Indian Tribes in States other than the State of Alaska;</text></clause></subparagraph><subparagraph id="H449D5AC563C1427DA145C421DFFBCD52" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">1 shall be a representative of either—</text><clause id="H98495C069AA84C3289DF3D8A036B13A6" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the Regional Fishery Management Councils established under section 302 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852</external-xref>); or</text></clause><clause id="H3C640DBC5CD24A93A6B02162EB249284" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a representative of the Marine Fisheries Commissions;</text></clause></subparagraph><subparagraph id="H3A847358F12C4F1CAE002E92A7013119" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">1 shall be a representative of the Sport Fishing and Boating Partnership Council;</text></subparagraph><subparagraph id="HCC5261270C2B45ECA348C7CF229DFA12" commented="no" display-inline="no-display-inline"><enum>(J)</enum><text display-inline="yes-display-inline">7 shall be representatives selected from at least one from each of the following: </text><clause id="H15973FC6262A4DA0AD59C75965C89BB6" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the recreational sportfishing industry;</text></clause><clause id="H735CFA7738604867AE547F75EB73815A" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the commercial fishing industry;</text></clause><clause id="HB056B6D6C5B74E8391908B75D0BD6415" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">marine recreational anglers;</text></clause><clause id="H3555FD298A0C4468A6741952112F3983" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">freshwater recreational anglers;</text></clause><clause id="H8DFEFB806E5A4B959D6A5EC91D8CDF4C" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">habitat conservation organizations; and</text></clause><clause id="HF7B5E099EE4B489BA6AA416FBECA90FF" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text display-inline="yes-display-inline">science-based fishery organizations;</text></clause></subparagraph><subparagraph id="H47C321CFEBF04A7EA0E4691AE10E9104" commented="no" display-inline="no-display-inline"><enum>(K)</enum><text display-inline="yes-display-inline">1 shall be a representative of a national private landowner organization;</text></subparagraph><subparagraph id="H0B7A38103CC74AD3B4D6BEB0DCFC4AE3" commented="no" display-inline="no-display-inline"><enum>(L)</enum><text display-inline="yes-display-inline">1 shall be a representative of an agricultural production organization;</text></subparagraph><subparagraph id="H09FC3FB29C004127BFD144E7B51F6B55" commented="no" display-inline="no-display-inline"><enum>(M)</enum><text display-inline="yes-display-inline">1 shall be a representative of local government interests involved in fish habitat restoration;</text></subparagraph><subparagraph id="HF3BE90107BCD45BE8516501AB278AF7A" commented="no" display-inline="no-display-inline"><enum>(N)</enum><text display-inline="yes-display-inline">2 shall be representatives from different sectors of corporate industries, which may include—</text><clause id="H5B451723361E4999B82BA20299DC018D" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">natural resource commodity interests, such as petroleum or mineral extraction;</text></clause><clause id="H7103B9828D4440B18C16BCB374FAE68A" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">natural resource user industries; and</text></clause><clause id="HA063B0CCB22443F28EBDC221C5A620F7" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">industries with an interest in fish and fish habitat conservation; and</text></clause></subparagraph><subparagraph id="HE47E14DEBD114B6699947803BA0F4C2F" commented="no" display-inline="no-display-inline"><enum>(O)</enum><text display-inline="yes-display-inline">1 shall be an individual in a leadership position in the private sector or landowner representative of an active partnership.</text></subparagraph></paragraph><paragraph id="HD0436911DD0F40C1AED5522F7A9CF262" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Compensation</header><text display-inline="yes-display-inline">A member of the Board shall serve without compensation.</text></paragraph><paragraph id="H3D87FF0A019544B3A1017E40BF8891CB" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Travel expenses</header><text display-inline="yes-display-inline">A member of the Board may be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duties of the Board.</text></paragraph></subsection><subsection id="HEFAE0716524B4BA198195DED138E6CB7" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Appointment and terms</header><paragraph id="HA110188D8E594BE8B8EC369A1F99B1CD" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, a member of the Board described in any of subparagraphs (F) through (O) of subsection (a)(2) shall serve for a term of 3 years.</text></paragraph><paragraph id="H331831BCAA91423B8143C2B95BCF646E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Initial board membership</header><subparagraph id="H58EF01885E6B42FB97A04884456DF694" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The initial Board shall consist of representatives as described in subparagraphs (A) through (F) of subsection (a)(2).</text></subparagraph><subparagraph id="H5940ED06D4C142C79C2611814D4D9DE7" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Remaining members</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the representatives of the initial Board under subparagraph (A) shall appoint the remaining members of the Board described in subparagraphs (H) through (O) of subsection (a)(2).</text></subparagraph><subparagraph id="H3926A1EFB1DC401CA22C53FFE591F509" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Tribal representatives</header><text display-inline="yes-display-inline">Not later than 60 days after the enactment of this Act, the Secretary shall provide to the Board a recommendation of not fewer than three Tribal representatives, from which the Board shall appoint one representative pursuant to subparagraph (G) of subsection (a)(2).</text></subparagraph></paragraph><paragraph id="H7CBFB8842A764147A6978CB58824C56C" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Staggered terms</header><text display-inline="yes-display-inline">Of the members described in subsection (a)(2)(J) initially appointed to the Board—</text><subparagraph id="H1DCF33B7CC9541C39DD41EED54F682B0" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">two shall be appointed for a term of 1 year;</text></subparagraph><subparagraph id="H873F101C2BDC4D4CBBBF426A679C82E1" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">two shall be appointed for a term of 2 years; and</text></subparagraph><subparagraph id="H1DDDA34324864E5BA09BC423B27D0C00" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">three shall be appointed for a term of 3 years.</text></subparagraph></paragraph><paragraph id="H477F4AE13CFC42DDB6CFA14B5F596B79" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Vacancies</header><subparagraph id="H413952115A9A48F3B249BB2527E38DC7" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A vacancy of a member of the Board described in subparagraph (H), (I), (J), (K), (L), (M), (N), or (O) of subsection (a)(2) shall be filled by an appointment made by the remaining members of the Board.</text></subparagraph><subparagraph id="H12EF001740874DD4B36BF7894AC6B8D4" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Tribal representatives</header><text display-inline="yes-display-inline">Following a vacancy of a member of the Board described in subparagraph (G) of subsection (a)(2), the Secretary shall recommend to the Board a list of not fewer than three Tribal representatives, from which the remaining members of the Board shall appoint a representative to fill the vacancy.</text></subparagraph></paragraph><paragraph id="HB151CFB3A6614A85836166CFFDD535E2" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Continuation of service</header><text display-inline="yes-display-inline">An individual whose term of service as a member of the Board expires may continue to serve on the Board until a successor is appointed.</text></paragraph><paragraph id="H5024AFA4E8634EA08E1593DE51FB09B1" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Removal</header><text display-inline="yes-display-inline">If a member of the Board described in any of subparagraphs (H) through (O) of subparagraph (a)(2) misses three consecutive regularly scheduled Board meetings, the members of the Board may—</text><subparagraph id="HD4ACC462977F4BF886FFC67CC480618C" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">vote to remove that member; and</text></subparagraph><subparagraph id="H346F6F7587B04805B462672B4DC5FE0D" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">appoint another individual in accordance with paragraph (4).</text></subparagraph></paragraph></subsection><subsection id="H0CFE96C725B8489391414DD5F8F645C2" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Chairperson</header><paragraph id="H05FF244E80414EACAF22AC16A76B288E" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The representative of the Association of Fish and Wildlife Agencies appointed under subsection (a)(2)(E) shall serve as Chairperson of the Board.</text></paragraph><paragraph id="HD48DB6A00C884C329AC42FC12E0858EA" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Term</header><text display-inline="yes-display-inline">The Chairperson of the Board shall serve for a term of 3 years.</text></paragraph></subsection><subsection id="H4B926E0AEF674D238C01BDAF93AE97D2" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Meetings</header><paragraph id="H723DCD0ECEBF4729BB882FBDFC08530B" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Board shall meet—</text><subparagraph id="H889A548D01FE4875A73623ADAAB4061C" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">at the call of the Chairperson; but</text></subparagraph><subparagraph id="HD64BF43E74D44C6587BEEEEFE18AF289" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">not less frequently than twice each calendar year.</text></subparagraph></paragraph><paragraph id="HA7ED3A93786A4100BF5CFC5200777AC5" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Public access</header><text display-inline="yes-display-inline">All meetings of the Board shall be open to the public.</text></paragraph></subsection><subsection id="H8230F38748E9414E96CF180E41388E2B" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Procedures</header><paragraph id="H768CE1FDCA974D71A911D3C5C683E0E9" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Board shall establish procedures to carry out the business of the Board, including—</text><subparagraph id="HBB4DBA11D4194296AD7946B521D7BB18" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a requirement that a quorum of the members of the Board be present to transact business;</text></subparagraph><subparagraph id="HB63EEAFB4D5243BE82926FC1B34D08A8" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a requirement that no recommendations may be adopted by the Board, except by the vote of two-thirds of all members;</text></subparagraph><subparagraph id="H6DFA72482D4E4F7585743E8B5A54B05F" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">procedures for establishing national goals and priorities for fish habitat conservation for the purposes of this title;</text></subparagraph><subparagraph display-inline="yes-display-inline">procedures for reviewing, evaluating, and making recommendations regarding fish habitat conservation projects.</text></subparagraph></paragraph><paragraph id="HE8EDC3796D9A4587B3BBFE3D81728F6E" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Quorum</header><text display-inline="yes-display-inline">A majority of the members of the Board shall constitute a quorum.</text></paragraph></subsection></section><section id="H6E3346D0AD3347A1A5341F2EFD63F7BC" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>204.</enum><header display-inline="yes-display-inline">Fish Habitat Partnerships</header><subsection id="HD21CAE40F8384D1BA0454A6D56A9E3CC" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Authority To recommend</header><text display-inline="yes-display-inline">The Board may recommend to Congress the designation of Fish Habitat Partnerships in accordance with this section.</text></subsection><subsection id="H863862BAC065475B912A93FF2472AF41" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of a Partnership shall be—</text><paragraph id="HFD9F0EAFCFFD40E191D12CA7A963C35D" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">to work with other regional habitat conservation programs to promote cooperation and coordination to enhance fish populations and fish habitats;</text></paragraph><paragraph id="H4AA114E8E3F74E78B40B77BF86F813F0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">to engage local and regional communities to build support for fish habitat conservation;</text></paragraph><paragraph id="H6949550AC1324780AA578E053BCD9669" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">to involve diverse groups of public and private partners;</text></paragraph><paragraph id="HE89F9F5627A041B093EEE0A0C5020675" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">to develop collaboratively a strategic vision and achievable implementation plan that is scientifically sound;</text></paragraph><paragraph id="HC9477360D0F84B289CD4058025A91E84" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">to leverage funding from sources that support local and regional partnerships;</text></paragraph><paragraph id="H512569BBF1C04E0B857445490F407FE6" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">to use adaptive management principles, including evaluation of project success and functionality;</text></paragraph><paragraph id="H0EA210D427CC4D5F8CFE6BD736EFF273" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">to develop appropriate local or regional habitat evaluation and assessment measures and criteria that are compatible with national habitat condition measures; and</text></paragraph><paragraph id="H5A353E278C0748BDA293E8C6E7C2B5D8" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">to implement local and regional priority projects that improve conditions for fish and fish habitat.</text></paragraph></subsection><subsection id="H5D330E336B074C7A8D4FD583CA16AEEE" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Criteria for designation</header><text display-inline="yes-display-inline">An entity seeking to be designated by Congress as a Partnership shall—</text><paragraph id="H0F61CFF257794773A885801C39E92206" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">submit to the Board an application at such time, in such manner, and containing such information as the Board may reasonably require; and</text></paragraph><paragraph id="HBC9F8BCE3A7542649A7B6EA89D941E81" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">demonstrate to the Board that the entity has—</text><subparagraph id="H1859E28879F34CDFA3B4B0338DC86133" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a focus on promoting the health of important fish and fish habitats;</text></subparagraph><subparagraph id="H0FCB551B5D35485F835A333E62EE5E70" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">an ability to coordinate the implementation of priority projects that support the goals and national priorities set by the Board that are within the Partnership boundary;</text></subparagraph><subparagraph id="HD06BB71A35654CFFA83C24E9811A301E" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">a self-governance structure that supports the implementation of strategic priorities for fish habitat;</text></subparagraph><subparagraph id="H04F2EF6CF4A74209A7A0008309BA1E03" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the ability to develop local and regional relationships with a broad range of entities to further strategic priorities for fish and fish habitat;</text></subparagraph><subparagraph id="H47455F3021F3479AA3AB321E5E77B2C0" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">a strategic plan that details required investments for fish habitat conservation that addresses the strategic fish habitat priorities of the Partnership and supports and meets the strategic priorities of the Board;</text></subparagraph><subparagraph id="H34D665E440D64F4385208B9CD1E1EA63" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">the ability to develop and implement fish habitat conservation projects that address strategic priorities of the Partnership and the Board; and</text></subparagraph><subparagraph id="HB003384AF3AB47A3AA1C644F27D9E7B0" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">the ability to develop fish habitat conservation priorities based on sound science and data, the ability to measure the effectiveness of fish habitat projects of the Partnership, and a clear plan as to how Partnership science and data components will be integrated with the overall Board science and data effort.</text></subparagraph></paragraph></subsection><subsection id="H04F38B42C7814E59B0725206C838A0E6" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Requirements for recommendation to Congress</header><text display-inline="yes-display-inline">The Board may recommend to Congress for designation an application for a Partnership submitted under subsection (c) if the Board determines that the applicant—</text><paragraph id="HB87332F04AC64175ABCB97C789A05BE6" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">meets the criteria described in subsection (c)(2);</text></paragraph><paragraph id="HD576E06FF2164B068AE2DE36E36278F7" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">identifies representatives to provide support and technical assistance to the Partnership from a diverse group of public and private partners, which may include State or local governments, nonprofit entities, Indian Tribes, and private individuals, that are focused on conservation of fish habitats to achieve results across jurisdictional boundaries on public and private land;</text></paragraph><paragraph id="HCEECBA05580C49C5ABE9384431719647" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">is organized to promote the health of important fish species and important fish habitats, including reservoirs, natural lakes, coastal and marine environments, coral reefs, and estuaries;</text></paragraph><paragraph id="H574266AD1F5D4A3CADEF77C8F2013DD5" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">identifies strategic fish and fish habitat priorities for the Partnership area in the form of geographical focus areas or key stressors or impairments to facilitate strategic planning and decision making;</text></paragraph><paragraph id="H36789365E4534BBFBF33AA38C08ECC22" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">is able to address issues and priorities on a nationally significant scale;</text></paragraph><paragraph id="H93289746677B4B15AC72ABAFFA83E6CD" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">includes a governance structure that—</text><subparagraph id="H5A823E9638B64DF5AD9D99AE909B756A" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">reflects the range of all partners; and</text></subparagraph><subparagraph id="H1F7B0970307B4BB1978FEA074C8CC383" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">promotes joint strategic planning and decision making by the applicant;</text></subparagraph></paragraph><paragraph id="H0B3B5506059141C2BAA7713BB4A7D1BB" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">demonstrates completion of, or significant progress toward the development of, a strategic plan to address declines in fish populations, rather than simply treating symptoms, in accordance with the goals and national priorities established by the Board; and</text></paragraph><paragraph id="HAE672932241F41048789DE46D6BEDC4E" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">promotes collaboration in developing a strategic vision and implementation program that is scientifically sound and achievable.</text></paragraph></subsection><subsection id="H5B70A7D191CC4D21B6883FEAC4EFA1C0" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Report to Congress</header><paragraph id="HED19A9C9D0534797A830CB5C424CC4B6" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than February 1 of the first fiscal year beginning after the date of enactment of this Act and each February 1 thereafter, the Board shall develop and submit to the appropriate congressional committees an annual report, to be entitled <quote>Report to Congress on Future Fish Habitat Partnerships and Modifications</quote>, that—</text><subparagraph id="H7A9E98AE0BA54341B9776C5E671391D3" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">identifies each entity that—</text><clause id="HBB8402671DBA4044A33487AAE8CC63A4" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">meets the requirements described in subsection (d); and</text></clause><clause id="H334BAFDFBF2C42AA885235C4DC27188A" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the Board recommends to Congress for designation as a Partnership;</text></clause></subparagraph><subparagraph id="HE75F28AAAFE342418373A30C0EF3B89A" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">describes any proposed modifications to a Partnership previously designated by Congress under subsection (f);</text></subparagraph><subparagraph id="HED76D043F9EE46E983AE9E54FFAD0C1E" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to each entity recommended for designation as a Partnership, describes, to the maximum extent practicable—</text><clause id="HBC04784794CD46598BBD92782A9F018F" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the purpose of the recommended Partnership; and</text></clause><clause id="H816FB33B94F14A058E28861B03C98942" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">how the recommended Partnership fulfills the requirements described in subsection (d).</text></clause></subparagraph></paragraph><paragraph id="H9C9675685B81426D9D4DD3BEB326FBC4" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Public availability; notification</header><text display-inline="yes-display-inline">The Board shall—</text><subparagraph id="H9E6B82B331574A5589CBF119368A6E50" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">make the report publicly available, including on the internet; and</text></subparagraph><subparagraph id="H865F87B1D2134677A3AF182236664937" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">provide to the appropriate congressional committees and the State agency of any State included in a recommended Partnership area written notification of the public availability of the report.</text></subparagraph></paragraph></subsection><subsection id="H4FC7B78257AA4E759828F65FC3922726" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Designation or modification of Partnership</header><text display-inline="yes-display-inline">Congress shall have the exclusive authority to designate or modify a Partnership.</text></subsection><subsection id="H3F6026DC94CD430AB4886F0EE7436638" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Existing Partnerships</header><paragraph id="H270B30533AD949BF94DE5F4D73724E09" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Designation review</header><text display-inline="yes-display-inline">Not later than 5 years after the date of enactment of this Act, any partnership receiving Federal funds as of the date of enactment of this Act shall be subject to a designation review by Congress in which Congress shall have the opportunity to designate the partnership under subsection (f).</text></paragraph><paragraph id="H761F59B59A014C17BA3B3A1080B39C95" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Ineligibility for Federal funds</header><text display-inline="yes-display-inline">A partnership referred to in paragraph (1) that Congress does not designate as described in that paragraph shall be ineligible to receive Federal funds under this title.</text></paragraph></subsection></section><section id="H0B3F90ECC7414FACBE8E94A7E7DD5221" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>205.</enum><header display-inline="yes-display-inline">Fish Habitat Conservation Projects</header><subsection id="H96B66D1615814DBE89779CA1CD862EB2" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Submission to Board</header><text display-inline="yes-display-inline">Not later than March 31 of each year, each Partnership shall submit to the Board a list of priority fish habitat conservation projects recommended by the Partnership for annual funding under this title.</text></subsection><subsection id="HF568AA210D9E4F3A9AFAE6A2258FAABE" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Recommendations by Board</header><text display-inline="yes-display-inline">Not later than July 1 of each year, the Board shall submit to the Secretary a priority list of fish habitat conservation projects that includes a description, including estimated costs, of each project that the Board recommends that the Secretary approve and fund under this title for the following fiscal year.</text></subsection><subsection id="H820D58A1AB3443A6AB5468FC5012CD34" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Criteria for project selection</header><text display-inline="yes-display-inline">The Board shall select each fish habitat conservation project recommended to the Secretary under subsection (b) after taking into consideration, at a minimum, the following information:</text><paragraph id="H1CD2590945EA4C9F9590173C3631311C" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">A recommendation of the Partnership that is, or will be, participating actively in implementing the fish habitat conservation project.</text></paragraph><paragraph id="H07233A40F68547A49B8ED1AA649C97F0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">The capabilities and experience of project proponents to implement successfully the proposed project.</text></paragraph><paragraph id="HE366F7C6C1414425AAFA958D195279AA" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">The extent to which the fish habitat conservation project—</text><subparagraph id="HCE192873897642F4BCF04557297B1EB5" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">fulfills a local or regional priority that is directly linked to the strategic plan of the Partnership and is consistent with the purpose of this title;</text></subparagraph><subparagraph id="HEFFDC8FA6FD741D484B7267127996B62" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">addresses the national priorities established by the Board;</text></subparagraph><subparagraph id="H3A4EA388C48F4FAF90E35F5115D324E7" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">is supported by the findings of the habitat assessment of the Partnership or the Board, and aligns or is compatible with other conservation plans;</text></subparagraph><subparagraph id="H65C4177F3B5E48EA984F029F54C77FBE" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">identifies appropriate monitoring and evaluation measures and criteria that are compatible with national measures;</text></subparagraph><subparagraph id="HA4FF52D90EDA48DF87B3ECC98453574E" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">provides a well-defined budget linked to deliverables and outcomes;</text></subparagraph><subparagraph id="HE43740F91BD04B608FC62BDB25527AFF" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">leverages other funds to implement the project;</text></subparagraph><subparagraph id="H9E8B555609A94DD6BDB85E1E462A1463" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">addresses the causes and processes behind the decline of fish or fish habitats; and</text></subparagraph><subparagraph id="H56CC8886A11540B785A60255F4E99ED1" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">includes an outreach or education component that includes the local or regional community.</text></subparagraph></paragraph><paragraph id="H247FB8A5CE104F5BA3AF1C5F05D8EA49" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">The availability of sufficient non-Federal funds to match Federal contributions for the fish habitat conservation project, as required by subsection (e).</text></paragraph><paragraph id="H5831DA1FA61F47899700D1FE53E4C1F1" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">The extent to which the fish habitat conservation project—</text><subparagraph id="H315306952D13439AACEF1C15CECE66DA" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">will increase fish populations in a manner that leads to recreational fishing opportunities for the public;</text></subparagraph><subparagraph id="H8DB979BAE89F4B8B9AFA9B6A0082B740" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">will be carried out through a cooperative agreement among Federal, State, and local governments, Indian Tribes, and private entities;</text></subparagraph><subparagraph id="HBA193E2CCD2B4D86AC552FD36F462709" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">increases public access to land or water for fish and wildlife-dependent recreational opportunities;</text></subparagraph><subparagraph id="H67F7AD2DAA4F412BAB649B1FDCA80E38" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">advances the conservation of fish and wildlife species that have been identified by a State agency as species of greatest conservation need;</text></subparagraph><subparagraph id="H815EA5492FD14A16A6796376CF908D78" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">where appropriate, advances the conservation of fish and fish habitats under the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801</external-xref> et seq.) and other relevant Federal law and State wildlife action plans; and</text></subparagraph><subparagraph id="H221B60A9CE29489E92A4710EBB034FCC" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">promotes strong and healthy fish habitats so that desired biological communities are able to persist and adapt.</text></subparagraph></paragraph><paragraph id="H7C4AA5179D05417AB941376E596B6B79" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">The substantiality of the character and design of the fish habitat conservation project.</text></paragraph></subsection><subsection id="H5DA5FB21BF344DFEBCB5637E814370E5" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Limitations</header><paragraph id="HE6FC56FCF904478EA155159051B7AE1F" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Requirements for evaluation</header><text display-inline="yes-display-inline">No fish habitat conservation project may be recommended by the Board under subsection (b) or provided financial assistance under this title unless the fish habitat conservation project includes an evaluation plan designed using applicable Board guidance—</text><subparagraph id="H91D068F655894ED795945C554D46D56E" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to appropriately assess the biological, ecological, or other results of the habitat protection, restoration, or enhancement activities carried out using the assistance;</text></subparagraph><subparagraph id="HA85F56F17CE148ED9281FB73510AE348" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to reflect appropriate changes to the fish habitat conservation project if the assessment substantiates that the fish habitat conservation project objectives are not being met;</text></subparagraph><subparagraph id="H492C94ACDD7048BA9B2ABBDCB6B3E3DB" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">to identify improvements to existing fish populations, recreational fishing opportunities, and the overall economic benefits for the local community of the fish habitat conservation project; and</text></subparagraph><subparagraph id="H5A4C3001E702416E94E1B3A5045859B2" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">to require the submission to the Board of a report describing the findings of the assessment.</text></subparagraph></paragraph><paragraph id="H2FB8162FAF974C89AB33DF11424FDD49" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Acquisition authorities</header><subparagraph id="H6C5854892C6746DE93306356F501549F" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State, local government, or other non-Federal entity is eligible to receive funds for the acquisition of real property from willing sellers under this title if the acquisition ensures—</text><clause id="H6D8C98F8B23147B49167FDDBFFFA7C4F" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">public access for fish and wildlife-dependent recreation; or</text></clause><clause id="H3AE8524A65FA4582BFDD53F198768840" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a scientifically based, direct enhancement to the health of fish and fish populations, as determined by the Board.</text></clause></subparagraph><subparagraph id="H652A9F01426341E8B08F23F6C72DA6D6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">State agency approval</header><clause id="HBC15FBC69965451EB77E230BD8ADFB70" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">All real property interest acquisition projects funded under this title must be approved by the State agency in the State in which the project is occurring.</text></clause><clause id="H1629901014C647C6B54A4D1199AC5794" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">The Board may not recommend, and the Secretary may not provide any funding for, any real property interest acquisition that has not been approved by the State agency.</text></clause></subparagraph><subparagraph id="H90E60352E023435A85C920B7B203C6EA" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Assessment of other authorities</header><text display-inline="yes-display-inline">The Board may not recommend, and the Secretary may not provide any funding under this title for, any real property interest acquisition unless the Partnership that recommended the project has conducted a project assessment, submitted with the funding request and approved by the Board, to demonstrate all other Federal, State, and local authorities for the acquisition of real property have been exhausted.</text></subparagraph><subparagraph id="H84A37F30B50A4BFF906976CEED4DAFE0" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Restrictions</header><text display-inline="yes-display-inline">A real property interest may not be acquired pursuant to a fish habitat conservation project by a State, local government, or other non-Federal entity conducted with funds provided under this title, unless—</text><clause id="HFA8432E4771942B4827EC59302C76D8B" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the owner of the real property authorizes the State, local government, or other non-Federal entity to acquire the real property; and</text></clause><clause id="H2A2EEBDA6A3F4AD992FBF8CA09D8F199" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary and the Board determine that the State, local government, or other non-Federal entity would benefit from undertaking the management of the real property being acquired because that is in accordance with the goals of a Partnership.</text></clause></subparagraph></paragraph></subsection><subsection id="H4EC879B7D42C48C38A674C48D666790F" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Non-Federal contributions</header><paragraph id="H1557BF4104DA45E7BA6D9040BC381F6D" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraphs (2) and (4), no fish habitat conservation project may be recommended by the Board under subsection (b) or provided financial assistance under this title unless at least 50 percent of the cost of the fish habitat conservation project will be funded with non-Federal funds.</text></paragraph><paragraph id="H9BE73F6D7E3148319569E77550CA9385" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Non-Federal share</header><text display-inline="yes-display-inline">Such non-Federal share of the cost of a fish habitat conservation project—</text><subparagraph id="H8BF9BB8A11BD46DB8B4407DAA6C99CC1" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">may not be derived from another Federal grant program; and</text></subparagraph><subparagraph id="H08E1370C246E441B89434BB997C9C8B0" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">may include in-kind contributions and cash.</text></subparagraph></paragraph><paragraph id="HF158AFBFB59642479A1283D4E2366E2D" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Special rule for Indian Tribes</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1) or any other provision of law, any funds made available to an Indian Tribe pursuant to this title may be considered to be non-Federal funds for the purpose of paragraph (1).</text></paragraph><paragraph id="H9665272CCA5541D186577D8B1F5229FC" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Waiver authority</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Commerce with respect to marine or estuarine projects, may waive the application of paragraph (2)(A) with respect to a State or an Indian Tribe, or otherwise reduce the portion of the non-Federal share of the cost of an activity required to be paid by a State or an Indian Tribe under paragraph (1), if the Secretary determines that the State or Indian Tribe does not have sufficient funds not derived from another Federal grant program to pay such non-Federal share, or portion of the non-Federal share, without the use of loans.</text></paragraph></subsection><subsection id="H9813773E09A244CDBE79B3DB4B99C07B" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Approval</header><paragraph id="HE41379E0A4854A408F1C4D874A91541D" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of receipt of the recommended priority list of fish habitat conservation projects under subsection (b), and subject to subsection (d) and based, to the maximum extent practicable, on the criteria described in subsection (c), the Secretary, after consulting with the Secretary of Commerce on marine or estuarine projects, shall approve or reject any fish habitat conservation project recommended by the Board.</text></paragraph><paragraph id="H5730C092E0874BF99307FE28429D72AB" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">If the Secretary approves a fish habitat conservation project under paragraph (1), the Secretary shall use amounts made available to carry out this title to provide funds to carry out the fish habitat conservation project.</text></paragraph><paragraph id="H0ED72033F54E4AD5ABB79594C47543E5" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Notification</header><text display-inline="yes-display-inline">If the Secretary rejects under paragraph (1) any fish habitat conservation project recommended by the Board, not later than 90 days after the date of receipt of the recommendation, the Secretary shall provide to the Board, the appropriate Partnership, and the appropriate congressional committees a written statement of the reasons that the Secretary rejected the fish habitat conservation project.</text></paragraph></subsection></section><section id="HDF5FE8879FB94172822EAC2398642DAF" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>206.</enum><header display-inline="yes-display-inline">Technical and scientific assistance</header><subsection id="HD54526377D20477B95AC2CD22F4C0E3B" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director, the National Oceanic and Atmospheric Administration Assistant Administrator, the Environmental Protection Agency Assistant Administrator, and the Director of the United States Geological Survey, in coordination with the Forest Service and other appropriate Federal departments and agencies, may provide scientific and technical assistance to Partnerships, participants in fish habitat conservation projects, and the Board.</text></subsection><subsection id="H0D2A094B8A874058964BC9291CED7FA6" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">Scientific and technical assistance provided under subsection (a) may include—</text><paragraph id="H3F23DAC5FF994294B2AA6514E99FA9E8" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">providing technical and scientific assistance to States, Indian Tribes, regions, local communities, and nongovernmental organizations in the development and implementation of Partnerships;</text></paragraph><paragraph id="H98AC081498B4412FBC76FA9300429BD2" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">providing technical and scientific assistance to Partnerships for habitat assessment, strategic planning, and prioritization;</text></paragraph><paragraph id="H478FDFE9FB4741D6BDF1D5167937847A" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">supporting the development and implementation of fish habitat conservation projects that are identified as high priorities by Partnerships and the Board;</text></paragraph><paragraph id="H507044F34B5F4407B919975E64D5D0F6" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">supporting and providing recommendations regarding the development of science-based monitoring and assessment approaches for implementation through Partnerships;</text></paragraph><paragraph id="H4FDAC24FF0C8426383B98F3597400F9E" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">supporting and providing recommendations for a national fish habitat assessment;</text></paragraph><paragraph id="H59AF0106FDC3420B9C5242513DBE3745" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">ensuring the availability of experts to assist in conducting scientifically based evaluation and reporting of the results of fish habitat conservation projects; and</text></paragraph><paragraph id="H0AD156EC961845D6A15FD8B4A5674815" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">providing resources to secure State agency scientific and technical assistance to support Partnerships, participants in fish habitat conservation projects, and the Board.</text></paragraph></subsection></section><section id="HE1E35EAF741F45B9B4E2AA4B44D65AD1" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>207.</enum><header display-inline="yes-display-inline">Coordination with States and Indian Tribes</header><text display-inline="no-display-inline">The Secretary shall provide a notice to, and cooperate with, the appropriate State agency or Tribal agency, as applicable, of each State and Indian Tribe within the boundaries of which an activity is planned to be carried out pursuant to this title, including notification, by not later than 30 days before the date on which the activity is implemented.</text></section><section id="HF6F1A3931649432A8A14FA6050237247" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>208.</enum><header display-inline="yes-display-inline">Interagency Operational Plan</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and every 5 years thereafter, the Director, in cooperation with the National Oceanic and Atmospheric Administration Assistant Administrator, the Environmental Protection Agency Assistant Administrator, the Director of the United States Geological Survey, and the heads of other appropriate Federal departments and agencies (including, at a minimum, those agencies represented on the Board) shall develop an interagency operational plan that describes—</text><paragraph id="HD2481E0A448C4B648586B633B3F6F875" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the functional, operational, technical, scientific, and general staff, administrative, and material needs for the implementation of this title; and</text></paragraph><paragraph id="HBF9557D2980D49DA9BA59884AA8A6ED2" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">any interagency agreements between or among Federal departments and agencies to address those needs.</text></paragraph></section><section id="H848A1A1AAEF641F3974A7D5074AD17F4" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>209.</enum><header display-inline="yes-display-inline">Accountability and reporting</header><subsection id="H45C1F89D777F4EE49F48A38665312924" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Reporting</header><paragraph id="HAC340B72ECA7435DA363A75465BF9A98" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 5 years after the date of enactment of this Act, and every 5 years thereafter, the Board shall submit to the appropriate congressional committees a report describing the progress of this title.</text></paragraph><paragraph id="H3B3799C5038744BA95621D4E4E23A98F" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report submitted under paragraph (1) shall include—</text><subparagraph id="H5A4B9CA0370E40FA910A6669DD7B31B1" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an estimate of the number of acres, stream miles, or acre-feet, or other suitable measures of fish habitat, that was maintained or improved by Partnerships under this title during the 5-year period ending on the date of submission of the report;</text></subparagraph><subparagraph id="HF801290DE2CB450A91D8C3BF9851F085" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a description of the public access to fish habitats established or improved under this title during that 5-year period;</text></subparagraph><subparagraph id="H7FCBA64738E24A4D9ACDD5C507737D4D" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">a description of the improved opportunities for public recreational fishing achieved under this title; and</text></subparagraph><subparagraph id="HF8480D8C6BA84DAD84DAFAE65D1E898E" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">an assessment of the status of fish habitat conservation projects carried out with funds provided under this title during that period, disaggregated by year, including—</text><clause id="H3747FFDA9A514C8C90598A41DDEE46B1" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">a description of the fish habitat conservation projects recommended by the Board under section 205(b);</text></clause><clause id="H6963BE3DECC643379DA8B3C032F493A8" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a description of each fish habitat conservation project approved by the Secretary under section 205(f), in order of priority for funding;</text></clause><clause id="H71B73A40895D47738AEAC33E4906BAF8" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">a justification for—</text><subclause id="HE1D3B29F62234C099B9F1040DE7A3650" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the approval of each fish habitat conservation project; and</text></subclause><subclause id="H7F07EEE746B4443ABB1DDFE6558F1E0D" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">the order of priority for funding of each fish habitat conservation project;</text></subclause></clause><clause id="H1FA0142CF17048FAA2A6E07F36FB809A" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">a justification for any rejection of a fish habitat conservation project recommended by the Board under section 205(b) that was based on a factor other than the criteria described in section 205(c); and</text></clause><clause id="H306533777C794C5E9B6E00D93C89149C" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">an accounting of expenditures by Federal, State, or local governments, Indian Tribes, or other entities to carry out fish habitat conservation projects under this title.</text></clause></subparagraph></paragraph></subsection><subsection id="HACA552F67E5B47AAA2F56D0AA7234D8D" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Status and trends report</header><text display-inline="yes-display-inline">Not later than December 31, 2021, and every 5 years thereafter, the Board shall submit to the appropriate congressional committees a report that includes—</text><paragraph id="H763422CA7E684F40958BF51C1CD8C5AD" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">a status of all Partnerships designated under this title;</text></paragraph><paragraph id="H3291F0DAB5094948A97B5A07FE289FCC" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the status of fish habitats in the United States as identified by designated Partnerships; and</text></paragraph><paragraph id="HEEB9A930AFF44BB487FDF1E218727E00" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">enhancements or reductions in public access as a result of—</text><subparagraph id="HECE33079591F44DAA1564F9021F819D6" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the activities of the Partnerships; or</text></subparagraph><subparagraph id="HF7D3A50D139649A6AA90948EF8DE6FCE" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">any other activities carried out pursuant to this title.</text></subparagraph></paragraph></subsection></section><section id="H1DA9453265B4470BA9AF12E9543064C9" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>210.</enum><header display-inline="yes-display-inline">Effect of this title</header><subsection id="H988ED40176F14855AD85D57344AB0D7F" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Water rights</header><text display-inline="yes-display-inline">Nothing in this title—</text><paragraph id="H9E3F1B3EF331471980732F51413F45E1" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">establishes any express or implied reserved water right in the United States for any purpose;</text></paragraph><paragraph id="HB41B57E28BE1467D926AE9BD144FCED9" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">affects any water right in existence on the date of enactment of this Act;</text></paragraph><paragraph id="HE16288F38F744C8990FA37CC4799CBA8" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">preempts or affects any State water law or interstate compact governing water; or</text></paragraph><paragraph id="HFED0C9D5EAB94F6E8C84CD15FC0404E1" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">affects any Federal or State law in existence on the date of enactment of the Act regarding water quality or water quantity.</text></paragraph></subsection><subsection id="H1CAED4AEF36C4E3FB4295C4504F92636" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Authority To acquire water rights or rights to property</header><text display-inline="yes-display-inline">Only a State, local government, or other non-Federal entity may acquire, under State law, water rights or rights to property with funds made available through section 212.</text></subsection><subsection id="H74A47BE77D8147AA891CFAA81743A308" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">State authority</header><text display-inline="yes-display-inline">Nothing in this title—</text><paragraph id="H90A2752B7DD44F6E87E92C88D51F44C4" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">affects the authority, jurisdiction, or responsibility of a State to manage, control, or regulate fish and display-inline="yes-display-inline">authorizes the Secretary to control or regulate within a State the fishing or hunting of fish and wildlife.</text></paragraph></subsection><subsection display-inline="yes-display-inline">Nothing in this title abrogates, abridges, affects, modifies, supersedes, or alters any right of an Indian Tribe recognized by treaty or any other means, including—</text><paragraph id="H83D3FE060731464C8C2DDCF0C3E4C9A0" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">an agreement between the Indian Tribe and the United States;</text></paragraph><paragraph id="HFD035C8AFE0347E0A89E955A8BFE7206" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text this title diminishes or affects the ability of the Secretary to join an adjudication of rights to the use of water pursuant to subsection (a), (b), or (c) of section 208 of the Departments of State, Justice, Commerce, and The Judiciary Appropriation Act, 1953 (<external-xref legal-doc="usc" parsable-cite="usc/43/666">43 U.S.C. 666</external-xref>).</text></subsection><subsection or</text></paragraph><paragraph id="H0EA04073044E4CE18AFC544EE89BD16F" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">any Partnership.</text></paragraph></section><section id="H2622CAE7EC944B118B62F58D58458162" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>212.</enum><header display-inline="yes-display-inline">Funding</header><subsection id="H2344229FA12C4CDB8D1B831256121181" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><paragraph id="HFA1DDAB257F84308A8E051DE2CE86615" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Fish Habitat Conservation Projects</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary $7,200,000 for each of fiscal years 2021 through 2025 to provide funds for fish habitat conservation projects approved under section 205(f), of which 5 percent is authorized only for projects carried out by Indian Tribes.</text></paragraph><paragraph id="H6CB9AF11453D407AA5830FFFA31E22D1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Administrative and planning expenses</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary for each of fiscal years 2021 through 2025 an amount equal to 5 percent of the amount appropriated for the applicable fiscal year pursuant to paragraph (1)—</text><subparagraph id="H8005AD03E21646D48D8C32B06CEEC0F8" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">for administrative and planning expenses under this title; and</text></subparagraph><subparagraph id="HC786CB6F9F354F69B114421EDE7B5497" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to carry out section 209.</text></subparagraph></paragraph><paragraph id="H1DE097C917B142A79561AAB8CC227DA5" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Technical and scientific assistance</header><text display-inline="yes-display-inline">There is authorized to be appropriated for each of fiscal years 2021 through 2025 to carry out, and provide technical and scientific assistance under, section 206—</text><subparagraph id="H438F1DFC5BFA46F0B327D85061323861" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">$400,000 to the Secretary for use by the United States Fish and Wildlife Service;</text></subparagraph><subparagraph id="H3DB9B2B787104827842AE3A68280A1E5" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">$400,000 to the National Oceanic and Atmospheric Administration Assistant Administrator for use by the National Oceanic and Atmospheric Administration;</text></subparagraph><subparagraph id="H11524305B4034E54AE7279C87590AD84" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">$400,000 to the Environmental Protection Agency Assistant Administrator for use by the Environmental Protection Agency;</text></subparagraph><subparagraph id="H17C3C45E92AB4CC9909CA90D5BFDD126" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">$400,000 to the Secretary for use by the United States Geological Survey; and</text></subparagraph><subparagraph id="HC8FFAD895EE74C7E8E1B0BD312A3AA27" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">$400,000 to the Secretary of Agriculture, acting through the Chief of the Forest Service, for use by the Forest Service.</text></subparagraph></paragraph></subsection><subsection id="HB444CB4E4DD14FCE84FEB267FFEA20AD" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Agreements and grants</header><text display-inline="yes-display-inline">The Secretary may—</text><paragraph id="HB0014D0EC9544C2AB671C6A0F6FBAE71" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">on the recommendation of the Board, and notwithstanding sections 6304 and 6305 of title 31, United States Code, and the Federal Financial Assistance Management Improvement Act of 1999 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/107">Public Law 106–107</external-xref>), enter into a grant agreement, cooperative agreement, or contract with a Partnership or other entity to provide funds authorized by this title for a fish habitat conservation project or restoration or enhancement project;</text></paragraph><paragraph id="HD37B6D04352A4B2DA6E20378FA32A90C" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">apply for, accept, and, subject to the availability of appropriations, use a grant from any individual or entity to carry out the purposes of this title; and</text></paragraph><paragraph id="H8E5D44ACCF484ED0B31B046DD54D2B43" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">subject to the availability of appropriations, make funds authorized by this Act available to any Federal department or agency for use by that department or agency to provide grants for any fish habitat protection project, restoration project, or enhancement project that the Secretary determines to be consistent with this title.</text></paragraph></subsection><subsection id="HB3A0D5885FB34C9AA524986883569E04" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Donations</header><paragraph id="HAC0E2454444E4247B4AE821700E8D704" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may—</text><subparagraph id="H95430A49F8BB4C3F9A671446091501C9" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">enter into an agreement with any organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 that is exempt from taxation under section 501(a) of that Code to solicit private donations to carry out the purposes of this title; and</text></subparagraph><subparagraph id="H5A3759D0EE75419EA18B7ED4AEFFE829" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">accept donations of funds, property, and services to carry out the purposes of this title.</text></subparagraph></paragraph><paragraph id="HCE4615D049E24659B530DE7DB0B44768" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Treatment</header><text display-inline="yes-display-inline">A donation accepted under this title—</text><subparagraph id="H2B55D9AA2394438E981AFD2298BC15FE" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">shall be considered to be a gift or bequest to, or otherwise for the use of, the United States; and</text></subparagraph><subparagraph id="H8A486B01D5A141A8998F602CEDA37BB3" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">may be—</text><clause id="HE6483EC20A744C9B858D822B8554BD39" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">used directly by the Secretary; or</text></clause><clause id="H3805528389B04877B21D0DC4BB82669D" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">provided to another Federal department or agency through an interagency agreement.</text></clause></subparagraph></paragraph></subsection></section><section id="HF353FCA0D13F462A957ED8D0A5DD5DBF" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>213.</enum><header display-inline="yes-display-inline">Prohibition against implementation of regulatory authority by Federal agencies through Partnerships</header><text display-inline="no-display-inline">Any Partnership designated under this title—</text><paragraph id="H991425804BFA469C96009F663499CBF6" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">shall be for the sole purpose of promoting fish conservation; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7C9C92BF4CCD45F5B4891F4790800E32"><enum>(2)</enum><text display-inline="yes-display-inline">shall not be used to implement any regulatory authority of any Federal agency.</text></paragraph></section><enum>III</enum><header display-inline="yes-display-inline">Miscellaneous</header><section id="H163BC729EEEB47E9AF85555F5B84876F" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Study to review conservation factors</header><subsection id="HA7B4E42006E744D1847EE4EDE856056E" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of Secretaries</header><text display-inline="yes-display-inline">In this section, the term <term>Secretaries</term> means—</text><paragraph id="HEC9F452584DD443883C0677C96AA2E40" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture;</text></paragraph><paragraph id="H5EBA48AB8F18418DB80971E293F5DF39" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of Commerce, acting through the Assistant Administrator of the National Marine Fisheries Service; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0DD0E7DB9F9B4F16A45CA8443830781E"><enum>(3)</enum><text display-inline="yes-display-inline">the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service.</text></paragraph></subsection><subsection id="H2D1FB9B709C54013BDF62BF0612DFEA3" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Study</header><text display-inline="yes-display-inline">To assess factors affecting successful conservation activities under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.), the Secretaries shall carry out a study—</text><paragraph id="idc16f61df25e448af8ef14c746586f914" commented="no" display-inline="no-display-inline"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idEBBFE471130E4C0AA488CF9B6B297E50"><enum>(A)</enum><text display-inline="yes-display-inline">to review any factors that threaten or endanger a species, such as wildlife disease, for which a listing under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) would not contribute to the conservation of the species; and </text></subparagraph><subparagraph id="id9B2E5645AE574055A97AE8DC2B93A5BA" indent="up1" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to identify additional conservation measures that can be taken to protect and conserve a species described in subparagraph (A);</text></subparagraph></paragraph><paragraph id="HF090113145C845719E2246EFAEE948D9" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">to review any barriers to—</text><subparagraph id="HF3C5F4BA6E1F46AB9E9F92B758E1FDAF" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the delivery of Federal, State, local, or private funds for such conservation activities, including statutory or regulatory impediments, staffing needs, and other relevant considerations; or</text></subparagraph><subparagraph id="HFC2F47EFEE5B476CA1AB5498EF4FC56F" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the implementation of conservation agreements, plans, or other cooperative agreements, including agreements focused on voluntary activities, multispecies efforts, and other relevant considerations;</text></subparagraph></paragraph><paragraph id="H9EB15AA583584289AF0423B74B1B0BA2" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">to review factors that impact the ability of the Federal Government to successfully implement the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.);</text></paragraph><paragraph id="H0E2676154503486BA8155CC046D78B2E" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">to develop recommendations regarding methods to address barriers identified under paragraph (2), if any;</text></paragraph><paragraph id="HF2BB8B934FF0400EB5EE9F927ADB6289" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">to review determinations under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) in which a species is determined to be recovered by the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service, or the Secretary of Commerce, acting through the Assistant Administrator of the National Marine Fisheries Service, but remains listed under that Act, including—</text><subparagraph id="H5D461E382A344A809B470C25EC83823B" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an explanation of the factors preventing a delisting or downlisting of the species; and</text></subparagraph><subparagraph id="H3A6FB04134D34E97B60D817A08F0520A" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations regarding methods to address the factors described in subparagraph (A); and</text></subparagraph></paragraph><paragraph id="H0F3CB7DFE1DD475F9DAB2EC038EE706F" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">to review any determinations under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) in which a species has been identified as needing listing or uplisting under that Act but remains unlisted or listed as a threatened species, respectively, including—</text><subparagraph id="H821507C9F77245E79349C374DBD9C188" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an explanation of the factors preventing a listing or uplisting of the species; and</text></subparagraph><subparagraph id="HF847CBCF87B742D184A4AE04695CFCAA" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations regarding methods to address the factors described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="HD66074041430441C91150DADA887DC72" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretaries shall submit to the Committees on Appropriations and Environment and Public Works of the Senate and the Committees on Appropriations and Natural Resources of the House of Representatives and make publicly available a report describing the results of the study under subsection (b).</text></subsection></section><section id="H3F4BE7BF8251488F90BB44ABC41534B7" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Study and report on expenditures</header><subsection id="H13E3637E37BD4B488E67AF26C7288F45" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Reports on expenditures</header><paragraph id="H3B39E8DD285B4F5AA0D16D7F9F4E4784" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Federal departments and agencies</header><subparagraph id="HD4B7D21AA9924640AFD7B347F4AB04AA" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">At the determination of the Comptroller General of the United States (referred to in this section as the <term>Comptroller General</term>), to facilitate the preparation of the reports from the Comptroller General under paragraph (2), the head of each Federal department and agency shall submit to the Comptroller General data and other relevant information that describes the amounts expended or disbursed (including through loans, loan guarantees, grants, or any other financing mechanism) by the department or agency as a direct result of any provision of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) (including any regulation promulgated pursuant to that Act) during—</text><clause id="H00179D6018814119BC245F47C5302FC5" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to the first report under paragraph (2), the 3 fiscal years preceding the date of submission of the report; and</text></clause><clause id="HB0E5A1FB351D45D9AC174C94E485661A" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to the second report under paragraph (2), the 2 fiscal years preceding the date of submission of the report.</text></clause></subparagraph><subparagraph id="H687DA1F8E28642C4AB90314DAEF7AAF6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">Data and other relevant information submitted under subparagraph (A) shall describe, with respect to the applicable amounts—</text><clause id="H9A48AD79EA594684A62A1A1841843B94" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the programmatic office of the department or agency on behalf of which each amount was expended or disbursed;</text></clause><clause id="H6A72BD9566FF44038E85115DF813E1FE" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the provision of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) (or regulation promulgated pursuant to that Act) pursuant to which each amount was expended or disbursed; and</text></clause><clause id="H9083F3FA5FF24933A2CA6BE7C6FACDCE" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">the project or activity carried out using each amount, in detail sufficient to reflect the breadth, scope, and purpose of the project or activity.</text></clause></subparagraph></paragraph><paragraph id="H506E62BE9244497EA159B399AD7FF9A1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Comptroller General</header><text display-inline="yes-display-inline">Not later than 2 years and 4 years after the date of enactment of this Act, the Comptroller General shall submit to the Committees on Appropriations, Commerce, Science, and Transportation, and Environment and Public Works of the Senate and the Committee on Appropriations and Natural Resources of the House of Representatives a report that describes—</text><subparagraph id="H67A0B8EF0A8F4E1D95EC98D91CA5A6A5" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the aggregate amount expended or disbursed by all Federal departments and agencies as a direct result of any provision of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) (including any regulation promulgated pursuant to that Act) during—</text><clause id="H1D4FCBA4E57D44A5ADE88B8DFD770EF4" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to the first report, the 3 fiscal years preceding the date of submission of the report; and</text></clause><clause id="H228ECF33D6F641179682BDA7732B9B9B" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to the second report, the 2 fiscal years preceding the date of submission of the report;</text></clause></subparagraph><subparagraph id="H8651E45422C44695AEBB8E5FAC884168" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the provision of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) (or regulation promulgated pursuant to that Act) pursuant to which each such amount was expended or disbursed; and</text></subparagraph><subparagraph id="H6E406664DBF64B4AA0EB1001F1E12E53" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to each relevant department or agency—</text><clause id="H9F145E4C3EC846AEAA539B7D8EF34799" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the total amount expended or disbursed by the department or agency as described in subparagraph (A); and</text></clause><clause id="H78E15E599C5641C59DA1F329B0C1CC23" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the information described in clauses (i) through (iii) of paragraph (1)(B).</text></clause></subparagraph></paragraph></subsection><subsection id="HCBC313309E29450995E138CC54B732E9" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Report on conservation activities</header><paragraph id="HA0225F4CC87E4F529D81ED5E81A71433" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Federal departments and agencies</header><text display-inline="yes-display-inline">At the determination of the Comptroller General, to facilitate the preparation of the report under paragraph (2), the head of each Federal department and agency shall submit to the Comptroller General data and other relevant information that describes the conservation activities by the Federal department or agency as a direct result of any provision of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA4419B7235E24145856E75DBC6B0FB7D"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to the second report under paragraph (2), the 2 fiscal years preceding the date of submission of the report.</text></subparagraph></paragraph><paragraph id="HBEC4AB0FDB0E4CB78DA39DDDB4B60AA9" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Comptroller General</header><text display-inline="yes-display-inline">Not later than 2 years and 4 years after the date of enactment of this Act, the Comptroller General shall submit to the Committees on Commerce, Science, and Transportation and Environment and Public Works of the Senate and the Committee on Natural Resources of the House of Representatives a report that—</text><subparagraph id="HFB46A4B2866F445F8F81BCE7920615CD" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">describes the conservation activities by all Federal departments and agencies for species listed as a threatened species or endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.), as reported under paragraph (1), during—</text><clause id="HE8785A790BA040B0AD876746873AAC3C" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to the first report, the 3 fiscal years preceding the date of submission of the report;
