			 assistants under the Medicare program, and for other purposes.</official-title></form>
	<legis-body>
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Access to Radiology Care Act of 2019</short-title></quote>.</text>
		</section><section id="id81cc432a451f4e9aa0385426f42643db"><enum>2.</enum><header>Medicare payment for radiologist assistant services</header>
 <subsection id="idbd87b862d8844056b6d5e6cb89396d63"><enum>(a)</enum><header>Coverage</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text> <paragraph id="id849bcb667fa24d3b8f6fea18cc52aa48"><enum>(1)</enum><text>in subsection (s)(2)(K)—</text>
 <subparagraph id="idba992eebb8ac4f3f93414b837984cafc"><enum>(A)</enum><text>by striking the semicolon at the end of clause (ii) and inserting a comma; and</text> </subparagraph><subparagraph id="id643ffedf12024cac836b718248fadba9"><enum>(B)</enum><text>by adding at the end the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="id52c22f7bcff748e3ae0eecac21d28d3c" style="OLC">
 <clause id="id4d22d5d6369241ed9d1e6606942f221e"><enum>(iii)</enum><text>radiologist assistant services (as defined in subsection (kkk)(1));</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="id2bdbe903a5f149998949751f4b6680d6"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>
 <quoted-block display-inline="no-display-inline" id="id22BE228A6538451FADFD35C6629E3EA3" other-style="archaic" style="other"><subsection id="id8FE4C49181734637AE501B03DD9F8E49"><enum>(kkk)</enum><header>Radiologist Assistant Services; Radiologist Assistant</header><paragraph commented="no" display-inline="yes-display-inline" id="id62920EF4AFD149C8A6909D5A5666919F"><enum>(1)</enum><text>The term <term>radiologist assistant services</term> means services—</text> <subparagraph id="idE80E8824197F4DB59BBA868FD7E84B52" indent="up1"><enum>(A)</enum><text>performed by a radiologist assistant (as defined in paragraph (2)) under the supervision of a radiologist as an employee, leased employee, or independent contractor of the supervising radiologist; and</text>
 </subparagraph><subparagraph id="idC24D1049CBC34F66A7891BD9DD436A92" indent="up1"><enum>(B)</enum><text>which the radiologist assistant is legally authorized to perform under State law (or the State regulatory mechanism provided by State law).</text>
 </subparagraph></paragraph><paragraph id="id4F509167DB914875B1466C0CF312D744" indent="up1"><enum>(2)</enum><text>The term <term>radiologist assistant</term> means a radiographer who is certified by the American Registry of Radiologic Technologists as a registered radiologist assistant or by the Certification Board for Radiology Practitioner Assistants as a radiology practitioner assistant to perform radiologic procedures under the supervision of a radiologist.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id12341bc7f04b460fa6675cc8138cb5f3"><enum>(b)</enum><header>Payment in relation to physician fee schedule</header>
 <paragraph id="id7dfc23b0316c49d0a20b0efaa7860313"><enum>(1)</enum><header>Payment level</header><text>Section 1833(a)(1)(O) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)(O)</external-xref>) is amended by inserting <quote>, or radiologist assistant services</quote> after <quote>or clinic nurse specialists</quote>.</text> </paragraph><paragraph id="idcaebd5eaebe748e9bad95cdae4a58386"><enum>(2)</enum><header>Application of fee schedule in hospital, ambulatory surgical center settings</header><text>Section 1848(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="id7464c2f3d1644515a1200981ed70ffb4" style="OLC">
						<paragraph id="iddaedd34742af431b82e8ec25c68172dd"><enum>(10)</enum><header>Application of fee schedule for radiologist assistant services in hospital, ambulatory surgical
			 center settings</header>
 <subparagraph id="id4ce6823aeaf44077aacd1bc516a4dcc0"><enum>(A)</enum><header>In general</header><text>In the case of radiologist assistant services (as defined in section 1861(kkk)(1)) furnished in a facility setting (as defined in subparagraph (B)), payment for such services furnished in such setting shall be made to the supervising radiologist in an amount determined pursuant to section 1833(a)(1)(O).</text>
 </subparagraph><subparagraph id="id7b5203fce8764f13ae1709697775a25b"><enum>(B)</enum><header>Facility setting defined</header><text>In this paragraph, the term <term>facility setting</term> means—</text> <clause id="id2f77096c35e848019c0a1604d8ffabb7"><enum>(i)</enum><text>a hospital or critical access hospital;</text>
 </clause><clause id="id3bb15edbf1ce4c9a9aefcfb067cb4fdb"><enum>(ii)</enum><text>an ambulatory surgical center; and</text> </clause><clause id="id49bf439404934e74a41fa873fd2c67d3"><enum>(iii)</enum><text>such other providers of services as the Secretary may specify.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id79f1f35ad1664b20aa59c89d62c7839c"><enum>(3)</enum><header>Payment to supervising radiologist</header><text>The first sentence of section 1842(b)(6) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(b)(6)</external-xref>) is amended—</text> <subparagraph id="ide4f5445bd12c4420bfd6a973684e0261"><enum>(A)</enum><text>by striking <quote>and</quote> before <quote>(J)</quote>; and</text>
 </subparagraph><subparagraph id="id298c9c623f5047debddc15c12f921480"><enum>(B)</enum><text>by inserting before the period at the end the following: <quote>, and (K) in the case of services described in clause (iii) of section 1861(s)(2)(K) (relating to radiologist assistant services), payment shall be made to the supervising radiologist</quote>.</text>
 </subparagraph></paragraph><paragraph id="id0bac13a490794c8aab200c74a1cc1d29"><enum>(4)</enum><header>Rules of construction</header><text>Nothing in this section, or the amendments made by this section, shall be construed as affecting—</text> <subparagraph id="id8af1ce04a7d14160b881616aaf35d6e6"><enum>(A)</enum><text>coverage of and payment for the technical component (including the technical component of a global fee) with respect to imaging services under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.) as in effect before the date of the enactment of this Act;</text>
 </subparagraph><subparagraph id="idc19c942b4db7421089a1c96c19188441"><enum>(B)</enum><text>the amount of payment made for physicians’ services under such title when furnished solely by a radiologist; or</text>
 </subparagraph><subparagraph id="idff912656b362496d86adcb1b197fb2f7"><enum>(C)</enum><text>the amount of payment made under such title for services furnished by a hospital, critical access hospital, ambulatory surgical center, or any other facility setting specified by the Secretary under section 1848(a)(10)(B)(iii) of the Social Security Act (as added by paragraph (3)), as the case may be.</text>
 </subparagraph></paragraph></subsection><subsection id="id4de3885895f2476bb341365b336e9498"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to services furnished on or after January 1, 2020.</text></subsection></section></legis-body></bill>
