		<section id="id09F73C6BA1EA4D16B5BA6E4720676693" section-type="section-one"><enum>1.</enum><header>Finding; purpose</header>
 <subsection id="idbc6e90be4adb4e75b180a3579afd9418"><enum>(a)</enum><header>Finding</header><text>Congress finds that, as of the date of the enactment of this Act, the Federal Government lacked—</text> <paragraph id="idc0af98f54a3b477eb5ce8d2f6f1414ad"><enum>(1)</enum><text>an office in the Executive Office of the President that can coordinate security policy relating to critical emerging, foundational, and dual-use technologies between the National Security Council and the National Economic Council and interface with international, Federal, State, and local entities on that policy; and</text>
 </paragraph><paragraph id="idc30cbe216eea4bd292696659f5e8611e"><enum>(2)</enum><text>a strategic plan—</text> <subparagraph id="idb58567906e2445f1847c7cac1530983d"><enum>(A)</enum><text>to stop the transfer of critical emerging, foundational, and dual-use technologies to countries that pose a national security risk; and</text>
 </subparagraph><subparagraph id="id4b8861d76bc14ff0a220d7caf2011b76"><enum>(B)</enum><text>to maintain United States technological leadership with respect to critical emerging, foundational, and dual-use technologies and ensure supply chain integrity and security for such technologies.</text>
 </subparagraph></paragraph></subsection><subsection id="idac42ecad82ef4b50bc7244cb089fdfa2"><enum>(b)</enum><header>Purpose</header><text>The primary purpose of this Act is to establish the Office of Critical Technologies and Security—</text> <paragraph id="id15fd151b097344ed9a758cc57eb26e30"><enum>(1)</enum><text>to coordinate a whole-of-government response to protect critical emerging, foundational, and dual-use technologies and to effectively enlist the support of regulators, the private sector, and other scientific and technical hubs, including academia, to support and assist with such response; and</text>
 </paragraph><paragraph id="idb9d5ccecd8b643338c17494d1002228f"><enum>(2)</enum><text>to develop a long-term strategy to achieve and maintain United States technological supremacy with respect to critical emerging, foundational, and dual-use technologies and ensure supply chain integrity and security for such technologies.</text>
				</paragraph></subsection></section><section id="iddc30016a55cc4c3987f19f13fcbac14e"><enum>2.</enum><header>Office of critical technologies and security</header>
 <subsection id="id4035e973e1f64fdf8149bceb58b7af35"><enum>(a)</enum><header>Establishment</header><text>There is established in the Executive Office of the President an Office of Critical Technology and Security (in this section referred to as the <quote>Office</quote>).</text>
			</subsection><subsection id="id50d2412d1765425fb44bc7f0b98ae3a4"><enum>(b)</enum><header>Director</header>
 <paragraph id="id4691180262fb4017acf3009438568d23"><enum>(1)</enum><header>In general</header><text>There shall be at the head of the Office a Director who shall be appointed by the President.</text> </paragraph><paragraph id="id1714a3331dd14e10adec2d36c9ae513c"><enum>(2)</enum><header>Reporting</header><text>The Director of the Office shall report directly to the President.</text>
 </paragraph><paragraph id="id1e93ab8529a044349b4cfcd4f9b30a7a"><enum>(3)</enum><header>Additional roles</header><text>In addition to serving as the head of the Office, the Director of the Office shall—</text> <subparagraph id="ide5b22b76534e4ca6a06140641684647d"><enum>(A)</enum><text>be a Deputy National Security Advisor for the National Security Council and serve as a member of such council;</text>
 </subparagraph><subparagraph id="ida1f61809a2af4e5d9d33c6eb6ce7c95e"><enum>(B)</enum><text>be a Deputy Director for the National Economic Council and serve as a member of such council; and</text> </subparagraph><subparagraph id="id42353db66d6b426f9fec7d02afea136c"><enum>(C)</enum><text>serve as the chairperson of the Council on Critical Technologies and Security established under section 3.</text>
 </subparagraph></paragraph></subsection><subsection id="id7549d6735c5c4f4e8238a577de487178"><enum>(c)</enum><header>Functions</header><text>The functions of the Director of the Office are as follows:</text> <paragraph id="id520292f0bef54edb86dc97c7e1c4af0e"><enum>(1)</enum><header>Coordination</header><text>To carry out coordination functions as follows:</text>
 <subparagraph id="id0786576ef17746ecb8999f81a8a57099"><enum>(A)</enum><text>To serve as a centralized focal point within the Executive Office of the President for coordinating policy and actions of the Federal Government—</text>
 <clause id="id9700a62f05824b5c991e843a2427b357"><enum>(i)</enum><text>to stop the transfer of critical emerging, foundational, and dual-use technologies to countries that pose a national security risk, including by leading the interagency process to identify emerging and foundational technologies under section 1758 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>); and</text>
 </clause><clause id="id45527bffa21d40b0a28b04bf20540fdc"><enum>(ii)</enum><text>to maintain United States technological leadership with respect to critical emerging, foundational, and dual-use technologies and ensure supply chain integrity and security for such technologies.</text>
 </clause></subparagraph><subparagraph id="id4d9ad3e54f6f48009955572618b69cfd"><enum>(B)</enum><text>To coordinate whole-of-government responses, working in partnership with heads of national security and economic agencies and agencies with science and technology hubs, including those described in section 3(c)(1).</text>
 </subparagraph><subparagraph id="ida0d8760d9f7040ec830eb7b3016e801b"><enum>(C)</enum><text>To facilitate coordination and consultation with—</text> <clause id="id0fefaec0b8994927b75863010ca4280e"><enum>(i)</enum><text>Federal and State regulators of telecommunications and technology industries, including the Federal Communications Commission, the Federal Trade Commission, and the Office of Science and Technology Policy;</text>
 </clause><clause id="id0b2713ea4a404382a67285d16d7780ed"><enum>(ii)</enum><text>the private sector, including industry, labor, consumer, and other groups as necessary;</text> </clause><clause id="idf76bd94be50e4298a8c93d9d77955801"><enum>(iii)</enum><text>other nongovernmental scientific and technical hubs and stakeholders, including academic stakeholders; and</text>
 </clause><clause id="id5dd328063af1469c8bef4bb9c029689d"><enum>(iv)</enum><text>key international partners and allies of the United States.</text> </clause></subparagraph></paragraph><paragraph id="idbf15710af0c741a8ad0a611cacb5e1f3"><enum>(2)</enum><header>Messaging and outreach</header><text>To lead messaging and outreach efforts by the Federal Government on the national security threat posed by the improper acquisition and transfer of critical emerging, foundational, and dual-use technologies that the Federal Government determines necessary to protect, by countries of concern including—</text>
 <subparagraph id="id1ca8b1ccb20c426d9ef12344c839e72f"><enum>(A)</enum><text>acting as the chief policy spokesperson for the Federal Government on related security and critical technology issues;</text>
 </subparagraph><subparagraph id="idace45609bffe40ad91049a02a9da6628"><enum>(B)</enum><text>encouraging Federal departments and agencies to work with key stakeholders as described in paragraph (1), as well as States, localities, international partners, and allies, to better analyze and disseminate critical information from the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)); and</text>
 </subparagraph><subparagraph id="idd911ff8d163347bd8fd38c1ddced8b6d"><enum>(C)</enum><text>improving overall education of the United States public and business leaders in key sectors about the threat to United States national security posed by—</text>
 <clause id="idcf2f6f1139f64e88b3e6f4190d5ef6bf"><enum>(i)</enum><text>the improper acquisition and transfer of critical technologies by countries that pose a national security risk; and</text>
 </clause><clause id="id69ad4dfa7c974fcbb8e7191f6a367772"><enum>(ii)</enum><text>reliance on foreign products identified by the Federal Government that pose a national security risk in private sector supply chains.</text>
 </clause></subparagraph></paragraph><paragraph id="id5896a151288049d38b9336027a398bf5"><enum>(3)</enum><header>Long-term strategy</header><text>To lead the development of a comprehensive, long-term strategic plan in coordination with United States allies and other defense partners—</text>
 <subparagraph id="id36e54e2eace8485ca02b3de7363436ac"><enum>(A)</enum><text>to enhance the interagency process for identifying emerging and foundational carried out under section 1758 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>) and to re-evaluate those identifications on an ongoing basis;</text>
 </subparagraph><subparagraph id="id78BAC56AD96E4FFBB4FBDD11844FC0FF"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id716753584713466BB342D035E7F85DDC"><enum>(i)</enum><text>to protect and enforce intellectual property rights;</text> </clause><clause id="idFF8F64DA45A943919DA42977ACE15B41" indent="up1"><enum>(ii)</enum><text>to reduce reliance on foreign products identified by the Federal Government that pose a national security risk to the United States in critical public sector supply chains;</text>
 </clause><clause id="id1E8D082B6080422993DDE91D3BB63776" indent="up1"><enum>(iii)</enum><text>to develop a strategy to inform the private sector about critical supply chain risks; and</text>
 </clause><clause id="id6EF78BEE775944CB9D6AA5B8F18012B1" indent="up1"><enum>(iv)</enum><text>to address other security concerns related to forced or unfair technology transfer to and from such countries;</text>
 </clause></subparagraph><subparagraph id="id1bbf02b45e3e45e3ad16792a33ce92c2"><enum>(C)</enum><text>to maintain technological leadership with respect to critical emerging, foundational, and dual-use technologies and to increase public sector funding for research and development that is key to maintaining such technological leadership;</text>
 </subparagraph><subparagraph id="id9ddfbb353f8f474ab091da2c86e8b023"><enum>(D)</enum><text>to develop specific policies and actions to enforce intellectual property and cybersecurity standards to deter and prosecute industrial espionage and other similar measures; and</text>
 </subparagraph><subparagraph id="id83a72fc97e1341119096aac681132405"><enum>(E)</enum><text>to develop specific policies—</text> <clause id="id47597d0e54144ad0b9aa6022537fd141"><enum>(i)</enum><text>to improve the research and development ecosystem, including academic institutions, nonprofit organizations, and private entities; and</text>
 </clause><clause id="id0a64dc19ff55430ba6216d7e58aa3028"><enum>(ii)</enum><text>to reestablish the United States as the world leader in research and development; and</text> </clause></subparagraph><subparagraph id="id1e345304a07e4a44a048ef963568c193"><enum>(F)</enum><text>to develop specific measures and goals that can be tracked and monitored as described in paragraph (4).</text>
					</subparagraph></paragraph><paragraph id="id9e81d30264394ddf9a73b5931c271c9c"><enum>(4)</enum><header>Monitoring and tracking</header>
 <subparagraph id="id77d4e1ca54ff40ddb6a3b385ec60ee50"><enum>(A)</enum><header>Measures</header><text>In conjunction with the Council of Economic Advisors, the United States Trade Representative, the Office of Science and Technology Policy, to use measures developed under paragraph (3)(F) to monitor and track—</text>
 <clause id="idcf9eaa807c8d4793a75a6aeb2b7b70b1"><enum>(i)</enum><text>key trends relating to transfer of critical emerging, foundational, and dual-use technologies;</text> </clause><clause id="id0e31b5e2db2b4d028e6c7f8460c4500d"><enum>(ii)</enum><text>key trends relating to United States government investments in innovation and competitiveness compared to governments of other countries;</text>
 </clause><clause id="id6ce2b6e9db054f19a8a395c28c2625df"><enum>(iii)</enum><text>inappropriate influence of international standards setting processes by foreign countries that pose a national security risk; and</text>
 </clause><clause id="id06a55c5f11fc4747b2302ce3495ff61b"><enum>(iv)</enum><text>progress implementing the comprehensive, long-term strategic plan developed under paragraph (3).</text> </clause></subparagraph><subparagraph id="id9544aa6a17d347da96a5909cf15d5f5a"><enum>(B)</enum><header>Goals</header><text>To monitor and track progress made towards achieving goals relating to protecting the security of critical technologies of the United States.</text>
 </subparagraph></paragraph></subsection><subsection id="id1e7699a632124d0e8d2fd40f112836df"><enum>(d)</enum><header>Staff</header><text>The Director of the Office may—</text> <paragraph id="id6afbfd618dc7453d81c2e7811b5f7bba"><enum>(1)</enum><text>without regard to the civil service laws, employ, and fix the compensation of, such specialists and other experts as may be necessary for the Director to carry out the functions of the Director; and</text>
 </paragraph><paragraph id="idd3dc1d39ee4749efb8580874c2a03608"><enum>(2)</enum><text>subject to the civil service laws, employ such other officers and employees as may be necessary to carry out the functions of the Director.</text>
				</paragraph></subsection><subsection id="id4b7b032607544fa6ae4c0c34e3ea39df"><enum>(e)</enum><header>Annual report</header>
 <paragraph id="idefa9dfe53b2c45cbbd4a6c21f48f65a5"><enum>(1)</enum><header>In general</header><text>Not less frequently than once each year, the Director shall submit to Congress a report on—</text> <subparagraph id="id17bd3a536653480da7d1ff2247c66e80"><enum>(A)</enum><text>the activities of the Office; and</text>
 </subparagraph><subparagraph id="id5afa1860f35842d38908fd9848b3c4b9"><enum>(B)</enum><text>matters relating to national security and the protection of critical technologies.</text> </subparagraph></paragraph><paragraph id="id674a4137c855460499876c1a92e6b003"><enum>(2)</enum><header>Form</header><text>Each report submitted under paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</text>
 </paragraph></subsection><subsection id="id775c423c9bd646239daf759f3db96bb3"><enum>(f)</enum><header>Conforming amendment</header><text>Section 101(c) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3021">50 U.S.C. 3021(c)</external-xref>) is amended by inserting <quote>the Director of the Office of Critical Technologies and Security,</quote> after <quote>Treasury,</quote>.</text> </subsection></section><section id="idae832dd93f6c4129b87e6dc7df2079ec"><enum>3.</enum><header>Council on critical technologies and security</header> <subsection id="id6e24dfffaabe44fab427778911c53f6b"><enum>(a)</enum><header>Establishment</header><text>There is a council known as the Council on Critical Technologies and Security (in this section referred to as the <quote>Council</quote>).</text>
 </subsection><subsection id="id169768920e364b6087e3cdfe03e86e00"><enum>(b)</enum><header>Function</header><text>The function of the Council shall be to advise the President on matters relating to challenges posed by foreign powers with respect to technology acquisition and transfer.</text>
			</subsection><subsection id="idd727ed5d3848423db399da1994f33ee7"><enum>(c)</enum><header>Membership</header>
 <paragraph id="ida91c71bd06534ed792448b5bf1c341a1"><enum>(1)</enum><header>Composition</header><text>The Council shall be composed of the following:</text> <subparagraph id="idc953328377544066a09ba77ee1ef0f8e"><enum>(A)</enum><text>The Director of the Office of Critical Technologies and Security appointed under section 2(b)(1).</text>
 </subparagraph><subparagraph id="id3ee2ae2ff1bf437d87e81bae320fc84c"><enum>(B)</enum><text>The Secretary of Agriculture.</text> </subparagraph><subparagraph id="idcc227c6fd1ee4167bfd5c18c1546cef2"><enum>(C)</enum><text>The Secretary of Commerce.</text>
 </subparagraph><subparagraph id="id9c92a433cbd84783babf9ae8848b0b25"><enum>(D)</enum><text>The Secretary of Defense.</text> </subparagraph><subparagraph id="id65b053aad0cf4f2db54955cef48604ac"><enum>(E)</enum><text>The Secretary of Education.</text>
 </subparagraph><subparagraph id="idcbc45c13a4e748e2be4fb7ede6887eb0"><enum>(F)</enum><text>The Secretary of Energy.</text> </subparagraph><subparagraph id="id50c4af6af24e4033a1f44b970ecc17fb"><enum>(G)</enum><text>The Secretary of Homeland Security.</text>
 </subparagraph><subparagraph id="id83adb2813e5240478becb18255ff8f70"><enum>(H)</enum><text>The Secretary of State.</text> </subparagraph><subparagraph id="idff204809a82e41da9d25d293a80ded45"><enum>(I)</enum><text>The Secretary of Transportation.</text>
 </subparagraph><subparagraph id="id3a6618733e38484aaba7978c20ef2743"><enum>(J)</enum><text>The Secretary of the Treasury.</text> </subparagraph><subparagraph id="idf5d3f7d4bf6347f99a82a6cb9da15f60"><enum>(K)</enum><text>The Director of the Office of Management and Budget.</text>
 </subparagraph><subparagraph id="idd3a7d8530b814f5085e3277012d4095f"><enum>(L)</enum><text>The Director of National Intelligence.</text> </subparagraph><subparagraph id="id2b36eb6906804d24bee9e49efae06464"><enum>(M)</enum><text>The Director of the Central Intelligence Agency.</text>
 </subparagraph><subparagraph id="id4a674ea67e4a428fbadf96009f1abbbe"><enum>(N)</enum><text>The Director of the Federal Bureau of Investigation.</text> </subparagraph><subparagraph id="idf1fd226cd800461885dbc38b155c9a54"><enum>(O)</enum><text>The United States Trade Representative.</text>
 </subparagraph><subparagraph id="idfa5e7e571b2f4acb84810f35efe1246f"><enum>(P)</enum><text>The Director of the National Economic Council.</text> </subparagraph><subparagraph id="idc378292a96a547ab8fd28a3382ca0b6d"><enum>(Q)</enum><text>The National Security Advisor.</text>
 </subparagraph><subparagraph id="iddf8aa58db72c4d7bbb13ccb6acbb34b7"><enum>(R)</enum><text>The Director of the Office of Science and Technology Policy.</text> </subparagraph><subparagraph id="id91fd12d48ad44f53be213371f80e74b0"><enum>(S)</enum><text>A representative of the Committee on Foreign Investment in the United States who shall be selected by the Committee for purposes of this section.</text>
 </subparagraph><subparagraph id="idb4598febb489452a9535719fa8c9519f"><enum>(T)</enum><text>The Ambassador to the United Nations.</text> </subparagraph><subparagraph id="id45e20c768e024a9ea4037b5ce3354d50"><enum>(U)</enum><text>The Chair of the Federal Communications Commission.</text>
 </subparagraph><subparagraph id="id2c0fa8ac1f444ab1ae5f8b03db1e529f"><enum>(V)</enum><text>The Chair of the Federal Trade Commission.</text> </subparagraph><subparagraph id="id358bacd475c14ad38a74f63678947d1f"><enum>(W)</enum><text>Such other heads of departments and agencies of the Federal Government as the chairperson of the Council considers appropriate.</text>
 </subparagraph></paragraph><paragraph id="id41cb1b76b2704d7f941c78d4d26853a2"><enum>(2)</enum><header>Chairperson</header><text>The chairperson of the Council shall be the Director of the Office of Critical Technologies and Security appointed under section 2(b)(1).</text>
 </paragraph></subsection><subsection id="id6a2d3f0361c847c99acbade15010a288"><enum>(d)</enum><header>Consultation and cooperation</header><text>The Council—</text> <paragraph id="ida63e7b4f5edb4b39889fc83f98348764"><enum>(1)</enum><text>may constitute such advisory committees and may consult with such representatives of industry, agriculture, labor, consumers, State and local governments, and other groups, as the Council considers advisable;</text>
 </paragraph><paragraph id="id7badf31204c442f089bce5ced386b5ff"><enum>(2)</enum><text>shall consult with the entities listed under section 2(c)(1)(C); and</text> </paragraph><paragraph id="id020a8813e6be42a9862bcafcaac1644a"><enum>(3)</enum><text>shall seek and obtain the cooperation of the various executive and independent agencies of the Federal Government in the development of specialized studies essential to its responsibilities.</text>
				</paragraph></subsection></section></legis-body>
