			 community mental health facilities to register to dispense controlled
			 substances through the practice of telemedicine, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H558F1AF5B84844AC8D512167DEC374F4" style="OLC">
 <section id="H5478B4D600524B6CB7044633241A75B5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modernizing Eligible Treatment centers for Healing Addiction Act of 2019</short-title></quote> or the <quote><short-title>METH Addiction Act</short-title></quote>.</text> </section><section id="HDCAF4BD1A7594DB78834AF40483D32FA"><enum>2.</enum><header>Registration of community addiction treatment facilities and community mental health facilities</header> <subsection id="HEFFD6AB3C5AC4007BD6469F3323B7A58"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>) is amended—</text>
 <paragraph id="id88649A6CD33C498587D884E12392F7F6"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (54)(A), by striking clause (i) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id60A798E4F1594EB2BC1D0DE9D7C3F97E" style="OLC"> <clause commented="no" display-inline="no-display-inline" id="ID5E739220CBB74249889E7E52D7A675BD" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">while the patient is being treated by, and physically located in—</text>
 <subclause commented="no" display-inline="no-display-inline" id="idDF5361389BA94AC3A2349473198CE594"><enum>(I)</enum><text display-inline="yes-display-inline">a hospital or clinic registered under section 303(f); or</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="idD2124E9A1B6F42F0B8A086743388C3E4"><enum>(II)</enum><text display-inline="yes-display-inline">a community addiction treatment facility or community mental health facility registered under section 303(l); and</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id528A73602BC94AA6A9BE935DD1492428"><enum>(2)</enum><text>by redesignating paragraph (58) as paragraph (59);</text> </paragraph><paragraph id="id27957F562B224624B25644CA1376954E"><enum>(3)</enum><text>by redesignating the second paragraph designated as paragraph (57) as paragraph (58);</text>
 </paragraph><paragraph id="idBA355388190A4A719629550EFF853A37"><enum>(4)</enum><text>by moving paragraphs (57), (58) (as so redesignated), and (59) (as so redesignated) 2 ems to the left; and</text>
 </paragraph><paragraph id="idFFE849FDED7245549618DBAABCD2E55F"><enum>(5)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idC1627B397BA04F38A4F9F124D5838D01" style="OLC"> <paragraph id="idEC5B1AEA79A045ACABF3BCA98A6A31E3" indent="up1"><enum>(60)</enum><text>The term <term>community addiction treatment facility</term> means an addiction treatment facility that, for the purpose of operating as an addiction treatment facility, is licensed, operated, authorized, or otherwise recognized by a State government.</text>
 </paragraph><paragraph id="id1184CC85A62F4B1E8A328C011D72A2D6" indent="up1"><enum>(61)</enum><text>The term <term>community mental health facility</term> means a mental health facility that, for the purpose of operating as a mental health facility, is licensed, operated, authorized, or otherwise recognized by a State government.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id3A6CADDC3AED4C2A86B444BF3A7B3DB0"><enum>(b)</enum><header>Registration</header><text>Section 303 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA1D1A032325E46BA87582A66D3C35733" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID69352F41ABED460AA73551EE636F84D0"><enum>(l)</enum><header>Community addiction treatment facilities and community mental health facilities</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id062668C7E9A04095B2ADEE40225EAE77"><enum>(1)</enum><header>Registration</header><text display-inline="yes-display-inline">The Attorney General may register community addiction treatment facilities and community mental health facilities to administer controlled substances through the practice of telemedicine.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id03DDDACD7DB04BCDBE040E3EA5B5B17C"><enum>(2)</enum><header>Denial of applications</header><text display-inline="yes-display-inline">The Attorney General may deny an application for registration under paragraph (1) if the Attorney General determines that the registration would be inconsistent with the public interest after considering—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="IDC92FF3C4A5C04749A176AA66D86A33E7"><enum>(A)</enum><text>any recommendation by the licensing board or professional disciplinary authority of the State in which the applicant is located;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE21713F25FDA448DB801C449B6C5B328"><enum>(B)</enum><text>the experience of the applicant in treating patients;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE3A18E14CBD54926BF4E5559CA69D147"><enum>(C)</enum><text>any conviction of an employee of the applicant under Federal or State law relating to treatment of patients;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1F159B6F0DE44D4083FC8A571E068B8A"><enum>(D)</enum><text>the compliance of the applicant with applicable Federal, State, or local laws relating to treatment of patients; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE62600EA979749D19A1D378BC1C87F49"><enum>(E)</enum><text>any other conduct by the applicant that may threaten the health and safety of the public.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="HF0068B54475443E4A94BA81C059854AA"><enum>(c)</enum><header>Implementation plan</header><text>Not later than 180 days after the date of enactment of this Act, the Attorney General shall notify Congress of the plan of the Department of Justice to implement the amendments made by this Act.</text>
 </subsection><subsection id="id59AB1E6BD38D4B72BF601D9295041AA6"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this Act shall take effect on the date that is 180 days after the date on which the Attorney General notifies Congress under subsection (c).</text></subsection></section></legis-body></bill>
