			 impacted by the War on Drugs, to provide for expungement of certain
			 cannabis offenses, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H4711645A876E4262889E6847BCC04DC8" style="OLC">
 <section id="H5A952079841D48E693A1AC25624AFA52" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Marijuana Opportunity Reinvestment and Expungement Act of 2019</short-title></quote> or the <quote><short-title>MORE Act of 2019</short-title></quote>.</text> </section><section id="H74D6F28916524C319FAC1E625474F389"><enum>2.</enum><header>Decriminalization of cannabis</header> <subsection id="H83BCB123326244359110B131A3A5E344"><enum>(a)</enum><header>Cannabis removed from schedule of controlled substances</header> <paragraph id="HC310514E1BF84646B200E9115ECAA7DE"><enum>(1)</enum><header>Removal in statute</header><text>Subsection (c) of schedule I of section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812</external-xref>) is amended—</text>
 <subparagraph id="H373338FD19B24FB3B45ECF10C4B562C5"><enum>(A)</enum><text>by striking <quote>(10) Marihuana.</quote>; and</text> </subparagraph><subparagraph id="H98416CB51CE645359D9EA43BC797AC34"><enum>(B)</enum><text>by striking <quote>(17) Tetrahydrocannabinols, except for tetrahydrocannabinols in hemp (as defined in section 297A of the Agricultural Marketing Act of 1946).</quote>.</text>
 </subparagraph></paragraph><paragraph id="H310D17BD52E447BEABDDBDFDEC8E8336"><enum>(2)</enum><header>Removal from schedule</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Attorney General shall finalize a rulemaking under section 201(a)(2) removing marihuana and tetrahydrocannabinols from the schedules of controlled substances. Marihuana and tetrahydrocannabinols shall each be deemed to be a drug or other substance that does not meet the requirements for inclusion in any schedule. A rulemaking under this paragraph shall be considered to have taken effect as of the date of enactment of this Act for purposes of any offense committed, case pending, conviction entered, and, in the case of a juvenile, any offense committed, case pending, and adjudication of juvenile delinquency entered before, on, or after the date of enactment of this Act.</text>
 </paragraph></subsection><subsection id="H9297D83E268D4C92B59D0A9AA5D8AE27"><enum>(b)</enum><header>Conforming amendments to controlled substances act</header><text>The Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801</external-xref> et seq.) is amended—</text> <paragraph id="HB247E8B6880D4AD69B529F359A02B526"><enum>(1)</enum><text>in section 102(44) (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(44)</external-xref>), by striking <quote>marihuana,</quote>;</text>
 </paragraph><paragraph id="H4C947266F8EB43DFAE9271D206E50CE2"><enum>(2)</enum><text>in section 401(b) (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)</external-xref>)—</text> <subparagraph id="HB133EB7831374C839F793A3ADC98883D"><enum>(A)</enum><text>in paragraph (1)—</text>
 <clause id="H058CC4DC06DA431AB70C995B3B6E8BFD"><enum>(i)</enum><text>in subparagraph (A)—</text> <subclause id="H08662D78E8C64CF4A5DD875F8ED7ED16"><enum>(I)</enum><text>in clause (vi), by inserting <quote>or</quote> after the semicolon;</text>
 </subclause><subclause id="H8FFE62FB325445D6A12EAC3D459FBE2D"><enum>(II)</enum><text>by striking clause (vii); and</text> </subclause><subclause id="H926F3E675DD34F058A7822F09973A42D"><enum>(III)</enum><text>by redesignating clause (viii) as clause (vii);</text>

 </paragraph><paragraph id="H6173551849A74BC1B06BCF2ED6C4105D"><enum>(7)</enum><text>in section 422(d) (<external-xref legal-doc="usc" parsable-cite="usc/21/863">21 U.S.C. 863(d)</external-xref>)—</text> <subparagraph id="HF392402CD63D41458E5EBB28EC7A3009"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>marijuana,</quote>; and</text>
 </subparagraph><subparagraph id="H2FAE65CF889F435B942AAC48D923C322"><enum>(B)</enum><text>in paragraph (5), by striking <quote>, such as a marihuana cigarette,</quote>; and</text> </subparagraph></paragraph><paragraph id="H8657D8BA1F3140E1AB128E82A903F140"><enum>(8)</enum><text>in section 516(d) (<external-xref legal-doc="usc" parsable-cite="usc/21/886">21 U.S.C. 886(d)</external-xref>), by striking <quote>section 401(b)(6)</quote> each place the term appears and inserting <quote>section 401(b)(5)</quote>.</text>
				</paragraph></subsection><subsection id="H05242719C8264FA78DCDA7196F7042F6"><enum>(c)</enum><header>Other conforming amendments</header>
 <paragraph id="H72524D2A63894B0AA6807272C2B84AED"><enum>(1)</enum><header>National forest system drug control act of 1986</header><text>The National Forest System Drug Control Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/559b">16 U.S.C. 559b</external-xref> et seq.) is amended—</text> <subparagraph id="HE324474FDF244331A13099F8AFF0B7B4"><enum>(A)</enum><text>in section 15002(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/559b">16 U.S.C. 559b(a)</external-xref>) by striking <quote>marijuana and other</quote>;</text>
 </subparagraph><subparagraph id="HCD0969C13FFC498B8EDFAE5CC7E8F056"><enum>(B)</enum><text>in section 15003(2) (<external-xref legal-doc="usc" parsable-cite="usc/16/559c">16 U.S.C. 559c(2)</external-xref>) by striking <quote>marijuana and other</quote>; and</text> </subparagraph><subparagraph id="H524FF4C11D794D2989671C8F4A0CBE11"><enum>(C)</enum><text>in section 15004(2) (<external-xref legal-doc="usc" parsable-cite="usc/16/559d">16 U.S.C. 559d(2)</external-xref>) by striking <quote>marijuana and other</quote>.</text>
 </subparagraph></paragraph><paragraph id="H4E9E6453BDF64789B0D1B87D129C6EFD"><enum>(2)</enum><header>Interception of communications</header><text>Section 2516 of title 18, United States Code, is amended—</text> <subparagraph id="H641C01C291E84E26B4296522ACBDECDB"><enum>(A)</enum><text>in subsection (1)(e), by striking <quote>marihuana,</quote>; and</text>
 </subparagraph><subparagraph id="HF0DB8E6BE0DD4833B19A085B538C0F7D"><enum>(B)</enum><text>in subsection (2) by striking <quote>marihuana</quote>.</text> </subparagraph></paragraph></subsection><subsection commented="no" id="HB3A1179352244747AE7BA6356327CC76"><enum>(d)</enum><header>Retroactivity</header><text display-inline="yes-display-inline">The amendments made by this section to the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801</external-xref> et seq.) are retroactive and shall apply to any offense committed, case pending, conviction entered, and, in the case of a juvenile, any offense committed, case pending, or adjudication of juvenile delinquency entered before, on, or after the date of enactment of this Act.</text>
			</subsection></section><section id="H759F93BD1F734B3EA6694D1320CB4D3E"><enum>3.</enum><header>Demographic data of cannabis business owners and employees</header>
 <subsection id="H59E6AB45B83D4524BEDCE45549FB7A81"><enum>(a)</enum><header>In general</header><text>The Bureau of Labor Statistics shall regularly compile, maintain, and make public data on the demographics of—</text>
 <paragraph id="HCF5D293643724A8AA154423C45B344DD"><enum>(1)</enum><text>individuals who are business owners in the cannabis industry; and</text> </paragraph><paragraph id="H49B915AC1D3E490E94FA0D8CE73C7C20"><enum>(2)</enum><text>individuals who are employed in the cannabis industry.</text>
 </paragraph></subsection><subsection id="H0A908C480D754DCF9ADF0BCF5590EA4A"><enum>(b)</enum><header>Demographic data</header><text>The data collected under subsection (a) shall include data regarding—</text> <paragraph id="HFEBF083CC615489799BA972C6EFF7957"><enum>(1)</enum><text>age;</text>
 </paragraph><paragraph id="H257434A181D54DE6904EDB9C091A943D"><enum>(2)</enum><text>certifications and licenses;</text> </paragraph><paragraph id="HC6A1AC812FEB4199BD136FFF3A0722AF"><enum>(3)</enum><text>disability status;</text>
 </paragraph><paragraph id="H2F9093B2F3824F78854DC7B2243D966B"><enum>(4)</enum><text>educational attainment;</text> </paragraph><paragraph id="HBB63F11F3BE14062A03D1A77C4B175AA"><enum>(5)</enum><text>family and marital status;</text>
 </paragraph><paragraph id="H593C150AB6F44B74A427D68015D1933C"><enum>(6)</enum><text>nativity;</text> </paragraph><paragraph id="H6CB00D141C524231BEB0509266F4E4C4"><enum>(7)</enum><text>race and Hispanic ethnicity;</text>
 </paragraph><paragraph id="H61C1A555089F46FFA0ED184153726B6B"><enum>(8)</enum><text>school enrollment;</text> </paragraph><paragraph id="H50CFC52420544AD49275158D02034998"><enum>(9)</enum><text>veteran status; and</text>
 </paragraph><paragraph id="H58F7CA40A87E435CB51F174CBD45093B"><enum>(10)</enum><text>sex.</text> </paragraph></subsection><subsection id="H4A8A2A113E5A436EB388AEC5D3A9E7C7"><enum>(c)</enum><header>Confidentiality</header><text>The name, address, and other identifying information of individuals employed in the cannabis industry shall be kept confidential by the Bureau and not be made available to the public.</text>
 </subsection><subsection id="H95D009C33F3F4449AE5B4626A09AD1C5"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HC95EA09768CF4A64BFB05F813541D10D"><enum>(1)</enum><header>Cannabis</header><text>The term <term>cannabis</term> means either marijuana or cannabis as defined under the State law authorizing the sale or use of cannabis in which the individual or entity is located.</text>
 </paragraph><paragraph id="HA31DFBB8BDA8423899179FC188A74DF5"><enum>(2)</enum><header>Cannabis industry</header><text>The term <term>cannabis industry</term> means an individual or entity that is licensed or permitted under a State or local law to engage in commercial cannabis-related activity.</text>
 </paragraph><paragraph id="H8F741FFFCDC147BF9130BFC863D31346"><enum>(3)</enum><header>Owner</header><text>The term <term>owner</term> means an individual or entity that is defined as an owner under the State or local law where the individual or business is licensed or permitted.</text>
				</paragraph></subsection></section><section id="H71705A47F7D44D00B64049E85F534AF6"><enum>4.</enum><header>Creation of Opportunity Trust Fund and imposition of tax on cannabis products</header>
			<subsection display-inline="no-display-inline" id="HBD2BC36E76FD47A091E427122B811B9D"><enum>(a)</enum><header>Trust Fund</header>
 <paragraph id="HBA8257D2FA504B0E8537479F493F9985"><enum>(1)</enum><header>Establishment</header><text>Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/98">chapter 98</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H8878CDC64B034D0587FF1E5D80C84D80" style="OLC">
						<section id="HF7D070CE1BCE492980C2E07D7C58E193"><enum>9512.</enum><header>Opportunity trust fund</header>
 <subsection id="H93A610EDF44B42B89BC1F6BD93CE4F9D"><enum>(a)</enum><header>Creation of Trust Fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a trust fund to be known as the <quote>Opportunity Trust Fund</quote> (referred to in this section as the <quote>Trust Fund</quote>), consisting of such amounts as may be appropriated or credited to such fund as provided in this section or section 9602(b).</text>
 </subsection><subsection id="H7C77B8DD92854CBBB7CB1A794E81DB8D"><enum>(b)</enum><header>Transfers to Trust Fund</header><text display-inline="yes-display-inline">There are hereby appropriated to the Trust Fund amounts equivalent to the net revenues received in the Treasury from the tax imposed by section 5701(h).</text>
 </subsection><subsection commented="no" id="HD26C6D476DCC41E1B55D44CB7D33E984"><enum>(c)</enum><header>Expenditures</header><text display-inline="yes-display-inline">Amounts in the Trust Fund shall be available, without further appropriation, only as follows:</text> <paragraph id="H04F6BD89902A46409408994C4B499605"><enum>(1)</enum><text>50 percent to the Attorney General to carry out section 3052(a) of part OO of the Omnibus Crime Control and Safe Streets Act of 1968.</text>
 </paragraph><paragraph id="H6D6944EE5DA74C69B174305FE9669F00"><enum>(2)</enum><text display-inline="yes-display-inline">10 percent to the Attorney General to carry out section 3052(b) of part OO of the Omnibus Crime Control and Safe Streets Act of 1968.</text>
 </paragraph><paragraph id="H837EA08225274E75BA54BB1978C4C3F1"><enum>(3)</enum><text display-inline="yes-display-inline">20 percent to the Administrator of the Small Business Administration to carry out section 5(b)(1) of the <short-title>Marijuana Opportunity Reinvestment and Expungement Act of 2019</short-title>.</text>
 </paragraph><paragraph id="H0501DB074935448D8AEC5B7A8B1FCB7B"><enum>(4)</enum><text display-inline="yes-display-inline">20 percent to the Administrator of the Small Business Administration to carry out section 5(b)(2) of the <short-title>Marijuana Opportunity Reinvestment and Expungement Act of 2019</short-title>.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HD4B59C18A8ED4A8C90339931DDDDBA20"><enum>(2)</enum><header>Clerical Amendment</header><text display-inline="yes-display-inline">The table of sections for subchapter A of chapter 98 of such Code is amended by adding at the end the following new item:</text>
					<quoted-block display-inline="no-display-inline" id="HD3A3B7E7B7E54F2DB767580F214486A9" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 9512. Opportunity trust fund.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H48A8F8524BF84DE7A0D4473A9DCFDC9A"><enum>(b)</enum><header>Imposition of tax</header>
 <paragraph id="HDB42FF1075D84661A8797414FD8F3156"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5701">Section 5701</external-xref> of the Internal Revenue Code of 1986 is amended by redesignating subsection (h) as subsection (i) and by inserting after subsection (g) the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HE0A92EAAD30740D49112159DD3154E69" style="OLC">
 <subsection id="H0D3123555360459DAC6BFE76A247291E"><enum>(h)</enum><header>Cannabis products</header><text display-inline="yes-display-inline">On cannabis products, manufactured in or imported into the United States, there shall be imposed a tax equal to 5 percent of the price for which sold.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H56AE91F52F4841BBA7E5D3C581E4DF2A"><enum>(2)</enum><header>Cannabis product defined</header><text>Section 5702 of such Code is amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="HD730FC8D93594B778810B88C6C61609E" style="OLC"> <subsection id="H2B11CDA0398A4EEBB5F6618DE8E6AFAA"><enum>(q)</enum><header>Cannabis product</header> <paragraph id="H93B39E91B5A34F7B87E7E57AFE578808"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the term <term>cannabis product</term> means any cannabis or any article which contains cannabis or any derivative thereof.</text>
 </paragraph><paragraph id="H5B495113F38C42659AAA7DAD98AB4699"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The term <term>cannabis product</term> shall not include any medicine or drug that is a prescribed drug (as such term is defined in section 213(d)(3)).</text>
 </paragraph><paragraph commented="no" id="HFEA109C9AD6A4CFDBE7BB906BF4E0490"><enum>(3)</enum><header>Cannabis</header><text>The term <term>cannabis</term>—</text> <subparagraph commented="no" id="HEB7E8F8217D34C99A1BC9218BAB30D4D"><enum>(A)</enum><text display-inline="yes-display-inline">means all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin; and</text>
 </subparagraph><subparagraph commented="no" id="H0EE0B7B645F74FF89FB36886A61AE0B7"><enum>(B)</enum><text display-inline="yes-display-inline">does not include—</text> <clause commented="no" id="H3812D85F8012480C9DD3F5114BD6AD03"><enum>(i)</enum><text>hemp, as defined in section 297A of the Agricultural Marketing Act of 1946; or</text>
 </clause><clause commented="no" id="H0BF0D01EE02D46C687EF2D6543D776DF"><enum>(ii)</enum><text>the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil, or cake, or the sterilized seed of such plant which is incapable of germination.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H06FD83B2D77943CABE4666D70C0B8DFC"><enum>(3)</enum><header>Cannabis products treated as tobacco products</header><text>Section 5702(c) of such Code is amended by striking <quote>and roll-your-own tobacco</quote> and inserting <quote>roll-your-own tobacco, and cannabis products</quote>.</text> </paragraph><paragraph id="HA2F1B73E0AB24454B7BA24858BC91B47"><enum>(4)</enum><header>Manufacturer of cannabis products treated as manufacturer of tobacco products</header><text>Section 5702 of such Code is amended by adding at the end the following new subsection:</text>

						<subsection id="HB0C1DC2F37B9448788B694CC3A760A29"><enum>(r)</enum><header>Manufacturer of cannabis products</header>
 <paragraph id="HA2ECB08EEC054A2F8D4FE7E060D7E4E1"><enum>(1)</enum><header>In general</header><text>Any person who plants, cultivates, harvests, produces, manufactures, compounds, converts, processes, prepares, or packages any cannabis product shall be treated as a manufacturer of cannabis products (and as manufacturing such cannabis product).</text>
 </paragraph><paragraph id="HBBE68D0822B446CD855700ACAC6E33DE"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply with respect to any cannabis product which is for such person’s own personal consumption or use.</text>
 </paragraph><paragraph id="HC178645719704ABE9268090F9D52FDB5"><enum>(3)</enum><header>Application of rules related to manufacturers of tobacco products</header><text>Any reference to a manufacturer of tobacco products, or to manufacturing tobacco products, shall be treated as including a reference to a manufacturer of cannabis products, or to manufacturing cannabis products, respectively.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H793465B1C01C4DBCAC9454786F63E433"><enum>(5)</enum><header>Application of certain rules for determining price</header><text>Section 5702(l) of such Code is amended—</text> <subparagraph id="HE38F86A6849B47F7985AE722F29D1130"><enum>(A)</enum><text>by striking <quote>section 5701(a)(2)</quote> and inserting <quote>subsections (a)(2) and (h) of section 5701</quote>; and</text>
 </subparagraph><subparagraph id="H0678855ABBDE410D8EB109A0977FE173"><enum>(B)</enum><text>by inserting <quote><header-in-text level="subsection" style="OLC">and cannabis products</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">cigars</header-in-text></quote> in the heading thereof.</text> </subparagraph></paragraph><paragraph commented="no" id="H9B7CDE74D7BF459EA8F50871C1A3164A"><enum>(6)</enum><header>Conforming amendment</header><text>Section 5702(j) of such Code is amended by adding at the end the following new sentence: <quote>In the case of a cannabis product, the previous sentence shall be applied by substituting <quote>from a facility of a manufacturer required to file a bond under section 5711</quote> for <quote>from the factory or from internal revenue bond under section 5704</quote>.</quote>.</text>
				</paragraph></subsection><subsection id="H346640D659C940489F2B527D3F16E936"><enum>(c)</enum><header>Effective date</header>
 <paragraph id="H837A7AFFAE824C38B63C19CDA15C3729"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided in this subsection, the amendments made by this section shall apply to articles manufactured or imported in calendar quarters beginning more than one year after the date of the enactment of this Act.</text>
 </paragraph><paragraph id="H2B3CCC7F3BB0432BA95D16F35A5861C6"><enum>(2)</enum><header>Trust fund</header><text>The amendments made by subsection (a) shall take effect on the date of the enactment of this Act.</text> </paragraph></subsection></section><section id="H13B49A363B974029989170B1156FA386"><enum>5.</enum><header>Opportunity trust fund programs</header> <subsection id="H9EFC2835AD654429BBAB216D63B8E949"><enum>(a)</enum><header>Cannabis Justice Office; community reinvestment grant program</header> <paragraph id="H059264BEB3FA407888EC02BBE582B03C"><enum>(1)</enum><header>Cannabis Justice Office</header><text>Part A of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10101">34 U.S.C. 10101</external-xref> et seq.) is amended by inserting after section 109 the following:</text>
					<quoted-block display-inline="no-display-inline" id="H66F071BE88C647A78F66677664004E9E" style="OLC">
						<section id="HCDE9EF151847453DAEDCF490EDDEA68F"><enum>110.</enum><header>Cannabis justice office</header>
 <subsection id="H000727EF1C1B409D97BF83A3E72DEB1A"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within the Office of Justice Programs a Cannabis Justice Office.</text> </subsection><subsection id="H34C618F7C80A47038EC287A420666730"><enum>(b)</enum><header>Director</header><text display-inline="yes-display-inline">The Cannabis Justice Office shall be headed by a Director who shall be appointed by the Assistant Attorney General for the Office of Justice Programs. The Director shall report to the Assistant Attorney General for the Office of Justice Programs. The Director shall award grants and may enter into compacts, cooperative agreements, and contracts on behalf of the Cannabis Justice Office. The Director may not engage in any employment other than that of serving as the Director, nor may the Director hold any office in, or act in any capacity for, any organization, agency, or institution with which the Office makes any contract or other arrangement.</text>
							</subsection><subsection id="H353352EBE663414980C2734543ABA06A"><enum>(c)</enum><header>Employees</header>
 <paragraph id="H8C6AC93FE4A348A09FE617F09D0D7EE9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall employ as many full-time employees as are needed to carry out the duties and functions of the Cannabis Justice Office under subsection (d). Such employees shall be exclusively assigned to the Cannabis Justice Office.</text>
 </paragraph><paragraph id="H6F46BE19478A429F8A1F1B2358E15075"><enum>(2)</enum><header>Initial hires</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this section, the Director shall—</text> <subparagraph id="HFAE8CF9E283341D19145EFE07F2E1C61"><enum>(A)</enum><text display-inline="yes-display-inline">hire no less than one-third of the total number of employees of the Cannabis Justice Office; and</text>
 </subparagraph><subparagraph id="HD9F325FC7412459F9BCE07C07DAF26B2"><enum>(B)</enum><text display-inline="yes-display-inline">no more than one-half of the employees assigned to the Cannabis Justice Office by term appointment that may after 2 years be converted to career appointment.</text>
 </subparagraph></paragraph><paragraph id="HFCB1559039104057921F212FA6D920DF"><enum>(3)</enum><header>Legal counsel</header><text display-inline="yes-display-inline">At least one employee hired for the Cannabis Justice Office shall serve as legal counsel to the Director and shall provide counsel to the Cannabis Justice Office.</text>
 </paragraph></subsection><subsection id="HB81452DEDE8242ED8081CD8E44322A3F"><enum>(d)</enum><header>Duties and Functions</header><text>The Cannabis Justice Office is authorized to—</text> <paragraph id="H9F07B2AD3ACA4C8791B47268ADAA9C86"><enum>(1)</enum><text>administer the Community Reinvestment Grant Program; and</text>
 </paragraph><paragraph id="HEA96D29661054FF2B6FBC80E6EA5E886"><enum>(2)</enum><text display-inline="yes-display-inline">perform such other functions as the Assistant Attorney General for the Office of Justice Programs may delegate, that are consistent with the statutory obligations of this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H60833048A7DE4B8898DA3E996045F69C"><enum>(2)</enum><header>Community Reinvestment Grant Program</header><text>Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (34 U.S.C. et seq.) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H7C1516A965A34DB0B56EC83D818FA01A" style="OLC">
						<part id="HE3032A1401014E989314AE8F2100A566"><enum>OO</enum><header>Community Reinvestment Grant Program</header>
							<section id="H4DF39165EDC24306B0382CBBB13FF954"><enum>3052.</enum><header>Authorization</header>
 <subsection id="H9C5C0D9D4B7140F9B2404AFED78B83FA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Cannabis Justice Office shall establish and carry out a grant program, known as the <quote>Community Reinvestment Grant Program</quote>, to provide eligible entities with funds to administer services for individuals most adversely impacted by the War on Drugs, including—</text>
 <paragraph id="H439F5F562FD04C98BB8A429BEA8953A3"><enum>(1)</enum><text>job training;</text> </paragraph><paragraph id="HB85A139B64D34AE0A25D7800B1B84844"><enum>(2)</enum><text>reentry services;</text>
 </paragraph><paragraph id="H0FA70E8DFB244546A2C01A5AD941E552"><enum>(3)</enum><text>legal aid for civil and criminal cases, including expungement of cannabis convictions;</text> </paragraph><paragraph id="H2E7E5E8853F044C69EA53702BE565EAC"><enum>(4)</enum><text>literacy programs;</text>
 </paragraph><paragraph id="HE3ACBB80658745348F4E99723A43D521"><enum>(5)</enum><text>youth recreation or mentoring programs; and</text> </paragraph><paragraph id="HFCBECBAE96424F9EA1ECE7F932E53623"><enum>(6)</enum><text>health education programs.</text>
 </paragraph></subsection><subsection id="HAEB101A733A942F193C93D70239BCF9B"><enum>(b)</enum><header>Substance use treatment services</header><text display-inline="yes-display-inline">The Community Reinvestment Grant Program established in subsection (a) shall provide eligible entities with funds to administer substance use treatment services for individuals most adversely impacted by the War on Drugs.</text>
 </subsection></section><section commented="no" id="HC3EB9CD5B148407AAF3378247ADEE67F"><enum>3053.</enum><header>Funding from opportunity trust fund</header><text display-inline="no-display-inline">The Director shall carry out the program under this part using funds made available under section 9512(c)(1) and (2) of the Internal Revenue Code.</text>
 </section><section id="H55F8BC85C78C43C6BD7D4656F03CDF20"><enum>3054.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text> <paragraph id="H004CC5C5B1C2431FBA6A5E2D911F5B52"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>cannabis conviction</term> means a conviction, or adjudication of juvenile delinquency, for a cannabis offense (as such term is defined in section 12(2) of the <short-title>Marijuana Opportunity Reinvestment and Expungement Act of 2019</short-title>).</text>
 </paragraph><paragraph id="H7ED2958C574C49C28875CA5C74788419"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>substance use treatment</term> means an evidence-based, professionally directed, deliberate, and planned regimen including evaluation, observation, medical monitoring, harm reduction, and rehabilitative services and interventions such as pharmacotherapy, mental health services, and individual and group counseling, on an inpatient or outpatient basis, to help patients with substance use disorder reach remission and maintain recovery.</text>
 </paragraph><paragraph id="H77AA2BEE75CD4D389AD8B9FB7B3ACCD0"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>eligible entity</term> means a nonprofit organization, as defined in section 501(c)(3) of the Internal Revenue Code, that is representative of a community or a significant segment of a community with experience in providing relevant services to individuals most adversely impacted by the War on Drugs in that community.</text>
 </paragraph><paragraph id="H3894A6E7D02044538BCE66FCE5804D18"><enum>(4)</enum><text>The term <term>individuals most adversely impacted by the War on Drugs</term> has the meaning given that term in section 5 of the <short-title>Marijuana Opportunity Reinvestment and Expungement Act of 2019</short-title>.</text></paragraph></section></part><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection display-inline="no-display-inline" id="H90DBAAF81BDA4832AFBFE599B9E3056A"><enum>(b)</enum><header>Cannabis opportunity program; equitable licensing grant program</header> <paragraph id="H63A29A5F4FA4405299130129CD50F367"><enum>(1)</enum><header>Cannabis Opportunity Program</header><text>The Administrator of the Small Business Administration shall establish and carry out a program, to be known as the <quote>Cannabis Opportunity Program</quote> to provide any eligible State or locality funds to make loans under section 7(m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/363">15 U.S.C. 363(m)</external-xref>) to assist small business concerns owned and controlled by socially and economically disadvantaged individuals, as defined in section 8(d)(3)(C) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(d)(3)(C)</external-xref>) that operate in the cannabis industry.</text>
 </paragraph><paragraph id="H3DE03D1332EB447DBD330D5542725A25"><enum>(2)</enum><header>Equitable Licensing Grant Program</header><text>The Administrator of the Small Business Administration shall establish and carry out a grant program, to be known as the <quote>Equitable Licensing Grant Program</quote>, to provide any eligible State of locality funds to develop and implement equitable cannabis licensing programs that minimize barriers to cannabis licensing and employment for individuals most adversely impacted by the War on Drugs, provided that each grantee includes in its cannabis licensing program at least four of the following:</text>
 <subparagraph id="HB5F96A358ECA4C609FDD069424E99277"><enum>(A)</enum><text display-inline="yes-display-inline">A waiver of cannabis license application fees for individuals who have had an income below 250 percent of the Federal Poverty Level for at least 5 of the past 10 years who are first-time applicants.</text>
 </subparagraph><subparagraph id="H970155496EAA4B3DB0066A82612636C5"><enum>(B)</enum><text>A prohibition on the denial of a cannabis license based on a conviction for a cannabis offense that took place prior to State legalization of cannabis or the date of enactment of this Act, as appropriate.</text>
 </subparagraph><subparagraph id="HECFE9026554A44CDB17956039C32950F"><enum>(C)</enum><text>A prohibition on criminal conviction restrictions for licensing except with respect to a conviction related to owning and operating a business.</text>
 </subparagraph><subparagraph id="HFCCAA246F1834116A53BEFF7E2EFAD4C"><enum>(D)</enum><text>A prohibition on cannabis license holders engaging in suspicionless cannabis drug testing of their prospective or current employees, except with respect to drug testing for safety-sensitive positions, as defined under the Omnibus Transportation Testing Act of 1991.</text>
 </subparagraph><subparagraph id="H357B6AD1B48547DEA88AE7D5BCEB30BE"><enum>(E)</enum><text>The establishment of a cannabis licensing board that is reflective of the racial, ethnic, economic, and gender composition of the State or locality, to serve as an oversight body of the equitable licensing program.</text>
 </subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HD57F3CC1C9494EAF81341D8D7506907A"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H4433D24F3E9F4AFC8F41BFA09D57EC74"><enum>(A)</enum><text>The term <term>individual most adversely impacted by the War on Drugs</term> means an individual—</text>
 <clause id="H41F999E29B754DA89A25454C58C0CF61"><enum>(i)</enum><text>who has had an income below 250 percent of the Federal Poverty Level for at least 5 of the past 10 years; and</text>
 </clause><clause id="H8F9C74C491FA4A52B15878CE655D396A"><enum>(ii)</enum><text>has been arrested for or convicted of the sale, possession, use, manufacture, or cultivation of cannabis or a controlled substance (except for a conviction involving distribution to a minor), or whose parent, sibling, spouse, or child has been arrested for or convicted of such an offense.</text>
 </clause></subparagraph><subparagraph id="HFADF815BE5D44B9A9E8A75D80A80FB2D"><enum>(B)</enum><text>The term <term>eligible State or locality</term> means a State or locality that has taken steps to—</text> <clause id="H0576A41292B848A7ABB7E2DF2DD76123"><enum>(i)</enum><text>create an automatic process, at no cost to the individual, for the expungement, destruction, or sealing of criminal records for cannabis offenses; and</text>
 </clause><clause id="H863DB33EE8E941F2A87CE4DCFFE1191B"><enum>(ii)</enum><text>eliminate violations or other penalties for persons under parole, probation, pre-trial, or other State or local criminal supervision for a cannabis offense.</text>
 </clause></subparagraph><subparagraph id="HF9763F5BC3D24BB6BD4F4A3DACD554DB"><enum>(C)</enum><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, Puerto Rico, any territory or possession of the United States, and any Indian Tribe (as defined in section 201 of <external-xref legal-doc="public-law" parsable-cite="pl/90/294">Public Law 90–294</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/25/1301">25 U.S.C. 1301</external-xref>) (commonly known as the <quote>Indian Civil Rights Act of 1968</quote>)).</text>
					</subparagraph></paragraph></subsection></section><section id="HF4F778884C164D398C6CA4076B882181" section-type="subsequent-section"><enum>6.</enum><header>Availability of Small Business Administration programs and services to cannabis-related legitimate
			 businesses and service providers</header>
 <subsection id="HF8C898CCE793426DAF0541FA43A3C190"><enum>(a)</enum><header>Definitions relating to cannabis-Related legitimate businesses and service providers</header><text>Section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HAC447CC171EB4C3E8FAEF5DE394D493D" style="OLC">
 <subsection commented="no" id="HA061388A10A94B4BA5D269598037E22C"><enum>(ff)</enum><header>Cannabis-Related legitimate businesses and service providers</header><text display-inline="yes-display-inline">In this Act:</text> <paragraph commented="no" id="H355BAB20D2B44E89A78B807A88FA48AC"><enum>(1)</enum><header>Cannabis</header><text>The term <term>cannabis</term>—</text>
 <subparagraph commented="no" id="H2C3444E77E33463D9EDF2A5E27882991"><enum>(A)</enum><text display-inline="yes-display-inline">means all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin; and</text>
 </subparagraph><subparagraph commented="no" id="HEEDF5E43B6C64916881B7E6BB80D7DCE"><enum>(B)</enum><text display-inline="yes-display-inline">does not include—</text> <clause commented="no" id="HBC141CDE25C74A56AA2C5E505AF225FD"><enum>(i)</enum><text>hemp, as defined in section 297A of the Agricultural Marketing Act of 1946; or</text>
 </clause><clause commented="no" id="H5CDB264880A94E7B8C9AD2019758D546"><enum>(ii)</enum><text>the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil, or cake, or the sterilized seed of such plant which is incapable of germination.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" id="H82CF6893CC8B496AA0C0EDF7F0C47E07"><enum>(2)</enum><header>Cannabis-Related Legitimate Business</header><text>The term <term>cannabis-related legitimate business</term> means a manufacturer, producer, or any person or company that is a small business concern and that—</text>
 <subparagraph commented="no" id="H78765417DD224900A2C6E20A395517C1"><enum>(A)</enum><text display-inline="yes-display-inline">engages in any activity described in subparagraph (B) pursuant to a law established by a State or a political subdivision of a State, as determined by such State or political sub-division; and</text>
 </subparagraph><subparagraph commented="no" id="HDF0B7C7B5C894127B5A45553077EC6D3"><enum>(B)</enum><text>participates in any business or organized activity that involves handling cannabis or cannabis products, including cultivating, producing, manufacturing, selling, transporting, displaying, dispensing, distributing, or purchasing cannabis or cannabis products.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H1C019EF066764627AAC8CABD2F6E29B0"><enum>(3)</enum><header>Service provider</header><text display-inline="yes-display-inline">The term <term>service provider</term>—</text> <subparagraph commented="no" id="HEC5E92DAF09C447199AFF5C4E3E02BB4"><enum>(A)</enum><text>means a business, organization, or other person that—</text>
 <clause commented="no" id="HF7A3B2C20001405F95ACC61187C24FC9"><enum>(i)</enum><text>sells goods or services to a cannabis-related legitimate business; or</text> </clause><clause commented="no" id="H1229468C50E14D48B964B7D5C8D7AF57"><enum>(ii)</enum><text>provides any business services, including the sale or lease of real or any other property, legal or other licensed services, or any other ancillary service, relating to cannabis; and</text>
 </clause></subparagraph><subparagraph commented="no" id="H940B808406AF4B3B914BB94B157C5BE2"><enum>(B)</enum><text>does not include a business, organization, or other person that participates in any business or organized activity that involves handling cannabis or cannabis products, including cultivating, producing, manufacturing, selling, transporting, displaying, dispensing, distributing, or purchasing cannabis or cannabis products.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H75ED14E35DD84EDD9A37766EB0BF84F4"><enum>(b)</enum><header>Small business development centers</header><text display-inline="yes-display-inline">Section 21(c) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(c)</external-xref>) is amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HA1553B71AA7842A68DE2D8DD3507FC8B" style="OLC">
 <paragraph id="HC93A17D7DC5C430D84CEF72369A7434F"><enum>(9)</enum><header>Services for cannabis-related legitimate businesses and service providers</header><text display-inline="yes-display-inline">A small business development center may not decline to provide services to an otherwise eligible small business concern under this section solely because such concern is a cannabis-related legitimate business or service provider.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H53912DEE686148539C8F8E7EE6EF5ECC"><enum>(c)</enum><header>Women’s business centers</header><text display-inline="yes-display-inline">Section 29 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C. 656</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HC57AC364E7D84835A5FD1913B57A355B" style="OLC">
 <subsection id="HC2F6A19E667D4A34BE84BC0B51788584"><enum>(p)</enum><header>Services for cannabis-Related legitimate businesses and service providers</header><text display-inline="yes-display-inline">A women’s business center may not decline to provide services to an otherwise eligible small business concern under this section solely because such concern is a cannabis-related legitimate business or service provider.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H29C21BE6160644DD87504E4863380B65"><enum>(d)</enum><header>SCORE</header><text display-inline="yes-display-inline">Section 8(b)(1)(B) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(b)(1)(B)</external-xref>) is amended by adding at the end the following new sentence: <quote>The head of the SCORE program established under this subparagraph may not decline to provide services to an otherwise eligible small business concern solely because such concern is a cannabis-related legitimate business or service provider.</quote>.</text>
 </subsection><subsection id="H53E73108342D4ECA996AA60A1AAD51AD"><enum>(e)</enum><header>Veteran Business Outreach Centers</header><text display-inline="yes-display-inline">Section 32 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657b">15 U.S.C. 657b</external-xref>) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HC29AA5048FAD41CBBDDB49AAF0C77D41" style="OLC">
 <subsection id="HAADB1696AD724B9A9129EC9C400DF53D"><enum>(h)</enum><header>Services for cannabis-Related legitimate businesses and service providers</header><text display-inline="yes-display-inline">A Veteran Business Outreach Center may not decline to provide services to an otherwise eligible small business concern under this section solely because such concern is a cannabis-related legitimate business or service provider.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H020A2B43D7F444A9AB2FE3B16B5A0CD3"><enum>(f)</enum><header><enum-in-header>7(a)</enum-in-header> loans</header><text display-inline="yes-display-inline">Section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>

 </subsection><subsection id="H06B98C602DA842408208684B23668FAC"><enum>(g)</enum><header>Disaster loans</header><text>Section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) is amended by inserting after paragraph (15) the following new paragraph:</text>

 </subsection><subsection id="H2FB3A55FA18B40228C79ABF2E86EF2D3"><enum>(h)</enum><header>Microloans</header><text>Section 7(m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)</external-xref>) is amended by adding at the end the following new paragraph:</text>

 <paragraph id="H2B56FE4FD15E43EE925A5B869DA7C857"><enum>(14)</enum><header>Assistance to cannabis-related legitimate businesses and service providers</header><text display-inline="yes-display-inline">An eligible intermediary may not decline to provide assistance under this subsection to an otherwise eligible borrower solely because such borrower is a cannabis-related legitimate business or service provider.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H1A8F1A1BFD4E456C8093C6FD3220A2AF"><enum>(i)</enum><header>State or local development company loans</header><text>Title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695</external-xref> et seq.) is amended by adding at the end the following new section:</text>

 <section id="HD9E74176EB65415A9023751822353BE9"><enum>511.</enum><header>Loans to cannabis-related legitimate businesses and service providers</header><text display-inline="no-display-inline">The Administrator may not decline to provide a guarantee for a loan under this title to an otherwise eligible State or local development company solely because such State or local development company provides financing to an entity that is a cannabis-related legitimate business or service provider (as defined in section 3(ff) of the Small Business Act).</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HF55B32DF461241F4A27895A25E1B7C8C"><enum>7.</enum><header>No discrimination in the provision of a federal public benefit on the basis of cannabis</header>
 <subsection id="HEC9F67A26D674C93A2066A190FD28672"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No person may be denied any Federal public benefit (as such term is defined in section 401(c) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1611">8 U.S.C. 1611(c)</external-xref>)) on the basis of any use or possession of cannabis, or on the basis of a conviction or adjudication of juvenile delinquency for a cannabis offense, by that person.</text>
 </subsection><subsection id="H22D8279742104F5598E448F7051CCFF6"><enum>(b)</enum><header>Security clearances</header><text>Federal agencies may not use past or present cannabis or marijuana use as criteria for granting, denying, or rescinding a security clearance.</text>
			</subsection></section><section id="H86081B3E501E418DBBCDD5A2112ECAC5"><enum>8.</enum><header>No adverse effect for purposes of the immigration laws</header>
 <subsection id="H4981323D160A470DADB74F98D0826257"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act), cannabis may not be considered a controlled substance, and an alien may not be denied any benefit or protection under the immigration laws based on any event, including conduct, a finding, an admission, addiction or abuse, an arrest, a juvenile adjudication, or a conviction, relating to cannabis, regardless of whether the event occurred before, on, or after the effective date of this Act.</text>
 </subsection><subsection commented="no" id="H9A5FCCF5DE8448D780BC8D04A7FF4171"><enum>(b)</enum><header>Cannabis defined</header><text>The term <term>cannabis</term>—</text> <paragraph commented="no" id="H2ABDEA1F9B8546A4A28A3C2628C941A5"><enum>(1)</enum><text display-inline="yes-display-inline">means all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture, or preparation of such plant, its seeds or resin; and</text>
 </paragraph><paragraph commented="no" id="H9259CEC9C6464368955D048C5E015257"><enum>(2)</enum><text display-inline="yes-display-inline">does not include—</text> <subparagraph commented="no" id="H842539BCAD3A40A68C63BEEE252060D0"><enum>(A)</enum><text>hemp, as defined in section 297A of the Agricultural Marketing Act of 1946; or</text>
 </subparagraph><subparagraph commented="no" id="HF0A6C3C44C1A46A4B49D07221A0149BB"><enum>(B)</enum><text>the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil, or cake, or the sterilized seed of such plant which is incapable of germination.</text>
 </subparagraph></paragraph></subsection><subsection id="H2EC05A2175044828B90FEB29CCB75357"><enum>(c)</enum><header>Conforming amendments to immigration and nationality act</header><text display-inline="yes-display-inline">The Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.) is amended—</text> <paragraph id="H5DEA1A7E2BF64FCBA3F2B56643D155DD"><enum>(1)</enum><text>in section 212(h), by striking <quote>and subparagraph (A)(i)(II) of such subsection insofar as it relates to a single offense of simple possession of 30 grams or less of marijuana</quote>;</text>
 </paragraph><paragraph id="HD3F6721B4F764BDEB0D8A73CE6B82424"><enum>(2)</enum><text>in section 237(a)(2)(B)(i), by striking <quote>other than a single offense involving possession for one’s own use of 30 grams or less of marijuana</quote>;</text> </paragraph><paragraph id="H6EE0EF9B3275493BAF7EA07710C4BA57"><enum>(3)</enum><text>in section 101(f)(3), by striking <quote>(except as such paragraph relates to a single offense of simple possession of 30 grams or less of marihuana)</quote>;</text>
 </paragraph><paragraph id="HC96889AF08274A78977D04A6B689E062"><enum>(4)</enum><text>in section 244(c)(2)(A)(iii)(II) by striking <quote>except for so much of such paragraph as relates to a single offense of simple possession of 30 grams or less of marijuana</quote>;</text>
 </paragraph><paragraph id="H47F3FF4F078A4A368AA297B90B9A0BEB"><enum>(5)</enum><text>in section 245(h)(2)(B) by striking <quote>(except for so much of such paragraph as related to a single offense of simple possession of 30 grams or less of marijuana)</quote>;</text>
 </paragraph><paragraph id="H815E6C973F814F20879E77BAE2F6CD2B"><enum>(6)</enum><text display-inline="yes-display-inline">in section 210(c)(2)(B)(ii)(III) by striking <quote>, except for so much of such paragraph as relates to a single offense of simple possession of 30 grams or less of marihuana</quote>; and</text>
 </paragraph><paragraph id="HCB8AD7AAB2FC4E9C8B4C558F2F7E3B15"><enum>(7)</enum><text display-inline="yes-display-inline">in section 245A(d)(2)(B)(ii)(II) by striking <quote>, except for so much of such paragraph as relates to a single offense of simple possession of 30 grams or less of marihuana</quote>.</text>
				</paragraph></subsection></section><section id="HC4FC91737D5547399CEA2D45E1A980F1"><enum>9.</enum><header>Resentencing and expungement</header>
			<subsection commented="no" id="H5D327BCC790C48F28D22D567BE690AF9"><enum>(a)</enum><header>Expungement of Federal cannabis offense convictions for individuals not under a criminal justice
			 sentence</header>
 <paragraph commented="no" id="HAED30F8A6431441D89E32464E1E953FB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, each Federal district shall conduct a comprehensive review and issue an order expunging each conviction or adjudication of juvenile delinquency for a Federal cannabis offense entered by each Federal court in the district before the date of enactment of this Act and on or after May 1, 1971. Each Federal court shall also issue an order expunging any arrests associated with each expunged conviction or adjudication of juvenile delinquency.</text>
 </paragraph><paragraph commented="no" id="H4B2F06B648F34764A08D950E15809D84"><enum>(2)</enum><header>Notification</header><text display-inline="yes-display-inline">To the extent practicable, each Federal district shall notify each individual whose arrest, conviction, or adjudication of delinquency has been expunged pursuant to this subsection that their arrest, conviction, or adjudication of juvenile delinquency has been expunged, and the effect of such expungement.</text>
 </paragraph><paragraph id="H1DFD1791D8604378859325570CCF99BD"><enum>(3)</enum><header>Right to petition court for expungement</header><text display-inline="yes-display-inline">At any point after the date of enactment of this Act, any individual with a prior conviction or adjudication of juvenile delinquency for a Federal cannabis offense, who is not under a criminal justice sentence, may file a motion for expungement. If the expungement of such a conviction or adjudication of juvenile delinquency is required pursuant to this Act, the court shall expunge the conviction or adjudication, and any associated arrests. If the individual is indigent, counsel shall be appointed to represent the individual in any proceedings under this subsection.</text>
 </paragraph><paragraph id="H0431039605F3493A8A0CEE954955781E"><enum>(4)</enum><header>Sealed record</header><text>The court shall seal all records related to a conviction or adjudication of juvenile delinquency that has been expunged under this subsection. Such records may only be made available by further order of the court.</text>
				</paragraph></subsection><subsection id="H7E6C288315C94F79A482DB81CEA095B5"><enum>(b)</enum><header>Sentencing review for individuals under a criminal justice sentence</header>
 <paragraph id="HBD8F34D8CDC94BE686C6CF44FF5EB0AD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For any individual who is under a criminal justice sentence for a Federal cannabis offense, the court that imposed the sentence shall, on motion of the individual, the Director of the Bureau of Prisons, the attorney for the Government, or the court, conduct a sentencing review hearing. If the individual is indigent, counsel shall be appointed to represent the individual in any sentencing review proceedings under this subsection.</text>
 </paragraph><paragraph id="HB3C433C177174CBAB0C5020F8DC3F4BA"><enum>(2)</enum><header>Potential reduced resentencing</header><text>After a sentencing hearing under paragraph (1), a court shall—</text> <subparagraph id="HD747DEDEDAB04FF9BA225D0C9128E82A"><enum>(A)</enum><text display-inline="yes-display-inline">expunge each conviction or adjudication of juvenile delinquency for a Federal cannabis offense entered by the court before the date of enactment of this Act, and any associated arrest;</text>
 </subparagraph><subparagraph id="HB46E6D15B465462E82CFEF3545B44688"><enum>(B)</enum><text>vacate the existing sentence or disposition of juvenile delinquency and, if applicable, impose any remaining sentence or disposition of juvenile delinquency on the individual as if this Act, and the amendments made by this Act, were in effect at the time the offense was committed; and</text>
 </subparagraph><subparagraph commented="no" id="HA5915E15FCCC467787782E92D43C87D5"><enum>(C)</enum><text display-inline="yes-display-inline">order that all records related to a conviction or adjudication of juvenile delinquency that has been expunged or a sentence or disposition of juvenile delinquency that has been vacated under this Act be sealed and only be made available by further order of the court.</text>
 </subparagraph></paragraph></subsection><subsection id="HED48F54D32134BB7BD57CD58B6375C13"><enum>(c)</enum><header>Effect of expungement</header><text display-inline="yes-display-inline">An individual who has had an arrest, a conviction, or juvenile delinquency adjudication expunged under this section—</text>
 <paragraph id="HA760519727174E9D96B75F4BE2B6A8DC"><enum>(1)</enum><text>may treat the arrest, conviction, or adjudication as if it never occurred; and</text> </paragraph><paragraph id="H6AFB07B6AE1941F6986CA07B407D4F64"><enum>(2)</enum><text display-inline="yes-display-inline">shall be immune from any civil or criminal penalties related to perjury, false swearing, or false statements, for a failure to disclose such arrest, conviction, or adjudication.</text>
 </paragraph></subsection><subsection id="HCF5C6085D4AD4DDFA6AF16730941303B"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph commented="no" id="H20E2AFB31D7944298B19C7E2A66464A4"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>Federal cannabis offense</term> means an offense that is no longer punishable pursuant to this Act or the amendments made under this Act.</text>
 </paragraph><paragraph id="HA38C00D589844AA5B02458EB0D8B859F"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>expunge</term> means, with respect to an arrest, a conviction, or a juvenile delinquency adjudication, the removal of the record of such arrest, conviction, or adjudication from each official index or public record.</text>
 </paragraph><paragraph id="HBC84B8F0D9204AD7B1186939D011ED6E"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>under a criminal justice sentence</term> means, with respect to an individual, that the individual is serving a term of probation, parole, supervised release, imprisonment, official detention, pre-release custody, or work release, pursuant to a sentence or disposition of juvenile delinquency imposed on or after the effective date of the Controlled Substances Act (May 1, 1971).</text>
 </paragraph></subsection></section><section id="H86ECCA69B4F442789E3FF3CD8DD8AEB7"><enum>10.</enum><header>References in existing law to marijuana or marihuana</header><text display-inline="no-display-inline">Wherever, in the statutes of the United States or in the rulings, regulations, or interpretations of various administrative bureaus and agencies of the United States—</text>
 <paragraph id="H74F5A6C347994B9F941AF4B37A23E02D"><enum>(1)</enum><text>there appears or may appear the term <term>marihuana</term> or <term>marijuana</term>, that term shall be struck and the term <term>cannabis</term> shall be inserted; and</text> </paragraph><paragraph id="H3A968A0AF215469792EEF6F228A566DE"><enum>(2)</enum><text>there appears or may appear the term <term>Marihuana</term> or <term>Marijuana</term>, that term shall be struck and the term <term>Cannabis</term> shall be inserted.</text>
 </paragraph></section><section id="H482D0415D539483DA7E366E0F3A42D6D"><enum>11.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or an amendment made by this Act, or any application of such provision to any person or circumstance, is held to be unconstitutional, the remainder of this Act, the amendments made by this Act, and the application of this Act and the amendments made by this Act to any other person or circumstance shall not be affected.</text>
 </section><section id="H9565F5FA1B8443B49E31B84ED7702D36"><enum>12.</enum><header>Cannabis offense defined</header><text display-inline="no-display-inline">For purposes of this Act, the term <term>cannabis offense</term> means a criminal offense related to cannabis—</text> <paragraph id="H7E7ECA607718495DAC56EDF9AD7D1EDA"><enum>(1)</enum><text display-inline="yes-display-inline">that, under Federal law, is no longer punishable pursuant to this Act or the amendments made under this Act; or</text>
 </paragraph><paragraph id="H1CBE996CEDD34D4B88B1F11CD1185004"><enum>(2)</enum><text display-inline="yes-display-inline">that, under State law, is no longer an offense or that was designated a lesser offense or for which the penalty was reduced under State law pursuant to or following the adoption of a State law authorizing the sale or use of cannabis.</text>
 </paragraph></section><section id="HA98734D32B224D75AD216DD062CAAEB8"><enum>13.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Unless otherwise provided in this Act, not later than 1 year after the date of enactment of this Act, the Department of the Treasury, the Department of Justice, and the Small Business Administration shall issue or amend any rules, standard operating procedures, and other legal or policy guidance necessary to carry out implementation of this Act. After the 1-year period, any publicly issued sub-regulatory guidance, including any compliance guides, manuals, advisories and notices, may not be issued without 60-day notice to appropriate congressional committees. Notice shall include a description and justification for additional guidance.</text></section></legis-body></bill>
