<official-title>To secure the rights of public employees to organize, act concertedly, and bargain collectively, which safeguard the public interest and promote the free and unobstructed flow of commerce, and for other purposes. </official-title>

<legis-body display-enacting-clause="yes-display-enacting-clause" id="H38A5BC64AED242439656687234D59C8E" style="OLC"> 
<section id="HE485EEFB4FFA4F5CBF628D7FEEC3E953" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Service Freedom to Negotiate Act of 2019</short-title></quote>.</text> </section> <section id="HF8C52425E874402DA220E46F89F5CA51"><enum>2.</enum><header>Definitions</header> <subsection id="HD753E990BC494DBD9F4F0EFAF999B604"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In this Act:</text> 
<paragraph id="H067B246AEDAB45EF8B840C1169C04344"><enum>(1)</enum><header>Authority</header><text>The term <term>Authority</term> means the Federal Labor Relations Authority.</text> </paragraph> <paragraph id="H73ABB1E63FA94D9D9AC6AFD39E2E39B1"><enum>(2)</enum><header>Appropriate unit</header><text display-inline="yes-display-inline">The term <term>appropriate unit</term> means a bargaining unit of public employees or supervisory employees that share a community of interest, have a bargaining history or history of prior organization, and represent the desires of employees seeking representation.</text> </paragraph>
<paragraph id="H92FAD62FF8BA4B549FCA12F91DB7346C"><enum>(3)</enum><header>Collective bargaining</header><text>The term <term>collective bargaining</term>, used with respect to public employees, supervisory employees, and public employers, means the performance of the mutual obligation of the representative of a public employer and the exclusive representative of public employees and supervisory employees in an appropriate unit of the employer to meet at reasonable times and to consult and bargain in a good-faith effort to reach agreement with respect to wages, hours, and other terms and conditions of employment affecting such employees and to execute, if requested by either party, a written document incorporating any collective bargaining agreement reached, but the obligation referred to in this paragraph does not compel either party to agree to a proposal or to make a concession (as described in section 8(d) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158(d)</external-xref>)).</text> </paragraph> <paragraph id="H738942B81AC04F5BA9C4B1E9F2922D7A"><enum>(4)</enum><header>Confidential employee</header><text>The term <term>confidential employee</term> means an employee of a public employer who acts in a confidential capacity with respect to an individual who formulates or effectuates management policies in the field of labor-management relations.</text> </paragraph>
<paragraph id="H9EE48638B5A74A5CBFA1AC2BAF641376"><enum>(5)</enum><header>Covered person</header><text>The term <term>covered person</term> means an individual or a labor organization.</text> </paragraph> <paragraph id="H84A756765C054A70B71E2C432F42F6D7"><enum>(6)</enum><header>Emergency services employee</header><text>The term <term>emergency services employee</term> means—</text> 
<subparagraph id="HB32D675C81214285970A4D76A2E9CACF"><enum>(A)</enum><text>a public employee providing out-of-hospital emergency medical care, including an emergency medical technician, paramedic, or first responder; or</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H08691D0B1420435FBCB1A8202096EB9A"><enum>(B)</enum><text>a public employee providing other services in response to emergencies that have the potential to cause death or serious bodily injury, including an employee in fire protection activities (as defined in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>)).</text> </subparagraph></paragraph>
<paragraph id="H79F8BE4A093A413187E8B35D0BD2CDDC"><enum>(7)</enum><header>Employ</header><text>The term <term>employ</term> has the meaning given the term in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text> </paragraph> <paragraph id="H00E1725C0F4C4E858AD8DF4777BF0AB4"><enum>(8)</enum><header>Labor organization</header><text display-inline="yes-display-inline">The term <term>labor organization</term> means any organization of any kind that is not under the control directly or indirectly by a public employer in which such employees participate and which exists for the purpose, in whole or in part, of dealing with public employers concerning grievances, labor disputes, wages, rates of pay, hours of employment, or conditions of work.</text> </paragraph>
<paragraph id="H35F1331B04B04F76941A7A23D89A58CC"><enum>(9)</enum><header>Law</header><text>The term <term>law</term>, used with respect to a State or a political subdivision thereof, includes the application of the laws of such State or such political subdivision, including any regulations or ordinances issued by such State or such political subdivision.</text> </paragraph> <paragraph id="H83311194D60C4FDC89CF9FDAA9B74590"><enum>(10)</enum><header>Law enforcement officer</header><text>The term <term>law enforcement officer</term> has the meaning given such term in section 1204 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10284">34 U.S.C. 10284</external-xref>).</text> </paragraph>
<paragraph id="HB2CD6C3213BD4263B2DD22DA1E7A2903"><enum>(11)</enum><header>Management employee</header><text display-inline="yes-display-inline">The term <term>management employee</term> means an individual employed by a public employer in a position the duties and responsibilities of which require the individual to formulate or determine the policies of the employer.</text> </paragraph> <paragraph id="HE6CEB18398F143A2B24C8C2A56B3BB0D"><enum>(12)</enum><header>Public employee</header> <subparagraph id="H800D01DCC10A4866AC44CF24562B6BC2"><enum>(A)</enum><header>In general</header><text>The term <term>public employee</term>—</text> 
<clause id="H994E43946CF0479D98DD9F726B0D13E3"><enum>(i)</enum><text>means, except as provided in clause (iii), an individual, employed by a public employer, who in any workweek is engaged in commerce or is employed in an enterprise engaged in commerce;</text> </clause> <clause id="H08B14D41B38C4F66854C271016A9937C"><enum>(ii)</enum><text display-inline="yes-display-inline">includes an individual described in clause (i) who is temporarily transferred to a supervisory or management position; and</text> </clause>
<clause id="H8299B4D560954B4CAB2E4CF17F818197"><enum>(iii)</enum><text>does not include a supervisory employee, management employee, or confidential employee, or an elected official.</text> </clause></subparagraph> <subparagraph id="H5D3FF3B2A84A44958B83E2B665A74CBD"><enum>(B)</enum><header>Commerce; Enterprise engaged in commerce</header><text>For the purpose of this paragraph, the terms <term>commerce</term> and <term>enterprise engaged in commerce</term> have the meanings given such terms in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text> </subparagraph></paragraph>
<paragraph id="HA82B3B24477B472498538638A84F73FD"><enum>(13)</enum><header>Public employer</header><text>The term <term>public employer</term> means any of the following that employs individuals:</text> <subparagraph id="H3498DD6D6A0649D2968142113414345C"><enum>(A)</enum><text>A State or the political subdivision of a State, including a territory or political subdivision of a territory.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HB482F145619E438482F41F2E26A04A43"><enum>(B)</enum><text>Any authority, agency, school district, board or other entity controlled and operated by an entity described in subparagraph (A).</text> </subparagraph></paragraph> <paragraph id="H567BAF6AB0294B11ADE135A69B917708"><enum>(14)</enum><header>State</header><text>The term <term>State</term> means each of the several States of the United States, the District of Columbia, and any territory or possession of the United States (as defined in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>)).</text> </paragraph>
<paragraph commented="no" id="H581541D348D64930BA5C5AAF367F2AC3"><enum>(15)</enum><header>Substantially provide or substantially provides</header><text>The term <term>substantially provide</term> or <term>substantially provides</term>, used with respect to the rights and procedures described in section 3(b), means providing rights and procedures that are equivalent to or greater than each of the rights and procedures described in such section.</text> </paragraph> <paragraph id="HE54F376557664FA09442E44B1E6B5102"><enum>(16)</enum><header>Supervisory employee</header> <subparagraph id="HC98047DD4EFA43E685453672589EDDBE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the term <term>supervisory employee</term> means an individual, employed by a public employer, who in any workweek is engaged in commerce or is employed in an enterprise engaged in commerce and who—</text> 
<clause id="H1285628483BB4EF39A0645FD7200867B"><enum>(i)</enum><text>has the authority in the interest of the employer, if the exercise of such authority is not merely routine or clerical in nature but requires the consistent exercise of independent judgment, to—</text> <subclause id="H589FE9F74059480DA8D3FBFC45849B02"><enum>(I)</enum><text>hire, promote, reward, transfer, furlough, lay off, recall, suspend, discipline, or remove public employees;</text> </subclause>
<subclause id="HBEEFF4A057614F279D4E29C2D17A10A0"><enum>(II)</enum><text>adjust the grievances of public employees; or</text> </subclause> <subclause id="H1AFF0701B1294069B98C195B1E4F16AF"><enum>(III)</enum><text>effectively recommend any action described in subclause (I) or (II); and</text> </subclause></clause>
<clause id="HFF3F4C3B832A4F63928CA7506A261D25"><enum>(ii)</enum><text>devotes a majority of time at work to exercising the authority under clause (i).</text> </clause></subparagraph> <subparagraph id="H601BC74074F8419B8D396C601BEB7D66"><enum>(B)</enum><header>Commerce; enterprise engaged in commerce</header><text>For the purpose of this paragraph, the terms <term>commerce</term> and <term>enterprise engaged in commerce</term> have the meanings given such terms in section 3 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>).</text> </subparagraph></paragraph></subsection>
<subsection id="H472F5581A77A474B932540195566DCAF"><enum>(b)</enum><header>State law</header><text>If any term defined in this section has a substantially equivalent meaning to the term (or a substantially equivalent term) under applicable State law on the date of the enactment of this Act, such term (or substantially equivalent term) and meaning under such applicable State law shall apply with respect to the term defined under this Act with respect to such State.</text> </subsection></section> <section id="HE202D68522E647A08B396BEEDD47BBBF"><enum>3.</enum><header>Federal minimum standards</header> <subsection id="H7FCE32F6914141CF82F548CB91CACBD2"><enum>(a)</enum><header>Determination</header> <paragraph id="H6C398688675247D4B51C22962DDDC219"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Authority shall make a determination for each State as to whether the laws of such State substantially provide for each of the rights and procedures under subsection (b) and not later than 30 days after the enactment of this Act, the Authority shall establish procedures for the implementation of this section.</text> </paragraph>
<paragraph id="H0C64A21642014D77A227B5D728D3C50D"><enum>(2)</enum><header>Consideration of additional opinions</header><text display-inline="yes-display-inline">In making the determination under paragraph (1), the Authority shall consider the opinions of affected public employees, supervisory employees, labor organizations, and public employers. In the case where the Authority is notified by an affected public employer and labor organization that both parties agree that the law applicable to such employer and labor organization substantially provides for the rights and procedures described in subsection (b), the Authority shall give such agreement weight to the maximum extent practicable in making the Authority's determination under paragraph (1).</text> </paragraph> <paragraph id="H53CC6885C50F439BA869BCB0445426DB"><enum>(3)</enum><header>Limited criteria</header><text>In making the determination described in paragraph (1), the Authority may consider the criteria described in subsection (b) and not any other criteria.</text> </paragraph>
<paragraph id="HFD68171CEFEC4143B0A7748F4DE6361D"><enum>(4)</enum><header>Subsequent determinations</header> 
<subparagraph id="H064C0C0AE95342D48D0757525BB1CE42"><enum>(A)</enum><header>In general</header><text>A determination made pursuant to paragraph (1) shall remain in effect unless and until the Authority issues a subsequent determination, in accordance with the procedures set forth in subparagraph (B).</text> </subparagraph> <subparagraph id="HE8587A426A3C4477A6B4F86346F1EF3F"><enum>(B)</enum><header>Request</header><text display-inline="yes-display-inline">A public employee, supervisory employee, public employer, or labor organization may submit to the Authority a written request for a subsequent determination under paragraph (1) with respect to a State if a material change of law in the State has occurred.</text> </subparagraph>
<subparagraph id="HDA089442515349EC915730451F352CB9"><enum>(C)</enum><header>Issuance</header><text display-inline="yes-display-inline">Not later than 30 days after receipt of a request under subparagraph (B), the Authority shall issue a subsequent determination under paragraph (1) if satisfied that a material change of law in the State has occurred.</text> </subparagraph></paragraph> <paragraph id="H52E62D858C7046B9B1F9152F9A6EB81A"><enum>(5)</enum><header>Judicial review</header><text>Any covered person or public employer aggrieved by a determination of the Authority under paragraph (1) may, during the 60-day period beginning on the date on which the determination was made, petition any United States Court of Appeals, in the circuit in which the covered person or public employer resides or transacts business or in the Court of Appeals for the District of Columbia Circuit, for judicial review. In any judicial review of a determination made by the Authority under paragraph (1), the procedures contained in subsections (c) and (d) of section 7123 of title 5, United States Code, shall be followed.</text> </paragraph></subsection>
<subsection id="HE3D08F43E64A445B889F7B5666352818"><enum>(b)</enum><header>Federal minimum standard</header><text display-inline="yes-display-inline">The collective bargaining rights and procedures under this subsection are as follows:</text> <paragraph id="H5BB701F74A644310939AC0C672363C49"><enum>(1)</enum><text>A right of public employees and supervisory employees—</text> 
<subparagraph id="H7EF4A74030B84E2F9C65158C683F04A3"><enum>(A)</enum><text>to self-organization;</text> </subparagraph> <subparagraph id="H36EE3043FBF4499DBF32E33B6B05EDDF"><enum>(B)</enum><text display-inline="yes-display-inline">to form, join, or assist a labor organization or to refrain from any such activity;</text> </subparagraph>
<subparagraph id="HB500C49563AB45E8B0667FF5148C04C0"><enum>(C)</enum><text>to bargain collectively through representatives of their own choosing; and</text> </subparagraph> <subparagraph id="H9538F33E8BAE4CDEAD7B6A3FBE9C9320"><enum>(D)</enum><text display-inline="yes-display-inline">to engage in other concerted activities for the purpose of collective bargaining or other mutual aid (including the filing of joint class or collective legal claims) or protection.</text> </subparagraph></paragraph>
<paragraph id="H6D243469076D45F2A8A6B5A23F21D0AB"><enum>(2)</enum><text display-inline="yes-display-inline">A requirement for public employers to—</text> <subparagraph id="HA5895125326C468CACFE0E94CEB1533B"><enum>(A)</enum><text display-inline="yes-display-inline">recognize the labor organization of its public employees (freely chosen in an election by a majority of such employees voting in the appropriate unit or chosen by voluntary recognition if that method is permitted under State law), without requiring an election to recertify a labor organization that is already recognized as the representative of such employees, unless not less than 30 percent of such employees in the appropriate unit freely sign a petition to decertify such labor organization—</text> 
<clause id="H3AFD09825F2B4BFEBEC03AB4B311C97E"><enum>(i)</enum><text display-inline="yes-display-inline">not earlier than the date that is 1 year after the date of the election (or after a voluntary recognition if permitted under State law) of the representative;</text> </clause> <clause commented="no" id="HEBD74CC48FAC4451AE7ECECFCAA1DF0E"><enum>(ii)</enum><text>if a valid collective bargaining agreement covering such employees and labor organization expires, not earlier than the date that is 1 year after the expiration of such agreement; and</text> </clause>
<clause commented="no" id="id2D055281D2074C489EEC1B636CE37F90"><enum>(iii)</enum><text>not during the term of a valid collective bargaining agreement covering such employees and labor organization, except for the 30-day period beginning on the date that is 90 days before the expiration of such agreement;</text> </clause></subparagraph> <subparagraph id="H26FA177709C740B2A7BA1E07DD97949E"><enum>(B)</enum><text>collectively bargain with such recognized labor organization; and</text> </subparagraph>
<subparagraph id="H951165EF2F684FACBD030040A6F7D140"><enum>(C)</enum><text>commit any agreements with such recognized labor organization to writing in a contract or memorandum of understanding.</text> </subparagraph></paragraph> <paragraph id="H2E21309D0EB84C198B5A45D75FE6DCD4"><enum>(3)</enum><text>An interest impasse resolution mechanism that includes a procedure for the settlement of grievances (including fact-finding, mediation, and arbitration) and culminates in binding arbitration.</text> </paragraph>
<paragraph id="HD348F7D437084DADA5ABE58BE2429B47"><enum>(4)</enum><text>Payroll deduction of labor organization fees for any duly selected representative of public employees and supervisory employees pursuant to the terms of an authorization executed by such public employees.</text> </paragraph> <paragraph id="HDC4099D4839B4C73AB0EEEE6EC40F989"><enum>(5)</enum><text>The enforcement of all relevant rights and protections provided by the law in the applicable State and enumerated in this section, and of any written contract or memorandum of understanding between a labor organization and a public employer, through—</text> 
<subparagraph id="HA629D68BAB7D4D9B89949A43D9B95560"><enum>(A)</enum><text>a State administrative agency, if the State so chooses;</text> </subparagraph> <subparagraph id="HE8D5CA88585F4F3881E1BD18DE9A7B87"><enum>(B)</enum><text>at the election of an aggrieved party, the State courts; or</text> </subparagraph>
<subparagraph id="H7583544808A24C8FB6028452F818D357"><enum>(C)</enum><text>in the case of an alleged violation, misinterpretation, or misapplication of the contract or memorandum of understanding, a grievance resolution procedure negotiated in such contract or memorandum.</text> </subparagraph></paragraph></subsection> <subsection id="HA389F8C04C1840388F83E2D369E8FD22"><enum>(c)</enum><header>Compliance with rights and procedures</header><text>If the Authority determines under subsection (a) that the laws of a State substantially provide each of the rights and procedures described in subsection (b), then subsection (d) shall not apply.</text> </subsection>
<subsection id="H5E69A150AB6C487F8E6464D017040EE3"><enum>(d)</enum><header>Failure To substantially provide</header> 
<paragraph id="H9ADCDF1A1B804D8B89929FEEFC8F3C3B"><enum>(1)</enum><header>In general</header><text>If the Authority determines under subsection (a) that the laws of a State do not substantially provide for each of the rights and procedures described in subsection (b), then such State shall be subject to the rules and activities of the Authority under section 4 beginning on the later of—</text> <subparagraph id="H916BDDD157A942329D2F858DD68BD5CE"><enum>(A)</enum><text>the date that is 2 years after the date of enactment of this Act;</text> </subparagraph>
<subparagraph id="H045922D925774208B66D7EEB45A024C0"><enum>(B)</enum><text>the date that is the last day of the first regular session of the legislature of the State that begins after the date of the enactment of this Act; or</text> </subparagraph> <subparagraph id="H1ED1E45C07164566BC8CC06EEA62E332"><enum>(C)</enum><text>in the case of a State receiving a subsequent determination under subsection (a)(4), the date that is the last day of the first regular session of the legislature of the State that begins after the date the Authority made the determination.</text> </subparagraph></paragraph>
<paragraph id="H38A5A71FC36C47D3A5F454769565AC00"><enum>(2)</enum><header>Partial failure</header><text>If the Authority makes a determination that a State does not substantially provide for each of the rights and procedures described in subsection (b) because the State fails to substantially provide for all of such rights and procedures with respect to all public employees or supervisory employees, the Authority shall identify—</text> <subparagraph id="HFA251CEE7A3F4078A70B7A09AD9EC74C"><enum>(A)</enum><text display-inline="yes-display-inline">the categories of public employees or supervisory employees of such State that shall be subject to the rules and activities of the Authority under section 4, pursuant to section 7(b)(4), beginning on the applicable date under paragraph (1);</text> </subparagraph>
<subparagraph id="HD16E3B0FD0234FCAA820D2774836096B"><enum>(B)</enum><text display-inline="yes-display-inline">the categories of public employees and supervisory employees of such State that shall not be subject to the rules and activities of the Authority under section 4;</text> </subparagraph> <subparagraph id="H23CD277985B244AFAEA619A69C8E9E24"><enum>(C)</enum><text display-inline="yes-display-inline">the categories of rights and procedures described in subsection (b) for which the State does not substantially provide for certain public employees and supervisory employees; and</text> </subparagraph>
<subparagraph id="HBCABD76216844F8582AA4B4CE010E922"><enum>(D)</enum><text>the categories of rights and procedures described in such subsection for which the State substantially provides for all employees.</text> </subparagraph></paragraph></subsection></section> <section id="HBE4E6FE848FF429DB2C20CA95A7ADFE6"><enum>4.</enum><header>Minimum standards administered by the Federal Labor Relations Authority</header> <subsection id="H15D296CEF52D40798A66D93435150D06"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Authority shall issue rules and take such actions that the Authority determines appropriate to establish and administer collective bargaining rights and procedures that substantially provide for the rights and procedures described in section 3(b) for States described in section 3(d).</text> </subsection>
<subsection id="HEC249EB79C4C4104AE38B18BBD3606D3"><enum>(b)</enum><header>Role of the Federal Labor Relations Authority</header><text>In carrying out subsection (a), the Authority shall—</text> <paragraph id="H8FC3DD2CE9AD4E3D9E594797ACAC4666"><enum>(1)</enum><text>protect the right of public employees—</text> 
<subparagraph id="H78C4F3ED7B5A4A1DB79A04059F97B30B"><enum>(A)</enum><text>to self-organization;</text> </subparagraph> <subparagraph id="HA53ADAA15015447F9F3185BA7F93D25C"><enum>(B)</enum><text>to form, join, or assist any labor organization or to refrain from any such activity;</text> </subparagraph>
<subparagraph id="H020B38DCAC40491EB41EF8E16D994F15"><enum>(C)</enum><text>to bargain collectively through representatives of their own choosing; and</text> </subparagraph> <subparagraph id="H9E173F7A2EF84C7BB4F343150FB1AED4"><enum>(D)</enum><text display-inline="yes-display-inline">to engage in other concerted activities for the purpose of collective bargaining or other mutual aid (including the filing of joint class or collective legal claims) or protection;</text> </subparagraph></paragraph>
<paragraph id="HE4AF8276C904445FAAEBFB63685F903B"><enum>(2)</enum><text display-inline="yes-display-inline">supervise or conduct elections to determine whether a labor organization has been selected as an exclusive representative by a majority of the public employees and supervisory employees voting in such election in an appropriate unit;</text> </paragraph> <paragraph id="HE94B99F4DDE1468CA1F32F94EDEAF867"><enum>(3)</enum><text display-inline="yes-display-inline">provide for the payroll deduction of labor organization fees to any such duly elected exclusive representative pursuant to the terms of an authorization executed by a public employee or supervisory employee;</text> </paragraph>
<paragraph id="H188215DC3CC4487887D2A9C9EE913325"><enum>(4)</enum><text>determine the appropriateness of units for labor organization representation;</text> </paragraph> <paragraph id="HA7FC3A950818484393B92DE8272BC86F"><enum>(5)</enum><text display-inline="yes-display-inline">require public employers to—</text> 
<subparagraph id="HA4125F03FD6B42218237752178F01B54"><enum>(A)</enum><text display-inline="yes-display-inline">recognize the labor organization of its public employees or supervisory employees (freely chosen by a majority of such employees voting in the appropriate unit) as the exclusive representative of such employees;</text> </subparagraph> <subparagraph id="HBC5E806955E946179E3771D7979C26C7"><enum>(B)</enum><text display-inline="yes-display-inline">bargain in good faith with such labor organization concerning public employees' or supervisory employees’ terms and conditions of employment, which shall include a procedure for the settlement of grievances culminating in binding arbitration in any agreement and a procedure for resolving any impasses in collective bargaining; and</text> </subparagraph>
<subparagraph id="H8D54BD859A0A469CBB634D1FACF9DCA9"><enum>(C)</enum><text>commit any agreements to writing in a contract or memorandum of understanding;</text> </subparagraph></paragraph> <paragraph id="HFDA0C764AEB54C2AA982247E89A0907B"><enum>(6)</enum><text display-inline="yes-display-inline">prohibit practices which interfere with, coerce, or intimidate public employees or supervisory employees in the exercise of rights guaranteed in paragraph (1) or regulations issued thereunder;</text> </paragraph>
<paragraph id="H6A18A52CFF6D4F14B003A5520203CF0A"><enum>(7)</enum><text>conduct hearings and resolve complaints concerning violations of any rule or order issued by the Authority pursuant to this Act;</text> </paragraph> <paragraph id="H3767BE5722AE4E02A2B8F389E1390ADB"><enum>(8)</enum><text display-inline="yes-display-inline">resolve exceptions to the awards of arbitrators that violate or exceed the scope of public policy; and</text> </paragraph>
<paragraph id="H5A8BC1F2D7FF495B954F2E4D77A84884"><enum>(9)</enum><text>take such other actions as are necessary and appropriate to effectively administer this Act, including issuing subpoenas requiring the attendance and testimony of witnesses and the production of documentary or other evidence from any place in the United States, administering oaths, taking or ordering the taking of depositions, ordering responses to written interrogatories, and receiving and examining witnesses.</text> </paragraph></subsection> <subsection id="H7DF609B35F0D41C4B490BA617A23065C"><enum>(c)</enum><header>Enforcement</header> <paragraph id="H5FB4C2DF7C51432D82DC9780A29D888E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Authority may issue an order directing compliance by any covered person or public employer found to be in violation of this section, and may petition any United States Court of Appeals with jurisdiction over the parties, or the United States Court of Appeals for the District of Columbia Circuit, to enforce any such final orders issued pursuant to this section or pursuant to rules issued under this section, and for appropriate temporary relief or a restraining order. Any covered person or public employer aggrieved by an order issued by the Authority under this section may, during the 60-day period beginning on the date on which the order was issued, petition any United States Court of Appeals, in the circuit which the covered person or public employer resides or transacts business or in the Court of Appeals for the District of Columbia Circuit, for judicial review. Any petition or appeal under this section shall be conducted in accordance with subsections (c) and (d) of section 7123 of title 5, United States Code.</text> </paragraph>
<paragraph id="H34FEBFCC84C944BFA182D94789E48165"><enum>(2)</enum><header>Private right of action</header> 
<subparagraph id="H11CCCA548A6B449BBA3990C699BC8260"><enum>(A)</enum><header>Filing a civil action</header><text display-inline="yes-display-inline">Unless the Authority has filed an order of enforcement as provided in paragraph (1), any party may, after the 180-day period following the filing of a charge with the Authority pursuant to the rules issued by the Authority under this section, file a civil action against any named State administrator in an appropriate district court of the United States to enjoin such administrator to enforce compliance—</text> <clause id="H9CED7A8810AF45E585A8F39647E85B19"><enum>(i)</enum><text>with this Act or the rules issued by the Authority under this section; or</text> </clause>
<clause id="HB10CD08D899C4C5DA8C6AA069C684234"><enum>(ii)</enum><text>to enforce compliance with any order issued by the Authority.</text> </clause></subparagraph> <subparagraph id="H0F4E4429892542A09192CF3FA8B86234"><enum>(B)</enum><header>Timing</header><text display-inline="yes-display-inline">Any civil action brought under subparagraph (A) shall be brought not later than the earlier of—</text> 
<clause id="H8EA40E4198D242F89B89C27A856344FC"><enum>(i)</enum><text display-inline="yes-display-inline">the date that is 180 days after the expiration of the 180-day period described in subparagraph (A); or</text> </clause> <clause id="H8403CCACDBB64A21AB827BA6E73860A7"><enum>(ii)</enum><text display-inline="yes-display-inline">the date that is 180 days after the date that the Authority dismisses a charge described in subparagraph (A).</text> </clause></subparagraph>
<subparagraph id="HC4A984F58ACC47D79A3DF1D9462E97D3"><enum>(C)</enum><header>Notice</header><text display-inline="yes-display-inline">A party filing a civil action under subparagraph (A) shall provide notice of such action to the Authority not later than the date of the filing of such action.</text> </subparagraph> <subparagraph id="HB0B4D9E02DAA46A38C4C4244F16656D7"><enum>(D)</enum><header>Jurisdiction and attorneys’ fees</header><text display-inline="yes-display-inline">An appropriate district court of the United States in which a civil action under subparagraph (A) is filed shall have jurisdiction over such action without regard to the amount in controversy or the citizenship of the parties and may award reasonable attorneys’ fees.</text> </subparagraph></paragraph></subsection></section>
<section id="H08B7CD949DE143A6AE06E4078DBF94D1"><enum>5.</enum><header>Lockouts and employee strikes prohibited when emergency or public safety services imperiled</header> 
<subsection id="HE37DDABF912A408091D85F94E7D575AE"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), any employer, emergency services employee, or law enforcement officer subject to the rules and activities of the Authority under section 4 may not engage in a lockout, strike, or any other organized job action of which a reasonably probable result is a measurable disruption of the delivery of emergency or public safety services. No labor organization may cause or attempt to cause a violation of this subsection.</text> </subsection> <subsection id="H3A604CB64306420FB7062948E5ECF238"><enum>(b)</enum><header>No preemption</header><text>Nothing in this section shall be construed to preempt any law of any State or political subdivision of any State with respect to strikes by emergency services employees or law enforcement officers.</text> </subsection></section>
<section id="HD580B585BE734880B076E140591F996B"><enum>6.</enum><header>Existing collective bargaining units and agreements</header><text display-inline="no-display-inline">The enactment of this Act shall not invalidate any certification, recognition, result of an election, collective bargaining agreement, or memorandum of understanding that—</text> <paragraph id="H0DD370409615401EAA782DE2CB5D28D6"><enum>(1)</enum><text display-inline="yes-display-inline">has been issued, approved, or ratified by any public employee relations board or commission, or by any State or political subdivision or an agent or management official of such State or political subdivision; and</text> </paragraph>
<paragraph id="H2FF73472CE054D639CB6342430899FF5"><enum>(2)</enum><text display-inline="yes-display-inline">is in effect on the day before the date of enactment of this Act.</text> </paragraph></section> <section id="H752269EA61F64CF69A8553D57AB9DB34"><enum>7.</enum><header>Exceptions</header> <subsection id="H3390BF12BD1A45F79B73C7400CF85933"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Authority shall not make a determination under section 3(a) that the laws of a State do not substantially provide for the rights and procedures under section 3(b) on the basis that relevant laws in the State—</text> 
<paragraph commented="no" id="HB4F0502741BC4BAA9FDDECCBC73C43BA"><enum>(1)</enum><text display-inline="yes-display-inline">permit a public employee or supervisory employee to appear on the employee's own behalf with respect to the relationship of the public employee or supervisory employee with the public employer involved;</text> </paragraph> <paragraph commented="no" id="HEFFDB20E7D4A4B0886FAF955958F6078"><enum>(2)</enum><text display-inline="yes-display-inline">do not cover public employees or supervisory employees of the State militia or national guard; or</text> </paragraph>
<paragraph commented="no" id="H50195FDC4B1147FE96C23E333438236F"><enum>(3)</enum><text>do not apply to a political subdivision of a State if—</text> <subparagraph commented="no" id="HB23545C4DF534FE8B0CBC682B66C0E21"><enum>(A)</enum><text>such political subdivision has a population of fewer than 5,000 people or employs fewer than 25 public employees; and</text> </subparagraph>
<subparagraph commented="no" id="H8873DFA873194875A363E34BF9E4525E"><enum>(B)</enum><text>the State in which such political subdivision is located notifies the Authority that such subdivision is exempt from such laws before the date on which the Authority makes the determination.</text> </subparagraph></paragraph></subsection> <subsection id="H2F57C22F0FC4494A9C60A8A2B10F074F"><enum>(b)</enum><header>Compliance</header> <paragraph id="H0E793A66905B433A9B98AEE04A2C23F9"><enum>(1)</enum><header>Actions of States</header><text>Nothing in this Act shall be construed to require a State to rescind or preempt the laws of any political subdivision of the State if such laws substantially provide for the rights and procedures described in section 3(b).</text> </paragraph>
<paragraph id="H528AA851F50243CAA793741D6C46A4F5"><enum>(2)</enum><header>Actions of the District of Columbia</header><text display-inline="yes-display-inline">Nothing in this Act or in the rules issued under this Act shall be construed—</text> <subparagraph id="H05EC62C7188E49098D15001A3A545AEF"><enum>(A)</enum><text display-inline="yes-display-inline">to require the District of Columbia to rescind—</text> 
<clause id="H53CA9781C77246819A209BAFBE33E169"><enum>(i)</enum><text>section 501 of the District of Columbia Government Comprehensive Merit Personnel Act of 1978 (1–605.01, D.C. Official Code), establishing the Public Employee Relations Board of the District of Columbia; or</text> </clause> <clause id="HCDB424B13018427D80D52BC9701C9375"><enum>(ii)</enum><text>section 502 of such Act (1–605.02, D.C. Official Code), establishing the power of the Board;</text> </clause></subparagraph>
<subparagraph id="HCC9FEAF702754D2888C92263690DBEFC"><enum>(B)</enum><text>to preempt the laws described in subparagraph (A); or</text> </subparagraph> <subparagraph id="H4417D6730B814CA7884D9357298333AF"><enum>(C)</enum><text>to limit or alter the powers of the government of the District of Columbia pursuant to the District of Columbia Home Rule Act (<external-xref legal-doc="public-law" parsable-cite="pl/93/198">Public Law 93–198</external-xref>; 1–201.01 et seq., D.C. Official Code).</text> </subparagraph></paragraph>
<paragraph id="H8FF7FE509C3A4F1AA31C0C59A9426E30"><enum>(3)</enum><header>Actions of the authority</header><text>Nothing in this Act shall be construed to preempt—</text> <subparagraph id="H6892C4B77D24437F81C5CB20303DB02F"><enum>(A)</enum><text>the laws of any State or political subdivision of a State that substantially provide for the rights and procedures described in section 3(b);</text> </subparagraph>
<subparagraph id="H5C9505727D754B3B937E349AA53A90BF"><enum>(B)</enum><text>the laws of any State or political subdivision of a State that substantially provide for the rights and procedures described in section 3(b), solely because such laws provide that a contract or memorandum of understanding between a public employer and a labor organization must be presented to a legislative body as part of the process for approving such contract or memorandum of understanding; or</text> </subparagraph> <subparagraph id="HB878D516829F4336861E1E6FC3BBA9B2"><enum>(C)</enum><text display-inline="yes-display-inline">the laws of any State or political subdivision of a State that permit or require a public employer to recognize a labor organization on the basis of signed authorizations executed by employees designating the labor organization as their representative.</text> </subparagraph></paragraph>
<paragraph id="HBD868494D4C040F087584F3A92F64329"><enum>(4)</enum><header>Limited enforcement power</header><text display-inline="yes-display-inline">In the case of a law described in section 3(d)(2), the Authority shall only exercise the authority under section 4 with respect to the categories of public employees or supervisory employees for whom State law does not substantially provide the rights and procedures described in section 3(b).</text> </paragraph></subsection></section> <section id="H66968E1C17654769BFBF4FAF6B31A4B5"><enum>8.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out this Act.</text></section>
