<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d13704e62" identifier="/us/bill/116/s/24/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Government Employee Fair Treatment Act of 2019</shortTitle>”.</content></section>
<section id="d13704e72" identifier="/us/bill/116/s/24/s2" role="instruction" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>COMPENSATION FOR FEDERAL AND OTHER GOVERNMENT EMPLOYEES AFFECTED BY A LAPSE IN APPROPRIATIONS.</heading><chapeau class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120">  <ref href="/us/usc/t31/s1341">Section 1341 of title 31, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d13704e84" identifier="/us/bill/116/s/24/s2/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a)(1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>An officer</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Except as specified in this subchapter or any other provision of law, an officer</quotedText>”; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d13704e95" identifier="/us/bill/116/s/24/s2/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">“(c)</num><paragraph class="inline"><num value="1">(1) </num><chapeau>In this subsection—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="A">“(A) </num><content>the term ‘<term>covered lapse in appropriations</term>’ means any lapse in appropriations that begins on or after December 22, 2018;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>the term ‘<term>District of Columbia public employer</term>’ means—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>the District of Columbia Courts;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the Public Defender Service for the District of Columbia; or</content></clause><clause class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the District of Columbia government;</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="C">“(C) </num><content>the term ‘<term>employee</term>’ includes an officer; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="D">“(D) </num><content>the term ‘<term>excepted employee</term>’ means an excepted employee or an employee performing emergency work, as such terms are defined by the Office of Personnel Management or the appropriate District of Columbia public employer, as applicable.</content></subparagraph></paragraph><paragraph class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="2">“(2) </num><content>Each employee of the United States Government or of a District of Columbia public employer furloughed as a result of a covered lapse in appropriations shall be paid for the period of the lapse in appropriations, and each excepted employee who is required to perform work during a covered lapse in appropriations shall be paid for such work, at the employee’s standard rate of pay, at the earliest date possible after the lapse in appropriations ends, regardless of scheduled pay dates.</content></paragraph><paragraph class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="3">“(3) </num><content>During a covered lapse in appropriations, each excepted employee who is required to perform work shall be entitled to use leave under chapter 63 of title 5, or any other applicable law governing the use of leave by the excepted employee, for which compensation shall be paid at the earliest date possible after the lapse in appropriations ends, regardless of scheduled pay dates.”</content></paragraph></subsection></quotedContent>.</content></paragraph></section>
