	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H1E4192111A2B4F6E923EE9157480F75D" style="OLC">
 <section id="HE3A4BB84EDA24B66BAD5C8A732EC3D51" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Land Renewable Energy Development Act of 2019</short-title></quote>.</text> </section><section id="H5BD9E805A8754A67B400446A1FD3B2D3"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="H2711BAF4BD7640E8B57C2EA08D316981"><enum>(1)</enum><header>Covered land</header><text>The term <term>covered land</term> means land that is—</text> <subparagraph id="H4B89A12B17FA41D8B8C9E03B2AD46F06"><enum>(A)</enum><text>public land; and</text>
 </subparagraph><subparagraph id="H02218387C9E04D85B798DA00782A644C"><enum>(B)</enum><text>not excluded from the development of geothermal, solar, or wind energy under—</text> <clause id="H87E49BB990E94BFBA0AA62DC626AA321"><enum>(i)</enum><text>a land use plan established under the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.); or</text>
 </clause><clause id="HA703F4932FAA4DFA8A08088730CB7C3D"><enum>(ii)</enum><text>other Federal law.</text> </clause></subparagraph></paragraph><paragraph id="H80AEA6E459574B4FAB2585FA88776185"><enum>(2)</enum><header>Exclusion area</header><text>The term <term>exclusion area</term> means covered land that is identified by the Bureau of Land Management as not suitable for development of renewable energy projects.</text>
 </paragraph><paragraph id="H503E60C5CB8242FDB812ECFD53D9A369"><enum>(3)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text> <subparagraph id="H4D688A572E874628BD654DDF538A2586"><enum>(A)</enum><text>National Forest System land; and</text>
 </subparagraph><subparagraph id="H5142A68D335348939C07BDDE6F1CF191"><enum>(B)</enum><text>public land.</text> </subparagraph></paragraph><paragraph id="HEBC02D8C9DDE422E800F11F18F9B4A4E"><enum>(4)</enum><header>Fund</header><text>The term <term>Fund</term> means the Renewable Energy Resource Conservation Fund established by section 9(c)(1).</text>
 </paragraph><paragraph id="idDF07482C9BD94224B3EE2B980B37E05B"><enum>(5)</enum><header>National Forest System</header><text>The term <term>National Forest System</term> has the meaning given the term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text>
 </paragraph><paragraph id="H0B433818FEAF495B9D3AA68E829940CC"><enum>(6)</enum><header>Priority area</header><text display-inline="yes-display-inline">The term <term>priority area</term> means covered land identified by the land use planning process of the Bureau of Land Management as being a preferred location for a renewable energy project, including a designated leasing area (as defined in section 2801.5(b) of title 43, Code of Federal Regulations (or a successor regulation)) that is identified under the rule of the Bureau of Land Management entitled <quote>Competitive Processes, Terms, and Conditions for Leasing Public Lands for Solar and Wind Energy Development and Technical Changes and Corrections</quote> (81 Fed. Reg. 92122 (December 19, 2016)) (or a successor regulation).</text>
 </paragraph><paragraph id="H034BCB839C4D48E1B68404C332716009"><enum>(7)</enum><header>Public land</header><text>The term <term>public land</term> has the meaning given the term <term>public lands</term> in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text>
 </paragraph><paragraph id="H22A9586680ED4E01A9CA07AAA7B334BE"><enum>(8)</enum><header>Renewable energy project</header><text>The term <term>renewable energy project</term> means a project carried out on covered land that uses wind, solar, or geothermal energy to generate energy.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3E38903885CB43A797ABEB1F35A6E62D"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph><paragraph id="H5FA7924CF0214F1580A299344501A1B2"><enum>(10)</enum><header>Variance area</header><text>The term <term>variance area</term> means covered land that—</text>
 <subparagraph id="HA1380CE42AFF49EFBED62FF75789787F"><enum>(A)</enum><text>is not an exclusion area; and</text> </subparagraph><subparagraph id="HECC485D4B8D14F83A0F440D5FB06DC13"><enum>(B)</enum><text>is not a priority area.</text>
				</subparagraph></paragraph></section><section id="H96FA4C783C3F415A857284E377D45681"><enum>3.</enum><header>Land use planning; supplements to programmatic environmental impact statements</header>
			<subsection id="H1C171EBF1AE54E65A7A5CF08D3DD6CBA"><enum>(a)</enum><header>Priority areas</header>
 <paragraph id="HFECBE4A952AB47B2BD97DAC482FE754D"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Secretary of Energy, shall establish priority areas on covered land for geothermal, solar, and wind energy projects.</text>
				</paragraph><paragraph id="HBC306AF91EDB402AB5BF95F3EAD9D004"><enum>(2)</enum><header>Deadline</header>
 <subparagraph id="HC5609283F13345EEAD9D528918BBC0E5"><enum>(A)</enum><header>Geothermal energy</header><text>For geothermal energy, the Secretary shall establish priority areas as soon as practicable, but not later than 5 years, after the date of enactment of this Act.</text>
 </subparagraph><subparagraph id="H14D508BB127043209D22A5AC9AA14334"><enum>(B)</enum><header>Solar energy</header><text display-inline="yes-display-inline">For solar energy, the Secretary shall establish additional priority areas as soon as practicable, but not later than 3 years, after the date of enactment of this Act.</text>
 </subparagraph><subparagraph display-inline="no-display-inline" id="H7BD48F3E737E4765ABB7E33AECAE5FF1"><enum>(C)</enum><header>Wind energy</header><text display-inline="yes-display-inline">For wind energy, the Secretary shall establish priority areas as soon as practicable, but not later than 3 years, after the date of enactment of this Act.</text>
 </subparagraph></paragraph></subsection><subsection id="HDFAA6E04731A434FB4D73AF63E112FBA"><enum>(b)</enum><header>Variance areas</header><text>To the maximum extent practicable, variance areas shall be considered for renewable energy project development, consistent with the principles of multiple use (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)).</text>
 </subsection><subsection id="H30ABA53A194549EABA0B6E6D181A6C58"><enum>(c)</enum><header>Review and modification</header><text>Not less frequently than once every 5 years, the Secretary shall—</text> <paragraph id="HFA2048609F1C4F0E95310A7B18921D84"><enum>(1)</enum><text>review the adequacy of land allocations for geothermal, solar, and wind energy priority and variance areas for the purpose of encouraging new renewable energy development opportunities; and</text>
 </paragraph><paragraph id="H595F4B45D8334C2DA5B31E335ADDC9EB"><enum>(2)</enum><text>based on the review carried out under paragraph (1), add, modify, or eliminate priority, variance, and exclusion areas.</text>
 </paragraph></subsection><subsection id="H9FF763EE1129499DA6E0A25FB63BF1F3"><enum>(d)</enum><header>Compliance with the national environmental policy act</header><text>For purposes of this section, compliance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) shall be accomplished—</text>
 <paragraph id="H4D1914D646234AA8A04E8E3C2153D56F"><enum>(1)</enum><text display-inline="yes-display-inline">for geothermal energy, by supplementing the October 2008 final programmatic environmental impact statement for geothermal leasing in the Western United States, including by incorporating any additional regional analyses that were completed by Federal agencies after the date on which the programmatic environmental impact statement was finalized;</text>
 </paragraph><paragraph id="HDA906D51C45041119746DCA93A742BB1"><enum>(2)</enum><text display-inline="yes-display-inline">for solar energy, by supplementing the July 2012 final programmatic environmental impact statement for the Solar Energy Program of the Bureau of Land Management, including by incorporating any additional regional analyses that were completed by Federal agencies after the date on which the programmatic environmental impact statement was finalized; and</text>
 </paragraph><paragraph id="HEF449283B94346E49E597CBA26C55F9B"><enum>(3)</enum><text display-inline="yes-display-inline">for wind energy, by supplementing the July 2005 final programmatic environmental impact statement for wind energy development, including by incorporating any additional regional analyses that were completed by Federal agencies after the date on which the programmatic environmental impact statement was finalized.</text>
 </paragraph></subsection><subsection id="HC38ECA05D3E04CCA9DC33A3BE3FE2DDC"><enum>(e)</enum><header>No effect on processing applications</header><text>A requirement to prepare a supplement to a programmatic environmental impact statement under this section shall not result in any delay in processing an application for a renewable energy project.</text>
 </subsection><subsection id="HC605C2BCCA564847BE8DD01941EC0A79"><enum>(f)</enum><header>Coordination</header><text>In developing a supplement required by this section, the Secretary shall coordinate, on an ongoing basis, with appropriate State, Tribal, and local governments, transmission infrastructure owners and operators, developers, and other appropriate entities to ensure that priority areas identified by the Secretary are—</text>
 <paragraph id="H6D3B8AD83D114E1295A4652EAE36CA48"><enum>(1)</enum><text display-inline="yes-display-inline">economically viable (including having access to existing or planned transmission capacity);</text> </paragraph><paragraph id="H76B5733EDB7B450D863961C44F13D6F5"><enum>(2)</enum><text display-inline="yes-display-inline">likely to avoid or minimize conflict with habitat for animals and plants, recreation, cultural resources, and other uses of covered land; and</text>
 </paragraph><paragraph id="H8AC30DCD10CA40FBA3ED88BD1DBBB5F3"><enum>(3)</enum><text>consistent with section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>), including subsection (c)(9) of that section (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712(c)(9)</external-xref>).</text>
				</paragraph></subsection></section><section id="H362A8CC66F7B45918BCC23AAE2955467"><enum>4.</enum><header>Environmental review on covered land</header>
 <subsection id="H0336176FEE5848B3B31A18136DBD398F"><enum>(a)</enum><header>In general</header><text>If the Secretary determines that a proposed renewable energy project has been sufficiently analyzed by a programmatic environmental impact statement conducted under section 3(d), the Secretary shall not require any additional review under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text>
 </subsection><subsection id="H617C665A80494E5C9B451AE37E8D3511"><enum>(b)</enum><header>Additional environmental review</header><text>If the Secretary determines that additional environmental review under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) is necessary for a proposed renewable energy project, the Secretary shall rely on the analysis in the programmatic environmental impact statement conducted under section 3(d) to the maximum extent practicable when analyzing the potential impacts of the project.</text>
 </subsection><subsection id="H3E6D52186C5E4A6C8532C0DF3AD36927"><enum>(c)</enum><header>Relationship to Other Law</header><text>Nothing in this section modifies or supersedes any requirement under applicable law.</text> </subsection></section><section id="HF974EB7D1C11406B8E8D71760DE71E7A"><enum>5.</enum><header>Program to improve renewable energy project permit coordination</header> <subsection id="H37165B12832B4138AB7619BB57FFE552"><enum>(a)</enum><header>Establishment</header> <paragraph id="idE00AA095EB1E4BED9B0B258B0F6E7C0A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish and implement, through the offices established under paragraph (2), a program to improve Federal permit coordination with respect to renewable energy projects on covered land.</text>
 </paragraph><paragraph id="id0A45A43CEB0348A6A2D03C518571D569"><enum>(2)</enum><header>Establishment of offices</header><text display-inline="yes-display-inline">To establish and implement the program described in paragraph (1), and to carry out other necessary activities, as determined by the Secretary, the Secretary shall establish—</text>
 <subparagraph id="id8D0CDD6F2C0F44A3B5C5FB138A6E44F5"><enum>(A)</enum><text display-inline="yes-display-inline">an office to serve as the National Renewable Energy Coordination Office; and</text> </subparagraph><subparagraph id="id543D158995A24C9DBFC9F06ADD7C2D9B"><enum>(B)</enum><text display-inline="yes-display-inline">State, district, or field Renewable Energy Coordination Offices, for such time as the Secretary determines to be appropriate.</text>
					</subparagraph></paragraph></subsection><subsection id="H50C92E9321C14B7AA192D5EC487915A7"><enum>(b)</enum><header>Memorandum of understanding</header>
 <paragraph id="H5A7F1F159E5C4944971B7FC2AFB1ED2A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall enter into a memorandum of understanding for purposes of this section, including to specifically expedite the environmental analysis of applications for projects proposed in a variance area or a priority area, with—</text>
 <subparagraph id="idEBCFE86498AF4714B4B745B0032B0EF7"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of Defense; and</text>
 </subparagraph><subparagraph id="id27DB7F2904BD484F9C939CE5844920C3"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture.</text> </subparagraph></paragraph><paragraph id="H6DD9FCC51A2D498B95332E734C5BF6C2"><enum>(2)</enum><header>State participation</header><text>The Secretary may request the Governor of any interested State to be a signatory to the memorandum of understanding under paragraph (1).</text>
				</paragraph></subsection><subsection id="HD51A2EAC499A439B84AEDCD04CC649C8"><enum>(c)</enum><header>Designation of Qualified Staff</header>
 <paragraph id="H67FDCFFBBC7E42FC96EB68AE6DF47A02"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date on which the memorandum of understanding under subsection (b) is executed, all Federal signatories, as appropriate, shall identify for the National Renewable Energy Coordination Office established under subsection (a)(2)(A) and each Renewable Energy Coordination Office established under subsection (a)(2)(B) 1 or more employees who have expertise in the regulatory issues relating to the office in which the employee is employed, including, as applicable, particular expertise in—</text>
 <subparagraph id="H8EFA0FD7E1BD4AE79DE92AB2815BE67C"><enum>(A)</enum><text>consultation regarding, and preparation of, biological opinions under section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>);</text>
 </subparagraph><subparagraph id="H49717561AC1B439C86F4357532E6C09C"><enum>(B)</enum><text>permits under section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>);</text> </subparagraph><subparagraph id="HA7CF1495F3F94C2B9B5C5ECC6805EE8C"><enum>(C)</enum><text>regulatory matters under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et seq.);</text>
 </subparagraph><subparagraph id="HA62B30A78BD94D1083EFE2E40D714E12"><enum>(D)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.);</text> </subparagraph><subparagraph id="HE5BF8B5E042D4A14AD0C6ECC0EC53533"><enum>(E)</enum><text>the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703</external-xref> et seq.);</text>
 </subparagraph><subparagraph id="HED2AC11DD2434B8E80CAA98F25A447D7"><enum>(F)</enum><text>the preparation of analyses under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.);</text>
 </subparagraph><subparagraph id="H0E6F40BDAA114879A73DADC17790B3DD"><enum>(G)</enum><text display-inline="yes-display-inline">implementation of the requirements of section 306108 of title 54, United States Code (formerly known as section 106 of the National Historic Preservation Act);</text>
 </subparagraph><subparagraph id="HCFAFFD677FBE4A70B29DE05403BA2DE6"><enum>(H)</enum><text display-inline="yes-display-inline">planning under section 14 of the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/472a">16 U.S.C. 472a</external-xref>); and</text> </subparagraph><subparagraph id="HA7B626F41681446C81D6936172FAF819"><enum>(I)</enum><text display-inline="yes-display-inline">the Act of June 8, 1940 (54 Stat. 250, chapter 278; <external-xref legal-doc="usc" parsable-cite="usc/16/668">16 U.S.C. 668</external-xref> et seq.) (commonly known as the <quote>Bald Eagle Protection Act</quote>).</text>
 </subparagraph></paragraph><paragraph id="H3F0D883406D74182AF42A97C7FDCB790"><enum>(2)</enum><header>Duties</header><text>Each employee assigned under paragraph (1) shall—</text> <subparagraph id="H1A8A8818AEF24927B2394D9471AE73AF"><enum>(A)</enum><text>be responsible for addressing all issues relating to the jurisdiction of the home office or agency of the employee; and</text>
 </subparagraph><subparagraph id="H0046FC5BEFAA488ABC4977B116B1B31A"><enum>(B)</enum><text>participate as part of the team of personnel working on proposed energy projects, planning, monitoring, inspection, enforcement, and environmental analyses.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="H04D3C92FAB2F4F85A1BFB2C727F197B4"><enum>(d)</enum><header>Clarification of existing authority</header><text display-inline="yes-display-inline">Section 307 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1737">43 U.S.C. 1737</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD5D11A6D4E4C4C1CBD6ADDA8BC16AA91" style="OLC">
 <subsection commented="no" id="id356A14F72CD74503BAFD81E5A696842C"><enum>(h)</enum><header>Donations</header><text display-inline="yes-display-inline">The Secretary, in accordance with subsection (c), may accept donations from renewable energy companies working on public lands, including donations to help cover the costs of environmental reviews.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H81F419BEDF2C4AFD865C95CC8ABB48D3"><enum>(e)</enum><header>Report to congress</header>
 <paragraph id="H320CA6D6D20D413DB7D9647F345C4F5F"><enum>(1)</enum><header>In general</header><text>Not later than February 1 of the first fiscal year beginning after the date of enactment of this Act, and each February 1 thereafter, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report describing the progress made under the program established under subsection (a)(1) during the preceding year.</text>
 </paragraph><paragraph id="HFFBD25A028614600894C799ABA2D4701"><enum>(2)</enum><header>Inclusions</header><text>Each report under paragraph (1) shall include—</text> <subparagraph id="HDB262553509E478A97057D512231DA5B"><enum>(A)</enum><text>projections for renewable energy production and capacity installations; and</text>
 </subparagraph><subparagraph id="HEC16457297444D72BC305FFB877E27C1"><enum>(B)</enum><text>a description of any problems relating to leasing, permitting, siting, or production.</text> </subparagraph></paragraph></subsection></section><section commented="no" id="H89F06C1CFF994BE8A036B2147887B5A8"><enum>6.</enum><header>Increasing economic certainty</header> <subsection commented="no" id="HFB112815869B471EBAE12CB85A987FD1"><enum>(a)</enum><header>In general</header><text>The Secretary shall consider the total amount paid in acreage rental rates, capacity fees, and other recurring annual fees in evaluating existing rates paid by renewable energy projects for the use of Federal land.</text>
 </subsection><subsection commented="no" id="H1275665744B847D9B7E87936CF3E84BC"><enum>(b)</enum><header>Increases in base rental rates</header><text>After a base rental rate is established on an issuance of a right-of-way authorization, for the entire term of the right-of-way authorization, any increase in the base rental rate shall be limited to the Implicit Price Deflator–Gross Domestic Product Index published by the Bureau of Economic Analysis of the Department of Commerce on the date of issuance of the right-of-way authorization.</text>
 </subsection><subsection commented="no" id="H3D118B17C24F4D51A98A676440650568"><enum>(c)</enum><header>Reductions in base rental rates</header><text>The Secretary may reduce acreage rental rates and capacity fees for existing and new wind and solar authorizations if the Secretary determines—</text>
 <paragraph commented="no" id="H750DED0AEF3C4E8081F608417FCBBB1D"><enum>(1)</enum><text>that the existing rates—</text> <subparagraph commented="no" id="HDA38DCD0F0BC4C74AF7047A85949782A"><enum>(A)</enum><text>exceed fair market value;</text>
 </subparagraph><subparagraph commented="no" id="H4D21F6508F9045A690D3C84BF3BF3C83"><enum>(B)</enum><text>impose economic hardships;</text> </subparagraph><subparagraph commented="no" id="HC73BFB7DB4BC4B4C819B2C31273E623D"><enum>(C)</enum><text>limit commercial interest in a competitive lease sale or right-of-way grant; or</text>
 </subparagraph><subparagraph commented="no" id="H664060E06AC94ECBA6BFD8E4D413F135"><enum>(D)</enum><text>are not competitively priced compared to other available land; or</text> </subparagraph></paragraph><paragraph commented="no" id="H41BA037286CC4EDE85C6B86C179D28ED"><enum>(2)</enum><text>that a reduced rental rate or capacity fee is necessary to promote the greatest use of wind and solar energy resources, especially inside priority areas.</text>
				</paragraph></subsection></section><section commented="no" id="HE0B7EEF33233431A9EF2FFDB91636692"><enum>7.</enum><header>Limited grandfathering</header>
 <subsection commented="no" id="H108FFF79AC9C4F25BD67102DACB2E075"><enum>(a)</enum><header>Definition of project</header><text>In this section, the term <term>project</term> means a system described in section 2801.9(a)(4) of title 43, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text>
 </subsection><subsection commented="no" id="H9FCE1F122FB945DEA31AB86D65F5BCDE"><enum>(b)</enum><header>Requirement To pay rents and fees</header><text>The owner of a project that applied for a right-of-way under section 501 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1761">43 U.S.C. 1761</external-xref>) on or before December 19, 2016, shall be obligated to pay with respect to the right-of-way all rents and fees in effect before the effective date of the rule of the Bureau of Land Management entitled <quote>Competitive Processes, Terms, and Conditions for Leasing Public Lands for Solar and Wind Energy Development and Technical Changes and Corrections</quote> (81 Fed. Reg. 92122 (December 19, 2016)).</text>
 </subsection></section><section commented="no" id="HA7E678A084234A27B0F080CF72A541D3"><enum>8.</enum><header>Renewable energy goal</header><text display-inline="no-display-inline">The Secretary and the Secretary of Agriculture, through management of public land and administration of Federal laws, shall seek to issue permits that, in total, authorize production of not less than 25 gigawatts of electricity from wind, solar, and geothermal energy projects by not later than December 31, 2025.</text>
		</section><section id="HC6725096CB8F4B88B83C66298C33DEA2"><enum>9.</enum><header>Disposition of revenues</header>
 <subsection id="H11ACE42809E548C0B524DCB5D73697AD"><enum>(a)</enum><header>Disposition of revenues</header><text display-inline="yes-display-inline">Without further appropriation or fiscal year limitation, of the amounts collected as bonus bids, rentals, fees, or other payments under a right-of-way, permit, lease, or other authorization (other than under section 504(g) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1764">43 U.S.C. 1764(g)</external-xref>)) for the development of wind or solar energy on covered land or National Forest System land—</text>
 <paragraph id="idF20340281CA54A3894BA1CBAF84015C7"><enum>(1)</enum><text>for the period beginning on January 1, 2020, and ending on December 31, 2039—</text> <subparagraph id="H30758449C65249B9A3C08C0B57FC32EB"><enum>(A)</enum><text>25 percent shall be paid by the Secretary of the Treasury to the State within the boundaries of which the revenue is derived;</text>
 </subparagraph><subparagraph id="HD05CB328029E4574900511FF46C0F09F"><enum>(B)</enum><text>25 percent shall be paid by the Secretary of the Treasury to the 1 or more counties within the boundaries of which the revenue is derived, to be allocated among the counties based on the percentage of land from which the revenue is derived;</text>
 </subparagraph><subparagraph id="H4862BBB59994415486457F97A163EC6F"><enum>(C)</enum><text display-inline="yes-display-inline">15 percent shall be deposited in the Treasury and be made available to the Secretary to carry out the program established under section 5(a), including the transfer of the funds by the Bureau of Land Management to other Federal agencies and State agencies to facilitate the processing of renewable energy permits on Federal land, with priority given to using the amounts, to the maximum extent practicable without detrimental impacts to emerging markets, to expediting the issuance of permits required for the development of renewable energy projects in the States from which the revenues are derived; and</text>
 </subparagraph><subparagraph id="H40DDF8F5B0FB4DBF93D49372A4E0A019"><enum>(D)</enum><text display-inline="yes-display-inline">35 percent shall be deposited in the Fund; and</text> </subparagraph></paragraph><paragraph id="id384F9F092C3B41C387B83C7A6A32836E"><enum>(2)</enum><text>beginning on January 1, 2040—</text>
 <subparagraph id="idFD0A74EE19E74DE79792CC87593FF2A7"><enum>(A)</enum><text>25 percent shall be paid by the Secretary of the Treasury to the State within the boundaries of which the revenue is derived;</text>
 </subparagraph><subparagraph id="id7A46256DDF754374B32BB4A9F8915985"><enum>(B)</enum><text>25 percent shall be paid by the Secretary of the Treasury to the 1 or more counties within the boundaries of which the revenue is derived, to be allocated among the counties based on the percentage of land from which the revenue is derived;</text>
 </subparagraph><subparagraph id="id559B04B1813645708E3C92E6359B30C1"><enum>(C)</enum><text display-inline="yes-display-inline">10 percent shall be deposited in the Treasury and be made available to the Secretary to carry out the program established under section 5(a), including the transfer of the funds by the Bureau of Land Management to other Federal agencies and State agencies to facilitate the processing of renewable energy permits on Federal land, with priority given to using the amounts, to the maximum extent practicable without detrimental impacts to emerging markets, to expediting the issuance of permits required for the development of renewable energy projects in the States from which the revenues are derived; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAD89BDC7A4EA40969214FB08393A859F"><enum>(D)</enum><text display-inline="yes-display-inline">40 percent shall be deposited in the Fund.</text> </subparagraph></paragraph></subsection><subsection id="H3AD6AB85A3D447E598983A4F54B3424E"><enum>(b)</enum><header>Payments to states and counties</header> <paragraph id="HD846DB5D94414B04BA4E697A4783C584"><enum>(1)</enum><header>In general</header><text>Amounts paid to States and counties under subsection (a) shall be used consistent with section 35 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191</external-xref>).</text>
 </paragraph><paragraph id="HE19FED920F324B76967B8C0C9A02D263"><enum>(2)</enum><header>Payments in lieu of taxes</header><text>A payment to a county under paragraph (1) shall be in addition to a payment in lieu of taxes received by the county under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/69">chapter 69</external-xref> of title 31, United States Code.</text>
				</paragraph></subsection><subsection id="H2DC4E74564BE467DA679C2E1D2BC4D9E"><enum>(c)</enum><header>Renewable energy resource conservation fund</header>
 <paragraph id="H46BF9AFCE8EC46E885337362EE345228"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury a fund, to be known as the <quote>Renewable Energy Resource Conservation Fund</quote>, which shall be administered by the Secretary, in consultation with the Secretary of Agriculture.</text>
 </paragraph><paragraph id="H46ACDC4A36384A53BBF4543BE919144B"><enum>(2)</enum><header>Use of funds</header><text>The Secretary may make amounts in the Fund available to Federal, State, local, and Tribal agencies to be distributed in regions in which renewable energy projects are located on Federal land, for the purposes of—</text>
 <subparagraph id="H6F6A419681F844C79CA13113F0183CB3"><enum>(A)</enum><text>restoring and protecting—</text> <clause id="HA0AA6A94E6BA4FA7A86A59FC00B1DA46"><enum>(i)</enum><text>fish and wildlife habitat for affected species;</text>
 </clause><clause id="H164A39220102487A8A676D76611EFC14"><enum>(ii)</enum><text>fish and wildlife corridors for affected species; and</text> </clause><clause id="H261F6064CB1747AD82BB04AF8184B360"><enum>(iii)</enum><text>water resources in areas affected by wind, geothermal, or solar energy development; and</text>
 </clause></subparagraph><subparagraph id="H4697BF0031DA4A19BBF49E906C8EDDC0"><enum>(B)</enum><text>preserving and improving recreational access to Federal land and water in an affected region through an easement, right-of-way, or other instrument from willing landowners for the purpose of enhancing public access to existing Federal land and water that is inaccessible or restricted.</text>
 </subparagraph></paragraph><paragraph id="HF5C93DC1F21D4163A3FE7866855BA223"><enum>(3)</enum><header>Partnerships</header><text>The Secretary may enter into cooperative agreements with State, local, and Tribal agencies, nonprofit organizations, and other appropriate entities to carry out the activities described in subparagraphs (A) and (B) of paragraph (2).</text>
				</paragraph><paragraph id="HCCD9170AB1CB45989382F5773E570E5E"><enum>(4)</enum><header>Investment of fund</header>
 <subparagraph id="H9B333744392242CF9CAA70F5E387689E"><enum>(A)</enum><header>In general</header><text>Any amounts deposited in the Fund shall earn interest in an amount determined by the Secretary of the Treasury on the basis of the current average market yield on outstanding marketable obligations of the United States of comparable maturities.</text>
 </subparagraph><subparagraph id="H971F484B1FF04748AC9A8B329A719E05"><enum>(B)</enum><header>Use</header><text>Any interest earned under subparagraph (A) may be expended in accordance with this subsection.</text> </subparagraph></paragraph><paragraph id="HA09FC3DD7AD14F379D5B8D671164B2C8"><enum>(5)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">At the end of each fiscal year, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report identifying—</text>
 <subparagraph id="H03E44256744942FE8030D5149B2D1863"><enum>(A)</enum><text>the amounts described in subsection (a) that were collected during that fiscal year, organized by source;</text>
 </subparagraph><subparagraph id="HA08E7DDEC75A4219BE8E527BDBCA2EA9"><enum>(B)</enum><text>the amount and purpose of payments made to each Federal, State, local, and Tribal agency under paragraph (2) during that fiscal year; and</text>
 </subparagraph><subparagraph id="HE6BFF59F1C334BE19DFFF8AC79156A87"><enum>(C)</enum><text>the amount remaining in the Fund at the end of the fiscal year.</text> </subparagraph></paragraph><paragraph id="H591A04877FEC4745A1B333B72FAF046A"><enum>(6)</enum><header>Intent of congress</header><text>It is the intent of Congress that the revenues deposited and used in the Fund shall supplement (and not supplant) annual appropriations for activities described in subparagraphs (A) and (B) of paragraph (2).</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H5CAC4A51428143D1B5A83CA428CF5308" section-type="subsequent-section"><enum>10.</enum><header>Promoting and enhancing development of geothermal energy</header>
 <subsection id="H902F333E6F4D4B5C93666FAFDBCCD4DC"><enum>(a)</enum><header>In general</header><text>Section 234(a) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15873">42 U.S.C. 15873(a)</external-xref>) is amended by striking <quote>in the first 5 fiscal years beginning after the date of enactment of this Act</quote> and inserting <quote>through fiscal year 2022</quote>.</text> </subsection><subsection id="HE29D7B4027C547F5A99E9B2FAA45ADC7"><enum>(b)</enum><header>Authorization</header><text>Section 234(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15873">42 U.S.C. 15873(b)</external-xref>) is amended—</text>
 <paragraph id="H880C863107014CE28289FDCAE6B38AD8"><enum>(1)</enum><text>by striking <quote>Amounts</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HF80924D000B144B1B56D17CA4E14579C" style="OLC"> <paragraph id="H11DE28D0CD3B41B1B08AFFC8FAA01F0D"><enum>(1)</enum><header>In general</header><text>Amounts</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H692375158F174903BF6DF3E7C4F83057"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H950B60B1F6144BF0A6C48A7356BB68AC" style="OLC"> <paragraph id="H5E93E85C9D614D8099582E99B8651082"><enum>(2)</enum><header>Authorization</header><text>Effective for fiscal year 2020 and each fiscal year thereafter, amounts deposited under subsection (a) shall be available to the Secretary of the Interior for expenditure, without further appropriation or fiscal year limitation, to implement the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001</external-xref> et seq.) and this Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="H8F2177A9C2B5403F9F0BD69D2D095506"><enum>11.</enum><header>Facilitation of coproduction of geothermal energy on oil and gas leases</header><text display-inline="no-display-inline">Section 4 of the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1003">30 U.S.C. 1003</external-xref>) is amended—</text> <paragraph id="id1306e49080a24649a28115f85c90b915"><enum>(1)</enum><text>in subsection (c), by striking <quote>The Secretary</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4f47371f46464d85a5f4849757b88496" style="OLC">
 <paragraph id="idd56b4ffcb8b141a299d7d6808d4b2649"><enum>(1)</enum><header>In general</header><text>The Secretary</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph><paragraph id="id5708a823b3c94f05884a14a8ffdd1936"><enum>(2)</enum><text>in subsection (b), by redesignating paragraph (3) as paragraph (2) and moving the paragraph so as to appear after paragraph (1) of subsection (c) (as designated by paragraph (1)); and</text>
 </paragraph><paragraph id="ide50dd92ab1ad4591b5c97355bbe192e5"><enum>(3)</enum><text>in subsection (c) (as amended by paragraphs (1) and (2)), by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id2BA3F8026BFE43279CB2487552ED4340" style="OLC"> <paragraph id="id1A1D0921F8CE4CDA9C1E5EF1A4F375B9"><enum>(3)</enum><header>Land subject to oil and gas lease</header> <subparagraph id="id2023a9b4212f49429cad309505c0f444"><enum>(A)</enum><header>Definition of land</header><text>In this paragraph, the term <term>land</term> means land that—</text>
 <clause id="id659888889fd546028aa526e9b7412f6c"><enum>(i)</enum><text>is under an oil and gas lease issued pursuant to the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181</external-xref> et seq.) or the Mineral Leasing Act for Acquired Lands (<external-xref legal-doc="usc" parsable-cite="usc/30/351">30 U.S.C. 351</external-xref> et seq.);</text>
 </clause><clause id="idf6104735997b45bdb5bea3459366ef86"><enum>(ii)</enum><text>is subject to an approved application for permit to drill; and</text> </clause><clause id="idb7b33c4bf14b4af9b123a27510e246b8"><enum>(iii)</enum><text>from which oil and gas production is occurring.</text>
 </clause></subparagraph><subparagraph id="id189005086e524d78a91fe84d286e0f01"><enum>(B)</enum><header>Geothermal energy</header><text>Land may be available for noncompetitive leasing under this section to the holder of an oil and gas lease described in subparagraph (A)(i)—</text>
 <clause id="id6C2AC15745E6412DA7CABDC9E45E80F0"><enum>(i)</enum><text>if the Secretary determines that geothermal energy will be produced from a well that is producing or is capable of producing oil and gas; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id70e494fa077b498da0c2ca84a73fdfbf"><enum>(ii)</enum><text>to provide for the coproduction of geothermal energy with oil and gas.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section commented="no" id="H3CF4A974B78244EDA25472EA7A53A9B5"><enum>12.</enum><header>Noncompetitive leasing of adjoining areas for development of geothermal resources</header><text display-inline="no-display-inline">Section 4(c) of the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1003">30 U.S.C. 1003(c)</external-xref>) (as amended by section 11) is amended by adding at the end the following:</text>
			<quoted-block id="HC47BD2138CC24E75AA275E7210FDD37E" style="OLC">
				<paragraph commented="no" id="H0168BC8FE7624B43817E54D759E2129F"><enum>(4)</enum><header>Adjoining land</header>
 <subparagraph commented="no" id="H28D21870A99045D8A2201CB83AAC5480"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text> <clause commented="no" id="H159086301A704E0287A663AB25C954AB"><enum>(i)</enum><header>Fair market value per acre</header><text>The term <term>fair market value per acre</term> means a dollar amount per acre that—</text>
 <subclause commented="no" id="HB8F89992C61F44E7A5529F286A5D3E5D"><enum>(I)</enum><text>subject to subclause (II), is equal to the market value per acre, as determined by the Secretary—</text> <item commented="no" id="idD3336332578548F487FCF377345B1292"><enum>(aa)</enum><text>under regulations promulgated under this paragraph;</text>
 </item><item commented="no" id="id6408D07B559A4DE78DD369E950D6EF82"><enum>(bb)</enum><text>taking into account the data described in subparagraph (B)(iii) regarding a valid discovery under subclause (I) of that subparagraph; and</text>
 </item><item commented="no" id="id90223153BB2F40D9BBDFAE612DB77AB4"><enum>(cc)</enum><text>not later than 180 days after the date on which the Secretary receives an application for a lease under this paragraph; and</text>
 </item></subclause><subclause commented="no" id="H17ED7394C2D44E5483269B8AB7AFA889"><enum>(II)</enum><text>shall be not less than the greater of—</text> <item commented="no" id="HFA950EB38D7043A39EDDF2F58597394B"><enum>(aa)</enum><text>4 times the median amount paid per acre for all land leased under this Act during the preceding year; or</text>
 </item><item commented="no" id="H31E868E5543D4824AD0125C0D192F8F2"><enum>(bb)</enum><text display-inline="yes-display-inline">$50.</text> </item></subclause></clause><clause commented="no" id="H7C60634E78ED4DF8A37DEC3D54C26F1F"><enum>(ii)</enum><header>Industry standards</header><text>The term <term>industry standards</term> means the standards by which a qualified geothermal professional assesses whether downhole or flowing temperature measurements with indications of permeability are sufficient to produce energy from geothermal resources, as determined through flow or injection testing or measurement of lost circulation while drilling.</text>
 </clause><clause commented="no" id="H7FAF8803B72142DCA9D8B9415A57841E"><enum>(iii)</enum><header>Qualified federal land</header><text>The term <term>qualified Federal land</term> means land that is available for leasing under this Act.</text> </clause><clause commented="no" id="HEF2D6D0055BA42B9B4601B0C9B201EC4"><enum>(iv)</enum><header>Qualified geothermal professional</header><text>The term <term>qualified geothermal professional</term> means an individual who is an engineer or geoscientist in good professional standing with at least 5 years of experience in geothermal exploration, development, or project assessment.</text>
 </clause><clause commented="no" id="H5999F71ED56D470E87F1B1A3E0ADD9A2"><enum>(v)</enum><header>Qualified lessee</header><text>The term <term>qualified lessee</term> means a person that is eligible to hold a geothermal lease under this Act (including applicable regulations).</text>
 </clause><clause commented="no" id="H2101B86F8679465F8076D1156C2C7537"><enum>(vi)</enum><header>Valid discovery</header><text>The term <term>valid discovery</term> means a discovery, by a new or existing slim hole or production well, of a geothermal resource that exhibits downhole or flowing temperature measurements with indications of permeability that are sufficient to meet industry standards.</text>
 </clause></subparagraph><subparagraph commented="no" id="H2029DFC26175416B81E183C202AE683E"><enum>(B)</enum><header>Authority</header><text>An area of qualified Federal land that adjoins other land for which a qualified lessee holds a legal right to develop geothermal resources may be available for a noncompetitive lease under this section to the qualified lessee at the fair market value per acre, if—</text>
 <clause commented="no" id="H703F875D75714A7D8748DDABFC100D6E"><enum>(i)</enum><text>the area of qualified Federal land—</text> <subclause commented="no" id="H35FE5E0737B448D5BE76D74965C48F61"><enum>(I)</enum><text>consists of not less than 1 acre and not more than 640 acres; and</text>
 </subclause><subclause commented="no" id="H255D51C59F04414F9C44E06AA205EAAB"><enum>(II)</enum><text>is not already leased under this Act or nominated to be leased under subsection (a);</text> </subclause></clause><clause commented="no" id="H123C9A101EF94018BB3DBDC8A2F9A0D5"><enum>(ii)</enum><text>the qualified lessee has not previously received a noncompetitive lease under this paragraph in connection with the valid discovery for which data has been submitted under clause (iii)(I); and</text>
 </clause><clause commented="no" id="HC914EE14F60E43178A30DD2C51E35910"><enum>(iii)</enum><text>sufficient geological and other technical data prepared by a qualified geothermal professional has been submitted by the qualified lessee to the applicable Federal land management agency that would lead individuals who are experienced in the subject matter to believe that—</text>
 <subclause commented="no" id="HCF61547EEF344B54B30318006937101C"><enum>(I)</enum><text>there is a valid discovery of geothermal resources on the land for which the qualified lessee holds the legal right to develop geothermal resources; and</text>
 </subclause><subclause commented="no" id="HCBA93621A1B749E186FEC74C2BA70A76"><enum>(II)</enum><text>those geothermal resources extend into the adjoining areas.</text> </subclause></clause></subparagraph><subparagraph commented="no" id="H25C2ED49C2EF4E35A0547BDF4E8CD193"><enum>(C)</enum><header>Regulations for determining fair market value</header><text>The Secretary shall promulgate regulations establishing a procedure to determine fair market value per acre under subparagraph (A)(i)(I) for purposes of this paragraph.</text>
					</subparagraph><subparagraph commented="no" id="id1A138AFEADDA454FA0D6FFF4D463E5A7"><enum>(D)</enum><header>Administration</header>
 <clause commented="no" id="H1D01E696BA3D45C8A26754542040A698"><enum>(i)</enum><header>In general</header><text>The Secretary shall—</text> <subclause commented="no" id="H2A6B0D4154C945099ABB80D48B7B4765"><enum>(I)</enum><text>publish a notice of any request to lease land under this paragraph;</text>
 </subclause><subclause commented="no" id="H0F0CF634D9B946ABB479BFF9A3B084E2"><enum>(II)</enum><text>provide to a qualified lessee and publish, with an opportunity for public comment for a period of 30 days, any proposed determination under this paragraph of the fair market value per acre of an area that the qualified lessee seeks to lease under this paragraph; and</text>
 </subclause><subclause commented="no" id="H63C8627709654F1EB35A96FF656C82B7"><enum>(III)</enum><text>provide to the qualified lessee and any adversely affected party the opportunity to appeal the final determination of the fair market value per acre of the area in an administrative proceeding before the applicable Federal land management agency, in accordance with applicable law (including regulations).</text>
 </subclause></clause><clause commented="no" id="H03733D6B08064E0AAAD113D9DB897B04"><enum>(ii)</enum><header>Limitation on nomination</header><text>After publication of a notice of request to lease land under this paragraph, the Secretary may not accept any nomination to lease that land under subsection (a) unless the request has been denied or withdrawn.</text>

 </clause></subparagraph><subparagraph commented="no" id="H032F1312044D4CFA9DCCB18EECC0451D"><enum>(E)</enum><header>Regulations</header><text>Not later than 270 days after the date of enactment of the <short-title>Public Land Renewable Energy Development Act of 2019</short-title>, the Secretary shall issue regulations to carry out this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HCC8AB4A8879343CDA7325E04A5546C66"><enum>13.</enum><header>Savings clause</header><text display-inline="no-display-inline">Notwithstanding any other provision of this Act, the Secretary shall continue to manage public land under the principles of multiple use and sustained yield in accordance with title I of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.), including due consideration of mineral and nonrenewable energy-related projects and other nonrenewable energy uses, for the purposes of land use planning, permit processing, and conducting environmental reviews.</text></section></legis-body></bill>
