 information to patients.</official-title></form><legis-body><section id="id930D0971A44C4523BBAD6084BCABC2D0" section-type="section-one"><enum>1.</enum><header>Patient disclosures</header><text display-inline="no-display-inline">Part P of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g">42 U.S.C. 280g</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idBC1EEBAB902D4386B8AA8559379D259D" style="OLC"><section id="id920C90A32082487381AE1BB1F89A8C6A"><enum>399V–7.</enum><header>Patient disclosures</header><subsection id="id86C1EEE459A543D38762F70699D19D55"><enum>(a)</enum><header>In general</header><text>The Secretary shall require—</text><paragraph id="id87CE7B86CAE945E18BB35202446ACA66"><enum>(1)</enum><text>health care facilities and practitioners to provide to patients a list of services rendered during the visit to such facility or practitioner upon discharge; and</text></paragraph><paragraph id="id92fef90f61e9495d8a2fd46d8b7d5504"><enum>(2)</enum><text>health care facilities and practitioners to send all bills to the patient within 30 business days.</text></paragraph></subsection><subsection id="idBD324DEE095E419195FD4AF18A5D9970"><enum>(b)</enum><header>Payment after billing</header><text>No patient may be required to pay a bill for health care services any earlier than 30 business days after receipt of a bill for such services.</text></subsection><subsection id="id7B2A478616E64A7E87B01A7281C80D5E"><enum>(c)</enum><header>Effect of violation</header><paragraph id="id728E2882D1ED435ABB754045C51DB079"><enum>(1)</enum><header>Notification and refund requirements</header><text>If a facility or practitioner bills a patient after the 30-business-day period described in subsection (a)(2), such facility or practitioner shall—</text><subparagraph id="id4428CE31E2784B42A9A651C91CBE3327"><enum>(A)</enum><text>report such bill to the Secretary; and</text></subparagraph><subparagraph id="idA55305F7086E4764A4D551D9C8095E66"><enum>(B)</enum><text>refund the patient for the full amount paid in response to such bill with interest, at a rate determined by the Secretary.</text></subparagraph></paragraph><paragraph id="id327E38F2B88B4CE48909975F1912C9FA"><enum>(2)</enum><header>Civil monetary penalties</header><subparagraph id="id799D8E13455A409B86E5C43613A07F26"><enum>(A)</enum><header>In general</header><text>The Secretary may impose civil monetary penalties of up to $10,000 a day on any facility or practitioner that submits more than 10 bills outside of the period described in subsection (a)(2), beginning on the date on which such facility or practitioner sends the tenth such bill.</text></subparagraph><subparagraph id="idADEE85E5A61C411A8446A035B65D3CE0"><enum>(B)</enum><header>Procedure</header><text>The provisions of section 1128A of the Social Security Act, other than subsections (a) and (b) and the first sentence of subsection (c)(1) of such section, shall apply to civil money penalties under this subsection in the same manner as such provisions apply to a penalty or proceeding under section 1128A of the Social Security Act.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
