		<official-title>To require the Secretary of Homeland Security to publish an annual report on the use of deepfake
			 technology, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Deepfake Report Act of 2019</short-title></quote>.</text>
 </section><section id="id6DF94FCFE5054257B41B4542F4A37FE5"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="id8c6f8fb307794cac991cdc993b16a269"><enum>(1)</enum><header>Digital content forgery</header><text>The term <term>digital content forgery</term> means the use of emerging technologies, including artificial intelligence and machine learning techniques, to fabricate or manipulate audio, visual, or text content with the intent to mislead.</text>
 </paragraph><paragraph id="id1A8DB73ABA6D4170A5F9713CAC3E0FF1"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text> </paragraph></section><section id="id76BA8D1997F94CC5A4A907BCC4DE99C8"><enum>3.</enum><header>Reports on digital content forgery technology</header> <subsection id="id79191CF817E1469DAB0CA2D5D8CE35DB"><enum>(a)</enum><header>In general</header><text>Not later than 200 days after the date of enactment of this Act and every 18 months thereafter, the Secretary, acting through the Under Secretary for Science and Technology, shall produce a report on the state of digital content forgery technology.</text>
 </subsection><subsection id="id57ef6d3e5c6e4b6db37a155f6a4f7b88"><enum>(b)</enum><header>Contents</header><text>Each report produced under subsection (a) shall include—</text> <paragraph id="idbe9994e24cfe4ab4b92306c9f990fa4c"><enum>(1)</enum><text>an assessment of the underlying technologies used to create or propagate digital content forgeries, including the evolution of such technologies;</text>
 </paragraph><paragraph id="idaa029663502e4bfdaf301e983c426853"><enum>(2)</enum><text>a description of the types of digital content forgeries, including use—</text> <subparagraph id="id2E198C28C92542008A7639E500E018ED"><enum>(A)</enum><text>by foreign or domestic sources; and</text>
 </subparagraph><subparagraph id="id6BD0142D2670441B9B192E93ECBDB97D"><enum>(B)</enum><text>in cyber attacks, pornography, and media;</text> </subparagraph></paragraph><paragraph id="idebe9dbc9816b45fcbdbf1541b196e9da"><enum>(3)</enum><text>an assessment of how foreign governments, and the proxies and networks thereof, use, or could use, digital content forgeries to harm national security;</text>
 </paragraph><paragraph id="id02b8738ad06740c6b7c14cc59c123081"><enum>(4)</enum><text>an assessment of how non-governmental entities in the United States, use, or could use, digital content forgeries;</text>
 </paragraph><paragraph id="id1e05b09bc967428eb6f97ec46c721838"><enum>(5)</enum><text>an assessment of the uses, applications, dangers, and benefits of deep learning technologies used to generate high fidelity artificial content of events that did not occur;</text>
 </paragraph><paragraph id="id0b765a0386f34fc98ad106aaca059cac"><enum>(6)</enum><text>an analysis of the methods used to determine whether content is genuinely created by a human or through digital content forgery technology, including an assessment of any effective heuristics used to make such a determination;</text>
 </paragraph><paragraph id="id78faefb1f4804ae38a791042afe745d8"><enum>(7)</enum><text>a description of the technological counter-measures that are, or could be, used to address concerns with digital content forgery technology;</text>
 </paragraph><paragraph id="id7e891cb0966840d2b382279660e61a8d"><enum>(8)</enum><text>recommendations regarding whether additional legal authorities are needed to address the findings of the report; and</text>
 </paragraph><paragraph id="id23cd1b76ea4f4bc8bdc724eb530d2199"><enum>(9)</enum><text>any additional information the Secretary determines appropriate.</text> </paragraph></subsection><subsection id="id0550D7B0F40D480293A7AC6B5DE314B2"><enum>(c)</enum><header>Consultation and public hearings</header><text>In producing each report required under subsection (a), the Secretary shall—</text>
 <paragraph id="id045B13D6A681456AAAD63EB2D8BDAD4E"><enum>(1)</enum><text>consult with—</text> <subparagraph id="idd7734c578f2146ebab5969bb6f138c0b"><enum>(A)</enum><text>the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>));</text>
 </subparagraph><subparagraph id="idc1e202484db3443fb62a754c27eda288"><enum>(B)</enum><text>the Secretary of Defense;</text> </subparagraph><subparagraph id="idb63c2eebfab44a849e1be3a2f7eca120"><enum>(C)</enum><text>the Chairman of the Joint Chiefs of Staff;</text>
 </subparagraph><subparagraph id="id9f11cc91929748a1aa5d5ab8a20227c1"><enum>(D)</enum><text>the Department of Justice, Computer Crime and Intellectual Property Section;</text> </subparagraph><subparagraph id="id16dbd78e11a74928abcae4a27c4102a3"><enum>(E)</enum><text>the Office of Science and Technology Policy;</text>
 </subparagraph><subparagraph id="id5b32961afd024ca8ba35b1c84b3f3ea3"><enum>(F)</enum><text>the National Institute of Standards and Technology;</text> </subparagraph><subparagraph id="id9af3b13c8c3a422b84865630eaf9278d"><enum>(G)</enum><text>the National Science Foundation;</text>
 </subparagraph><subparagraph id="id75503aac6324468caa09410e33b11804"><enum>(H)</enum><text>the Federal Election Commission;</text> </subparagraph><subparagraph id="id1b3cdc81756b4373bf33f59f79af49f6"><enum>(I)</enum><text>the Federal Trade Commission; and</text>
 </subparagraph><subparagraph id="id346cda546729421e8ddf82869914e85c"><enum>(J)</enum><text>any other agency of the Federal government that the Secretary considers necessary; and</text> </subparagraph></paragraph><paragraph id="id9F764BFAAFFE4FE6B19A9F008F16D526"><enum>(2)</enum><text>conduct public hearings to gather, or otherwise allow interested parties an opportunity to present, information and advice relevant to the production of the report.</text>
 </paragraph></subsection><subsection id="idC0B4CFDE301D4C8692300A7A4F855587"><enum>(d)</enum><header>Form of report</header><text>Each report produced under subsection (a) shall be produced in unclassified form, but may contain a classified annex.</text>
 </subsection><subsection id="id7E47C0191CA94123BF15E7C1E7DEAA26"><enum>(e)</enum><header>Applicability of FOIA</header><text>Nothing in this Act, or in a report produced under this section, shall be construed to allow the disclosure of information or a record that is exempt from public disclosure under section 552 of title 5, United States Code.</text>
