		<official-title>To amend section 1341 of title 31, United States Code, to require payment of interest on back pay
			 for employees affected by a lapse in appropriations.</official-title>

 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Back Pay Fairness Act of 2019</short-title></quote>.</text> </section><section id="idDE6ECA48860A4E21BD8C21AF39BF7EBD" section-type="subsequent-section"><enum>2.</enum><header>Interest on back pay for employees affected by a lapse in appropriations</header> <subsection id="id5ADD12F264BD4D34AB5589B67EFF0353"><enum>(a)</enum><header>In general</header> <text display-inline="yes-display-inline">Section 1341(c) of title 31, United States Code, is amended—</text>
 <paragraph id="id30CA100EF8F34FBE9D0AE723C1CB5A6F"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (3) as paragraph (4); and</text> </paragraph><paragraph id="id3CE30845D3DC4312928E6D137017BA64"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5D0BFCB35129408EB5D32CE16375E0DC" style="OLC">
 <paragraph id="id3511A80E314441D9BC0FA3967A84BAE5" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD9604C3706A748879FA8E958BF7D86BA"><enum>(A)</enum><text>If a payment under paragraph (2) to an employee furloughed as a result of a covered lapse in appropriations or to an excepted employee is made after the regularly scheduled pay date for such payment in the absence of a lapse in appropriations, the payment shall include an interest payment prorated daily which shall accrue from such regularly scheduled pay date.</text>
 </subparagraph><subparagraph id="id79008991D25F43AFB3254ECF103D17E1" indent="up1"><enum>(B)</enum><text>An interest payment under subparagraph (A)—</text> <clause id="id632B00BEA4614E93A959D69C5B1309C5"><enum>(i)</enum><text>shall be computed at the rate of interest established by the Secretary of the Treasury under section 3902 that is in effect on the first day of the covered lapse in appropriations; and</text>
 </clause><clause id="idD5F986BB76B34081B4E1AB6F1E543E70"><enum>(ii)</enum><text>shall be in addition to any other remedy available under any other law, rule, or regulation.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="id7BFEDF5E03774EB9AE7DD89D7B12161C"><enum>(b)</enum><header>Applicability</header><text>The amendments made by this section shall apply with respect to any covered lapse in appropriations (as defined in section 1341(c) of title 31, United States Code) that begins before, on, or after the date of enactment of this Act.</text>
