which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To increase the minimum age for sale of tobacco products to 21.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tobacco-Free Youth Act</short-title></quote>.</text></section><section id="id2D1A197E17F148F998D939762A0BD630"><enum>2.</enum><header>Minimum age of sale of tobacco products</header><subsection id="id33537EA1DF4E470A81403FFB6C9465B8"><enum>(a)</enum><header>Establishing minimum age of 21 for sale of tobacco products</header><text display-inline="yes-display-inline">Section 1926 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-26">42 U.S.C. 300x–26</external-xref>) is amended—</text><paragraph id="id2FB93C081AB64B9181FB55200DF8A51A"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">age of 18</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">age of 21</header-in-text></quote>;</text></paragraph><paragraph id="id0D128565CC7449DF9405C081582713CB"><enum>(2)</enum><text>by striking <quote>age of 18</quote> each place such phrase appears and inserting <quote>age of 21</quote>;</text></paragraph><paragraph id="id68083837CC1845B3B0B315D73B73B2CC"><enum>(3)</enum><text>in subsection (a)—</text><subparagraph id="id8A67479CDC3042BF8911F0C8C8B5A017"><enum>(A)</enum><text>in paragraph (1), by striking <quote>fiscal year 1994</quote> and inserting <quote>fiscal year 2021</quote>; and</text></subparagraph><subparagraph id="id9356E696B863497095C17C2CEBA50380"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idDD6E16201E6A4949B0AD8D54E6CF7CAC"><enum>(i)</enum><text>by striking <quote>fiscal year 1993</quote> and inserting <quote>fiscal year 2020</quote>;</text></clause><clause id="id70C7B242888D473CA469EAD222039AA7"><enum>(ii)</enum><text>by striking <quote>fiscal year 1994</quote> and inserting <quote>fiscal year 2021</quote>; and</text></clause><clause id="id2754667DC95346D68F6B43FC4788B832"><enum>(iii)</enum><text>by striking <quote>fiscal year 1995</quote> and inserting <quote>fiscal year 2022</quote>; and</text></clause></subparagraph></paragraph><paragraph id="id476E2660EE724607A9B2F111E2483A4F"><enum>(4)</enum><text>in subsection (d)—</text><subparagraph id="id2D0FCE2F7CEF495BBC10A71869FD6782"><enum>(A)</enum><text>in paragraph (1), by striking <quote>1995</quote> and inserting <quote>2022</quote>;</text></subparagraph><subparagraph id="idC7423EE0BDE74B689F3D92812AF8D967"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idBA8D7AEBF05F43F0B30276A6D2250D01"><enum>(i)</enum><text>by striking <quote>1994</quote> and inserting <quote>2021</quote>; and</text></clause><clause id="idD1D23B265F4847819FA32E150962131F"><enum>(ii)</enum><text>by striking the period and inserting <quote>; and</quote>;</text></clause></subparagraph><subparagraph id="idDCAA9232ABFE4CC4AE8926D845DF2080"><enum>(C)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and adjusting the margins accordingly;</text></subparagraph><subparagraph id="id0E4EEFEDF7734D3A91A17BA61FA0AAD5"><enum>(D)</enum><text>by striking <quote>this section, the term</quote> and inserting “this section—</text><quoted-block display-inline="no-display-inline" id="id210CBEE24D494BB5BC129CEDBECB8305" style="OLC"><paragraph id="id5BB32D515BBB4BC9917EFDDA4C3E1B73"><enum>(1)</enum><text>the term</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idBDC854F7F09C4AD3B7F63FF2B04F029E"><enum>(E)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id638692FC3BF44D758624A276E9641A1F" style="OLC"><paragraph id="id2CE070032C564FC1B4379749144B8591"><enum>(2)</enum><text>the term <term>tobacco product</term> has the meaning given such term in section 201(rr) of the Federal Food, Drug, and Cosmetic Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id0F86723B2DFB4FF7BB88E25A0000DCEA"><enum>(b)</enum><header>FDA</header><paragraph id="idD6740ED018E24BCBBBF84DEC229110AA"><enum>(1)</enum><header>In general</header><text>Section 906(d) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387f">21 U.S.C. 387f(d)</external-xref>) is amended—</text><subparagraph id="id7C1F504D1CBA41D391EC4A216DE6B248"><enum>(A)</enum><text>in paragraph (3)(A)(ii), by striking <quote>18 years</quote> and inserting <quote>21 years</quote>; and</text></subparagraph><subparagraph id="id2F5E50C0D61B4E82AF8D884587CDE382"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idBA04799AA13D4D548A1CEFE07DC3C217" style="OLC"><paragraph id="id153AF5FD39154A77AC9DD51D790117E7"><enum>(5)</enum><header>Minimum age of sale</header><text>It shall be unlawful for any retailer to sell a tobacco product to any person younger than 21 years of age, consistent with section 1140.14 of title 21, Code of Federal Regulations (or any successor regulations).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id2498F482DFA6492C9C5FA1D8A1C4EC3C"><enum>(2)</enum><header>Regulations</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Health and Human Services shall update regulations issued under chapter IX of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/387">21 U.S.C. 387</external-xref> et seq.) as appropriate to carry out the amendments made by paragraph (1).</text></paragraph></subsection><subsection id="idEBA710CBD7F14D90BA89219A6AEF86C6"><enum>(c)</enum><header>Non-Preemption</header><text>Nothing in the amendments made by subsection (a) or (b) shall be construed to prevent a State or local governmental entity from establishing, enforcing, or maintaining a law with respect to sales of tobacco products to individuals below a minimum age, provided that such State or local law is in addition to, or more stringent than, Federal law.</text></subsection></section></legis-body></bill>
