		<official-title>To terminate certain rules issued by the Secretary of the Interior and the Secretary of Commerce
			 relating to endangered and threatened species, and for other purposes.</official-title>

 <section id="id967B3CC785CE4E74AB306BEFAF0E5B47" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect America's Wildlife and Fish in Need of Conservation Act of 2019</short-title></quote>.</text> </section><section id="id65304E4451174329B3202196A1FF2303" section-type="subsequent-section"><enum>2.</enum> <header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
 <paragraph id="id7077e1d0320746f0a03d0ce09fcc9e2a"><enum>(1)</enum><text>global wildlife populations have fallen by 60 percent over 4 decades due to habitat loss, pollution, deforestation, climate change, and other anthropogenic factors;</text>
 </paragraph><paragraph id="id2c691393ec6642d4be8c3b2f056961e9"><enum>(2)</enum><text>current rates of species extinction are up to 1,000 times greater than the natural rate of extinction; and</text>
 </paragraph><paragraph id="id9c3d7022b1b444288222f6bc7def9848"><enum>(3)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) is one of the most popular and successful environmental laws of the United States.</text>
			</paragraph></section><section id="ida63830a37de54adf8e79e84405186c9d"><enum>3.</enum><header>Termination of regulations relating to endangered and threatened species and restoration of prior
			 regulations</header>
 <subsection id="iddb0b17c588994db5b5f9269a6d3fea19"><enum>(a)</enum><header>In general</header><text>The amendments to parts 17, 402, and 424 of title 50, Code of Federal Regulations, made by the following final rules are void:</text>
 <paragraph id="ide193e15378714a8bbb1a27f2c8fb3793"><enum>(1)</enum><text>The final rule promulgated by the Secretary of the Interior entitled <quote>Endangered and Threatened Wildlife and Plants; Regulations for Prohibitions to Threatened Wildlife and Plants</quote> (84 Fed. Reg. 44753 (August 27, 2019)).</text>
 </paragraph><paragraph id="id27488b0bb12c4f52876d1db60a6b1091"><enum>(2)</enum><text>The final rule promulgated by the Secretary of the Interior and the Secretary of Commerce entitled <quote>Endangered and Threatened Wildlife and Plants; Regulations for Interagency Cooperation</quote> (84 Fed. Reg. 44976 (August 27, 2019)).</text> </paragraph><paragraph id="id443b0c9b40a34da1a866d3c497a26aee"><enum>(3)</enum><text>The final rule promulgated by the Secretary of the Interior and the Secretary of Commerce entitled <quote>Endangered and Threatened Wildlife and Plants; Regulations for Listing Species and Designating Critical Habitat</quote> (84 Fed. Reg. 45020 (August 27, 2019)).</text>
 </paragraph></subsection><subsection id="id4a72aba9b337401bb37f535164bf7cb2"><enum>(b)</enum><header>Effectiveness</header><text>Parts 17, 402, and 424 of title 50, Code of Federal Regulations, shall be in effect as if the amendments voided under subsection (a) had not been made.</text>
 </subsection><subsection id="id284c1cbddfd24892b2cfdd67affd805e"><enum>(c)</enum><header>Promulgation of new rules</header><text>Any rule proposed by the Secretary of the Interior or the Secretary of Commerce after the date of enactment of this Act to amend part 17, 402, or 424 of title 50, Code of Federal Regulations (other than any rule that is necessary to carry out subsections (a) and (b))—</text>
 <paragraph id="idb5039a4bd09e48d3873ed9f4c2e9129e"><enum>(1)</enum><text>shall analyze and incorporate the impacts of climate change, including long-term impacts, on—</text> <subparagraph id="idCAB25A87E7F9463CA00D07CFCED0E80E"><enum>(A)</enum><text>species listed as threatened species or endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) and species that are candidates to be so listed; and</text>
 </subparagraph><subparagraph id="idAD2A24AFBBB844C5AF337900A238E068"><enum>(B)</enum><text>the habitats of species described in subparagraph (A);</text> </subparagraph></paragraph><paragraph id="idfc2411c366e34e3f8aad22da013ae1cc"><enum>(2)</enum><text>may analyze and incorporate alternatives for providing automatic protections under section 9(a) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1538">16 U.S.C. 1538(a)</external-xref>) in the case of species listed as threatened species under that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.); and</text>
 </paragraph><paragraph id="id5fc55faf3a894da980c7035e52374d81"><enum>(3)</enum><text>may not—</text> <subparagraph id="idea48a2e8ea6f41739a0af5b9f81074da"><enum>(A)</enum><text>analyze or incorporate any positive or negative economic impacts associated with the decision of whether to list a species as a threatened species or an endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.);</text>
 </subparagraph><subparagraph id="ide85b9e9d80054d47be57b44050ec74f6"><enum>(B)</enum><text>limit the authority of the Secretary of the Interior or the Secretary of Commerce to consider the impacts of climate change, including the long-term impacts; or</text>
 </subparagraph><subparagraph id="idd2c40ca04a7a4fa1a708dfb2b147cc28"><enum>(C)</enum><text>interfere in any manner with the best available science.</text> </subparagraph></paragraph></subsection></section><section id="id5fa6db0337544a63a16317ca5aadfab2"><enum>4.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
 <paragraph id="ida30fad23820346fe927e0756166691d5"><enum>(1)</enum><text>Congress recognizes the potential benefit of clarifying inconsistencies in—</text> <subparagraph id="id31DE793FED80450F9B48FE0361B66F4D"><enum>(A)</enum><text>the past practices of the United States Fish and Wildlife Service and the National Marine Fisheries Service under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.); and</text>
 </subparagraph><subparagraph id="idD522B28009E24B5693F9D359A6AAEF64"><enum>(B)</enum><text>interpretations by those agencies of regulations under that Act, especially under section 7 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>); and</text>
 </subparagraph></paragraph><paragraph id="idf5c52cf8a2274166a57cbd0b421a5495"><enum>(2)</enum><text>Congress acknowledges the importance of providing incentives for landowners to conserve species, especially by rewarding the landowners for—</text>
 <subparagraph id="idAD369E4B429342EF96D343AB31E0506B"><enum>(A)</enum><text>helping to prevent the need to add species to the list of threatened species or endangered species under that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.); and</text>
 </subparagraph><subparagraph id="idC4A0467D129B446F9CAB462A68F8C896"><enum>(B)</enum><text>successfully conserving species listed as endangered species under that Act to the point that the species can be downlisted to the list of threatened species under that Act.</text>
				</subparagraph></paragraph></section></legis-body>
