 families with children under the age of 6, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="HBA3F96DDC6924D61912BA8E5B0E8D183" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lead-Safe Housing for Kids Act of 2019</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idC2A65D68C9BD4A278D08C76978DC34E6"><enum>2.</enum><header>Amendments to the Lead-Based Paint Poisoning Prevention Act</header><text display-inline="no-display-inline">Section 302(a) of the Lead-Based Paint Poisoning Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4822">42 U.S.C. 4822(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id969BD803BF6C40A5A99EF6E39733A0D5"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (4) as paragraph (5); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99F7F458CD36484FB8CFD41A22FD7298"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) the following:</text><quoted-block display-inline="no-display-inline" id="idFA3F903EC3F0464395064F3B8E4B5756" style="OLC"><paragraph id="id577375E158EA437282F8711CDCBA2C89"><enum>(4)</enum><header>Additional procedures for families with children under the age of 6</header><subparagraph id="id9E95EC34E4C8480B8E4F76696A106F71"><enum>(A)</enum><header>Risk assessment</header><clause id="id9626060FD8EB4E52A1E57B2C9094BB06"><enum>(i)</enum><header>Definition</header><text>In this subparagraph, the term <term>covered housing</term>—</text><subclause id="id666D53E82E394FB6BE2EFD4F7C7E8250"><enum>(I)</enum><text>means housing receiving Federal assistance described in paragraph (1) that was constructed prior to 1978; and</text></subclause><subclause id="id50B6670B80F44432BBCB80B11FBF5498"><enum>(II)</enum><text>does not include—</text><item id="id31016766C7DF49F891465210B8F18BA4"><enum>(aa)</enum><text>single-family housing covered by an application for mortgage insurance under the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1701">12 U.S.C. 1701</external-xref> et seq.); or</text></item><item commented="no" display-inline="no-display-inline" id="idF1E097AE0218460D825FC181F36AC5E9"><enum>(bb)</enum><text>multi-family housing that—</text><subitem commented="no" display-inline="no-display-inline" id="idA50C9DACAAD4402EBE4527D8CF66DA56"><enum>(AA)</enum><text>is covered by an application for mortgage insurance under the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1701">12 U.S.C. 1701</external-xref> et seq.); and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id2C977DD249F14ADB9AE88EF61BEFDB15"><enum>(BB)</enum><text>does not receive any other Federal housing assistance.</text></subitem></item></subclause></clause><clause id="idA8AF5DB75BA04F149E90F8C3ED3E43D5"><enum>(ii)</enum><header>Regulations</header><text>Not later than 180 days after the date of enactment of the <short-title>Lead-Safe Housing for Kids Act of 2019</short-title>, the Secretary shall promulgate regulations that—</text><subclause id="id98EDCCB321FB4E71A08929DB56B022D7"><enum>(I)</enum><text>require the owner of covered housing in which a family with a child of less than 6 years of age will reside or is expected to reside to conduct an initial risk assessment for lead-based paint hazards—</text><item id="id6513E49FCA9D4CB58BAFC7D49EDA9CBD"><enum>(aa)</enum><text>in the case of covered housing receiving tenant-based rental assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>), not later than 15 days after the date on which the family and the owner submit a request for approval of a tenancy or lease renewal, whichever occurs first;</text></item><item id="idB294D3614EFE4AF29BBDD45BD159C6AC"><enum>(bb)</enum><text>in the case of covered housing receiving public housing assistance under the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437</external-xref> et seq.) or project-based rental assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>), not later than 15 days after the date on which a physical condition inspection occurs; and</text></item><item id="idFF85EC7ADC4E477CAF747A9047E63E2B"><enum>(cc)</enum><text>in the case of covered housing not described in item (aa) or (bb), not later than a date established by the Secretary;</text></item></subclause><subclause id="id06579700F52B403B88D04B6677D7EB9D"><enum>(II)</enum><text>provide that a visual assessment alone is not sufficient for purposes of complying with subclause (I);</text></subclause><subclause id="idF0F77932910547178A13CD97F0C2236F"><enum>(III)</enum><text>require that, if lead-based paint hazards are identified by an initial risk assessment conducted under subclause (I), the owner of the covered housing shall—</text><item id="id378563DC536F49B483777BA5058964E3"><enum>(aa)</enum><text>not later than 30 days after the date on which the initial risk assessment is conducted, control the lead-based paint hazards, including achieving clearance in accordance with regulations promulgated under section 402 or 404 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2682">15 U.S.C. 2682</external-xref>, 2684), as applicable; and</text></item><item id="id1ECB7197B6DE4B14939A09ACC526AD9F"><enum>(bb)</enum><text>provide notice to all residents in the covered housing affected by the initial risk assessment, and provide notice in the common areas of the covered housing, that lead-based paint hazards were identified and will be controlled within the 30-day period described in item (aa); and</text></item></subclause><subclause id="idFA785128BCE943D69129A3EA58C5570E"><enum>(IV)</enum><text>provide that there shall be no extension of the 30-day period described in subclause (III)(aa).</text></subclause></clause><clause id="idF991E9EA8AA3481DB7FAB08EAB68CFDF"><enum>(iii)</enum><header>Exceptions</header><text>The regulations promulgated under clause (ii) shall provide an exception to the requirement under subclause (I) of such clause for covered housing—</text><subclause id="idD5E8AAC36D0E4B3F9A2F68062F0F9E3A"><enum>(I)</enum><text>if the owner of the covered housing submits to the Secretary documentation—</text><item id="id829EC24E267B4AF6BD843EB2C273EB37"><enum>(aa)</enum><text>that the owner conducted a risk assessment of the covered housing for lead-based paint hazards during the 12-month period preceding the date on which the family is expected to reside in the covered housing; and</text></item><item id="id5E078ED2B03C409680D7E5BC9B4740E4"><enum>(bb)</enum><text>of any clearance examinations of lead-based paint hazard control work resulting from the risk assessment described in item (aa);</text></item></subclause><subclause id="id6446E48AC5CC44B2A311FBEF6A76E727"><enum>(II)</enum><text>from which all lead-based paint has been identified and removed and clearance has been achieved in accordance with regulations promulgated under section 402 or 404 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2682">15 U.S.C. 2682</external-xref>, 2684), as applicable;</text></subclause><subclause id="id0F8AF1DB2BB445489D17A70C27E66415"><enum>(III)</enum><item commented="no" display-inline="yes-display-inline" id="idFCD3CF62FF334BE3A029B8E3F56B1D2A"><enum>(aa)</enum><text>if lead-based paint hazards are identified in the dwelling unit in the covered housing in which the family will reside or is expected to reside;</text></item><item id="id753B335CC3A54C2D9CF4D8873A6DB831" indent="up1"><enum>(bb)</enum><text>the dwelling unit is unoccupied;</text></item><item id="idBE3F9F2A7A1A4114A4758C866305EF40" indent="up1"><enum>(cc)</enum><text>the owner of the covered housing, without any further delay in occupancy or increase in rent, provides the family with another dwelling unit in the covered housing that has no lead-based paint hazards; and</text></item><item id="id4529912D6B3B4D92908DAA190663B927" indent="up1"><enum>(dd)</enum><text>the common areas servicing the new dwelling unit have no lead-based paint hazards; and</text></item></subclause><subclause id="id76F63B34450C4E3992E07DF6EF307FF5"><enum>(IV)</enum><text>in accordance with any other standard or exception the Secretary deems appropriate based on health-based standards.</text></subclause></clause></subparagraph><subparagraph id="id38A6B4EE72C648948BA72ED04ACB50F4"><enum>(B)</enum><header>Relocation</header><text>Not later than 180 days after the date of enactment of the <short-title>Lead-Safe Housing for Kids Act of 2019</short-title>, the Secretary shall promulgate regulations to provide that a family with a child of less than 6 years of age that occupies a dwelling unit in covered housing in which lead-based paint hazards were identified, but not controlled in accordance with regulations required under clause (ii), may relocate on an emergency basis and without placement on any waitlist, penalty (including rent payments to be made for that dwelling unit), or lapse in assistance to—</text><clause id="id876AB33E4D694DD1B9504163E341F148"><enum>(i)</enum><text>a dwelling unit that was constructed in 1978 or later; or</text></clause><clause id="id64835040EBAF49E38DB9BEA3FFCEF2FC"><enum>(ii)</enum><text>another dwelling unit in covered housing that has no lead-based paint hazards.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="H51A393EDA3BD4DA08D6F7FCEBAC65405" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out the amendments made by section two such sums as may be necessary for each of fiscal years 2020 through 2024.</text></section></legis-body></bill>
