<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d63969e62" identifier="/us/bill/116/s/199/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Leech Lake Band of Ojibwe Reservation Restoration Act</shortTitle>”.</content></section>
<section id="d63969e72" identifier="/us/bill/116/s/199/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>LEECH LAKE BAND OF OJIBWE RESERVATION RESTORATION.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d63969e76" identifier="/us/bill/116/s/199/s2/a" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Congress finds that—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e84" identifier="/us/bill/116/s/199/s2/a/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>the Federal land described in subsection (b)(1) was taken from members of the Leech Lake Band of Ojibwe during a period—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e88" identifier="/us/bill/116/s/199/s2/a/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>beginning in 1948;</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e92" identifier="/us/bill/116/s/199/s2/a/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>during which the Bureau of Indian Affairs incorrectly interpreted an order of the Secretary of the Interior to mean that the Department of the Interior had the authority to sell tribal allotments without the consent of a majority of the rightful landowners; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e96" identifier="/us/bill/116/s/199/s2/a/1/C" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>ending in 1959, when the Secretary of the Interior was—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d63969e100" identifier="/us/bill/116/s/199/s2/a/1/C/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>advised that sales described in subparagraph (B) were illegal; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d63969e104" identifier="/us/bill/116/s/199/s2/a/1/C/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>ordered to cease conducting those sales;</content></clause></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e108" identifier="/us/bill/116/s/199/s2/a/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>as a result of the Federal land described in subsection (b)(1) being taken from members of the Leech Lake Band of Ojibwe, the Leech Lake Band of Ojibwe hold the smallest percentage of its original reservation lands of any Ojibwe bands in Minnesota;</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e112" identifier="/us/bill/116/s/199/s2/a/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3)</num><subparagraph class="inline" id="d63969e115" identifier="/us/bill/116/s/199/s2/a/3/A"><num value="A">(A) </num><content>the applicable statute of limitations prohibits individuals from pursuing through litigation the return of the land taken as described in paragraph (1); but</content></subparagraph><subparagraph class="indentUp0 firstIndent1 fontsize10" id="d63969e119" identifier="/us/bill/116/s/199/s2/a/3/B" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>a Federal judge ruled that the land could be restored to the affected individuals through the legislative process;</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e123" identifier="/us/bill/116/s/199/s2/a/4" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><chapeau>a comprehensive review of the Federal land demonstrated that—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e127" identifier="/us/bill/116/s/199/s2/a/4/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>a portion of the Federal land is encumbered by—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d63969e131" identifier="/us/bill/116/s/199/s2/a/4/A/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>utility easements;</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d63969e135" identifier="/us/bill/116/s/199/s2/a/4/A/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>rights-of-way for roads; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d63969e139" identifier="/us/bill/116/s/199/s2/a/4/A/iii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="iii">(iii) </num><content>flowage and reservoir rights; and</content></clause></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e143" identifier="/us/bill/116/s/199/s2/a/4/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>there are no known cabins, campgrounds, lodges, or resorts located on any portion of the Federal land; and</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e147" identifier="/us/bill/116/s/199/s2/a/5" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="5">(5) </num><chapeau>on reacquisition by the Tribe of the Federal land, the Tribe—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e151" identifier="/us/bill/116/s/199/s2/a/5/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>has pledged to respect the easements, rights-of-way, and other rights described in paragraph (4)(A); and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e155" identifier="/us/bill/116/s/199/s2/a/5/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B)</num><clause class="inline" id="d63969e158" identifier="/us/bill/116/s/199/s2/a/5/B/i"><num value="i">(i) </num><content>does not intend immediately to modify the use of the Federal land; but</content></clause><clause class="indentUp0 firstIndent1 fontsize10" id="d63969e162" identifier="/us/bill/116/s/199/s2/a/5/B/ii" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>will keep the Federal land in tax-exempt fee status as part of the Chippewa National Forest until the Tribe develops a plan that allows for a gradual subdivision of some tracts for economic and residential development by the Tribe.</content></clause></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d63969e166" identifier="/us/bill/116/s/199/s2/b" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e174" identifier="/us/bill/116/s/199/s2/b/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">Federal land</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e181" identifier="/us/bill/116/s/199/s2/b/1/A" role="definitions" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The term “<term>Federal land</term>” means the approximately 11,760 acres of Federal land located in the Chippewa National Forest in Cass County, Minnesota, the boundaries of which shall be depicted on the map, and described in the legal description, submitted under subsection (d)(1)(B).</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e189" identifier="/us/bill/116/s/199/s2/b/1/B" role="definitions" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><heading><inline class="smallCaps">Inclusions</inline>.—</heading><chapeau>The term “<term>Federal land</term>” includes—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d63969e197" identifier="/us/bill/116/s/199/s2/b/1/B/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>any improvement located on the Federal land described in subparagraph (A); and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d63969e201" identifier="/us/bill/116/s/199/s2/b/1/B/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>any appurtenance to the Federal land.</content></clause></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e205" identifier="/us/bill/116/s/199/s2/b/2" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of Agriculture.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e213" identifier="/us/bill/116/s/199/s2/b/3" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Tribe</inline>.—</heading><content>The term “<term>Tribe</term>” means the Leech Lake Band of Ojibwe.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d63969e221" identifier="/us/bill/116/s/199/s2/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Transfer to Reservation</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e228" identifier="/us/bill/116/s/199/s2/c/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>Subject to valid existing rights and paragraph (2), the Secretary shall transfer to the administrative jurisdiction of the Secretary of the Interior all right, title, and interest of the United States in and to the Federal land.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e236" identifier="/us/bill/116/s/199/s2/c/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Treatment</inline>.—</heading><chapeau>Effective immediately on the transfer under paragraph (1), the Federal land shall be—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e244" identifier="/us/bill/116/s/199/s2/c/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>held in trust by the United States for the benefit of the Tribe; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e248" identifier="/us/bill/116/s/199/s2/c/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>considered to be a part of the reservation of the Tribe.</content></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d63969e252" identifier="/us/bill/116/s/199/s2/d" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Survey, Map, and Legal Description</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e259" identifier="/us/bill/116/s/199/s2/d/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary shall—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e267" identifier="/us/bill/116/s/199/s2/d/1/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>not later than 180 days after the date of enactment of this Act, complete a plan of survey to establish the boundaries of the Federal land; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e271" identifier="/us/bill/116/s/199/s2/d/1/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>as soon as practicable after the date of enactment of this Act, submit a map and legal description of the Federal land to—</chapeau><clause class="indentUp1 firstIndent1 fontsize10" id="d63969e275" identifier="/us/bill/116/s/199/s2/d/1/B/i" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">(i) </num><content>the Committee on Natural Resources of the House of Representatives; and</content></clause><clause class="indentUp1 firstIndent1 fontsize10" id="d63969e279" identifier="/us/bill/116/s/199/s2/d/1/B/ii" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the Committee on Indian Affairs of the Senate.</content></clause></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e283" identifier="/us/bill/116/s/199/s2/d/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Force and effect</inline>.—</heading><content>The map and legal description submitted under paragraph (1)(B) shall have the same force and effect as if included in this Act, except that the Secretary may correct any clerical or typographical error in the map or legal description.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e291" identifier="/us/bill/116/s/199/s2/d/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Public availability</inline>.—</heading><content>The map and legal description submitted under paragraph (1)(B) shall be on file and available for public inspection in the office of the Secretary.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d63969e299" identifier="/us/bill/116/s/199/s2/e" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="e">(e) </num><heading><inline class="smallCaps">Administration</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e306" identifier="/us/bill/116/s/199/s2/e/1" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>Except as otherwise expressly provided in this section, nothing in this section affects any right or claim of the Tribe, as in existence on the date of enactment of this Act, to any land or interest in land.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e314" identifier="/us/bill/116/s/199/s2/e/2" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Prohibitions</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e321" identifier="/us/bill/116/s/199/s2/e/2/A" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><heading><inline class="smallCaps">Exports of unprocessed logs</inline>.—</heading><content>Federal law (including regulations) relating to the export of unprocessed logs harvested from Federal land shall apply to any unprocessed logs that are harvested from the Federal land.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" id="d63969e329" identifier="/us/bill/116/s/199/s2/e/2/B" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><heading><inline class="smallCaps">Non-permissible use of land</inline>.—</heading><content>The Federal land shall not be eligible or used for any gaming activity carried out under the Indian Gaming Regulatory Act (<ref href="/us/usc/t25/s2701/etseq">25 U.S.C. 2701 et seq.</ref>).</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" id="d63969e341" identifier="/us/bill/116/s/199/s2/e/3" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Forest management</inline>.—</heading><content>Any commercial forestry activity carried out on the Federal land shall be managed in accordance with applicable Federal law.</content></paragraph></subsection></section>
