 <subsection id="id5A76B80B455148498B5DA34F042D9D50"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle F of title IX of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16291">42 U.S.C. 16291</external-xref> et seq.) is amended by adding at the end the following:</text>

					<section id="idD8C166D6ADC4411A90270C818D3BDA98"><enum>969.</enum><header>Natural gas carbon capture research, development, and demonstration program</header>
 <subsection id="id3BEBDD059AAC45999602CC5814F567D7"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="idF6181498BAAA4F949363DA91B7DA4960"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an entity that documents to the satisfaction of the Secretary that—</text>
 <subparagraph id="idcec3ec1884a5404895225b7731ccaced"><enum>(A)</enum><text>the entity is financially responsible; and</text> </subparagraph><subparagraph id="id49a5478b4f54435c995b21e96de06784"><enum>(B)</enum><text>the entity will provide sufficient information to the Secretary to enable the Secretary to ensure that any funds awarded to the entity are spent efficiently and effectively.</text>
 </subparagraph></paragraph><paragraph id="idDD174EADA0884741B84CB33F266EC524"><enum>(2)</enum><header>Natural gas</header><text>The term <term>natural gas</term> means any fuel consisting in whole or in part of—</text> <subparagraph id="id72e6088c530340f9ae8247031e80b3fe"><enum>(A)</enum><text>natural gas;</text>
 </subparagraph><subparagraph id="id5f4a321054b644b8bcd5b5458347cb04"><enum>(B)</enum><text>liquid petroleum gas;</text> </subparagraph><subparagraph id="id4b59cc0e41914fe390c64fd4ec2a9e9c"><enum>(C)</enum><text>synthetic gas derived from petroleum or natural gas liquids;</text>
 </subparagraph><subparagraph id="ida8a05e0897ed4eb1a741be0aa585f749"><enum>(D)</enum><text>any mixture of natural gas and synthetic gas; or</text> </subparagraph><subparagraph id="idd3bf0b6973a24a7aacc53dafe5039e01"><enum>(E)</enum><text>any product derived directly from natural gas, including hydrogen.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5381F6218A3742B48F14FF5728AE10BC"><enum>(3)</enum><header>Natural gas-generated power</header><text>The term <term>natural gas-generated power</term> means electric energy generated through the use of natural gas.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id511E8F8D2B8A44289B95258BAF133824"><enum>(4)</enum><header>Program</header><text>The term <term>program</term> means the program established under subsection (b)(1).</text>
							</paragraph><paragraph id="id4F007B89815A45D1940A0E0A20ECD0D2"><enum>(5)</enum><header>Qualifying electric generation facility</header>
 <subparagraph id="idC755A592FF6D4334A69A2F4F3342C3C6"><enum>(A)</enum><header>In general</header><text>The term <term>qualifying electric generation facility</term> means a facility that generates electric energy using natural gas as the fuel.</text> </subparagraph><subparagraph id="id16863BC908BE458F940B27751819052E"><enum>(B)</enum><header>Inclusions</header><text>The term <term>qualifying electric generation facility</term> includes—</text>
 <clause id="idDA2B41ACBBE14658AA30C4BF71C54565"><enum>(i)</enum><text>a traditional natural gas plant;</text> </clause><clause id="id7B88ED557A354459B47D8D0D78514A1B"><enum>(ii)</enum><text>a simple cycle plant;</text>
 </clause><clause id="idF3E5F262CE4746B29242E6C0477581E7"><enum>(iii)</enum><text>a combined cycle plant;</text> </clause><clause id="idCB55509A2E3F420FACFFD7687AC69343"><enum>(iv)</enum><text>a combined heat and power plant; or</text>
 </clause><clause id="id5DDFA43C42B94DB4A4AB347E59F5F303"><enum>(v)</enum><text>any other facility that uses natural gas as the fuel for generating electric energy.</text> </clause></subparagraph></paragraph><paragraph id="id0DEAEABECAF446C4B92AD55C9A3DBFD6"><enum>(6)</enum><header>Qualifying technology</header><text>The term <term>qualifying technology</term> means any commercially viable technology, as determined by the Secretary, for the capture of carbon dioxide produced during the generation of natural gas-generated power.</text>
							</paragraph></subsection><subsection id="idce78283dccb0440d828e64e231d94e81"><enum>(b)</enum><header>Establishment of research, development, and demonstration program</header>
 <paragraph id="idF6D66AC12B1E4A1491B2E207ED68E5FA"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a program of research, development, and demonstration of qualifying technologies for use by qualifying electric generation facilities.</text>
 </paragraph><paragraph id="id1961F6A598C04DE1A904B4073861D001"><enum>(2)</enum><header>Objectives</header><text>The objectives of the program shall be—</text> <subparagraph id="id32304ed083334b7280ef4134e9bf5554"><enum>(A)</enum><text>to identify opportunities to accelerate the development and commercial applications of qualifying technologies to reduce the quantity of carbon dioxide emissions released from qualifying electric generation facilities;</text>
 </subparagraph><subparagraph id="idff889403cd804776b298496724cba0a4"><enum>(B)</enum><text>to enter into cooperative agreements with eligible entities to expedite and carry out demonstration projects (including pilot projects) for qualifying technologies for use by qualifying electric generation facilities to demonstrate the technical feasibility and economic potential of those qualifying technologies for commercial deployment; and</text>
 </subparagraph><subparagraph id="id75feb08978514ab8828eac93d45a76d2"><enum>(C)</enum><text>to identify any barriers to the commercial deployment of any qualifying technologies under development.</text>
 </subparagraph></paragraph><paragraph id="id6BAB7A1B19144B828BB98859B0028A48"><enum>(3)</enum><header>Participation of National Laboratories, universities, and research facilities</header><text>The program may include the participation of—</text> <subparagraph id="id03DE7F52FA9848FD955424E548BA605E"><enum>(A)</enum><text>National Laboratories;</text>
 </subparagraph><subparagraph id="idD18B0E5689464576AFE1155175588745"><enum>(B)</enum><text>institutions of higher education;</text> </subparagraph><subparagraph id="id67F02B22D2CC4545A2FA281E5AC18AA2"><enum>(C)</enum><text>research facilities; or</text>
 </subparagraph><subparagraph id="id2DA0215E5F4B449398CFD15AAF70661F"><enum>(D)</enum><text>other appropriate entities.</text> </subparagraph></paragraph><paragraph id="id0DE28820B3164FC48CFDB7746828E192"><enum>(4)</enum><header>Cooperative agreements</header> <subparagraph id="id2DCAE5F15FCE40AEB0EC20F2DE22B3FE"><enum>(A)</enum><header>In general</header><text>In carrying out the program, the Secretary may enter into cooperative agreements with eligible entities to carry out research, development, and demonstration projects for qualifying technologies.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3C0DA495F07B4F46ACBEF5A784345F62"><enum>(B)</enum><header>Applications; proposals</header><text>An eligible entity desiring to enter into a cooperative agreement under this paragraph shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text>
								</subparagraph></paragraph></subsection><subsection id="id3d9340084bbd40b68ca19da8890f1298"><enum>(c)</enum><header>Carbon capture facilities demonstration program</header>
 <paragraph id="id4F93765BF80447F5892F28828D52A9F2"><enum>(1)</enum><header>Establishment</header><text>As part of the program, the Secretary shall establish a demonstration program under which the Secretary shall enter into cooperative agreements with eligible entities for demonstration or pilot projects to license, permit, construct, and operate, by not later than September 30, 2025, three or more facilities to capture carbon dioxide from qualifying electric generation facilities.</text>
 </paragraph><paragraph id="id4F66893CD68940EC92B42483A3C0E6D6"><enum>(2)</enum><header>Goals</header><text>Each demonstration or pilot project under the demonstration program shall—</text> <subparagraph id="id2CDA263F65444191A9485B3A7F0E8A47"><enum>(A)</enum><text>be designed to further the development of qualifying technologies that may be used by a qualifying electric generation facility;</text>
 </subparagraph><subparagraph id="id50ff612db80144c5852a7adf39ef591a"><enum>(B)</enum><text>be financed in part by the private sector;</text> </subparagraph><subparagraph id="id3a2ccd40cf784911b4488928c387ed1b"><enum>(C)</enum><text>if necessary, secure agreements for the offtake of the majority of the carbon dioxide emissions captured by qualifying technologies during the project; and</text>
 </subparagraph><subparagraph id="id79bd873169714ff6aa90f9fc6a1e9b05"><enum>(D)</enum><text>support energy production in the United States.</text> </subparagraph></paragraph><paragraph id="idBC773A752C5D47AC9D5F443DAA8BD75F"><enum>(3)</enum><header>Request for applications</header><text>Not later than 120 days after the date of enactment of this Act, the Secretary shall solicit applications for cooperative agreements for projects—</text>
 <subparagraph id="id67f7f16335d049a484430046ec2bf972"><enum>(A)</enum><text>to demonstrate qualifying technologies at three or more qualifying electric generation facilities;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4073a9beb5e342e6be27b650a854e1c8"><enum>(B)</enum><text>to obtain any license or permit from a State or Federal agency that is necessary for the construction of three or more facilities to capture carbon dioxide from a qualifying electric generation facility; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD959EA30BF174AF1A45C8540795247B1"><enum>(C)</enum><text>to construct and operate three or more facilities to capture carbon dioxide from a qualifying electric generation facility.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id47878D20E01B4EAEB32D64060ACE2470"><enum>(4)</enum><header>Review of applications</header><text>In reviewing applications submitted under paragraph (3), the Secretary, to the maximum extent practicable, shall—</text>
 <subparagraph id="idABA98932F9B94E7F8313055BEA09FE7C"><enum>(A)</enum><text>ensure a broad geographic distribution of project sites;</text> </subparagraph><subparagraph id="id89A25FB371634C889722F2D1528F410A"><enum>(B)</enum><text>ensure that a broad selection of qualifying electric generation facilities are represented;</text>
 </subparagraph><subparagraph id="id54DFCA7CE9CB418AAA014CE6C8BA659F"><enum>(C)</enum><text>ensure that a broad selection of qualifying technologies are represented;</text> </subparagraph><subparagraph id="id4d354dc24a3644d0b0dcdafd8c480606"><enum>(D)</enum><text>require information and knowledge gained by each participant in the demonstration program to be transferred and shared among—</text>
 <clause id="idEE4967D3BB0B4596B86367D57CC80517"><enum>(i)</enum><text>all participants in the demonstration program; and</text> </clause><clause id="id1337CFEED7C04406A4499C232140D28C"><enum>(ii)</enum><text>other interested parties; and</text>
 </clause></subparagraph><subparagraph id="id70CB122F8AB145D389CF2BBAB0927BCD"><enum>(E)</enum><text>leverage existing—</text> <clause id="id8868D931D5214D8D98389A6908A9A4A7"><enum>(i)</enum><text>public-private partnerships; and</text>
 </clause><clause id="id65B45AEC172945B39795479693EF1DDF"><enum>(ii)</enum><text>Federal resources.</text> </clause></subparagraph></paragraph></subsection><subsection id="id516B4DA917BC4192A9AD62EDA6B96C65"><enum>(d)</enum><header>Cost sharing</header><text>In carrying out this section, the Secretary shall require cost sharing in accordance with section 988.</text>
 </subsection><subsection id="id7D404213E67C44279D10E7A3C96D40F0"><enum>(e)</enum><header>Fee title</header><text>The Secretary may vest fee title or other property interests acquired under cooperative agreements entered into under subsection (b)(4) in any entity, including the United States.</text>
 </subsection><subsection id="id02b2c297db904d21a34ef34dafde3367"><enum>(f)</enum><header>Report</header><text>Not later than 180 days after the date on which the Secretary solicits applications under subsection (c)(3), and annually thereafter, the Secretary shall submit to the appropriate committees of jurisdiction of the Senate and the House of Representatives a report that—</text>
 <paragraph id="idc82ec86571c14af08776ce9a59af8491"><enum>(1)</enum><text>with respect to subsections (b) and (c), includes recommendations for any legislative changes needed to improve the implementation of those subsections;</text>
 </paragraph><paragraph id="id76B699FC7C444684890A5F177ED3AB35"><enum>(2)</enum><text>with respect to subsection (b), includes—</text> <subparagraph id="id6338136D39F8493390E55B04A1C0342B"><enum>(A)</enum><text>a detailed description of how applications for cooperative agreements under paragraph (4) of that subsection will be solicited and evaluated, including—</text>
 <clause id="idD71F380C8EB54F9B96C8445DF4CA63D8"><enum>(i)</enum><text>a list of any activities carried out by the Secretary to solicit or evaluate applications; and</text>
 </clause><clause id="id2202EAAECBC6433587D35ADC532EF09C"><enum>(ii)</enum><text>a process for ensuring that any projects carried out under a cooperative agreement are designed to result in the development or demonstration of qualifying technologies;</text>
 </clause></subparagraph><subparagraph id="id1C4FE3C9F2284A40B071A27396715EE7"><enum>(B)</enum><text>a detailed list of technical milestones for each qualifying technology pursued under that subsection;</text>
 </subparagraph><subparagraph id="idBFDDE3D132FC4826A310E2E60DFAB48A"><enum>(C)</enum><text>a detailed description of how each project carried out pursuant to a cooperative agreement under paragraph (4) of that subsection will meet the milestones for carbon capture described in the September 2017 report of the Office of Fossil Energy entitled <quote>Accelerating Breakthrough Innovation in Carbon Capture, Utilization, and Storage</quote>; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFFD45BBC5C134BDF96BD681098A4D3B7"><enum>(D)</enum><text>an affirmation from the Secretary that all recipients of funding under that subsection are eligible entities; and</text>
 </subparagraph></paragraph><paragraph id="idC6483F5C97114A18B5DABA4C6EFB4F94"><enum>(3)</enum><text>with respect to the demonstration program established under subsection (c), includes—</text> <subparagraph id="idDDD17F8D66384005B3611E34B4D6F5B7"><enum>(A)</enum><text>an estimate of the cost of licensing, permitting, constructing, and operating each carbon capture facility expected to be constructed under that demonstration program;</text>
 </subparagraph><subparagraph id="idead138e3091a4d1599263c49b49804cd"><enum>(B)</enum><text>a schedule for—</text> <clause id="id75c26bbab61445a3a4433edf8575e1a6"><enum>(i)</enum><text>obtaining any license or permit necessary to construct and operate each carbon capture facility expected to be constructed; and</text>
 </clause><clause id="idb532d0ab7d9b490d8323137b25685cf1"><enum>(ii)</enum><text>constructing each facility; and</text> </clause></subparagraph><subparagraph id="id66d83288616c4b93a3d9f91768d354f0"><enum>(C)</enum><text>an estimate of any financial assistance, compensation, or incentives proposed to be paid by the host State, Indian Tribe, or local government with respect to each facility.</text>
 </subparagraph></paragraph></subsection><subsection id="id987ad49e4b7542be82edbba8e332fd0d"><enum>(g)</enum><header>Funding</header><text>For each of fiscal years 2020 through 2025, out of any amounts appropriated to the Department to carry out fossil energy research and development activities and not otherwise obligated, the Secretary may use to carry out this section not more than $50,000,000.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idB6AD78D566F14911B49AC6B22406366C"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 600) is amended by inserting after the item relating to section 968 the following:</text>

 <subsection id="idd480534f-070b-4049-8e13-f85086f611f8"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="id2C4010B402F143729BABED66EAF656BE"><enum>(1)</enum><header>Commercially viable technology</header><text>The term <term>commercially viable technology</term> means technology that has the potential to be successfully deployed and compete effectively in the marketplace at an appropriate size or scale.</text>
 </paragraph><paragraph id="ida9339501-8178-45f1-8124-608d0f40fc1c"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an entity that documents to the satisfaction of the Secretary that—</text> <subparagraph id="idf371e944-383f-4f5f-ab25-0907aab11016"><enum>(A)</enum><text>the entity is financially responsible; and</text>
 </subparagraph><subparagraph id="idf43a4ba8-fcc1-446c-8287-49f077874a85"><enum>(B)</enum><text>the entity will provide sufficient information to the Secretary to enable the Secretary to ensure that any funds awarded to the entity are spent efficiently and effectively.</text>
 </subparagraph></paragraph><paragraph id="id3ae505f3-1d26-43a0-9eaf-51dd3553cb55"><enum>(3)</enum><header>Natural gas</header><text>The term <term>natural gas</term> means any fuel consisting in whole or in part of—</text> <subparagraph id="id2fc46d5a-e5c0-4e1b-9ec0-40cc6d2d397d"><enum>(A)</enum><text>natural gas;</text>
 </subparagraph><subparagraph id="id48b3397f-8414-4f21-a1c7-1168760942d7"><enum>(B)</enum><text>liquid petroleum gas;</text> </subparagraph><subparagraph id="idc913d746-8fa1-4b30-bb65-37ac1edc2972"><enum>(C)</enum><text>synthetic gas derived from petroleum or natural gas liquids;</text>
 </subparagraph><subparagraph id="id7a184ea8-2826-44f1-8a68-d53fa43dd2cf"><enum>(D)</enum><text>any mixture of natural gas and synthetic gas; or</text> </subparagraph><subparagraph id="id61a12588-1af6-4f8a-8ff2-51bf3465e323"><enum>(E)</enum><text>biomethane.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide45c0087-3363-40b3-9248-555cac374856"><enum>(4)</enum><header>Natural gas-generated power</header><text>The term <term>natural gas-generated power</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id5EE5E6C1B014436B916F8086CF473803"><enum>(A)</enum><text>electric energy generated through the use of natural gas; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBC9F040B131A4DBF8A7E5EC1A6459805"><enum>(B)</enum><text>the generation of hydrogen from natural gas.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5ef3fd19-2c13-4e6f-8c87-afa4837497db"><enum>(5)</enum><header>Program</header><text>The term <term>program</term> means the program established under subsection (b)(1).</text>
							</paragraph><paragraph id="id961e132f-1a3a-42bb-b68d-da0227c156d5"><enum>(6)</enum><header>Qualifying electric generation facility</header>
 <subparagraph id="id66301790-6ae9-47e9-b27c-55b6d2acd9d8"><enum>(A)</enum><header>In general</header><text>The term <term>qualifying electric generation facility</term> means a facility that generates electric energy using natural gas as the fuel.</text> </subparagraph><subparagraph id="id4097fb67-f3b6-4c30-9b02-21e368ac18c3"><enum>(B)</enum><header>Inclusions</header><text>The term <term>qualifying electric generation facility</term> includes a new or existing—</text>
 <clause id="idd845b653-8dbe-4bc5-bccd-f0808e38d025"><enum>(i)</enum><text>simple cycle plant;</text> </clause><clause id="idd8bf1013-f5e0-469c-9ace-98201f911256"><enum>(ii)</enum><text>combined cycle plant;</text>
 </clause><clause id="id9cffca41-1446-4adf-99d5-31638ed2fbc9"><enum>(iii)</enum><text>combined heat and power plant;</text> </clause><clause id="id5CE0BB7A4F7D454FBC257A585B905334"><enum>(iv)</enum><text>steam methane reformer that produces hydrogen from natural gas for use in the production of electric energy; or</text>
 </clause><clause id="id1a7b0def-78b5-4bbd-b792-c6d6e989da42"><enum>(v)</enum><text>facility that uses natural gas as the fuel for generating electric energy.</text> </clause></subparagraph></paragraph><paragraph id="id0de2ca65-075b-4dc6-b52a-43dcce122a45"><enum>(7)</enum><header>Qualifying technology</header><text>The term <term>qualifying technology</term> means any commercially viable technology, as determined by the Secretary, for the capture of carbon dioxide produced during the generation of natural gas-generated power.</text>
							</paragraph></subsection><subsection id="id0911b8f3-21a4-4531-b261-fda1acc66dd8"><enum>(b)</enum><header>Establishment of research, development, and demonstration program</header>
 <paragraph id="id1784f8bf-820d-42f7-8d41-737c6b29a3e0"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a program of research, development, and demonstration of qualifying technologies for use by qualifying electric generation facilities.</text>
 </paragraph><paragraph id="id0728428b-7202-4318-b464-a10e0c9d6176"><enum>(2)</enum><header>Objectives</header><text>The objectives of the program shall be—</text> <subparagraph id="iddc040e29-cdc4-433f-ac46-2cfb35efbd6a"><enum>(A)</enum><text>to identify opportunities to accelerate the development and commercial applications of qualifying technologies to reduce the quantity of carbon dioxide emissions released from qualifying electric generation facilities;</text>
 </subparagraph><subparagraph id="ida6c1bfa1-05ab-44e9-9b78-276f02c9b82b"><enum>(B)</enum><text>to enter into cooperative agreements with eligible entities to expedite and carry out demonstration projects (including pilot projects) for qualifying technologies for use by qualifying electric generation facilities to demonstrate the technical and commercial viability of those qualifying technologies for commercial deployment; and</text>
 </subparagraph><subparagraph id="ide8dcdca5-8fd5-4a78-b18c-9f5c28c84204"><enum>(C)</enum><text>to identify any barriers to the commercial deployment of any qualifying technologies under development.</text>
 </subparagraph></paragraph><paragraph id="idc5cd77d2-335c-488e-afa3-a4e12e6828cd"><enum>(3)</enum><header>Participation of National Laboratories, universities, and research facilities</header><text>The program may include the participation of—</text> <subparagraph id="id00ecb842-e94d-4019-87de-b44d45c61698"><enum>(A)</enum><text>National Laboratories;</text>
 </subparagraph><subparagraph id="id529d687c-39bc-41f8-9153-d0fe40456f03"><enum>(B)</enum><text>institutions of higher education;</text> </subparagraph><subparagraph id="idba81690b-5b84-42cc-9cad-c26cf343e80c"><enum>(C)</enum><text>research facilities; or</text>
 </subparagraph><subparagraph id="id55a3d6f2-73f3-4736-89a5-2cba0a008b21"><enum>(D)</enum><text>other appropriate entities.</text> </subparagraph></paragraph><paragraph id="id954c8c7d-d89a-416e-9c0c-4152693e0b5c"><enum>(4)</enum><header>Cooperative agreements</header> <subparagraph id="id5b6f93f4-9ca8-4fc8-aa68-d3c5d385989f"><enum>(A)</enum><header>In general</header><text>In carrying out the program, the Secretary may enter into cooperative agreements with eligible entities to carry out research, development, and demonstration projects for qualifying technologies.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb20c17c7-bec1-416f-b6d5-2900abbeb30a"><enum>(B)</enum><header>Applications; proposals</header><text>An eligible entity desiring to enter into a cooperative agreement under this paragraph shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text>
								</subparagraph></paragraph></subsection><subsection id="idef5405cc-338f-48ce-9dde-df2015033342"><enum>(c)</enum><header>Carbon capture facilities demonstration program</header>
 <paragraph id="id0bc1eca6-c100-4e44-a8a9-d89ba032224c"><enum>(1)</enum><header>Establishment</header><text>As part of the program, the Secretary shall establish a demonstration program under which the Secretary shall enter into cooperative agreements with eligible entities for demonstration or pilot projects to license, permit, construct, and operate, by not later than September 30, 2025, 3 or more facilities to capture carbon dioxide from qualifying electric generation facilities.</text>
 </paragraph><paragraph id="ide027e62d-eabc-4475-9fa1-7d8200ec1f56"><enum>(2)</enum><header>Goals</header><text>Each demonstration or pilot project under the demonstration program shall—</text> <subparagraph id="id334047fd-c18d-4db2-a3e5-ac18bdcad040"><enum>(A)</enum><text>be designed to further the development of qualifying technologies that may be used by a qualifying electric generation facility;</text>
 </subparagraph><subparagraph id="id0662b38f-f4f4-4089-9395-edf4f264188c"><enum>(B)</enum><text>be financed in part by the private sector;</text> </subparagraph><subparagraph id="id69ae8837-2f42-41f0-ac7d-184a0567aec5"><enum>(C)</enum><text>if necessary, secure agreements for the offtake of the majority of the carbon dioxide emissions captured by qualifying technologies during the project; and</text>
 </subparagraph><subparagraph id="id2d5d4b64-a6b0-4224-ae86-189ea56856d9"><enum>(D)</enum><text>support energy production in the United States.</text> </subparagraph></paragraph><paragraph id="idf754bd20-7038-423a-836b-fa658601ac6e"><enum>(3)</enum><header>Request for applications</header><text>Not later than 120 days after the date of enactment of this Act, the Secretary shall solicit applications for cooperative agreements for projects—</text>
 <subparagraph id="idb55be56e-f1ae-47a4-9919-2a03e41afe4e"><enum>(A)</enum><text>to demonstrate qualifying technologies at 3 or more qualifying electric generation facilities;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbffab701-0034-487a-ab43-aac9fe9718ec"><enum>(B)</enum><text>to obtain any license or permit from a State or Federal agency that is necessary for the construction of 3 or more facilities to capture carbon dioxide from a qualifying electric generation facility; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idae480a0e-d6da-4171-9a5d-82a6f53dc9a2"><enum>(C)</enum><text>to construct and operate 3 or more facilities to capture carbon dioxide from a qualifying electric generation facility.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd6ddafae-4764-4b90-8876-0dba14693b70"><enum>(4)</enum><header>Review of applications</header><text>In reviewing applications submitted under paragraph (3), the Secretary, to the maximum extent practicable, shall—</text>
 <subparagraph id="idfc29b846-6624-4583-91ee-2442f62a7452"><enum>(A)</enum><text>ensure a broad geographic distribution of project sites;</text> </subparagraph><subparagraph id="id56a89c69-851e-46fe-91cf-1f2ac79a61ff"><enum>(B)</enum><text>ensure that a broad selection of qualifying electric generation facilities are represented;</text>
 </subparagraph><subparagraph id="id83a6ca44-ddb5-46c0-87d7-fb1220901dda"><enum>(C)</enum><text>ensure that a broad selection of qualifying technologies are represented; and</text> </subparagraph><subparagraph id="id1df83617-9338-4231-a528-ac49f36b1de2"><enum>(D)</enum><text>leverage existing—</text>
 <clause id="idc126e900-438a-40d3-8493-82e3b6aa857e"><enum>(i)</enum><text>public-private partnerships; and</text> </clause><clause id="idc9be3ac4-9d9a-4021-a26a-15c3fc4b8135"><enum>(ii)</enum><text>Federal resources.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="idaff9c3cb-0d90-479a-97dc-b503870983d5"><enum>(d)</enum><header>Cost sharing</header><text>In carrying out this section, the Secretary shall require cost sharing in accordance with section 988.</text>
 </subsection><subsection id="id632e83ad-accb-4ada-9ae6-1311e8de08b8"><enum>(e)</enum><header>Fee title</header><text>The Secretary may vest fee title or other property interests acquired under cooperative agreements entered into under subsection (b)(4) in any entity, including the United States.</text>
 </subsection><subsection id="id6d745d05-4946-4232-9911-786625fe4596"><enum>(f)</enum><header>Report</header><text>Not later than 180 days after the date on which the Secretary solicits applications under subsection (c)(3), and annually thereafter, the Secretary shall submit to the appropriate committees of jurisdiction of the Senate and the House of Representatives a report that—</text>
 <paragraph id="idf1ccb2d5-0e09-4a9e-9aba-1ded36c8025b"><enum>(1)</enum><text>with respect to subsections (b) and (c), includes recommendations for any legislative changes needed to improve the implementation of those subsections;</text>
 </paragraph><paragraph id="id03fd75c8-494b-4051-931b-cf07a0446827"><enum>(2)</enum><text>with respect to subsection (b), includes—</text> <subparagraph id="iddd9cac8a-6995-4602-aa25-9d58e73ac154"><enum>(A)</enum><text>a detailed description of how applications for cooperative agreements under paragraph (4) of that subsection will be solicited and evaluated, including—</text>
 <clause id="idaa6d4042-716a-4677-b602-3bc9e5a48860"><enum>(i)</enum><text>a list of any activities carried out by the Secretary to solicit or evaluate applications; and</text>
 </clause><clause id="idafebbb25-ac9f-4669-b64c-886caa75c4bd"><enum>(ii)</enum><text>a process for ensuring that any projects carried out under a cooperative agreement are designed to result in the development or demonstration of qualifying technologies;</text>
 </clause></subparagraph><subparagraph id="ida6fef9b2-37aa-40db-81f1-56b07eb4d8d5"><enum>(B)</enum><text>a detailed list of technical milestones for each qualifying technology pursued under that subsection;</text>
 </subparagraph><subparagraph id="id837c760c-354d-4179-b3d7-0624b4fef8db"><enum>(C)</enum><text>a detailed description of how each project carried out pursuant to a cooperative agreement under paragraph (4) of that subsection will meet the milestones for carbon capture described in the September 2017 report of the Office of Fossil Energy entitled <quote>Accelerating Breakthrough Innovation in Carbon Capture, Utilization, and Storage</quote>; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd24a8008-2ea0-40c7-a896-a2ba9c1810ce"><enum>(D)</enum><text>an affirmation from the Secretary that all recipients of funding under that subsection are eligible entities; and</text>
 </subparagraph></paragraph><paragraph id="ide7e0ad58-820f-4ec2-a336-3c5e78977299"><enum>(3)</enum><text>with respect to the demonstration program established under subsection (c), includes—</text> <subparagraph id="id45376b69-294c-44a2-8bbc-e18f94ee1a6c"><enum>(A)</enum><text>an estimate of the cost of licensing, permitting, constructing, and operating each carbon capture facility expected to be constructed under that demonstration program;</text>
 </subparagraph><subparagraph id="id0edd34fc-f4f7-4eea-8d09-c41b8409ecb1"><enum>(B)</enum><text>a schedule for—</text> <clause id="id4ca21746-79c0-4860-8ac3-8fef17f2c07b"><enum>(i)</enum><text>obtaining any license or permit necessary to construct and operate each carbon capture facility expected to be constructed; and</text>
 </clause><clause id="ida1db8183-b1f8-412e-ba93-67a8febc7a31"><enum>(ii)</enum><text>constructing each facility; and</text> </clause></subparagraph><subparagraph id="id934bd088-d2c1-4a46-a635-1cc5eff9ce79"><enum>(C)</enum><text>an estimate of any financial assistance, compensation, or incentives proposed to be paid by the host State, Indian Tribe, or local government with respect to each facility.</text>
 </subparagraph></paragraph></subsection><subsection id="ide26c4d76-5295-4f7b-94b5-e2c97579537c"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section $50,000,000 for each of fiscal years 2020 through 2025.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id7ca13c4c-886c-475f-94fc-f2a927b5329e"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 600) is amended by inserting after the item relating to section 968 the following:</text>
