			 with respect to the availability of broadband services, and for other
 purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="id5f1fa97f4e584639ad57456a8b39f4c5" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Broadband Deployment Accuracy and Technological Availability Act</short-title></quote> or the <quote><short-title>Broadband DATA Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idea70f49d47b8439188b3faba6cc91933" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Broadband data</header><subsection commented="no" display-inline="no-display-inline" id="id39385F7C1CAC4ED2BD6BE63F5107C79A"><enum></enum><text display-inline="yes-display-inline">The Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block act-name="" display-inline="no-display-inline" id="id54E1193D1232432A9A738B19257FAA82" style="OLC"><title commented="no" id="id5188D6ABF8CA4653875239D77F2DA5AE" level-type="subsequent" style="OLC"><enum>VIII</enum><header display-inline="yes-display-inline">Broadband data</header><section commented="no" display-inline="no-display-inline" id="idCE39B69ECFBC458DBED415C02205BA97" section-type="subsequent-section"><enum>801.</enum><header display-inline="yes-display-inline">Definitions</header><subsection commented="no" display-inline="no-display-inline" id="idD1DECCAFA2CD44A682ADC8EEB9658FAD"><enum></enum><text display-inline="yes-display-inline">In this title:</text><paragraph commented="no" display-inline="no-display-inline" id="id7dc821314d654c4a90a1cbacbcc346d4"><enum>(1)</enum><header display-inline="yes-display-inline">Broadband internet access service</header><text display-inline="yes-display-inline">The term <term>broadband internet access service</term> has the meaning given the term in section 8.1(b) of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE15766BF46474ADCB78EFE7CE9A1BA68"><enum>(2)</enum><header display-inline="yes-display-inline">Broadband Map</header><text display-inline="yes-display-inline">The term <term>Broadband Map</term> means the map created by the Commission under section 802(c)(1)(A).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaeb2984e0a114024b0ec64e9ab4697bf"><enum>(3)</enum><header display-inline="yes-display-inline">Cell edge probability</header><text display-inline="yes-display-inline">The term <term>cell edge probability</term> means the likelihood that the minimum threshold download and upload speeds with respect to broadband internet access service will be met or exceeded at a distance from a base station that is intended to indicate the ultimate edge of the coverage area of a cell.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id150fcffc831d49c1b06b719da296ad66"><enum>(4)</enum><header display-inline="yes-display-inline">Cell loading</header><text display-inline="yes-display-inline">The term <term>cell loading</term> means the percentage of the available air interface resources of a base station that are used by consumers with respect to broadband internet access service.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id194e381d854d47fe8a06a01eae2ed06a"><enum>(5)</enum><header display-inline="yes-display-inline">Clutter</header><text display-inline="yes-display-inline">The term <term>clutter</term> means a natural or man-made surface feature that affects the propagation of a signal from a base station.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb04dc35455074c3bba810ba40d6a43ad"><enum>(6)</enum><header display-inline="yes-display-inline">Fabric</header><text display-inline="yes-display-inline">The term <term>Fabric</term> means the Broadband Serviceable Location Fabric established under section 802(b)(1)(B).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3278367d85dc404b87441ef235868c39"><enum>(7)</enum><header display-inline="yes-display-inline">Form 477</header><text display-inline="yes-display-inline">The term <term>Form 477</term> means Form 477 of the Commission relating to local telephone competition and broadband reporting.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43de3b3e63614239a7fa4229f4866641"><enum>(8)</enum><header display-inline="yes-display-inline">Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d1e8be72e71470c86038a3774d9d9b1"><enum>(9)</enum><header display-inline="yes-display-inline">Mobility Fund Phase II</header><text display-inline="yes-display-inline">The term <term>Mobility Fund Phase II</term> means the second phase of the proceeding to provide universal service support from the Mobility Fund (WC Docket No. 10–90; WT Docket No. 10–208).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida40d14eaf25f4779bdb74bb1795cf809"><enum>(10)</enum><header display-inline="yes-display-inline">Propagation model</header><text display-inline="yes-display-inline">The term <term>propagation model</term> means a mathematical formulation for the characterization of radio wave propagation as a function of frequency, distance, and other conditions.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd2d16e908fdc4d5486e4bc09ed994e3a"><enum>(11)</enum><header display-inline="yes-display-inline">Provider</header><text display-inline="yes-display-inline">The term <term>provider</term> means a provider of fixed or mobile broadband internet access service.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5508EF4801B948BA8B9AC2D267A68247"><enum>(12)</enum><header display-inline="yes-display-inline">Quality of service</header><text display-inline="yes-display-inline">The term <term>quality of service</term> means, with respect to broadband internet access service, the download and upload speeds (and, for relevant services, latency) with respect to that service, as determined by, and to the extent otherwise collected by, the Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide4f37ebbb281451ca2558dce7d063be7"><enum>(13)</enum><header display-inline="yes-display-inline">Shapefile</header><text display-inline="yes-display-inline">The term <term>shapefile</term> means a digital storage format containing geospatial or location-based data and attribute information—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1b3d0e6562114744acbf4e53150fc965"><enum>(A)</enum><text display-inline="yes-display-inline">regarding the availability of broadband internet access service; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5508de4c42df4c1f84be2a4732ab62c3"><enum>(B)</enum><text display-inline="yes-display-inline">that can be viewed, edited, and mapped in geographic information system software.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd8e0901c4dc94e0ea9576e739867736f"><enum>(14)</enum><header display-inline="yes-display-inline">Standard broadband installation</header><text display-inline="yes-display-inline">The term <term>standard broadband installation</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6b876f10c72142a580346eea6dfc441c"><enum>(A)</enum><text display-inline="yes-display-inline">means the initiation by a provider of fixed broadband internet access service in an area in which the provider has not previously offered that service, with no charges or delays attributable to the extension of the network of the provider; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida3ce0838317a4a9a83e172f6289fe733"><enum>(B)</enum><text display-inline="yes-display-inline">includes the initiation of fixed broadband internet access service through routine installation that can be completed not later than 10 business days after the date on which the service request is submitted.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id18aa6d1c80034304aee6d9f4e4486393" section-type="subsequent-section"><enum>802.</enum><header display-inline="yes-display-inline">Broadband maps</header><subsection commented="no" display-inline="no-display-inline" id="id6d6471c77ed04e86ba65af136844f3a0"><enum>(a)</enum><header display-inline="yes-display-inline">Rules</header><paragraph commented="no" display-inline="no-display-inline" id="id76a16b7a5e6949898dc7f6887e705c6d"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this title, the Commission shall issue final rules that shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd0b8cb232e6548e3a59f072b948b3902"><enum>(A)</enum><text display-inline="yes-display-inline">require the biannual collection and dissemination of granular data, as determined by the Commission—</text><clause commented="no" display-inline="no-display-inline" id="ide0ee335de3f9466e9dbbf7c85a53ab1a"><enum>(i)</enum><text display-inline="yes-display-inline">relating to the availability and quality of service with respect to terrestrial fixed, fixed wireless, satellite, and mobile broadband internet access service; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id452bba869ecc4ca884f7ed523f6022a1"><enum>(ii)</enum><text display-inline="yes-display-inline">that the Commission shall use to compile the maps created under subsection (c)(1) (referred to in this section as <quote>coverage maps</quote>), which the Commission shall make publicly available; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f4ecc86bf764d758f458822d900e11b"><enum>(B)</enum><text display-inline="yes-display-inline">establish—</text><clause commented="no" display-inline="no-display-inline" id="id9e391cd6e06f4c40803af33f4cd8c987"><enum>(i)</enum><text display-inline="yes-display-inline">processes through which the Commission can verify the accuracy of data submitted under subsection (b)(2);</text></clause><clause commented="no" display-inline="no-display-inline" id="id3e5267070fe44776b892c1bf2e8e9f9c"><enum>(ii)</enum><text display-inline="yes-display-inline">processes and procedures through which the Commission, and, as necessary, other entities or individuals submitting non-public or competitively sensitive information under this title, can protect the security, privacy, and confidentiality of that non-public or competitively sensitive information, including—</text><subclause commented="no" display-inline="no-display-inline" id="idB1395C83E40943D396909432A42EB17C"><enum>(I)</enum><text display-inline="yes-display-inline">information contained in the Fabric;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idDF68B8C703804F00996B64807C402596"><enum>(II)</enum><text display-inline="yes-display-inline">the dataset created under subsection (b)(1)(A) supporting the Fabric; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id712028DA31CE4210BADB7475CBA0E1C0"><enum>(III)</enum><text display-inline="yes-display-inline">the data submitted under subsection (b)(2);</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id40c9b88677c7422394a432d2204728b1"><enum>(iii)</enum><text display-inline="yes-display-inline">the challenge process described in subsection (b)(5); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id2E394C84CC7246129955AF27114C0857"><enum>(iv)</enum><text display-inline="yes-display-inline">the process described in section 804(b).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id818c4ef6759644309d2649a9faf6e2d0"><enum>(2)</enum><header display-inline="yes-display-inline">Other data</header><text display-inline="yes-display-inline">In issuing the rules under paragraph (1), the Commission shall develop a process through which the Commission can collect verified data for use in the coverage maps from—</text><subparagraph commented="no" display-inline="no-display-inline" id="id85971cec379341ca9f3db4bf887fc77a"><enum>(A)</enum><text display-inline="yes-display-inline">State, local, and Tribal governmental entities that are primarily responsible for mapping or tracking broadband internet access service coverage for a State, unit of local government, or Indian Tribe, as applicable;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcc52faf733be4766b1068ea005e2e86b"><enum>(B)</enum><text display-inline="yes-display-inline">third parties, if the Commission determines that it is in the public interest to use such data in—</text><clause commented="no" display-inline="no-display-inline" id="id0C1521DC35B34D01BAE98CF6554487EB"><enum>(i)</enum><text display-inline="yes-display-inline">the development of the coverage maps; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idAA7C7AC4F1A347448DAC64CFBD603032"><enum>(ii)</enum><text display-inline="yes-display-inline">the verification of data submitted under subsection (b); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id16496a468697406a90b4f77d1f767f20"><enum>(C)</enum><text display-inline="yes-display-inline">other Federal agencies.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf5b2aa3749034393b3f7627984dd97ba"><enum>(3)</enum><header display-inline="yes-display-inline">Updates</header><text display-inline="yes-display-inline">The Commission shall revise the rules issued under paragraph (1) to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idae6f8d4814ae4d358b0b0a3f3e6a4d4e"><enum>(A)</enum><text display-inline="yes-display-inline">reflect changes in technology;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41c1ab8a92d64139a91a878cb00250f4"><enum>(B)</enum><text display-inline="yes-display-inline">ensure the accuracy of propagation models, as further provided in subsection (b)(3); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd74249ed50b74c5b997445eadf8e91fc"><enum>(C)</enum><text display-inline="yes-display-inline">improve the usefulness of the coverage maps.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc98444331ce34fc48aa9b6045edf6180"><enum>(b)</enum><header display-inline="yes-display-inline">Content of rules</header><paragraph commented="no" display-inline="no-display-inline" id="id6764024c003545baac3adbadfb8d9312"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment of a serviceable location fabric regarding fixed broadband</header><subparagraph commented="no" display-inline="no-display-inline" id="id6cd8a0a3a14c432b812bbfd1df1d8cc7"><enum>(A)</enum><header display-inline="yes-display-inline">Dataset</header><clause commented="no" display-inline="no-display-inline" id="ide6df7fad9b504872b7e95aa585d9343e"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall create a common dataset of all locations in the United States where fixed broadband internet access service can be installed, as determined by the Commission.</text></clause><clause commented="no" display-inline="no-display-inline" id="id31471862ddca4518939e310266be5d48"><enum>(ii)</enum><header display-inline="yes-display-inline">Contracting</header><subclause commented="no" display-inline="no-display-inline" id="id49E74729D841474DB8A0479B10C1E16C"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subclauses (II) and (III), the Commission may contract with an entity with expertise with respect to geographic information systems (referred to in this subsection as <quote>GIS</quote>) to create and maintain the dataset under clause (i).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7238ECB5DCDA4B26B3D2638F6C861D50"><enum>(II)</enum><header display-inline="yes-display-inline">Application of the Federal Acquisition Regulation</header><text display-inline="yes-display-inline">A contract into which the Commission enters under subclause (I) shall in all respects comply with applicable provisions of the Federal Acquisition Regulation.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id01F042AF20D14C0C88D08D62795113DD"><enum>(III)</enum><header display-inline="yes-display-inline">Limitations</header><text display-inline="yes-display-inline">With respect to a contract into which the Commission enters under subclause (I)—</text><item commented="no" display-inline="no-display-inline" id="id9690ECFC94C3495993D572DB9596AC47"><enum>(aa)</enum><text display-inline="yes-display-inline">the entity with which the Commission enters into the contract shall be selected through a competitive bid process that is transparent and open; and</text></item><item commented="no" display-inline="no-display-inline" id="idDBEF82CF62B641D0968CF9F969B1B998"><enum>(bb)</enum><text display-inline="yes-display-inline">the contract shall be for a term of not longer than 5 years, after which the Commission may enter into a new contract—</text><subitem commented="no" display-inline="no-display-inline" id="id180A92A91B5946829ADD170B8F36C0FC"><enum>(AA)</enum><text display-inline="yes-display-inline">with an entity, and for the purposes, described in clause (i); and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id0C3A4DDD5DAB4B40A93C123C6095249F"><enum>(BB)</enum><text display-inline="yes-display-inline">that complies with the requirements under subclause (II) and this subclause; and</text></subitem></item><item commented="no" display-inline="no-display-inline" id="idA2C906A9D3784416A048415BB4DD38FF"><enum>(cc)</enum><text display-inline="yes-display-inline">the contract shall—</text><subitem commented="no" display-inline="no-display-inline" id="idD03AC0234A6D4D69B67ADD697475A45E"><enum>(AA)</enum><text display-inline="yes-display-inline">prohibit the entity described in item (aa) from selling, leasing, or otherwise disclosing for monetary consideration any personally identifiable information to any other entity other than for purposes authorized under this title; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id3A3542A6A6E3401EA35003E4FE068A42"><enum>(BB)</enum><text display-inline="yes-display-inline">require the entity described in item (aa) to include in any contract with any other entity a provision that prohibits that other entity from engaging in an action that is prohibited under subitem (AA).</text></subitem></item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida7bc1d5e46964eef8ac42611d6dcca7b"><enum>(B)</enum><header display-inline="yes-display-inline">Fabric</header><text display-inline="yes-display-inline">The rules issued by the Commission under subsection (a)(1) shall establish the Broadband Serviceable Location Fabric, which shall—</text><clause commented="no" display-inline="no-display-inline" id="idadabde87cfa744c8bf2113b99542dfea"><enum>(i)</enum><text display-inline="yes-display-inline">contain geocoded information for each location identified under subparagraph (A)(i);</text></clause><clause commented="no" display-inline="no-display-inline" id="idbea1e807225e4985b70cee710c7466c1"><enum>(ii)</enum><text display-inline="yes-display-inline">serve as the foundation upon which all data relating to the availability of fixed broadband internet access service collected under paragraph (2)(A) shall be reported and overlaid;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5e11bc6ac8b74c6bb2ba1ef377be3291"><enum>(iii)</enum><text display-inline="yes-display-inline">be compatible with commonly used GIS software; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf2c699c509d04369854293470aaec17c"><enum>(iv)</enum><text display-inline="yes-display-inline">at a minimum, be updated every 6 months by the Commission.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc4afb24fc1f440da8d49acb3caf25306"><enum>(C)</enum><header display-inline="yes-display-inline">Implementation priority</header><text display-inline="yes-display-inline">The Commission shall prioritize implementing the Fabric for rural and insular areas of the United States.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id974f3c0b97e641559d643fbbebd5bc77"><enum>(2)</enum><header display-inline="yes-display-inline">Collection of information</header><text display-inline="yes-display-inline">The rules issued by the Commission under subsection (a)(1) shall include uniform standards for the reporting of broadband internet access service data that the Commission shall collect—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfa95e1bc622140868660d6833ad87254"><enum>(A)</enum><text display-inline="yes-display-inline">from each provider of terrestrial fixed, fixed wireless, or satellite broadband internet access service, which shall include data that—</text><clause commented="no" display-inline="no-display-inline" id="id8eef233319fc4b9eb398a9de0d0c2e6a"><enum>(i)</enum><text display-inline="yes-display-inline">documents the areas where the provider—</text><subclause commented="no" display-inline="no-display-inline" id="id6EACB98CAA16499DBD03F690FA841D04"><enum>(I)</enum><text display-inline="yes-display-inline">has actually built out the broadband network infrastructure of the provider such that the provider is able to provide that service; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idC69BEE17D22C45489BF9735A0DD38BC7"><enum>(II)</enum><text display-inline="yes-display-inline">could provide that service, as determined by identifying where the provider is capable of performing a standard broadband installation, if applicable;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id43a3524c9d954e88ab771584787f1e34"><enum>(ii)</enum><text display-inline="yes-display-inline">includes information regarding download and upload speeds, at various thresholds established by the Commission, and, if applicable, latency with respect to broadband internet access service that the provider makes available;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4633adca70ee465b9a88d15f80c50d29"><enum>(iii)</enum><text display-inline="yes-display-inline">can be georeferenced to the GIS data in the Fabric;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0dcb89226ca240beba6b8551b35aa429"><enum>(iv)</enum><text display-inline="yes-display-inline">the provider shall report as—</text><subclause commented="no" display-inline="no-display-inline" id="idb4a0c851bbd5482188ab8185ecb2e4e6"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to providers of fixed wireless broadband internet access service—</text><item commented="no" display-inline="no-display-inline" id="id4d963c1e5f774ba7b11c54c20fad7963"><enum>(aa)</enum><text display-inline="yes-display-inline">propagation maps and propagation model details that—</text><subitem commented="no" display-inline="no-display-inline" id="id89e6639aa9834547937a0e31e2f4ec6f"><enum>(AA)</enum><text display-inline="yes-display-inline">satisfy standards that are similar to those applicable to providers of mobile broadband internet access service under subparagraph (B) with respect to propagation maps and propagation model details, taking into account material differences between fixed wireless and mobile broadband internet access service; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id4dbea53a990849a88a8fa5ccd1000fee"><enum>(BB)</enum><text display-inline="yes-display-inline">reflect the speeds and latency of the service provided by the provider; or</text></subitem></item><item commented="no" display-inline="no-display-inline" id="id235e6d63de6b4d97aeb9e0b9c2278bdd"><enum>(bb)</enum><text display-inline="yes-display-inline">a list of addresses or locations that constitute the service area of the provider, except that the Commission—</text><subitem commented="no" display-inline="no-display-inline" id="id9F76C39358C746F9ADDE22E95749899D"><enum>(AA)</enum><text display-inline="yes-display-inline">may only permit, and not require, a provider to report the data using that means of reporting; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="idA089F35DABB14081897D5D7218986FEB"><enum>(BB)</enum><text display-inline="yes-display-inline">in the rules issued under subsection (a)(1), shall provide a method for using that means of reporting with respect to Tribal areas; and</text></subitem></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idfd00ec46184e43a8a2b37bbe2d25ff57"><enum>(II)</enum><text display-inline="yes-display-inline">with respect to providers of terrestrial fixed and satellite broadband internet access service—</text><item commented="no" display-inline="no-display-inline" id="idade21f0f996f4e889872fc1a48d78ca5"><enum>(aa)</enum><text display-inline="yes-display-inline">polygon shapefiles; or</text></item><item commented="no" display-inline="no-display-inline" id="idc2f634826daa4d00bef7b0c5d5f3dd23"><enum>(bb)</enum><text display-inline="yes-display-inline">a list of addresses or locations that constitute the service area of the provider, except that the Commission—</text><subitem commented="no" display-inline="no-display-inline" id="idCBD743B43E9F4417B568F74B008A421B"><enum>(AA)</enum><text display-inline="yes-display-inline">may only permit, and not require, a provider to report the data using that means of reporting; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="idF165776193C948A68BC5346B2753B798"><enum>(BB)</enum><text display-inline="yes-display-inline">in the rules issued under subsection (a)(1), shall provide a method for using that means of reporting with respect to Tribal areas; and</text></subitem></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idA88B8514EC084EEB88E26FCCCF3BA22D"><enum>(v)</enum><text display-inline="yes-display-inline">the Commission determines is appropriate with respect to certain technologies in order to ensure that the Broadband Map is granular and accurate; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id170922629df6495989dc690534b166fb"><enum>(B)</enum><text display-inline="yes-display-inline">from each provider of mobile broadband internet access service, which shall include propagation maps and propagation model details that indicate the current (as of the date on which the information is collected) fourth generation Long-Term Evolution (commonly referred to as <quote>4G LTE</quote>) mobile broadband internet access service coverage of the provider, which shall—</text><clause commented="no" display-inline="no-display-inline" id="idA6B45D7F73844FA1893EB4BD3C364217"><enum>(i)</enum><text display-inline="yes-display-inline">take into consideration the effect of clutter; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idD16F6CEDCCA344B9A0356FC57388DF99"><enum>(ii)</enum><text display-inline="yes-display-inline">satisfy—</text><subclause commented="no" display-inline="no-display-inline" id="id1717E8E5003C41EAA4AF105C8588ED64"><enum>(I)</enum><text display-inline="yes-display-inline">the requirements of having—</text><item commented="no" display-inline="no-display-inline" id="idEDF4C418B8F54D11BDFF24D8E3C64766"><enum>(aa)</enum><text display-inline="yes-display-inline">a download speed of not less than 5 megabits per second and an upload speed of not less than 1 megabit per second with a cell edge probability of not less than 90 percent; and</text></item><item commented="no" display-inline="no-display-inline" id="id7963CB4334D44FCA9BFB5D8CF4614494"><enum>(bb)</enum><text display-inline="yes-display-inline">cell loading of not less than 50 percent; and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="ideb01e3bb9c3c4707a8729a112569aaea"><enum>(II)</enum><text display-inline="yes-display-inline">any other parameter that the Commission determines to be necessary to create a map under subsection (c)(1)(C) that is more precise than the map produced as a result of the submissions under the Mobility Fund Phase II information collection.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34c13afdfdd8432497e7b04ef9d70c5c"><enum>(3)</enum><header display-inline="yes-display-inline">Update of reporting standards for mobile broadband internet access service</header><text display-inline="yes-display-inline">For the purposes of paragraph (2)(B), if the Commission determines that the reporting standards under that paragraph are insufficient to collect accurate propagation maps and propagation model details with respect to future generations of mobile broadband internet access service technologies, the Commission shall immediately commence a rule making to adopt new reporting standards with respect to those technologies that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id26141DBBDB9F44C1A0B7E38CC1D8ECEC"><enum>(A)</enum><text display-inline="yes-display-inline">shall be the functional equivalent of the standards required under paragraph (2)(B); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id609B60B31BC64350A57884F60E53FB0E"><enum>(B)</enum><text display-inline="yes-display-inline">allow for the collection of propagation maps and propagation model details that are as accurate and granular as, or more accurate and granular than, the maps and model details collected by the Commission under paragraph (2)(B).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFD33DB81CCAA4523BAD920C4DC983365"><enum>(4)</enum><header display-inline="yes-display-inline">Certification and verification</header><text display-inline="yes-display-inline">With respect to a provider that submits information to the Commission under paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id824eb625827b452ab3adf7d5057fe8a3"><enum>(A)</enum><text display-inline="yes-display-inline">the provider shall include in each submission a certification from a corporate officer of the provider that the officer has examined the information contained in the submission and that, to the best of the officer’s actual knowledge, information, and belief, all statements of fact contained in the submission are true and correct; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3e58bfafd1334efaa5fd8b84193562fe"><enum>(B)</enum><text display-inline="yes-display-inline">the Commission shall verify the accuracy and reliability of the information in accordance with measures established by the Commission.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide3c16d38e99142a4b9dfb63db9c7326c"><enum>(5)</enum><header display-inline="yes-display-inline">Challenge process</header><subparagraph commented="no" display-inline="no-display-inline" id="id0af262ff24f14e368807c1addfacd0e3"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the rules issued under subsection (a), and subject to subparagraph (B), the Commission shall establish a user-friendly challenge process through which consumers, State, local, and Tribal governmental entities, and other entities or individuals may submit coverage data to the Commission to challenge the accuracy of—</text><clause commented="no" display-inline="no-display-inline" id="id449D5462D713407BAE993D664BE4E844"><enum>(i)</enum><text display-inline="yes-display-inline">the coverage maps;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5DF9A792F7E442D98CFB02684AFFC76F"><enum>(ii)</enum><text display-inline="yes-display-inline">any information submitted by a provider regarding the availability of broadband internet access service; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id38E5497567D34480B0BF8BA45EC06111"><enum>(iii)</enum><text display-inline="yes-display-inline">the information included in the Fabric.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc2c2921a249b4f6fb635c94616c2af98"><enum>(B)</enum><header display-inline="yes-display-inline">Considerations; verification; response to challenges</header><text display-inline="yes-display-inline">In establishing the challenge process required under subparagraph (A), the Commission shall—</text><clause commented="no" display-inline="no-display-inline" id="ida31c98911c7c4ffca4ea77379b5ff92e"><enum>(i)</enum><text display-inline="yes-display-inline">consider—</text><subclause commented="no" display-inline="no-display-inline" id="idef0c00fc1b314bb4b813e59ffe55bd5b"><enum>(I)</enum><text display-inline="yes-display-inline">the types of information that an entity or individual submitting a challenge should provide to the Commission in support of the challenge;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id99e168f88dc24d719bb0698338fc5c52"><enum>(II)</enum><text display-inline="yes-display-inline">the appropriate level of granularity for the information described in subclause (I);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8ca5fab150cd407d937bf1be39b7d834"><enum>(III)</enum><text display-inline="yes-display-inline">the need to mitigate the time and expense incurred by, and the administrative burdens placed on, entities or individuals in—</text><item commented="no" display-inline="no-display-inline" id="id215021EC80144C2E9D5E9DE9F942BF01"><enum>(aa)</enum><text display-inline="yes-display-inline">challenging the accuracy of a coverage map; and</text></item><item commented="no" display-inline="no-display-inline" id="id065C31869E0948F292A57325B472E71C"><enum>(bb)</enum><text display-inline="yes-display-inline">responding to challenges described in item (aa);</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id5f5f5979d04f4a309fd69a2730323d3b"><enum>(IV)</enum><text display-inline="yes-display-inline">the costs to consumers and providers resulting from a misallocation of funds because of a reliance on outdated or otherwise inaccurate information in the coverage maps;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idD058A2B1672E49069C1086781176BFB0"><enum>(V)</enum><text display-inline="yes-display-inline">any lessons learned from the challenge process established under Mobility Fund Phase II, as determined from comments solicited by the Commission; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id66D1E715FC304BF5ABAF34A24A2916EC"><enum>(VI)</enum><text display-inline="yes-display-inline">the need for user-friendly challenge submission formats that will promote participation in the challenge process;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idc927ab9c52294514a58dd779751e2733"><enum>(ii)</enum><text display-inline="yes-display-inline">include a process for verifying the data submitted through the challenge process in order to ensure the reliability of that data;</text></clause><clause commented="no" display-inline="no-display-inline" id="ide8e7a963876f4efb98175933da8bb5ea"><enum>(iii)</enum><text display-inline="yes-display-inline">allow providers to respond to challenges submitted through the challenge process; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7BA3AE498D2F49B28973FF7DB67F1E92"><enum>(iv)</enum><text display-inline="yes-display-inline">develop an online mechanism, which—</text><subclause commented="no" display-inline="no-display-inline" id="idBC55C7E288A04E2EAD653153E8DC3E33"><enum>(I)</enum><text display-inline="yes-display-inline">shall be integrated into the coverage maps;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idE7AE904AD1844604924AC0CEEEE0EB3B"><enum>(II)</enum><text display-inline="yes-display-inline">allows for an entity described in subparagraph (A) to submit a challenge under the challenge process;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id137523E453574703969582D41F68FA11"><enum>(III)</enum><text display-inline="yes-display-inline">makes challenge data available in both geographic information system and non-geographic information system formats; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idEA3CCF8D92E2491881B9838E8BA5009A"><enum>(IV)</enum><text display-inline="yes-display-inline">clearly identifies the areas in which broadband internet access service is available, and the upload and download speeds at which that service is available, as reported to the Commission under this section.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide29fe1e65e8e446d99e5551cafcbcf56"><enum>(C)</enum><header display-inline="yes-display-inline">Use of challenges</header><text display-inline="yes-display-inline">The rules issued to establish the challenge process under subparagraph (A) shall include—</text><clause commented="no" display-inline="no-display-inline" id="id035a4a01781b48f8aa76c58983361213"><enum>(i)</enum><text display-inline="yes-display-inline">a process for the speedy resolution of challenges; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id36a371b73c9b47a2870f63d2a700591e"><enum>(ii)</enum><text display-inline="yes-display-inline">a process for the regular and expeditious updating of the coverage maps and granular data disseminated by the Commission as challenges are resolved.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC8658F02D1444D509B04375528DC703D"><enum>(D)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">Not earlier than 1 year, and not later than 18 months, after the date on which the rules issued under subsection (a)(1) take effect, the Commission shall, after an opportunity for notice and comment, submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that—</text><clause commented="no" display-inline="no-display-inline" id="idAB17AFFBA81B401F9BA033F5C473FBE5"><enum>(i)</enum><text display-inline="yes-display-inline">evaluates the challenge process described in subparagraph (A); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id808EC548B8F341DC931D06A25EF52EB1"><enum>(ii)</enum><text display-inline="yes-display-inline">considers whether the Commission should commence an inquiry on the need for other tools to help—</text><subclause commented="no" display-inline="no-display-inline" id="idB6E9A20DB3524C62878C184112D7BDBC"><enum>(I)</enum><text display-inline="yes-display-inline">identify potential inaccuracies in the data relating to broadband internet access service that providers report; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2567FF26B1B84BA1AFB6F61F04E099BA"><enum>(II)</enum><text display-inline="yes-display-inline">improve the accuracy of the data described in subclause (I).</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id007149809ac444e687297d9fe4dc31c8"><enum>(6)</enum><header display-inline="yes-display-inline">Reform of form 477 process</header><subparagraph commented="no" display-inline="no-display-inline" id="idBE30EF3ADCEE469E8A1C5993460E0544"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the rules issued under subsection (a) take effect, the Commission shall—</text><clause commented="no" display-inline="no-display-inline" id="id46ec123df584491bb9fc57616d1efe3c"><enum>(i)</enum><text display-inline="yes-display-inline">reform the Form 477 broadband deployment service availability collection process of the Commission—</text><subclause commented="no" display-inline="no-display-inline" id="id101E43B91BE24C3FA80B11B115F519AF"><enum>(I)</enum><text display-inline="yes-display-inline">to achieve the purposes of this title; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id390A29238F294D6198705E4951BD9B3B"><enum>(II)</enum><text display-inline="yes-display-inline">in a manner that—</text><item commented="no" display-inline="no-display-inline" id="id533FAC9E33AE47059E2A0969807B29F9"><enum>(aa)</enum><text display-inline="yes-display-inline">enables the comparison of data and maps produced before the implementation of this title with data and coverage maps produced after the implementation of this title; and</text></item><item commented="no" display-inline="no-display-inline" id="id6D8742983DEE45B58D7EBAE0BD5A248F"><enum>(bb)</enum><text display-inline="yes-display-inline">maintains the public availability of data relating to the deployment of broadband internet access service; and</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ida9a8f2677ba2454e97e151b392d3afbb"><enum>(ii)</enum><text display-inline="yes-display-inline">harmonize reporting requirements and procedures regarding the deployment of broadband internet access service that are in effect on the day before the date on which the rules issued under subsection (a)(1) take effect with those requirements and procedures in those rules.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id377AD0DFED1E43AFB2621F2210F018F9"><enum>(B)</enum><header display-inline="yes-display-inline">Continued collection and reporting</header><text display-inline="yes-display-inline">On and after the date on which the Commission carries out subparagraph (A), the Commission shall continue to collect and publicly report subscription data that the Commission collected through the Form 477 broadband deployment service availability process, as in effect on July 1, 2019.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDC1A158AE5F948E0BEE839E7395CBAD7"><enum>(7)</enum><header display-inline="yes-display-inline">Sharing data with NTIA</header><text display-inline="yes-display-inline">The Commission shall establish a process to make the data collected under paragraph (2) available to the National Telecommunications and Information Administration.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6da94e726e0a418a9c736a41e71303f5"><enum>(c)</enum><header display-inline="yes-display-inline">Maps</header><text display-inline="yes-display-inline">The Commission shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id08e228a9e1a3447997e8d051e50fb6fd"><enum>(1)</enum><text display-inline="yes-display-inline">after consultation with the Federal Geographic Data Committee established under section 753(a) of the Geospatial Data Act of 2018, create—</text><subparagraph commented="no" display-inline="no-display-inline" id="id91975949DF4A44BC827161BA249E7E9A"><enum>(A)</enum><text display-inline="yes-display-inline">the Broadband Map, which shall depict—</text><clause commented="no" display-inline="no-display-inline" id="idE14D024124D64C1F80B95D75AAA76AEA"><enum>(i)</enum><text display-inline="yes-display-inline">the extent of the availability of broadband internet access service in the United States, without regard to whether that service is fixed broadband internet access service or mobile broadband internet access service, which shall be based on data collected by the Commission from all providers; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id031B08A18894494B9A265A2FA35A6A24"><enum>(ii)</enum><text display-inline="yes-display-inline">the areas of the United States that remain unserved by providers;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddbb29124bdf647568ce38aee3581d121"><enum>(B)</enum><text display-inline="yes-display-inline">a map that depicts the availability of fixed broadband internet access service, which shall be based on data collected by the Commission from providers under subsection (b)(2)(A); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida0ac4d357d8e4e67bb8bb384e128b83f"><enum>(C)</enum><text display-inline="yes-display-inline">a map that depicts the availability of mobile broadband internet access service, which shall be based on data collected by the Commission from providers under subsection (b)(2)(B);</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3201bea3d62143b68dc3c46d86a66414"><enum>(2)</enum><text display-inline="yes-display-inline">use the maps created under paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2948a52575c447e099a0a8a4fa046a89"><enum>(A)</enum><text display-inline="yes-display-inline">to determine the areas in which terrestrial fixed, fixed wireless, mobile, and satellite broadband internet access service is and is not available; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb6743fa3f0a4463c83ff03ecd4c00808"><enum>(B)</enum><text display-inline="yes-display-inline">when making any new award of funding with respect to the deployment of broadband internet access service;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id181d5f622880468b80192c0c2466f144"><enum>(3)</enum><text display-inline="yes-display-inline">update the maps created under paragraph (1) not less frequently than biannually using the most recent data collected from providers under subsection (b)(2);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id15c798e0701f4edda5262c343b0d4199"><enum>(4)</enum><text display-inline="yes-display-inline">consult with—</text><subparagraph commented="no" display-inline="no-display-inline" id="id48077030BE3D4417B3D3D2F8488237FC"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture to enable the Secretary of Agriculture to consult the maps created under paragraph (1) when considering the awarding of funds for the deployment of broadband internet access service under any program administered by the Administrator of the Rural Utilities Service; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ACC9BC240D945B1BD61AB612DD0CBFA"><enum>(B)</enum><text display-inline="yes-display-inline">the National Telecommunications and Information Administration to enable the Administration to consult the maps created under paragraph (1) when considering the awarding of funds for the deployment of broadband internet access service under any future program administered by the Administration;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4317D07280654E0696D4A7EC4E82E0C4"><enum>(5)</enum><text display-inline="yes-display-inline">make available to any Federal agency, upon request, the maps created under paragraph (1); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id452904E383BB4EDAADB867BB9FFED2AB"><enum>(6)</enum><text display-inline="yes-display-inline">make public at an appropriate level of granularity—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3023DB0723E64C2991D435B544DE35A8"><enum>(A)</enum><text display-inline="yes-display-inline">the maps created under paragraph (1); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7FC75F510B354F2B9785DB1979DB2048"><enum>(B)</enum><text display-inline="yes-display-inline">the data collected by the Commission with respect to the availability of broadband internet access service and the quality of service with respect to broadband internet access service.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDADBABB4BEB64A96B7E58D104C986DE6"><enum>(d)</enum><header display-inline="yes-display-inline">Delayed effective date for quality of service rules</header><text display-inline="yes-display-inline">Any requirement of a rule issued under subsection (a)(1) that relates to quality of service shall take effect not earlier than the date that is 180 days after the date on which the Commission issues that rule.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="idc9381ce9b5954adfbc701f9c39d92707" section-type="subsequent-section"><enum>803.</enum><header display-inline="yes-display-inline">Enforcement</header><subsection commented="no" display-inline="no-display-inline" id="idbbf2680e143245c1b40dc104f273ae40"><enum></enum><text display-inline="yes-display-inline">It shall be unlawful for an entity or individual to willfully and knowingly, or recklessly, submit information or data under this title that is materially inaccurate or incomplete with respect to the availability of broadband internet access service or the quality of service with respect to broadband internet access service.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id404709299c8d4f3baac65f13d81e20d9" section-type="subsequent-section"><enum>804.</enum><header display-inline="yes-display-inline">Improving data accuracy</header><subsection commented="no" display-inline="no-display-inline" id="id05867c5feee442e4b6845cc04f7f1af8"><enum>(a)</enum><header display-inline="yes-display-inline">Audits</header><text display-inline="yes-display-inline">The Commission shall conduct regular audits of information submitted to the Commission by providers under section 802(b)(2) to ensure that the providers are complying with this title.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id306e8b228f464ea79d069b77b9918eb9"><enum>(b)</enum><header display-inline="yes-display-inline">Crowdsourcing</header><paragraph commented="no" display-inline="no-display-inline" id="id60f64796a39d404cb0fdace80086e70e"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall develop a process through which entities or individuals in the United States may submit specific information about the deployment and availability of broadband internet access service in the United States on an ongoing basis so that the information may be used to verify and supplement information provided by providers of broadband internet access service for inclusion in the maps created under section 802(c)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc7dc7f57e40049eeabd07572dd8205e0"><enum>(2)</enum><header display-inline="yes-display-inline">Collaboration</header><text display-inline="yes-display-inline">As part of the efforts of the Commission to facilitate the ability of entities and individuals to submit information under paragraph (1), the Commission shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6BC636584C63479FBC2C6ED5913C8025"><enum>(A)</enum><text display-inline="yes-display-inline">prioritize the consideration of data provided by data collection applications used by consumers that the Commission has determined—</text><clause commented="no" display-inline="no-display-inline" id="id15320D64BC2F4EA9958CC52FA67E707C"><enum>(i)</enum><text display-inline="yes-display-inline">are highly reliable; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1DF0D8F504934898912892CE46A6C3CF"><enum>(ii)</enum><text display-inline="yes-display-inline">have proven methodologies for determining network coverage and network performance;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id54FD5448DD8A440BAB2087A65EBB9D1A"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 1 year after the date of enactment of this title, conclude a process that tests the feasibility of partnering with Federal agencies that operate delivery fleet vehicles, including the United States Postal Service, to facilitate the collection and submission of information described in that paragraph; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCC27BBE7B4144122A1D1472F091A2152"><enum>(C)</enum><text display-inline="yes-display-inline">not later than 14 months after the date of enactment of this title, publish on the website of the Commission, and submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives, a report regarding the testing described in subparagraph (B), which shall include—</text><clause commented="no" display-inline="no-display-inline" id="idD8450168F10642F4B6070060C9B6EA5E"><enum>(i)</enum><text display-inline="yes-display-inline">a determination regarding whether the partnerships with Federal agencies described in that subparagraph are able to facilitate the collection and submission of information described in paragraph (1); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id497693815F004ED19E0CB9F741E391B6"><enum>(ii)</enum><text display-inline="yes-display-inline">any steps that the Commission plans to take to facilitate the partnerships described in that subparagraph.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id40adf7581f3e4f08b9694fc592cdb6f5"><enum>(c)</enum><header display-inline="yes-display-inline">Technical assistance to Indian Tribes</header><paragraph commented="no" display-inline="no-display-inline" id="id4ce83bab3f464c02bbf210c49bb6d1bf"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the Commission shall hold workshops for Tribal governments in each of the 12 Bureau of Indian Affairs regions to provide technical assistance with the collection and submission of data under section 802(a)(2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbfc5b6f5f6ef4881a0aca9ce5361d1fd"><enum>(2)</enum><header display-inline="yes-display-inline">Annual review</header><text display-inline="yes-display-inline">Each year, the Commission, in consultation with Indian Tribes, shall review the need for continued workshops required under paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0A2C8C0CF5EE435DAB5057F6828C015F"><enum>(d)</enum><header display-inline="yes-display-inline">Technical assistance to small service providers</header><text display-inline="yes-display-inline">The Commission shall establish a process through which a provider that has fewer than 100,000 active broadband internet access service connections may request and receive assistance from the Commission with respect to geographic information system data processing to ensure that the provider is able to comply with the requirements under section 802(b) in a timely and accurate manner.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idAE7C1A83E50A40EFAEDBF5876B57E698"><enum>(e)</enum><header display-inline="yes-display-inline">Technical assistance to State, local, and Tribal governments and consumers</header><text display-inline="yes-display-inline">The Commission shall provide technical assistance to consumers and State, local, and Tribal governmental entities with respect to the challenge process established under section 802(b)(5), which shall include—</text><paragraph commented="no" display-inline="no-display-inline" id="id5BBB18487B744D9E83FA180D84950CD6"><enum>(1)</enum><text display-inline="yes-display-inline">detailed tutorials and webinars; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9EAB678E377549ECA05AC1B7CBC2B720"><enum>(2)</enum><text display-inline="yes-display-inline">the provision of staff of the Commission to provide assistance, as needed, throughout the entirety of the challenge process.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7D5949C8D64549D3A0CA0ABA58FAA3B5"><enum>(f)</enum><header display-inline="yes-display-inline">GAO assessment of fabric source data</header><paragraph commented="no" display-inline="no-display-inline" id="id8AF4CF484D2341F38DA6A87279ACCAC2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct an assessment of key data sources that are used for purposes of the Fabric to identify and geocode locations where fixed broadband internet access service can be installed in order for the Comptroller General to develop recommendations for how the quality and completeness of those data sources can be improved as data sources for the Fabric.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFA9D631E2622486A9BA0B4EB98954912"><enum>(2)</enum><header display-inline="yes-display-inline">Sources included</header><text display-inline="yes-display-inline">For the purposes of the assessment conducted under paragraph (1), the key data sources described in that paragraph shall include—</text><subparagraph commented="no" display-inline="no-display-inline" id="idCD3AEAE2F3F04B7DA99F816DBAFF1B9F"><enum>(A)</enum><text display-inline="yes-display-inline">any relevant sources of Federal data, including the National Address Database administered by the Department of Transportation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFD591BF44F4441728105FC7570C89552"><enum>(B)</enum><text display-inline="yes-display-inline">State- and county-level digitized parcel data; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9A0D8997CCFB42EF985559D06E4CF6DB"><enum>(C)</enum><text display-inline="yes-display-inline">property tax attribute recording.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id31E2855D4FF9425C80161B6367B73FE1"><enum>(3)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this title, the Comptroller General of the United States shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that contains the recommendations developed under paragraph (1).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id8c891666471c4bed8725dc72abba72bf" section-type="subsequent-section"><enum>805.</enum><header display-inline="yes-display-inline">Cost</header><subsection commented="no" display-inline="no-display-inline" id="idD6A66DD70EFB41AEAF09010B44990CFA"><enum>(a)</enum><header display-inline="yes-display-inline">USF</header><text display-inline="yes-display-inline">The Commission may not use funds from the universal service programs of the Commission established under section 254, and the regulations issued under that section, to pay for any costs associated with this title.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id739FE9A3398C4A7D93547511C6EB5DDB"><enum>(b)</enum><header display-inline="yes-display-inline">Other funds</header><text display-inline="yes-display-inline">The Commission may recover costs associated with this title under section 9 to the extent provided for in an appropriation Act, as required under subsection (a) of that section.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id336b9903eb4e4969845848e3adb58586" section-type="subsequent-section"><enum>806.</enum><header display-inline="yes-display-inline">Other provisions</header><subsection commented="no" display-inline="no-display-inline" id="ide9624b434eaa425295139dc217dc7208"><enum>(a)</enum><header display-inline="yes-display-inline">OMB</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the initial rule making required under section 802(a)(1) shall be exempt from review by the Office of Management and Budget.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd8de20f2fb594eed9b16d0de50bc0d2a"><enum>(b)</enum><header display-inline="yes-display-inline">PRA</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>) shall not apply to the initial rule making required under section 802(a)(1).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id8CD3B860FD234DFF8E28D20AF406C61A"><enum>(c)</enum><header display-inline="yes-display-inline">Execution of responsibilities</header><text display-inline="yes-display-inline">Except as provided in section 802(b)(1)(A)(ii), the Commission—</text><paragraph commented="no" display-inline="no-display-inline" id="idA75B288ED97E487ABB0A4B439DD30E7D"><enum>(1)</enum><text display-inline="yes-display-inline">including the offices of the Commission, shall carry out the responsibilities assigned to the Commission under this title; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD4D8AE8F22174FA895E7A9C6C0AB9DFC"><enum>(2)</enum><text display-inline="yes-display-inline">may not delegate any of the responsibilities assigned to the Commission under this title to any third party, including the Universal Service Administrative Company.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id25E1EEE4D787413BB3F378A2B97AA8FA"><enum>(d)</enum><header display-inline="yes-display-inline">Reporting</header><text display-inline="yes-display-inline">Each fiscal year, the Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that summarizes the implementation of this title and associated enforcement activities conducted during the previous fiscal year.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idC5B36875FEA5426D81DB1C6BA3847EBE"><enum>(e)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">If the Commission, before the date of enactment of this title, has taken an action that, in whole or in part, implements this title, the Commission shall not be required to revisit such action to the extent that such action is consistent with this title.</text></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body><attestation><attestation-group><attestation-date
