			 of the committee concerned</action-desc></action><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend the Native American Business Development, Trade Promotion, and Tourism Act of 2000, the
			 Buy Indian Act, and the Native American Programs Act of 1974 to provide
			 industry and economic development opportunities to Indian communities.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
 <section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Indian Community Economic Enhancement Act of 2019 </short-title></quote>.</text>
 </section><section commented="no" display-inline="no-display-inline" id="idc3be6b80-2301-41e0-b3d0-97f762a5dbed" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph commented="no" display-inline="no-display-inline" id="id77990f79-6f11-4c7d-8e0d-777e8d8970e6"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idc60d31bd-e13f-4af9-94bc-251dceef0846"><enum>(A)</enum><text display-inline="yes-display-inline">to bring industry and economic development to Indian communities, Indian Tribes must overcome a number of barriers, including—</text>
 <clause commented="no" display-inline="no-display-inline" id="id7be1eef0-b23d-450d-a1dc-7dd2d8f179e2" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">geographical location;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id12d6030d-c99f-4498-9cc4-95483a57c709" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">lack of infrastructure or capacity;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idefac2ac3-3279-4296-8b9e-3b0bcd78102e" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">lack of sufficient collateral and capital; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id67e7e127-773c-4103-8797-f6c55aa8297e" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">regulatory bureaucracy relating to—</text>
 <subclause commented="no" display-inline="no-display-inline" id="id4e2a2e18-c4aa-47e4-9fd5-47341487f9a6"><enum>(I)</enum><text display-inline="yes-display-inline">development; and</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="id9c4b933e-fd3b-418c-873f-6e2ab6074839"><enum>(II)</enum><text display-inline="yes-display-inline">access to services provided by the Federal Government; and</text>
 </subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb906a56c-73a8-4dbc-86e0-b69f50a07864" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the barriers described in subparagraph (A) often add to the cost of doing business in Indian communities;</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf8a41e12-b75c-4f52-8d37-a2f5d598d0ad"><enum>(2)</enum><text display-inline="yes-display-inline">Indian Tribes—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id8a033e34-9757-4f01-a939-d7c37fac73f5"><enum>(A)</enum><text display-inline="yes-display-inline">enact laws and exercise sovereign governmental powers;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25726134-2956-4c8a-8d49-170d569b10f0"><enum>(B)</enum><text display-inline="yes-display-inline">determine policy for the benefit of Tribal members; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9354d9a4-2711-441e-a927-85bf8c504d8f"><enum>(C)</enum><text display-inline="yes-display-inline">produce goods and services for consumers;</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67ca6380-e704-40c1-b403-8c2079b1b37a"><enum>(3)</enum><text display-inline="yes-display-inline">the Federal Government has—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id8d802e16-6c07-4d84-ab81-6c5024a35787"><enum>(A)</enum><text display-inline="yes-display-inline">an important government-to-government relationship with Indian Tribes; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3c44375a-cd88-437e-957c-a812041dd899"><enum>(B)</enum><text display-inline="yes-display-inline">a role in facilitating healthy and sustainable Tribal economies;</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8799f642-38b2-4abe-adbf-e6d923c5cf35"><enum>(4)</enum><text display-inline="yes-display-inline">the input of Indian Tribes in developing Federal policy and programs leads to more meaningful and effective measures to assist Indian Tribes and Indian entrepreneurs in building Tribal economies;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0e816e16-2147-4352-aab9-a9e54a3b815a"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idc8742569-e103-4ebe-9efe-ce9220aa4632"><enum>(A)</enum><text display-inline="yes-display-inline">many components of Tribal infrastructure need significant repair or replacement; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0e96de96-6109-434b-912b-7030ae08c6a5" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">access to private capital for projects in Indian communities—</text>
 <clause commented="no" display-inline="no-display-inline" id="id1f6f1bf9-8b82-4722-b476-baa1fa51f121"><enum>(i)</enum><text display-inline="yes-display-inline">may not be available; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="id2deb5f45-eaf4-48f1-8f7a-e9e0a2a1f23d"><enum>(ii)</enum><text display-inline="yes-display-inline">may come at a higher cost than such access for other projects;</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60e13ad0-7d93-4a18-ad40-7e860ed7db29"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id067d4754-1ef9-4a22-bdd2-830a56ba655f"><enum>(A)</enum><text display-inline="yes-display-inline">Federal capital improvement programs, such as those that facilitate tax-exempt bond financing and loan guarantees, are tools that help improve or replace crumbling infrastructure;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3f68142c-7562-48bd-8572-0ebe2cd94709" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">lack of parity in treatment of an Indian Tribe as a governmental entity under Federal tax and certain other regulatory laws impedes, in part, the ability of Indian Tribes to raise capital through issuance of tax exempt debt, invest as an accredited investor, and benefit from other investment incentives accorded to State and local governmental entities; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5de95489-9de1-4f16-9600-d28e8dad9ab9" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">as a result of the disparity in treatment of Indian Tribes described in subparagraph (B), investors may avoid financing, or demand a premium to finance, projects in Indian communities, making the projects more costly or inaccessible;</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9f92036f-894d-41ce-8ae5-387b267d8299"><enum>(7)</enum><text display-inline="yes-display-inline">there are a number of Federal loan guarantee programs available to facilitate financing of business, energy, economic, housing, and community development projects in Indian communities, and those programs may support public-private partnerships for infrastructure development, but improvements and support are needed for those programs specific to Indian communities to facilitate more effectively private financing for infrastructure and other urgent development needs; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id657ef742-6d08-48bc-a1bd-fd9df0ab2d9b"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id0712008e-8b88-4982-a2d7-b2174441103c"><enum>(A)</enum><text display-inline="yes-display-inline">most real property held by Indian Tribes is trust or restricted land that essentially cannot be held as collateral; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id780f23a9-f8b0-4645-b45d-a0788be3c8d7" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">while creative solutions, such as leasehold mortgages, have been developed in response to the problem identified in subparagraph (A), some solutions remain subject to review and approval by the Bureau of Indian Affairs, adding additional costs and delay to Tribal projects.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="idd85d32b5-2f63-48d7-88f6-0f5355f82311" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Native American Business Development, Trade Promotion, and Tourism Act of 2000</header>
 <subsection commented="no" display-inline="no-display-inline" id="id78dac6bf-4013-4624-b642-ed81df775348"><enum>(a)</enum><header display-inline="yes-display-inline">Findings; purposes</header><text display-inline="yes-display-inline">Section 2 of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4301">25 U.S.C. 4301</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0123760e-0b60-4d51-ad22-532bdcbb439c" style="OLC">
 <subsection commented="no" display-inline="no-display-inline" id="idc3d9bcad-8fd7-466f-bbc8-e06625f69c01"><enum>(c)</enum><header display-inline="yes-display-inline">Applicability to Indian-Owned businesses</header><text display-inline="yes-display-inline">The findings and purposes in subsections (a) and (b) shall apply to any Indian-owned business governed—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id6411a32a-3bdb-4b33-9463-0adb2f9f499d"><enum>(1)</enum><text display-inline="yes-display-inline">by Tribal laws regulating trade or commerce on Indian lands; or</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd8f27d95-35a8-4b53-b285-80eacb0ae26e"><enum>(2)</enum><text display-inline="yes-display-inline">pursuant to section 5 of the Act of August 15, 1876 (19 Stat. 200, chapter 289; <external-xref legal-doc="usc" parsable-cite="usc/25/261">25 U.S.C. 261</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id6be8e539-9ada-413c-8bb3-540fcb7c682d"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">Section 3 of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4302">25 U.S.C. 4302</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id4f0a0a96-4c92-4112-b4ab-f4a06b4277dc"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (6) and paragraphs (7) through (9), as paragraphs (2) through (7) and paragraphs (9) through (11), respectively;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd7ddad18-e7e5-4ada-9b7a-2fdd6c0b5fea"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting before paragraph (2) (as redesignated by paragraph (1)) the following:</text> <quoted-block display-inline="no-display-inline" id="idc6f76398-83ec-4215-9d14-f055725f4985" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="id7199aeb1-8cad-4ce3-b820-d8e601321879"><enum>(1)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of Native American Business Development appointed pursuant to section 4(a)(2).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaf09e68b-1e43-4113-af6e-54795223782e"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (7) (as redesignated by paragraph (1)) the following:</text> <quoted-block display-inline="no-display-inline" id="id4602001c-8712-4622-b883-8094a2e5c417" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="idac148242-f359-4b71-a41b-2f8148c86ec3"><enum>(8)</enum><header display-inline="yes-display-inline">Office</header><text display-inline="yes-display-inline">The term <term>Office</term> means the Office of Native American Business Development established by section 4(a)(1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3e573ab7-5f29-4090-aa08-663eb1ad50c2"><enum>(c)</enum><header display-inline="yes-display-inline">Office of Native American Business Development</header><text display-inline="yes-display-inline">Section 4 of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4303">25 U.S.C. 4303</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id1e9363c3-d4a8-4e06-9292-cc366346850f"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id3dfda4e9-2ac3-4fdb-988b-cbe634c055ce"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
 <clause commented="no" display-inline="no-display-inline" id="id59d017c5-4b4b-4053-8b5d-799814bc6238"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>Department of Commerce</quote> and inserting <quote>Office of the Secretary</quote>; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="idf0cb4909-8a8c-42ea-ad34-1e7676cb338d"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>(referred to in this Act as the <term>Office</term>)</quote>; and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddfc64ef4-a852-4005-ac5c-ded9310db5b4"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), in the first sentence, by striking <quote>(referred to in this Act as the <term>Director</term>)</quote>; and</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf84f0c61-fa53-4234-a01b-2e7370bf4661"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="iddcfbb8bb-f73f-406b-97c6-ab94982f1cbb" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="id6399e69b-56fe-4ed3-ac74-e4122da21614"><enum>(c)</enum><header display-inline="yes-display-inline">Duties of Director</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id9665f7e8-9541-4ff3-91df-617ab7aeee34"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director shall serve as—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ide3831ea8-efee-4d4a-86e1-1908d6276c27"><enum>(A)</enum><text display-inline="yes-display-inline">the program and policy advisor to the Secretary with respect to the trust and governmental relationship between the United States and Indian Tribes; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbb3b321b-ef0b-4522-b1e6-2a7398fe78ed"><enum>(B)</enum><text display-inline="yes-display-inline">the point of contact for Indian Tribes, Tribal organizations, and Indians regarding—</text>
 <clause commented="no" display-inline="no-display-inline" id="id09e0c29e-8d8e-4178-a00b-10e37f8bd092"><enum>(i)</enum><text display-inline="yes-display-inline">policies and programs of the Department of Commerce; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id575320d8-a3e3-4b99-b0bd-e3c31985c397"><enum>(ii)</enum><text display-inline="yes-display-inline">other matters relating to economic development and doing business in Indian lands.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0837e726-fb83-44e4-a208-ac6c83a98065"><enum>(2)</enum><header display-inline="yes-display-inline">Departmental coordination</header><text display-inline="yes-display-inline">The Director shall coordinate with all offices and agencies within the Department of Commerce to ensure that each office and agency has an accountable process to ensure—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idcdf55e05-6f1a-4e4e-81f6-0f39d3ffcb16"><enum>(A)</enum><text display-inline="yes-display-inline">meaningful and timely coordination and assistance, as required by this Act; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida5eeea5a-f2cf-4ba6-aa97-9756e0bb6fef"><enum>(B)</enum><text display-inline="yes-display-inline">consultation with Indian Tribes regarding the policies, programs, assistance, and activities of the offices and agencies.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7921FC518E314C6181D0A2A4833CB9AF"><enum>(3)</enum><header display-inline="yes-display-inline">Office operations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section not more than $2,000,000 for each fiscal year.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id06e5992d-53c9-4cff-a95f-63344f8f7f6a"><enum>(d)</enum><header display-inline="yes-display-inline">Indian community development initiatives</header><text display-inline="yes-display-inline">The Native American Business Development, Trade Promotion, and Tourism Act of 2000 is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="id96883b70-e429-4bac-9e98-be6330db60d9"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 8 (<external-xref legal-doc="usc" parsable-cite="usc/25/4307">25 U.S.C. 4307</external-xref>) as section 10; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc146e126-de9c-46fa-a8f7-c02066c820a8"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 7 (<external-xref legal-doc="usc" parsable-cite="usc/25/4306">25 U.S.C. 4306</external-xref>) the following:</text> <quoted-block display-inline="no-display-inline" id="id7dacb881-aafb-43c1-9c0d-98c426a042ee" style="OLC"> <section commented="no" display-inline="no-display-inline" id="id3ea653e1-ec31-437e-9c41-639ae60f87b6" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Indian community development initiatives</header> <subsection commented="no" display-inline="no-display-inline" id="ida112df29-b1f6-4b18-a13b-2652bd0b2690"><enum>(a)</enum><header display-inline="yes-display-inline">Interagency coordination</header><text display-inline="yes-display-inline">Not later than 1 year after the enactment of this section, the Secretary, the Secretary of the Interior, and the Secretary of the Treasury shall coordinate—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idf63d150b-2210-4449-9b37-f00f348836c9"><enum>(1)</enum><text display-inline="yes-display-inline">to develop initiatives that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idb60829c3-e5fd-49dc-a3eb-e6f5a1e94959"><enum>(A)</enum><text display-inline="yes-display-inline">encourage, promote, and provide education regarding investments in Indian communities through—</text>
 <clause commented="no" display-inline="no-display-inline" id="id07e1eb43-80a8-4921-a0f4-f408aae3f4e1"><enum>(i)</enum><text display-inline="yes-display-inline">the loan guarantee program of Bureau of Indian Affairs under section 201 of the Indian Financing Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/25/1481">25 U.S.C. 1481</external-xref>);</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idde3d2093-9acd-48ae-82b1-b0b523452ede"><enum>(ii)</enum><text display-inline="yes-display-inline">programs carried out using amounts in the Community Development Financial Institutions Fund established under section 104(a) of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4703">12 U.S.C. 4703(a)</external-xref>); and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id8f8888be-0af0-4816-8469-fce68240fff3"><enum>(iii)</enum><text display-inline="yes-display-inline">other capital development programs;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id54dc1157-7a89-4b6b-b834-c33d0112e3a4"><enum>(B)</enum><text display-inline="yes-display-inline">examine and develop alternatives that would qualify as collateral for financing in Indian communities; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86eae2b3-f9a9-4159-990e-018f222a9ccb"><enum>(C)</enum><text display-inline="yes-display-inline">provide entrepreneur and other training relating to economic development through tribally controlled colleges and universities and other Indian organizations with experience in providing such training;</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id074a89ac-afe4-4e75-b02f-9d9e8b1843d1"><enum>(2)</enum><text display-inline="yes-display-inline">to consult with Indian Tribes and with the Securities and Exchange Commission to study, and collaborate to establish, regulatory changes necessary to qualify an Indian Tribe as an accredited investor for the purposes of sections 230.500 through 230.508 of title 17, Code of Federal Regulations (or successor regulations), consistent with the goals of promoting capital formation and ensuring qualifying Indian Tribes have the ability to withstand investment loss, on a basis comparable to other legal entities that qualify as accredited investors who are not natural persons;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0DDE6B20BFDF468FAC7F184E59CAE2DB"><enum>(3)</enum><text display-inline="yes-display-inline">to identify regulatory, legal, or other barriers to increasing investment, business, and economic development, including qualifying or approving collateral structures, measurements of economic strength, and contributions of Indian economies in Indian communities through the Authority established under section 4 of the Indian Tribal Regulatory Reform and Business Development Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4301">25 U.S.C. 4301</external-xref> note);</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76b601c6-3f09-4f2b-8f18-ae37f9152b28"><enum>(4)</enum><text display-inline="yes-display-inline">to ensure consultation with Indian Tribes regarding increasing investment in Indian communities and the development of the report required in paragraph (5); and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id93CA92385A2E436CABB7F28B4AA25A16"><enum>(5)</enum><text display-inline="yes-display-inline">not less than once every 2 years, to provide a report to Congress regarding—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id35FF0088467549B1958598D183E5565B"><enum>(A)</enum><text display-inline="yes-display-inline">improvements to Indian communities resulting from such initiatives and recommendations for promoting sustained growth of the Tribal economies;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7DA88B9085B04683B3D8A41379BA8274"><enum>(B)</enum><text display-inline="yes-display-inline">results of the study and collaboration regarding the necessary changes referenced in paragraph (2) and the impact of allowing Indian Tribes to qualify as an accredited investor; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEA3179FC6A1F4890A7DDE6DA445DF1C9"><enum>(C)</enum><text display-inline="yes-display-inline">the identified regulatory, legal, and other barriers referenced in paragraph (3).</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id53c8bc95-4903-46e3-bd77-365e7ca3df85"><enum>(b)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">For assistance provided pursuant to section 108 of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4707">12 U.S.C. 4707</external-xref>) to benefit Native Community Development Financial Institutions, as defined by the Secretary of the Treasury, section 108(e) of such Act shall not apply.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id1548ab3ffc224fe9b2ed58aef07c6296"><enum>(c)</enum><header display-inline="yes-display-inline">Indian economic development feasibility study</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idfa08d44155bb480c947b2bd8efb4584f"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Government Accountability Office shall conduct a study and, not later than 18 months after the date of enactment of this subsection, submit to the Committee on Indian Affairs of the Senate and the Committee on Natural Resources of the House of Representatives a report on the findings of the study and recommendations.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc90608662a234bccb7f313632f2a17f0"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The study shall include an assessment of each of the following:</text> <subparagraph commented="no" display-inline="no-display-inline" id="idb84d64ae28924cccbb77e26a28f5ed96"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The study shall assess current Federal capitalization and related programs and services that are available to assist Indian communities with business and economic development, including manufacturing, physical infrastructure (such as telecommunications and broadband), community development, and facilities construction for such purposes. For each of the Federal programs and services identified, the study shall assess the current use and demand by Indian Tribes, individuals, businesses, and communities of the programs, the capital needs of Indian Tribes, businesses, and communities related to economic development, the extent to which the programs and services overlap or are duplicative, and the extent that similar programs have been used to assist non-Indian communities compared to the extent used for Indian communities.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbfb6977a64314793861f6437f38742f7"><enum>(B)</enum><header display-inline="yes-display-inline">Financing assistance</header><text display-inline="yes-display-inline">The study shall assess and quantify the extent of assistance provided to non-Indian borrowers and to Indian (both Tribal and individual) borrowers (including information about such assistance as a percentage of need for Indian borrowers and for non-Indian borrowers, assistance to Indian borrowers and to non-Indian borrowers as a percentage of total applicants, and such assistance to Indian borrowers as individuals as compared to such assistance to Indian Tribes) through the loan programs, the loan guarantee programs, or bond guarantee programs of the—</text>
 <clause commented="no" display-inline="no-display-inline" id="idf2487a6e09bc461294fbc0538d651d05"><enum>(i)</enum><text display-inline="yes-display-inline">Department of the Interior;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ideda31a574108478a8fcfbad0dc6fc77a"><enum>(ii)</enum><text display-inline="yes-display-inline">Department of Agriculture;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id2585a479d09b4305b7947628c3bb4e3e"><enum>(iii)</enum><text display-inline="yes-display-inline">Department of Housing and Urban Development;</text> </clause><clause commented="no" display-inline="no-display-inline" id="ida571b0cacc6b45b29eb942b510763978"><enum>(iv)</enum><text display-inline="yes-display-inline">Department of Energy;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id1b4f08d0412e496cb59632367509c306"><enum>(v)</enum><text display-inline="yes-display-inline">Small Business Administration; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="idc948dd4acd1e469fb742f6919ba734e4"><enum>(vi)</enum><text display-inline="yes-display-inline">Community Development Financial Institutions Fund of the Department of the Treasury.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida0930a8fe1fe4a3bb63ba4f30057224f"><enum>(C)</enum><header display-inline="yes-display-inline">Tax incentives</header><text display-inline="yes-display-inline">The study shall assess and quantify the extent of the assistance and allocations afforded for non-Indian projects and for Indian projects pursuant to each of the following tax incentive programs:</text>
 <clause commented="no" display-inline="no-display-inline" id="id650de2ac7a9948d88322433c37f47f04"><enum>(i)</enum><text display-inline="yes-display-inline">New market tax credit.</text> </clause><clause commented="no" display-inline="no-display-inline" id="idcfc14e218d274833a8c2a951f4a6e5df"><enum>(ii)</enum><text display-inline="yes-display-inline">Low income housing tax credit.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id39271d42f75742b18a1688c527a3a7cf"><enum>(iii)</enum><text display-inline="yes-display-inline">Investment tax credit.</text> </clause><clause commented="no" display-inline="no-display-inline" id="ida689167607db4ca68c949a18eaa22d33"><enum>(iv)</enum><text display-inline="yes-display-inline">Renewable energy tax incentives.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id5336876539364ce78c61b5a08c2a3de0"><enum>(v)</enum><text display-inline="yes-display-inline">Accelerated depreciation.</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id84c7db162fec4ce48e1548f89124568d"><enum>(D)</enum><header display-inline="yes-display-inline">Tribal investment incentive</header><text display-inline="yes-display-inline">The study shall assess various alternative incentives that could be provided to enable and encourage Tribal governments to invest in an Indian community development investment fund or bank.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2088A636396C4D0096F16E1CE7F41258"><enum>(e)</enum><header display-inline="yes-display-inline">Conforming and technical amendments</header><text display-inline="yes-display-inline">The Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4301">25 U.S.C. 4301</external-xref> et seq.) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id31B8057F84A74FCEBC65670982CF4BCF"><enum>(1)</enum><text display-inline="yes-display-inline">in section 3—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id56B14A98E1EB45E899031FD9DFA03D54"><enum>(A)</enum><text display-inline="yes-display-inline">in each of paragraphs (1), (4), and (8), by striking <quote>tribe</quote> and inserting <quote>Tribe</quote>; and</text>

 <subsection commented="no" display-inline="no-display-inline" id="id21764770-4058-42eb-bc43-83229f50f9dd"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="id924539e0-0b02-4e56-a1d6-6f5fa1b17633"><enum>(1)</enum><header display-inline="yes-display-inline">Indian economic enterprise</header><text display-inline="yes-display-inline">The term <term>Indian economic enterprise</term> has the meaning given the term in section 1480.201 of title 48, Code of Federal Regulations (or successor regulations).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3a96d54f-9044-4118-8ab6-f30c119e9f24"><enum>(2)</enum><header display-inline="yes-display-inline">Mentor firm; protege firm</header><text display-inline="yes-display-inline">The terms <term>mentor firm</term> and <term>protege firm</term> have the meanings given those terms in section 831(c) of the National Defense Authorization Act for Fiscal Year 1991 (<external-xref legal-doc="usc" parsable-cite="usc/10/2302">10 U.S.C. 2302</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/510">Public Law 101–510</external-xref>).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a7c0bbd-9f86-4832-8795-af31b4a115a9"><enum>(3)</enum><header display-inline="yes-display-inline">Secretaries</header><text display-inline="yes-display-inline">The term <term>Secretaries</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id753956e0-af2f-416f-b167-ca28ff5a3c62"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of the Interior; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ecb7d14-dd71-4c8e-ae5d-5c4f6072f2d9"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Health and Human Services.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4d305f07-0853-4598-abe9-91e678857dbd"><enum>(b)</enum><header display-inline="yes-display-inline">Enterprise development</header> <paragraph commented="no" display-inline="no-display-inline" id="id88fe0ace-fef5-444c-964e-c3f522e7e121"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Unless determined by one of the Secretaries to be impracticable and unreasonable—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id2a6d228d-1d25-4a00-b2e1-f9249d1a29cd"><enum>(A)</enum><text display-inline="yes-display-inline">Indian labor shall be employed; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5d740859-adf2-4b91-bdae-5835135988ed"><enum>(B)</enum><text display-inline="yes-display-inline">purchases of Indian industry products (including printing and facilities construction, notwithstanding any other provision of law) may be made in open market by the Secretaries.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide970fd69-ed4b-4762-9a3d-ac13fcef2de8"><enum>(2)</enum><header display-inline="yes-display-inline">Mentor-Protege Program</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="id8a88411b-2ba6-49bf-b128-af7e1bab20c9"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Participation in the Mentor-Protege Program established under section 831(a) of the National Defense Authorization Act for Fiscal Year 1991 (<external-xref legal-doc="usc" parsable-cite="usc/10/2302">10 U.S.C. 2302</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/510">Public Law 101–510</external-xref>) or receipt of assistance under a developmental assistance agreement under that program shall not render any individual or entity involved in the provision of Indian labor or an Indian industry product ineligible to receive assistance under this section.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idba742b90-36ba-4fea-ae4b-98cb5de98140"><enum>(B)</enum><header display-inline="yes-display-inline">Treatment</header><text display-inline="yes-display-inline">For purposes of this section, no determination of affiliation or control (whether direct or indirect) may be found between a protege firm and a mentor firm on the basis that the mentor firm has provided, or agreed to provide, to the protege firm, pursuant to a mentor-protege agreement, any form of developmental assistance described in section 831(f) of the National Defense Authorization Act for Fiscal Year 1991 (<external-xref legal-doc="usc" parsable-cite="usc/10/2302">10 U.S.C. 2302</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/510">Public Law 101–510</external-xref>).</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id219a817e-272e-4b10-8004-dd0b4ed47f55"><enum>(c)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">In carrying out this section, the Secretaries shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="id5c7f9eb2-a8b5-47e8-bcb7-eb73fbfe7af8"><enum>(1)</enum><text display-inline="yes-display-inline">conduct outreach to Indian industrial entities;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd8e35a5b-155a-4666-bef7-2ae82693e0d6"><enum>(2)</enum><text display-inline="yes-display-inline">provide training;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide94f60f6-361e-4bed-abf4-1b65f68fa62a"><enum>(3)</enum><text display-inline="yes-display-inline">promulgate regulations in accordance with this section and with the regulations under part 1480 of title 48, Code of Federal Regulations (or successor regulations), to harmonize the procurement procedures of the Department of the Interior and the Department of Health and Human Services, to the maximum extent practicable;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc304dc90-b666-4d72-84ee-38333f53faf0"><enum>(4)</enum><text display-inline="yes-display-inline">require regional offices of the Bureau of Indian Affairs and the Indian Health Service to aggregate data regarding compliance with this section;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1ebef09e-048d-41df-a6aa-b7a50def0fdb"><enum>(5)</enum><text display-inline="yes-display-inline">require procurement management reviews by their respective Departments to include a review of the implementation of this section; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21c5cb1a-1548-4569-81c6-55d2aeea7ca9"><enum>(6)</enum><text display-inline="yes-display-inline">consult with Indian Tribes, Indian industrial entities, and other stakeholders regarding methods to facilitate compliance with—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idd1b5077d-665e-4d01-9c51-c383621dbb60"><enum>(A)</enum><text display-inline="yes-display-inline">this section; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc99285ee-25e8-43c9-8d9f-e7bd30345f5e"><enum>(B)</enum><text display-inline="yes-display-inline">other small business or procurement goals.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idaa0b3f69-37c0-4b50-be50-94b1ee652657"><enum>(d)</enum><header display-inline="yes-display-inline">Report</header>
 <paragraph commented="no" display-inline="no-display-inline" id="ida88669a3-9595-4680-96fc-ecbc6e34f226"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, and not less frequently than once every 2 years thereafter, each of the Secretaries shall submit to the Committee on Indian Affairs of the Senate and the Committee on Natural Resources of the House of Representatives a report describing, during the period covered by the report, the implementation of this section by each of the respective Secretaries.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide7cb487e-1c83-47f9-b1e4-efbe68ab903e"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report under this subsection shall include, for each fiscal year during the period covered by the report—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idb10975bf-bde5-49a5-b78e-a257a00e4381"><enum>(A)</enum><text display-inline="yes-display-inline">the names of each agency under the respective jurisdiction of each of the Secretaries to which this section has been applied, and efforts made by additional agencies within the Secretaries' respective Departments to use the procurement procedures under this Act;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5e7d9f60-0f69-44c3-b361-fc1235324c67"><enum>(B)</enum><text display-inline="yes-display-inline">a summary of the types of purchases made from, and contracts (including any relevant modifications, extensions, or renewals) awarded to, Indian economic enterprises, expressed by agency region;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id90c44031-d973-4486-9f72-d0f1086b31e0"><enum>(C)</enum><text display-inline="yes-display-inline">a description of the percentage increase or decrease in total dollar value and number of purchases and awards made within each agency region, as compared to the totals of the region for the preceding fiscal year;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3692e8cd-0788-4d74-a7e6-7f4dc1e03582"><enum>(D)</enum><text display-inline="yes-display-inline">a description of the methods used by applicable contracting officers and employees to conduct market searches to identify qualified Indian economic enterprises;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id195baa7a-71ba-46f2-8afd-292c795087e2"><enum>(E)</enum><text display-inline="yes-display-inline">a summary of all deviations granted under section 1480.403 of title 48, Code of Federal Regulations (or successor regulations), including a description of—</text>
 <clause commented="no" display-inline="no-display-inline" id="id153acfde-7d88-4c76-8aef-ddd331ea5b94"><enum>(i)</enum><text display-inline="yes-display-inline">the types of alternative procurement methods used, including any Indian owned businesses reported under other procurement goals; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idc851871b-846e-476e-acea-ea942c042555"><enum>(ii)</enum><text display-inline="yes-display-inline">the dollar value of any awards made pursuant to those deviations;</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53bead7e-09d4-47e7-825c-1be869d1e934"><enum>(F)</enum><text display-inline="yes-display-inline">a summary of all determinations made to provide awards to Indian economic enterprises, including a description of the dollar value of the awards;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddb9b2793-c366-4e63-b4d2-327f892cf1b7"><enum>(G)</enum><text display-inline="yes-display-inline">a description or summary of the total number and value of all purchases of, and contracts awarded for, supplies, services, and construction (including the percentage increase or decrease, as compared to the preceding fiscal year) from—</text>
 <clause commented="no" display-inline="no-display-inline" id="id0380b06e-8e7e-4583-b57d-ac937a81b4bd"><enum>(i)</enum><text display-inline="yes-display-inline">Indian economic enterprises; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id8c159f40-330d-40ba-bc8c-71619052b6c9"><enum>(ii)</enum><text display-inline="yes-display-inline">non-Indian economic enterprises;</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f111601-852e-48df-b844-1769ab528aae"><enum>(H)</enum><text display-inline="yes-display-inline">any administrative, procedural, legal, or other barriers to achieving the purposes of this section, together with recommendations for legislative or administrative actions to address those barriers; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC64742FD8FFF48ED8745069C02270DBC"><enum>(I)</enum><text display-inline="yes-display-inline">for each agency region—</text> <clause commented="no" display-inline="no-display-inline" id="idEF8127DFAB774B3C9B08FC09826370D7"><enum>(i)</enum><text display-inline="yes-display-inline">the total amount spent on purchases made from, and contracts awarded to, Indian economic enterprises; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idEFF2BF36F3E649FF8384D7ACEB379BB8"><enum>(ii)</enum><text display-inline="yes-display-inline">a comparison of the amount described in clause (i) to the total amount that the agency region would likely have spent on the same purchases made from a non-Indian economic enterprise or contracts awarded to a non-Indian economic enterprise.</text>
 </clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB0BFA0AC8DE44EE9BDC041C1C2F5A412"><enum>(e)</enum><header display-inline="yes-display-inline">Goals</header><text display-inline="yes-display-inline">Each agency shall establish an annual minimum percentage goal for procurement in compliance with this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id39748a5b-4eaf-4018-af21-adc99e6ffb25" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Native American Programs Act of 1974</header>
 <subsection commented="no" display-inline="no-display-inline" id="iddcd6ef94-5743-4436-a8e5-f538293a99f6"><enum>(a)</enum><header display-inline="yes-display-inline">Financial assistance for Native American projects</header><text display-inline="yes-display-inline">Section 803 of the Native American Programs Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/2991b">42 U.S.C. 2991b</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="id98918978-b435-482c-897c-3bdf9ac1d02a"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (b) through (d) as subsections (c) through (e), respectively; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idccb74548-bc82-4103-83f8-58dc8071901e"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the following:</text> <quoted-block display-inline="no-display-inline" id="id33927f6b-2f16-4b32-872a-a18a59144edf" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="id5a34e3dc-4b03-495c-94cc-91388e93f838"><enum>(b)</enum><header display-inline="yes-display-inline">Economic development</header> <paragraph commented="no" display-inline="no-display-inline" id="id0e8fe66c-1898-4517-a3f5-6abbd2022ff2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commissioner may provide assistance under subsection (a) for projects relating to the purposes of this title to a Native community development financial institution, as defined by the Secretary of the Treasury.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcf8163a8-0808-4e6d-8ae2-6bc8ea9f9946"><enum>(2)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">With regard to not less than 50 percent of the total amount available for assistance under this section, the Commissioner shall give priority to any application seeking assistance for—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id03c663ac-1e5f-43f9-af89-a96f8d8d0ee5"><enum>(A)</enum><text display-inline="yes-display-inline">the development of a Tribal code or court system for purposes of economic development, including commercial codes, training for court personnel, regulation pursuant to section 5 of the Act of August 15, 1876 (19 Stat. 200, chapter 289; <external-xref legal-doc="usc" parsable-cite="usc/25/261">25 U.S.C. 261</external-xref>), and the development of nonprofit subsidiaries or other Tribal business structures;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideb8ff2a2-56ad-4a97-8d72-c0aa520c6b91"><enum>(B)</enum><text display-inline="yes-display-inline">the development of a community development financial institution, including training and administrative expenses; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4614ca7c-2d0f-426b-b56d-d723b2485230"><enum>(C)</enum><text display-inline="yes-display-inline">the development of a Tribal master plan for community and economic development and infrastructure.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide1990aa2-93f5-4533-b2dc-8d668eea72b6"><enum>(b)</enum><header display-inline="yes-display-inline">Technical assistance and training</header><text display-inline="yes-display-inline">Section 804 of the Native American Programs Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/2991c">42 U.S.C. 2991c</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id2501b9a4-b10b-4532-9a73-29e7ae74d7d1"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>The Commissioner</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id2baa6735-c2d7-439a-8550-86646773cc0e" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="id4d9e5559-82e1-4ef7-b309-be886525288a"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commissioner</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id08873cba-445d-4c6a-b016-ba0955dece5e"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id70fe09fa-b8da-4f48-9159-2f77ca49ac24" style="OLC"> <subsection commented="no" display-inline="no-display-inline" id="ided694a39-d772-49fa-9b86-1835ab393819"><enum>(b)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">In providing assistance under subsection (a), the Commissioner shall give priority to any application described in section 803(b)(2).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5620778a-75e5-4840-9653-f007d3ad49fb"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">Section 816 of the Native American Programs Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/2992d">42 U.S.C. 2992d</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="idbb79592e-2816-42c7-a113-c6b6f45f8430"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>803(d)</quote> each place it appears and inserting <quote>803(e)</quote>; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida3ff7006-21b7-4f5d-b62b-e989646f4609"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id7C7DE63440844AD0BEB0A970E6DC3629"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>such sums as may be necessary</quote> and inserting <quote>$34,000,000</quote>; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id88280B25FC424924A7A25FCF9D9A290D"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>1999, 2000, 2001, and 2002</quote> and inserting <quote>2020 through 2024</quote>.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id389A93B83FB044CFBDDE73B1A3D44341"><enum>(d)</enum><header display-inline="yes-display-inline">Conforming and technical amendments</header><text display-inline="yes-display-inline">The Native American Programs Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/2991">42 U.S.C. 2991</external-xref> et seq.) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="idB756837D86474D7E914168C4C3CE1335"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>tribe</quote> each place the term appears and inserting <quote>Tribe</quote>;</text>
