Russell National School Lunch Act to prohibit the stigmatization of
			 children who are unable to pay for school meals, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="HA48C336926224FC38A951D8FD37EB0C8" style="OLC">
 <section id="idC92A38F2F87047F5BBF2874DFC23D80B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Shame at School Act of 2019</short-title></quote>.</text> </section><section id="H0BDA7C3EA1EB4E6285E07B738849F5E9"><enum>2.</enum><header>Mandatory certification</header><text display-inline="no-display-inline">Section 9(b)(5) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(5)</external-xref>) is amended—</text>
 <paragraph id="H01354C50584F4514B29FE055406FBA26"><enum>(1)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">Discretionary</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Mandatory</header-in-text></quote>; and</text> </paragraph><paragraph id="H8C829CB74C7543929A9D189B6AE28EF0"><enum>(2)</enum><text>in the matter preceding subparagraph (A), by striking <quote>may</quote> and inserting <quote>shall</quote>.</text>
 </paragraph></section><section id="HCE4976B3CE1541CEB0FEAAB11228CEC8"><enum>3.</enum><header>Retroactive reimbursement</header><text display-inline="no-display-inline">Section 9(b)(9) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(9)</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id8FD5CD8EDE11472A8787805125D0A2FF" style="OLC">
				<subparagraph id="id6796E494A0E945068A62817338A151B0"><enum>(D)</enum><header>Retroactive reimbursement</header>
 <clause id="HA8724BBE5BDB46C583CF38DC7F56DC54"><enum>(i)</enum><header>Definitions</header><text>In this subparagraph:</text> <subclause commented="no" id="id8F8DA449F698423884ED17E20D6BA947"><enum>(I)</enum><header>Change in eligibility</header><text>The term <quote>change in eligibility</quote> means, with respect to eligibility for the school lunch program under this Act—</text>
 <item commented="no" id="idF5470B2E874347A3A0BED5C826578083"><enum>(aa)</enum><text>a change from eligibility for reduced price meals to eligibility for free meals; and</text> </item><item commented="no" display-inline="no-display-inline" id="id922148ED24574AD18C0357331EE76DB2"><enum>(bb)</enum><text>a change from noneligibility to eligibility for free or reduced price meals.</text>
 </item></subclause><subclause id="idAAD8A74F53FD4CCBBBF83FC5A3697A22"><enum>(II)</enum><header>Meal claim</header><text display-inline="yes-display-inline">The term <term>meal claim</term> means any documentation provided by a school food authority to a State agency in order to receive reimbursement under this Act for the cost of a meal served to a child by the school food authority.</text>
 </subclause><subclause commented="no" id="id1C8C60409E5F46BF9C9FD4A446CC5A7E"><enum>(III)</enum><header>Previously submitted</header><text display-inline="yes-display-inline">The term <quote>previously submitted</quote>, with respect to a meal claim, means a meal claim submitted on or after the retroactive date.</text> </subclause><subclause commented="no" id="id125AB9F8056941A3BBD55552835BFA06"><enum>(IV)</enum><header>Retroactive date</header><text display-inline="yes-display-inline">The term <quote>retroactive date</quote> means the date that is the earlier of—</text>
 <item commented="no" id="id34B52725370445098201C7F75E90DA28"><enum>(aa)</enum><text display-inline="yes-display-inline">the first day of the current school year; and</text> </item><item commented="no" display-inline="no-display-inline" id="id317CF7E2BA5E45F28991DC1835ABA589"><enum>(bb)</enum><text display-inline="yes-display-inline">the date that is 90 days prior to the date of a change in eligibility of a child.</text>
							</item></subclause></clause><clause commented="no" id="id9893B07CAA5B4D79A9438C02C9783710"><enum>(ii)</enum><header>Retroactivity</header>
 <subclause commented="no" id="id4E01D3BD7299471998FFC12B7C5FE455"><enum>(I)</enum><header>Submission of meal claims</header><text display-inline="yes-display-inline">A local educational agency shall—</text> <item commented="no" id="id64643B7E5BFA453F9DCF9AB8EE5D6DC0"><enum>(aa)</enum><text display-inline="yes-display-inline">revise and resubmit a previously submitted meal claim to reflect a change in eligibility described in subclause (i)(I)(aa) of a child; and</text>
 </item><item commented="no" id="idD12646BF2AF84082BDAFBE31998817AC"><enum>(bb)</enum><text>submit a meal claim for any meal provided on or after the retroactive date for a child that has a change of eligibility described in subclause (i)(I)(bb).</text>
 </item></subclause><subclause commented="no" id="id44CD7DDD497A400BA17FCDFB1E09E770"><enum>(II)</enum><header>Reimbursement</header><text>The Secretary shall reimburse each meal claim submitted by a local educational agency under subclause (I).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H4B0196A7FAE94ECBA175E7E2749EEB06"><enum>4.</enum><header>Reducing stigma associated with unpaid school meal fees</header><text display-inline="no-display-inline">Section 9(b) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)</external-xref>) is amended by striking paragraph (10) and inserting the following:</text>

				<paragraph commented="no" id="HC66BB7B1FC2F4B4180143100F748D47C"><enum>(10)</enum><header>Reducing stigma associated with unpaid school meal fees</header>
 <subparagraph commented="no" id="H41E2567EFE8243D5A223057BE3023FBD"><enum>(A)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text> <clause commented="no" id="H515EAAB59BFC4B93BE327E56884390B7"><enum>(i)</enum><header>Covered child</header><text display-inline="yes-display-inline">The term <term>covered child</term> means a child who—</text>
 <subclause id="HCF7856A3F4B84472BB2D3EA10003F3A3"><enum>(I)</enum><text>is enrolled in a school that participates in the school lunch program under this Act or the school breakfast program under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>); and</text>
 </subclause><subclause commented="no" id="H2F975BB54A174F2ABA4FA3A333926A2F"><enum>(II)</enum><text>is a member of a household that owes unpaid school meal fees.</text> </subclause></clause><clause commented="no" id="H506E9A0A0215464FA656353CB5ACEEF4"><enum>(ii)</enum><header>Unpaid school meal fees</header><text display-inline="yes-display-inline">The term <term>unpaid school meal fees</term> means outstanding fees owed by a household to a local educational agency for lunch provided under this Act or breakfast provided under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>).</text>
 </clause></subparagraph><subparagraph commented="no" id="H279A03CBDB3444F5B6DC08ADE8082794"><enum>(B)</enum><header>Overt identification prohibited</header><text>A local educational agency or school food authority may not, based on the status of a covered child as a covered child—</text>
 <clause commented="no" id="H0E9059F73E754F048597CF5BDF4E4E99"><enum>(i)</enum><text>physically segregate the covered child;</text> </clause><clause commented="no" id="H597092C45DD24D00BC6A66674FB3A059"><enum>(ii)</enum><text>overtly identify the covered child—</text>
 <subclause commented="no" id="H521852E0241746C59ED301C95A754280"><enum>(I)</enum><text>through the use of special tokens or tickets; or</text> </subclause><subclause commented="no" id="H483F9C0071634887B04D06560C1CA727"><enum>(II)</enum><text>by an announcement or a published list of names; or</text>
 </subclause></clause><clause commented="no" id="H14995E6B373B42E3BA2B6BAA4564A0C3"><enum>(iii)</enum><text>identify or stigmatize the covered child by any other means.</text> </clause></subparagraph><subparagraph commented="no" id="HBB9E40B5C8EB4994A35F405E149CFD92"><enum>(C)</enum><header>Eligibility determination by local educational agency</header><text>For any covered child who is a member of a household that has unpaid school meal fees for 1 consecutive week of meals or more, a local educational agency shall—</text>
 <clause commented="no" id="H2F2A3AE2BB084D8EA2A1C90788E1EE10"><enum>(i)</enum><text>attempt to directly certify the covered child for free meals under paragraph (4) or (5); or</text> </clause><clause commented="no" id="H0B49E92BF89845B6997192E33A730578"><enum>(ii)</enum><text>in a case where the local educational agency is not able to directly certify the covered child under paragraph (4) or (5), provide to the household of the covered child—</text>
 <subclause commented="no" id="HFC1206F5FA014E47AAABA2C361D28074"><enum>(I)</enum><text>a household application for free or reduced price lunch under this Act and free breakfast under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) and applicable descriptive material; and</text>
 </subclause><subclause commented="no" id="H317B6152907A41DBB4F8E6650A0E474D"><enum>(II)</enum><text>written and oral communication to encourage submission of the application described in subclause (I).</text>
 </subclause></clause></subparagraph><subparagraph commented="no" id="HD3917D8481994D2586F679D9BC9C1807"><enum>(D)</enum><header>Collection of unpaid school meal fees</header><text>In attempting to collect unpaid school meal fees from a household, a local educational agency or school food authority may not—</text>
 <clause commented="no" id="H41C63E1B12D845F6B1447A3A46CA3EF1"><enum>(i)</enum><text>except as described in subparagraph (E), direct any communication regarding unpaid school meal fees to a covered child who is a member of the household;</text>
 </clause><clause commented="no" id="HEE97B58B21F64789B0E01F2C7CF9DB77"><enum>(ii)</enum><text>withhold educational opportunities from, or otherwise stigmatize, a covered child due to the status of the covered child as a covered child; or</text>
 </clause><clause commented="no" id="H73A6B18D5096499D8E6B5E2935A806CD"><enum>(iii)</enum><text>use a debt collector (as defined in section 803 of the Consumer Credit Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692a">15 U.S.C. 1692a</external-xref>)).</text>
						</clause></subparagraph><subparagraph commented="no" id="H64477D7DF3FE49819AEA241D0B862D84"><enum>(E)</enum><header>Letters</header>
 <clause commented="no" id="id20B9DAD26B344415BD04E7895D68AF62"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), a school food authority may request a covered child to deliver a letter addressed to a parent or guardian of the covered child that contains a communication relating to unpaid school meal fees.</text>
 </clause><clause commented="no" id="id601422C3AF19436E8D9968B2637CAC95"><enum>(ii)</enum><header>Condition</header><text>In carrying out clause (i), a school food authority shall not provide the letter to the covered child in a manner that stigmatizes the covered child.</text>
 </clause></subparagraph><subparagraph commented="no" id="HC14C5FD2825F408182D25798458CA1E2"><enum>(F)</enum><header>Eliminating stigma in meal service</header><text>In providing a meal to a covered child, a local educational agency or school food authority may not, based on the status of the covered child as a covered child, dispose of or take away from the covered child any food that has already been served to the covered child.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HC94A4B001BA04F0D86ABE99A201B5F3B"><enum>5.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the Secretary of Agriculture should ensure, to the maximum extent practicable, that a school food authority that participates in the school lunch program under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751</external-xref> et seq.) or the school breakfast program under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) shall provide to a child who requests a lunch or breakfast the same lunch or breakfast provided to students not certified to receive free or reduced price school lunch or breakfast under those Acts, regardless of the ability of the child to pay for the lunch or breakfast requested.</text></section></legis-body></bill>
