Special use permits for recreation and public purposes.</toc-entry></toc> </subsection></section><section id="iddf2d02c7593344179c9b7ed8d9023c57"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="id6280d810423e406cb9cc6b35b79ae152"><enum>(1)</enum><header>County</header><text>The term <term>County</term> means Douglas County, Nevada.</text> </paragraph><paragraph id="id4434cf4615c74b579ee5aa8cfc36b2fd"><enum>(2)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>Douglas County Economic Development and Conservation Act</quote> and dated October 14, 2019.</text>
 </paragraph><paragraph id="idc4b318eef26f4067acd0b0f7d802baa5"><enum>(3)</enum><header>Public land</header><text>The term <term>public land</term> has the meaning given the term <term>public lands</term> in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text> </paragraph><paragraph id="id520545d7160e475bba61731f15d97b29"><enum>(4)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text>
 <subparagraph id="id41a25ee9f28044c786e7e67d723c5789"><enum>(A)</enum><text>with respect to National Forest System land, the Secretary of Agriculture, acting through the Chief of the Forest Service; and</text>
 </subparagraph><subparagraph id="id55333745b4654c43bcd77436ebb5ce39"><enum>(B)</enum><text>with respect to land managed by the Bureau of Land Management, including land held in trust for the benefit of the Tribe, the Secretary of the Interior.</text>
 </subparagraph></paragraph><paragraph id="id23b7c8374e7d4670ae5f340215e137b6"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means the State of Nevada.</text> </paragraph><paragraph id="ida0d14f4da49e4160818e344fd4288aa6"><enum>(6)</enum><header>Tribe</header><text>The term <term>Tribe</term> means the Washoe Tribe of Nevada and California.</text>
 </paragraph><paragraph id="idb35148e293ce4a108827ba59f8b6e782"><enum>(7)</enum><header>Wilderness</header><text>The term <term>Wilderness</term> means the Burbank Canyons Wilderness designated by section 301(a).</text> </paragraph></section><title id="idc02f57a573df4d6f844858d7a8af9f75"><enum>I</enum><header>Land conveyances and sales</header> <section id="id7677d569ee474b7ea25e52b3202ed5db"><enum>101.</enum><header>Conveyance to State</header> <subsection id="id23f5b75128a4450a997af50550f19938"><enum>(a)</enum><header>In general</header><text>Subject to valid existing rights, the Secretary concerned shall convey to the State, without consideration, all right, title, and interest of the United States in and to the land described in subsection (b).</text>
 </subsection><subsection id="id7a75c6b43ad44f229f1bb152f66f1f17"><enum>(b)</enum><header>Description of land</header><text>The land referred to in subsection (a) is the approximately 67 acres of Forest Service land generally depicted as <quote>Lake Tahoe-Nevada State Park</quote> on the Map.</text>
 </subsection><subsection id="id7009697cac8c48fea1c996b19cde0297"><enum>(c)</enum><header>Costs</header><text>As a condition of the conveyance under subsection (a), the State shall pay all costs associated with the conveyance (including any costs for surveys and other administrative costs).</text>
				</subsection><subsection id="idd9d46b888f0f44269b17934644d0146d"><enum>(d)</enum><header>Use of land</header>
 <paragraph id="idb7e580ae3c604e0f9246441bfd7fdf45"><enum>(1)</enum><header>In general</header><text>The land conveyed to the State under subsection (a) shall be used only for—</text> <subparagraph id="id1a49544729184e75bf8e5158f1758984"><enum>(A)</enum><text>the conservation of wildlife or natural resources; or</text>
 </subparagraph><subparagraph id="idaad5b8604e5f4fc9a62ba4d040d2d9a6"><enum>(B)</enum><text>a public park.</text> </subparagraph></paragraph><paragraph id="id85b43aef216843a09776791e3a26f089"><enum>(2)</enum><header>Facilities</header><text>Any facility on land conveyed under subsection (a) shall be constructed and managed in accordance with the uses described in paragraph (1).</text>
 </paragraph></subsection><subsection id="idd548cc8096684da7abdcdad48e137137"><enum>(e)</enum><header>Reversion</header><text>If any portion of the land conveyed under subsection (a) is used in a manner that is inconsistent with the uses described in subsection (d), the land shall, at the discretion of the Secretary concerned, revert to the United States.</text>
				</subsection></section><section id="id5c10d8430bad4667b4e3a4b7f927e8c9"><enum>102.</enum><header>Tahoe Rim Trail</header>
 <subsection id="id7def3626154a44fea05a0e78dde3ce1e"><enum>(a)</enum><header>In general</header><text>The Secretary of Agriculture, in consultation with the County and other stakeholders, shall develop and implement a cooperative management agreement for the land described in subsection (b)—</text>
 <paragraph id="id8b6f3d44b2dd49b9a2630daa3ef3519c"><enum>(1)</enum><text>to improve the quality of recreational access to the land by providing such additional amenities as are agreed to by the Secretary and the County; and</text>
 </paragraph><paragraph id="id35735c0805604ba88b2d718d44f33b45"><enum>(2)</enum><text>to conserve the natural resource values of the land.</text> </paragraph></subsection><subsection id="id0c2ae36dbcd54ecea592b34df4e0d96a"><enum>(b)</enum><header>Description of land</header><text>The land referred to in subsection (a) is the approximately 13 acres of land generally depicted as <quote>Tahoe Rim Trail North Parcel</quote> on the Map.</text>
				</subsection></section><section id="idb0d3fa9282884dd59151d089e7447212"><enum>103.</enum><header>Conveyance to County</header>
 <subsection id="ide0f808fdee3b4ede8e6306166c99e707"><enum>(a)</enum><header>Definition of Federal land</header><text>In this section, the term <term>Federal land</term> means the approximately 7,777 acres of Federal land in the County generally depicted as <quote>Douglas County Land Conveyances</quote> on the Map.</text> </subsection><subsection id="idaed496a0ce324c19afd1c600f79b875a"><enum>(b)</enum><header>Authorization of conveyance</header><text>Subject to valid existing rights and notwithstanding the land use planning requirements of section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>), not later than 180 days after the date on which the Secretary concerned receives a request from the County for the conveyance of the Federal land, the Secretary concerned shall convey to the County, without consideration, all right, title, and interest of the United States in and to the Federal land.</text>
 </subsection><subsection id="id383104B572C0415482DCA10804D6D821"><enum>(c)</enum><header>Costs</header><text>As a condition of the conveyance under subsection (b), the County shall pay all costs associated with the conveyance (including any costs for surveys and other administrative costs).</text>
 </subsection><subsection id="id12ab634dc9e14daabe6f38512b1ef259"><enum>(d)</enum><header>Use of Federal land</header><text>The Federal land conveyed under subsection (b)—</text> <paragraph id="idadc5beba928c428a9287c280cda75f44"><enum>(1)</enum><text>may be used by the County for flood control or any other public purpose consistent with the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869</external-xref> et seq.); and</text>
 </paragraph><paragraph id="id38018094550f4448a5ea59329c3b84d9"><enum>(2)</enum><text>shall not be disposed of by the County.</text> </paragraph></subsection><subsection id="idb87f8ccf99864da18965ce86f999e5b6"><enum>(e)</enum><header>Reversion</header><text>If the Federal land conveyed under subsection (b) is used in a manner inconsistent with subsection (d), the Federal land shall, at the discretion of the Secretary concerned, revert to the United States.</text>
				</subsection><subsection id="id00538f0868e144f2a620b3cebc9995a6"><enum>(f)</enum><header>Acquisition of Federal reversionary interest</header>
 <paragraph id="id7a279d4bb7ed435abf172aeb4c7c44ef"><enum>(1)</enum><header>Request</header><text>The County may submit to the Secretary concerned a request to acquire the Federal reversionary interest in all or any portion of the Federal land conveyed under subsection (b).</text>
					</paragraph><paragraph id="id792ca6a392704b879b250b8f26ff8cbd"><enum>(2)</enum><header>Appraisal</header>
 <subparagraph id="idedc1da6e9b8841759569083c305f9088"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of receipt of a request under paragraph (1), the Secretary concerned shall complete an appraisal of the Federal reversionary interest in the Federal land requested by the County.</text>
 </subparagraph><subparagraph id="id672cca6edafc42b29ba5d7e98a3d4d0f"><enum>(B)</enum><header>Requirement</header><text>The appraisal under subparagraph (A) shall be completed in accordance with—</text> <clause id="id04dd5bf56bad486988b0cbd660d2b351"><enum>(i)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text>
 </clause><clause id="id3bbd33e488624e8ba874439e4118e600"><enum>(ii)</enum><text>the Uniform Standards of Professional Appraisal Practice.</text> </clause></subparagraph></paragraph><paragraph id="iddaeffd841b5f4bd399fa162a4911479e"><enum>(3)</enum><header>Conveyance required</header> <subparagraph id="id478fb2d1221145d7a9b8eb28b6dc538f"><enum>(A)</enum><header>In general</header><text>If, by the date that is 1 year after the date of completion of the appraisal under paragraph (2), the County submits to the Secretary concerned an offer to acquire the Federal reversionary interest requested under paragraph (1), the Secretary concerned, by not later than the date that is 30 days after the date on which the offer is submitted, shall convey to the County that reversionary interest.</text>
 </subparagraph><subparagraph id="id031495843e9f4682865cc08cf62bc0b0"><enum>(B)</enum><header>Consideration</header><text>As consideration for the conveyance of the Federal reversionary interest under subparagraph (A), the County shall pay to the Secretary concerned an amount equal to the appraised value of the Federal reversionary interest, as determined under paragraph (2).</text>
 </subparagraph><subparagraph id="id11C0D91AAF244ACF9C38A4EF71F9AF3D"><enum>(C)</enum><header>Costs</header><text>As a condition of conveyance of the Federal reversionary interest under subparagraph (A), the County shall pay all costs associated with the conveyance (including any costs for surveys and other administrative costs).</text>
 </subparagraph></paragraph><paragraph id="id8f9269e7adf046af8a1c06fa1e64d3c1"><enum>(4)</enum><header>Disposition of proceeds</header><text>Any amounts collected under this subsection shall be disposed of in accordance with section 104(i).</text> </paragraph></subsection><subsection id="id4fe6432f7f384addb773ffe62207ad95"><enum>(g)</enum><header>Revocation of orders</header><text>Any public land order that withdraws any portion of the Federal land from appropriation or disposal under a public land law shall be revoked to the extent necessary to permit disposal of the Federal land under this section.</text>
				</subsection></section><section id="idb7a01a30a17d4ce9987886a855baece2"><enum>104.</enum><header>Sale of certain Federal land</header>
 <subsection id="id7173c57f87e24f49a3a904032098ed9b"><enum>(a)</enum><header>In general</header><text>Notwithstanding sections 202 and 203 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1713), the Secretary concerned shall, in accordance with the other provisions of that Act and any other applicable law, and subject to valid existing rights, conduct 1 or more sales of the Federal land (including mineral rights to that land) described in subsection (b) to qualified bidders.</text>
 </subsection><subsection id="ided3a709e921b4430b7d10a445b3bc374"><enum>(b)</enum><header>Description of land</header><text>The Federal land referred to in subsection (a) is—</text> <paragraph id="idc5db66839a274624a4e696d6fe0ca7dd"><enum>(1)</enum><text>the approximately 59.5 acres of public land generally depicted as <quote>Lands for Disposal</quote> on the Map;</text>
 </paragraph><paragraph id="id4e8ff86f636e46799c7c562416195a49"><enum>(2)</enum><text>not more than 10,000 acres of land in the County that—</text> <subparagraph id="id35a1c4bc7a6d4d3d8da40babdc2e3368"><enum>(A)</enum><text>is not segregated or withdrawn on or after the date of enactment of this Act, unless the land is withdrawn in accordance with subsection (g); and</text>
 </subparagraph><subparagraph id="id49a9ed330c0746e285308aa199ccede9"><enum>(B)</enum><text>is identified for disposal by the Secretary concerned through—</text> <clause id="ida2a5cc45fd474b689a4599ca2dd7a06f"><enum>(i)</enum><text>the Carson City Consolidated Resource Management Plan; or</text>
 </clause><clause id="id2ae39c5c910643ad94e440db5a7a0e11"><enum>(ii)</enum><text>any subsequent amendment to that management plan that is undertaken with full public involvement; and</text>
 </clause></subparagraph></paragraph><paragraph commented="no" id="idDE71C4D837D441B39E3244CD7712D172"><enum>(3)</enum><text>any mineral right associated with land described in paragraph (1) or (2).</text> </paragraph></subsection><subsection id="id5d6b9b669fe34efeb44708a44c8dfcc3"><enum>(c)</enum><header>Joint selection required</header><text>The Secretary concerned and the County shall jointly select which parcels of the Federal land described in subsection (b)(2) to offer for sale under subsection (a).</text>
 </subsection><subsection id="id5d48daaad39e433f9db10679c1b8417e"><enum>(d)</enum><header>Compliance with local planning and zoning laws</header><text>Before carrying out a sale of Federal land under subsection (a), the County shall submit to the Secretary concerned a certification that qualified bidders have agreed to comply with—</text>
 <paragraph id="id4e1e95a495ff49a2ac67856bedb805e9"><enum>(1)</enum><text>County zoning ordinances; and</text> </paragraph><paragraph id="id675843ccd1d043fbb0c71f1959b6e5be"><enum>(2)</enum><text>any master plan for the area approved by the County.</text>
 </paragraph></subsection><subsection id="id8eaa5a8687384a3aa4ed6d9904e09c57"><enum>(e)</enum><header>Method of sale</header><text>The sale of Federal land under subsection (a) shall be—</text> <paragraph id="idaa19d872f46341608f153799b3a1de0f"><enum>(1)</enum><text>through a competitive bidding process, unless otherwise determined by the Secretary concerned; and</text>
 </paragraph><paragraph id="id54061d0c4c024a308b72d9bec8de8a47"><enum>(2)</enum><text>for not less than fair market value.</text> </paragraph></subsection><subsection id="id60d8c4f8ea834c9c816ca963eb5df74d"><enum>(f)</enum><header>Recreation and Public Purposes Act conveyances</header> <paragraph id="id16ebf45c57704a4596fb7a84a593af3d"><enum>(1)</enum><header>In general</header><text>Not later than 30 days before any land described in subsection (b) is offered for sale under subsection (a), the State or County may elect to obtain the land for public purposes, in accordance with the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869</external-xref> et seq.).</text>
 </paragraph><paragraph id="idf89064af390e437995a6306ce8d480e7"><enum>(2)</enum><header>Retention</header><text>Pursuant to an election made under paragraph (1), the Secretary concerned shall retain the relevant land for conveyance to the State or County in accordance with the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869</external-xref> et seq.).</text>
					</paragraph></subsection><subsection id="idedba597f74d1467195d42d3b2da7575d"><enum>(g)</enum><header>Withdrawal</header>
 <paragraph id="idf4c5d6d64f2a49a49ac4c8458d3dbc7f"><enum>(1)</enum><header>In general</header><text>Subject to valid existing rights and except as provided in paragraph (3), the Federal land described in subsection (b) is withdrawn from—</text>
 <subparagraph id="idc5c5f89e37204b9b8809fee09b9cf8ff"><enum>(A)</enum><text>all forms of entry, appropriation, or disposal under the public land laws;</text> </subparagraph><subparagraph id="idb1a85d2c85e044f38943d666434a8cef"><enum>(B)</enum><text>location, entry, and patent under the mining laws; and</text>
 </subparagraph><subparagraph id="id6848db5089f14f4abcd5119134326a75"><enum>(C)</enum><text>disposition under all laws relating to mineral and geothermal leasing or mineral materials.</text> </subparagraph></paragraph><paragraph id="id3411669c767848a9b6f3015b5e702e4f"><enum>(2)</enum><header>Termination</header><text>The withdrawal under paragraph (1) shall terminate—</text>
 <subparagraph id="ide910d9cb36ab4008b7b591274abc7422"><enum>(A)</enum><text>on the date of sale or conveyance of title to the land described in subsection (b) pursuant to this section; or</text>
 </subparagraph><subparagraph id="idad2fbf5f41004741a8a223d6af804178"><enum>(B)</enum><text>with respect to any land described in subsection (b) that is not sold or exchanged, not later than 1 year after the date on which the land was offered for sale under this section.</text>
 </subparagraph></paragraph><paragraph id="id82952eae449f432580f36f4ccd4ad84a"><enum>(3)</enum><header>Exception</header><text>Paragraph (1)(A) shall not apply to—</text> <subparagraph id="id142077814AA54BCAB4D8D25F89462A77"><enum>(A)</enum><text>a sale conducted in accordance with this section; or</text>
 </subparagraph><subparagraph id="idD5C2AFA4C98C42378AE0A7631A079C05"><enum>(B)</enum><text>an election by the State or County under subsection (f)(1).</text> </subparagraph></paragraph></subsection><subsection id="id28702ecf9bd84f1ab211b3a951195d2b"><enum>(h)</enum><header>Deadline for sale</header> <paragraph id="id5e22ac48094949848ca774b1502d615f"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), not later than 1 year after the date of enactment of this Act, if there is a qualified bidder for the land described in subsection (b), the Secretary concerned shall offer the land for sale to the qualified bidder.</text>
 </paragraph><paragraph id="idaf457e4e46c047b58c9055c1d9c0363a"><enum>(2)</enum><header>Postponement; exclusion from sale</header><text>At the request of the County, the Secretary concerned may temporarily postpone or exclude from sale under paragraph (1) all or a portion of the land described in subsection (b).</text>
 </paragraph></subsection><subsection id="ida9fddb882dc24e798a2979d0c514d659"><enum>(i)</enum><header>Disposition of proceeds</header><text>Of the proceeds of a sale under this section—</text> <paragraph id="idd6937376dd174f0e9e5657023079f1c8"><enum>(1)</enum><text>5 percent shall be disbursed to the State for use by the State for general education programs of the State;</text>
 </paragraph><paragraph id="id27d7307faa0943a0a3aa24c34ed22fde"><enum>(2)</enum><text>10 percent shall be disbursed to the County for use by the County for general budgeting purposes; and</text>
 </paragraph><paragraph id="idc51ccf33073c439abf3bf882df8c4924"><enum>(3)</enum><text>85 percent shall be deposited in a special account in the Treasury of the United States, to be known as the <quote>Douglas County Special Account</quote>, which shall be available to the Secretary concerned until expended, without further appropriation—</text>
 <subparagraph id="idce942f7d998b44409c0e9abb56f83e42"><enum>(A)</enum><text>to reimburse costs incurred by the Secretary concerned in preparing for the sale of the land described in subsection (b), including—</text>
 <clause id="id76ae2c57f50846e3b98c2ea816567173"><enum>(i)</enum><text>the costs of surveys and appraisals; and</text> </clause><clause id="idc132dae321d54b3eb3b9a54bc0d39321"><enum>(ii)</enum><text>the costs of compliance with—</text>
 <subclause id="idBDE076A44D2E4AEDA977A392E8426844"><enum>(I)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.); and</text> </subclause><subclause id="id3662ADB2E811488DA0CF9C58B7ABACB6"><enum>(II)</enum><text>sections 202 and 203 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>, 1713);</text>
 </subclause></clause></subparagraph><subparagraph id="id6caacb410b7b4a94a03ed3c1d2744c27"><enum>(B)</enum><text>to reimburse costs incurred by the Bureau of Land Management and the Forest Service in preparing for, and carrying out, the transfers of land to be held in trust by the United States under section 201; and</text>
 </subparagraph><subparagraph id="idef5be86feb524f8e8d5560cffa106952"><enum>(C)</enum><text>to acquire environmentally sensitive land or an interest in environmentally sensitive land in the County—</text>
 <clause id="idf0cda6d7eacf4cf3a7cb47c503b35d6b"><enum>(i)</enum><text>pursuant to the Douglas County Open Space and Agricultural Lands Preservation Implementation Plan, or any subsequent amendment to the plan that is undertaken with full public involvement; and</text>
 </clause><clause id="idbdb5dfdf311d498ab3c3157c651dd33e"><enum>(ii)</enum><text>for flood control purposes.</text> </clause></subparagraph></paragraph></subsection><subsection id="idd7d8fff9cbba4024952b39cca92f5a21"><enum>(j)</enum><header>Availability of funds</header><text>Section 4(e) of the Southern Nevada Public Land Management Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/263">Public Law 105–263</external-xref>; 112 Stat. 2346; 116 Stat. 2007; 117 Stat. 1317; 118 Stat. 2414; 120 Stat. 3045; 123 Stat. 1114) is amended—</text>
 <paragraph id="id54a8c916c5f14491bdb230d258036082"><enum>(1)</enum><text>in paragraph (3)(A)—</text> <subparagraph id="id7f6abeac47ba4b57b5d4d63101c7e58c"><enum>(A)</enum><text>by striking clause (iv) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="idb36dfbe9039e4435b88b5277a9b6a55a" style="OLC">
 <clause id="ide69b6fdf58d142e9894cedf78018d5c9"><enum>(iv)</enum><text>development of parks, trails, and natural areas in Clark, Lincoln, and White Pine Counties, Washoe County (subject to paragraph (4)), Carson City (subject to paragraph (5)), and Douglas County (subject to paragraph (6)), Nevada, pursuant to a cooperative agreement with a unit of local government or regional governmental entity;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="id4f894e1b9d04441199e86ad06a8ec966"><enum>(B)</enum><text>in clause (v), by striking <quote>Clark, Lincoln, and White Pine Counties and Carson City (subject to paragraph (5))</quote> and inserting <quote>Clark, Lincoln, and White Pine Counties, Washoe County (subject to paragraph (4)), Carson City (subject to paragraph (5)), and Douglas County (subject to paragraph (6))</quote>; and</text>
 </subparagraph></paragraph><paragraph id="ide58c8ee780d442938dc90905426dd213"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idcf32b8bd29074cc7b8a10433d342438e" style="OLC"> <paragraph id="ida76509f150da460391812fd3569ada33"><enum>(6)</enum><header>Limitation for Douglas County</header><text>Douglas County shall be eligible to nominate for expenditure amounts to acquire land or any interest in land for parks, trails, or natural areas and for conservation initiatives—</text>
 <subparagraph id="id512c957156254bceafecbc6d80d2a1ab"><enum>(A)</enum><text>within the Carson River watershed;</text> </subparagraph><subparagraph id="idabf67235402e4fe59f58bed9267a2ece"><enum>(B)</enum><text>within the Walker River watershed; or</text>
 </subparagraph><subparagraph id="id05b9ed99487e4882afdd661d98efb70d"><enum>(C)</enum><text>for the conservation of sage-grouse habitat.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="idf7a32d481f9f43b68eb7c582b1498b96"><enum>(k)</enum><header>Revocation of orders</header><text>Any public land order that withdraws any portion of the land described in subsection (b) from appropriation or disposal under a public land law shall be revoked to the extent necessary to permit disposal of that land under this section.</text>
				</subsection></section><section id="id615d84eba3494670a0234e3e052036a2"><enum>105.</enum><header>Open space recreation area</header>
 <subsection id="idf521c34269a941b6bf463f2840e9e65f"><enum>(a)</enum><header>Authorization of conveyance</header><text>Not later than 180 days after the date on which the Secretary of Agriculture receives a request from the County, the Secretary of Agriculture shall convey to the County, without consideration, all right, title, and interest of the United States in and to the Federal land described in subsection (b).</text>
 </subsection><subsection id="idb3240cfbdb594649a31467c875e9281d"><enum>(b)</enum><header>Description of land</header><text>The land referred to in subsection (a) is the approximately 1,084 acres of land generally depicted as <quote>Open Space Recreation Area</quote> on the Map.</text>
 </subsection><subsection id="idDB1F85757C134AF99A7B4E5764D7866E"><enum>(c)</enum><header>Costs</header><text>As a condition of the conveyance under subsection (a), the County shall pay all costs associated with the conveyance (including any costs for surveys and other administrative costs).</text>
 </subsection><subsection id="id25458ba815b447e59655e1a2d9a9e212"><enum>(d)</enum><header>Use of land</header><text>The land conveyed under subsection (a)—</text> <paragraph id="idFC77CAC2ABDC45E4A9F7C2E0A08E7DC9"><enum>(1)</enum><text>shall be used by the County for recreation and any other public purpose consistent with the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869</external-xref> et seq.); and</text>
 </paragraph><paragraph id="idBF95D694C9E748B2ACE20BFB199A8F99"><enum>(2)</enum><text>shall not be disposed of by the County.</text> </paragraph></subsection></section></title><title id="id1ececfb6276340dda4fbf91cedfc2880"><enum>II</enum><header>Tribal cultural resources</header> <section id="id48265eaaf6d546f6996185d75c857cfa"><enum>201.</enum><header>Transfer of land to be held in trust for Tribe</header> <subsection id="iddff4e780d32b4466b605a3fbdd5b0eef"><enum>(a)</enum><header>In general</header><text>Subject to valid existing rights, all right, title, and interest of the United States in and to the land described in subsection (b)—</text>
 <paragraph id="id1858fca6ea714e7eb45963ce95a7bbdf"><enum>(1)</enum><text>shall be held in trust by the United States for the benefit of the Tribe; and</text> </paragraph><paragraph id="id0310e9db743f4cefba708a2e991e74f5"><enum>(2)</enum><text>shall be part of the reservation of the Tribe.</text>
 </paragraph></subsection><subsection id="id098e59b4cae3424c9933e56cf744b58f"><enum>(b)</enum><header>Description of land</header><text>The land referred to in subsection (a) is—</text> <paragraph id="id92849d4ef9504cacb0ab1a022dd74e2d"><enum>(1)</enum><text>the approximately 2,669 acres of Federal land generally depicted as <quote>Washoe Tribe Conveyances</quote> on the Map; and</text>
 </paragraph><paragraph id="idca09b7fe80d74a6f9eb0ad73c5a49b8a"><enum>(2)</enum><text>any land—</text> <subparagraph id="id70DF9C1DA9904AAC817B50A8F7F40F8D"><enum>(A)</enum><text>generally depicted as <quote>Section 5 lands</quote> on the Map; and</text>
 </subparagraph><subparagraph id="idEFE7DB42FA944EADB66C6C566F8CF02A"><enum>(B)</enum><text>administered on the date of enactment of this Act by—</text> <clause id="idD947D989CFD742B8B051F83E1E9DA8D7"><enum>(i)</enum><text>the Bureau of Land Management; or</text>
 </clause><clause id="id6693AF35E0CF4419A2B01EC6E31E1456"><enum>(ii)</enum><text>the Forest Service.</text> </clause></subparagraph></paragraph></subsection><subsection id="idae070c047c7d4cd7983ab65e00b673c0"><enum>(c)</enum><header>Survey</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary concerned shall complete a survey of the boundary lines to establish the boundaries of the land taken into trust under subsection (a).</text>
				</subsection><subsection id="id30484657cec549c59f3506e01e91f26d"><enum>(d)</enum><header>Use of trust land</header>
 <paragraph id="id6975aa6cc7c74dff8a067725773ef830"><enum>(1)</enum><header>Gaming</header><text>Land taken into trust under this section shall not be eligible, or considered to have been taken into trust, for class II gaming or class III gaming (as those terms are defined in section 4 of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2703">25 U.S.C. 2703</external-xref>)).</text>
					</paragraph><paragraph id="id9adebb949390492591bcc536a06467a9"><enum>(2)</enum><header>Thinning; landscape restoration</header>
 <subparagraph commented="no" id="id0c775f2609144e79942d0cc4bb17cdcd"><enum>(A)</enum><header>In general</header><text>The Secretary concerned, in consultation and coordination with the Tribe, may carry out any fuel reduction or other landscape restoration activities on the land taken into trust under subsection (a) (including land that includes threatened or endangered species habitat), that are beneficial to—</text>
 <clause commented="no" id="id0573d9938e5f40e697e4519245fdc9b7"><enum>(i)</enum><text>the Tribe; and</text> </clause><clause commented="no" id="id12264afe8afa4c31a5f383152602086d"><enum>(ii)</enum><text>as applicable—</text>
 <subclause commented="no" id="id9E0AE056C0274DBD98AE7EC6A2DF1A3C"><enum>(I)</enum><text>the Bureau of Land Management; or</text> </subclause><subclause commented="no" id="id1C54B4913B694C1FA70258C2301C3B9A"><enum>(II)</enum><text>the Forest Service.</text>
 </subclause></clause></subparagraph><subparagraph id="id951ce788238540adb4d08888b48b4fd3"><enum>(B)</enum><header>Conservation benefits</header><text>Activities carried out under subparagraph (A) include activities that provide conservation benefits to a species that—</text>
 <clause id="id16006f2be8334cb19dd0e4fd82c5064a"><enum>(i)</enum><text>is not listed as endangered or threatened under section 4(c) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533(c)</external-xref>); but</text>
 </clause><clause id="ida09d238d8d494d69a268388780806b0d"><enum>(ii)</enum><text>is—</text> <subclause id="id617f273486554a0da687a422d2d1c09c"><enum>(I)</enum><text>a candidate for a listing as an endangered or threatened species under that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.);</text>
 </subclause><subclause id="iddefcafc68a0b4d18ac3cf94cb7315b77"><enum>(II)</enum><text>a species of concern; or</text> </subclause><subclause id="idf76e1455ad2642569c570c05e8a2b1cd"><enum>(III)</enum><text>listed by a State as a threatened or endangered species.</text>
 </subclause></clause></subparagraph></paragraph></subsection><subsection id="id5dcb8ec5d5c14f26aecbcfc1985bb4ae"><enum>(e)</enum><header>Water rights</header><text>Nothing in this section affects the allocation, ownership, interest, or control, as in existence on the date of enactment of this Act, of any water, water right, or any other valid existing right held by—</text>
 <paragraph id="id7403317A25854DB5B4254F2F432EF1AF"><enum>(1)</enum><text>the United States;</text> </paragraph><paragraph id="idBC623AA8C9874973A5AB8FC362CE5438"><enum>(2)</enum><text>an Indian Tribe;</text>
 </paragraph><paragraph id="idE5BB7827C36D41D2886B1A3C300853E4"><enum>(3)</enum><text>a State; or</text> </paragraph><paragraph id="idBA5A27E3A8A9474CB68D114C2A7A4CD5"><enum>(4)</enum><text>a person.</text>
					</paragraph></subsection></section></title><title id="id87cdb806f5a449fbbf109519119e425b"><enum>III</enum><header>Resolution of Burbank Canyons Wilderness Study Area</header>
			<section id="id5674414f842e40f0ab6a454a1e121cd9"><enum>301.</enum><header>Addition to National Wilderness Preservation System</header>
 <subsection id="id42847f27bb08468a9b44bd81ed9c8ba2"><enum>(a)</enum><header>Designation</header><text>In furtherance of the purposes of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), the approximately 12,392 acres of Federal land managed by the Bureau of Land Management and generally depicted as <quote>Burbank Canyons Wilderness</quote> on the Map is designated as wilderness and as a component of the National Wilderness Preservation System, to be known as the <quote>Burbank Canyons Wilderness</quote>.</text>
 </subsection><subsection id="id862a40f0cc504a62bdf9701081924039"><enum>(b)</enum><header>Boundary</header><text>The boundary of any portion of the Wilderness that is bordered by a road shall be not less than 100 feet from the centerline of the road to allow public access.</text>
				</subsection><subsection id="id095c171db6df44bd969eeab99a0086fb"><enum>(c)</enum><header>Map and legal description</header>
 <paragraph id="idc46ec8fdc9564396894a232f3c9393b4"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary concerned shall prepare a map and legal description of the Wilderness.</text>
 </paragraph><paragraph id="id174524409771450285635e972b507d55"><enum>(2)</enum><header>Effect</header><text>The map and legal description prepared under paragraph (1) shall have the same force and effect as if included in this Act, except that the Secretary concerned may correct any minor error in the map or legal description.</text>
 </paragraph><paragraph id="id0a9f14b259254d0abb9cdf743cb855f5"><enum>(3)</enum><header>Availability</header><text>A copy of the map and legal description prepared under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text>
 </paragraph></subsection><subsection id="idd3f2705df9be4405bcffd67b895c5873"><enum>(d)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the Wilderness is withdrawn from—</text> <paragraph id="idd03253d9ef764590a666a8644dcddb4f"><enum>(1)</enum><text>all forms of entry, appropriation, or disposal under the public land laws;</text>
 </paragraph><paragraph id="id74430a783a68423b81dfea9a417c51b5"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text> </paragraph><paragraph id="id250ef61ae1144a888c9315a5b40298b7"><enum>(3)</enum><text>disposition under all laws relating to mineral and geothermal leasing or mineral materials.</text>
					</paragraph></subsection></section><section id="idc1fe04a7279d404494b9af391d756720"><enum>302.</enum><header>Administration</header>
 <subsection id="id3a37bffde60b4255a231226c3f83230f"><enum>(a)</enum><header>Management</header><text>Subject to valid existing rights, the Wilderness shall be administered by the Secretary concerned in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), except that—</text>
 <paragraph id="id65561f85c345420193f93d3398b343f7"><enum>(1)</enum><text>any reference in that Act to the effective date shall be considered to be a reference to the date of enactment of this Act; and</text>
 </paragraph><paragraph id="idc458f8ca05384de187e793be4130121c"><enum>(2)</enum><text>any reference in that Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary of the Interior.</text>
 </paragraph></subsection><subsection id="id88163f729e6349d4baa71603891aec8b"><enum>(b)</enum><header>Livestock</header><text>The grazing of livestock in the Wilderness, if established before the date of enactment of this Act, shall be allowed to continue, subject to such reasonable regulations, policies, and practices as the Secretary concerned considers to be necessary in accordance with—</text>
 <paragraph id="id00eb2b0842414b098ce45e20d424ddbd"><enum>(1)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text> </paragraph><paragraph id="idc77c0f30015a40209df3e5497e323d1b"><enum>(2)</enum><text>the guidelines set forth in Appendix A of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (House Report 101–405).</text>
 </paragraph></subsection><subsection id="id3354178e320e49298ce525d1af6f5058"><enum>(c)</enum><header>Incorporation of acquired land and interests</header><text>Any land or interest in land within the boundaries of the Wilderness that is acquired by the United States after the date of enactment of this Act shall be added to, and administered as part of, the Wilderness.</text>
				</subsection><subsection id="id4138c1c4b5834e9c87f3ca9c885bfdde"><enum>(d)</enum><header>Adjacent management</header>
 <paragraph id="idf9500fce72fa4f33b40a778acc1f6585"><enum>(1)</enum><header>In general</header><text>Congress does not intend for the designation of the Wilderness to create a protective perimeter or buffer zone around the Wilderness.</text>
 </paragraph><paragraph id="id986aff6c1a81409f8cf52428fd1fee72"><enum>(2)</enum><header>Nonwilderness activities</header><text>The fact that nonwilderness activities or uses can be seen or heard from areas within the Wilderness shall not preclude the conduct of the activities or uses outside the boundary of the Wilderness.</text>
 </paragraph></subsection><subsection id="idbb0b7a7ada194362a7ca52a011370f94"><enum>(e)</enum><header>Military overflights</header><text>Nothing in this Act restricts or precludes—</text> <paragraph id="idb1c6eee9e51240a28c3bb40cbc34068d"><enum>(1)</enum><text>low-level overflights of military aircraft over the Wilderness, including military overflights that can be seen or heard within the wilderness area;</text>
 </paragraph><paragraph id="id18ea13b8e36741ad936c37260cc43fbe"><enum>(2)</enum><text>flight testing and evaluation; or</text> </paragraph><paragraph id="idfb4aacac20674454b4278377dbd69440"><enum>(3)</enum><text>the designation or creation of new units of special use airspace, or the establishment of military flight training routes, over the Wilderness.</text>
 </paragraph></subsection><subsection id="ida43fbc9ab87d4a51ac1147dd38e1242f"><enum>(f)</enum><header>Existing airstrips</header><text>Nothing in this Act restricts or precludes low-level overflights by aircraft utilizing airstrips in existence on the date of enactment of this Act that are located within 5 miles of the proposed boundary of the Wilderness.</text>
 </subsection><subsection id="idba0cead6d62b42f68ddcb3525e62d773"><enum>(g)</enum><header>Wildfire, insect, and disease management</header><text>In accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>), the Secretary concerned may take any measures in the Wilderness that the Secretary concerned determines to be necessary for the control of fire, insects, and diseases, including, as the Secretary concerned determines to be appropriate, the coordination of the activities with the State or a local agency.</text>
 </subsection><subsection id="id2d48cc1776834aae89e2aefb3efe9e4d"><enum>(h)</enum><header>Data collection</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.) and subject to such terms and conditions as the Secretary concerned may prescribe, the Secretary concerned may authorize the installation and maintenance of hydrologic, meteorologic, or climatological collection devices in the Wilderness if the Secretary concerned determines that the facilities, and access to the facilities, are essential to flood warning, flood control, or water reservoir operation activities.</text>
				</subsection><subsection id="id425aa995c85a422e9e2c265f32679106"><enum>(i)</enum><header>Water rights</header>
 <paragraph id="id944e5397eaea4a93884b774ac93d0bb9"><enum>(1)</enum><header>Findings</header><text>Congress finds that—</text> <subparagraph id="id36569f7797f0410cae7ad9502e2a7d1c"><enum>(A)</enum><text>the Wilderness is located—</text>
 <clause id="id949c01dca5214930a536b2506dae566e"><enum>(i)</enum><text>in the semiarid region of the Great Basin; and</text> </clause><clause id="iddc7acc9fa7e0485798874b8b3a3bec97"><enum>(ii)</enum><text>at the headwaters of the streams and rivers on land with respect to which there are few, if any—</text>
 <subclause id="id89275ff2e83040a18d668cc87667b617"><enum>(I)</enum><text>actual or proposed water resource facilities located upstream; and</text> </subclause><subclause id="id598c7db73d40497287e4ab290ab43e3a"><enum>(II)</enum><text>opportunities for diversion, storage, or other uses of water occurring outside the land that would adversely affect the wilderness values of the land;</text>
 </subclause></clause></subparagraph><subparagraph id="id8de3fcf832e940c899122bf524fa2174"><enum>(B)</enum><text>the Wilderness is generally not suitable for use or development of new water resource facilities; and</text>
 </subparagraph><subparagraph id="idb7340920ce4f4d95a1a8af72dc2e606e"><enum>(C)</enum><text>because of the unique nature of the Wilderness, it is possible to provide for proper management and protection of the wilderness and other values of land by means different from the means used in other laws.</text>
 </subparagraph></paragraph><paragraph id="id1e5c87fe6ccf4a4faa7de7ba7dca06ac"><enum>(2)</enum><header>Purpose</header><text>The purpose of this section is to protect the wilderness values of the Wilderness by means other than a federally reserved water right.</text>
 </paragraph><paragraph id="id2809f11b4bb54cd89f4424f4239bbd41"><enum>(3)</enum><header>Statutory construction</header><text>Nothing in this Act—</text> <subparagraph id="id7e946fd7b8cf474e8786dafc8876e8dd"><enum>(A)</enum><text>constitutes an express or implied reservation by the United States of any water or water rights with respect to the Wilderness;</text>
 </subparagraph><subparagraph id="idb25642f18329473d96d1416d6b862038"><enum>(B)</enum><text>affects any water rights in the State (including any water rights held by the United States) in existence on the date of enactment of this Act;</text>
 </subparagraph><subparagraph id="id6828408a5be74ee0bc56e5da22411f09"><enum>(C)</enum><text>establishes a precedent with regard to any future wilderness designations;</text> </subparagraph><subparagraph id="id113e1348304d4e679c5642f5f078f4f7"><enum>(D)</enum><text>affects the interpretation of, or any designation made under, any other Act; or</text>
 </subparagraph><subparagraph id="id551c49138f394b47b70232ddb18b8342"><enum>(E)</enum><text>limits, alters, modifies, or amends any interstate compact or equitable apportionment decree that apportions water among and between the State and other States.</text>
 </subparagraph></paragraph><paragraph id="id23a1fba420ca427b9ca9c755ea50d986"><enum>(4)</enum><header>State water law</header><text>The Secretary concerned shall follow the procedural and substantive requirements of State law in order to obtain and hold any water rights not in existence on the date of enactment of this Act with respect to the Wilderness.</text>
					</paragraph><paragraph id="id1fe3c57ab9164747b3ffbbbcfc72594e"><enum>(5)</enum><header>New projects</header>
						<subparagraph id="id9dc303c675e94ca9bdddc669d69b00d3"><enum>(A)</enum><header>Definition of water resource facility</header>
 <clause id="idff737614ff264729a4ee0fa1b30e9941"><enum>(i)</enum><header>In general</header><text>In this paragraph, the term <term>water resource facility</term> means irrigation and pumping facilities, reservoirs, water conservation works, aqueducts, canals, ditches, pipelines, wells, hydropower projects, transmission and other ancillary facilities, and other water diversion, storage, and carriage structures.</text>
 </clause><clause id="id1b963a2bd1ab463d8cd0dcdcab542856"><enum>(ii)</enum><header>Exclusion</header><text>In this paragraph, the term <term>water resource facility</term> does not include a wildlife guzzler.</text> </clause></subparagraph><subparagraph id="idf1c5a55e022542caa6389bc0abd77d31"><enum>(B)</enum><header>Restriction on new water resource facilities</header><text>Except as otherwise provided in this Act, on or after the date of enactment of this Act, neither the President nor any other officer, employee, or agent of the United States shall fund, assist, authorize, or issue a license or permit for the development of any new water resource facility within any wilderness area, including a portion of a wilderness area, that is located in the County.</text>
						</subparagraph></paragraph></subsection></section><section id="idaa378228baec44ffa0ebdf343715d6e6"><enum>303.</enum><header>Fish and wildlife management</header>
 <subsection id="id20ad61c4e7754406be543459e33fd2f3"><enum>(a)</enum><header>In general</header><text>In accordance with section 4(d)(7) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(7)</external-xref>), nothing in this Act affects or diminishes the jurisdiction of the State with respect to fish and wildlife management, including the regulation of hunting, fishing, and trapping, in the Wilderness.</text>
 </subsection><subsection id="id1def5a87c6b6445b8536d4cdcf72f5ce"><enum>(b)</enum><header>Management activities</header><text>In furtherance of the purposes and principles of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), the Secretary concerned may conduct any management activities in the Wilderness that are necessary to maintain or restore any fish or wildlife population, or the habitats to support such a population, if the activities are carried out—</text>
 <paragraph id="id24da3b0c56bf4e598ee249351058358b"><enum>(1)</enum><text>in a manner that is consistent with relevant wilderness management plans; and</text> </paragraph><paragraph id="idfa6d7cbf6e3046e8a4bdff51dd7cea2c"><enum>(2)</enum><text>in accordance with—</text>
 <subparagraph id="id2da10c9c8acd4a41bfeeafc032457ae2"><enum>(A)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.); and</text> </subparagraph><subparagraph id="id3697ebeaeee44faeb644df21a3ba139e"><enum>(B)</enum><text>appropriate policies, such as those set forth in Appendix B of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (House Report 101–405), including the occasional and temporary use of motorized vehicles and aircraft if the use, as determined by the Secretary concerned, would promote healthy, viable, and more naturally distributed wildlife populations that would enhance wilderness values with the minimal impact necessary to reasonably accomplish those tasks.</text>
 </subparagraph></paragraph></subsection><subsection id="idaacf1492b6334a78b27f3cc79f09c706"><enum>(c)</enum><header>Existing activities</header><text>Consistent with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>) and in accordance with appropriate policies such as those set forth in Appendix B of the report of the Committee on Interior and Insular Affairs of the House of Representatives accompanying H.R. 2570 of the 101st Congress (House Report 101–405), the State may continue to use aircraft, including helicopters, to survey, capture, transplant, monitor, and provide water for wildlife populations in the Wilderness.</text>
				</subsection><subsection id="idfce577d60f56462c8fbc51467178da00"><enum>(d)</enum><header>Hunting, fishing, and trapping</header>
 <paragraph id="id4b2be58b4f0a453c9bf809452cba1e6d"><enum>(1)</enum><header>In general</header><text>The Secretary concerned may designate areas in which, and establish periods during which, for reasons of public safety, administration, or compliance with applicable laws, no hunting, fishing, or trapping will be permitted in the Wilderness.</text>
 </paragraph><paragraph id="id06e06a05206b46c19cc30d8c680be98e"><enum>(2)</enum><header>Consultation</header><text>Except in emergencies, the Secretary concerned shall consult with the appropriate State agency and notify the public before making any designation under paragraph (1).</text>
					</paragraph></subsection><subsection id="id19d87dfa6e064b73aa7dbceabc327944"><enum>(e)</enum><header>Cooperative agreement</header>
 <paragraph id="id4aed88831c87464eabfb4ce18c5ba918"><enum>(1)</enum><header>In general</header><text>The State (including a designee of the State) may conduct wildlife management activities in the Wilderness—</text>
 <subparagraph id="idd4c5177afb1b4620a4ab3357f05272a3"><enum>(A)</enum><text>in accordance with the terms and conditions specified in the cooperative agreement between the Secretary of the Interior and the State entitled <quote>Memorandum of Understanding between the Bureau of Land Management and the Nevada Department of Wildlife Supplement No. 9</quote> and signed November and December 2003, including any amendments to the cooperative agreement agreed to by the Secretary of the Interior and the State; and</text>
 </subparagraph><subparagraph id="idf610d2ceb5e84a0487f323757686b69f"><enum>(B)</enum><text>subject to all applicable laws (including regulations).</text> </subparagraph></paragraph><paragraph id="idd42723657ea044eebe11f2c34f9a49a0"><enum>(2)</enum><header>References; Clark County</header><text>For the purposes of this subsection, any reference contained in the cooperative agreement described in paragraph (1)(A) to <quote>Clark County</quote> shall be considered to be a reference to the Wilderness.</text>
					</paragraph></subsection></section><section id="idca0f9446512c4c98aa1c83edd45167cc"><enum>304.</enum><header>Release of wilderness study area</header>
 <subsection id="idcdb04b092971485992e3bfcf00026c29"><enum>(a)</enum><header>Finding</header><text>Congress finds that, for purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the approximately 1,065 acres of public land in the Burbank Canyons Wilderness study area that is not designated as wilderness by section 301 has been adequately studied for wilderness designation.</text>
 </subsection><subsection id="idea3aa95a5ce24173960b77982c593136"><enum>(b)</enum><header>Release</header><text>Effective beginning on the date of enactment of this Act, the public land described in subsection (a)—</text>
 <paragraph id="id0e45c9ffe9fe4bd181750a9288bfcf31"><enum>(1)</enum><text>shall no longer be subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text>
 </paragraph><paragraph id="id311940fba3b946a0a2ecc9a7a6c1cf7a"><enum>(2)</enum><text>shall be managed in accordance with any applicable—</text> <subparagraph id="idce12917b28ff45aa9ef5c489ca60c7e7"><enum>(A)</enum><text>land management plans adopted under section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>); and</text>
 </subparagraph><subparagraph id="id6fbff4c60c9648878043d114c5413ddb"><enum>(B)</enum><text>cooperative conservation agreements in existence on the date of enactment of this Act.</text> </subparagraph></paragraph></subsection></section><section id="ided2a59e75405445fabf6341d8b1bb980"><enum>305.</enum><header>Native American cultural and religious uses</header><text display-inline="no-display-inline">Nothing in this title alters or diminishes the treaty rights of any Indian tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)).</text>
			</section></title><title id="id094482595c87402ba4c7f3ab2d6a6a30"><enum>IV</enum><header>Transfer of administrative jurisdiction over Forest Service land</header>
			<section id="id8edb7f2e7fe644718ca9e01875cce551"><enum>401.</enum><header>Authority to transfer</header>
 <subsection id="id14a4d9589919407f85cfd3946c335b5f"><enum>(a)</enum><header>In general</header><text>Consistent with section 3(b) of <external-xref legal-doc="public-law" parsable-cite="pl/96/586">Public Law 96–586</external-xref> (commonly known as the <quote>Santini-Burton Act</quote>) (94 Stat. 3384), and subject to valid existing rights, on receipt of a request by the State or County and subject to such terms and conditions as are satisfactory to the Secretary of Agriculture, the Secretary of Agriculture may transfer to the State or County the Forest Service land, or any interest in the Forest Service land, described in subsection (b), without consideration, to protect the environmental quality and public recreational use of the transferred Forest Service land.</text>
 </subsection><subsection id="idfaa60fa01111401783f417b839604d25"><enum>(b)</enum><header>Description of Forest Service land</header><text>The land referred to in subsection (a) is any Forest Service land located within the boundaries of the area acquired under <external-xref legal-doc="public-law" parsable-cite="pl/96/586">Public Law 96–586</external-xref> (commonly known as the <quote>Santini-Burton Act</quote>) (94 Stat. 3381) that is—</text>
 <paragraph id="id6551f90f40834a99ba2236b2ecc78f21"><enum>(1)</enum><text>unsuitable for Forest Service administration; or</text> </paragraph><paragraph id="idb365e42f8c4f4b2c82c95fe322f0455a"><enum>(2)</enum><text>necessary for a public purpose.</text>
 </paragraph></subsection><subsection id="ida2ab41e6ee374265acd19f1b293c5c23"><enum>(c)</enum><header>Use of land</header><text>Any land or interest conveyed pursuant to subsection (a) shall—</text> <paragraph id="id5fd8d6126ea848869085cbe45e9037e9"><enum>(1)</enum><text>be managed by the State or County, as applicable—</text>
 <subparagraph id="id95a184dffb8049b3adcd6f566f450a1e"><enum>(A)</enum><text>to maintain undeveloped open space;</text> </subparagraph><subparagraph id="idF5F597EC0D414610A9AAA0302FFD1345"><enum>(B)</enum><text>to preserve the natural characteristics of the transferred land in perpetuity; and</text>
 </subparagraph><subparagraph id="id6ab864497c944e5888faedb0807d7815"><enum>(C)</enum><text>to protect and enhance water quality, stream environment zones, and important wildlife habitat; and</text> </subparagraph></paragraph><paragraph id="id30d36e3136db49f386c6d3b7cd011a9a"><enum>(2)</enum><text>be used by the State or County, as applicable, for recreation or other public purposes, including trails, trailheads, fuel reduction, flood control, and other infrastructure consistent with the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869</external-xref> et seq.).</text>
 </paragraph></subsection><subsection id="idcdf300e4da1b4934bdce745c5e99c060"><enum>(d)</enum><header>Reversion</header><text>If any land or interest in land conveyed pursuant to subsection (a) is used in a manner that is inconsistent with subsection (c), the land or interest shall, at the discretion of the Secretary of Agriculture, revert to the United States.</text>
				</subsection></section><section id="id5cbf46cb43fa48fab75f063e0b65c032"><enum>402.</enum><header>Special use permits for recreation and public purposes</header>
 <subsection id="idd0ab5b3673ed46bf887e4d154e6c4a29"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date on which the Secretary of Agriculture receives from the County or a unit of local government an application for the use of the Federal land described in subsection (b), the Secretary, in accordance with all applicable laws, shall issue to the County or unit of local government a special use permit for recreation and public purposes for a term of not less than 30 years.</text>
 </subsection><subsection id="id726bb4ede3134a828b4c6f56a7d2c20d"><enum>(b)</enum><header>Description of land</header><text>The land referenced in subsection (a) is the approximately 188 acres of Federal land in the County generally depicted as <quote>Directed Special Use Permit</quote> on the Map.</text></subsection></section></title></legis-body></bill>
