 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advanced Geothermal Innovation Leadership Act of 2019</short-title></quote> or the <quote><short-title>AGILE Act of 2019</short-title></quote>.</text>
 </section><section id="id07962971a0e5419c9bbcaaf0e30c8a5b"><enum>2.</enum><header>Update to geothermal resource assessment</header><text display-inline="no-display-inline">Section 2501 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/30/1028">30 U.S.C. 1028</external-xref>) is amended—</text> <paragraph commented="no" id="idD0B7353CA88B44E0BFB353AB01DE29CE"><enum>(1)</enum><text>by redesignating subsections (a) and (b) as subsections (b) and (d), respectively;</text>
 </paragraph><paragraph commented="no" id="id58B9CE299FFF47D3B747900BA324E213"><enum>(2)</enum><text>by inserting before subsection (b) (as so redesignated) the following:</text> <quoted-block display-inline="no-display-inline" id="idD24005CC03AC4B4FA987917146DEFF62" style="OLC"> <subsection commented="no" id="idb4df40f597b14fac8070ab8bb4519f33"><enum>(a)</enum><header>Definition of enhanced geothermal systems</header><text>In this section, the term <term>enhanced geothermal systems</term> has the meaning given the term in section 612 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17191">42 U.S.C. 17191</external-xref>).</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" id="idD17B741D360749C5B0972F153328CC75"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) (as so redesignated) the following:</text> <quoted-block display-inline="no-display-inline" id="id581E497B6CBE48CFA2646C91CF5DF40A" style="OLC"> <subsection id="idb15038bda5fa43b38bf29815ef7e0ad0"><enum>(c)</enum><header>Update to geothermal resource assessment</header><text>The Secretary of the Interior, acting through the United States Geological Survey, and in consultation with the Secretary of Energy, shall update the United States geothermal resource assessment carried out by the United States Geological Survey, including by focusing on—</text>
 <paragraph id="id23cbb37477ad49a9a22dcfb467458c37"><enum>(1)</enum><text>with respect to areas previously identified by the Department of Energy or the United States Geological Survey as having significant potential for hydrothermal energy or enhanced geothermal systems energy—</text>
 <subparagraph id="idb6a2ecec17d5473fb7b7ba8d724dfe1c"><enum>(A)</enum><text>improving the resolution of resource potential at systematic temperatures and depths, including temperatures and depths appropriate for power generation and direct use applications;</text>
 </subparagraph><subparagraph id="id635ae490322240748f048f600e080329"><enum>(B)</enum><text>quantifying the total potential to coproduce geothermal energy and minerals;</text> </subparagraph><subparagraph id="id06aa8732ad6e4cd089223e9c128c2097"><enum>(C)</enum><text>incorporating data relevant to underground thermal energy storage and exchange, such as aquifer and soil properties; and</text>
 </subparagraph><subparagraph id="idc339e4b8ea8446d782c5b3451db7307d"><enum>(D)</enum><text>producing high resolution maps, including—</text> <clause id="id65759A55BC17415E9A44E98D78DAC079"><enum>(i)</enum><text>maps that indicate key subsurface parameters for electric and direct use resources; and</text>
 </clause><clause id="id20F02C7969B94863A7C4AD0E7B7A55F0"><enum>(ii)</enum><text>risk maps for induced seismicity based on geologic, geographic, and operational parameters; and</text> </clause></subparagraph></paragraph><paragraph id="id99595a745ce7481493a102ab3f2f6f20"><enum>(2)</enum><text>to the maximum extent practicable, expanding geothermal assessments, including enhanced geothermal systems assessments, to include assessments for the Commonwealth of Puerto Rico and the States of Alaska and Hawaii.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id02D70561DFCC4613AAACF2B511FB8571"><enum>(4)</enum><text>in subsection (d) (as so redesignated), by striking <quote>necesary</quote> and inserting <quote>necessary</quote>.</text> </paragraph></section><section id="id14e3bf9f8dd24c918a1bd89ef0def7b6"><enum>3.</enum><header>General geothermal research and development programs</header><text display-inline="no-display-inline">Section 614 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17193">42 U.S.C. 17193</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idE86B945F23C5442292B5CC2C0A1E6EE4" style="OLC">
				<subsection id="ide57f3e1113264fe7bb9b4bcf14b9b783"><enum>(d)</enum><header>Oil and gas technology transfer initiative</header>
 <paragraph id="id1b7a4f6f0cbe4165aa5c8182d1e1cfaf"><enum>(1)</enum><header>In general</header><text>The Secretary shall support an initiative among the Office of Fossil Energy, the Office of Energy Efficiency and Renewable Energy, and the private sector to modify, improve, and demonstrate the use in geothermal energy development of relevant advanced technologies and operation techniques used in the oil and gas sector.</text>
 </paragraph><paragraph commented="no" id="id6c8be89332f94e649f7e301b16370229"><enum>(2)</enum><header>Priorities</header><text>In carrying out paragraph (1), the Secretary shall prioritize technologies with the greatest potential to significantly increase the use and lower the cost of geothermal energy in the United States, including the cost and speed of geothermal drilling.</text>
					</paragraph></subsection><subsection id="id6d5ebbdde391493f91e8ab0c7139927d"><enum>(e)</enum><header>Secondary use subprogram</header>
 <paragraph id="id4EC5D3D1F66A4B0492398CF2EAFF5349"><enum>(1)</enum><header>In general</header><text>The Secretary shall support within the Geothermal Technologies Office a program of research, development, and demonstration in the secondary use of geothermal energy other than for electricity, direct use, or geothermal exchange heat pumps.</text>
 </paragraph><paragraph id="id4bffec74116b4f8fa9304381d8a930e9"><enum>(2)</enum><header>Program areas</header><text>The program under paragraph (1) shall include the following areas:</text> <subparagraph id="idfed18feff49e47d4b24b9fac2c63295b"><enum>(A)</enum><text>Minerals recovery, including lithium, silica, and rare earth elements.</text>
 </subparagraph><subparagraph id="id08b594d7a86449e7bd0ff05671e317ed"><enum>(B)</enum><text>Geothermal-powered desalination.</text> </subparagraph><subparagraph id="id372df8af085b46cb893b7fd0f5a15753"><enum>(C)</enum><text>Industrial applications of geothermal energy.</text>
 </subparagraph><subparagraph id="id5417e5fe4b5a49358bdaddebd062d38b"><enum>(D)</enum><text>The use of geothermal energy as a grid management resource or seasonal energy storage.</text> </subparagraph><subparagraph id="id8a664b08e84e40869b6c44a3a8c4c380"><enum>(E)</enum><text>Other cost competitive secondary uses of geothermal energy, as determined by the Secretary.</text>
 </subparagraph><subparagraph id="id7365a3ddfb1a406f8bfd1255ddb10aaa"><enum>(F)</enum><text>Systems that utilize a combination of the techniques and uses described in subparagraphs (A) through (E) with geothermal heat or power.</text>
						</subparagraph></paragraph><paragraph id="idd1c571cff85147a9ac6b7895755d32ac"><enum>(3)</enum><header>Coproduction of geothermal energy and minerals production prize competition</header>
 <subparagraph id="ida2d89612a6544fd18952f9e9ee904bff"><enum>(A)</enum><header>In general</header><text>The Secretary shall carry out a prize competition under which the Secretary shall award prizes to demonstrate the coproduction of critical minerals (as defined by the Secretary of the Interior on the date of enactment of the <short-title>AGILE Act of 2019</short-title>) from geothermal resources.</text>
 </subparagraph><subparagraph id="idda84774b9e1d4c3d9208ec4b9c57f220"><enum>(B)</enum><header>Requirements</header><text>A demonstration awarded a prize under subparagraph (A) shall—</text> <clause id="id16ae31c217de46ef8d9097bb212a2630"><enum>(i)</enum><text>improve the cost-effectiveness of removing minerals from geothermal brines as part of the coproduction process;</text>
 </clause><clause id="id28d6f45724d9415995f60c9b983caab5"><enum>(ii)</enum><text>increase recovery rates of the targeted mineral commodity;</text> </clause><clause id="id08ac9a48cc804e05a3b126d79e87464a"><enum>(iii)</enum><text>decrease water use and other environmental impacts, as determined by the Secretary; and</text>
 </clause><clause id="idd64be9538c0842c7a841a49e0fb27276"><enum>(iv)</enum><text>demonstrate a path to commercial viability.</text> </clause></subparagraph><subparagraph id="id8635c7c2b3874aed91987e47484b8c80"><enum>(C)</enum><header>Maximum prize amount</header><text>The maximum amount of a prize awarded under subparagraph (A) shall be $10,000,000.</text>
 </subparagraph><subparagraph id="idea450a6e67f74ec7a170c0e1f115e446"><enum>(D)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this paragraph $5,000,000 for each of fiscal years 2020 through 2023.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idF99C18FAE2544FD58E9D7471C8C6851B"><enum>4.</enum><header>Modifying the definition of renewable energy to include thermal energy</header>
 <subsection id="id897CFF96CA544CB0A1817C88A42CA0EF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 203 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15852">42 U.S.C. 15852</external-xref>) is amended—</text> <paragraph id="id938338E0AD8C4C0381E00174F1116526"><enum>(1)</enum><text>in subsection (b)—</text>
 <subparagraph id="id64F7DB2938004317B171C02BA4B87EFC"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraph (2) as paragraph (3);</text> </subparagraph><subparagraph id="idD4A24552B25042EEB7946D8C74FB314E"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text>
						<quoted-block display-inline="no-display-inline" id="idFC676084C8F4445898F590F894B91F7C" style="OLC">
 <paragraph id="id47AB06C749FE44F5BE27A986A3AB1E54"><enum>(2)</enum><header>Qualified waste heat resource</header><text>The term <quote>qualified waste heat resource</quote> means—</text> <subparagraph id="idA29FB150E83F49F3BBAC5C5472581599"><enum>(A)</enum><text>exhaust heat or flared gas from any industrial process;</text>
 </subparagraph><subparagraph id="id123DD668338140139E36D6D617AB34D3"><enum>(B)</enum><text>waste gas or industrial tail gas that would otherwise be flared, incinerated, or vented;</text> </subparagraph><subparagraph id="id9F247CD19FD2497793CED2A9F37D3D87"><enum>(C)</enum><text>a pressure drop in any gas as part of an industrial or commercial process; or</text>
 </subparagraph><subparagraph id="id9567EB4042BA4DFC9127A3ED32E5A11B"><enum>(D)</enum><text>such other forms of waste heat as the Secretary determines appropriate.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph><subparagraph id="id82B00FC257564BBC9AEA0FA84737F285"><enum>(C)</enum><text>in paragraph (3) (as so redesignated)—</text>
 <clause id="id0F33963990F54A309E9D714325999EE5"><enum>(i)</enum><text>by striking <quote>generated from</quote> and inserting <quote>produced from, or, in the case of thermal energy resulting from a thermal energy project placed in service after December 31, 2018, thermal energy generated from, or avoided by,</quote>; and</text>
 </clause><clause id="id5630EA1C297543E7AD778D5311BC6C89"><enum>(ii)</enum><text>by inserting <quote>qualified waste heat resource,</quote> before <quote>or new</quote>; and</text> </clause></subparagraph></paragraph><paragraph id="id176010C59EEC48D59B8E4E260065598D"><enum>(2)</enum><text>in subsection (c)—</text>
 <subparagraph id="idb3ee52ab595f4692b78b309151ad5b86"><enum>(A)</enum><text>by redesignating paragraphs (1) through (3) as subparagraphs (A) through (C), respectively, and indenting appropriately;</text>
 </subparagraph><subparagraph id="id98b7f1703eee4f9496eafd73eda5ca1d"><enum>(B)</enum><text>in the matter preceding subparagraph (A) (as so redesignated), by striking <quote>For purposes</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id974a633f8b86422ab7631ee96b09b999" style="OLC"> <paragraph id="id9edf7fb1b7cb41a38d1d348435d116f3"><enum>(1)</enum><header>In general</header><text>For purposes</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="id0288418d549b4b28a832bb7d762c322c"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idc9ecc053b4e7444f8eebb5f162bb70eb" style="OLC"> <paragraph id="ide3b9eaaf2c7a4c97bf768033cb476251"><enum>(2)</enum><header>Separate calculation</header> <subparagraph id="ide6c8f0cd239a4c20ae0c6e026652f153"><enum>(A)</enum><header>In general</header><text>For purposes of determining compliance with the requirement of this section, any energy consumption that is avoided through the use of renewable energy shall be considered to be renewable energy produced.</text>
 </subparagraph><subparagraph id="idf7d647b7ba404bbdb8c8deda5c4cbf20"><enum>(B)</enum><header>Denial of double benefit</header><text>Avoided energy consumption that is considered to be renewable energy produced under subparagraph (A) shall not also be counted for purposes of achieving compliance with another Federal energy efficiency goal.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></subsection><subsection id="id523062c7fd7d431f85926e534e6d4655"><enum>(b)</enum><header>Conforming amendment</header><text>Section 2410q(a) of title 10, United States Code, is amended by striking <quote>section 203(b)(2) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15852">42 U.S.C. 15852(b)(2)</external-xref>)</quote> and inserting <quote>section 203(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15852">42 U.S.C. 15852(b)</external-xref>)</quote>.</text> </subsection></section><section id="idda6de24a2fdf44e5993bff58f977b073"><enum>5.</enum><header>Enhanced geothermal research and development</header> <subsection id="idd77130ad315b41ea9353f151bcbafbcb"><enum>(a)</enum><header>Definition of engineered</header><text>Section 612(1) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17191">42 U.S.C. 17191(1)</external-xref>) is amended in the matter preceding subparagraph (A) by striking <quote>subjected to intervention, including intervention</quote> and inserting <quote>designed to access subsurface heat, including nonstimulation technologies,</quote>.</text>
 </subsection><subsection id="id49E70A7B9E5340209882D553E2C15B38"><enum>(b)</enum><header>Programs</header><text>Section 615(b) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17194">42 U.S.C. 17194(b)</external-xref>) is amended—</text>
 <paragraph id="id0DDCBC074633442BBF9311A57A3A6FDB"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text> <subparagraph id="idED55DCD7958349C4A178B1E6D36E7D30"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking <quote>mapping</quote> and inserting <quote>and fracture mapping, including real-time modeling</quote>;</text>
 </subparagraph><subparagraph id="id067CCDA1812B44FCA6ECB08B049C7370"><enum>(B)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text> </subparagraph><subparagraph id="id16BF0D60072E4002A88397A3FB251A9D"><enum>(C)</enum><text>by redesignating subparagraph (F) as subparagraph (K); and</text>
 </subparagraph><subparagraph id="id788CC1A37DBF4E99BB09F0E3343F3174"><enum>(D)</enum><text>by inserting after subparagraph (E) the following:</text> <quoted-block display-inline="no-display-inline" id="id3AFCE3860A8842F3A071A6465691B6C8" style="OLC"> <subparagraph id="idbcd92600219a49eca4eb3e65a20f4b10"><enum>(F)</enum><text>well placement and orientation;</text>
 </subparagraph><subparagraph id="ide14d790b688a40378e46bfd5edfbfbca"><enum>(G)</enum><text>long-term reservoir management;</text> </subparagraph><subparagraph id="id8c89f195ffeb455c90042123ff085656"><enum>(H)</enum><text>drilling technologies, methods, and tools;</text>
 </subparagraph><subparagraph id="id38d7e75691cd4fc18c6ee932d530c0fb"><enum>(I)</enum><text>improved exploration tools;</text> </subparagraph><subparagraph id="idd12529b65ba249458418b83a099790a1"><enum>(J)</enum><text>zonal isolation; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="id0AD182B3EDF144F284CA6B344C3A56BC"><enum>(2)</enum><text>by striking paragraph (2) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="idA9EBA7CF1B8F43BE8A339F8C3C0D336F" style="OLC"> <paragraph id="id07d355321f8c42359111f86231d97595"><enum>(2)</enum><header>Frontier observatories for research in geothermal energy</header> <subparagraph id="idcbb699e007e24a24a6bd97c4b0bd2971"><enum>(A)</enum><header>Program</header><text>The Secretary shall support 2 field research sites operated by public or academic entities, which shall each be known as a <quote>Frontier Observatory for Research in Geothermal Energy</quote> or <quote>FORGE</quote> site, to develop, test, and enhance techniques and tools for enhanced geothermal energy.</text>
 </subparagraph><subparagraph id="id3BA5243AD8BE471394711832B14748AB"><enum>(B)</enum><header>Site selection</header><text>Of the FORGE sites referred to in subparagraph (A)—</text> <clause id="ideb48d11e6d004c35a36daf3a6593d325"><enum>(i)</enum><text>1 shall be the existing research site in Milford, Utah; and</text>
 </clause><clause id="id81EC146F14AD462A8EDC8D1F9D64E7EE"><enum>(ii)</enum><text>1 shall be selected by the Secretary through a competitive selection process.</text> </clause></subparagraph><subparagraph id="id89BAAC78028D49E2A794E64DCDCD347A"><enum>(C)</enum><header>Site duration</header><text>The FORGE site selected under subparagraph (B)(ii) shall operate for an initial term of not more than 7 years after the date on which site preparation is complete.</text>
							</subparagraph><subparagraph id="id420D44867C5E4D7895295E6406EC6F21"><enum>(D)</enum><header>Additional terms</header>
 <clause id="id435A93942A6042AC851A9EA008DB2B0B"><enum>(i)</enum><header>In general</header><text>At the end of an operational term described in clause (ii), a FORGE site may—</text> <subclause id="id52385F41763E401E85E66BA04F4CBED3"><enum>(I)</enum><text>be transferred to the private sector for further enhanced geothermal testing; or</text>
 </subclause><subclause id="id478DC9EDADE24A9797F170CD0D7699EF"><enum>(II)</enum><text>subject to appropriations and a merit review by the Secretary, operate for an additional term of not more than 7 years.</text>
 </subclause></clause><clause id="id94FD6083ECF9400997ADDC94C31E6852"><enum>(ii)</enum><header>Operational term described</header><text>An operational term referred to in clause (i)—</text> <subclause id="id10883DA4925A4726BF2C1D35902C248A"><enum>(I)</enum><text>in the case of the FORGE site designated under subparagraph (B)(i), is the existing operational term; and</text>
 </subclause><subclause id="id66BD992F75FD44D794A3A0110E711759"><enum>(II)</enum><text>in the case of the FORGE site selected under subparagraph (B)(ii), is the initial term under subparagraph (C) or an additional term under clause (i)(II).</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="id4b27c9e5b7654e4eb5e102c67ba0d306"><enum>(3)</enum><header>Enhanced geothermal systems demonstrations</header>
 <subparagraph id="id637a7487ceee44328546c774bf5f393d"><enum>(A)</enum><header>In general</header><text>Beginning on the date of enactment of the <short-title>AGILE Act of 2019</short-title>, the Secretary, in collaboration with industry partners and institutions of higher education, shall support an initiative for demonstration of enhanced geothermal systems for power production or direct use.</text>
							</subparagraph><subparagraph id="idEB8E438A4CCA4203B7A6B0DC8E7AC33B"><enum>(B)</enum><header>Projects</header>
 <clause id="idC16AD37B7361457696D80C77AF905CB8"><enum>(i)</enum><header>In general</header><text>Under the initiative described in subparagraph (A), not less than 4 demonstration projects shall be carried out in locations that are commercially viable for enhanced geothermal systems development, as determined by the Secretary.</text>
 </clause><clause id="id25183BAF7EE7402A84E6E968FEF9C290"><enum>(ii)</enum><header>Requirements</header><text>Demonstration projects under clause (i) shall—</text> <subclause id="idc9809b43dd804bba806ac9dfba8e236e"><enum>(I)</enum><text>collectively demonstrate—</text>
 <item id="id3C8F965200B84CC4BE255A6D25B01260"><enum>(aa)</enum><text>different geologic settings, such as hot sedimentary aquifers, layered geologic systems, supercritical systems, and basement rock systems; and</text>
 </item><item id="id1155f8d0fa234b0fbb6799bf8ee1ca69"><enum>(bb)</enum><text>a variety of development techniques, including open hole and cased hole completions, differing well orientations, and stimulation mechanisms;</text>
 </item></subclause><subclause id="id05c299d2cd6e45b694bc5bce04e9a7c7"><enum>(II)</enum><text>to the extent practicable, use existing sites where subsurface characterization or geothermal energy integration analysis has been conducted; and</text>
 </subclause><subclause id="id8A85DCBFE9154FC7B191D2EDAFEC9BC4"><enum>(III)</enum><text>each be carried out in accordance with section 988 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16352">42 U.S.C. 16352</external-xref>).</text>
 </subclause></clause><clause id="id39765c519bc9402d8e6616011474250b"><enum>(iii)</enum><header>Eastern demonstration</header><text>Not less than 1 demonstration project under clause (i) shall be located in an area east of the Mississippi River that is suitable for enhanced geothermal demonstration for power, heat, or a combination of power and heat.</text>
								</clause></subparagraph><subparagraph id="id2125FAD735FE4E568799E6022808E9ED"><enum>(C)</enum><header>Optional program structure</header>
 <clause id="idCF6AF18D8FFA47E5B70E3A174815E6A3"><enum>(i)</enum><header>In general</header><text>The Secretary may, pursuant to section 646(g) of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7256">42 U.S.C. 7256(g)</external-xref>), structure the initiative described in subparagraph (A) as a cost share milestone-based payment initiative (similar to the National Aeronautics and Space Administration Commercial Orbital Transportation Services program).</text>
 </clause><clause commented="no" id="idb02b0eb011af457ebfe3879e82d0343c"><enum>(ii)</enum><header>Requirements</header><text>If the Secretary elects to carry out clause (i), the Secretary shall—</text> <subclause commented="no" id="id48712f9599c049508135149e2c29c1e9"><enum>(I)</enum><text>request proposals from eligible entities, as determined by the Secretary, that include—</text>
 <item commented="no" id="idF7BA9F634E7E43CBB7C9A10CD4A9F8CA"><enum>(aa)</enum><text>a business plan;</text> </item><item commented="no" id="id5A6506E26E1A4ADCA098BE81ED19031F"><enum>(bb)</enum><text>technical details; and</text>
 </item><item commented="no" id="id516BBBC160C346BABBF47AF3112719D1"><enum>(cc)</enum><text>proposed milestones and associated payments; and</text> </item></subclause><subclause commented="no" id="id4aa58ab5c5d24210aa9d6a285b94376e"><enum>(II)</enum><text>select projects—</text>
 <item commented="no" id="id4D96D5AA35FF4166AED570FD5B72289C"><enum>(aa)</enum><text>based on the demonstrated ability of the eligible entity to meet the milestones and associated payments described in the proposal of that eligible entity; and</text>
 </item><item commented="no" id="idA12584B5B0A34E3D9C0F03CE8D529728"><enum>(bb)</enum><text>that have the greatest potential commercial applicability.</text></item></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section><section id="idd56c619e3aec48d9b6c6205c648623d5"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 623 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17202">42 U.S.C. 17202</external-xref>) is amended by striking <quote>$90,000,000</quote> in the first sentence and all that follows through the period at the end of the second sentence and inserting <quote>$150,000,000 for each of fiscal years 2020 through 2024.</quote>.</text>
 </section><section id="idc7e83e8095d84f16bc87745caa47d027"><enum>7.</enum><header>Reauthorization of high cost region geothermal energy grant program</header><text display-inline="no-display-inline">Section 625 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17204">42 U.S.C. 17204</external-xref>) is amended—</text> <paragraph commented="no" id="ide0def975de5b48eb8b11da1717924911"><enum>(1)</enum><text>in subsection (a)(2), by inserting <quote>or heat</quote> after <quote>electrical power</quote>; and</text>
 </paragraph><paragraph commented="no" id="idB3AC5D1093EA4A47948EC5897063766E"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (e) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id6E710D50CE054001BC38DD44C12A7707" style="OLC"> <subsection commented="no" id="id5168D11A89C64ECA825EE3D3E47768BF"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $5,000,000 for each of fiscal years 2020 through 2024.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idFD6C56F47A4241D78C63DB4ACDD75531"><enum>8.</enum><header> Program to improve Federal geothermal permit coordination</header>
 <subsection id="id684228d7098a47f5b17c282b0c3ffd09"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id7A65CBB9FE9440DC9B716451DA55A954"><enum>(1)</enum><header>Program</header><text>The term <term>Program</term> means the Geothermal Energy Permitting Coordination Program established under subsection (b).</text>
 </paragraph><paragraph id="id55A50C16104B4A4C90370127DD69F1DD"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph></subsection><subsection id="id7635DCFB7BF3498ABA4974CD3BD05155"><enum>(b)</enum><header>Establishment of Program</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall establish a program, to be known as the <quote>Geothermal Energy Permitting Coordination Program</quote>, to improve Federal permit coordination and reduce regulatory timelines with respect to geothermal energy projects on Federal land by increasing the expertise of officials administering and approving permits.</text>
 </subsection><subsection id="idB665105E74094C95818531C4D58DDB4B"><enum>(c)</enum><header>Establishment of Program offices</header><text>To carry out the Program, the Secretary shall establish one or more Program offices at State or district offices of the Department of the Interior.</text>
			</subsection><subsection id="id4d7363c18e86427ca9a275aae1fa029f"><enum>(d)</enum><header>Memorandum of understanding</header>
 <paragraph id="id2073d2d173094d4595ebc283fe2a148e"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall enter into a memorandum of understanding for purposes of this section with—</text>
 <subparagraph id="id7c2c0e87de234c08b06a7f78382e5620"><enum>(A)</enum><text>the Secretary of Agriculture;</text> </subparagraph><subparagraph id="id9d6b878b381b4779af13d8b8c556cc97"><enum>(B)</enum><text>the Administrator of the Environmental Protection Agency; and</text>
 </subparagraph><subparagraph id="id05d50652dc0148758fd436088c4c5187"><enum>(C)</enum><text>the Secretary of Defense.</text> </subparagraph></paragraph><paragraph id="id9ca01ec5179e4d76a4a23690b7a52870"><enum>(2)</enum><header>State participation</header><text>The Secretary may request that the Governor of any State be a signatory to the memorandum of understanding under paragraph (1).</text>
				</paragraph></subsection><subsection id="idfc0ae7d24c684745a4e138d9cd17268f"><enum>(e)</enum><header>Designation of qualified staff</header>
 <paragraph id="id84d57f8d0e3a49e2bdd5f00395fb085c"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date on which the memorandum of understanding under subsection (d) is executed, all Federal signatories, as appropriate, shall assign to each Program office established under subsection (c) one or more employees who have expertise in the regulatory issues relating to the office or agency in which the employee is employed, including, as applicable, particular expertise in—</text>
 <subparagraph id="id9f27f16dfdc74ec9a007a44df9a88396"><enum>(A)</enum><text>consultation regarding, and preparation of, biological opinions under section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>);</text>
 </subparagraph><subparagraph id="ida34abae2bc584b7699b42a447b54131b"><enum>(B)</enum><text>permits under section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>);</text> </subparagraph><subparagraph id="id7bdaa7421ed4419e8b361da84223ebf1"><enum>(C)</enum><text>regulatory matters under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et seq.);</text>
 </subparagraph><subparagraph id="idEE37174413954313874CFEBC7A17082A"><enum>(D)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.);</text> </subparagraph><subparagraph id="id7a6d77d979cc4ebf8d52aa18391bd5cc"><enum>(E)</enum><text>planning under section 14 of the National Forest Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/16/472a">16 U.S.C. 472a</external-xref>);</text>
 </subparagraph><subparagraph id="idbc6804301e1c42509e829f2435c92dd0"><enum>(F)</enum><text>developing geothermal resources under the Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001</external-xref> et seq.); and</text>
 </subparagraph><subparagraph id="id150d44a3d9cc4f94920c67acaefc985c"><enum>(G)</enum><text>the preparation of analyses under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text>
 </subparagraph></paragraph><paragraph id="idbd566ed6a4164d22b9fab97cdd081039"><enum>(2)</enum><header>Duties</header><text>Each employee assigned under paragraph (1) shall—</text> <subparagraph id="idcfa4c3ccd4634ed09614dcc0d17abf59"><enum>(A)</enum><text>not later than 90 days after the date on which the employee is assigned, report to the State Director of the Bureau of Land Management for the State in which the office to which the employee is assigned is located;</text>
 </subparagraph><subparagraph id="id95d683c104fb4f57a7c3066dd7b90938"><enum>(B)</enum><text>be responsible for all issues relating to the jurisdiction of the home office or agency of the employee; and</text>
 </subparagraph><subparagraph id="id16e5f16cbff3486a85175b699c216be4"><enum>(C)</enum><text>participate as part of the team of personnel working on proposed energy projects, planning, and environmental analyses.</text>
 </subparagraph></paragraph></subsection><subsection id="id4d0ab2e1a32741f794d97fed5bc32805"><enum>(f)</enum><header>Additional personnel</header><text>The Secretary shall assign to each Program office any additional personnel that are necessary to ensure the effective implementation of—</text>
 <paragraph id="id0e7bf4f942c94dbe9cd11c99a21b24b7"><enum>(1)</enum><text>the Program; and</text> </paragraph><paragraph id="idc3d4af73ffc24fb9a150f9d7514c3fd9"><enum>(2)</enum><text>any program administered by the Program office, including inspection and enforcement relating to energy development on Federal land, in accordance with the multiple use mandate of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.).</text>
 </paragraph></subsection><subsection id="id279ddb72f58546b8aa7eed4ee29d888c"><enum>(g)</enum><header>Transfer of funds</header><text>To facilitate the coordination and processing of geothermal permits on Federal land under the administration of a Program office, the Secretary may authorize the expenditure or transfer of any funds that are necessary to—</text>
 <paragraph id="id35f44a9d8e1f42f3931faa1d47e6d181"><enum>(1)</enum><text>the United States Fish and Wildlife Service;</text> </paragraph><paragraph id="id6dac9d7da71e4fd5986b7b6f453b633d"><enum>(2)</enum><text>the Bureau of Indian Affairs;</text>
 </paragraph><paragraph id="ideae573e015454389a0868d9b1872cb1b"><enum>(3)</enum><text>the Forest Service;</text> </paragraph><paragraph id="id0a80dc550823428680423f813235d3f6"><enum>(4)</enum><text>the Environmental Protection Agency;</text>
 </paragraph><paragraph id="id8d27c9ffd3364317bb3701844ec6f662"><enum>(5)</enum><text>the Corps of Engineers;</text> </paragraph><paragraph id="ida9afda4c023c44a697570a5bb47330b3"><enum>(6)</enum><text>the Department of Defense; or</text>
 </paragraph><paragraph id="idbc96297bdabc490b910703103baac6e8"><enum>(7)</enum><text>any State in which a geothermal project is located.</text> </paragraph></subsection><subsection id="id3b72dc6f9fa44f8fa849bedfa7bed523"><enum>(h)</enum><header>Reports</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall submit to Congress a report that describes—</text>
 <paragraph id="idada443893b4a4d1a8e88ca1b430f2cfe"><enum>(1)</enum><text>the progress of the Program; and</text> </paragraph><paragraph id="id6b752084cb5d473dbcd7680b22dcee86"><enum>(2)</enum><text>any problems relating to leasing, permitting, or siting with respect to geothermal energy development on Federal land.</text>
 </paragraph></subsection><subsection id="id62fc5f00a11e4d189747ceec375f2a4f"><enum>(i)</enum><header>Savings clause</header><text>Nothing in this section affects—</text> <paragraph id="idec4846901fc74b31a894ded184c3f8c2"><enum>(1)</enum><text>the operation of any Federal or State law; or</text>
 </paragraph><paragraph id="id1164925e80bf4137a549898274aa72b4"><enum>(2)</enum><text>any delegation of authority made by the head of a Federal agency any employee of which is participating in the Program.</text></paragraph></subsection></section></legis-body></bill>
