			 of broadband services to all areas of the United States, and for other
 purposes.</official-title></form><legis-body><section id="id148b71b50a0d48919c4fecc278591da1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Broadband Data Improvement Act of 2019</short-title></quote>.</text></section><section id="id62328b86b1c246789dc5aab3d8f87ff2"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id70d206fe0bc2454ebe44120d11b96f1e"><enum>(1)</enum><header>Broadband internet access service</header><text>The term <term>broadband internet access service</term> has the meaning given the term in section 8.1 of title 47, Code of Federal Regulations, or any successor regulation.</text></paragraph><paragraph id="idEEE4B38934054915B65F67F695E2C0A3"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph id="id234B7A27BA1C4B3A9BFD5949246AB1E2"><enum>(3)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> means—</text><subparagraph id="id555E7C7715B04D708214E30BFF4149C9"><enum>(A)</enum><text>the Commission;</text></subparagraph><subparagraph id="idEF14210D8EA04789A368E84789862F16"><enum>(B)</enum><text>the Department of Agriculture;</text></subparagraph><subparagraph id="id0925432407924FFE81A67A20B2D249E4"><enum>(C)</enum><text>the Department of Commerce;</text></subparagraph><subparagraph id="idEE86CA716E8940A5B5449ACFD82E8FA8"><enum>(D)</enum><text>the Department of the Interior;</text></subparagraph><subparagraph id="idE045265FBE6D4D71AE70AA5D8F4F6FCB"><enum>(E)</enum><text>the Federal Trade Commission;</text></subparagraph><subparagraph id="id110EE65ABF1746379672C90685E78107"><enum>(F)</enum><text>the National Economic Council; and</text></subparagraph><subparagraph id="id940C53758052457AAC93B9970901E9B7"><enum>(G)</enum><text>the Office of Science and Technology Policy.</text></subparagraph></paragraph><paragraph id="id71bc516814d54bcdaf74d8826377049c"><enum>(4)</enum><header>Form 477</header><text>The term <term>Form 477</term> means Form 477 of the Commission relating to local telephone competition and broadband reporting.</text></paragraph><paragraph id="idcd311312b312434a82d3d1cba16cfc14"><enum>(5)</enum><header>National broadband map</header><text>The term <term>National Broadband Map</term> means the map developed and maintained by the Commission with respect to the availability of broadband internet access service.</text></paragraph><paragraph id="id130b1c04161f46b4a451d3f014dd06a8"><enum>(6)</enum><header>Propagation model</header><text>The term <term>propagation model</term> means an empirical mathematical formulation for the characterization of radio wave propagation as a function of frequency, distance, and other conditions.</text></paragraph><paragraph commented="no" id="id688B5A731D1C4D63AA7B21D3407702E0"><enum>(7)</enum><header>Provider</header><text>The term <term>provider</term> means a provider of broadband internet access service.</text></paragraph><paragraph id="id5a86a1b03800407580b9642ed5cb7888"><enum>(8)</enum><header>Shapefile</header><text>The term <term>shapefile</term> means a digital storage format containing geospatial or location-based data and attribute information—</text><subparagraph id="id37F7707AAE0F4078B95E9408E4E64CB6"><enum>(A)</enum><text>regarding the availability of broadband internet access service; and</text></subparagraph><subparagraph id="id4DC2A7AE615B4377898297052D9DA745"><enum>(B)</enum><text>that can be viewed, edited, and mapped in geographic information system software.</text></subparagraph></paragraph><paragraph id="id0ff2115fd80c428d98d12bc36318221c"><enum>(9)</enum><header>Standard broadband installation</header><text>The term <term>standard broadband installation</term>—</text><subparagraph id="idE5F705ECD6E44032BEEF5921B5C64BA1"><enum>(A)</enum><text>means the initiation of new wireline broadband internet access service with no charges or delays attributable to the extension of the network of the provider; and</text></subparagraph><subparagraph id="idC8B467D28EE544EFA3F64A806C6FA861"><enum>(B)</enum><text>includes the initiation of service that requires only routine installation that can be completed not later than 10 business days after the date on which the service request is submitted.</text></subparagraph></paragraph><paragraph id="id417748e5143649e3a30db5c76659e8a9"><enum>(10)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text></paragraph></section><section id="ide8458b32c9154c92ac87931b12674727"><enum>3.</enum><header>New data submission and public feedback processes</header><subsection id="id5fdcc6c715e542ec9abb59bd4d87d007"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Commission shall issue a rule to establish—</text><paragraph id="id7d3eba1587ca4261a5ae7f498bf220e6"><enum>(1)</enum><text>a reporting requirement under which each provider shall, not less frequently than biannually, submit to the Commission accurate and granular information regarding the geographic availability of broadband internet access service provided by the provider; and</text></paragraph><paragraph id="id729edb85fc09454a9389769395e32917"><enum>(2)</enum><text>a framework for an ongoing challenge process through which a provider or a member of the public may submit information challenging the accuracy of the information reflected on the National Broadband Map.</text></paragraph></subsection><subsection id="id55f227e1c9234f54afbd7f53d3a01199"><enum>(b)</enum><header>Reporting requirement conditions</header><text>The reporting requirement established by the Commission under subsection (a)(1) shall—</text><paragraph id="ida3077acaafa34cf4b4b4aaef890014f9"><enum>(1)</enum><text>require information regarding the service area of each provider to be—</text><subparagraph id="id94dc7cba906d4f468119f6b0d6fd2943"><enum>(A)</enum><text>submitted in shapefile format, or another geospatial format as the Commission may prescribe, to achieve the level of reporting specificity required under paragraph (2) of this subsection; and</text></subparagraph><subparagraph id="ida3b5575951974c039b83469410bf7d5a"><enum>(B)</enum><text>before making each submission required under subsection (a)(1), certified—</text><clause id="idB5B4724767BF4D4DADDA4703AD57C68D"><enum>(i)</enum><text>as adhering to such reporting standards as the Commission may prescribe;</text></clause><clause id="idE31DC58591454D2599A2690B08D71982"><enum>(ii)</enum><text>on a form to be prescribed by the Commission; and</text></clause><clause id="idCBAE1BD7217B4700A83383F2C931B4DA"><enum>(iii)</enum><text>by an officer of the provider;</text></clause></subparagraph></paragraph><paragraph id="id437482953c344d2ba44d67b54cd4ebf5"><enum>(2)</enum><text>allow for an understanding by the Commission and the general public of speeds and service delivery types of broadband internet access service that are available through—</text><subparagraph id="id0fdde8c0c5cc4642ba369d6d18a97a2a"><enum>(A)</enum><text>a standard broadband installation for fixed wireline services; and</text></subparagraph><subparagraph id="id340813ebb80f41b0a3e5764b95a56ff2"><enum>(B)</enum><text>standardized and tested propagation models with respect to—</text><clause id="idf8d67e1b35724ef599ac72e87aa71fa9"><enum>(i)</enum><text>fixed wireless and satellite services; and</text></clause><clause id="id55285d3814af46ffa3c6f25531bf453a"><enum>(ii)</enum><text>mobile services, with defined factors for signal strength, cell edge probability, and cell loading;</text></clause></subparagraph></paragraph><paragraph id="idfe110da629bb4a5d928c6143f2fe9f40"><enum>(3)</enum><text>define uniform mandatory standards for the reporting of broadband internet access service coverage for each delivery type with respect to broadband internet access service in order to—</text><subparagraph id="id1ADC405ED05449DD878CB4082B554887"><enum>(A)</enum><text>ensure the accuracy and granularity of the data submitted; and</text></subparagraph><subparagraph id="idEF002AA70E40408E8BA22D192260CDD6"><enum>(B)</enum><text>require each provider to employ consistent reporting methods across all States in which the provider provides service;</text></subparagraph></paragraph><paragraph id="ida400fad7c4c44bcaaeef9b25d78a6d6d"><enum>(4)</enum><text>update or replace the Form 477 broadband deployment service availability data collection process of the Commission; and</text></paragraph><paragraph id="id6DBF72E3E6CE408093503EABB6654C83"><enum>(5)</enum><text>eliminate all duplicative reporting requirements and procedures regarding the availability of broadband internet access service that are in existence as of the date on which the Commission establishes the requirement.</text></paragraph></subsection><subsection id="idcc34f5153a13406ba3964db294418d5a"><enum>(c)</enum><header>Challenge process conditions</header><text>The framework for the challenge process established by the Commission under subsection (a)(2) shall include an ongoing schedule for the periodic—</text><paragraph id="id5819f9b505114b6d96f756dbe6b3ba8b"><enum>(1)</enum><text>receipt, analysis, and resolution of feedback received through the process; and</text></paragraph><paragraph id="idc5206664ac634a19af0180e66fcb6b8a"><enum>(2)</enum><text>updating of the National Broadband Map, which shall be completed—</text><subparagraph id="idA15B6812F8B84958BEA6D8873FC5596D"><enum>(A)</enum><text>in an expeditious manner; and</text></subparagraph><subparagraph id="id5861D71C2A78404680DC7E20FA2C89B2"><enum>(B)</enum><text>in response to the feedback described in paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="id6c0f320482594f048402c075216b5075"><enum>(d)</enum><header>National Broadband Map</header><paragraph id="id8D331BFE3F5F4772B0606EF2180BD6E4"><enum>(1)</enum><header>In general</header><text>Subject to feedback received through the challenge process, the framework for which is established under subsection (a)(2), a Federal agency shall use the National Broadband Map to determine—</text><subparagraph id="id1410873E85FB4F91ACEC22F5FE55FE99"><enum>(A)</enum><text>the extent of the availability of broadband internet access service; and</text></subparagraph><subparagraph id="id94DE95CFF55641C3876F22EDE1FEDCC3"><enum>(B)</enum><text>the areas of the United States that remain unserved by providers.</text></subparagraph></paragraph><paragraph id="id014d0d40ba1f408d8613cc827b8f77f5"><enum>(2)</enum><header>Challenge notice of opportunity</header><text>Before awarding funding that supports the development of broadband internet access services and that is based on the information reflected on the National Broadband Map, a Federal agency shall provide notice of an opportunity for public feedback to challenge or update the information on the map that—</text><subparagraph id="id671073f5f87b47b198559bdf89bbe046"><enum>(A)</enum><text>aligns with the schedule established under subsection (c); or</text></subparagraph><subparagraph id="id193c0a71889346c38cf388e612ca13ee"><enum>(B)</enum><text>provides a separate public feedback opportunity under rules that may be established by the Federal agency.</text></subparagraph></paragraph></subsection></section><section id="idbca9a2d5af5846fab5bc05f49f199122"><enum>4.</enum><header>Data validation and submission assistance</header><subsection id="ida3ebda1d965444a98e45af28c9198f71"><enum>(a)</enum><header>Selected provider</header><paragraph id="id850A4BFF77A84FADA2F0E8DD88022CCA"><enum>(1)</enum><header>Selection of provider</header><subparagraph id="id0FD4CD69D8B44BBDA013C2123C0A94C9"><enum>(A)</enum><header>In general</header><text>The Commission shall use competitive procedures to enter into a contract with an entity to provide the services described in paragraph (2).</text></subparagraph><subparagraph id="idAA42245431F843FFB613621052B91039"><enum>(B)</enum><header>Commission discretion</header><text>The Commission may—</text><clause id="id9D267621A568452BB8CE2DA6C0AB9A63"><enum>(i)</enum><text>determine—</text><subclause id="idE5AEBB5058E8443385A41DA954A6DA06"><enum>(I)</enum><text>the period in which an entity selected under subparagraph (A) shall serve in that capacity; and</text></subclause><subclause id="idF138DFCE2F0C4EAFA8001B95C23508EB"><enum>(II)</enum><text>whether to grant an extension with respect to the period described in subclause (i), including the length of that extension; and</text></subclause></clause><clause id="id9D44742E3FE541A3BE70FDBF1B38DBBF"><enum>(ii)</enum><text>with respect to the contract described in subparagraph (A), include—</text><subclause id="idEE20742A0C7E42F49164A37BAB738B26"><enum>(I)</enum><text>a provision relating to liquidated damages; and</text></subclause><subclause id="id7F2C84C1C5824493BC69EE027A1A3818"><enum>(II)</enum><text>any other reasonable provision to ensure that the contract is sound and enforceable.</text></subclause></clause></subparagraph></paragraph><paragraph id="id32A753A78169432FAA71954BD4397CE4"><enum>(2)</enum><header>Responsibilities</header><text>Subject to section 106(h)(2) of the Broadband Data Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/47/1304">47 U.S.C. 1304(h)(2)</external-xref>), the entity selected under paragraph (1) shall, in consultation with, and under the supervision of, the Commission—</text><subparagraph id="id06FC9CDF2C61400C9F1F918BF750206A"><enum>(A)</enum><text>provide—</text><clause id="id002b0ae083034f0e85aeaa213b13175b"><enum>(i)</enum><text>geographic information system data processing assistance to providers that require that assistance in order to comply with the reporting requirements established by the Commission under section 3(a)(1);</text></clause><clause id="id07a1e544c0774b66baa54d4fa0181e59"><enum>(ii)</enum><text>support for the facilitation of the challenge process, the framework for which is established by the Commission under section 3(a)(2); and</text></clause><clause id="id81be120fecdd43e2861ead84010680eb"><enum>(iii)</enum><text>independent data validation services, including in-field verification of the availability of broadband internet access service reported by providers, to the Commission to ensure the accuracy and continual refinement of the National Broadband Map;</text></clause></subparagraph><subparagraph id="ida313966c2d5d4c85b9a3f15c6dc7ed45"><enum>(B)</enum><text>execute data-sharing agreements, as may be requested, with providers to facilitate the exchange of information needed to create shapefiles, or any other such depiction as the Commission may prescribe, of the availability of broadband internet access service for the purposes of carrying out subsection (d);</text></subparagraph><subparagraph id="idc110a11ce4ed47e7a868c78a12307d19"><enum>(C)</enum><text>analyze the information exchanged under subparagraph (B) to produce depictions of the availability of fixed broadband internet access service and mobile broadband internet access service in compliance with the requirements established under section 3(a)(1), for any providers that are eligible for the assistance described in subparagraph (A)(i);</text></subparagraph><subparagraph id="id5a7dcc1870e9461987d942bf7e1bdc90"><enum>(D)</enum><text>provide the depictions of service availability under subparagraph (C) to the Commission for—</text><clause id="id28A57F3404E040F48A1FA0B13B08647C"><enum>(i)</enum><text>the internal use of the Commission; and</text></clause><clause id="id04DCAA51EDAF443798AC95AD04A49708"><enum>(ii)</enum><text>incorporation in the National Broadband Map;</text></clause></subparagraph><subparagraph id="ida8b4985000994c7e8ad9d8bae5e986bc"><enum>(E)</enum><text>support collaboration between the Commission and other Federal agencies to—</text><clause id="idBF995A31A4004B7EB0E4E53E6F8F06DB"><enum>(i)</enum><text>track, map, and validate how funds made available through Federal grants, loans, or other financial awards or incentives for the development of broadband infrastructure have been expended to improve the availability of broadband internet access service; and</text></clause><clause id="idAA0F6AA02E5C4738B0C3E43AED6040D9"><enum>(ii)</enum><text>ensure transparency and accountability with respect to the expenditures described in clause (i), taking into account existing accountability measures, such as requiring the deployment of broadband infrastructure to be reported on a geocoded or other location-specific basis;</text></clause></subparagraph><subparagraph id="id14cd4158600f4ea583034121162dd294"><enum>(F)</enum><text>develop and implement an online mechanism to be integrated into the National Broadband Map, which shall solicit and collect feedback submitted by the public and providers through the challenge process, the framework for which is established under section 3(a)(2); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7fa1098cd72e4f8bb33aa6cdc8afab43"><enum>(G)</enum><text>in consultation with the Commission, establish an ongoing data validation and verification process, including selective in-person field validation activities, that shall—</text><clause commented="no" display-inline="no-display-inline" id="idDD124F6811E34E7E82C979AD7532ED79"><enum>(i)</enum><text>be guided by intelligence collected through the receipt of public feedback, the acquisition and analysis of third-party datasets, or other methods the entity may develop; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7AE54D287A134B7EADA5343DC0880F7E"><enum>(ii)</enum><text>advise the Commission regarding the continual refinement of the National Broadband Map.</text></clause></subparagraph></paragraph></subsection><subsection id="id4a4ecab167014dd4bf803ba18cf4af09"><enum>(b)</enum><header>Public comment required</header><text>With respect to the selection of an entity under subsection (a), the Commission shall seek comment from the public, providers, and other relevant stakeholders regarding the experience and capabilities of organizations that are qualified to be so selected.</text></subsection><subsection id="id2db9ee375fc040fa91444f9db9da86fd"><enum>(c)</enum><header>Termination for cause; selection of new entity</header><paragraph id="idF1D7BA57E73B4D7A9726137755343263"><enum>(1)</enum><header>In general</header><text>The Commission may, by order, terminate for cause an entity selected under subsection (a).</text></paragraph><paragraph id="id0341A7B81B004F61A5E80D185511A816"><enum>(2)</enum><header>New entity</header><text>If the Commission issues a termination order under paragraph (1)(A), the Commission shall, not later than 120 days after the date on which the Commission issues that order, select a new qualified entity to carry out subsection (a) in the same manner as provided in that subsection, including by seeking comment as provided in subsection (b).</text></paragraph></subsection><subsection id="idc96053f141094d61876705f352317968"><enum>(d)</enum><header>Provider request for assistance</header><paragraph id="idBC1C236A3B11432DA941F9A9B2E00862"><enum>(1)</enum><header>In general</header><text>The Commission shall implement a process through which a provider may request geographic information system data processing assistance from the entity selected under subsection (a).</text></paragraph><paragraph id="id722A298FEBB74CAC800440D12794CDAB"><enum>(2)</enum><header>Conditions for approval</header><text>The entity selected under subsection (a) shall grant a request for assistance submitted by a provider under paragraph (1)—</text><subparagraph id="id3F6BC4984BF54A14B0977D1AC8F7266A"><enum>(A)</enum><text>if the provider has more than 100,000 broadband connections—</text><clause id="id811B05DF32A147BEA77A1A49EE646E0A"><enum>(i)</enum><text>upon a demonstration of need by the provider; and</text></clause><clause id="id7DC15072741F4665A997E0B16CE45AD9"><enum>(ii)</enum><text>after review and approval by the Commission; and</text></clause></subparagraph><subparagraph id="idC129486399F24EC89E6A39FE957DEDAE"><enum>(B)</enum><text>if the provider has not more than 100,000 broadband connections, automatically, subject to the availability of funds.</text></subparagraph></paragraph></subsection><subsection id="id7bdc447e61f6451e9eccc3b8630e7413"><enum>(e)</enum><header>No regulatory authority</header><text>Nothing in this section may be construed to grant an entity selected under subsection (a) any regulatory jurisdiction with respect to, or oversight authority over, providers or information technology.</text></subsection></section><section id="id6C9F997DE6BD432FA2AB6816B5932654"><enum>5.</enum><header>Enforcement</header><subsection id="idE46131DCCDCA4256AA9B7D9180A1F597"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be unlawful for a person to willfully and knowingly submit information or data under this Act that is inaccurate with respect to the availability of broadband internet access service.</text></subsection><subsection id="idE4CF2E0776EA43318678EEF7129EBDBC"><enum>(b)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any person that violates subsection (a) shall be subject to an appropriate penalty, as determined by the Commission, under—</text><paragraph id="id820A2864077B44F7AACF83425241893F"><enum>(1)</enum><text display-inline="yes-display-inline">the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> et seq.), including section 501 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/47/501">47 U.S.C. 501</external-xref>); and</text></paragraph><paragraph id="id603B2DF1F0B14780B1172E064DF1C616"><enum>(2)</enum><text>the rules of the Commission.</text></paragraph></subsection></section><section id="id959a03542e0842adb220594630a932bf"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Commission to carry out this Act the following amounts:</text><paragraph id="id821e902d750c401cbec0677de47462a8"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id5031E7774EC8469BB0CA92BF7E06498F"><enum>(A)</enum><text>For fiscal year 2020, $55,000,000, not less than $34,500,000 of which shall be made available to carry out section 4.</text></subparagraph><subparagraph id="id22FAD3B394994B8C81D2368845F991A6" indent="up1"><enum>(B)</enum><text>The amounts made available under subparagraph (A) shall remain available until expended.</text></subparagraph></paragraph><paragraph id="ida9f2bfc1f6df4254886e691b683dea4a"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id66F161EA99124071BD4752E9D6628784"><enum>(A)</enum><text>For each of fiscal years 2021 through 2026, $50,000,000, not less than $29,500,000 of which shall be made available in each such fiscal year to carry out section 4.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5E7694A5715E411E9690552B88D579C0" indent="up1"><enum>(B)</enum><text>The amounts made available under subparagraph (A) shall remain available until expended.</text></subparagraph></paragraph></section></legis-body></bill>
