			 withdrawal in real-time, and for other purposes. </official-title></form>

 <section id="id2074004D9FF747AFB51F1B9883A98E61" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Payments Modernization Act of 2019 </short-title></quote>.</text> </section><section id="id7A884675C9B44E50A3F7C64B27091781"><enum>2.</enum><header>Findings and purposes</header> <subsection id="id1ACA86BE6837407E9934DA34ED54CEDD"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
 <paragraph id="id1174E4B115124652B3A87BA622D58F7E"><enum>(1)</enum><text>Families in the United States spend billions of dollars in overdraft fees in part because they are waiting for checks to clear over a weekend or holiday.</text>
 </paragraph><paragraph id="id6CAA56088BE54F9FAA6402BBAC544A8F"><enum>(2)</enum><text>The inefficient payment system in the United States drives families, especially those living paycheck to paycheck, to use high-cost financial services to access funds more rapidly.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF31EE1FF5BBC4901964D53F7BD6C81DF"><enum>(3)</enum><text display-inline="yes-display-inline">A faster payment system would provide people of the United States immediate access to funds and relief for those who overdraw their accounts because their deposits are not available in real-time, helping families potentially save billions of dollars each year.</text>
 </paragraph><paragraph id="idd97ae50acdd54a599cad0fd1edcb07c7"><enum>(4)</enum><text>The United States lags behind other countries in the speed and efficiency of its payment system.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC97C94F2D9EC4196BE4440C6BFB292ED"><enum>(5)</enum><text>Central banks around the world have already implemented real-time payment systems, including in the United Kingdom, Australia, Mexico, Poland, Japan, and South Africa.</text>
 </paragraph><paragraph id="ide6ef94a0e09f40d89e2ce5fc67e32c8a"><enum>(6)</enum><text>The Federal Reserve System was created by Congress on December 24, 1913, in response to the financial panic of 1907.</text>
 </paragraph><paragraph id="id31f0312b08a54d8a90d1e82448d98fc5"><enum>(7)</enum><text>Since its beginning, the Federal Reserve System has played a crucial role in the payment system of the United States.</text>
 </paragraph><paragraph id="idafbc12c2da5d48b484b14fcd9922a6f4"><enum>(8)</enum><text>The role of the Federal Reserve System in providing payment services is—</text> <subparagraph id="idF33A306087BE4D5AB6F48A84F4B742AD"><enum>(A)</enum><text>to promote the integrity and efficiency of the payment mechanism; and</text>
 </subparagraph><subparagraph id="idD1AF8A3996964242A87BA41D3AF85704"><enum>(B)</enum><text>to ensure the provision of payment services to all depository institutions on an equitable basis and in an atmosphere of competitive fairness.</text>
 </subparagraph></paragraph><paragraph id="idf8a608174b464f218998badf80aac8e6"><enum>(9)</enum><text>The Monetary Control Act of 1980 (title I of <external-xref legal-doc="public-law" parsable-cite="pl/96/221">Public Law 96–221</external-xref>; 94 Stat. 132) provided the Board of Governors of the Federal Reserve System with the authority to oversee the payment system in the United States.</text>
 </paragraph><paragraph id="idCF9BE705C17F4229801E6D90FEEEF855"><enum>(10)</enum><text>The Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4001">12 U.S.C. 4001</external-xref> et seq.), enacted on August 10, 1987, provided the Board of Governors of the Federal Reserve System with full authority to regulate all aspects of the payment system, including the receipt, payment, collection, clearing of checks, and related functions of the payment system pertaining to checks.</text>
 </paragraph><paragraph id="id8d3dc981148e496d8d0a339435a5faaa"><enum>(11)</enum><text>In a July 2018 report on financial technology, the Department of Treasury acknowledged the important role of the Board of Governors of the Federal Reserve System in bringing real-time payment settlement services to the United States when the Department recommended the Board of Governors work to facilitate a faster retail payment system, in particular, for smaller financial institutions such as community banks and credit unions, noting that such institutions should also have the ability to access the most innovative technologies and payment services.</text>
 </paragraph><paragraph id="id13c17e04269c49b2a69442e069322224"><enum>(12)</enum><text>The authorities described in paragraphs (9) and (10) are more critical than ever given how the financial services sector has been defined as a vital component of critical infrastructure in the United States.</text>
 </paragraph><paragraph id="id4cd0adf476414a08ade54a45b8742ff3"><enum>(13)</enum><text>The role of the Board of Governors of the Federal Reserve System in the financial services sector will ensure the resiliency of the payment system in the United States.</text>
 </paragraph><paragraph id="id59c1e4362c47404786773bc7b5e21796"><enum>(14)</enum><text>The Board of Governors of the Federal Reserve System should develop a real-time interbank payment system to ensure that—</text>
 <subparagraph id="id8688425A0D3741B0869B60994D812A3D"><enum>(A)</enum><text>consumers are prioritized;</text> </subparagraph><subparagraph id="idA20AA117C51740DFB685764B930BFFAA"><enum>(B)</enum><text>consumers and small businesses are protected from fraud and errors, including with respect to a payment initiated by a consumer or small business;</text>
 </subparagraph><subparagraph id="id6331D5611B8F44B2AC40E07D942B1F2E"><enum>(C)</enum><text>the payment system is open to increased competition; and</text> </subparagraph><subparagraph id="id67658FF87E3342CD9C7822CD3867DB63"><enum>(D)</enum><text>outsized entities do not monopolize the financial infrastructure of the United States.</text>
 </subparagraph></paragraph></subsection><subsection id="id387599C7F1D9422CA6890FFAD7E78E61"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text> <paragraph id="iddfcae5f7a58341e592e39ac44e05ca2d"><enum>(1)</enum><text>to ensure that the United States has a safe, fast, efficient, equitable, and fair payment system;</text>
 </paragraph><paragraph id="idd3e68b3530cf46159cdd877968ceb1e3"><enum>(2)</enum><text>to clarify that the Board of Governors of the Federal Reserve System has the existing authority to build a real-time payment system; and</text>
 </paragraph><paragraph id="id0548FA4DAAE84E78A79F1B2208463440"><enum>(3)</enum><text>to make certain that the Board of Governors of the Federal Reserve System follows through on implementing the system described in paragraph (2).</text>
 </paragraph></subsection></section><section id="idF8B42CA1884F4B6984FB027B4279C382"><enum>3.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act, the term <term>real-time</term> has the meaning given the term in section 602 of the Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4001">12 U.S.C. 4001</external-xref>), as amended by section 4(a) of this Act.</text>
		</section><section id="H28A14AC0143D4B71A48211E27DF2714D" section-type="subsequent-section"><enum>4.</enum><header>Requirement that funds deposited be available for withdrawal in real-time</header>
			<subsection id="idA432F4DF1E484FEB892E9D9255467BFA"><enum>(a)</enum><header>Definitions</header>
 <paragraph id="idC6288158851D4F27AAA96A499D415882"><enum>(1)</enum><header>In general</header><text>Section 602 of the Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4001">12 U.S.C. 4001</external-xref>) is amended—</text> <subparagraph id="id2CEBA888501545A58C51FF9686C348E0"><enum>(A)</enum><text>by redesignating paragraphs (20) through (25) as paragraphs (21) through (26), respectively; and</text>
 </subparagraph><subparagraph id="idEEED1C6C5BD94DCBAB939500C595BEB2"><enum>(B)</enum><text>by inserting after paragraph (19) the following:</text> <quoted-block display-inline="no-display-inline" id="id97782E5ED0364046B37BB21FE7CEBE69" style="OLC"> <paragraph id="id077929A664314435A60C569B3BC4C906"><enum>(20)</enum><header>Real-time</header><text>The term <term>real-time</term>—</text>
 <subparagraph id="id1F69AEDB49AE4552BE42848333D8B918"><enum>(A)</enum><text>means any time; and</text> </subparagraph><subparagraph id="id3D0E86F07D9D43E99BD8F5CD41D7CCEB"><enum>(B)</enum><text>includes a Saturday, Sunday, and a legal holiday.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="idC72CAB29E9D94EE08710914164126D78"><enum>(2)</enum><header>Technical and conforming amendment</header><text>Section 3 of the Check Clearing for the 21st Century Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5002">12 U.S.C. 5002(2)(D)(iv)</external-xref>) is amended by striking <quote>section 602(24)</quote> and inserting <quote>section 602(25)</quote>.</text>
 </paragraph></subsection><subsection id="H12A851A8289C4292A39DF7666FE59D68"><enum>(b)</enum><header>Expedited funds availability schedules</header><text display-inline="yes-display-inline">Section 603 of the Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4002">12 U.S.C. 4002</external-xref>) is amended—</text> <paragraph id="H71C0EF1EA5524848AFBD75AAF869BC36"><enum>(1)</enum><text>in subsection (a)—</text>
 <subparagraph id="HCB67EDF780FB4EE3BFDFD835A509AEA0"><enum>(A)</enum><text display-inline="yes-display-inline">in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Next Business Day</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Real-time</header-in-text></quote>;</text> </subparagraph><subparagraph id="HBDDEB0D49CD0421784D4227C2FF6A6B2"><enum>(B)</enum><text>in paragraph (1)—</text>
 <clause id="H2A038D064E2C4298980D24A24CCB06F1"><enum>(i)</enum><text>by striking <quote>Except as provided in subsection (e) and in section 604, in</quote> and inserting <quote>In</quote>; and</text> </clause><clause id="HCF4C0CDCB06C4531B8B37936AA3E39C3"><enum>(ii)</enum><text display-inline="yes-display-inline">in the matter following subparagraph (B) by striking <quote>not later than the business day after the business day on which</quote> and inserting <quote>in real-time when</quote>; and</text>
 </clause></subparagraph><subparagraph id="HC71575182632467EAB95BFCB6D751116"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (2), in the matter preceding subparagraph (A), by striking <quote>not later than the business day after the business day on which</quote> and inserting <quote>in real-time after</quote>; and</text> </subparagraph></paragraph><paragraph id="H41269613A86A4B849C3D3651068BE3C1"><enum>(2)</enum><text>by striking subsection (b) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H631A9699D41746A4BBCFD0913C6E89CA" style="OLC">
 <subsection id="H903DB03B58654A58BBBF220523F889CA"><enum>(b)</enum><header>Permanent Schedule</header><text display-inline="yes-display-inline">Funds deposited in an account at a depository institution by a check drawn on a local or nonlocal originating depository institution shall be available for withdrawal in real-time.</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block>
 </paragraph><paragraph id="HAAC5480177CC485ABB5778ED3985EF43"><enum>(3)</enum><text display-inline="yes-display-inline">by striking subsection (c);</text> </paragraph><paragraph id="H05FCCAF02BD244A8917D96EAA60E98E5"><enum>(4)</enum><text>by striking subsection (d);</text>
 </paragraph><paragraph id="H1080A2C9D2F74E1288C7E89837029956"><enum>(5)</enum><text>by redesignating subsections (e) and (f) as subsections (c) and (d), respectively;</text> </paragraph><paragraph id="H66495E7C2E484DC7B35EED7FCAB59999"><enum>(6)</enum><text display-inline="yes-display-inline">in subsection (c), as redesignated by paragraph (5)—</text>
 <subparagraph id="HC3B7F4B5412844C9BC7F5D234997530D"><enum>(A)</enum><text>in paragraph (1)—</text> <clause id="id39EB6E68E63448C19359FA0CFC99781D"><enum>(i)</enum><text>in subparagraph (A)—</text>
 <subclause id="HAC96A3FFADFB4D7FA0BB9189C15EE003"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>Not more than 4 business days shall intervene between the business day a</quote> and inserting <quote>A</quote>;</text> </subclause><subclause id="H80F586D528D24B5682958ECA43F09BC8"><enum>(II)</enum><text>by inserting a comma after <quote>subparagraph (B)</quote>;</text>
 </subclause><subclause id="H74006A97F14E417E88816C06F5A05D37"><enum>(III)</enum><text>by striking <quote>is</quote>; and</text> </subclause><subclause id="HF568B0379EB64E39AAFA2AD05DC9437E"><enum>(IV)</enum><text display-inline="yes-display-inline">by striking <quote>and the business day on which funds from such deposit are available for withdrawal</quote> and inserting <quote>shall be available for withdrawal in real-time</quote>; and</text>
 </subclause></clause><clause id="id75DF0F2BC1E1490CBAC7264268F1B1CB"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (B), in the subparagraph heading, by striking <quote><header-in-text level="subparagraph" style="OLC">paragraph</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">subparagraph</header-in-text></quote>; and</text> </clause></subparagraph><subparagraph id="H8A87CB4CBA464D9193C328EFB888A7C4"><enum>(B)</enum><text>in paragraph (2)—</text>
 <clause id="HA5E4FF43CB914AD68114C789EC3B5F4F"><enum>(i)</enum><text>by striking <quote>, (b), and (c)</quote> and inserting <quote>and (b)</quote>; and</text> </clause><clause id="H0D2B6841C56747C2B6C7BC486AC3F013"><enum>(ii)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">temporary and permanent schedules</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">permanent schedule</header-in-text></quote>; and</text>
 </clause></subparagraph></paragraph><paragraph id="HE1B2731B836F42C0942B47FFD44EA02D"><enum>(7)</enum><text>in subsection (d)(2), as redesignated by paragraph (5), by striking <quote>(c), or (e)</quote> and inserting <quote>or (c)</quote>.</text> </paragraph></subsection><subsection id="H082AF15C46284508842EB13860C71C24"><enum>(c)</enum><header>Safeguard exceptions</header><text display-inline="yes-display-inline">Section 604 of the Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4003">12 U.S.C. 4003</external-xref>) is amended—</text>
 <paragraph id="H84C6691F6D8949AA8CD1D14995751C94"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H5D18E032FF5740AD8846E741670BAB35"><enum>(A)</enum><text>in paragraph (1)—</text>
 <clause id="H90595F4ABB4249959ED68C8982E46FEA"><enum>(i)</enum><text>in the paragraph heading by striking <quote><header-in-text level="paragraph" style="OLC">Next business day</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Real-time</header-in-text></quote>; and</text> </clause><clause id="H32666D91A6A74D58925D0D5A4BDF98CB"><enum>(ii)</enum><text display-inline="yes-display-inline">in the matter following subparagraph (D) by striking <quote>on the business day after the business day on which such cash or funds are deposited or, in the case of a wire transfer, on the business day after the business day on which</quote> and inserting <quote>in real-time after such cash or funds are deposited or, in the case of a wire transfer, in real-time after</quote>;</text>
 </clause></subparagraph><subparagraph id="H7875F09F89C24834802D1A5F42999CCD"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="H09BF7DD0A0A8413D8D9B383844D20706"><enum>(i)</enum><text>by striking <quote>, 603(c), or paragraphs</quote> and inserting <quote>paragraph</quote>; and</text>
 </clause><clause id="H5072C041F8EA481CA6BFB0296DF58B9E"><enum>(ii)</enum><text>by striking <quote>603(e)</quote> and inserting <quote>603(c)</quote>; and</text> </clause></subparagraph><subparagraph id="H3E7E9E55F4A2454089BADCCC58CFD918"><enum>(C)</enum><text>by striking paragraph (3)(B) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H3E1E8BDAAC37483690157793C225A7BD" style="OLC">
 <subparagraph id="H1137F69DB7DB42FBB6E299D43FD810EC"><enum>(B)</enum><text display-inline="yes-display-inline">any such funds deposited in excess of such amount shall be available for withdrawal in real-time.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="HF4EF0917C616486A9FF1F32C23765473"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), in the matter preceding paragraph (1), by striking <quote>(c), or (e)</quote> and inserting <quote>or (c)</quote>;</text>
 </paragraph><paragraph id="H1AF3D7BC19C64D36AB486D096BB6B287"><enum>(3)</enum><text>in subsection (c)(1), by striking <quote>(c), and (e)</quote> and inserting <quote>and (c)</quote>; and</text> </paragraph><paragraph id="HA82D9BBAA8DF4BE2B0C53F0D365B3884"><enum>(4)</enum><text>in subsection (d), by striking <quote>(c), and (e)</quote> and inserting <quote>and (c)</quote>.</text>
 </paragraph></subsection><subsection id="H83DF773677394FF48958B47B14A98034"><enum>(d)</enum><header>Miscellaneous provisions</header><text>Section 607 of the Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4006">12 U.S.C. 4006</external-xref>) is amended—</text> <paragraph id="H57AE2DAA32744DF883AAEE0DAE34D8E5"><enum>(1)</enum><text>by striking subsections (a) and (b); and</text>
 </paragraph><paragraph id="HCF559923BF264A95BA44B9C21F528547"><enum>(2)</enum><text>by redesignating subsections (c) through (f) as subsections (a) through (d), respectively.</text> </paragraph></subsection><subsection id="H04FFBF52B3A9437A854D65CBBD221668"><enum>(e)</enum><header>Regulations and reports by Board</header><text>Section 609 of the Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4008">12 U.S.C. 4008</external-xref>) is amended—</text>
 <paragraph id="HE01D9DBB7AB64F37B4217D63168F27E0"><enum>(1)</enum><text>by striking subsections (d) and (f); and</text> </paragraph><paragraph id="H2CAABA2E0C154E32B1D330FB09897DEC"><enum>(2)</enum><text>by redesignating subsection (e) as subsection (d).</text>
 </paragraph></subsection></section><section id="id92db9e6dc66d487faf088e0ee1375709"><enum>5.</enum><header>Payments mandate</header><text display-inline="no-display-inline">The Federal Reserve shall create a real-time payment system that—</text> <paragraph id="ida2622fc6c8e2417781a37028e1c15579"><enum>(1)</enum><text>at a minimum, conforms with the principles outlined in the final report of the Faster Payments Task Force of the Federal Reserve System;</text>
 </paragraph><paragraph id="ida60734dafad94c36b9029ed8e90e4e08"><enum>(2)</enum><text>allows end users have fast access to funds in real-time;</text> </paragraph><paragraph id="id67a7bafc48e840278e59969e853f683a"><enum>(3)</enum><text>operates as a utility, allowing end users to reach any other end user, including unbanked, underserved and cross-border end users, regardless of the solution used by the end user;</text>
 </paragraph><paragraph id="id2c8111d899374218954495b86ec96a9c"><enum>(4)</enum><text>prioritizes safety and soundness, consumer health, efficiency, and other relevant public interest considerations;</text>
 </paragraph><paragraph id="ide5788987e85848bc8fa882acb860596c"><enum>(5)</enum><text>provides end users with the confidence and trust in the safety and security of the system by ensuring that—</text>
 <subparagraph id="id6b89a8205f804d658b6fc4ff1d7d91d9"><enum>(A)</enum><text>fraud and errors are minimized and resolved quickly; and</text> </subparagraph><subparagraph id="id7c7539e01321418ea10f1874afa4631d"><enum>(B)</enum><text>the assets, accounts, and information of the end user are protected, even as payments cross different solutions;</text>
 </subparagraph></paragraph><paragraph id="idbc341016d1024494868b0d136b48c1cb"><enum>(6)</enum><text>has transparent operating information; and</text> </paragraph><paragraph id="id6e6cd89b8adc4418ba82633e74668ea4"><enum>(7)</enum><text>ensures that there are no volume discounts made that disadvantage smaller financial institutions.</text></paragraph></section></legis-body></bill>
