Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide standards relating to airline travel by Federal employees for official business.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fly Smart Act</short-title></quote>.</text></section><section id="idA817B64E0500456FA6659C10BC26C14F"><enum>2.</enum><header>Airline accommodations for official Government travel</header><subsection id="id003CF8333B094476A62E36D95E26CB98"><enum>(a)</enum><header>In general</header><paragraph id="id218CFA7412834ECEA5DBBA88676DB79C"><enum>(1)</enum><header>Coach-class requirement</header><text>Except as provided in subsection (b), for official travel, both domestic and international, a covered employee, including the head of an agency, shall use coach-class accommodations.</text></paragraph><paragraph id="id33282D0325014BD3983B13C68ACD9695"><enum>(2)</enum><header>Ban on military aircraft for domestic travel</header><text>A covered employee, including the head of an agency, may not travel on a military aircraft for domestic official travel unless—</text><subparagraph id="id92258F5687C24D17834F8B992CB186A0"><enum>(A)</enum><text>the destination of the covered employee is a military installation; or</text></subparagraph><subparagraph id="idCCF7C13E1CA3493F807E2E736A572DAD"><enum>(B)</enum><text>the covered employee is serving in, or applying to, as applicable, a position in the Department of Defense.</text></subparagraph></paragraph></subsection><subsection id="idFD5CD168063444B791DC9F8DDD3DA802"><enum>(b)</enum><header>Exceptions</header><paragraph id="id86848505B5064F9ABB93DD876E3C7457"><enum>(1)</enum><header>First-class and business class</header><text>Subject to the other provisions of this subsection, the head of the agency employing a covered employee (or to which a covered employee is applying, as applicable), or in the case of the head of an agency, the White House Chief of Staff, may sign a waiver authorizing the covered employee or the agency head, as applicable, to use—</text><subparagraph id="idEE0E9CF0D4AF4443BB80E9F156CCF318"><enum>(A)</enum><text>first-class accommodations for official travel if—</text><clause id="id532DF0B022C249F0AA0F421756A9E761"><enum>(i)</enum><text>no coach-class accommodations are available on any flight that is scheduled to—</text><subclause id="idF2089C95195942018A5124E54B8FAB52"><enum>(I)</enum><text>leave not more than 24 hours before the proposed departure time of the covered employee or the agency head; or</text></subclause><subclause id="idB224F69C2CEA444D9509B5B8A04BC7C2"><enum>(II)</enum><text>arrive not more than 24 hours after the proposed arrival time of the covered employee or the agency head;</text></subclause></clause><clause id="idC5066E60B86742C1A57FDF53C4795A31"><enum>(ii)</enum><text>the use of first-class accommodations is necessary to accommodate a disability or a special need that has been certified under paragraph (4); or</text></clause><clause id="idFEC42D71391C439C9FAABE8B4B9A9CA6"><enum>(iii)</enum><text>the use of first-class accommodations is necessary because of exceptional security circumstances, which—</text><subclause id="id0220EA0C3F5A41D8BFF75675ABFD7A68"><enum>(I)</enum><text>shall be established by the individual signing the waiver;</text></subclause><subclause id="id313DAD948A1144A3B617EF8DA3E1E106"><enum>(II)</enum><text>shall be found only when required to meet the mission of the agency in which the covered employee or the agency head is employed, or to which the covered employee is applying, as applicable; and</text></subclause><subclause id="id1470517257EE4035957D1060ADF67998"><enum>(III)</enum><text>include a situation in which—</text><item id="id7C6926BE94F64AB1B55B33FFDFC82D18"><enum>(aa)</enum><text>the use of accommodations other than first-class accommodations would endanger—</text><subitem id="idEE38B3201BEF4BA59A7C8042B7036C60"><enum>(AA)</enum><text>the life of the covered employee or the agency head; or</text></subitem><subitem id="id306087995407495B81DE256E43056DA6"><enum>(BB)</enum><text>Government property;</text></subitem></item><item id="id5A4E28D09532410D8951614DA28A1892"><enum>(bb)</enum><text>the covered employee is—</text><subitem id="id8832FED547D8461ABB68BD7A8794BBA9"><enum>(AA)</enum><text>an agent on protective detail; and</text></subitem><subitem id="id48DD5A07FB5D4C2F88B7F175CA80DB58"><enum>(BB)</enum><text>accompanying an individual who is authorized to use first-class accommodations; or</text></subitem></item><item id="id833BEA4E21504A9CA96913A009CFD99A"><enum>(cc)</enum><text>the covered employee is a courier or control officer accompanying controlled pouches or packages; and</text></item></subclause></clause></subparagraph><subparagraph id="idE11599AE2D1F45749DE97A693F4FF937"><enum>(B)</enum><text>business-class accommodations for official travel if—</text><clause id="id8D8A803873064072AE23547B5999B919"><enum>(i)</enum><text>the use of business-class accommodations is necessary because of a situation described in clause (ii) or (iii) of subparagraph (A);</text></clause><clause commented="no" display-inline="no-display-inline" id="id1F772C500B1743E1BBAA04B3835D4763"><enum>(ii)</enum><text>coach-class accommodations on an authorized or approved foreign airline do not provide adequate sanitation or health standards;</text></clause><clause commented="no" display-inline="no-display-inline" id="idFFC91F46D5904EF7B09C26C3952BB831"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id6B007C66B3914AE2B0206ED686450BA5"><enum>(I)</enum><text>regularly scheduled flights between origin and destination points, including connecting points, provide only other than coach-class accommodations; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id877DE06151E74B2384B11D4940696C59" indent="up1"><enum>(II)</enum><text>the covered employee or the agency head certifies, on the voucher of the covered employee or the agency head, that the situation described in subclause (I) applies;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idAC246F5A4162451BBAF7F712CAA36D27"><enum>(iv)</enum><text>the transportation costs of the covered employee or the agency head are paid in full through the acceptance by the agency in which the covered employee or the agency head is employed, or to which the covered employee is applying, as applicable, of payment from a non-Federal source in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/4/300">chapter 300</external-xref> of title 41, Code of Federal Regulations, or any successor regulation;</text></clause><clause commented="no" display-inline="no-display-inline" id="id76B3AE64ED06496D8E27484B0878A4B9"><enum>(v)</enum><text>subject to paragraph (5), with respect to a situation in which the origin or the destination of the travel is outside the continental United States—</text><subclause commented="no" display-inline="no-display-inline" id="id7F51FE3CC1334E54B047C9B9C26F0FB0"><enum>(I)</enum><text>the scheduled flight time is more than 14 hours; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idBD1E2FBBC9B04037A33D63EC291B0C2C"><enum>(II)</enum><text>the covered employee or the agency head is required to report to duty not later than the day after the date on which the travel of the covered employee or the agency head begins;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id733C174663AC49E9A3EFD0D4DFD0C2EF"><enum>(vi)</enum><text>the use of the accommodations results in overall cost savings to the Federal Government by avoiding additional subsistence costs, overtime, or lost productive time while the covered employee or the agency head waits for coach-class accommodations to become available;</text></clause><clause commented="no" display-inline="no-display-inline" id="idB891B54DA1F44265A8AD2A2D2CED12B2"><enum>(vii)</enum><text>no space is available in coach-class accommodations in time to accomplish the mission of the agency in which the covered employee or the agency head is employed, or to which the covered employee is applying, as applicable, which is urgent and cannot be postponed; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id18B7F0A24D8C445C9E455C07463384AB"><enum>(viii)</enum><text>when required because of the mission of the agency in which the covered employee or the agency head is employed, or to which the covered employee is applying, as applicable, consistent with the internal procedures of that agency.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCB635D92E5654AAEA1905888FF6F019D"><enum>(2)</enum><header>Disclosure of cost</header><text>Not later than 90 days after the date on which official travel for which the head of an agency or the White House Chief of Staff has signed a waiver under paragraph (1) ends, the head of the agency or the White House Chief of Staff, as applicable, shall disclose on a public website—</text><subparagraph id="id1420c45b5e8b478caf6e4464ab13bb77"><enum>(A)</enum><text>the signed waiver;</text></subparagraph><subparagraph id="id5d4fd0f0eabc4ca5b87f0ea317503b10"><enum>(B)</enum><text>the exception under that paragraph on which the head of the agency or the White House Chief of Staff relied when authorizing the travel; and</text></subparagraph><subparagraph id="id475840c63cdd4069bf9f6e5e5c50ba4e"><enum>(C)</enum><text>the cost of any flight in other than coach-class accommodations with respect to the waiver.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id00EDBB4DF62D497690A91F1E0AB0AA4B"><enum>(3)</enum><header>No blanket approval</header><text>The head of the agency employing a covered employee (or to which a covered employee is applying, as applicable), or in the case of the head of an agency, the White House Chief of Staff, may authorize a covered employee or an agency head, as applicable, to use accommodations other than coach-class accommodations for official travel only on a case-by-case basis, unless the covered employee or the agency head has a disability or a special need that has been certified under paragraph (4).</text></paragraph><paragraph id="id81C42445330A465EB1D24A9A5A603D7A"><enum>(4)</enum><header>Certification of disability or special need</header><subparagraph id="id8FCD9C0C66A14B7B9775DB53410B0CAE"><enum>(A)</enum><header>Disability</header><clause id="idBDAA109B03C94BE6969090E529C7BC83"><enum>(i)</enum><header>In general</header><text>A disability described in paragraph (1)(A)(ii) shall be certified annually, unless the disability is a lifelong condition, in which case the disability shall be certified once.</text></clause><clause id="idF07FE632405D4CA18F766F041D09B6F7"><enum>(ii)</enum><header>Contents</header><text>A certification required under clause (i) shall include, at a minimum—</text><subclause id="id8B090D70B3E745939B82AD16F89CE5D4"><enum>(I)</enum><text>a written statement by a competent medical authority stating that a special accommodation for the covered employee is necessary;</text></subclause><subclause id="id1437EBAA835D4416B67E208758C3EB10"><enum>(II)</enum><text>an approximate duration of the special accommodation described in subclause (I); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id736AB9828EC14876876A65B192D3A517"><enum>(III)</enum><text>a recommendation regarding the suitable class of transportation for the covered employee based on the disability.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEC499B819DC341BEA84C1E17C62E86CC"><enum>(B)</enum><header>Special need</header><text>The special need of a covered employee, including the head of an agency, described in paragraph (1)(A)(ii) shall be certified annually (unless the special need is a lifelong condition, in which case the special need shall be certified once) in accordance with the procedures of the agency in which the covered employee is employed, or to which the covered employee is applying, as applicable.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC8DCC0C1158F47C987E7FD84272D595A"><enum>(5)</enum><header>Application of 14-hour rule</header><text>A covered employee, including the head of an agency, who travels using business-class accommodations under paragraph (1)(B)(v) shall not be eligible for a rest stop on the way to, or upon arrival at, the duty site of the covered employee.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFCECC7D6863A4ED18FD4802C5EE21448"><enum>(6)</enum><header>Inclusion of attendant</header><text>If a covered employee, including the head of an agency, the travel of whom in accommodations other than coach-class accommodations is authorized because of a disability or special need that is certified under paragraph (4), is authorized to have an attendant accompany that covered employee, the head of the agency employing the covered employee (or to which a covered employee is applying, as applicable), or in the case of the head of an agency, the White House Chief of Staff, may also authorize the attendant to use other than coach-class accommodations during that travel.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFDCF97B3ECBF4799A9BFDE229F2FF775"><enum>(7)</enum><header>Limit on delegation</header><text>The head of an agency and the White House Chief of Staff may not delegate the duties and authorities under this subsection, except for the duties and authorities under paragraph (2).</text></paragraph></subsection><subsection id="idBF3AA544F19E4988B31FA03DA88497E8"><enum>(c)</enum><header>Rules of construction</header><paragraph id="id3779DA72A887442CAABA2E9D16BEE953"><enum>(1)</enum><header>Upgrades</header><text>Nothing in this section may be construed to prevent a covered employee from upgrading to first-class accommodations or business-class accommodations for official travel at the personal expense of the covered employee, including through the redemption by the covered employee of frequent flyer benefits.</text></paragraph><paragraph id="id45EF201485414F7497FC296CB008FE74"><enum>(2)</enum><header>Two cabins available</header><subparagraph id="idC00D92F3557D477DA65A0A1DD0E2A88A"><enum>(A)</enum><header>Different seat types</header><text>If an airline flight has 2 classes of accommodations available with 2 distinctly different seating types (including a situation in which the girth and pitch of the seats between the 2 cabins are different), the airline terms the front cabin as business-class accommodations or higher, and the tickets for the flight are fare-coded as business-class accommodations, the front cabin shall be construed to be other than coach-class accommodations for the purposes of this section.</text></subparagraph><subparagraph id="id791660EEAD7547C0B829FCAC67ED72F2"><enum>(B)</enum><header>Identical seat types</header><text>If an airline flight has 2 cabins available with 1 type of seating available for the entire aircraft (such that the girth and pitch of the seats are identical in both cabins), the seats in the front cabin are fare-coded as full-fare economy class, and only restricted economy fares are available in the rear cabin, the entire aircraft shall be construed to be coach-class accommodations for the purposes of this section.</text></subparagraph></paragraph></subsection></section><section id="id07D6E7FE18654DDD8704E254CDC57943"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="idADE1A57690A0479E8F91B43923BAD905"><enum>(1)</enum><text>the term <term>agency</term> has the meaning given the term <term>Executive agency</term> in section 105 of title 5, United States Code;</text></paragraph><paragraph id="id05BB946DFA84472DA5EEE70BE6A2AC3B"><enum>(2)</enum><text>the term <term>business-class accommodations</term> means a premium class of accommodation offered by an airline that—</text><subparagraph id="idA4028BA8719E4716A35DDD68B895A21D"><enum>(A)</enum><text>is more expensive, and offers more amenities, than coach-class accommodations;</text></subparagraph><subparagraph id="id51340518C27E4C6380C44DDD56F5F9A0"><enum>(B)</enum><text>is less expensive, and offers fewer amenities, than first-class accommodations; and</text></subparagraph><subparagraph id="idFCD11797FBC34BEB969F8257A72CBE9E"><enum>(C)</enum><text>is occasionally described by the airline using terms including <quote>business</quote>, <quote>business elite</quote>, <quote>business first</quote>, <quote>world business</quote>, <quote>connoisseur</quote>, and <quote>envoy</quote>;</text></subparagraph></paragraph><paragraph id="idC98A40D3EE7F473795F8F54DAFAA056B"><enum>(3)</enum><text>the term <term>coach-class accommodations</term>—</text><subparagraph id="idA08CC25C6A704927BF02AE8214017429"><enum>(A)</enum><text>means the basic class of accommodation offered to a traveler on an airline and which is normally the lowest fare offered by the airline, without regard to the terminology used to describe the accommodations; and</text></subparagraph><subparagraph id="id0328D698C13C435B9C80846F38B42462"><enum>(B)</enum><text>is occasionally described by an airline using terms including—</text><clause id="id3F82D1F9245C498CB9243FB97602564D"><enum>(i)</enum><text><quote>tourist class</quote> or <quote>economy-class</quote>; and</text></clause><clause id="idBEECD4273C33410AA21CD310CE333612"><enum>(ii)</enum><text><quote>single class</quote> if the airline offers 1 class of accommodations to all travelers;</text></clause></subparagraph></paragraph><paragraph id="idFCF8B54A49204C86BA52E0E3428D8809"><enum>(4)</enum><text>the term <term>covered employee</term> means—</text><subparagraph id="id8051AF3DB8674E6BB95548BFF47DA713"><enum>(A)</enum><text>an employee traveling on official business;</text></subparagraph><subparagraph id="id34EEFBF990F840818CE5B2F77FBD53AE"><enum>(B)</enum><text>an individual who is—</text><clause id="idC433D17BB85D4F528F7C41D29DC1FFE2"><enum>(i)</enum><text>interviewing for a position as an employee; and</text></clause><clause id="id0442B5B20494498CB56A12E61727984D"><enum>(ii)</enum><text>performing pre-employment interview travel;</text></clause></subparagraph><subparagraph id="id3C3A08235CD84D619B0D7FF93E1ED8F4"><enum>(C)</enum><text>an employee who is required to interrupt the official business travel of the employee to perform emergency travel as a result of—</text><clause id="id41DA4D883E914700B252D2EEFB2B81F1"><enum>(i)</enum><text>an incapacitating illness or injury; or</text></clause><clause id="id66E7B5063F904DDE91710616C009FBFE"><enum>(ii)</enum><text>a personal emergency situation; or</text></clause></subparagraph><subparagraph id="id7752C33253CA4D029BF430C157880374"><enum>(D)</enum><text>an employee who—</text><clause id="idBB181649E38C4210896562E4DEB2E8C8"><enum>(i)</enum><text>is employed in a law enforcement or investigative capacity; and</text></clause><clause id="id0B8C60EAF2554A99B07E5D0A0F1DB244"><enum>(ii)</enum><text>along with the family members of the employee, is required to relocate temporarily to safeguard the life of the employee, and any family members of the employee, as applicable, because of a threat resulting from the assigned duties of the employee;</text></clause></subparagraph></paragraph><paragraph id="idADF9C7B5430C42178F885F485ACEED22"><enum>(5)</enum><text>the term <term>employee</term> means an individual employed in or under an agency, including an individual employed intermittently in the Government service as an expert or consultant and paid on a daily when-actually-employed basis and an individual serving without pay or at $1 a year;</text></paragraph><paragraph id="id44CA9FE493FC4699B6B0121E87C417D9"><enum>(6)</enum><text>the term <term>first-class accommodations</term> means the highest class of accommodation offered by an airline with respect to cost and amenities;</text></paragraph><paragraph id="id1C957506F8564AE7B47E1BB230B7EB25"><enum>(7)</enum><text>the term <term>other than coach-class accommodations</term>—</text><subparagraph id="id3EF41FE2F3704A2A852CCD11963AEF80"><enum>(A)</enum><text>means any class of accommodation above coach-class accommodations; and</text></subparagraph><subparagraph id="id3D53B5CC50E8455CA361252125035F55"><enum>(B)</enum><text>includes first-class accommodations and business-class accommodations; and</text></subparagraph></paragraph><paragraph id="id98F2DB54D3384FBAB96B7DEB36FFA74A"><enum>(8)</enum><text>the term <term>scheduled flight time</term>—</text><subparagraph id="idBFB6BB8E4D2B4E59819181D844547F9C"><enum>(A)</enum><text>with respect to air travel, means the flight time between the originating departure point of the travel and the ultimate arrival point of the travel;</text></subparagraph><subparagraph id="id25B826679B6845C0BA85D5AF6B557F2D"><enum>(B)</enum><text>includes scheduled non-overnight time spent at an airport during a change of planes; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8A3E8C11B47E440BB58A1840D8A9DC55"><enum>(C)</enum><text>does not include time spent at the originating or ultimate arrival airport.</text></subparagraph></paragraph></section></legis-body></bill>
