or</text></subparagraph><subparagraph id="id235c6f4ae08343bb8f4b9effb0b0dbaf"><enum>(B)</enum><text>investigates missing persons cases of interest to Indian tribes, murder cases of interest to Indian tribes, or unidentified remains cases of interest to Indian tribes.</text></subparagraph></paragraph><paragraph id="idD05E141296D242978376E34B0179FDAA"><enum>(3)</enum><header>Indian</header><text display-inline="yes-display-inline">The term <term>Indian</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="idE7268DCE097544BF964416DBBC27D8E7"><enum>(4)</enum><header>Indian country</header><text display-inline="yes-display-inline">The term <term>Indian country</term> has the meaning given the term in section 1151 of title 18, United States Code.</text></paragraph><paragraph id="idE20A38B5FDE84A3993912D4C579CB2CA"><enum>(5)</enum><header>Indian land</header><text>The term <term>Indian land</term> has the meaning given the term <term>Indian lands</term> in section 3 of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4302">25 U.S.C. 4302</external-xref>).</text></paragraph><paragraph id="id79ED29261EA849E59782F62536DF00B0"><enum>(6)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" id="id541E1BC7A09743428F3E55D141E13BD4"><enum>(7)</enum><header>Manslaughter</header><text display-inline="yes-display-inline">The term <term>manslaughter</term> has the meaning given the term in section 1112 of title 18, United States Code.</text></paragraph><paragraph commented="no" id="id6254A7C363994E3E83D87C7F76756EE2"><enum>(8)</enum><header>Missing</header><text display-inline="yes-display-inline">The term <term>missing</term> has the meaning determined by the applicable Federal law enforcement agency.</text></paragraph><paragraph commented="no" id="id0C8B6AABBB1744E18435940DF858143F"><enum>(9)</enum><header>Missing persons case of interest to Indian tribes</header><text>The term <term>missing persons case of interest to Indian tribes</term> means a case involving—</text><subparagraph commented="no" id="idAD52F5A54DAE4D909E02F965EF156AC9"><enum>(A)</enum><text>a missing Indian; or</text></subparagraph><subparagraph id="ida353156d53f0451485ff3f71c70616b4"><enum>(B)</enum><text>a missing person whose last known location is believed to be on, in, or near Indian land.</text></subparagraph></paragraph><paragraph commented="no" id="id7475450AD6D84FA690CD9CCB4BCD02D7"><enum>(10)</enum><header>Murder</header><text>The term <term>murder</term> has the meaning given the term in section 1111 of title 18, United States Code.</text></paragraph><paragraph id="id467422e8ae474ee08034ef83f9228f90"><enum>(11)</enum><header>Murder case of interest to Indian tribes</header><text>The term <term>murder case of interest to Indian tribes</term> means a case involving—</text><subparagraph id="id1d6ad7ed45404bdda4accb655857e508"><enum>(A)</enum><text>a murdered Indian; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id322b28a6129d46708efb7ef2e0ef94d6"><enum>(B)</enum><text>a person murdered on, in, or near Indian land.</text></subparagraph></paragraph><paragraph commented="no" id="idCBE5340CFB1D4AF4B454B131074A239E"><enum>(12)</enum><header>Murdered</header><text display-inline="yes-display-inline">The term <term>murdered</term>, with respect to a person, means the person was the victim of—</text><subparagraph commented="no" id="idEB9FA962BBAA44B996D63DD4EC8E1E07"><enum>(A)</enum><text display-inline="yes-display-inline">murder; or</text></subparagraph><subparagraph commented="no" id="id7A507C99E24A4C2DBCEB66B8FF1FDE5D"><enum>(B)</enum><text>manslaughter.</text></subparagraph></paragraph><paragraph commented="no" id="id1c3a7281617d4a67adccba90a88a6d86"><enum>(13)</enum><header>National crime information databases</header><text>The term <term>national crime information databases</term> has the meaning given the term in section 534(f)(3) of title 28, United States Code.</text></paragraph><paragraph id="id97BA10273478498680FCB01B1EBF6FD3"><enum>(14)</enum><header>Relevant Tribal stakeholder</header><text display-inline="yes-display-inline">The term <term>relevant Tribal stakeholder</term> means, as applicable—</text><subparagraph id="idE1867D1EA10B4BDD89E394EB2E2CC827"><enum>(A)</enum><text display-inline="yes-display-inline">an Indian tribe;</text></subparagraph><subparagraph id="id3E08123EE99544DCB545EAA0530B9C69"><enum>(B)</enum><text display-inline="yes-display-inline">a tribal organization; and</text></subparagraph><subparagraph id="id32B65EDBC56D4ADDBEB11CB2B54D9308"><enum>(C)</enum><text display-inline="yes-display-inline">a national or regional organization that—</text><clause id="id5399D450EE0F47F8ADEF5C13A6868AD0"><enum>(i)</enum><text display-inline="yes-display-inline">represents a substantial Indian constituency; and</text></clause><clause id="idE1B4D1F70A1A4BD0993B22AD5BB4EF43"><enum>(ii)</enum><text display-inline="yes-display-inline">has expertise in the fields of—</text><subclause id="id4179F6CB15E9409A8FFDB3733691FBA9"><enum>(I)</enum><text display-inline="yes-display-inline">human trafficking;</text></subclause><subclause id="idC8D3DD6BD9994D80B4D6E9F54A4073FC"><enum>(II)</enum><text display-inline="yes-display-inline">violence against women and children; or</text></subclause><subclause id="idED24E0453495437EA01ED3F64EDE1C2E"><enum>(III)</enum><text display-inline="yes-display-inline">Tribal justice systems.</text></subclause></clause></subparagraph></paragraph><paragraph id="id23D1BFD677D6484B96E36369B50FC619"><enum>(15)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id095ef729b39a4b8c832cb0dfbf46ffb2"><enum>(16)</enum><header>Tribal justice official</header><text>The term <term>tribal justice official</term> has the meaning given the term in section 2 of the Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2801">25 U.S.C. 2801</external-xref>).</text></paragraph><paragraph id="id3e0732b34191454abb94c297dc0c0e6b"><enum>(17)</enum><header>Tribal organization</header><text>The term <term>tribal organization</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id56dc603e36d746fc8c631a5b5020f74b"><enum>(18)</enum><header>Unidentified remains case of interest to Indian tribes</header><text>The term <term>unidentified remains case of interest to Indian tribes</term> means a case involving—</text><subparagraph id="id70d067e25ff7453d93ded5e285b875be"><enum>(A)</enum><text>unidentified Indian remains; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id77e4ae536ffa43a58bc6c1fcb8f62022"><enum>(B)</enum><text>unidentified remains found on, in, or near Indian land.</text></subparagraph></paragraph></section><title id="idD69824CA1246458B82184A462BCC5B1C" style="OLC" changed="deleted" reported-display-style="strikethrough" committee-id="SLIA00"><enum>I</enum><header>Bridging agency data gaps</header><section id="id938707189840488582585237fea97455"><enum>101.</enum><header>Federal law enforcement database reporting requirements</header><subsection id="idaf0233eb5204430aa0fa8aeab8e7b53d"><enum>(a)</enum><header>In general</header><text>Section 151(a) of the Sex Offender Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/34/20961">34 U.S.C. 20961(a)</external-xref>) is amended—</text><paragraph id="ide13d19b2def342bdaeb6df82af0b4691"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="idb1e7761cfdeb44dc9421c49254bb1669"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></paragraph><paragraph id="idc2b0afcaab7e401da3f2a80a561e1585"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="id4b9a657cc84f44c1a4054915f46de4c5" style="OLC" changed="deleted" reported-display-style="strikethrough" committee-id="SLIA00"><paragraph id="ide1601a7e46fc4542a18f76678801d147"><enum>(2)</enum><text>the National Missing and Unidentified Persons System, to be used by a person accessing the System only within the scope of the work of the person in assisting or supporting law enforcement efforts to solve missing, unidentified, and unclaimed person cases across the United States; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id550206fad8c64c7e93dc56f45e90d140"><enum>(b)</enum><header>Sharing of information</header><text>Not later than 2 years after the date of enactment of this Act, the Attorney General shall, in a manner that maintains the integrity of confidential, private, and law enforcement sensitive information, provide for information on missing persons and unidentified remains contained in national crime information databases to be transmitted to, entered in, and otherwise shared with the National Missing and Unidentified Persons System.</text></subsection><subsection id="idAA2641B7DEDA4384BAF14B98C337CFB1"><enum>(c)</enum><header>Temporary reporting requirements</header><text>Until such time as the data sharing procedures required under subsection (b) are in effect, each Federal law enforcement agency shall enter into the National Missing and Unidentified Persons System each missing persons case of interest to Indian tribes and each unidentified remains case of interest to Indian tribes reported to or investigated by the Federal law enforcement agency.</text></subsection><subsection id="id4dd777ebab5f40b5960721af89f025e0"><enum>(d)</enum><header>Coordination with NamUs Tribal liaison</header><text>The Director and the Director of the Federal Bureau of Investigation shall each appoint a liaison to coordinate with the 1 or more Tribal liaisons appointed under section (4)(a) to ensure that—</text><paragraph id="id0795E93662C24E248EE8F3E8CC0D951C"><enum>(1)</enum><text>all missing persons cases of interest to Indian tribes and all unidentified remains cases of interest to Indian tribes are fully captured in the National Missing and Unidentified Persons System; and</text></paragraph><paragraph id="idAD196739192D41BB92075E7FBF8370B0"><enum>(2)</enum><text>Indian tribes are aware of, and able to access, information in the National Missing and Unidentified Persons System.</text></paragraph></subsection></section><section id="id05889431DFAA45F282235EFD0B6BDAA2"><enum>102.</enum><header>National Missing and Unidentified Persons System Tribal liaison</header><subsection id="id90980a848dda44298c37c26fce839a64"><enum>(a)</enum><header>Appointment</header><text>The Attorney General, acting through the Director of the National Institute of Justice, shall appoint 1 or more Tribal liaisons for the National Missing and Unidentified Persons System.</text></subsection><subsection id="ida01f477045e140419b9b3aa672530082"><enum>(b)</enum><header>Duties</header><text>The duties of a Tribal liaison appointed under subsection (a) shall include—</text><paragraph id="id4a414c7d627e4bc7b0eed13714429607"><enum>(1)</enum><text>coordinating the reporting of information relating to missing persons cases of interest to Indian tribes and unidentified remains cases of interest to Indian tribes;</text></paragraph><paragraph id="ide3074483a8c34b148caf2c96ff5152e2"><enum>(2)</enum><text>consulting and coordinating with relevant Tribal stakeholders to address the reporting, documentation, and tracking of missing persons cases of interest to Indian tribes and unidentified remains cases of interest to Indian tribes;</text></paragraph><paragraph id="id0a1235b9eadb4504939bfdd027783db9"><enum>(3)</enum><text>developing working relationships, and maintaining communication, with relevant Tribal stakeholders;</text></paragraph><paragraph id="id2f73f070c64b486b818c9124961535db"><enum>(4)</enum><text>providing technical assistance and training to relevant Tribal stakeholders, victim service advocates, medical examiners, and tribal justice officials regarding—</text><subparagraph id="idc9a049a358dd4ff48f1169dbfc76b18e"><enum>(A)</enum><text>the gathering and reporting of information to the National Missing and Unidentified Persons System; and</text></subparagraph><subparagraph id="id7028032759a14cc0811d70c242c30bfe"><enum>(B)</enum><text>working with non-Tribal law enforcement agencies to ensure all missing persons cases of interest to Indian tribes and unidentified remains cases of interest to Indian tribes are reported to the National Missing and Unidentified Persons System;</text></subparagraph></paragraph><paragraph id="id4d6e00075273415093c187f4658b9655"><enum>(5)</enum><text>coordinating with the Office of Tribal Justice and the Office of Justice Services, as necessary; and</text></paragraph><paragraph id="id0985fe5925df4df183f80f7a51f076f9"><enum>(6)</enum><text>conducting other training, information gathering, and outreach activities to improve resolution of missing persons cases of interest to Indian tribes and unidentified remains cases of interest to Indian tribes.</text></paragraph></subsection><subsection id="ide342819dab6343f08fe7dd2f1f3466cd"><enum>(c)</enum><header>Reporting and transparency</header><paragraph id="idc4c3d50f3d2e40d08750406a32453e1f"><enum>(1)</enum><header>Annual reports to Congress</header><text>During the 3-year-period beginning on the date of enactment of this Act, the Attorney General, acting through the Director of the National Institute of Justice, shall submit to the Committees on Indian Affairs and the Judiciary of the Senate and the Committees on Natural Resources and the Judiciary of the House of Representatives an annual report—</text><subparagraph id="id63E0C73748484CF6BECF396BD1BC944A"><enum>(A)</enum><text>describing the activities and accomplishments of the 1 or more Tribal liaisons appointed under subsection (a) during the 1-year period preceding the date of the report; and</text></subparagraph><subparagraph id="id356916E2B8994CB89F722AEC67240B50"><enum>(B)</enum><text>summarizing—</text><clause id="id25c9cc7468514eaf97d85c75515d58a6"><enum>(i)</enum><text>the number of missing persons cases of interest to Indian tribes and unidentified remains cases of interest to Indian tribes listed in the National Missing and Unidentified Persons System;</text></clause><clause id="id86fa2e5ca57f4312950e047253313b00"><enum>(ii)</enum><text>the percentage of missing persons cases of interest to Indian tribes and unidentified remains cases of interest to Indian tribes closed during the 1-year period preceding the date of the report; and</text></clause><clause id="idd396e704a57e445dbcaf5b494d920d45"><enum>(iii)</enum><text>the reasons for those closures.</text></clause></subparagraph></paragraph><paragraph id="idf28b66dd5b6a45e7a213469324634841"><enum>(2)</enum><header>Public transparency</header><text>Annually, the Attorney General, acting through the Director of the National Institute of Justice, shall publish on a website publicly accessible information—</text><subparagraph id="id755E77D6F3E94CEAA46184C18EED9C51"><enum>(A)</enum><text>describing the activities and accomplishments of the 1 or more Tribal liaisons appointed under subsection (a) during the 1-year period preceding the date of the publication; and</text></subparagraph><subparagraph id="idD5B9034AE73C4425A8ACE3081D6169F1"><enum>(B)</enum><text>summarizing—</text><clause id="id3eae8940630540c2a852db30c9816367"><enum>(i)</enum><text>the number of missing persons cases of interest to Indian tribes and unidentified remains cases of interest to Indian tribes listed in the National Missing and Unidentified Persons System;</text></clause><clause id="id0f74d6b5be0e44f68643d8b736ce4209"><enum>(ii)</enum><text>the percentage of missing persons cases of interest to Indian tribes and unidentified remains cases of interest to Indian tribes closed during the 1-year period preceding the date of the report; and</text></clause><clause id="idc54211657e0c4efe9aa3163f58b775af"><enum>(iii)</enum><text>the reasons for those closures.</text></clause></subparagraph></paragraph></subsection></section><section id="id66F4CFC523FC4922BEEA4E4C562C8F5B"><enum>103.</enum><header>Law enforcement data sharing with Indian tribes</header><subsection id="id96ED6BDDC2804B689B1CC0BB5E2941B1"><enum>(a)</enum><header>Access to national crime information databases by tribes</header><text display-inline="yes-display-inline">Section 233(b) of the Tribal Law and Order Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/34/41107">34 U.S.C. 41107</external-xref>) is amended—</text><paragraph id="idDF6DF25F7C5944708B0401BA8EA77CA2"><enum>(1)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idA17C4D50846C4145A36969B0EE91AB95" style="OLC" changed="deleted" reported-display-style="strikethrough" committee-id="SLIA00"><paragraph id="idE8BAB30FA9734DD19B3980D4A86E443E"><enum>(1)</enum><header>In general</header><text>The Attorney General shall ensure that—</text><subparagraph id="id68c31b82ec974fa0a36a06be3b99db0c"><enum>(A)</enum><text>tribal law enforcement officials that meet applicable Federal or State requirements shall be permitted access to national crime information databases;</text></subparagraph><subparagraph id="id12d47e860ed14d279ad664bc6da3446d"><enum>(B)</enum><text>technical assistance and training is provided to Bureau of Indian Affairs and tribal law enforcement agencies to gain access to, and the ability to use and input information into, the National Crime Information Center and other national crime information databases pursuant to section 534 of title 28, United States Code; and</text></subparagraph><subparagraph id="id55bbf1178b7f4d7097eb6dc771cbec38"><enum>(C)</enum><text>the Federal Bureau of Investigation coordinates with the Office of Justice Services to ensure tribal law enforcement agencies are assigned appropriate credentials or ORI numbers for uniform crime reporting purposes.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id53EC2B0A18694AAEB1E57177D36CB980"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idC4EDA075DCF640E8BACC4A0465624040" style="OLC" changed="deleted" reported-display-style="strikethrough" committee-id="SLIA00"><paragraph id="idb362d66ccdf8426eaabea6c956c01e80"><enum>(2)</enum><header>Tribal Access Program</header><subparagraph id="id02fe45a358ab400b8b7ec78764e24c0c"><enum>(A)</enum><header>In general</header><text>The Attorney General shall establish a program, to be known as the <quote>Tribal Access Program</quote>, to enhance the ability of tribal governments to access and enter information into Federal criminal information databases under this section.</text></subparagraph><subparagraph id="idc3f78a0e0ef6470c96629869826f549a"><enum>(B)</enum><header>Authorization of appropriations</header><clause id="ide5c68bee4fbc4a20939d81f46a67902b"><enum>(i)</enum><header>In general</header><text>There is authorized to be appropriated to carry out the Tribal Access Program under subparagraph (A) $3,000,000 for each of fiscal years 2020 through 2024, to remain available until expended.</text></clause><clause commented="no" id="id059c0b92fda64b2eac6511a181010ba6"><enum>(ii)</enum><header>Additional funding</header><text>The Attorney General may use to carry out the Tribal Access Program under subparagraph (A) any balances remaining for the account under the heading <quote><header-in-text level="appropriations-small" style="appropriations">Violence against women prevention and prosecution programs</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="OLC">State and Local Law Enforcement Activities Office on Violence Against Women</header-in-text></quote> of the Department of Justice from appropriations for full fiscal years prior to the date of enactment of the <short-title>Bridging Agency Data Gaps and Ensuring Safety for Native Communities Act</short-title>.</text></clause></subparagraph></paragraph><paragraph id="id97f113d985bc446ca1bf7b98af6e7146"><enum>(3)</enum><header>Information sharing</header><text>To the extent otherwise permitted by law, any report issued as a result of the analysis of information entered into Federal criminal information databases or obtained from Federal criminal databases, including for the purpose of conducting background checks, shall be shared with each Indian tribe of jurisdiction.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id76D76F2F05B44535B49BFCD4AD2E6E6D"><enum>104.</enum><header>Report on Indian country law enforcement personnel resources and need</header><subsection id="id31f0b23a7ccb411e8dfde170f7712d6c"><enum>(a)</enum><header>Definition of DOJ law enforcement agency</header><text>In this section, the term <term>DOJ law enforcement agency</term> means each of—</text><paragraph id="id0682c33d0bfa47fb81cb154fd3bbd7fd"><enum>(1)</enum><text>the Federal Bureau of Investigation;</text></paragraph><paragraph id="id0a508d24899b4a728e52cced530f5ddc"><enum>(2)</enum><text>the Drug Enforcement Administration;</text></paragraph><paragraph id="idda1a15000a664b52a2d090e861a0d687"><enum>(3)</enum><text>the United States Marshals Service;</text></paragraph><paragraph id="id5a33317f086c4e589af15f993749f77b"><enum>(4)</enum><text>the Bureau of Alcohol, Tobacco, Firearms and Explosives; and</text></paragraph><paragraph id="idbe90169d93e744a9b046b54c87e47b7e"><enum>(5)</enum><text>the Offices of the United States Attorneys.</text></paragraph></subsection><subsection id="id19794d3f22194f14b3e4126690045f17"><enum>(b)</enum><header>Report</header><text>Each fiscal year, the Attorney General shall submit to the appropriate committees of Congress a report describing for that fiscal year—</text><paragraph id="idbccf064da9b246bd86578e04d244dba7"><enum>(1)</enum><text>the number of full-time employees of each DOJ law enforcement agency that are assigned to work on criminal investigations and prosecutions in Indian country;</text></paragraph><paragraph id="ida600e5feb5c64f7db612c1e6dc7a3fa3"><enum>(2)</enum><text>an estimate of the average caseload of—</text><subparagraph id="idafd4aafbe1194bd7872baab3f83e2385"><enum>(A)</enum><text>the full-time employees described in paragraph (1); compared to</text></subparagraph><subparagraph id="id8b85596c7e0b4afea8e1b1f1af09e504"><enum>(B)</enum><text>the other full-time employees at the respective DOJ law enforcement agency that are assigned to work on criminal investigations and prosecutions; and</text></subparagraph></paragraph><paragraph id="ida9fc82495e0c4f00894859bb22baa0a0"><enum>(3)</enum><text>an explanation for any differences in the average caseloads identified under subparagraphs (A) and (B) of paragraph (2).</text></paragraph></subsection></section></title><title id="id2F237B37010B40A686CE064D6E72FFD0" style="OLC" changed="deleted" reported-display-style="strikethrough" committee-id="SLIA00"><enum>II</enum><header>Ensuring safety for Native communities</header><section id="idd8562e8f84f943f893fe5b2c6bc2b196"><enum>201.</enum><header>Demonstration program on Bureau of Indian Affairs law enforcement employment background checks</header><subsection id="ida78a8d2c997441f4b2b7ab1c81d270b1"><enum>(a)</enum><header>Establishment of program</header><paragraph id="ida0cb845e5c34439daade86dfc5f52870"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a demonstration program for the purpose of conducting or adjudicating, in coordination with the Director of the Bureau of Indian Affairs, personnel background investigations for applicants for law enforcement positions in the Bureau of Indian Affairs.</text></paragraph><paragraph id="id17db63bdd9af4a9a81870de0468a2aa3"><enum>(2)</enum><header>Background investigations and security clearance determinations</header><subparagraph id="id8d56715bd0174b24b764b8a0693bc310"><enum>(A)</enum><header>BIA investigations</header><text>As part of the demonstration program established under paragraph (1), the Secretary may carry out a background investigation, security clearance determination, or both a background investigation and a security clearance determination for an applicant for a law enforcement position in the Bureau of Indian Affairs.</text></subparagraph><subparagraph id="id0a53e7522e6d4086886e3d0a7ec03ecb"><enum>(B)</enum><header>Use of previous investigations and determinations</header><clause id="ide4b80933c2e6447a866fa13ca45d6360"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), as part of the demonstration program established under paragraph (1), the Secretary, in adjudicating background investigations for applicants for law enforcement positions in the Bureau of Indian Affairs, shall consider previous background investigations for an applicant, security clearance determinations for an applicant, or both background investigations and security clearance determinations for an applicant, as the case may be, that have been conducted by a State or local government, Indian tribe, tribal organization, or the Bureau of Indian Affairs, within the 5-year period preceding the application for employment with the Bureau of Indian Affairs.</text></clause><clause id="idbc60bb9abdc447e595bfe3c08818fa41"><enum>(ii)</enum><header>Quality</header><text>The Secretary shall only consider previous background investigations and security clearance determinations for an applicant that have been conducted by a State or local government, Indian tribe, or tribal organization if the Secretary can verify that those previous investigations and determinations, as the case may be, are of a comparable quality and thoroughness to investigations and determinations carried out by the Bureau of Indian Affairs, the Office of Personnel Management, or another Federal agency.</text></clause><clause id="id4ec220d111b04180a1a48c0c27982e7c"><enum>(iii)</enum><header>Additional investigation</header><text>If, as described in clause (i), the Secretary considers an existing background investigation, security clearance determination, or both, as the case may be, for an applicant that has been carried out by a State or local government, Indian tribe, tribal organization, or the Bureau of Indian Affairs, the Secretary—</text><subclause id="id872e2bcc0b484c149d5b46314fa26320"><enum>(I)</enum><text>may carry out additional investigation and examination of the applicant if the Secretary determines that such additional information is needed in order to make an appropriate determination as to the character and trustworthiness of the applicant before final adjudication can be made and a security clearance can be issued; and</text></subclause><subclause id="idf49d9dc134f9432e8271d03fa0296396"><enum>(II)</enum><text>shall not initiate a new background investigation process with the National Background Investigations Bureau or other Federal agency unless that new background investigation process covers a period of time that was not covered by a previous background investigation process.</text></subclause></clause><clause id="iddcb8f62a9aac420bb440d6b45e0f67a4"><enum>(iv)</enum><header>Agreements</header><text>The Secretary may enter into a Memorandum of Agreement with a State or local government, Indian tribe, or tribal organization to develop steps to expedite the process of receiving and obtaining access to background investigation and security clearance determinations for use in the demonstration program.</text></clause></subparagraph></paragraph><paragraph id="id1d8b6d4ed1994adb8ed324de4eac6891"><enum>(3)</enum><header>Sunset</header><text>The demonstration program established under this section shall terminate 5 years after the date of the commencement of the program.</text></paragraph></subsection><subsection id="id15ad940432c94e718fff913dcef5f5d3"><enum>(b)</enum><header>Sufficiency</header><text>Notwithstanding any other provision of law, a background investigation conducted or adjudicated by the Secretary pursuant to the demonstration program authorized in subsection (a) that results in the granting of a security clearance to an applicant for a law enforcement position in the Bureau of Indian Affairs shall be sufficient to meet the applicable requirements of the Office of Personnel Management or other Federal agency for such investigations.</text></subsection><subsection id="ida43aea5df3fb4cb785104fb243a362db"><enum>(c)</enum><header>Annual report</header><text>The Secretary shall submit an annual report to the Committee on Indian Affairs of the Senate and the Committee on Natural Resources of the House of Representatives on the demonstration program established under subsection (a), which shall include a description of—</text><paragraph id="id70500dec94f54fb98fd3394f69cc52ed"><enum>(1)</enum><text>the demonstration program and any relevant annual changes or updates to the program;</text></paragraph><paragraph id="id46364a676e9d4170a2432dd0717c945a"><enum>(2)</enum><text>the number of background investigations carried out under the program;</text></paragraph><paragraph id="id28a2d7a18e3d4214b2327a804f3d1e67"><enum>(3)</enum><text>the costs, including any cost savings, associated with the investigation and adjudication process under the program;</text></paragraph><paragraph id="id13e53c103c1c4cf5976ffb277c775ed8"><enum>(4)</enum><text>the processing times for the investigation and adjudication processes under the program;</text></paragraph><paragraph id="ide30da55efff44ba69728cfadfb536e53"><enum>(5)</enum><text>any Memoranda of Agreement entered into with State or local government, Indian tribe, or tribal organization; and</text></paragraph><paragraph id="idc9bc86cd619e4fb69a82e0f709854a31"><enum>(6)</enum><text>any other information that the Secretary determines to be relevant.</text></paragraph></subsection><subsection id="idfc013a1f46af4f43aeb2bfb8d8bada36"><enum>(d)</enum><header>GAO study and report</header><paragraph id="id3e017d10057748238889578bf0f21aea"><enum>(1)</enum><header>Initial report</header><text>Not later than 18 months after the date on which the demonstration program commences under this section, the Comptroller General of the United States shall prepare and submit to Congress an initial report on such demonstration program.</text></paragraph><paragraph id="ida4d1041037cd4a1e9b0a72e64282546c"><enum>(2)</enum><header>Final report</header><text>Not later than 18 months after the date on which the demonstration program terminates under subsection (a)(3), the Comptroller General of the United States shall prepare and submit to Congress a final report on such demonstration program.</text></paragraph><paragraph id="id78ad7d2254ae413db828642f9417592f"><enum>(3)</enum><header>Tribal input</header><text>In preparing the reports under this subsection, the Comptroller General of the United States shall obtain input from Indian tribes regarding the demonstration program under this section.</text></paragraph></subsection></section><section commented="no" id="id98495141f2d74f01a6d7f72593ecf21f"><enum>202.</enum><header>Missing and murdered response coordination grant program</header><subsection id="idd272f5f2325f4ac99f701dd1d2217760"><enum>(a)</enum><header>Establishment of program</header><text>The Attorney General shall establish within the Office of Justice Programs a grant program under which the Attorney General shall make grants to eligible entities described in subsection (b) to carry out eligible activities described in subsection (c).</text></subsection><subsection commented="no" id="id1B987993CA874AB0802FC9E39A42A7F5"><enum>(b)</enum><header>Eligible entities</header><paragraph commented="no" id="id39ECF2E26B6A47DC93157CEC4F8F4F96"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To be eligible to receive a grant under the grant program established under subsection (a) an entity shall be—</text><subparagraph commented="no" id="idF0E3EB9576E44EA6AC467D79ED3F3946"><enum>(A)</enum><text display-inline="yes-display-inline">a relevant Tribal stakeholder;</text></subparagraph><subparagraph commented="no" id="id1E7CAD6F41AA44178F4494F889E39EAE"><enum>(B)</enum><text display-inline="yes-display-inline">subject to paragraph (2), a State, in consortium with a relevant Tribal stakeholder;</text></subparagraph><subparagraph id="id31d3ca0688674e69a3362673c0511361"><enum>(C)</enum><text>a consortium of 2 or more relevant Tribal stakeholders; or</text></subparagraph><subparagraph id="id97783f19d0a9410d8475f61db569f779"><enum>(D)</enum><text>subject to paragraph (2), a consortium of 2 or more States and 1 or more relevant Tribal stakeholders.</text></subparagraph></paragraph><paragraph commented="no" id="id59821209DFBB49F5B1F74E8087DA0FAC"><enum>(2)</enum><header>State eligibility</header><text>To be eligible under subparagraph (B) or (D) of paragraph (1), a State shall demonstrate to the satisfaction of the Attorney General that the State—</text><subparagraph commented="no" id="id7C2481CD34CC4D0DB5D64A707E0B1519"><enum>(A)</enum><text>reports missing persons cases in the State to the national crime information databases; or</text></subparagraph><subparagraph commented="no" id="idCFFAAD43D9194F8B8FE1CC6350F1B27F"><enum>(B)</enum><text>if not, has a plan to do so using a grant received under the grant program established under subsection (a).</text></subparagraph></paragraph></subsection><subsection commented="no" id="idB18CF756FFB146AAB9058A25C7AFB2B4"><enum>(c)</enum><header>Eligible activities</header><text>An eligible entity receiving a grant under the grant program established under subsection (a) may use the grant—</text><paragraph commented="no" id="id774AA0C18736430092A48C75E7F08219"><enum>(1)</enum><text display-inline="yes-display-inline">to establish a statewide or regional center to document and track missing persons cases of interest to Indian tribes and murder cases of interest to Indian tribes;</text></paragraph><paragraph commented="no" id="id7FE53D0F2E7C441F82CD416720085383"><enum>(2)</enum><text display-inline="yes-display-inline">to establish a State or regional commission to respond to, and to improve coordination between Federal law enforcement agencies, and Tribal, State, and local law enforcement agencies of the investigation of, missing persons cases of interest to Indian tribes and murder cases of interest to Indian tribes; and</text></paragraph><paragraph commented="no" id="id5FC716D7C166477EB8721690AD05116F"><enum>(3)</enum><text display-inline="yes-display-inline">to document, develop, and disseminate resources for use by Federal law enforcement agencies and Tribal, State, and local law enforcement agencies for the coordination of the investigation of missing persons cases of interest to Indian tribes and murder cases of interest to Indian tribes.</text></paragraph></subsection><subsection commented="no" id="id4B25E9F767574BDEB1DE29BE950D58B1"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out the program $1,000,000 for each of fiscal years 2020 through 2024.</text></subsection></section><section commented="no" id="id9861c2be598c4318b65b14e1e0eb66c0"><enum>203.</enum><header>GAO study on Federal law enforcement agency evidence collection, handling, and
 processing</header><subsection commented="no" id="id87EACEDE3B6A4DEE9FB4FF4BBE4475E3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study—</text><paragraph id="idc6108cb34b0641798cdf936bd2bedd30"><enum>(1)</enum><text>on the evidence collection, handling, and processing procedures and practices of the Office of Justice Services and the Federal Bureau of Investigation in exercising jurisdiction over crimes involving Indians or committed in Indian country;</text></paragraph><paragraph id="idebd9dfd452144bc3a01a9f5c04f0c6de"><enum>(2)</enum><text>on any barriers to evidence collection, handling, and processing by the agencies referred to in paragraph (1);</text></paragraph><paragraph id="idbfe72b72896945a9b867b5b20244a641"><enum>(3)</enum><text>on the views of law enforcement officials at the agencies referred to in paragraph (1) and their counterparts within the Offices of the United States Attorneys concerning any relationship between—</text><subparagraph id="id54dd29dd1bf5406bb8a467b7d2df1645"><enum>(A)</enum><text>the barriers identified under paragraph (2); and</text></subparagraph><subparagraph id="idbf29852a63114f4897b0cd8f4b49673a"><enum>(B)</enum><text>United States Attorneys declination rates due to insufficient evidence; and</text></subparagraph></paragraph><paragraph id="ide39343002b6447db99fb3f205a5d8ba1"><enum>(4)</enum><text>that includes a survey of barriers to evidence collection, handling, and processing faced by State and local law enforcement agencies that exercise jurisdiction over Indian country under the Act of August 15, 1953 (67 Stat. 588, chapter 505), and the amendments made by that Act.</text></paragraph></subsection><subsection commented="no" id="id187F48786F864461918AE0EA6F2D019F"><enum>(b)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report describing the results of the study conducted under subsection (a).</text></subsection></section><section id="id654716bc19db4f408840de395cac91d4"><enum>204.</enum><header>Bureau of Indian Affairs and Tribal law enforcement officer counseling resources interdepartmental

display-inline="no-display-inline" id="id929b1c29-8123-4f86-b1a9-10f309c8140b"><enum>(B)</enum><text>a death investigation of a person found on, in, or adjacent to Indian land. </text></subparagraph></paragraph><paragraph id="id874ef351-518c-4846-b3da-56d3fb44fa8e"><enum>(3)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Justice Services.</text></paragraph><paragraph commented="no" id="ide24acd3f-e782-411f-9d1b-35560acd0a3c"><enum>(4)</enum><header>Federal law enforcement agency</header><text display-inline="yes-display-inline">The term <term>Federal law enforcement agency</term> means the Bureau of Indian Affairs direct-service police, the Federal Bureau of Investigation, and any other Federal law enforcement agency that—</text><subparagraph id="id04d01738-8fa7-4e37-bda5-e39beac705b2"><enum>(A)</enum><text>has jurisdiction over crimes in Indian country; or</text></subparagraph><subparagraph id="idd49fdb01-685e-4d30-81e0-73f87593b941"><enum>(B)</enum><text>investigates missing persons cases of interest to Indian tribes, death investigations of General.</text></paragraph><paragraph commented="no" id="id2e83efea-5478-4bd1-a52a-da0d1bc886b5"><enum>(10)</enum><header>Missing persons case of interest to Indian tribes</header><text>The term <term>missing persons case of interest to Indian tribes</term> means a case involving—</text><subparagraph commented="no" id="id5ffc6307-1c4e-4040-b9da-44ade2443abe"><enum>(A)</enum><text>a missing Indian; or</text></subparagraph><subparagraph id="id4babf511-b343-486c-bf3d-4366459dd532"><enum>(B)</enum><text>a missing person whose last known location is believed to be on, in, or adjacent to Indian land.</text></subparagraph></paragraph><paragraph commented="no" id="ida3e90f73-d275-4b24-a6ba-c7163241ea3e"><enum>(11)</enum><header>National crime information databases</header><text>The term <term>national crime information databases</term> has the meaning given the term in section 534(f)(3) of title 28, United States Code.</text></paragraph><paragraph id="ide27aa55f-4261-40bc-82e0-42acd9ce1690"><enum>(12)</enum><header>Relevant Tribal organization</header><text display-inline="yes-display-inline">The term <term>relevant Tribal organization</term> means, as applicable—</text><subparagraph id="id92195197-52a0-489a-82dd-ee331daad2fd"><enum>(A)</enum><text display-inline="yes-display-inline">a tribal organization; and</text></subparagraph><subparagraph id="ideb5bb499-fa5e-4fd5-8c31-390f41f9ca6e"><enum>(B)</enum><text display-inline="yes-display-inline">a national or regional organization that—</text><clause id="id954f0434-6cae-4838-811e-96b6e0205df6"><enum>(i)</enum><text display-inline="yes-display-inline">represents a substantial Indian constituency; and</text></clause><clause id="id335f10b6-a9f6-4ad4-8274-f3748a8b12d6"><enum>(ii)</enum><text display-inline="yes-display-inline">has expertise in the fields of—</text><subclause id="id6d973bc1-1feb-4417-b69b-dc486594d38a"><enum>(I)</enum><text display-inline="yes-display-inline">human trafficking of Indians;</text></subclause><subclause id="idd71d3095469c4e6da2cbf446d293a8e3"><enum>(II)</enum><text>human trafficking on Indian land; </text></subclause><subclause id="idb85fb7e4-4a3d-4eb7-a66b-f2ee026e3479"><enum>(III)</enum><text display-inline="yes-display-inline">violence against Indian women and children; or</text></subclause><subclause id="id5e6bfba2-e6ed-4fc7-8819-b0a5efe5dd7d"><enum>(IV)</enum><text display-inline="yes-display-inline">tribal justice systems.</text></subclause></clause></subparagraph></paragraph><paragraph id="ideb4c0472-eaca-4623-8c56-016bd6180a3d"><enum>(13)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="idb5f67fd3-51c3-4786-9f14-85027665e2b3"><enum>(14)</enum><header>Tribal justice official</header><text>The term <term>tribal justice official</term> has the meaning given the term in section 2 of the Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2801">25 U.S.C. 2801</external-xref>).</text></paragraph><paragraph id="id217b9fed-6787-4057-96f9-ab01fcceb91a"><enum>(15)</enum><header>Tribal organization</header><text>The term <term>tribal organization</term> has the meaning given the term in section 4 of the <term>unclaimed remains case of interest to Indian tribes</term> means a case involving—</text><subparagraph id="id91f04f4253a346d39ad0fb3f2818ca36"><enum>(A)</enum><text>unclaimed Indian remains; or</text></subparagraph><subparagraph id="iddd599d0380a94fa98f7cad6fb4ab3e21"><enum>(B)</enum><text>unclaimed remains found on, in, or adjacent to Indian land. </text></subparagraph></paragraph><paragraph id="id1febcb56-7e76-46e8-b44f-f613ddc3027b"><enum>(17)</enum><header>Unidentified remains case of interest to Indian tribes</header><text>The term <term>unidentified remains case of interest to Indian tribes</term> means a case involving—</text><subparagraph id="id5c776b24-085a-40bd-9f23-bc50419e58e2"><enum>(A)</enum><text>unidentified Indian remains; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2d9d2e17-a600-4c5b-8492-d33c3681adb7"><enum>(B)</enum><text>unidentified remains found on, in, or adjacent to Indian land.</text></subparagraph></paragraph></section><title id="id5b53d1c0-788d-4e36-b1cd-1f570cf1459b" style="OLC" changed="added" reported-display-style="italic" committee-id="SLIA00"><enum>I</enum><header>Bridging agency data gaps</header><section id="id50ff866f-2920-458f-b918-640b6a4c9e25"><enum>101.</enum><header>Federal law enforcement database reporting requirements</header><subsection id="idd020cd12-839a-47aa-96cb-a4ae47a6eeea"><enum>(a)</enum><header>In general</header><text>Section 151 of the Sex Offender Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/34/20961">34 U.S.C. 20961</external-xref>) is amended—</text><paragraph id="id7C9868A3A6B64D7BB8FBF0BB57D941A4"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph><paragraph id="id6E48C702FACD4A3382A7EBBE5F4F4612"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text><quoted-block display-inline="no-display-inline" id="idb5635759-dcbd-47c4-a6c8-350bed685658" style="OLC" changed="added" reported-display-style="italic" committee-id="SLIA00"><subsection id="id05cdf123-2a86-45f8-a8c9-e5b8e7b97490"><enum>(b)</enum><header>Access by NamUs</header><text>Notwithstanding any other provision of law, not later than 2 years after the date of enactment of the <short-title>BADGES for Native Communities Act</short-title>, the Attorney General shall ensure access, as appropriate, to the national crime information databases (as defined in section 534(f)(3) of title 28, United States Code) by the National Missing and Unidentified Persons System, to be used by a person accessing the System only within the scope of the work of the person in assisting or supporting law enforcement efforts to solve missing, unidentified, and unclaimed person cases across the United States; and</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idd4b371ac-71d0-457e-878e-bfe806732240"><enum>(b)</enum><header>Sharing of information</header><text>Not later than 2 years after the date of enactment of this Act, the Attorney General shall, in a manner that maintains the integrity of confidential, private, and law enforcement sensitive information and with the permission of the local law enforcement agency that originated the case, provide for information on missing persons, unclaimed remains, and unidentified remains contained in national crime information databases to be transmitted to, entered in, and otherwise shared with the National Missing and Unidentified Persons System.</text></subsection><subsection id="id1c09da9f-daa4-41a7-8652-240cc221b261"><enum>(c)</enum><header>Temporary reporting requirements</header><text>Until such time as the data sharing procedures required under subsection (b) are in effect, each Federal law enforcement agency, as appropriate, shall enter into the National Missing and Unidentified Persons System each missing persons case of interest to Indian tribes, each unclaimed remains case of interest to Indian tribes, and each unidentified remains case of interest to Indian tribes investigated by the Federal law enforcement agency.</text></subsection><subsection id="id95dbbc1c-9e4f-421f-8ad8-c6167a1ecaf3"><enum>(d)</enum><header>Coordination with NamUs Tribal facilitator</header><text>The Director and the Director of the Federal Bureau of Investigation shall each appoint a liaison to coordinate with the 1 or more Tribal facilitators appointed under section 102(a)—</text><paragraph id="id0414646468BF4488A638FF12D7CE9B1E"><enum>(1)</enum><text>to ensure that—</text><subparagraph id="idc6ae8bd4-1220-4a9a-9b5d-571d363416c4"><enum>(A)</enum><text>missing persons cases of interest to Indian tribes, unclaimed remains cases of interest to Indian tribes, and unidentified remains cases of interest to Indian tribes investigated by a Federal law enforcement agency are fully captured in the National Missing and Unidentified Persons System; and</text></subparagraph><subparagraph id="id6ca099c3-ee4e-47b5-b4aa-b524572cf9f3"><enum>(B)</enum><text>Indian tribes are aware of, and able to access, information in the National Missing and Unidentified Persons System; and</text></subparagraph></paragraph><paragraph id="id99eff5255e5a43a7be8c0838d1845ed3"><enum>(2)</enum><text>to conduct outreach to State and local law enforcement agencies that exercise jurisdiction over Indian country under the Act of August 15, 1953 (67 Stat. 588, chapter 505), and the amendments made by that Act, to increase the input of information concerning missing persons cases of interest to Indian tribes, unclaimed remains cases of interest to Indian tribes, and unidentified remains cases of interest to Indian tribes in the National Missing and Unidentified Persons System. </text></paragraph></subsection></section><section id="idbcba9cef-119f-414d-91d8-2d35654c9eea"><enum>102.</enum><header>National Missing and Unidentified Persons System Tribal facilitator</header><subsection id="idcb2dc62a-8231-4785-8e3d-f1c6372ae6c4"><enum>(a)</enum><header>Appointment</header><text>The Attorney General, acting through the Director of the National Institute of Justice, shall appoint 1 or more Tribal facilitators for the National Missing and Unidentified Persons System.</text></subsection><subsection id="id5ea62cc7-437c-43a3-8a63-6ce61c3c9cf6"><enum>(b)</enum><header>Duties</header><text>The duties of a Tribal facilitator appointed under subsection (a) shall include—</text><paragraph id="idb14a9bd9-9ae0-4490-b49c-ecbe9355e320"><enum>(1)</enum><text>coordinating the reporting of information relating to missing persons cases of interest to Indian tribes, unclaimed remains cases of interest to Indian tribes, and unidentified remains cases of interest to Indian tribes;</text></paragraph><paragraph id="id5aaacd6c-af32-4069-bf2a-93c9cb16bf94"><enum>(2)</enum><text>consulting and coordinating with Indian tribes and relevant Tribal organizations to address the reporting, documentation, and tracking of missing persons cases of interest to Indian tribes, unclaimed remains cases of Interest to Indian tribes, and unidentified remains cases of interest to Indian tribes;</text></paragraph><paragraph id="id454c1fad-64ba-496d-a3e7-47cb9df07e42"><enum>(3)</enum><text>developing working relationships, and maintaining communication, with Indian tribes and relevant Tribal organizations;</text></paragraph><paragraph id="id80cf1915-7583-420b-959a-8683d2e58724"><enum>(4)</enum><text>providing technical assistance and training to Indian tribes and relevant Tribal organizations, victim service advocates, medical examiners, coroners, and tribal justice officials regarding—</text><subparagraph id="id0edf78f0-ec2a-46c6-b49c-e327a7f3c9ec"><enum>(A)</enum><text>the gathering and reporting of information to the National Missing and Unidentified Persons System; and</text></subparagraph><subparagraph id="id0bb59c34-68a5-44bc-9a17-61f2d3dee947"><enum>(B)</enum><text>working with non-Tribal law enforcement agencies to ensure missing persons cases of interest to Indian tribes, unclaimed remains cases of interest to Indian tribes, and unidentified remains cases of interest to Indian tribes are reported to the National Missing and Unidentified Persons System;</text></subparagraph></paragraph><paragraph id="idf4d66dc3-2475-4d7b-8aff-ad561172acc7"><enum>(5)</enum><text>coordinating with the Office of Tribal Justice, the Office of Justice Services, the Executive Office for United States Attorneys, and the National Indian Country Training Initiative, as necessary; and</text></paragraph><paragraph id="id80749ad7-aec1-4d8d-8140-4bc04818cfb5"><enum>(6)</enum><text>conducting other training, information gathering, and outreach activities to improve resolution of missing persons cases of interest to Indian tribes, unclaimed remains cases of interest to Indian tribes, and unidentified remains cases of interest to Indian tribes.</text></paragraph></subsection><subsection id="idfb2c18af-b86f-4ad3-a115-ad94b8b7d555"><enum>(c)</enum><header>Reporting and transparency</header><paragraph id="ide1ceba34-9ea9-4044-afc4-e8f14e85671c"><enum>(1)</enum><header>Annual reports to Congress</header><text>During the 3-year-period beginning on the date of enactment of this Act, the Attorney General, acting through the Director of the National Institute of Justice, shall submit to the Committees on Indian Affairs and the Judiciary of the Senate and the Committees on Natural Resources and the Judiciary of the House of Representatives an annual report—</text><subparagraph id="id429e4065-fbb8-46be-bb2e-34a05836dc52"><enum>(A)</enum><text>describing the activities and accomplishments of the 1 or more Tribal facilitators appointed under subsection (a) during the 1-year period preceding the date of the report; and</text></subparagraph><subparagraph id="id29dc314e-4bd9-40fe-ac51-cb6a2fa125df"><enum>(B)</enum><text>summarizing—</text><clause id="id192e3738-4d2e-4068-bb3b-321106727ee7"><enum>(i)</enum><text>the number of missing persons cases of interest to Indian tribes, unclaimed remains cases of interest to Indian tribes, and unidentified remains cases of interest to Indian tribes that the Tribal facilitator can identify in the National Missing and Unidentified Persons System; and</text></clause><clause id="id05b84d319d1d4af28a940cfc8904f8cd"><enum>(ii)</enum><text>the percentage of missing persons cases of interest to Indian tribes, unclaimed remains cases of interest to Indian tribes, and unidentified remains cases of interest to Indian tribes closed during the 1-year period preceding the date of the report that the Tribal facilitator can identify in the National Missing and Unidentified Persons System. </text></clause></subparagraph></paragraph><paragraph id="idbf8e5e59-6c20-4646-b881-98d543a1dba2"><enum>(2)</enum><header>Public transparency</header><text>Annually, the Attorney General, acting through the Director of the National Institute of Justice, shall publish on a website publicly accessible information—</text><subparagraph id="idf5b9c8ca-0f9f-4df2-883a-405542d233b5"><enum>(A)</enum><text>describing the activities and accomplishments of the 1 or more Tribal facilitators appointed under subsection (a) during the 1-year period preceding the date of the publication; and</text></subparagraph><subparagraph id="ide2aaa621-c547-414a-b9f3-b5d317cfc256"><enum>(B)</enum><text>summarizing—</text><clause id="id5df7e129-ab64-46df-8282-249239d173c1"><enum>(i)</enum><text>the number of missing persons cases of interest to Indian tribes, unclaimed remains cases of interest to Indian tribes, and unidentified remains cases of interest to Indian tribes that the Tribal facilitator can identify in the National Missing and Unidentified Persons System;</text></clause><clause id="id97d313e6-2b83-4903-b91e-28a4f8fe9230"><enum>(ii)</enum><text>the percentage of missing persons cases of interest to Indian tribes, unclaimed remains cases of interest to Indian tribes, and unidentified remains cases of interest to Indian tribes closed during the 1-year period preceding the date of the report that the Tribal facilitator can identify in the National Missing and Unidentified Persons System.</text></clause></subparagraph></paragraph></subsection></section><section id="id4ca1afd9-bf25-40d3-800c-46d8aea4efca"><enum>103.</enum><header>Law enforcement data sharing with Indian tribes</header><subsection id="id079b3b97-f95c-40c7-ac12-936fbda4cc96"><enum>(a)</enum><header>Access to national crime information databases by tribes</header><text display-inline="yes-display-inline">Section 233(b) of the Tribal Law and Order Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/34/41107">34 U.S.C. 41107</external-xref>) is amended—</text><paragraph id="id366bf65b-1bc3-4797-bb5d-a129af62f9c9"><enum>(1)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id5f895203-c507-487c-b359-a0e5bfabce8c" style="OLC" changed="added" reported-display-style="italic" committee-id="SLIA00"><paragraph id="id86df9d2a-487d-42f0-b8cd-fef0ef76c63e"><enum>(1)</enum><header>In general</header><text>The Attorney General shall ensure that—</text><subparagraph id="ide14640e0-9e87-4fd6-9242-974878ed8612"><enum>(A)</enum><text>tribal law enforcement officials that meet applicable Federal or State requirements shall be permitted access to national crime information databases;</text></subparagraph><subparagraph id="id31dc2925-d164-4d89-b1bc-80ee23c15366"><enum>(B)</enum><text>technical assistance and training is provided to Bureau of Indian Affairs and tribal law enforcement agencies to gain access to, and the ability to use and input information into, the National Crime Information Center and other national crime information databases pursuant to section 534 of title 28, United States Code; and</text></subparagraph><subparagraph id="id554616ef-20b8-4fe0-a2f4-f8512783bc27"><enum>(C)</enum><text>as appropriate, the Federal Bureau of Investigation ensures tribal law enforcement agencies and tribal justice systems are assigned appropriate credentials or ORI numbers for uniform crime reporting purposes.</text></subparagraph></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="ida2e21dfa-2b82-40c6-a1ea-2b052337364d"><enum>(2)</enum><text>in paragraph (3), by striking <quote>with criminal jurisdiction over Indian country</quote>.</text></paragraph></subsection><subsection id="id2f7c3bc0-9b97-4439-82c4-4040d5b21714"><enum>(b)</enum><header>Acquisition, preservation, and exchange of identification records and information</header><text>Section 534(d) of title 28, United States Code, is amended—</text><paragraph id="id03015d5e-97ac-4721-9e2d-af3b8424f348"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and indenting appropriately;</text></paragraph><paragraph id="idad74102b-f5f4-4927-808b-13f2a2ee62c2"><enum>(2)</enum><text>in the matter preceding subparagraph (A) (as so redesignated), by striking <quote>The Attorney General</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id33d4edbe-a5cf-4fe0-9f01-4855c2727d7d" style="OLC" changed="added" reported-display-style="italic" committee-id="SLIA00"><paragraph id="id8370af17-967f-4b1d-9b02-8c2a60328c8d"><enum>(1)</enum><header>In general</header><text>The Attorney General</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idb591b889-aee6-4894-8af8-88825a72da60"><enum>(3)</enum><text>by adding at the end the committee-id="SLIA00"><paragraph id="id4ebd31e1-d2fa-48b8-adc6-ad7c19161ec8"><enum>(2)</enum><header>Tribal Civil and Criminal Information Access Program</header><subparagraph id="id7b0aca71-52b7-452f-aaa2-1434dc4f7364"><enum>(A)</enum><header>In general</header><text>The Attorney General shall establish a program, to be known as the <quote>Tribal Civil and Criminal Information Access Program</quote>, to enhance the ability of tribal governments to access, enter information into, and obtain information from Federal criminal information databases under this section.</text></subparagraph><subparagraph id="idfb727d88-7fb4-420c-8d35-096e91e65af6"><enum>(B)</enum><header>Authorization of appropriations</header><clause id="id52b73371-4325-4d94-8b5a-6d19185c67d4"><enum>(i)</enum><header>In general</header><text>There are authorized to be appropriated to carry out the Tribal Civil and Criminal Information Access Program under subparagraph (A)—</text><subclause id="id6E0998DEC9E744FE9B27E7CB909B0E6A"><enum>(I)</enum><text> $5,000,000 for each of fiscal years 2021 and 2022, to remain available until expended; and</text></subclause><subclause id="id5971ed2cdf9749ad8aef50d85a6b5149"><enum>(II)</enum><text>$7,000,000 for each fiscal years 2023 through 2025, to remain available until expended. </text></subclause></clause><clause commented="no" id="id8df8d6f0-50a3-4e5e-b16a-a1afe406ac3a"><enum>(ii)</enum><header>Additional funding</header><subclause commented="no" id="id3DEDCE0DD5CD4D62B985032253B38BEE"><enum>(I)</enum><header>In general</header><text>The Attorney General may use to carry out the Tribal Civil and Criminal Information Access Program under subparagraph (A) any balances remaining for the account under the heading <quote><header-in-text level="appropriations-small" style="appropriations">Violence against women prevention and prosecution programs</header-in-text></quote> under the heading <quote><header-in-text style="appropriations" level="appropriations-intermediate">Office on Violence Against Women</header-in-text></quote> under the heading <quote><header-in-text style="appropriations" level="appropriations-intermediate">State and Local Law Enforcement Activities</header-in-text></quote> of the Department of Justice from appropriations for full fiscal years prior to the date of enactment of the <short-title>BADGES for Native Communities Act</short-title> that were made available to carry out section 905(b)(1) of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/34/20903">34 U.S.C. 20903(b)(1)</external-xref>). </text></subclause><subclause id="idf3cac6efe1c24f699fe2ffc8629b9b2c"><enum>(II)</enum><header>Transfers</header><text>The Attorney General may transfer some or all of the balances described in subclause (I) to any appropriations account of the Department of Justice as needed to support the Tribal Civil and Criminal Information Access Program. </text></subclause></clause></subparagraph></paragraph><paragraph id="idb1d2d673-24ed-4842-ab92-ca69f52f678d"><enum>(3)</enum><header>Information sharing</header><text>To the extent otherwise permitted by law, any report issued as a result of the analysis of information entered into Federal criminal information databases or obtained from Federal criminal databases shall be shared with each Indian tribe of jurisdiction, as appropriate.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ided23eb4257c64b0180a35d706493b47d"><enum>(c)</enum><header>Identification records</header><text>The second undesignated paragraph in the matter under the heading <quote><header-in-text Investigation</header-in-text></quote> under title II of the Departments of State, Justice, and Commerce, the Judiciary, and Related Agencies Appropriation Act, 1973 (<external-xref legal-doc="usc" parsable-cite="usc/34/41101">34 U.S.C. 41101</external-xref>) is amended—</text><paragraph id="id705e870cc3ad470f9e29e6390aa7a440"><enum>(1)</enum><text>by inserting <quote>or Tribal</quote> after <quote>if authorized by State</quote>; and</text></paragraph><paragraph id="ide5fed0bfc61c4ef29a7985e3771c66c1"><enum>(2)</enum><text>by inserting <quote>, Tribal,</quote> before <quote>and local governments</quote>.</text></paragraph></subsection></section><section id="id88689ffa-9379-45d7-a807-37398f1e7b35"><enum>104.</enum><header>Report on Indian country law enforcement personnel resources and need</header><subsection id="id5f5d3307909f4e35bd953e30fefe6fad"><enum>(a)</enum><header>Department of the Interior Office of Justice Services</header><text>Section 3(c)(16) of the Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2802">25 U.S.C. 2802(c)(16)</external-xref>) is amended by striking subparagraph (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ideb33a5b54f2645a0873e540c49ebb7a7" changed="added" reported-display-style="italic" committee-id="SLIA00"><subparagraph id="idbf82bbd9ea8647e2b472bc246723f2d5"><enum>(C)</enum><text>a list of the unmet—</text><clause id="id1aee7d1b4bb74716a482ddf4a5d53573"><enum>(i)</enum><text>staffing needs of law enforcement, corrections, and court personnel, including criminal investigators, medical examiners, coroners, forensic technicians, indigent defense staff, and prosecution staff, at tribal and Bureau of Indian Affairs justice agencies;</text></clause><clause id="id7c7df10295b941d493ff2568d880d0c8"><enum>(ii)</enum><text>replacement and repair needs of tribal and Bureau of Indian Affairs corrections facilities;</text></clause><clause id="id4de0ee48fa014ae8895e718aed13ac2a"><enum>(iii)</enum><text>infrastructure and capital needs for tribal police and court facilities, including evidence storage and processing; and</text></clause><clause id="id1224c9bcc1074aee9160d4ef71e0abcb"><enum>(iv)</enum><text>public safety and emergency communications and technology needs; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idffde8dc2fb764e18bfa06eef423b2208"><enum>(b)</enum><header>Department of Justice</header><paragraph id="id4951e4e7-ede3-4a85-b694-e7c93b816518"><enum>(1)</enum><header>Definition of Department of Justice law enforcement agency</header><text>In this subsection, the term <term>Department of Justice law enforcement agency</term> means each of—</text><subparagraph id="id95f93580-95cb-4111-aed0-a932940ba5e1"><enum>(A)</enum><text>the Federal Bureau of Investigation;</text></subparagraph><subparagraph id="id3629b7cf-d838-48b7-b25e-d5c51a65dc95"><enum>(B)</enum><text>the Drug Enforcement Administration;</text></subparagraph><subparagraph id="id67ea57e7-d8af-45e2-811a-c6aad914a84d"><enum>(C)</enum><text>the United States Marshals Service;</text></subparagraph><subparagraph id="ide26ac84e-e9f8-4ab5-82a1-f24657dce1bf"><enum>(D)</enum><text>the Bureau of Alcohol, Tobacco, Firearms and Explosives; and</text></subparagraph><subparagraph id="idd7e0ab75-94ac-4d8b-8507-49b568b435a8"><enum>(E)</enum><text>the Offices of the United States Attorneys.</text></subparagraph></paragraph><paragraph id="id9ef21dd3-2898-4493-9c24-9680826ec067"><enum>(2)</enum><header>Annual report</header><text>Each fiscal year, the Attorney General shall submit to the appropriate committees of Congress a report describing for that fiscal year—</text><subparagraph id="idd4223779-4cb9-4caf-a67f-585e3e3aa0a0"><enum>(A)</enum><text>the number of full-time employees of each Department of Justice law enforcement agency that are assigned to work on criminal investigations and prosecutions in Indian country; and</text></subparagraph><subparagraph id="id6bd2602f4c324ea286b911bf7dfd81a3"><enum>(B)</enum><text>the percentage of time the full-employees spend specifically working in Indian country. </text></subparagraph></paragraph><paragraph id="id268bea5166804fd5b5a6501683d8a6b5"><enum>(3)</enum><header>GAO study and report</header><subparagraph id="idE392D446230B4356A08E0B47AFFFCC85"><enum>(A)</enum><header>In general</header><text>Not later than 18 months after the date on which the first annual report is submitted under paragraph (2), the Comptroller General of the United States shall conduct a study that examines any identified unmet staffing needs for Department of Justice law enforcement agencies tasked with work on criminal investigations and prosecutions in Indian country.</text></subparagraph><subparagraph id="id8F836F32E119444B9D8FBEE2400C6628"><enum>(B)</enum><header>Report</header><text>On completion of the study under subparagraph (A), the Comptroller General of the United States shall submit to Congress a report that describes the results of the study, including, as appropriate, proposals for methods by which the Department of Justice can better measure the unmet staffing needs for Department of Justice law enforcement agencies tasked with work on criminal investigations and prosecutions in Indian country.</text></subparagraph></paragraph></subsection></section></title><title id="id88c9805b-ec92-411c-82a3-47a83d13c85b" style="OLC" changed="added" reported-display-style="italic" committee-id="SLIA00"><enum>II</enum><header>Ensuring safety for Native communities</header><section id="id898ca119-d40a-4d2d-b484-4b9f0852523a"><enum>201.</enum><header>Demonstration program on Bureau of Indian Affairs law enforcement employment background checks</header><subsection id="idbf6e6c95-7c5c-4f9f-bfdd-4241655e204e"><enum>(a)</enum><header>Establishment of program</header><paragraph id="ide3dd2f4d-88c0-4e1d-8c42-c8e65b6c6883"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a demonstration program for the purpose of conducting or adjudicating, in coordination with the Director of the Bureau of Indian Affairs, personnel background investigations for applicants for law enforcement positions in the Bureau of Indian Affairs.</text></paragraph><paragraph id="ide1ad7631-21e4-4c53-be2b-c40c067f5125"><enum>(2)</enum><header>Background investigations and security clearance determinations</header><subparagraph id="id24895537-67da-4906-9051-9050170a39bd"><enum>(A)</enum><header>BIA investigations</header><text>As part of the demonstration program established under paragraph (1), the Secretary may carry out a background investigation, security clearance determination, or both a background investigation and a security clearance determination for an applicant for a law enforcement position in the Bureau of Indian Affairs.</text></subparagraph><subparagraph id="idefc57516-e44b-4228-b006-e728e0aea6a4"><enum>(B)</enum><header>Use of previous investigations and determinations</header><clause id="iddd6cb48a-d8f0-44df-9ecb-3bc5591c5f3d"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), as part of the demonstration program established under paragraph (1), the Secretary, in adjudicating background investigations for applicants for law enforcement positions in the Bureau of Indian Affairs, shall consider previous background investigations for an applicant, security clearance determinations for an applicant, or both background investigations and security clearance determinations for an applicant, as the case may be, that have been conducted by a State or local government, Indian tribe, tribal organization, or the Bureau of Indian Affairs, within the 5-year period preceding the application for employment with the Bureau of Indian Affairs.</text></clause><clause id="id9f4a6e57-5a71-4679-8ad1-0eabbee87fef"><enum>(ii)</enum><header>Quality</header><text>The Secretary shall only consider previous background investigations and security clearance determinations for an applicant that have been conducted by a State or local government, Indian tribe, or tribal organization if the Secretary can verify that those previous investigations and determinations, as the case may be, are of a comparable quality and thoroughness to investigations and determinations carried out by the Bureau of Indian Affairs, the Office of Personnel Management, or another Federal agency.</text></clause><clause id="id6ac85800-3c50-4259-8be6-83465709deae"><enum>(iii)</enum><header>Additional investigation</header><text>If, as described in clause (i), the Secretary considers an existing background investigation, security clearance determination, or both, as the case may be, for an applicant that has been carried out by a State or local government, Indian tribe, tribal organization, or the Bureau of Indian Affairs, the Secretary—</text><subclause id="id2a2dd82c-5907-4ba5-b377-aa90abc70745"><enum>(I)</enum><text>may carry out additional investigation and examination of the applicant if the Secretary determines that such additional information is needed in order to make an appropriate determination as to the character and trustworthiness of the applicant before final adjudication can be made and a security clearance can be issued; and</text></subclause><subclause id="id3d3ffd84-a239-49cc-a1d4-44bb1beff0d9"><enum>(II)</enum><text>shall not initiate a new background investigation process with the National Background Investigations Bureau or other Federal agency unless that new background investigation process covers a period of time that was not covered by a previous background investigation process.</text></subclause></clause><clause id="idbb64c1ff-9607-41ec-97c5-471cfd863eea"><enum>(iv)</enum><header>Agreements</header><text>The Secretary may enter into a Memorandum of Agreement with a State or local government, Indian tribe, or tribal organization to develop steps to expedite the process of receiving and obtaining access to background investigation and security clearance determinations for use in the demonstration program.</text></clause></subparagraph></paragraph><paragraph id="ide3692823-862b-48d8-964f-f7aa2274ce33"><enum>(3)</enum><header>Sunset</header><text>The demonstration program established under this section shall terminate 5 years after the date of the commencement of the program.</text></paragraph></subsection><subsection id="id2f9729df-68d5-49cb-8625-5ce7c2ad4482"><enum>(b)</enum><header>Sufficiency</header><text>Notwithstanding any other provision of law, a background investigation conducted or adjudicated by the Secretary pursuant to the demonstration program authorized in subsection (a) that results in the granting of a security clearance to an applicant for a law enforcement position in the Bureau of Indian Affairs shall be sufficient to meet the applicable requirements of the Office of Personnel Management or other Federal agency for such investigations.</text></subsection><subsection id="idb5ddf7e3-fef5-48e2-8c26-740daf6da7e9"><enum>(c)</enum><header>Annual report</header><text>The Secretary shall submit an annual report to the Committee on Indian Affairs of the Senate and the Committee on Natural Resources of the House of Representatives on the demonstration program established under subsection (a), which shall include a description of—</text><paragraph id="idcafdf1a1-f773-4bb5-ba58-ba0f6fd39c0a"><enum>(1)</enum><text>the demonstration program and any relevant annual changes or updates to the program;</text></paragraph><paragraph id="id9f2718ba-e7b0-4a6e-9a34-17e1d7a066ef"><enum>(2)</enum><text>the number of background investigations carried out under the program;</text></paragraph><paragraph id="id42163454-394b-4345-ac4f-29a54f32b305"><enum>(3)</enum><text>the costs, including any cost savings, associated with the investigation and adjudication process under the program;</text></paragraph><paragraph id="id54a3f757-4078-4b96-b2ab-50b30d53e72b"><enum>(4)</enum><text>the processing times for the investigation and adjudication processes under the program;</text></paragraph><paragraph id="id9b5a23ab-5bc5-477e-8d4d-6a4b7ef85499"><enum>(5)</enum><text>any Memoranda of Agreement entered into with State or local government, Indian tribe, or tribal organization; and</text></paragraph><paragraph id="id36874758-3280-4aca-a47e-60fe07ab3157"><enum>(6)</enum><text>any other information that the Secretary determines to be relevant.</text></paragraph></subsection><subsection id="id76bb5eb8-15e3-4fc7-8631-233265929fbe"><enum>(d)</enum><header>GAO study and report</header><paragraph id="id27ede330-1a4f-43e5-b022-c04e35b169ab"><enum>(1)</enum><header>Initial report</header><text>Not later than 18 months after the date on which the demonstration program commences under this section, the Comptroller General of the United States shall prepare and submit to Congress an initial report on such demonstration program.</text></paragraph><paragraph id="ida9833228-d073-423e-9645-45db0942c088"><enum>(2)</enum><header>Final report</header><text>Not later than 18 months after the date on which the demonstration program terminates under subsection (a)(3), the Comptroller General of the United States shall prepare and submit to Congress a final report on such demonstration program.</text></paragraph><paragraph id="id6c791b22-d348-46fa-970a-80857d567edc"><enum>(3)</enum><header>Tribal input</header><text>In preparing the reports under this subsection, the Comptroller General of the United States shall obtain input from Indian tribes regarding the demonstration program under this section.</text></paragraph></subsection></section><section commented="no" id="idf9b1fd11-ded3-4b6e-acf3-cb1a73441b33"><enum>202.</enum><header>Missing and murdered response coordination grant program</header><subsection id="id04d4049d-5881-4d45-be5f-7f658db7569a"><enum>(a)</enum><header>Establishment of program</header><text>The Attorney General shall establish within the Office of Justice Programs a grant program under which the Attorney General shall make grants to eligible entities described in subsection (b) to carry out eligible activities described in subsection (c).</text></subsection><subsection commented="no" id="ida2687c34-837a-4f03-9b18-166c1cf714a0"><enum>(b)</enum><header>Eligible entities</header><paragraph commented="no" id="id8fe70c24-831d-48d5-8ae5-8db873a261fc"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To be eligible to receive a grant under the grant program established under subsection (a) an entity shall be—</text><subparagraph id="id672716991d1e4e43b51c97f48561ebf0"><enum>(A)</enum><text>an Indian tribe; </text></subparagraph><subparagraph commented="no" id="id5022fb84-088d-46eb-9ceb-3f9c63f7945f"><enum>(B)</enum><text display-inline="yes-display-inline">a relevant Tribal organization;</text></subparagraph><subparagraph commented="no" id="idb96fab81-4e6c-4cb7-b0c4-1d7b0f8e5998"><enum>(C)</enum><text display-inline="yes-display-inline">subject to paragraph (2), a State, in consortium with 1 or more Indian tribes or relevant Tribal organizations;</text></subparagraph><subparagraph id="id08002034-9436-4db5-b2ce-712fd82c91dd"><enum>(D)</enum><text>a consortium of 2 or more Indian tribes or relevant Tribal organizations; or</text></subparagraph><subparagraph id="idf0f467e7-2fdf-4a44-8566-e7fd155ab6cd"><enum>(E)</enum><text>subject to paragraph (2), a consortium of 2 or more States and 1 or more Indian tribes or relevant Tribal organizations.</text></subparagraph></paragraph><paragraph commented="no" id="idbf3d5b3f-d27c-452e-acff-b1de6c55c3d1"><enum>(2)</enum><header>State eligibility</header><text>To be eligible under subparagraph (C) or (E) of paragraph (1), a State shall demonstrate to the satisfaction of the Attorney General that the State—</text><subparagraph commented="no" id="id4df62025-1aec-496a-a788-ad6d57cbfa31"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id9F836224AC4A40B9B839FEC0B9C90FFB"><enum>(i)</enum><text>reports missing persons cases in the State to the national crime information databases; or</text></clause><clause commented="no" id="id06D7BB8BF8F0465094C0CDE2B42AF2F9" indent="up1"><enum>(ii)</enum><text>if not, has a plan to do so using a grant received under the grant program established under subsection (a); and</text></clause></subparagraph><subparagraph id="id34450ED1DF8B470D98730971D13BB4ED"><enum>(B)</enum><text>if data sharing between the State and the Indian tribes and relevant Tribal organizations with which the State is in consortium is part of the intended use of the grant received under the grant program established under subsection (a), has entered into a memorandum of understanding with each applicable Indian tribe and relevant Tribal organization.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id7b18de8e-6dcd-4602-ac51-6a95fc39018d"><enum>(c)</enum><header>Eligible activities</header><text>An eligible entity receiving a grant under the grant program established under subsection (a) may use the grant—</text><paragraph commented="no" id="ida6cf9c8e-d541-4007-b2e6-ee03dcc269f7"><enum>(1)</enum><text display-inline="yes-display-inline">to establish a statewide or regional center—</text><subparagraph commented="no" id="idFB4931C994814B9D990D8280A3928D33"><enum>(A)</enum><text display-inline="yes-display-inline">to document and track missing persons cases of interest to Indian tribes and death investigations of interest to Indian tribes; and</text></subparagraph><subparagraph id="id6a17374bf1a4494aa6998ddc003b200e"><enum>(B)</enum><text>to input information regarding missing persons cases of interest to Indian tribes, unclaimed remains cases of interest to Indian tribes, and unidentified remains cases of interest to Indian tribes into the National Missing and Unidentified Persons System; </text></subparagraph></paragraph><paragraph commented="no" id="id5ce1d04b-6292-4433-abb6-01dbef269054"><enum>(2)</enum><text display-inline="yes-display-inline">to establish a State or regional commission to respond to, and to improve coordination between Federal law enforcement agencies, and Tribal, State, and local law enforcement agencies of the investigation of, missing persons cases of interest to Indian tribes and death investigations of interest to Indian tribes; and</text></paragraph><paragraph commented="no" id="idb5a2fc6a-deac-456a-812a-2f4853e4a343"><enum>(3)</enum><text display-inline="yes-display-inline">to document, develop, and disseminate resources for the coordination and improvement of the investigation of missing persons cases of interest to Indian tribes and death investigations of interest to Indian tribes.</text></paragraph></subsection><subsection commented="no" id="idc6b4f1c0-f630-4f12-a263-20cf5a0f6359"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out the program $1,000,000 for each of fiscal years 2020 through 2024.</text></subsection></section><section commented="no" id="id9c405960-342e-43e6-b455-b6ea5e1fd50e"><enum>203.</enum><header>GAO study on Federal law enforcement agency evidence collection, handling, and
 processing</header><subsection commented="no" id="id9aecdb68-ff67-409b-8c18-a01469902cc8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study—</text><paragraph id="id0f357fa5-e5c1-4bfc-ac0b-062132b21e86"><enum>(1)</enum><text>on the evidence collection, handling, and processing procedures and practices of the Office of Justice Services and the Federal Bureau of Investigation in exercising jurisdiction over crimes involving Indians or committed in Indian country;</text></paragraph><paragraph id="idfb01e24b-73ce-4a99-a851-37545d6628f7"><enum>(2)</enum><text>on any barriers to evidence collection, handling, and processing by the agencies referred to in paragraph (1);</text></paragraph><paragraph id="id77b7120a-e91d-416d-8e2d-e28e55fda9ce"><enum>(3)</enum><text>on the views of law enforcement officials at the agencies referred to in paragraph (1) and their counterparts within the Offices of the United States Attorneys concerning any relationship between—</text><subparagraph id="idac074a43-d14d-4069-967c-050fa9f83fc2"><enum>(A)</enum><text>the barriers identified under paragraph (2); and</text></subparagraph><subparagraph id="id51bfa598-04f0-4335-a42f-93ed4076804c"><enum>(B)</enum><text>United States Attorneys declination rates due to insufficient evidence; and</text></subparagraph></paragraph><paragraph id="idc62b6e29-8e4b-4797-ba6b-3f208a01ead2"><enum>(4)</enum><text>that includes a survey of barriers to evidence collection, handling, and processing faced by—</text><subparagraph id="id15fc17c70ff04b73be71058f56574e03"><enum>(A)</enum><text>Tribal law enforcement agencies; and </text></subparagraph><subparagraph id="idB391A531933148E9A5D34A83F2F7C4A0"><enum>(B)</enum><text>State and local law enforcement agencies that exercise jurisdiction over Indian country under the Act of August 15, 1953 (67 Stat. 588, chapter 505), and the amendments made by that Act.</text></subparagraph></paragraph></subsection><subsection commented="no" id="idad4b080b-5d79-4f93-8825-b5c6dcc7fff8"><enum>(b)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report describing the results of the study conducted under subsection (a).</text></subsection></section><section id="id42b9f11b-ae57-4eb4-9ff4-33f5526a13ce"><enum>204.</enum><header>Bureau of Indian Affairs and Tribal law enforcement officer counseling resources interdepartmental
 coordination</header><text display-inline="no-display-inline">The Secretary of Health and Human Services and the Attorney General shall coordinate with the Director—</text><paragraph id="idA362B12FD74848A3923F8F97582CB14F"><enum>(1)</enum><text display-inline="yes-display-inline">to ensure that Federal training materials and culturally appropriate mental health and wellness programs are locally or regionally available to law enforcement officers working for the Bureau of Indian Affairs or an Indian tribe who are experiencing occupational stress; and</text></paragraph><paragraph id="idF425218A44EF4C81A67A570ADEF3EB62"><enum>(2)</enum><text>to determine whether law enforcement agencies operated by the Bureau of Indian Affairs and Indian tribes are eligible to receive services under—</text><subparagraph id="idC26458DDB9FB41029D1BE33D4376087E"><enum>(A)</enum><text>the Law Enforcement Assistance Program of Federal Occupational Health of the Department of Health and Human Services; or </text></subparagraph><subparagraph id="id40036FBFBD1844209851AC2BC54EE284"><enum>(B)</enum><text>any other law enforcement assistance program targeted to meet the needs of law enforcement officers working for law enforcement agencies operated by the Federal Government or an Indian tribe.</text></subparagraph></paragraph></section></title></legis-body><endorsement><action-date>June 4, 2020</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
