 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Bio and Agro-Defense Facility Act of 2019</short-title></quote>.</text>
 </section><section id="id6B9D0F6A386244F1868DAE4056E4A141"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="id81dbad8658cd4bfe8874f1688db2c0f7"><enum>(1)</enum><header>Animal</header><text>The term <term>animal</term> has the meaning given the term in section 10403 of the Animal Health Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8302">7 U.S.C. 8302</external-xref>).</text>
 </paragraph><paragraph id="idD9BD949FAB1047EB8947A9B04E7747AE"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Agriculture.</text> </paragraph><paragraph id="ide5b4265b270b455dbd347beddad7b658"><enum>(3)</enum><header>Transboundary disease</header><text>The term <term>transboundary disease</term> has the meaning given the term in section 12203(a) of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/7/8914">7 U.S.C. 8914(a)</external-xref>).</text>
 </paragraph><paragraph commented="no" id="id904B9AE25496433FAA02780F25A11EAC"><enum>(4)</enum><header>Veterinary countermeasure</header><text>The term <term>veterinary countermeasure</term> has the meaning given the term in section 10403 of the Animal Health Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8302">7 U.S.C. 8302</external-xref>).</text>
			</paragraph></section><section id="idE581D16C465E438E99846130F215B3EA"><enum>3.</enum><header>National Bio and Agro-Defense Facility</header>
 <subsection changed="deleted" id="idfc6c00f238494a6cb1eee835694c703f" reported-display-style="strikethrough"><enum>(a)</enum><header>In general</header><text>The Secretary shall carry out the relevant responsibilities of the Secretary under Homeland Security Presidential Directive 9 (relating to the defense of United States agriculture and food) and the national biodefense strategy developed under section 1086 of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="usc" parsable-cite="usc/6/104">6 U.S.C. 104</external-xref>) by acting, as appropriate, through the National Bio and Agro-Defense Facility as a national security laboratory asset of the national biodefense enterprise to provide integrated research, development, and test and evaluation infrastructure for defending against bio- and agro-terrorism threats.</text>
 </subsection><subsection changed="deleted" commented="no" id="id1a76685f453c42da8a14bb602e370e9a" reported-display-style="strikethrough"><enum>(b)</enum><header>Duties</header><text>Pursuant to subsection (a), the Secretary shall use the National Bio and Agro-Defense Facility—</text> <paragraph commented="no" id="id475f7bd28dd148a59e3306cfe9a114bd"><enum>(1)</enum><text>to integrate agricultural, zoonotic disease, and public health research;</text>
 </paragraph><paragraph commented="no" id="idda3d1a6501c548dca93180d34856db96"><enum>(2)</enum><text>to address threats from human pathogens, high-consequence zoonotic disease agents, emerging foreign animal diseases, and animal transboundary diseases;</text>
 </paragraph><paragraph commented="no" id="id49216DEA9B084621B1DB92015F08E3DF"><enum>(3)</enum><text>to address biological incidence threats;</text> </paragraph><paragraph id="ida6eb07f9f2d94d48914e21eb5919b86b"><enum>(4)</enum><text>to provide training; and</text>
 </paragraph><paragraph id="idec97a0dc77bc4a85bcb4958db8f62f76"><enum>(5)</enum><text>to coordinate, partner, and share data and information with the Secretary of Homeland Security, including the support of the production of biological material threat assessments.</text>
 </paragraph></subsection><subsection changed="added" id="idEFF5F2B1653E47F9B429DD8B20E7F715" reported-display-style="italic"><enum>(a)</enum><header>In general</header><text>The National Bio and Agro-Defense Facility shall be a national security laboratory asset to provide integrated research, development, test and evaluation infrastructure, and response capabilities for defending the United States against bio- and agro-terrorism threats.</text>
 </subsection><subsection changed="added" commented="no" id="id635E7C2442A549AB8A593C6ECAE05FC8" reported-display-style="italic"><enum>(b)</enum><header>Duties</header><text>Pursuant to subsection (a), the Secretary, the Secretary of Homeland Security, the Secretary of Health and Human Services, and the heads of other appropriate Federal departments and agencies shall use the National Bio and Agro-Defense Facility to protect the food supply, agriculture, and public health of the United States, including by—</text>
 <paragraph commented="no" id="id9673325EE6AA4F3B91A3B4417387698A"><enum>(1)</enum><text>integrating agricultural, zoonotic disease, and other appropriate research;</text> </paragraph><paragraph commented="no" id="id006F8E802818457ABEDBD8C5949D6BC7"><enum>(2)</enum><text>addressing threats from high-consequence zoonotic disease agents, emerging foreign animal diseases, and animal transboundary diseases;</text>
 </paragraph><paragraph commented="no" id="id6324071481244D3BBFCD09FE28AAE6EE"><enum>(3)</enum><text>addressing biological incidence threats;</text> </paragraph><paragraph id="idB44D0B94D9FF46EDB8ADCAE07D6DAE2E"><enum>(4)</enum><text>providing appropriate education and training to address bio- and agro-defense threats and responses;</text>
 </paragraph><paragraph commented="no" id="id2A3583ADE3904ABB8BD893BFB20E5BA1"><enum>(5)</enum><text>sharing data and related information with appropriate Federal departments or agencies, as requested by the heads of those departments or agencies, or as necessary, to support the production of biological material threat assessments; and</text>
 </paragraph><paragraph commented="no" id="idCF4C6ACE77F74A9E8D5FD130D3A65F5F"><enum>(6)</enum><text>coordinating, partnering, and sharing data and related information to enhance the carrying out of the duties of the National Bio and Agro-Defense Facility for the development of priority zoonotic animal disease diagnostics, vaccines, drugs, and other countermeasures.</text>
 </paragraph></subsection></section><section id="idcc6cd882437048398024138516aac578"><enum>4.</enum><header>Research and development</header><text display-inline="no-display-inline"><deleted-phrase reported-display-style="strikethrough">Pursuant to section 3, the Secretary shall carry out research and development objectives—</deleted-phrase></text>
 </section><section display-inline="yes-display-inline" id="id7257B73152FE409F85FDA0294120B92B" section-type="undesignated-section"><text display-inline="no-display-inline"><added-phrase reported-display-style="italic">Pursuant to section 3, the Secretary, the Secretary of Homeland Security, the Secretary of Health and Human Services, and the heads of other appropriate Federal departments and agencies shall continually establish shared priorities for the research to be conducted in the National Bio and Agro-Defense Facility and carry out research and development objectives at the National Bio and Agro-Defense Facility—</added-phrase></text>
 <paragraph id="idc90b897e31e64c0c94d285710866802f"><enum>(1)</enum><text>to develop veterinary countermeasures for emerging foreign animal diseases and animal transboundary diseases;</text>
 </paragraph><paragraph id="id6286c71086bc4d91b1b0da5b41b6eacb"><enum>(2)</enum><text>to provide <deleted-phrase reported-display-style="strikethrough">advance</deleted-phrase><added-phrase reported-display-style="italic">advanced</added-phrase> test, diagnostic, and evaluation capability for threat detection, vulnerability assessment, and veterinary countermeasure assessment for animal and zoonotic <deleted-phrase reported-display-style="strikethrough">diseases; and</deleted-phrase><deleted-phrase reported-display-style="strikethrough"></deleted-phrase></text>
 </paragraph><paragraph changed="deleted" id="ida578194b253d49268acc0a64cfd04749" reported-display-style="strikethrough"><enum>(3)</enum><text>for such other purposes as the Secretary determines to be appropriate.</text> </paragraph></section><section changed="deleted" id="id106c31136fab453d8b2914e3e2cde5cf" reported-display-style="strikethrough"><enum>5.</enum><header>Evaluation</header><text display-inline="no-display-inline">Pursuant to section 4, not less frequently than biennially, the Secretary, in coordination with the Secretary of Homeland Security and the heads of other relevant agencies, shall evaluate and update the strategic research plan for the National Bio and Agro-Defense Facility based on risk and threat assessments.</text>
		</section><section changed="deleted" id="id75f53694192b409d8763230fac57027d" reported-display-style="strikethrough"><enum>6.</enum><header>Availability of data</header>
 <subsection changed="not-changed" id="idFE6E65166A594613B4A91F3BAF20DB92"><enum><deleted-phrase reported-display-style="strikethrough">(a)</deleted-phrase></enum><header><deleted-phrase reported-display-style="strikethrough">Congressional report</deleted-phrase></header><text display-inline="yes-display-inline"><deleted-phrase reported-display-style="strikethrough">Every 6 months until</deleted-phrase><added-phrase reported-display-style="italic">diseases;</added-phrase></text> <paragraph changed="added" id="ide43b7503823b4496a3b8b0fabf63bb46" reported-display-style="italic"><enum>(3)</enum><text>to assist, as appropriate, with the development, and address vulnerability assessments, of the agriculture and food sectors; and</text>
 </paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="id865D63AC83184A2DB77CB8090EF1B676" reported-display-style="italic"><enum>(4)</enum><text>for such other purposes as the Secretary, in consultation with the Secretary of Homeland Security, the Secretary of Health and Human Services, and the heads of other appropriate Federal departments and agencies, determines to be appropriate.</text>
				</paragraph></subsection></section><section changed="added" id="id66349230D03C4719943D7F42881B48F5" reported-display-style="italic"><enum>5.</enum><header>Evaluation and plan</header>
 <subsection id="idDA6ED3CC8FC04B819CA7E1CDA04F139C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Pursuant to section 4, not less frequently than biennially, the Secretary, in coordination with the Secretary of Homeland Security, the Secretary of Health and Human Services, and the heads of other appropriate Federal departments and agencies, shall—</text>
 <paragraph id="id62AC50D290C841B0B151877F98DC5378"><enum>(1)</enum><text display-inline="yes-display-inline">evaluate the work of the National Bio and Agro-Defense Facility;</text> </paragraph><paragraph id="id3D98A8D7155A4972AFE63E7F8E35666B"><enum>(2)</enum><text display-inline="yes-display-inline">publish a strategic research plan for the National Bio and Agro-Defense Facility based on risk and threat assessments; and</text>
 </paragraph><paragraph id="id8DA9F18C3AC847D7B1B4FC32B71E8779"><enum>(3)</enum><text>submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate, the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on Health, Education, Labor, and Pensions of the Senate, the Committee on Agriculture of the House of Representatives, the Committee on Homeland Security of the House of Representatives, and the Committee on Energy and Commerce of the House of Representatives the strategic research plan described in paragraph (2).</text>
 </paragraph></subsection><subsection id="idf418f4e42bef43c5bc4a1c565fe2371c"><enum>(b)</enum><header>Classified information</header><text>The strategic research plan required under subsection (a)(2)—</text> <paragraph id="idF034FCD60C374EDABFB9E16B0FAE5170"><enum>(1)</enum><text>shall be published in an unclassified format that is publically available;</text>
 </paragraph><paragraph id="idC4E9813809774F40A94748E1EBA63A05"><enum>(2)</enum><text>shall be submitted under subsection (a)(3) in unclassified form; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDF6F3A20378949578507CADEDD7BEEB0"><enum>(3)</enum><text>may include in the submission under subsection (a)(3) a classified annex for any sensitive or classified information, as necessary.</text>
 </paragraph></subsection></section><section changed="added" id="id1b42de6df9d24657880da08becaa39e7" reported-display-style="italic"><enum>6.</enum><header>Memoranda of agreement</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary shall enter into memoranda of agreement with the Secretary of Homeland Security, the Secretary of Health and Human Services, and the heads of other appropriate Federal departments and agencies for the use, operation, and research of the National Bio and Agro-Defense Facility by those Secretaries and department and agency heads.</text>
		</section><section changed="added" id="idEEDC1CE363D844768E64CFA2A2162D10" reported-display-style="italic"><enum>7.</enum><header>Availability of data and congressional briefings</header>
 <subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="id9BD311F53EE845B9B68A423AEC2886B0"><enum><added-phrase reported-display-style="italic">(a)</added-phrase></enum><header><added-phrase reported-display-style="italic">In general</added-phrase></header><text display-inline="yes-display-inline"><added-phrase reported-display-style="italic">Every 6 months until</added-phrase> the date described in subsection (b), the Secretary and the Secretary of Homeland Security, as appropriate, shall <deleted-phrase reported-display-style="strikethrough">submit</deleted-phrase><added-phrase reported-display-style="italic">provide</added-phrase> to the Committees on Agriculture, Nutrition, and Forestry and Homeland Security and Governmental Affairs of the Senate and the Committees on Agriculture and Homeland Security of the House of Representatives a report <added-phrase reported-display-style="italic">and briefing</added-phrase> describing—</text>
 <paragraph changed="not-changed" id="id121202BDC46B4B4EBE00D5FA1890FBD7"><enum>(1)</enum><text display-inline="yes-display-inline">progress under each phase described in the memorandum of agreement entitled <quote>Memorandum of Agreement Between the U.S. Department of Agriculture Marketing and Regulatory Programs, the U.S. Department of Agriculture Research, Education, and Economics, and the Department of Homeland Security Science and Technology Directorate</quote> and dated June 20, 2019, that is not completed as of the date of enactment of this Act; <deleted-phrase reported-display-style="strikethrough">and</deleted-phrase></text>
 </paragraph><paragraph changed="not-changed" id="id405D901B506C4494BCCF6F0F19C04516"><enum><deleted-phrase reported-display-style="strikethrough">(2)</deleted-phrase></enum><text><deleted-phrase reported-display-style="strikethrough">the operations and mission, including coordination, under any successor memorandum of agreement, or similar joint agreement or understanding, between the Department of Agriculture</deleted-phrase></text>
 </paragraph><paragraph changed="added" id="idb9516c4700944b909e69675c749addb9" reported-display-style="italic"><enum>(2)</enum><text>the status of completion of the memoranda of agreement under section 6; and</text> </paragraph><paragraph changed="added" id="id69D303DC6ABB43F094EF4827BBF95264" reported-display-style="italic"><enum>(3)</enum><text>the operations and mission of the National Bio and Agro-Defense Facility, including the coordination and carrying out of—</text>
 <subparagraph changed="added" id="idCA156D1D81A04C109559555F643800AE" reported-display-style="italic"><enum>(A)</enum><text>the memoranda of agreement described in paragraphs (1) and (2);</text> </subparagraph><subparagraph changed="added" id="id7638D4CD2C274641AE32918DDF6E8F20" reported-display-style="italic"><enum>(B)</enum><text>any successor memoranda of agreement to the memoranda of agreement described in paragraphs (1) and (2); or</text>
 </subparagraph><subparagraph changed="not-changed" id="idD6EAEB2157CE4662915F860A531689B7"><enum><added-phrase reported-display-style="italic">(C)</added-phrase></enum><text><added-phrase reported-display-style="italic">any similar joint agreement or understanding between the Department of Agriculture</added-phrase> and the Department of Homeland Security, or other relevant agencies, that documents the biodefense mission of the National Bio and Agro-Defense Facility.</text>
 </subparagraph></paragraph></subsection><subsection changed="not-changed" id="idF33DA61982EE408FB4BF1B5647BFD6AC"><enum>(b)</enum><header>Termination</header><text display-inline="yes-display-inline">The reporting <deleted-phrase reported-display-style="strikethrough">requirement</deleted-phrase><added-phrase reported-display-style="italic">and briefing requirements</added-phrase> under subsection (a) shall terminate on the date that is <deleted-phrase reported-display-style="strikethrough">2</deleted-phrase><added-phrase reported-display-style="italic">5</added-phrase> years after the date on which the National Bio and Agro-Defense Facility attains full operating capability.</text>
 </subsection><subsection changed="deleted" id="idC1F2A9A2E062439D9CB990D2E18A909A" reported-display-style="strikethrough"><enum>(c)</enum><header>Effective date</header><text>This section shall take effect on the date of enactment of this Act.</text> </subsection></section><section changed="deleted" id="id6EF7C7C81C6B41C0B4F7F1A36A3DF2A9" reported-display-style="strikethrough"><enum>7.</enum><header>Effect</header> </section><section changed="added" commented="no" id="id7d525155d38f4a6281275bd6d71fbe37" reported-display-style="italic"><enum>8.</enum><header>Budget and report</header> <subsection commented="no" id="id7A0195CEB10B47AFA823CB4504BACB87"><enum>(a)</enum><header>Budget</header><text display-inline="yes-display-inline">Concurrently with each budget submission to the Director of the Office of Management and Budget, the Secretary, the Secretary of Homeland Security, and the Secretary of Health and Human Services shall jointly submit to the Director of the Office of Management and Budget an integrated budget plan for the defense of the United States food system, including the operation and use of the National Bio and Agro-Defense Facility.</text>
 </subsection><subsection commented="no" id="id361BBC0F46C442B895471FE661578921"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 60 days after the date on which the budget of the United States Government is submitted by the President under section 1105 of title 31, United States Code, for each fiscal year, the Secretary, the Secretary of Homeland Security, and the Secretary of Health and Human Services shall jointly submit to Congress a report describing an integrated budget plan described in subsection (a), which shall be consistent with the budget submission of the President under that section for the defense of the United States food system, including the operation and use of the National Bio and Agro-Defense Facility.</text>
			</subsection></section><section changed="added" commented="no" display-inline="no-display-inline" id="id4D5ABE9C19F24FA6B4D6F5974C42B504" reported-display-style="italic" section-type="subsequent-section"><enum>9.</enum><header>Effect</header>
 <subsection changed="not-changed" id="id875E0B049D764A349ADCAA5D88E1844D"><enum>(a)</enum><header>In general</header><text>Nothing in this Act requires the Secretary to have <deleted-phrase reported-display-style="strikethrough">administrative jurisdiction over</deleted-phrase><added-phrase reported-display-style="italic">responsibility for operations of</added-phrase> the National Bio and Agro-Defense Facility.</text> </subsection><subsection changed="not-changed" id="id7BDA72BC052C4DADA68B0CB4CF8C82A1"><enum>(b)</enum><header>Transfer of jurisdiction</header><text>If <deleted-phrase reported-display-style="strikethrough">administrative jurisdiction over</deleted-phrase><added-phrase reported-display-style="italic">responsibility for operations of</added-phrase> the National Bio and Agro-Defense Facility is transferred from the Secretary to another Federal agency, any reference in this Act (other than section <deleted-phrase reported-display-style="strikethrough">6</deleted-phrase><added-phrase reported-display-style="italic">7</added-phrase>) to the Secretary shall be deemed to be a reference to the head of that Federal agency.</text>
 </subsection></section><section changed="deleted" id="id74037544223E40FAB61CA80BCF0E685F" reported-display-style="strikethrough"><enum>8.</enum><header>Effective date</header><text display-inline="no-display-inline">Except for section 6, this Act shall take effect on the date on which all phases in the memorandum of agreement described in section 6(a)(1) are completed.</text>
		</section><section changed="added" id="id61D2A5B297214103A8C08869A1245C94" reported-display-style="italic"><enum>10.</enum><header>Effective date</header>
 <subsection id="idA54787DC0C814A11AD3C58A02532B1E0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), this Act shall take effect on the date on which the initial operating capability described in the memorandum of agreement described in section 7(a)(1) takes effect.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id49FCA7CF0109474E992345F2D7E1DC0B"><enum>(b)</enum><header>Exceptions</header><text>Sections 7 and 8 shall take effect on the date of enactment of this Act.</text></subsection></section></legis-body><endorsement><action-date>December 17, 2019</action-date><action-desc>Reported with amendments</action-desc></endorsement></bill>
