 </paragraph><paragraph id="id24bd0cd977ff4fe29af397a07a305d1a"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> <subparagraph id="id14de097cb8214d83aed1da18459b1f1f"><enum>(A)</enum><text>the <committee-name committee-id="SSAS00">Committee on Armed Services of the Senate</committee-name>;</text>

 </subparagraph><subparagraph id="idF704334CF7AA4A6BAD953D27FAF9D280"><enum>(J)</enum><text>the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>.</text> </subparagraph></paragraph><paragraph id="id7ab0a251672248218f064652686a4e7e"><enum>(3)</enum><header>China</header><text>The term <term>China</term> means the People’s Republic of China.</text>
 </paragraph><paragraph id="idB65848EE6AAF466CAE392E6F32424759"><enum>(4)</enum><header>Financial institution</header><text>The term <term>financial institution</term> has the meaning given that term in section 5312 of title 31, United States Code.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFEDA4EA8E1834C72A5DA39C99B24138F"><enum>(5)</enum><header display-inline="yes-display-inline">Social credit system</header><text display-inline="yes-display-inline">The term <term>social credit system</term> means a system proposed by the Government of China, scheduled to be implemented by 2020, that would aggregate data on every Chinese citizen and business from existing financial credit systems, mass surveillance, public records, online activity, and artificial intelligence to expand the notion of a financial credit score, potentially rewarding or punishing certain financial, social, religious, or political behaviors.</text>
 </paragraph><paragraph id="idea386ab828984d43901e7559219fee08"><enum>(6)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text> <subparagraph id="idda3c2beca93746e2b0a05dc67a554327"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3017a31c87264fbdb2d1826e5d640425"><enum>(B)</enum><text>an entity organized under the laws of the United States or of any jurisdiction within the United States, including a foreign branch of such an entity.</text>
 </subparagraph></paragraph></section><section changed="deleted" committee-id="SSFR00" id="idb1b8ff0651044dc18b0afbdbc3d17aa8" reported-display-style="strikethrough"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text> <paragraph id="idf0f5f2eda859402bae15e9ffa68ac093"><enum>(1)</enum><text>to reaffirm the principles and objectives set forth in the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="public-law" parsable-cite="pl/102/383">Public Law 102–383</external-xref>), namely that—</text>
 <subparagraph id="id613e9998690f4cf684fb8670adecd806"><enum>(A)</enum><text>the United States has <quote>a strong interest in the continued vitality, prosperity, and stability of Hong Kong</quote>;</text> </subparagraph><subparagraph id="id889c5054c97d410aa7002b2443d20931"><enum>(B)</enum><text><quote>[s]upport for democratization is a fundamental principle of United States foreign policy</quote>;</text>
 </subparagraph><subparagraph id="iddd1b91b8c253429aa59c82ae94f06eb1"><enum>(C)</enum><text><quote>the human rights of the people of Hong Kong are of great importance to the United States and are directly relevant to United States interests in Hong Kong [and] serve as a basis for Hong Kong’s continued economic prosperity</quote>; and</text>
 </subparagraph><subparagraph id="id35c97764cca4483b98019dd3325a944a"><enum>(D)</enum><text>Hong Kong must remain sufficiently autonomous from the People’s Republic of China to justify a different treatment under a particular law of the United States, or any provision thereof, from that accorded the People’s Republic of China;</text>
 </subparagraph></paragraph><paragraph id="id0ce8d547092947d1899e546cef2f9929"><enum>(2)</enum><text>to support the democratic aspirations of the people of Hong Kong, as guaranteed to them by the Joint Declaration of the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the People’s Republic of China on the Question of Hong Kong, done at Beijing December 19, 1984 (referred to in this Act as the <quote>Joint Declaration</quote>), the International Covenant on Civil and Political Rights, done at New York December 19, 1966, the Universal Declaration of Human Rights, done at Paris December 10, 1948, and the Basic Law of the Hong Kong Special Administrative Region of the People’s Republic of China (referred to in this Act as the <quote>Basic Law</quote>);</text>
 </paragraph><paragraph id="id086045f1d63f4d2cb883757757943659"><enum>(3)</enum><text>to urge the Government of the People's Republic of China to uphold its commitments to Hong Kong, including allowing the people of Hong Kong to rule Hong Kong with a high degree of autonomy and without undue interference, and ensuring that Hong Kong voters freely enjoy the right to elect the Chief Executive and all members of the Hong Kong Legislative Council by universal suffrage;</text>
 </paragraph><paragraph id="id3bd437851f5c4c608a59cfe5ef5426ee"><enum>(4)</enum><text>to support the establishment of a genuine democratic option to freely and fairly nominate and elect the Chief Executive of Hong Kong, and the establishment by 2020 of open and direct democratic elections for all members of the Hong Kong Legislative Council;</text>
 </paragraph><paragraph id="idc451c2e8ef154c2a8fe24f0f7d25b306"><enum>(5)</enum><text>to support the robust exercise by residents of Hong Kong of the rights to free speech and the press as guaranteed to them by the Basic Law and the Joint Declaration;</text>
 </paragraph><paragraph id="ida5d757f417d944fc8993d56cb123ffff"><enum>(6)</enum><text>to ensure that all residents of Hong Kong are afforded freedom from arbitrary or unlawful arrest, detention, or imprisonment as guaranteed to them by the Basic Law and the Joint Declaration;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb7f25bc0cad14591861ed477cfb28e82"><enum>(7)</enum><text>to draw international attention to any violations by the Government of the People’s Republic of China of the fundamental rights of residents of Hong Kong and any encroachment upon the autonomy guaranteed to Hong Kong by the Basic Law and the Joint Declaration;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id72F337FAD6D94AEEBC6462F366DD327D"><enum>(8)</enum><text>to protect United States citizens and long-term permanent residents living in Hong Kong and those visiting and transiting through Hong Kong; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4C507E63E688448DBDD42004EA881803"><enum>(9)</enum><text>to maintain the economic and cultural ties that provide significant benefits to the United States and Hong Kong.</text>
			</paragraph></section><section changed="deleted" commented="no" committee-id="SSFR00" display-inline="no-display-inline" id="id38636B52C22E4E839728F0122C41191B" reported-display-style="strikethrough"><enum>4.</enum><header>Amendments to the United States-Hong Kong Policy Act of 1992</header>
 <subsection commented="no" display-inline="no-display-inline" id="id9C8CF3C869C240F89D296E4DC9C4DE18"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Title II of the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5721">22 U.S.C. 5721</external-xref> et seq.) is amended—</text> <paragraph id="id0ff1af1c90ae4268868de7ea4bd332d8"><enum>(1)</enum><text>in section 201(b), by inserting <quote>or after</quote> after <quote>entered into before</quote>; and</text>
 </paragraph><paragraph id="idccfab30a87e046a7b216b1249157e887"><enum>(2)</enum><text>adding at the end the following:</text> <quoted-block changed="deleted" committee-id="SSFR00" display-inline="no-display-inline" id="id05C7F7AF479049ADAC851A153A9DC400" reported-display-style="strikethrough" style="OLC"> <section id="id2F272F6585934627B98AF55543E3E898"><enum>205.</enum><header>Secretary of State report regarding the autonomy of Hong Kong</header> <subsection id="idD7841FB62BB24918BA3C3118CC8119E0"><enum>(a)</enum><header>Report</header> <paragraph id="idE27B2060814E483DA4E15CEA51B3560F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State shall annually certify to Congress, in conjunction with the report required under section 301, whether Hong Kong is sufficiently autonomous to justify special treatment by the United States for bilateral agreements and programs, in accordance with this Act, including the degree to which Hong Kong’s autonomy has been eroded due to actions taken by the Government of China that are inconsistent with its commitments in the Basic Law and the Joint Declaration and the impact of such erosion on specific areas of cooperation with the United States, including on political rights, civil liberties, rule of law, freedom of information, religious freedom, and democratic governance in Hong Kong.</text>
 </paragraph><paragraph id="id43f709dfaa0a4157afdf1c1d75781c73"><enum>(2)</enum><header>Factor for consideration</header><text>In making a certification under paragraph (1), the Secretary of State should consider the terms, obligations, and expectations expressed in the Joint Declaration with respect to Hong Kong.</text>
 </paragraph></subsection><subsection id="idbf1cd3c7d4084eda8492078fa2855211"><enum>(b)</enum><header>Waiver authority</header><text>The Secretary of State may waive the application of subsection (a) if the Secretary—</text> <paragraph id="id7ade2b9bc06e46338373e5c14462b0ca"><enum>(1)</enum><text>determines that such a waiver is in the national security interests of the United States; and</text>
 </paragraph><paragraph id="id5fbe0ac7f5d0427b885b4d27b47a4905"><enum>(2)</enum><text>on or before the date on which the waiver takes effect, notifies the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> of the intent to waive such subsection.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="idc459cecb2b4543d293b70e838e6d01a1"><enum>(b)</enum><header>Visa applicants</header><text>Title II of the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5721">22 U.S.C. 5721</external-xref> et seq.), as amended by subsection (a), is further amended by adding at the end the following:</text>
				<quoted-block changed="deleted" committee-id="SSFR00" display-inline="no-display-inline" id="ide7d46dee7cf54a308384fe13fdbc4fd0" reported-display-style="strikethrough" style="OLC">
					<section id="id2a7d47fbd5724e34ac0742ffdf93604f"><enum>206.</enum><header>Treatment of Hong Kong applicants for visas to study or work in the United States</header>
 <subsection id="id4764ae58d3364fd69823e213123fe5c5"><enum>(a)</enum><header>Statement of policy</header><text>Notwithstanding any other provision of law, applications for visas to enter, study, or work in the United States, which are submitted by otherwise qualified applicants who resided in Hong Kong in 2014, shall not be denied on the basis of the applicant’s arrest, detention, or other adverse government action taken as a result of the applicant’s participation in nonviolent protest activities related to the electoral process, internationally recognized human rights, protecting an independent judiciary, or the rule of law.</text>
 </subsection><subsection id="id5129fe634c7246ee8f05e181f21cdf7d"><enum>(b)</enum><header>Implementation</header><text>The Secretary of State shall take such steps as may be necessary to ensure that consular officers are aware of the policy described in subsection (a) and receive appropriate training and support to ensure that the policy is carried out so that affected individuals do not face discrimination or unnecessary delay in the processing of their visa applications, including—</text>
 <paragraph id="id33e72bb77342420583570a5c66c27ab4"><enum>(1)</enum><text>providing specialized training for consular officers posted to Hong Kong, Beijing, Guangzhou, or Macau;</text>
 </paragraph><paragraph id="id4c2dd43859634c47890e893703448c3d"><enum>(2)</enum><text>instructing the United States Consulate in Hong Kong to maintain an active list of individuals whom are known to have been detained, arrested, or otherwise targeted by the Government of Hong Kong or of China, or intermediaries of such governments, as a result of their participation in the 2014 protests, to facilitate the cross-checking of visa applications for Hong Kong residents;</text>
 </paragraph><paragraph id="idbfa58b41117e4535affb88c7a038b115"><enum>(3)</enum><text>amending the physical and online versions of the visa application, as necessary, to notify relevant applicants of such policy; and</text>
 </paragraph><paragraph id="idac031ae11eb9472088ed650a29017559"><enum>(4)</enum><text>instructing personnel at the United States Consulate in Hong Kong to engage with relevant individuals in the Hong Kong community to proactively inform them that they will not face discrimination when applying for a visa to the United States due to any adverse action taken against them by the authorities as a result of their participation in the 2014 protests or other peaceful pro-democracy or human rights demonstrations.</text>
 </paragraph></subsection><subsection id="iddf06479fc50e498fab6b4dccd58b5743"><enum>(c)</enum><header>Cooperation with like-Minded countries</header><text>The Secretary of State, or his or her designee, shall contact appropriate representatives of other democratic countries, particularly those who receive a large number of applicants for student and employment visas from Hong Kong—</text>
 <paragraph id="id246163c32cc947a48fea766f869a505f"><enum>(1)</enum><text>to inform them of the United States policy regarding arrests for participation in nonviolent protests in Hong Kong;</text>
 </paragraph><paragraph id="id2cec1e5af22440e4b001ba504913c0e0"><enum>(2)</enum><text>to encourage them to take similar steps to ensure the rights of nonviolent protesters are protected from discrimination due to the actions of the Government of Hong Kong and of China; and</text>
 </paragraph><paragraph id="id0b2e1bbea0ac4601a81abbbeb40c3bda"><enum>(3)</enum><text>to offer to share information, as appropriate, regarding the execution of such policy, including information regarding persons eligible for relief under such policy.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section changed="deleted" committee-id="SSFR00" id="idea657dbbea3e442dbd63b212bb96859a" reported-display-style="strikethrough"><enum>5.</enum><header>Annual report on enforcement of United States export control and sanctions laws by Hong Kong</header>
 <subsection id="id744841342e1d4616b8ea5af6e5bfa7cb"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Secretary of Commerce, in consultation with the Secretary of the Treasury and the Secretary of State, shall submit a report to the committees specified in subsection (b) that includes—</text>
 <paragraph id="id70cfc8a2529f4a83ab64caf0c17bacc5"><enum>(1)</enum><text>an assessment of whether the Government of Hong Kong has adequately enforced the export control laws of the United States with respect to sensitive dual-use items;</text>
 </paragraph><paragraph id="idAF990BF9FFD7447389763E551BA0D6A6"><enum>(2)</enum><text>to the extent possible, an identification of—</text> <subparagraph id="id47256E666DAF4273BA5567DA6D1D89EA"><enum>(A)</enum><text>any items that were reexported from Hong Kong in violation of such laws;</text>
 </subparagraph><subparagraph id="idB1EB0A9E2C5841DB91DDF1D6568F21EC"><enum>(B)</enum><text>the countries and persons to which such items were reexported; and</text> </subparagraph><subparagraph id="idE84CF3CD357544E3942B7439844DFB02"><enum>(C)</enum><text>how such items were used;</text>
 </subparagraph></paragraph><paragraph id="id1e5ef20221c34fdd8482f46c688efec3"><enum>(3)</enum><text>an assessment of whether sensitive dual-use items subject to the export control laws of the United States are being—</text>
 <subparagraph id="idF197AB0F71C64D5C834C194AD22F2C45"><enum>(A)</enum><text>transshipped through Hong Kong; and</text> </subparagraph><subparagraph id="idE2CE6E86ECD14E509536E43B2FA9A321"><enum>(B)</enum><text>used to develop—</text>
 <clause id="idFFDCC5F407E14BA7B7BCD0CDF1F36C39"><enum>(i)</enum><text>the Sharp Eyes, Skynet, Integrated Joint Operations Platform, or other systems of mass surveillance and predictive policing; or</text>
 </clause><clause id="id9257268DB69F412ABA41CF008BAF4FEC"><enum>(ii)</enum><text>the <quote>social credit</quote> system of China;</text> </clause></subparagraph></paragraph><paragraph id="id9e6a7abdc9fc40418cb05485cae5e9c9"><enum>(4)</enum><text>an assessment of the efforts by the Government of China to use the status of Hong Kong as a separate customs territory to import items into China in violation of the export control laws of the United States, whether as part of the Greater Bay Area plan, the assignment of Hong Kong by Beijing as a national technology and innovation center, or through other programs that may exploit Hong Kong as a conduit for controlled sensitive technology;</text>
 </paragraph><paragraph id="id4fd5bd0c59074c178bbb6b6b933f300b"><enum>(5)</enum><text>an assessment of whether the Government of Hong Kong has adequately enforced sanctions imposed by the United States and the United Nations; and</text>
 </paragraph><paragraph id="idDB5B74F924894B2F96AEE00C6D29A207"><enum>(6)</enum><text>a description of the types of goods and services transshipped or reexported through Hong Kong in violation of such sanctions to—</text>
 <subparagraph id="idD3A9493C3C84456AAD4B2213AB32B8AE"><enum>(A)</enum><text>North Korea or Iran; or</text> </subparagraph><subparagraph id="id384D1F1D0A384F9491845D777B93B34E"><enum>(B)</enum><text>other countries, regimes, or persons subject to such sanctions for engaging in activities—</text>
 <clause id="id0640AC05152C447994B62ACBD37FCF69"><enum>(i)</enum><text>relating to international terrorism, international narcotics trafficking, or the proliferation of weapons of mass destruction; or</text>
 </clause><clause id="idABCF405718BF4F268844486026780ACC"><enum>(ii)</enum><text>that otherwise present a threat to the national security, foreign policy, or economy of the United States.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id24E2D26DFACA4D318CCA007146AE7ADA"><enum>(b)</enum><header>Committees specified</header><text>The committees specified in this subsection are—</text> <paragraph id="idD48E777A7EF7464083A463CEB1A756DD"><enum>(1)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text>
 </paragraph><paragraph id="idC7603C4255BA444393B6D1DD832A4FFC"><enum>(2)</enum><text>the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs of the Senate</committee-name>;</text> </paragraph><paragraph id="idA3AAA2DB523142BF9A6DED77817678D1"><enum>(3)</enum><text>the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>;</text>

 </paragraph></subsection><subsection id="id6432d5a1ef444f3c8555de900ceda349"><enum>(c)</enum><header>Form of report</header><text>The report required under subsection (a) shall be submitted in unclassified form, but may include a classified annex.</text>
			</subsection></section><section changed="deleted" committee-id="SSFR00" id="idea44b2888bca49d0924b92599f26234c" reported-display-style="strikethrough"><enum>6.</enum><header>Protecting United States citizens and others from rendition to mainland China</header>
 <subsection id="id204da2be400a46e39c71f69fb18e888b"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text> <paragraph id="id96718f89da124901b94c6990c231aa15"><enum>(1)</enum><text>The proposed amendments to Hong Kong’s Fugitive Ordinance, if enacted—</text>
 <subparagraph id="id89B19CAE510049A38D011D4EA7962919"><enum>(A)</enum><text>would allow rendition from Hong Kong of residents or foreign nationals to countries—</text> <clause id="id92CD80605CDE436D8F279D4F6F01CED7"><enum>(i)</enum><text>with criminal procedure systems that lack strong protections for the rights of defendants; or</text>
 </clause><clause id="id2A2845A4D3B8402F89C447B137093E25"><enum>(ii)</enum><text>in which the law is used as to repress internationally recognized human rights, including to mainland China;</text>
 </clause></subparagraph><subparagraph id="id990caacc241e43ec8db7d619eca58818"><enum>(B)</enum><text>would remove independent legislative oversight and appropriate judicial review of extradition requests;</text>
 </subparagraph><subparagraph id="idD4B563909C224B15AE795738591FF11D"><enum>(C)</enum><text>may increase the influence of the Government of China in Hong Kong and further erode the autonomy guaranteed Hong Kong by the Joint Declaration; and</text>
 </subparagraph><subparagraph id="id5cf6312f865647b99e5516e25a3c16bd"><enum>(D)</enum><text>would erode Hong Kong’s reputation as a center of commerce and freedom governed by the rule of law.</text> </subparagraph></paragraph><paragraph id="id66f6d51fc61e49dd8cdab7e3bd2c21dd"><enum>(2)</enum><text>The Government of China has subjected Chinese and foreign nationals, including citizens of the United States, Canada, Australia, Sweden, and Taiwan, to arbitrary detention, televised confessions, denial of legal representation and medical treatment, and other type of mistreatment.</text>
 </paragraph></subsection><subsection id="idd23bf12db15c458aabc4b427c7745400"><enum>(b)</enum><header>Policy statements</header><text>It is the policy of the United States—</text> <paragraph id="idf3d30b571c694cf1b7295187b97fd382"><enum>(1)</enum><text>to ensure that United States citizens are protected from rendition to mainland China;</text>
 </paragraph><paragraph id="id10887995d1e94886a3150b199b3b5067"><enum>(2)</enum><text>pursuant to section 103(7) of the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5713">22 U.S.C. 5713(7)</external-xref>), to encourage United States businesses <quote>to continue to operate in Hong Kong in accordance with applicable United States and Hong Kong law</quote>; and</text>
 </paragraph><paragraph id="id30f704e8404840838b956b83bddf4121"><enum>(3)</enum><text>pursuant to section 201(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/5721">22 U.S.C. 5721(b)</external-xref>), to decide whether the Government of Hong Kong is <quote>legally competent to carry out its obligations</quote> under treaties and international agreements established between the United States and Hong Kong.</text>
 </paragraph></subsection><subsection id="id57cf53a16956435a89da24a2634f4de1"><enum>(c)</enum><header>Response to threat of rendition</header><text>If the proposed amendments to Hong Kong’s Fugitive Offenders Ordinance are enacted, and the amended law allows renditions to countries that lack protection for the rights of defendants—</text>
 <paragraph id="id37529beb9ca544c9b4936b26df4bc5e3"><enum>(1)</enum><text>not later than 30 days after the date of the enactment of such amendments, the President shall submit a report to the appropriate congressional committees that—</text>
 <subparagraph id="idA0CFF2EE885B444697CB9E0AA913EB47"><enum>(A)</enum><text>assesses whether the Government of Hong Kong is <quote>legally competent</quote> to administer the United States-Hong Kong Agreement for the Surrender of Fugitive Offenders;</text> </subparagraph><subparagraph id="id261AE25B416B48D58CEECB4D52F5B4D7"><enum>(B)</enum><text>determines whether any additional authorities are needed to revise or withdraw from that treaty to protect United States citizens and national security and to support the guaranteed protections of the Joint Declaration; and</text>
 </subparagraph><subparagraph id="iddab3daac45fe4049bb375db94ab138f0"><enum>(C)</enum><text>includes a strategy for protecting United States citizens from rendition to mainland China from Hong Kong, including an assessment of—</text>
 <clause id="id11BD16D6CA1144148DFBEBAD11076F61"><enum>(i)</enum><text>whether additional resources are needed for American Citizen Services at the United States Consulate in Hong Kong; and</text>
 </clause><clause id="id3B9B1ADFF7DE4DD1BB443EA2BF54CA10"><enum>(ii)</enum><text>whether the Department of State will revise the travel advisory for Hong Kong to reflect the potential impact of the revised Fugitive Offenders Ordinance on United States residents and individuals traveling to, or transiting through, Hong Kong; and</text>
 </clause></subparagraph></paragraph><paragraph id="id9a6d9f5215b14f3dab01f72e0cde733c"><enum>(2)</enum><text>if the Government of Hong Kong enacts a new law regarding national security, pursuant to Article 23 of the Basic Law, the President and the Secretary of State shall take the actions required under paragraph (1) and any additional actions required under section 202 of the United States-Hong Kong Policy Act of 1992 (U.S.C. 5722) unless Secretary of State certifies that—</text>
 <subparagraph id="idCD3011F1897B461A9169AF18516144C4"><enum>(A)</enum><text>the new law does not violate the guarantees of the Joint Declaration; and</text> </subparagraph><subparagraph id="id1666F2AF48634629BD3E986476100A62"><enum>(B)</enum><text>the internationally recognized human rights of Hong Kong citizens and foreign residents will not be restricted as a result of the new law’s implementation.</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSFR00" id="ida27e927cc54b4f25855baed8d2accdfc" reported-display-style="strikethrough"><enum>7.</enum><header>Identification of persons responsible for abductions  and for other actions to suppress basic
			 freedoms in Hong Kong</header>
 <subsection id="id97649711afb24a0faae83c34f9aaf9ee"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter in conjunction with the publication of the report required under section 301 of the Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5731">22 U.S.C. 5731</external-xref>) the President shall submit, to the appropriate congressional committees, a list containing the name of each person who the President determines, based on credible information, is responsible for—</text>
 <paragraph id="id836bd6e3b24843eaae51196dd06b93e1"><enum>(1)</enum><text>the surveillance, abduction, detention, abuse, or forced confession of Gui Minhai, Lee Bo, Lam Wing-kee, Lui Bo, or Cheung Chi-ping, all of whom are involved in the operation of the Mighty Current Publishing House based in Hong Kong;</text>
 </paragraph><paragraph id="id3a259842784f46fdb0512591f780dc44"><enum>(2)</enum><text>the surveillance, abduction, detention, abuse, or forced confession of Guo Zhongxiao or Wang Jianmin, both of whom are involved in the operation of magazine publications based in Hong Kong; or</text>
 </paragraph><paragraph id="id284b8767fae64eb3b16d21a2450515b0"><enum>(3)</enum><text>the rendition to the mainland of the People’s Republic of China of any individual, or the arbitrary detention, torture, or forced confession of any individual after rendition, in connection with the exercise by that individual of internationally recognized human rights in Hong Kong, including such individuals extradited to the mainland of the People's Republic of China under any amended fugitive offenders ordinance in Hong Kong.</text>
 </paragraph></subsection><subsection id="idbc4f435517fe46fba3f89a4357949457"><enum>(b)</enum><header>Consideration of certain information</header><text>In preparing the list required under subsection (a), the President shall consider—</text> <paragraph id="id3225E65792A547CEBFEE54D401BA15C2"><enum>(1)</enum><text>information provided by the chairperson and ranking member of each of the appropriate congressional committees; and</text>
 </paragraph><paragraph id="idDEC1864BEF5F4146ACCABB5C80AB548E"><enum>(2)</enum><text>credible information obtained by other countries or nongovernmental organizations, including organizations inside China or Hong Kong, that monitor the human rights abuses of the Government of the China or its agents.</text>
				</paragraph></subsection><subsection id="id23a9f2a2896544ea9fb93faa98d518e0"><enum>(c)</enum><header>Requests by chairperson and ranking member of appropriate congressional committees</header>
 <paragraph id="id39211173827141fd975f3933c8f4a5a6"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after receiving a written request from the chairperson and ranking member of 1 of the appropriate congressional committees with respect to whether a person meets the criteria for being added to the list required under subsection (a), the President shall submit a response to the chairperson and ranking member of the committee that made the request with respect to the status of the person.</text>
 </paragraph><paragraph id="ide9afdffd61c741979b7d980ea995908b"><enum>(2)</enum><header>Information about removal decisions</header><text>If the President removes from the list required under subsection (a) a person that was placed on the list at the request of the chairperson and ranking member of 1 of the appropriate congressional committees, the President shall provide the chairperson and ranking member with any information that contributed to the decision to remove the person.</text>
 </paragraph><paragraph id="idA97F1C9A88F747F4851AAAF73F91C50F"><enum>(3)</enum><header>Form</header><text>The President may submit a response required under paragraph (1) in classified form if the President determines that such classification is vital to the national security interests of the United States.</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSFR00" id="id7e3d79c74a524d1b961f06182ef60ef8" reported-display-style="strikethrough"><enum>8.</enum><header>Inadmissibility of certain aliens and family members</header>
 <subsection id="id65b52f0442e34e43bc9b453bbd5bd837"><enum>(a)</enum><header>In general</header><text>Section 212(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block changed="deleted" committee-id="SSFR00" display-inline="no-display-inline" id="id3520d48cf4844f0d8588718ff854827c" reported-display-style="strikethrough" style="OLC">
 <subparagraph id="ide7b58936b6834ac7a05ce3650d7e8363"><enum>(J)</enum><header>Certain aliens responsible for abductions or extraditions from hong kong</header><text>Any alien included in the list submitted by the President under section 7(a) of the <short-title>Hong Kong Human Rights and Democracy Act of 2019</short-title> is inadmissible.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idc559124cde374f80bb21132174ac4fdc"><enum>(b)</enum><header>Current visas revoked</header>
 <paragraph id="idBD61CC70281646CA9D74758726F81B4E"><enum>(1)</enum><header>In general</header><text>The issuing consular officer, the Secretary of State, or the Secretary of Homeland Security (or a designee of either Secretary) shall revoke any visa or other entry documentation issued to any alien who is included on the list required under section 7(a), regardless of when such visa or entry documentation was issued.</text>
 </paragraph><paragraph id="idBAC1F6CF4B6F49B08076A28499E01FD2"><enum>(2)</enum><header>Effective date</header><text>Revocations under paragraph (1) shall take effect on the date such action is taken and shall automatically cancel any other valid visa or entry documentation that is in the alien’s possession.</text>
				</paragraph></subsection><subsection id="id4b960ffc352b4f96a4724f7b7e73523d"><enum>(c)</enum><header>Waiver for national security interests</header>
 <paragraph id="ida23cc5ea5c4d4807b4a699bcfb40b6cf"><enum>(1)</enum><header>In general</header><text>The Secretary of State may waive, with respect to an alien, the application of section 212(a)(2) of the Immigration and Nationality Act, as amended by subsection (a), or the application of subsection (b) if the Secretary—</text>
 <subparagraph id="id96d61b1bfef1448d96ed4186e6334a79"><enum>(A)</enum><text>determines that such waiver—</text> <clause id="id6cb36adafa1243b1947d13f518f62f9b"><enum>(i)</enum><text>is necessary to permit the United States to comply with the Agreement between the United Nations and the United States of America regarding the Headquarters of the United Nations, signed June 26, 1947, and entered into force November 21, 1947, or other applicable international obligations of the United States; or</text>
 </clause><clause id="id6fe47ea7a187405394df89d543848444"><enum>(ii)</enum><text>is vital to the national security interests of the United States; and</text> </clause></subparagraph><subparagraph id="idd2d9a624eb9c497cae6f7fd67544624b"><enum>(B)</enum><text>before granting such waiver, provides to the appropriate congressional committees notice of, and a justification for, the waiver.</text>
 </subparagraph></paragraph><paragraph id="idf74e9b09c24c4cdd82794a7f4be08a16"><enum>(2)</enum><header>Timing for certain waivers</header><text>Notification under subparagraph (B) of paragraph (1) shall be made not later than 15 days before granting a waiver under such paragraph if the Secretary grants such waiver under subparagraph (A)(ii) of such paragraph.</text>
 </paragraph></subsection><subsection id="idd7bbabc633794b68b6f8f26a2c9c9f0f"><enum>(d)</enum><header>Regulatory authority</header><text>The Secretary of State shall prescribe such regulations as may be necessary to carry out this section.</text>
			</subsection></section><section changed="deleted" committee-id="SSFR00" id="id35cfeee9a23e428ebe24bff2c910d459" reported-display-style="strikethrough"><enum>9.</enum><header>Financial measures</header>
 <subsection id="id4a820c4e1f9c4298bad243223bedae09"><enum>(a)</enum><header>Blocking of property</header><text>The President shall exercise all powers granted by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) (except that the requirements of section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref>) shall not apply) to the extent necessary to block and prohibit all transactions in all property and interests in property of a person on the list required under section 7(a) if such property and interests in property—</text>
 <paragraph id="idDB5D45A8E4584F6A98802D71DCAA0847"><enum>(1)</enum><text>are in the United States;</text> </paragraph><paragraph id="id55D3CA4CBCA345898DC2FC54A6FDE7E0"><enum>(2)</enum><text>come within the United States; or</text>
 </paragraph><paragraph id="id19FC6041EE214272AB013E2B98BC3783"><enum>(3)</enum><text>are or come within the possession or control of a United States person.</text>
				</paragraph></subsection><subsection id="id2daec3f43b8b4ee68e5695e0ab04b607"><enum>(b)</enum><header>Exception for importation of goods</header>
 <paragraph id="idbe09df34099e424787c40d42a5540e29"><enum>(1)</enum><header>In general</header><text>The requirement to impose sanctions under subsection (a) shall not include the authority to impose sanctions with respect to the importation of goods.</text>
 </paragraph><paragraph id="idaf06df6fc928432599a9cc0a3111aa90"><enum>(2)</enum><header>Good defined</header><text>In this subsection, the term <term>good</term> means any article, natural or manmade substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text>
 </paragraph></subsection><subsection id="id58c8dbd844e945a9a5b54a939da08bef"><enum>(c)</enum><header>Waiver for national security interests</header><text>The President may waive the application of subsection (a) if the President—</text> <paragraph id="idCA963B21AC694B1797B83F1E7BCB0D60"><enum>(1)</enum><text>determines that such waiver is vital for the national security interests of the United States; and</text>
 </paragraph><paragraph id="idBD1A89A196BC44CAA06457A7DC1E2FE1"><enum>(2)</enum><text>not later than 15 days before granting the waiver, submits to the appropriate congressional committees notice of, and a justification for, the waiver.</text>
				</paragraph></subsection><subsection id="id96380f1da7794c4b81c13ff8355f42e8"><enum>(d)</enum><header>Enforcement</header>
 <paragraph id="idd2e7d283a3454e57a80df4552df13717"><enum>(1)</enum><header>Penalties</header><text>Any person that violates, attempts to violate, conspires to violate, or causes a violation of subsection (a) or any regulation, license, or order issued to carry out that subsection shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of such section.</text>
 </paragraph><paragraph id="id2a837348d8044c99bb71c0f80a45aeb2"><enum>(2)</enum><header>Requirements for financial institutions</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of the Treasury shall prescribe or amend regulations to the extent necessary to require each financial institution that is a United States person and has within its possession or control assets that are property or interests in property of a person on the list required under section 7(a) to certify to the Secretary that, to the best of the knowledge of the financial institution, the financial institution has blocked all assets within the possession or control of the financial institution in accordance with subsection (a).</text>
 </paragraph><paragraph id="id862ada4a0cbf49bdbd56fb444c3b4ff5"><enum>(3)</enum><header>Notification to congress</header><text>Not later than 10 days before prescribing or revising regulations under paragraph (2), the President shall notify the appropriate congressional committees of the proposed regulations and the provisions of this Act or amendments made by this Act that the regulations are implementing.</text>
 </paragraph></subsection><subsection id="id9e6bbd8e5599456186eeb1e823a24144"><enum>(e)</enum><header>Rulemaking</header><text>The Secretary of the Treasury shall issue such regulations, licenses, and orders as may be necessary to carry out this section.</text>
			</subsection></section><section changed="deleted" committee-id="SSFR00" id="id353b700082e5427d877111b6e663646c" reported-display-style="strikethrough"><enum>10.</enum><header>Reports to Congress</header>
 <subsection id="ideeb38a5507f0442082ca3f362efe3b9d"><enum>(a)</enum><header>In general</header><text>The President shall submit a report to the appropriate congressional committees that includes—</text> <paragraph id="idff833bae9de34b258d3a651633580521"><enum>(1)</enum><text>a list of each foreign person with respect to which the President imposed sanctions pursuant to section 8 or 9 during the 1-year period preceding the submission of the report;</text>
 </paragraph><paragraph id="idf861c0fe4d37474b878476e32bd32ca3"><enum>(2)</enum><text>a description of the type of sanctions imposed with respect to each such person;</text> </paragraph><paragraph id="id490a26befe084e1ab7dbe1f1a23c6335"><enum>(3)</enum><text>the number of foreign persons with respect to which the President—</text>
 <subparagraph id="id27c540735e4b408da56e0a097c96872b"><enum>(A)</enum><text>imposed sanctions under section 8 or 9 during that year; and</text> </subparagraph><subparagraph id="idf52e6c8c12184c98921c08cf9a6aaf00"><enum>(B)</enum><text>terminated sanctions under section 8 or 9 during that year;</text>
 </subparagraph></paragraph><paragraph id="id478a67ddaa2b47c7a49aa829b280f449"><enum>(4)</enum><text>the dates on which such sanctions were imposed or terminated; and</text> </paragraph><paragraph id="id5d6aa99e3f444e0a81e4e156b20d6784"><enum>(5)</enum><text>the reasons for imposing or terminating such sanctions.</text>
				</paragraph></subsection><subsection id="idd5093f3a61fa48c88e83fec065da1164"><enum>(b)</enum><header>Dates for submission</header>
 <paragraph id="ide37e48ecd9604bc586135741255dccf4"><enum>(1)</enum><header>Initial report</header><text>The President shall submit the initial report under subsection (a) not later than 1 year after the date of the enactment of this Act.</text>
				</paragraph><paragraph id="ide8c6589581994242819034c2d92d2471"><enum>(2)</enum><header>Subsequent reports</header>
 <subparagraph id="ida6825e66e4a34d9394d6770566ec89f0"><enum>(A)</enum><header>In general</header><text>The President shall submit a report under subsection (a) on December 10, or the first day thereafter on which both Houses of Congress are in session, of—</text>
 <clause id="id37919f18f3dd4594a553fa5bd4586125"><enum>(i)</enum><text>the calendar year in which the initial report is submitted if the initial report is submitted before December 10 of that calendar year; and</text>
 </clause><clause id="ide010e375eedd42fcafeca6426b2f5e8f"><enum>(ii)</enum><text>each calendar year thereafter.</text> </clause></subparagraph></paragraph></subsection><subsection id="id5332d05f31444a6a99817e0bd50eaf2f"><enum>(c)</enum><header>Form of report</header> <paragraph id="idb9b3732662624e8890162800fd705869"><enum>(1)</enum><header>In general</header><text>Each report required under subsection (a) shall be submitted in unclassified form, but may include a classified annex.</text>
 </paragraph><paragraph id="ida805829b859f4a87bca4b6dac6752b2a"><enum>(2)</enum><header>Exception</header><text>The name of a foreign person to be included in the list required under subsection (a)(1) may not be included in the classified annex authorized under paragraph (1) unless the President—</text>
 <subparagraph id="idc773c1e09d794737bacf5ba89bc803df"><enum>(A)</enum><text>determines that such inclusion is vital to the national security interests of the United States;</text> </subparagraph><subparagraph id="id90609f99d881421a8f611c0c6a8d30c5"><enum>(B)</enum><text>uses the annex in a manner consistent with congressional intent and the purposes of this Act; and</text>
 </subparagraph><subparagraph id="idb2d96466ff9949298dfa3529e679b2e5"><enum>(C)</enum><text>not later than 15 days before including such name in the classified annex, provides to the appropriate congressional committees notice of, and a justification for, including the name in the classified annex despite any publicly available credible information indicating that the person engaged in an activity described in section 8 or 9.</text>
					</subparagraph></paragraph></subsection><subsection id="id156ae66318b943b69b1f9bad468b88bd"><enum>(d)</enum><header>Public availability</header>
 <paragraph id="idd7e8e6ad07af4269ace3ba2b5698d49e"><enum>(1)</enum><header>In general</header><text>The unclassified portion of the report required under subsection (a) shall be made available to the public, including through publication in the Federal Register.</text>
 </paragraph><paragraph id="idaeb8278bb4254b1e9ec950f2779423d1"><enum>(2)</enum><header>Nonapplicability of confidentiality requirement with respect to visa records</header><text>The President shall publish the list required under subsection (a)(1) without regard to the requirements under section 222(f) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1202">8 U.S.C. 1202(f)</external-xref>) with respect to confidentiality of records pertaining to the issuance or refusal of visas or permits to enter the United States.</text></paragraph></subsection></section></legis-body>

 <subparagraph commented="no" display-inline="no-display-inline" id="idAEF969B09CAE43818F769AD869D8E708"><enum>(A)</enum><text display-inline="yes-display-inline">use existing financial credit systems, public records, online activity, and other tools of surveillance to aggregate data on every Chinese citizen and business; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC6B80C89A66A4932AE6F1991748A1464"><enum>(B)</enum><text display-inline="yes-display-inline">use such data to monitor, shape, and rate certain financial, social, religious, or political behaviors.</text>
 </subparagraph></paragraph><paragraph id="idcc6ba563-0944-456c-a76c-f8efaca08cc0"><enum>(3)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text> <subparagraph id="id57ba1dab-f347-4b65-8b25-2f52f0603d26"><enum>(A)</enum><text>a United States citizen;</text>
 </subparagraph><subparagraph id="id53E7629D9B0847B5BDC599CEAFA1826D"><enum>(B)</enum><text>a lawfully admitted permanent resident of the United States; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4080bc7b-5915-4482-81f8-8d3da0a89523"><enum>(C)</enum><text>an entity organized under the laws of—</text> <clause commented="no" display-inline="no-display-inline" id="id92809D4F9E5649DE90B96C123E9955A9"><enum>(i)</enum><text>the United States; or</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id07CE4B781CAF4B08BB622D9A197843D1"><enum>(ii)</enum><text>any jurisdiction within the United States, including a foreign branch of such an entity.</text>
 </clause></subparagraph></paragraph></section><section changed="added" committee-id="SSFR00" id="iddc45955b-10ff-4f56-81ac-937521fa8a63" reported-display-style="italic"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text> <paragraph id="id01d3ee0f-1ac1-43d3-aa49-efa42b154015"><enum>(1)</enum><text>to reaffirm the principles and objectives set forth in the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="public-law" parsable-cite="pl/102/383">Public Law 102–383</external-xref>), namely that—</text>
 <subparagraph id="id74ea6cf9-f490-49c3-a02d-319466bb2691"><enum>(A)</enum><text>the United States has <quote>a strong interest in the continued vitality, prosperity, and stability of Hong Kong</quote>;</text> </subparagraph><subparagraph id="idf83a500a-6783-4ff1-9b73-566b6b57f8ef"><enum>(B)</enum><text><quote>[s]upport for democratization is a fundamental principle of United States foreign policy</quote> and therefore <quote>naturally applies to United States policy toward Hong Kong</quote>;</text>
 </subparagraph><subparagraph id="iddeb6ef54-df9c-4c02-bac4-77aadccd1980"><enum>(C)</enum><text><quote>the human rights of the people of Hong Kong are of great importance to the United States and are directly relevant to United States interests in Hong Kong [and] serve as a basis for Hong Kong’s continued economic prosperity</quote>; and</text>
 </subparagraph><subparagraph id="id86c8f68e-0511-47a8-96c7-94682ba0a565"><enum>(D)</enum><text>Hong Kong must remain sufficiently autonomous from the People’s Republic of China to <quote>justify treatment under a particular law of the United States, or any provision thereof, different from that accorded the People’s Republic of China</quote>;</text>
 </subparagraph></paragraph><paragraph id="id8b63f35b-0c14-430a-86f9-8ea9f6ea2c27"><enum>(2)</enum><text>to support the high degree of autonomy and fundamental rights and freedoms of the people of Hong Kong, as enumerated by—</text>
 <subparagraph id="idACDD8FD39B194046BE9F9D2A1EF1E21B"><enum>(A)</enum><text>the Joint Declaration of the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the People’s Republic of China on the Question of Hong Kong, done at Beijing December 19, 1984 (referred to in this Act as the <quote>Joint Declaration</quote>);</text>
 </subparagraph><subparagraph id="id0AD62ACD0B1240C0A59EF9C11403A713"><enum>(B)</enum><text>the International Covenant on Civil and Political Rights, done at New York December 19, 1966; and</text>
 </subparagraph><subparagraph id="id9B8BD130AA58404A9436E10A8D610937"><enum>(C)</enum><text>the Universal Declaration of Human Rights, done at Paris December 10, 1948;</text>
 </subparagraph></paragraph><paragraph id="id8DAAD76E3574462FBBCEDDBAEB7B08AF"><enum>(3)</enum><text>to support the democratic aspirations of the people of Hong Kong, including the <quote>ultimate aim</quote> of the selection of the Chief Executive and all members of the Legislative Council by universal suffrage, as articulated in the Basic Law of the Hong Kong Special Administrative Region of the People’s Republic of China (referred to in this Act as the <quote>Basic Law</quote>);</text>
 </paragraph><paragraph id="ide750d1ce-fb69-44f9-b30b-f131ab6be3da"><enum>(4)</enum><text>to urge the Government of the People’s Republic of China to uphold its commitments to Hong Kong, including allowing the people of Hong Kong to govern Hong Kong with a high degree of autonomy and without undue interference, and ensuring that Hong Kong voters freely enjoy the right to elect the Chief Executive and all members of the Hong Kong Legislative Council by universal suffrage;</text>
 </paragraph><paragraph id="ide976a3cf-877b-4f76-aa86-c7cef5e4761a"><enum>(5)</enum><text>to support the establishment of a genuine democratic option to freely and fairly nominate and elect the Chief Executive of Hong Kong, and the establishment by 2020 of open and direct democratic elections for all members of the Hong Kong Legislative Council;</text>
 </paragraph><paragraph id="id62e990b0-8298-4df2-b616-a74b628ee744"><enum>(6)</enum><text>to support the robust exercise by residents of Hong Kong of the rights to free speech, the press, and other fundamental freedoms, as provided by the Basic Law, the Joint Declaration, and the International Covenant on Civil and Political Rights;</text>
 </paragraph><paragraph id="id936741c0-b8a3-4d87-b2a6-9a9c6d6f0bfe"><enum>(7)</enum><text>to support freedom from arbitrary or unlawful arrest, detention, or imprisonment for all Hong Kong residents, as provided by the Basic Law, the Joint Declaration, and the International Covenant on Civil and Political Rights;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id960fbca4-a77d-431a-b604-25741aec38a2"><enum>(8)</enum><text>to draw international attention to any violations by the Government of the People’s Republic of China of the fundamental rights of the people of Hong Kong, as provided by the International Covenant on Civil and Political Rights, and any encroachment upon the autonomy guaranteed to Hong Kong by the Basic Law and the Joint Declaration;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcc1dbf0f-30b5-4c8c-90d0-9ceb198d5404"><enum>(9)</enum><text>to protect United States citizens and long-term permanent residents living in Hong Kong, as well as people visiting and transiting through Hong Kong;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id113e2f99-3a2c-44a5-9b6f-741fd99febf7"><enum>(10)</enum><text>to maintain the economic and cultural ties that provide significant benefits to both the United States and Hong Kong; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id472E6C39450C419AB574BF8BC028F3B7"><enum>(11)</enum><text>to coordinate with allies, including the United Kingdom, Australia, Canada, Japan, and the Republic of Korea, to promote democracy and human rights in Hong Kong.</text>
			</paragraph></section><section changed="added" commented="no" committee-id="SSFR00" display-inline="no-display-inline" id="id2d946ed4-c797-4c63-af91-35e780a00d53" reported-display-style="italic"><enum>4.</enum><header>Amendments to the United States-Hong Kong Policy Act of 1992</header>
 <subsection commented="no" display-inline="no-display-inline" id="idb8b9bdec-c2ba-4924-976e-cbdd2787bb1f"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Title II of the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5721">22 U.S.C. 5721</external-xref> et seq.) is amended—</text> <paragraph commented="no" id="id2b588ff3-6b93-435f-92d1-f506e94490a5"><enum>(1)</enum><text>in section 201(b), by striking <quote>such date</quote> each place such term appears and inserting <quote>the date of the enactment of the <short-title>Hong Kong Human Rights and Democracy Act of 2019</short-title></quote>; and</text>
 </paragraph><paragraph id="id0d93876d-0cda-41f7-9236-4e80c233d367"><enum>(2)</enum><text>adding at the end the following:</text> <quoted-block changed="added" committee-id="SSFR00" display-inline="no-display-inline" id="idfa401568-dbcb-4770-9c0e-3d60dccf525f" reported-display-style="italic" style="OLC"> <section id="idb57e674e-d3d0-4409-b9ee-5a2dfe6ebb78"><enum>205.</enum><header>Secretary of State report regarding the autonomy of Hong Kong</header> <subsection id="id05ca559f-aa42-4dab-a3de-ddb454acfd99"><enum>(a)</enum><header>Certification</header> <paragraph id="idff0a8a39-1512-465c-8a5d-2bcd604b35a3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), the Secretary of State, on at least an annual basis, and in conjunction with the report required under section 301, shall issue a certification to Congress that—</text>
 <subparagraph id="idE4B538803DF541D8885B3897C6AC14A5"><enum>(A)</enum><text display-inline="yes-display-inline">indicates whether Hong Kong continues to warrant treatment under United States law in the same manner as United States laws were applied to Hong Kong before July 1, 1997;</text>
 </subparagraph><subparagraph id="id66A5473DE6C0479CB3DEBB1A057D37FD"><enum>(B)</enum><text display-inline="yes-display-inline">addresses—</text> <clause commented="no" id="idAACDEB8E445C4569A93979855DF2D009"><enum>(i)</enum><text>commercial agreements;</text>
 </clause><clause id="id1099ca28ae28445d831b7a028249825c"><enum>(ii)</enum><text>law enforcement cooperation, including extradition requests;</text> </clause><clause id="iddd2b3a51337d4f0d92455cb223fb4c3f"><enum>(iii)</enum><text>sanctions enforcement;</text>
 </clause><clause id="id6085ba09fbdb43e7ba13617420c8b6f3"><enum>(iv)</enum><text>export controls, and any other agreements and forms of exchange involving dual use, critical, or other sensitive technologies;</text>
 </clause><clause commented="no" id="id03dcf68e4b63432682bf4a5f1eca5030"><enum>(v)</enum><text>any formal treaties or agreements between the United States and Hong Kong;</text> </clause><clause id="ida1019e85658e48ad8817c786e9381e34"><enum>(vi)</enum><text>other areas of bilateral cooperation that the Secretary determines to be relevant; and</text>
 </clause><clause id="idee8b1bdd403942738ab72afcd70e6b5b"><enum>(vii)</enum><text>decision-making within the Government of Hong Kong, including executive, legislative, and judicial structures, including—</text>
 <subclause id="ida6929c0c68b145afa6ef1d2f34f694ad"><enum>(I)</enum><text>freedom of assembly;</text> </subclause><subclause id="ida8a4912ecd5644ed9d7ef1f83a746831"><enum>(II)</enum><text>freedom of speech;</text>
 </subclause><subclause id="idc18be727eb64498692993c157ff3b343"><enum>(III)</enum><text>freedom of expression; and</text> </subclause><subclause id="idf73d54841dc04c80adf72ae6a8cc7c92"><enum>(IV)</enum><text>freedom of the press, including the Internet and social media;</text>
 </subclause></clause><clause id="ida001f1a37d874dac958118024a68dbb0"><enum>(viii)</enum><text>universal suffrage, including the ultimate aim of the selection of the Chief Executive and all members of the Legislative Council by universal suffrage;</text>
 </clause><clause id="idfc012fd9f26c4aa9984e5358b31b5907"><enum>(ix)</enum><text>judicial independence;</text> </clause><clause id="id7c0cd876b5d94b69847cc9a5756581e1"><enum>(x)</enum><text>police and security functions;</text>
 </clause><clause id="id4587c4c7ded14be988582f1b13218b28"><enum>(xi)</enum><text>education;</text> </clause><clause id="idd722af5c192f450bbccecd4c72c59953"><enum>(xii)</enum><text>laws or regulations regarding treason, secession, sedition, subversion against the Central People’s Government of the People’s Republic of China, or theft of state secrets;</text>
 </clause><clause id="idc40b117b7c8c4b7682eb1110fb58010e"><enum>(xiii)</enum><text>laws or regulations regarding foreign political organizations or bodies;</text> </clause><clause id="idd828391324274606bc30e5617db91054"><enum>(xiv)</enum><text>laws or regulations regarding political organizations; and</text>
 </clause><clause id="id000A3097560A4AF2A484B5C0697BC37A"><enum>(xv)</enum><text>other rights enumerated in the Universal Declaration of Human Rights, done at Paris December 10, 1948, and the International Covenant on Civil and Political Rights, done at New York December 19, 1966; and</text>
 </clause></subparagraph><subparagraph id="id0989392D56DE4E74B670A46497AA05B6"><enum>(C)</enum><text display-inline="yes-display-inline">includes—</text> <clause id="id5070F223AE0646358F016111EF7A2BB3"><enum>(i)</enum><text>an assessment of the degree of any erosions to Hong Kong’s autonomy in each category listed in subparagraph (B) resulting from actions by the Government of the People’s Republic of China that are inconsistent with its commitments under the Basic Law or the Joint Declaration;</text>
 </clause><clause id="idDB79CA2A02E446E3986616347064DA45"><enum>(ii)</enum><text>an evaluation of the specific impacts to any areas of cooperation between the United States and Hong Kong resulting from erosions of autonomy in Hong Kong or failures of the Government of Hong Kong to fulfill obligations to the United States under international agreements within the categories listed in subparagraph (B); and</text>
 </clause><clause id="id754A414943E2492DBB9585A96CC1F4A6"><enum>(iii)</enum><text>a list of any specific actions taken by the United States Government in response to any erosion of autonomy or failures to fulfill obligations to the United States under international agreements identified in this certification and the report required under section 301.</text>
 </clause></subparagraph></paragraph><paragraph id="id4185cf4c-1ef6-45b2-a277-8e704e09439d"><enum>(2)</enum><header>Factor for consideration</header><text>In making each certification under paragraph (1), the Secretary of State should consider the terms, obligations, and expectations expressed in the Joint Declaration with respect to Hong Kong.</text>
 </paragraph><paragraph id="id592d1e69c65b40698a2da09e229bac08"><enum>(3)</enum><header>Additional certifications</header><text>The certification under section (1) shall be issued annually, but the Secretary may issue additional certifications at any time if the Secretary determines it is warranted by circumstances in Hong Kong.</text>
								</paragraph></subsection><subsection id="iddad35490-0ab9-4adb-b733-bb10813455ea"><enum>(b)</enum><header>Waiver authority</header>
 <paragraph id="idE7DEAB6F0FDB4B64B77D0B698564E626"><enum>(1)</enum><header>In general</header><text>The Secretary of State may waive the application of subsection (a) if—</text> <subparagraph commented="no" id="id62A312F2F857482AA7AE572477A4B1E6"><enum>(A)</enum><text>the Secretary determines that such a waiver is in the national security interests of the United States; and</text>
 </subparagraph><subparagraph commented="no" id="idd4e4806c-b070-4ea0-89e5-25b3c96a3934"><enum>(B)</enum><text>on or before the date on which the waiver takes effect, the Secretary notifies the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> of the intent to waive such subsection;</text> </subparagraph></paragraph><paragraph commented="no" id="id29452565683A4D3E8CBD3FFA6F04C9A0"><enum>(2)</enum><header>Partial waiver</header><text>Except for the list of actions described in subsection (a)(1)(C)(iii), the Secretary of State may waive relevant parts of the application of subsection (a) if the President issues an Executive order under section 202 that suspends the application of any particular United States law to Hong Kong.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id35af2339-9b19-40dd-964c-9a6f05de076a"><enum>(b)</enum><header>Visa applicants</header><text>Title II of the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5721">22 U.S.C. 5721</external-xref> et seq.), as amended by subsection (a), is further amended by adding at the end the following:</text>

					<section id="ida2a14dff-86fc-46c7-aed9-74e3693f996d"><enum>206.</enum><header>Treatment of Hong Kong applicants for visas to study or work in the United States</header>
 <subsection id="idf8012e9b-9d56-40eb-9b62-bd63f8f8087e"><enum>(a)</enum><header>Visa eligibility for certain Hong Kong students</header><text>Notwithstanding any other provision of law, applications for visas to enter, study, or work in the United States, which are submitted by otherwise qualified applicants who resided in Hong Kong in 2014 and later, may not be denied primarily on the basis of the applicant’s subjection to politically-motivated arrest, detention, or other adverse government action.</text>
 </subsection><subsection id="id470450b1-581c-42a8-a42f-c48ad2daedb8"><enum>(b)</enum><header>Implementation</header><text>The Secretary of State shall take such steps as may be necessary to ensure that consular officers are aware of the policy described in subsection (a) and receive appropriate training and support to ensure that the policy is carried out so that affected individuals do not face discrimination or unnecessary delay in the processing of their visa applications, including—</text>
 <paragraph id="id8de4753e-237a-4f8d-bc77-6a738c66477c"><enum>(1)</enum><text>providing specialized training for all consular officers posted to the United States Embassy in Beijing or to any United States consulate in the People’s Republic of China, the Hong Kong Special Administrative Region, or the Macau Special Administrative Region;</text>
 </paragraph><paragraph id="id43a6fbf4-461b-47b9-9383-8a1eb74304b7"><enum>(2)</enum><text>instructing the United States Consulate in Hong Kong to maintain an active list of individuals who are known to have been formally charged, detained, or convicted by the Government of Hong Kong Special Administrative Region or by the Government of the People’s Republic of China, or intermediaries of such governments, based on politically-motivated considerations related to their exercise of rights enumerated in the Universal Declaration of Human Rights, done at Paris December 10, 1948, or the International Covenant on Civil and Political Rights, done at New York December 19, 1966, to facilitate the cross-checking of visa applications for Hong Kong residents; and</text>
 </paragraph><paragraph id="id6c5614c8-17ef-4d70-b019-9911d9499413"><enum>(3)</enum><text>updating any relevant United States Government websites with information on the policy described in subsection (a).</text>
 </paragraph></subsection><subsection id="idcc179c39-e0eb-4338-9c54-6805a1958de3"><enum>(c)</enum><header>Cooperation with like-minded countries</header><text>The Secretary of State shall contact appropriate representatives of other democratic countries, particularly those who receive a large number of applicants for student and employment visas from Hong Kong—</text>
 <paragraph id="id27b5d257-212f-42e1-b5ae-ef4fda827728"><enum>(1)</enum><text>to inform them of the United States policy regarding arrests for participation in nonviolent protests in Hong Kong; and</text>
 </paragraph><paragraph id="id5e5dc740-d6d1-4a78-bc1f-07861e457883"><enum>(2)</enum><text>to encourage them to take similar steps to ensure the rights of nonviolent protesters are protected from discrimination due to the actions of the Government of Hong Kong and of the Government of the People’s Republic of China.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section changed="added" committee-id="SSFR00" id="ide6c1742d-6977-49ea-aa64-cdfee1321a6e" reported-display-style="italic"><enum>5.</enum><header>Annual report on violations of United States export control laws and United Nations sanctions
			 occurring in Hong Kong</header>
 <subsection id="id9a351d24-f490-4d78-908c-c57515d553ce"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter until the date that is 7 years after the date of the enactment of this Act, the Secretary of Commerce, in consultation with the Secretary of the Treasury and the Secretary of State, shall submit a report to the committees specified in subsection (b) that includes—</text>
 <paragraph id="idb646b0ce-22bb-4c02-a660-c0a697a0acd8"><enum>(1)</enum><text>an assessment of the nature and extent of violations of United States export control and sanctions laws occurring in Hong Kong;</text>
 </paragraph><paragraph id="id4958043f-00c1-4b53-a385-e7693a4759b3"><enum>(2)</enum><text>to the extent possible, the identification of—</text> <subparagraph id="id7db108cc-ae1c-47d2-8f82-7667f87ad646"><enum>(A)</enum><text>any items that were reexported from Hong Kong in violation of the laws referred to in paragraph (1);</text>
 </subparagraph><subparagraph id="id9c63a7f9-1de4-4198-981f-dff06894bb5f"><enum>(B)</enum><text>the countries and persons to which the items referred to in subparagraph (A) were reexported; and</text> </subparagraph><subparagraph id="id1121bb51-7df4-4958-b334-5209ccf8296e"><enum>(C)</enum><text>how such items were used;</text>
 </subparagraph></paragraph><paragraph id="ida9f04c17-4be7-4d58-b625-ef107c6c2b41"><enum>(3)</enum><text>an assessment of whether sensitive dual-use items subject to the export control laws of the United States are being—</text>
 <subparagraph id="ida788b31a-640e-47d6-b76b-22dffa3880bd"><enum>(A)</enum><text>transshipped through Hong Kong; and</text> </subparagraph><subparagraph id="id77a2f207-078a-4ac1-9142-ecb015b26436"><enum>(B)</enum><text>used to develop—</text>
 <clause id="idde13996a-6aee-4409-bd6c-1af02458ea69"><enum>(i)</enum><text>the Sharp Eyes, Skynet, Integrated Joint Operations Platform, or other systems of mass surveillance and predictive policing; or</text>
 </clause><clause id="id58c5677a-c4da-47ed-a84a-e9898fa612fb"><enum>(ii)</enum><text>the <quote>social credit system</quote> of the People’s Republic of China;</text> </clause></subparagraph></paragraph><paragraph id="ide0681d4c-e345-4923-bca4-756c7360accb"><enum>(4)</enum><text>an assessment of the efforts by the Government of the People’s Republic of China to use the status of Hong Kong as a separate customs territory to import items into the People’s Republic of China from Hong Kong in violation of the export control laws of the United States, whether as part of the Greater Bay Area plan, through the assignment by Beijing of Hong Kong as a national technology and innovation center, or through other programs that may exploit Hong Kong as a conduit for controlled sensitive technology;</text>
 </paragraph><paragraph id="id25a5153b-eb68-4f17-b557-15250c5a1493"><enum>(5)</enum><text>an assessment of whether the Government of Hong Kong has adequately enforced sanctions imposed by the United Nations;</text>
 </paragraph><paragraph id="ide2caa115-ba57-4fcc-93cc-6cf99fdefbfc"><enum>(6)</enum><text>a description of the types of goods and services transshipped or reexported through Hong Kong in violation of such sanctions to—</text>
 <subparagraph id="id117d7af9-bd42-4463-9af5-5da04e6434fd"><enum>(A)</enum><text>North Korea or Iran; or</text> </subparagraph><subparagraph id="id596a1377-f143-462f-9de5-a3da4c638c96"><enum>(B)</enum><text>other countries, regimes, or persons subject to such sanctions for engaging in activities—</text>
 <clause id="id0f28a605-8d7f-4fca-a0eb-90bcd9054297"><enum>(i)</enum><text>relating to international terrorism, international narcotics trafficking, or the proliferation of weapons of mass destruction; or</text>
 </clause><clause id="id11722795-b2f4-4f3c-a536-6b7c32b38ab7"><enum>(ii)</enum><text>that otherwise present a threat to the national security, foreign policy, or economy of the United States; and</text>
 </clause></subparagraph></paragraph><paragraph id="id262FC6EADD944E2EB70BBCDDB4411144"><enum>(7)</enum><text>an assessment of whether shortcomings in the enforcement of export controls or sanctions by the Government of Hong Kong necessitates the assignment of additional Department of the Treasury, Department of Commerce, or Department of State personnel to the United States Consulate in Hong Kong.</text>
 </paragraph></subsection><subsection id="idb163928c-9257-4f07-8cfd-3acbbeb341e7"><enum>(b)</enum><header>Committees specified</header><text>The committees specified in this subsection are—</text> <paragraph id="id5F8FB414872A4EE7AB1108F58C142319"><enum>(1)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text>
 </paragraph><paragraph id="id6284F0DDC37E40828066FF1C2D0685C9"><enum>(2)</enum><text>the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs of the Senate</committee-name>;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id16F44304C69A4D48ACABA760EEE2C870"><enum>(3)</enum><text>the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>;</text>
 </paragraph><paragraph id="idFF2D03D2DB8445E0A76CCDA74FBB1982"><enum>(4)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>; and</text> </paragraph><paragraph id="idD715551278F34E789D9C1745B5F45077"><enum>(5)</enum><text>the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name></text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1D3AB870789549D8985C10A2333A78F3"><enum>(c)</enum><header>Form of report</header><text>The report required under subsection (a) shall be submitted in unclassified form, but may include a classified annex.</text>
			</subsection></section><section changed="added" committee-id="SSFR00" id="ida390a8e5-8794-4285-9254-77df4cb4eb76" reported-display-style="italic"><enum>6.</enum><header>Protecting United States citizens and others from rendition to the People’s Republic of China</header>
 <subsection id="idc131ecf81d6646b0bbce57e7fdf05de2"><enum>(a)</enum><header>Policy statements</header><text>It is the policy of the United States—</text> <paragraph id="idd20488a861e542a2bd4f5e096d6f1318"><enum>(1)</enum><text>to safeguard United States citizens from extradition, rendition, or abduction to the People’s Republic of China from Hong Kong for trial, detention, or any other purpose;</text>
 </paragraph><paragraph id="id15aa8347dcf4475c9455d7a56f27a2de"><enum>(2)</enum><text>to safeguard United States businesses in Hong Kong from economic coercion and intellectual property theft;</text>
 </paragraph><paragraph id="id2aea5824ccf34f4daf4e75152fac4768"><enum>(3)</enum><text>pursuant to section 103(7) of the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5713">22 U.S.C. 5713(7)</external-xref>), to encourage United States businesses <quote>to continue to operate in Hong Kong, in accordance with applicable United States and Hong Kong law</quote>; and</text>
 </paragraph><paragraph id="id52dfffd2d10a48568774afd02252a073"><enum>(4)</enum><text>pursuant to section 201(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/5721">22 U.S.C. 5721(b)</external-xref>), to evaluate, not less frequently than annually and as circumstances, dictate whether the Government of Hong Kong is <quote>legally competent to carry out its obligations</quote> under treaties and international agreements established between the United States and Hong Kong.</text>
 </paragraph></subsection><subsection id="id084eae1f12f648e88dd4ae7431ad27f1"><enum>(b)</enum><header>Response to threat of rendition</header><text>Not later than 30 days after the President determines that legislation proposed or enacted by the Government of Hong Kong would put United States citizens at risk of extradition or rendition to the People’s Republic of China or to other countries that lack protections for the rights of defendants, the President shall submit a report to the appropriate congressional committees that—</text>
 <paragraph id="id0B42FA85D00C4ABB8ED56B98B27B4DF5"><enum>(1)</enum><text>contains a strategy for protecting United States citizens and businesses in Hong Kong;</text>
 </paragraph><paragraph id="id792820A97D924E559B40B9AC5CC0CAD2"><enum>(2)</enum><text>assesses the potential risks of the legislation to United States citizens residing in, traveling to, or transiting through Hong Kong; and</text>
 </paragraph><paragraph id="id982872d6e876408eb3025978132ec365"><enum>(3)</enum><text>determines whether—</text> <subparagraph id="id51406B087F4C40D499B287000642D61E"><enum>(A)</enum><text>additional resources are needed for American Citizen Services at the United States Consulate in Hong Kong; and</text>
 </subparagraph><subparagraph id="idEE1903AE596D41B8AC8223712EFA2FA6"><enum>(B)</enum><text>the Government of Hong Kong is <quote>legally competent</quote> to administer the United States-Hong Kong Agreement for the Surrender of Fugitive Offenders, done at Hong Kong December 20, 1996, or other relevant law enforcement agreements between the United States and Hong Kong.</text>
					</subparagraph></paragraph></subsection></section><section changed="added" committee-id="SSFR00" id="id896e19c4-880a-4cce-ab02-e4ad33a4d252" reported-display-style="italic"><enum>7.</enum><header>Sanctions relating to undermining fundamental freedoms and autonomy in Hong Kong</header>
			<subsection id="ide8a93ab3a302472e8077783772b0f73e"><enum>(a)</enum><header>Identification of persons responsible for undermining fundamental freedoms and autonomy in Hong
			 Kong</header>
 <paragraph id="ide7496a7a06404ad792aa1b65ba6aef77"><enum>(1)</enum><header>In general</header><text>The President shall submit a report to the appropriate congressional committees, in accordance with paragraph (2), that identifies each foreign person that the President determines, based on credible information, is responsible for—</text>
 <subparagraph id="id29cdcde14da94eb3856d4f07e65ab405"><enum>(A)</enum><text>the extrajudicial rendition, arbitrary detention, torture, or forced confession of any person in Hong Kong; or</text>
 </subparagraph><subparagraph id="iddb1d9900250841fe831808511dc10cb9"><enum>(B)</enum><text>other gross violations of internationally recognized human rights in Hong Kong.</text> </subparagraph></paragraph><paragraph id="id16b6d3f0a4da495ab7c984ce7d8a8610"><enum>(2)</enum><header>Timing of reports</header><text>The President shall submit to the appropriate congressional committees—</text>
 <subparagraph id="id13B42D3EC4924A138EC12250B4E9AD60"><enum>(A)</enum><text>the report required under paragraph (1)—</text> <clause id="id73B804408B404245962E000073388DF3"><enum>(i)</enum><text>not later than 180 days after the date of the enactment of this Act; and</text>
 </clause><clause id="idF155AFCB48B54716A102A11A696A9320"><enum>(ii)</enum><text>not less frequently than annually thereafter in conjunction with the publication of the report required under section 301 of the United States-Hong Kong Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5731">22 U.S.C. 5731</external-xref>); and</text>
 </clause></subparagraph><subparagraph id="id111534A08D6141C5A92ABB3BE5A40484"><enum>(B)</enum><text>an update to the report not later than 15 days after any new action is taken under subsection (b) based on the discovery of new credible information described in paragraph (1).</text>
 </subparagraph></paragraph><paragraph id="id1AF5322AD5814D5E9C1534775B437049"><enum>(3)</enum><header>Consideration of certain information</header><text>In preparing the report required under paragraph (1), the President shall consider—</text> <subparagraph id="ide3bbbf8070f745938451ee7f0b77cd50"><enum>(A)</enum><text>information provided jointly by the chairperson and ranking member of each of the appropriate congressional committees; and</text>
 </subparagraph><subparagraph id="id88a8b15653584722a7639661f47528dd"><enum>(B)</enum><text>credible information obtained by other countries or reputable nongovernmental organizations that monitor violations of human rights abuses.</text>
 </subparagraph></paragraph><paragraph id="ideb6e5df3137d483b974429f8a1df86c4"><enum>(4)</enum><header>Form</header><text>The report required under paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</text>
 </paragraph></subsection><subsection id="id89a58b40daec47dbb72544c13a2a2ea1"><enum>(b)</enum><header>Imposition of sanctions</header><text>The President shall impose the sanctions described in subsection (c) with respect to each foreign person identified in the report required under subsection (a)(1).</text>
 </subsection><subsection id="id2d90492ef0014ef3802d6d684153ca7b"><enum>(c)</enum><header>Sanctions described</header><text>The sanctions described in this subsection are the following:</text> <paragraph id="id227ce935f6db4423a4ec1830ecb9873e"><enum>(1)</enum><header>Asset blocking</header><text>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.) to the extent necessary to block and prohibit all transactions in property and interests in property of a foreign person identified in the report required under subsection (a)(1) if such property and interests in property are in the United States, come within the United States, or come within the possession or control of a United States person.</text>
				</paragraph><paragraph id="idf0a6a1b73b76476caa7d0e85ebc1093d"><enum>(2)</enum><header>Ineligibility for visas, admission, or parole</header>
 <subparagraph id="id07098925339e4fc2ad67341ca8b88dcd"><enum>(A)</enum><header>Visas, admission, or parole</header><text>An alien described in subsection (a)(1) is—</text> <clause id="id2d8db436836d4f749df41ba8f3008cd5"><enum>(i)</enum><text>inadmissible to the United States;</text>
 </clause><clause id="idcb1832c160744e39b9c040a7379bd3ac"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text> </clause><clause id="idd35375401f4e4554b0357c308fdb0f1d"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.).</text>
						</clause></subparagraph><subparagraph id="id0478d1ca397f4646ae5a6288b270e32b"><enum>(B)</enum><header>Current visas revoked</header>
 <clause id="id029c89f488484755a7f7fd3a9d2796d5"><enum>(i)</enum><header>In general</header><text>An alien described in subsection (a)(1) is subject to revocation of any visa or other entry documentation regardless of when the visa or other entry documentation is or was issued.</text>
 </clause><clause id="id82424aced98148b7847efe5dd3fb8211"><enum>(ii)</enum><header>Immediate effect</header><text>A revocation under clause (i) shall—</text> <subclause id="id3ed223ce293342ebae2fcf32bfd4e4e8"><enum>(I)</enum><text>take effect immediately; and</text>
 </subclause><subclause id="iddf870e0835b94d5ab5d295dae1105894"><enum>(II)</enum><text>automatically cancel any other valid visa or entry documentation that is in the alien’s possession.</text> </subclause></clause></subparagraph><subparagraph id="id24329f1e00c64ed1a94c288af6b9e2a7"><enum>(C)</enum><header>Exception to comply with international obligations</header><text>Sanctions under this paragraph shall not apply with respect to an alien if admitting or paroling the alien into the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations.</text>
 </subparagraph></paragraph><paragraph id="id1ba469a21ee94fb1bb660a184d81d025"><enum>(3)</enum><header>Penalties</header><text>The penalties provided for in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) shall apply to a foreign person that violates, attempts to violate, conspires to violate, or causes a violation of paragraph (1) to the same extent that such penalties apply to a person that commits an unlawful act described in subsection (a) of such section 206.</text>
 </paragraph></subsection><subsection id="id39b47702e643454394d599aadd3d9696"><enum>(d)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref> and 1704) to carry out this section.</text>
 </subsection><subsection id="id8136e128863149c3a3e74a79ac8fd056"><enum>(e)</enum><header>Waiver</header><text>The President may waive the application of sanctions under this section with respect to a person identified in the report required under subsection (a)(1) if the President determines and certifies to the appropriate congressional committees that such a waiver is in the national interest of the United States.</text>
			</subsection><subsection id="id59452c5081124972b109f59bb1737530"><enum>(f)</enum><header>Exception relating to importation of goods</header>
 <paragraph id="iddfc5678951b64fdaa13e363febf3fe50"><enum>(1)</enum><header>In general</header><text>The authorities and requirements to impose sanctions authorized under this section shall not include the authority or a requirement to impose sanctions on the importation of goods.</text>
 </paragraph><paragraph id="idb2af2cfc337e49fba760fa7243c0e8e9"><enum>(2)</enum><header>Good defined</header><text>In this subsection, the term <term>good</term> means any article, natural or manmade substance, material, supply, or manufactured product, including inspection and test equipment, and excluding technical data.</text>
 </paragraph></subsection><subsection id="idcc93ca06dd4941cc82f481342677c783"><enum>(g)</enum><header>Termination of sanctions</header><text>The President may terminate the application of sanctions under this section with respect to a person if the President determines and reports to the appropriate congressional committees not less than 15 days before the termination takes effect that—</text>
 <paragraph id="ida7d32634277846cb9f3cf90607744673"><enum>(1)</enum><text>credible information exists that the person did not engage in the activity for which sanctions were imposed;</text>
 </paragraph><paragraph id="id39aab33a04dc4455b0f30b3aaaf4fbc4"><enum>(2)</enum><text>the person has been prosecuted appropriately for the activity for which sanctions were imposed;</text> </paragraph><paragraph id="id9b917563c0df4f52b420c08391f61192"><enum>(3)</enum><text>the person has credibly demonstrated a significant change in behavior, has paid an appropriate consequence for the activity for which sanctions were imposed, and has credibly committed to not engage in an activity described in subsection (a)(1) in the future; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF0461EB4EB71459D97840EC28775CD5C"><enum>(4)</enum><text>the termination of the sanctions is in the national security interests of the United States.</text> </paragraph></subsection><subsection id="id37A23997AE254D339908D678D2702DEF"><enum>(h)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="id2f4680af32b94f69bd88ed73c306a4e4"><enum>(1)</enum><header>Admission; admitted; alien</header><text>The terms <term>admission</term>, <term>admitted</term>, and <term>alien</term> have the meanings given those terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text>
 </paragraph><paragraph id="idADDB3E596ECB4C27A7783428C27DADB9"><enum>(2)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means a person that is not a United States person.</text> </paragraph></subsection></section><section changed="added" committee-id="SSFR00" id="id7c976448-80f8-4224-8f79-c87757a4061f" reported-display-style="italic"><enum>8.</enum><header>Sanctions reports</header> <subsection id="ide51ffb0732fe47c4ac907308a7d2f2ff"><enum>(a)</enum><header>In general</header><text>In accordance with section 7, the President shall submit, to the appropriate congressional committees, a report that includes—</text>
 <paragraph id="idaebad293ca6c481696d99900f9b47ae6"><enum>(1)</enum><text>a list of each foreign person with respect to which the President imposed sanctions during the year preceding the submission of the report;</text>
 </paragraph><paragraph id="id8026ecf7a96f4e19bc32e5f099a9ef6c"><enum>(2)</enum><text>a description of the type of sanctions imposed with respect to each such person;</text> </paragraph><paragraph id="idab88478856b9453fb6eb01d55f75511f"><enum>(3)</enum><text>the number of foreign persons with respect to which the President terminated sanctions under section 7 during that year;</text>
 </paragraph><paragraph id="idd304d51cb7aa47989e4263712ea635ea"><enum>(4)</enum><text>the dates on which such sanctions were imposed or terminated, as applicable;</text> </paragraph><paragraph id="id49e590d4b3b1421f946996e4ae6af3f7"><enum>(5)</enum><text>the reasons for imposing or terminating such sanctions; and</text>
 </paragraph><paragraph id="ide049351a961248c1bac9b392607540b4"><enum>(6)</enum><text>a description of the efforts of the President to encourage the governments of other countries to impose sanctions that are similar to the sanctions authorized under section 7.</text>
 </paragraph></subsection><subsection id="id8518be1717d548d9ad78527e49e7bda1"><enum>(b)</enum><header>Public availability</header><text>The unclassified portion of the report required under subsection (a) shall be made available to the public, including through publication in the Federal Register.</text>
 </subsection><subsection id="id33c032604c8f48ffb26659a439d76bec"><enum>(c)</enum><header>Nonapplicability of confidentiality requirement with respect to visa records</header><text>The President shall publish the report required under subsection (a) without regard to the requirements of section 222(f) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1202">8 U.S.C. 1202(f)</external-xref>) with respect to confidentiality of records pertaining to the issuance or refusal of visas or permits to enter the United States.</text>
 </subsection></section><section changed="added" committee-id="SSFR00" id="id414aef4f1d9c41909eb09912c251d026" reported-display-style="italic"><enum>9.</enum><header>Sense of Congress on People’s Republic of China state-controlled media</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="idcb7252124a1845aaa5a0000d45d860ec"><enum>(1)</enum><text>the United States condemns the deliberate targeting and harassment of democracy activists, diplomatic personnel of the United States and other nations, and their families by media organizations controlled by the Government of the People’s Republic of China, including Wen Wei Po and Ta Kung Po;</text>
 </paragraph><paragraph id="idca8b68bded174ffca942797b1ea046ca"><enum>(2)</enum><text>the Secretary of State should clearly inform the Government of the People’s Republic of China that the use of media outlets to spread disinformation or to intimidate and threaten its perceived enemies in Hong Kong or in other countries is unacceptable; and</text>
 </paragraph><paragraph id="id7ac398db524f477982536d4100fb5e17"><enum>(3)</enum><text>the Secretary of State should take any activities described in paragraph (1) or (2) into consideration when granting visas for travel and work in the United States to journalists from the People’s Republic of China who are affiliated with any such media organizations.</text>
 </paragraph></section><section changed="added" committee-id="SSFR00" id="id4928F4E9C9A54DD6A148D84686B75D62" reported-display-style="italic"><enum>10.</enum><header>Sense of Congress on commercial exports of crowd control equipment to Hong Kong</header><text display-inline="no-display-inline">It is sense of Congress that the Department of Commerce, in conjunction with other relevant Federal departments and agencies, should consider appropriate adjustments to the current United States export controls with respect to Hong Kong to prevent the supply of crowd control and surveillance equipment that could be used inappropriately in Hong Kong.</text></section></legis-body><endorsement><action-date>September 26, 2019</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
