<section commented="no" display-inline="no-display-inline" id="HD6DBCCD700774FCCBAFEF9D3B28A71C8" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pallone-Thune Telephone Robocall Abuse Criminal Enforcement and Deterrence Act</short-title></quote> or the <quote><short-title>Pallone-Thune TRACED Act</short-title></quote>.</text></section> <section id="H78BE94A22A02453EAECF3A0B13582C53"><enum>2.</enum><header>Commission defined</header><text display-inline="no-display-inline">In this Act, the term <quote>Commission</quote> means the Federal Communications Commission.</text></section> 
<section id="HEF81384AE42E40B999927B3C0CEF214D"><enum>3.</enum><header>Forfeiture</header> 
<subsection id="H8AA81766B47D4976850652EDBE36125E"><enum>(a)</enum><header>In general</header><text>Section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>) is amended—</text> <paragraph id="HCC9A7BA9733C41B49AC2CDF31B2ED5B9"><enum>(1)</enum><text>in subsection (b), by adding at the end the following:</text> 
<quoted-block id="HEA55D58435F84898877FCF9B547B767E" style="OLC"> 
<paragraph id="H8B396B131BEC4E7DA9F46A7D14B14272"><enum>(4)</enum><header>Civil forfeiture</header> 
<subparagraph id="H79E4F2BCE48D46FCBF03825A43E3999F"><enum>(A)</enum><header>In general</header><text>Any person that is determined by the Commission, in accordance with paragraph (3) or (4) of section 503(b), to have violated this subsection shall be liable to the United States for a forfeiture penalty pursuant to section 503(b)(1). Paragraph (5) of section 503(b) shall not apply in the case of a violation of this subsection. A forfeiture penalty under this subparagraph shall be in addition to any other penalty provided for by this Act. The amount of the forfeiture penalty determined under this subparagraph shall be determined in accordance with subparagraphs (A) through (F) of section 503(b)(2).</text></subparagraph> <subparagraph id="H8A003DB1241C4EFEBFDF071B622ECED5"><enum>(B)</enum><header>Violation with intent</header><text display-inline="yes-display-inline">Any person that is determined by the Commission, in accordance with paragraph (3) or (4) of section 503(b), to have violated this subsection with the intent to cause such violation shall be liable to the United States for a forfeiture penalty pursuant to section 503(b)(1). Paragraph (5) of section 503(b) shall not apply in the case of a violation of this subsection. A forfeiture penalty under this subparagraph shall be in addition to any other penalty provided for by this Act. The amount of the forfeiture penalty determined under this subparagraph shall be equal to an amount determined in accordance with subparagraphs (A) through (F) of section 503(b)(2) plus an additional penalty not to exceed $10,000.</text></subparagraph> 
<subparagraph id="H513951F9071C46579B84597F250F5C76"><enum>(C)</enum><header>Recovery</header><text>Any forfeiture penalty determined under subparagraph (A) or (B) shall be recoverable under section 504(a).</text></subparagraph> <subparagraph id="HA2E9995CE8D4471E92EA9E84D102C35A"><enum>(D)</enum><header>Procedure</header><text display-inline="yes-display-inline">No forfeiture liability shall be determined under subparagraph (A) or (B) against any person unless such person receives the notice required by section 503(b)(3) or section 503(b)(4).</text></subparagraph> 
<subparagraph id="HD48797EACCED4CE8A88567111B3EC458"><enum>(E)</enum><header>Statute of limitations</header><text>Notwithstanding paragraph (6) of section 503(b), no forfeiture penalty shall be determined or imposed against any person—</text> <clause id="H0A4ADE69F05E4FD495197F41A8A280BE"><enum>(i)</enum><text>under subparagraph (A) if the violation charged occurred more than 1 year prior to the date of issuance of the required notice or notice of apparent liability; or</text></clause> 
<clause id="HD8AD80568A5740E0B512CF8C009FF84C"><enum>(ii)</enum><text>under subparagraph (B) if the violation charged occurred more than 4 years prior to the date of issuance of the required notice or notice of apparent liability.</text></clause></subparagraph> <subparagraph id="H1F20C55BF6284E6BBA206ACA745E9A0C"><enum>(F)</enum><header>Rule of construction</header><text>Notwithstanding any law to the contrary, the Commission may not determine or impose a forfeiture penalty on a person under both subparagraphs (A) and (B) based on the same conduct.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph> 
<paragraph id="H9561CCF3BCFC4D36AD238308912E6189"><enum>(2)</enum><text>in subsection (e)(5)(A)—</text> <subparagraph id="H27FD0176A6CB4339A5B48512E40878E2"><enum>(A)</enum><text>in clause (ii), by adding at the end the following: <quote>Paragraph (5) of section 503(b) shall not apply in the case of a violation of this subsection.</quote>; and</text></subparagraph> 
<subparagraph id="H44723F9475BC48E4BDA4D77FC7518693"><enum>(B)</enum><text>in clause (iv)—</text> <clause id="H828259CD2F1A4F84B7D78D097A8FFFEC"><enum>(i)</enum><text>in the heading, by striking <quote><header-in-text level="clause" style="OLC">2-year</header-in-text></quote> and inserting <quote><header-in-text level="clause" style="OLC">4-year</header-in-text></quote>; and</text></clause> 
<clause id="HAF3F3573E8E54DD69B089199CF63B9D1"><enum>(ii)</enum><text>by striking <quote>2 years</quote> and inserting <quote>4 years</quote>; and</text></clause></subparagraph></paragraph> <paragraph id="HF51C6CFB228048CF847F30574B6AC561"><enum>(3)</enum><text>by striking subsection (h) and inserting the following:</text> 
<quoted-block id="H35AFA45477B74D899844D4A3238B2A8A" style="OLC"> 
<subsection id="H702256BA3E724052B4321B027E52A44D"><enum>(h)</enum><header>Annual report to Congress on robocalls and transmission of misleading or inaccurate caller identification information</header> 
<paragraph id="HEDC18A62C0D34403ADA3236FB775121D"><enum>(1)</enum><header>Report required</header><text>Not later than 1 year after the date of the enactment of this subsection, and annually thereafter, the Commission, after consultation with the Federal Trade Commission, shall submit to Congress a report regarding enforcement by the Commission of subsections (b), (c), (d), and (e) during the preceding calendar year.</text></paragraph> <paragraph id="HF551265B3F464A89A12E608F9AA7C52D"><enum>(2)</enum><header>Matters for inclusion</header><text>Each report required by paragraph (1) shall include the following:</text> 
<subparagraph id="H3BDBFFE044EE457DAF80ACA7711F3029"><enum>(A)</enum><text>The number of complaints received by the Commission during each of the preceding 5 calendar years, for each of the following categories:</text> <clause id="H7A97670B306547A78BE77CCF387C5FDC"><enum>(i)</enum><text>Complaints alleging that a consumer received a call in violation of subsection (b) or (c).</text></clause> 
<clause id="H89144B2930194C558D93D9DFACBC15F1"><enum>(ii)</enum><text>Complaints alleging that a consumer received a call in violation of the standards prescribed under subsection (d).</text></clause> <clause id="H11F3D6766ACF48BAB512F46DF67FB872"><enum>(iii)</enum><text>Complaints alleging that a consumer received a call in connection with which misleading or inaccurate caller identification information was transmitted in violation of subsection (e).</text></clause></subparagraph> 
<subparagraph id="HC7FA4087791544068F8727EA5DCBF860"><enum>(B)</enum><text>The number of citations issued by the Commission pursuant to section 503(b) during the preceding calendar year to enforce subsection (d), and details of each such citation.</text></subparagraph> <subparagraph id="H9D531F07E8DD42FAB16285821BBDFD22"><enum>(C)</enum><text>The number of notices of apparent liability issued by the Commission pursuant to section 503(b) during the preceding calendar year to enforce subsections (b), (c), (d), and (e), and details of each such notice including any proposed forfeiture amount.</text></subparagraph> 
<subparagraph id="H338E853EB10443A09A00C718095E1858"><enum>(D)</enum><text>The number of final orders imposing forfeiture penalties issued pursuant to section 503(b) during the preceding calendar year to enforce such subsections, and details of each such order including the forfeiture imposed.</text></subparagraph> <subparagraph id="H1ACFE55B3AEA49FCA229E2CA6CF453E7"><enum>(E)</enum><text>The amount of forfeiture penalties or criminal fines collected, during the preceding calendar year, by the Commission or the Attorney General for violations of such subsections, and details of each case in which such a forfeiture penalty or criminal fine was collected.</text></subparagraph> 
<subparagraph id="HA0ED32E122CE44A0BD5CDC619675AD22"><enum>(F)</enum><text>Proposals for reducing the number of calls made in violation of such subsections.</text></subparagraph> <subparagraph id="H92BDC9E8555F4AAC8A515A3511279F90"><enum>(G)</enum><text>An analysis of the contribution by providers of interconnected VoIP service and non-interconnected VoIP service that discount high-volume, unlawful, short-duration calls to the total number of calls made in violation of such subsections, and recommendations on how to address such contribution in order to decrease the total number of calls made in violation of such subsections.</text></subparagraph></paragraph> 
<paragraph id="HA3EB1FE27DC2415197533CE23A8FD969"><enum>(3)</enum><header>No additional reporting required</header><text>The Commission shall prepare the report required by paragraph (1) without requiring the provision of additional information from providers of telecommunications service or voice service (as defined in section 4(a) of the <short-title>Pallone-Thune TRACED Act</short-title>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HA6FB166645CD4207B356204184B0EA2C"><enum>(b)</enum><header>Applicability</header><text>The amendments made by this section shall not affect any action or proceeding commenced before and pending on the date of the enactment of this Act.</text></subsection> 
<subsection id="H75ED00FAAAED47DCAD6F4090EFABC467"><enum>(c)</enum><header>Deadline for regulations</header><text>The Commission shall prescribe regulations to implement the amendments made by this section not later than 270 days after the date of the enactment of this Act.</text></subsection></section> <section id="H30C26A8DC0094094B38B3220B67D4541"><enum>4.</enum><header>Call authentication</header> <subsection id="H901E01829625488F8B78F71D785F696A"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H17A8C77BA07A4C06BBB1D6497EB8DB3B"><enum>(1)</enum><header>STIR/SHAKEN authentication framework</header><text>The term <quote>STIR/SHAKEN authentication framework</quote> means the secure telephone identity revisited and signature-based handling of asserted information using tokens standards proposed by the information and communications technology industry.</text></paragraph> <paragraph id="H5B28B47B1703474FBEAED901CEA100D2"><enum>(2)</enum><header>Voice service</header><text>The term <quote>voice service</quote>—</text> 
<subparagraph id="HC5CEDB7A0EF94B4B8B892E5B52A386DB"><enum>(A)</enum><text>means any service that is interconnected with the public switched telephone network and that furnishes voice communications to an end user using resources from the North American Numbering Plan or any successor to the North American Numbering Plan adopted by the Commission under section 251(e)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/251">47 U.S.C. 251(e)(1)</external-xref>); and</text></subparagraph> <subparagraph id="H97B36C12511F41698A72BF50ABD2B733"><enum>(B)</enum><text>includes—</text> 
<clause id="H5BCFA2A8337240628265971232A377B5"><enum>(i)</enum><text>transmissions from a telephone facsimile machine, computer, or other device to a telephone facsimile machine; and</text></clause> <clause id="H7FE0850C851643C0B706BDC89A9E19A5"><enum>(ii)</enum><text>without limitation, any service that enables real-time, two-way voice communications, including any service that requires internet protocol-compatible customer premises equipment (commonly known as <quote>CPE</quote>) and permits out-bound calling, whether or not the service is one-way or two-way voice over internet protocol.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H066585B627C9403983514CDA44DB2A9C"><enum>(b)</enum><header>Authentication frameworks</header> 
<paragraph id="H2C983C393337426995C0B25FD9C45921" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraphs (2) and (3), and in accordance with paragraph (6), not later than 18 months after the date of the enactment of this Act, the Commission shall—</text> <subparagraph id="HFF9229100A9049C18B8AA640F28DB3F8" commented="no"><enum>(A)</enum><text>require a provider of voice service to implement the STIR/SHAKEN authentication framework in the internet protocol networks of the provider of voice service; and</text></subparagraph> 
<subparagraph id="H88B0935C159C42B7B613CB19C4D33C73" commented="no"><enum>(B)</enum><text>require a provider of voice service to take reasonable measures to implement an effective call authentication framework in the non-internet protocol networks of the provider of voice service.</text></subparagraph></paragraph> <paragraph id="H3E66364102064125A9D12A0A4D0792F0"><enum>(2)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Commission shall not take the action described in paragraph (1) with respect to a provider of voice service if the Commission determines, not later than 12 months after the date of the enactment of this Act, that such provider of voice service—</text> 
<subparagraph id="HE1BF6A58FC9F4249A5A270FA2771C1FF"><enum>(A)</enum><text>in internet protocol networks—</text> <clause id="HEBD3C91187DA47A5A05F5CA19E4BE975"><enum>(i)</enum><text>has adopted the STIR/SHAKEN authentication framework for calls on the internet protocol networks of the provider of voice service;</text></clause> 
<clause id="H357DBC813CD945C8BC6A22C90DB40AAC"><enum>(ii)</enum><text>has agreed voluntarily to participate with other providers of voice service in the STIR/SHAKEN authentication framework;</text></clause> <clause id="H0D46120FC2D34D66AAF0F09485CB03E1"><enum>(iii)</enum><text>has begun to implement the STIR/SHAKEN authentication framework; and</text></clause> 
<clause id="H6FF5BCB764664F71A32E0580AA0CB1D1"><enum>(iv)</enum><text>will be capable of fully implementing the STIR/SHAKEN authentication framework not later than 18 months after the date of the enactment of this Act; and</text></clause></subparagraph> <subparagraph id="H779F7FC42CA24430A0B373862436086D"><enum>(B)</enum><text>in non-internet protocol networks—</text> 
<clause id="H29214CBEF67E480993246DFB18E1FC7C"><enum>(i)</enum><text>has taken reasonable measures to implement an effective call authentication framework; and</text></clause> <clause id="H018CDCCEC4D5413DB157FE04B6AF887E"><enum>(ii)</enum><text>will be capable of fully implementing an effective call authentication framework not later than 18 months after the date of the enactment of this Act.</text></clause></subparagraph></paragraph> 
<paragraph id="HB9D6DA6A32404F15AD619EC79684C471"><enum>(3)</enum><header>Implementation report</header><text>Not later than 12 months after the date of the enactment of this Act, the Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the determination required under paragraph (2), which shall include—</text> <subparagraph id="H224C550F8F3F442FB6EEE706456D2584"><enum>(A)</enum><text>an analysis of the extent to which providers of voice service have implemented the call authentication frameworks described in subparagraphs (A) and (B) of paragraph (1), including whether the availability of necessary equipment and equipment upgrades has impacted such implementation; and</text></subparagraph> 
<subparagraph id="HB89254C2B37440D7B78C319F5AC0638B"><enum>(B)</enum><text>an assessment of the efficacy of the call authentication frameworks described in subparagraphs (A) and (B) of paragraph (1) in addressing all aspects of call authentication.</text></subparagraph></paragraph> <paragraph id="HA1C5B7250D594B2580D147D247AFFC7B"><enum>(4)</enum><header>Review and revision or replacement</header><text>Not later than 3 years after the date of the enactment of this Act, and every 3 years thereafter, the Commission, after public notice and an opportunity for comment, shall—</text> 
<subparagraph id="HD1AE7F6D2CBA472A90A253B5DB81308A"><enum>(A)</enum><text>assess the efficacy of the technologies used for call authentication frameworks implemented under this section;</text></subparagraph> <subparagraph id="H7046876317BE4B83923EC4A616D55D05"><enum>(B)</enum><text>based on the assessment under subparagraph (A), revise or replace the call authentication frameworks under this section if the Commission determines it is in the public interest to do so; and</text></subparagraph> 
<subparagraph id="H2D17713FB252486EABC81027ACD98977"><enum>(C)</enum><text>submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the findings of the assessment under subparagraph (A) and on any actions to revise or replace the call authentication frameworks under subparagraph (B).</text></subparagraph></paragraph> <paragraph id="H05461F6D65C14807BDC9DEF296DB02E7"><enum>(5)</enum><header>Extension of implementation deadline</header> <subparagraph id="H66383FA6F947431D8DA837F093F91573"><enum>(A)</enum><header>Burdens and barriers to implementation</header><text>Not later than 12 months after the date of the enactment of this Act, and as appropriate thereafter, the Commission—</text> 
<clause id="H1D69DC279916447A88CE663133F873FD"><enum>(i)</enum><text>shall assess any burdens or barriers to the implementation required by paragraph (1), including—</text> <subclause id="H0E30E68FD64845BC9654276C63214949"><enum>(I)</enum><text>for providers of voice service to the extent the networks of such providers use time-division multiplexing;</text></subclause> 
<subclause id="H321B3175E9DA4A5F811658B9CE454875"><enum>(II)</enum><text>for small providers of voice service and those in rural areas; and</text></subclause> <subclause id="H8505FA115A7640348D7AF163CE9DC41E"><enum>(III)</enum><text>the inability to purchase or upgrade equipment to support the call authentication frameworks under this section, or lack of availability of such equipment; and</text></subclause></clause> 
<clause id="H27513FF18A7A461B9349C9EC8755FF50"><enum>(ii)</enum><text display-inline="yes-display-inline">in connection with an assessment under clause (i), may, upon a public finding of undue hardship, delay required compliance with the 18-month time period described in paragraph (1), for a reasonable period of time, for a provider or class of providers of voice service, or type of voice calls, as necessary for that provider or class of providers or type of calls to participate in the implementation in order to address the identified burdens and barriers.</text></clause></subparagraph> <subparagraph id="H59C2503E4E14458A901EA60881935374"><enum>(B)</enum><header>Delay of compliance required for certain non-internet protocol networks</header><text display-inline="yes-display-inline">Subject to subparagraphs (C) through (F), for any provider or class of providers of voice service, or type of voice calls, only to the extent that such a provider or class of providers of voice service, or type of voice calls, materially relies on a non-internet protocol network for the provision of such service or calls, the Commission shall grant a delay of required compliance under subparagraph (A)(ii) until a call authentication protocol has been developed for calls delivered over non-internet protocol networks and is reasonably available.</text></subparagraph> 
<subparagraph id="H850A08BD85A548688A84D262D8A4F5E7"><enum>(C)</enum><header>Robocall mitigation program</header> 
<clause id="H8995B14FECC7468F8E5EEDBF49540B62"><enum>(i)</enum><header>Program required</header><text>During the time of a delay of compliance granted under subparagraph (A)(ii), the Commission shall require, pursuant to the authority of the Commission, that any provider subject to such delay shall implement an appropriate robocall mitigation program to prevent unlawful robocalls from originating on the network of the provider.</text></clause> <clause id="HBA06EB9CF73C4D1AB673B809557763F2"><enum>(ii)</enum><header>Additional requirements</header><text>If the consortium registered under section 13(d) identifies a provider of voice service that is subject to a delay of compliance granted under subparagraph (A)(ii) as repeatedly originating large-scale unlawful robocall campaigns, the Commission shall require such provider to take action to ensure that such provider does not continue to originate such calls.</text></clause> 
<clause id="H474D6D3F7EF0402FB8C811CC405C5338"><enum>(iii)</enum><header>Minimization of burden</header><text>The Commission shall make reasonable efforts to minimize the burden of any robocall mitigation required pursuant to clause (ii), which may include prescribing certain specific robocall mitigation practices for providers of voice service that have repeatedly originated large-scale unlawful robocall campaigns.</text></clause></subparagraph> <subparagraph id="H4F9F1B740E10405AAD674D9A3C806B95"><enum>(D)</enum><header>Full participation</header><text>The Commission shall take reasonable measures to address any issues in an assessment under subparagraph (A)(i) and enable as promptly as reasonable full participation of all classes of providers of voice service and types of voice calls to receive the highest level of trust. Such measures shall include, without limitation, as appropriate, limiting or terminating a delay of compliance granted to a provider under subparagraph (B) if the Commission determines in such assessment that the provider is not making reasonable efforts to develop the call authentication protocol described in such subparagraph.</text></subparagraph> 
<subparagraph id="H4D2EDA340D4A407CA0C8ACB377AD0B5E"><enum>(E)</enum><header>Alternative methodologies</header><text>The Commission shall identify, in consultation with small providers of voice service and those in rural areas, alternative effective methodologies to protect customers from unauthenticated calls during any delay of compliance granted under subparagraph (A)(ii).</text></subparagraph> <subparagraph id="H9B8CBA6C942949628F67667928A16584"><enum>(F)</enum><header>Revision of delay of compliance</header><text>Not less frequently than annually after the first delay of compliance is granted under subparagraph (A)(ii), the Commission—</text> 
<clause id="H07A7D2DEA06E433A904D2C9962A0B4BD"><enum>(i)</enum><text>shall consider revising or extending any delay of compliance granted under subparagraph (A)(ii);</text></clause> <clause id="HDF0D9C405CB64A8FA86F57951B5DA543"><enum>(ii)</enum><text>may revise such delay of compliance; and</text></clause> 
<clause id="H67FD9F5D6FCE4C5F90BF4CEA95AE546D"><enum>(iii)</enum><text>shall issue a public notice with regard to whether such delay of compliance remains necessary, including—</text> <subclause id="H9A0BA2FDCD264ED5844FD8E95A7AC2F3"><enum>(I)</enum><text>why such delay of compliance remains necessary; and</text></subclause> 
<subclause id="H77688B083F8F4E98B061794B695AA994"><enum>(II)</enum><text>when the Commission expects to achieve the goal of full participation as described in subparagraph (D).</text></subclause></clause></subparagraph></paragraph> <paragraph id="H11FD47CE3D784E2BA82D118FE8096E16"><enum>(6)</enum><header>No additional cost to consumers or small business customers</header><text>The Commission shall prohibit providers of voice service from adding any additional line item charges to consumer or small business customer subscribers for the effective call authentication technology required under paragraph (1).</text></paragraph> 
<paragraph id="HCA6A3EDD74974CBC859000DC63B57664"><enum>(7)</enum><header>Accurate identification</header><text>Not later than 12 months after the date of the enactment of this Act, the Commission shall issue best practices that providers of voice service may use as part of the implementation of effective call authentication frameworks under paragraph (1) to take steps to ensure the calling party is accurately identified.</text></paragraph></subsection> <subsection id="HB57D18F802C94771A5D813A3DA720134"><enum>(c)</enum><header>Safe harbor and other regulations</header> <paragraph id="H13D71BB6BBE74E278B9200A05AA55DAB"><enum>(1)</enum><header>In general</header><text>Consistent with the regulations prescribed under subsection (j) of section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>), as added by section 10, the Commission shall, not later than 1 year after the date of the enactment of this Act, promulgate rules—</text> 
<subparagraph id="HFFEDD2C014714639A5A211FE5193F633"><enum>(A)</enum><text display-inline="yes-display-inline">establishing when a provider of voice service may block a voice call based, in whole or in part, on information provided by the call authentication frameworks under subsection (b), with no additional line item charge;</text></subparagraph> <subparagraph id="H5D9D8EF125E44136AB0384707A0E47A6"><enum>(B)</enum><text>establishing a safe harbor for a provider of voice service from liability for unintended or inadvertent blocking of calls or for the unintended or inadvertent misidentification of the level of trust for individual calls based, in whole or in part, on information provided by the call authentication frameworks under subsection (b);</text></subparagraph> 
<subparagraph id="HFE815570330C4B2EABD7B67B6FA61EE8"><enum>(C)</enum><text>establishing a process to permit a calling party adversely affected by the information provided by the call authentication frameworks under subsection (b) to verify the authenticity of the calling party’s calls; and</text></subparagraph> <subparagraph id="H125C7016B1524DD3B20439A8C8265054"><enum>(D)</enum><text>ensuring that calls originating from a provider of voice service in an area where the provider is subject to a delay of compliance with the time period described in subsection (b)(1) are not unreasonably blocked because the calls are not able to be authenticated.</text></subparagraph></paragraph> 
<paragraph id="H58FDAD8E507B408D86825A9275F7271C"><enum>(2)</enum><header>Considerations</header><text>In establishing the safe harbor under paragraph (1), consistent with the regulations prescribed under subsection (j) of section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>), as added by section 10, the Commission shall consider limiting the liability of a provider of voice service based on the extent to which the provider of voice service—</text> <subparagraph id="HF60AD5452FD544BDA41BDAE6D7C75AE1"><enum>(A)</enum><text>blocks or identifies calls based, in whole or in part, on the information provided by the call authentication frameworks under subsection (b);</text></subparagraph> 
<subparagraph id="H37B1BA39517F4BC8A0022A0B5E386EAE"><enum>(B)</enum><text display-inline="yes-display-inline">implemented procedures based, in whole or in part, on the information provided by the call authentication frameworks under subsection (b); and</text></subparagraph> <subparagraph id="H86AA1821549D4A8ABDEE9BE9EBFA8BFF"><enum>(C)</enum><text>used reasonable care, including making all reasonable efforts to avoid blocking emergency public safety calls.</text></subparagraph></paragraph></subsection> 
<subsection id="H461DAF079A2B4F57B84D2032665B99C5"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall preclude the Commission from initiating a rulemaking pursuant to its existing statutory authority.</text></subsection></section> <section id="H3447FB35AAB6489283DB80E92C5D1553"><enum>5.</enum><header>Interagency working group</header> <subsection id="H74F2B933759042DAAC871D75561C1A62"><enum>(a)</enum><header>In general</header><text>The Attorney General, in consultation with the Chairman of the Commission, shall convene an interagency working group to study Government prosecution of violations of section 227(b) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)</external-xref>).</text></subsection> 
<subsection id="H528478D7A4D94551A936E1B07F4BE074"><enum>(b)</enum><header>Duties</header><text>In carrying out the study under subsection (a), the interagency working group shall—</text> <paragraph id="H60FCC6A829B54B499F5329EAFE8A1A08"><enum>(1)</enum><text>determine whether, and if so how, any Federal laws, including regulations, policies, and practices, or budgetary or jurisdictional constraints inhibit the prosecution of such violations;</text></paragraph> 
<paragraph id="H735ABC4959574D3691CF7C7F70CC4515"><enum>(2)</enum><text>identify existing and potential Federal policies and programs that encourage and improve coordination among Federal departments and agencies and States, and between States, in the prevention and prosecution of such violations;</text></paragraph> <paragraph id="H0D324647407E46BD8DD09F84FE704D8F"><enum>(3)</enum><text>identify existing and potential international policies and programs that encourage and improve coordination between countries in the prevention and prosecution of such violations; and</text></paragraph> 
<paragraph id="H26F32C338CDB4CA1A47474BF98746A94"><enum>(4)</enum><text>consider—</text> <subparagraph id="H4D4D3B53A4AA4053BE2A5B7FB5F71202"><enum>(A)</enum><text>the benefit and potential sources of additional resources for the Federal prevention and prosecution of criminal violations of that section;</text></subparagraph> 
<subparagraph id="H383A3F82A4B44B318FFB271C545DED0C"><enum>(B)</enum><text>whether to establish memoranda of understanding regarding the prevention and prosecution of such violations between—</text> <clause id="H7D1204053F4841AA8A90A791CD9139C1"><enum>(i)</enum><text>the States;</text></clause> 
<clause id="H83D5CFDFC95E4A6E9690AB37E9A7A8E3"><enum>(ii)</enum><text>the States and the Federal Government; and</text></clause> <clause id="H0BCA282220904DF3ACCEB14FB007ADDE"><enum>(iii)</enum><text>the Federal Government and a foreign government;</text></clause></subparagraph> 
<subparagraph id="HECDD70761EA84926AC7A0E7A9FE97BFA"><enum>(C)</enum><text>whether to establish a process to allow States to request Federal subpoenas from the Commission;</text></subparagraph> <subparagraph id="HE164FDBE80D64C7B982C8CE38BF8A11C"><enum>(D)</enum><text>whether extending civil enforcement authority to the States would assist in the successful prevention and prosecution of such violations;</text></subparagraph> 
<subparagraph id="H2CA69CF5820144C1A1F70EB4F966D4CD"><enum>(E)</enum><text>whether increased forfeiture and imprisonment penalties are appropriate, such as extending imprisonment for such a violation to a term longer than 2 years;</text></subparagraph> <subparagraph id="H41152C0187904DFA8C8166EF3C529326"><enum>(F)</enum><text>whether regulation of any entity that enters into a business arrangement with a common carrier regulated under title II of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/201">47 U.S.C. 201</external-xref> et seq.) for the specific purpose of carrying, routing, or transmitting a call that constitutes such a violation would assist in the successful prevention and prosecution of such violations; and</text></subparagraph> 
<subparagraph id="H4E20B11B02BE4C66AB8F09D81DDA70B3"><enum>(G)</enum><text>the extent to which, if any, Department of Justice policies to pursue the prosecution of violations causing economic harm, physical danger, or erosion of an inhabitant’s peace of mind and sense of security inhibit the prevention or prosecution of such violations.</text></subparagraph></paragraph></subsection> <subsection id="H1F7D3CA30869417F9443405E59E927A0"><enum>(c)</enum><header>Members</header><text>The interagency working group shall be composed of such representatives of Federal departments and agencies as the Attorney General considers appropriate, such as—</text> 
<paragraph id="HE57AF490E30C491290677CF15ABA1094"><enum>(1)</enum><text>the Department of Commerce;</text></paragraph> <paragraph id="HC2000C64D57842F49B6E911BA5F81D64"><enum>(2)</enum><text>the Department of State;</text></paragraph> 
<paragraph id="HFE19140401AC4AA68C97A3C1AA70D74D"><enum>(3)</enum><text>the Department of Homeland Security;</text></paragraph> <paragraph id="H17853D98392E4056BD506726B282D13B"><enum>(4)</enum><text>the Commission;</text></paragraph> 
<paragraph id="H97A83654203D473285D3D26C8F705B72"><enum>(5)</enum><text>the Federal Trade Commission; and</text></paragraph> <paragraph id="HCEFBB30AE8A5424F9EF8FDACCB1C5758"><enum>(6)</enum><text>the Bureau of Consumer Financial Protection.</text></paragraph></subsection> 
<subsection id="H26AADABDA39A460C9F51A8A3A87F2510"><enum>(d)</enum><header>Non-Federal stakeholders</header><text>In carrying out the study under subsection (a), the interagency working group shall consult with such non-Federal stakeholders as the Attorney General determines have the relevant expertise, including the National Association of Attorneys General.</text></subsection> <subsection id="HA31F5A4A49544A51AB027FAC609CCE7F"><enum>(e)</enum><header>Report to Congress</header><text>Not later than 270 days after the date of the enactment of this Act, the interagency working group shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the findings of the study under subsection (a), including—</text> 
<paragraph id="H1709CE964C364452849B2054479BAF85"><enum>(1)</enum><text>any recommendations regarding the prevention and prosecution of such violations; and</text></paragraph> <paragraph id="H24C3C1410FD9467D981F3696F37FC918"><enum>(2)</enum><text>a description of what progress, if any, relevant Federal departments and agencies have made in implementing the recommendations under paragraph (1).</text></paragraph></subsection></section> 
<section id="H132DF04FBF584FBEB7BF657F3570AFB4"><enum>6.</enum><header>Access to number resources</header> 
<subsection id="H57DB8B662A104F97B48CAFE45CC1BFCC"><enum>(a)</enum><header>In general</header> 
<paragraph id="H5BBBA8405A934EE4977898F71B1E7D17"><enum>(1)</enum><header>Examination of FCC policies</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Commission shall commence a proceeding to determine how Commission policies regarding access to number resources, including number resources for toll-free and non-toll-free telephone numbers, could be modified, including by establishing registration and compliance obligations, and requirements that providers of voice service given access to number resources take sufficient steps to know the identity of the customers of such providers, to help reduce access to numbers by potential perpetrators of violations of section 227(b) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)</external-xref>).</text></paragraph> <paragraph id="H392ABF9D012B4A6ABC5BE209F1713D47"><enum>(2)</enum><header>Regulations</header><text>If the Commission determines under paragraph (1) that modifying the policies described in that paragraph could help achieve the goal described in that paragraph, the Commission shall prescribe regulations to implement those policy modifications.</text></paragraph></subsection> 
<subsection id="H05B0716DB3984611A41205FAC2D0ECAB"><enum>(b)</enum><header>Authority</header><text>Any person who knowingly, through an employee, agent, officer, or otherwise, directly or indirectly, by or through any means or device whatsoever, is a party to obtaining number resources, including number resources for toll-free and non-toll-free telephone numbers, from a common carrier regulated under title II of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/201">47 U.S.C. 201</external-xref> et seq.), in violation of a regulation prescribed under subsection (a), shall, notwithstanding section 503(b)(5) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/503">47 U.S.C. 503(b)(5)</external-xref>), be subject to a forfeiture penalty under section 503(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/47/503">47 U.S.C. 503(b)</external-xref>). A forfeiture penalty under this subsection shall be in addition to any other penalty provided for by law.</text></subsection></section> <section id="H5D58F077931848FC852FBA142C2D8FC8"><enum>7.</enum><header>Protections from spoofed calls</header> <subsection id="HD295191819534C86BEC7C9B9FFC62CF8"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, and consistent with the call authentication frameworks under section 4, the Commission shall initiate a rulemaking to help protect a subscriber from receiving unwanted calls or text messages from a caller using an unauthenticated number.</text></subsection> 
<subsection id="H73BCF74AF3D74A2FAB39E64D261C1818"><enum>(b)</enum><header>Considerations</header><text>In promulgating rules under subsection (a), the Commission shall consider—</text> <paragraph id="H5FEE4BCDC8FF4FC1BCA1FB45EC2E8361"><enum>(1)</enum><text>the Government Accountability Office report on combating the fraudulent provision of misleading or inaccurate caller identification information required by section 503(c) of division P of the Consolidated Appropriations Act, 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>);</text></paragraph> 
<paragraph id="H70EB2EA19F324884A735FB4D526DA9B7"><enum>(2)</enum><text>the best means of ensuring that a subscriber or provider has the ability to block calls from a caller using an unauthenticated North American Numbering Plan number;</text></paragraph> <paragraph id="HB7CA12AAA68C4A3D8571949F3F57BFEB"><enum>(3)</enum><text>the impact on the privacy of a subscriber from unauthenticated calls;</text></paragraph> 
<paragraph id="H066C0C0F961F496793E31E4352D174DD"><enum>(4)</enum><text>the effectiveness in verifying the accuracy of caller identification information; and</text></paragraph> <paragraph id="H068E0BBE75AD46159321735E3D33C1F1"><enum>(5)</enum><text>the availability and cost of providing protection from the unwanted calls or text messages described in subsection (a).</text></paragraph></subsection></section> 
<section id="H3A34C4271E494A1689872A8FD4B65892"><enum>8.</enum><header>Consumer protections for exemptions</header> 
<subsection id="H171170C275C64C679B1766CB6D2BA5CA"><enum>(a)</enum><header>In general</header><text>Section 227(b)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)(2)</external-xref>) is amended—</text> <paragraph id="H8217996C49CD41BEBFF6EB68E40BD38C"><enum>(1)</enum><text>in subparagraph (G)(ii), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph> 
<paragraph id="H3CEF1671BC434A04BD994CD8C0F2899E"><enum>(2)</enum><text>in subparagraph (H), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> <paragraph id="H929E7B4FE95C4FD88DEC67677B89756B"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H89D4DE5B09ED40618A61B3B2C5CCF191" style="OLC"> 
<subparagraph id="H50D8CFF004664AEE8ECF6B8CBAC49215"><enum>(I)</enum><text>shall ensure that any exemption under subparagraph (B) or (C) contains requirements for calls made in reliance on the exemption with respect to—</text> <clause id="H963E7B85D95247FB8A50251CD3614473"><enum>(i)</enum><text>the classes of parties that may make such calls;</text></clause> 
<clause id="HB5C5535B10D74BA5A82D57418BC02CD3"><enum>(ii)</enum><text>the classes of parties that may be called; and</text></clause> <clause id="H4C63978E532341249BA3F51C01296806"><enum>(iii)</enum><text>the number of such calls that a calling party may make to a particular called party.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H129B4C33B26F43F88CC408E59BF8E869"><enum>(b)</enum><header>Deadline for regulations</header><text>In the case of any exemption issued under subparagraph (B) or (C) of section 227(b)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)(2)</external-xref>) before the date of the enactment of this Act, the Commission shall, not later than 1 year after such date of enactment, prescribe such regulations, or amend such existing regulations, as necessary to ensure that such exemption contains each requirement described in subparagraph (I) of such section, as added by subsection (a). To the extent such an exemption contains such a requirement before such date of enactment, nothing in this section or the amendments made by this section shall be construed to require the Commission to prescribe or amend regulations relating to such requirement.</text></subsection></section> <section id="H9D6E0DCB08B64BD69F2D35611CB4E5D7"><enum>9.</enum><header>Report on reassigned number database</header> <subsection id="HA1B447D0076645F6BFA535D43C30ECCA" commented="no"><enum>(a)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Commission shall submit to Congress, and make publicly available on the website of the Commission, a report on the status of the efforts of the Commission pursuant to the Second Report and Order in the matter of Advanced Methods to Target and Eliminate Unlawful Robocalls (CG Docket No. 17–59; FCC 18–177; adopted on December 12, 2018).</text></subsection> 
<subsection id="HD85038EC14934E71A69A17DFF26DD7D4" commented="no"><enum>(b)</enum><header>Contents</header><text>The report required by subsection (a) shall describe the efforts of the Commission, as described in such Second Report and Order, to ensure—</text> <paragraph id="H463B81E8760A400BBB3DC14A15801287" commented="no"><enum>(1)</enum><text>the establishment of a database of telephone numbers that have been disconnected, in order to provide a person making calls subject to section 227(b) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)</external-xref>) with comprehensive and timely information to enable such person to avoid making calls without the prior express consent of the called party because the number called has been reassigned;</text></paragraph> 
<paragraph id="H8DFEBE0F45B54C369D6FA9F1C5DC8C32" commented="no"><enum>(2)</enum><text>that a person who wishes to use any safe harbor provided pursuant to such Second Report and Order with respect to making calls must demonstrate that, before making the call, the person appropriately checked the most recent update of the database and the database reported that the number had not been disconnected; and</text></paragraph> <paragraph id="H84A6BF10C97B4E34A396B985AB364C4D" commented="no"><enum>(3)</enum><text>that if the person makes the demonstration described in paragraph (2), the person will be shielded from liability under section 227(b) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)</external-xref>) should the database return an inaccurate result.</text></paragraph></subsection></section> 
<section id="H5D2DC0C9D8884D0B96C24B2B5813C24B"><enum>10.</enum><header>Stop robocalls</header> 
<subsection id="HE0581374FE5E4EF5B040DC3EAE0A6432"><enum>(a)</enum><header>Information sharing regarding robocall and spoofing violations</header><text>Section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H0CC366EA147E44EA9BF5F9038622556D" style="OLC"> <subsection id="H1C0D0A4633B84DAC86B66CF49461503A"><enum>(i)</enum><header>Information sharing</header> <paragraph id="HB5E490D045464EDA983238A2F8C5C1E5"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of the enactment of this subsection, the Commission shall prescribe regulations to establish a process that streamlines the ways in which a private entity may voluntarily share with the Commission information relating to—</text> 
<subparagraph id="HA3C5E55A312F426092661674F82CDBD6"><enum>(A)</enum><text>a call made or a text message sent in violation of subsection (b); or</text></subparagraph> <subparagraph id="H4DA1011B1B5A43D09356E675BD4523EE"><enum>(B)</enum><text>a call or text message for which misleading or inaccurate caller identification information was caused to be transmitted in violation of subsection (e).</text></subparagraph></paragraph> 
<paragraph id="H20269B12F3C541118ADB70E242032A51"><enum>(2)</enum><header>Text message defined</header><text>In this subsection, the term <quote>text message</quote> has the meaning given such term in subsection (e)(8).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HBB22151FBE0F469298246601906BA7AF"><enum>(b)</enum><header>Robocall blocking service</header><text>Section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>), as amended by subsection (a), is further amended by adding at the end the following:</text>

<subsection id="HFBAFFC608B774152AC8672D392226DDD"><enum>(j)</enum><header>Robocall blocking service</header> 
<paragraph id="H7E052F4131854F9FBB131640E13835A4"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this subsection, the Commission shall take a final agency action to ensure the robocall blocking services provided on an opt-out or opt-in basis pursuant to the Declaratory Ruling of the Commission in the matter of Advanced Methods to Target and Eliminate Unlawful Robocalls (CG Docket No. 17–59; FCC 19–51; adopted on June 6, 2019)—</text> <subparagraph id="H126AF2723A99425A8BE3006B51692BFB"><enum>(A)</enum><text>are provided with transparency and effective redress options for both—</text> 
<clause id="H4EF0C73BE03041A1912DE65345766B0B"><enum>(i)</enum><text>consumers; and</text></clause> <clause id="HD7F5A7A2C4FB4887A5B030E3FDE2D3C1"><enum>(ii)</enum><text>callers; and</text></clause></subparagraph> 
<subparagraph id="HF416138DC06946138BE84906B77AA665"><enum>(B)</enum><text>are provided with no additional line item charge to consumers and no additional charge to callers for resolving complaints related to erroneously blocked calls; and</text></subparagraph> <subparagraph id="H9720E1D4B82243408DF0CAB18B2A38EC"><enum>(C)</enum><text>make all reasonable efforts to avoid blocking emergency public safety calls.</text></subparagraph></paragraph> 
<paragraph id="H214D6E01D1EF4207B62B091DBB8B749A"><enum>(2)</enum><header>Text message defined</header><text>In this subsection, the term <quote>text message</quote> has the meaning given such term in subsection (e)(8).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H78449417263F4B3E8AA9F00F924D7D7E"><enum>(c)</enum><header>Study on information requirements for certain VoIP service providers</header> <paragraph id="HD65B4140953F4D84BC68DDDD3C0584A9"><enum>(1)</enum><header>In general</header><text>The Commission shall conduct a study regarding whether to require a provider of covered VoIP service to—</text> 
<subparagraph id="H9338221DA70945A0BB124996E1EB3403"><enum>(A)</enum><text>provide to the Commission contact information for such provider and keep such information current; and</text></subparagraph> <subparagraph id="HB0E38FDB2D564038ABDE3284AAAA0EDA"><enum>(B)</enum><text>retain records relating to each call transmitted over the covered VoIP service of such provider that are sufficient to trace such call back to the source of such call.</text></subparagraph></paragraph> 
<paragraph id="H3ADD6EE6CDB84527B1B9898034365B22"><enum>(2)</enum><header>Report to Congress</header><text>Not later than 18 months after the date of the enactment of this Act, the Commission shall submit to Congress a report on the results of the study conducted under paragraph (1).</text></paragraph> <paragraph id="H723AC0378F0E42C6BD1C2C58FC782F69"><enum>(3)</enum><header>Covered VoIP service defined</header><text>In this subsection, the term <quote>covered VoIP service</quote> means a service that—</text> 
<subparagraph id="H7C7DFD864C9549F5AFE7021643D83285"><enum>(A)</enum><text>is an interconnected VoIP service (as defined in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>)); or</text></subparagraph> <subparagraph id="H10FE39D5E6C84E59AA68AA31F0F46A51"><enum>(B)</enum><text>would be an interconnected VoIP service (as so defined) except that the service permits users to terminate calls to the public switched telephone network but does not permit users to receive calls that originate on the public switched telephone network.</text></subparagraph></paragraph></subsection> 
<subsection id="H3A18A6AD6CD94F9C813DE435DDA34411"><enum>(d)</enum><header>Transitional rule regarding definition of text message</header><text>Paragraph (2) of subsection (i) of section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>), as added by subsection (a) of this section, and paragraph (2) of subsection (j) of such section 227, as added by subsection (b) of this section, shall apply before the effective date of the amendment made to subsection (e)(8) of such section 227 by subparagraph (C) of section 503(a)(2) of division P of the Consolidated Appropriations Act, 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>) as if such amendment was already in effect.</text></subsection></section> <section id="H83F2B1091B4A4DA8A713CD07D23794F4"><enum>11.</enum><header>Provision of evidence of certain robocall violations to Attorney General</header> <subsection id="H2311471EE42D455690FD573C8E35EC02"><enum>(a)</enum><header>In general</header><text>If the Chief of the Enforcement Bureau of the Commission obtains evidence that suggests a willful, knowing, and repeated robocall violation with an intent to defraud, cause harm, or wrongfully obtain anything of value, the Chief of the Enforcement Bureau shall provide such evidence to the Attorney General.</text></subsection> 
<subsection id="HA849AA81DD9543A9A08FD44B69DDBE16"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Commission shall publish on its website and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that—</text> <paragraph id="H5E8BB488BCD747A6AE54E2792F99F46A"><enum>(1)</enum><text>states the number of instances during the preceding year in which the Chief of the Enforcement Bureau provided the evidence described in subsection (a) to the Attorney General; and</text></paragraph> 
<paragraph id="HD0FE83E878F34A569E917AA0B9B7EDD8"><enum>(2)</enum><text>contains a general summary of the types of robocall violations to which such evidence relates.</text></paragraph></subsection> <subsection id="HB6207E5967904772990CA48ED16A2BA2"><enum>(c)</enum><header>Rules of construction</header><text>Nothing in this section shall be construed to affect the ability of the Commission or the Chief of the Enforcement Bureau under other law—</text> 
<paragraph id="HABA12BB79DF84AD1AD59C0D14D13E228"><enum>(1)</enum><text>to refer a matter to the Attorney General; or</text></paragraph> <paragraph id="H384EB8CBF5BF464E818FB8CD0BF1DB9A"><enum>(2)</enum><text>to pursue or continue pursuit of an enforcement action in a matter with respect to which the Chief of the Enforcement Bureau provided the evidence described in subsection (a) to the Attorney General.</text></paragraph></subsection> 
<subsection id="HC63D90502A3A4C5FBEB12080889E7D1D"><enum>(d)</enum><header>Robocall violation defined</header><text>In this section, the term <quote>robocall violation</quote> means a violation of subsection (b) or (e) of section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>).</text></subsection></section> <section id="H2318390D944C4177A382629E65A47E24"><enum>12.</enum><header>Protection from one-ring scams</header> <subsection id="HD68C9E2163E742B78C162CD26C1B0F61"><enum>(a)</enum><header>Initiation of proceeding</header><text>Not later than 120 days after the date of the enactment of this Act, the Commission shall initiate a proceeding to protect called parties from one-ring scams.</text></subsection> 
<subsection id="H15794678383946C88B5B8524F66F5081"><enum>(b)</enum><header>Matters To be considered</header><text>As part of the proceeding required by subsection (a), the Commission shall consider how the Commission can—</text> <paragraph id="HDBF853CDD5E54247B8CFE21E66424033"><enum>(1)</enum><text>work with Federal and State law enforcement agencies to address one-ring scams;</text></paragraph> 
<paragraph id="H417A35BB82544F04A14903E2E7A2A8B9"><enum>(2)</enum><text>work with the governments of foreign countries to address one-ring scams;</text></paragraph> <paragraph id="H4AFB41E27E914292A4DCE98EF9D58962"><enum>(3)</enum><text>in consultation with the Federal Trade Commission, better educate consumers about how to avoid one-ring scams;</text></paragraph> 
<paragraph id="H8059FB37B3FD449FA744E0E9190A7A1E"><enum>(4)</enum><text>incentivize voice service providers to stop calls made to perpetrate one-ring scams from being received by called parties, including consideration of adding identified one-ring scam type numbers to the Commission’s existing list of permissible categories for carrier-initiated blocking;</text></paragraph> <paragraph id="HF96B72CF5A324DB1BF3C861CA0F92DD3"><enum>(5)</enum><text>work with entities that provide call-blocking services to address one-ring scams; and</text></paragraph> 
<paragraph id="H6C495C15E2114BAE9282765E888DD150"><enum>(6)</enum><text>establish obligations on international gateway providers that are the first point of entry for these calls into the United States, including potential requirements that such providers verify with the foreign originator the nature or purpose of calls before initiating service.</text></paragraph></subsection> <subsection id="HCCA151372DE247BF8DBDDECB16B91082"><enum>(c)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of the enactment of this Act, the Commission shall publish on its website and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the status of the proceeding required by subsection (a).</text></subsection> 
<subsection id="HF8BE095EF0CB4A76A5660C9D4C4AC547"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HD2900187471B4B9B8044AAB0E2A02261"><enum>(1)</enum><header>One-ring scam</header><text>The term <quote>one-ring scam</quote> means a scam in which a caller makes a call and allows the call to ring the called party for a short duration, in order to prompt the called party to return the call, thereby subjecting the called party to charges.</text></paragraph> 
<paragraph id="HEC0855992F364430B91E35712016E127"><enum>(2)</enum><header>State</header><text>The term <quote>State</quote> has the meaning given such term in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text></paragraph> <paragraph id="H089F2CEACCC9409EADD87DE76E2ABE83"><enum>(3)</enum><header>Voice service</header><text>The term <quote>voice service</quote> has the meaning given such term in section 227(e)(8) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(8)</external-xref>). This paragraph shall apply before the effective date of the amendment made to such section by subparagraph (C) of section 503(a)(2) of division P of the Consolidated Appropriations Act, 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>) as if such amendment was already in effect.</text></paragraph></subsection></section> 
<section id="H269BE45B25804B4F9A6FFA17DB48AEDF"><enum>13.</enum><header>Annual robocall report</header> 
<subsection id="HA2BC9983B60C431B92A4439F07701100"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Commission shall make publicly available on the website of the Commission, and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, a report on the status of private-led efforts to trace back the origin of suspected unlawful robocalls by the registered consortium and the participation of voice service providers in such efforts.</text></subsection> <subsection id="H7725DBBF41EB47D798DB308CA7280A11"><enum>(b)</enum><header>Contents of report</header><text>The report required under subsection (a) shall include, at minimum, the following:</text> 
<paragraph id="H75F0B0A8B8764C229C49BBA5B1FECF5C"><enum>(1)</enum><text>A description of private-led efforts to trace back the origin of suspected unlawful robocalls by the registered consortium and the actions taken by the registered consortium to coordinate with the Commission.</text></paragraph> <paragraph id="H01C43E8F66144A138023B142DB18DCC8"><enum>(2)</enum><text>A list of voice service providers identified by the registered consortium that participated in private-led efforts to trace back the origin of suspected unlawful robocalls through the registered consortium.</text></paragraph> 
<paragraph id="H1EF191F9339246C591228246C9B95F5F"><enum>(3)</enum><text>A list of each voice service provider that received a request from the registered consortium to participate in private-led efforts to trace back the origin of suspected unlawful robocalls and refused to participate, as identified by the registered consortium.</text></paragraph> <paragraph id="H24BE56FBFBD041BF9C0FC01E8810D281"><enum>(4)</enum><text>The reason, if any, each voice service provider identified by the registered consortium provided for not participating in private-led efforts to trace back the origin of suspected unlawful robocalls.</text></paragraph> 
<paragraph id="HFF500CC1324E4CC8887465CD0F83702B"><enum>(5)</enum><text>A description of how the Commission may use the information provided to the Commission by voice service providers or the registered consortium that have participated in private-led efforts to trace back the origin of suspected unlawful robocalls in the enforcement efforts by the Commission.</text></paragraph></subsection> <subsection id="H20479FFB108543B7B61FBBA2AE82B9F5"><enum>(c)</enum><header>Additional information</header><text>Not later than 210 days after the date of the enactment of this Act, and annually thereafter, the Commission shall issue a notice to the public seeking additional information from voice service providers and the registered consortium of private-led efforts to trace back the origin of suspected unlawful robocalls necessary for the report by the Commission required under subsection (a).</text></subsection> 
<subsection id="H9B4B394B795F490FBBDE221BB95C87DD"><enum>(d)</enum><header>Registration of consortium of private-Led efforts To trace back the origin of suspected unlawful robocalls</header> 
<paragraph id="H7999A414FC7046B0800C917A8C55FA1B"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Commission shall issue rules to establish a registration process for the registration of a single consortium that conducts private-led efforts to trace back the origin of suspected unlawful robocalls. The consortium shall meet the following requirements:</text> <subparagraph id="HF25239854A8D45679A0E15FCC0184F02"><enum>(A)</enum><text>Be a neutral third party competent to manage the private-led effort to trace back the origin of suspected unlawful robocalls in the judgement of the Commission.</text></subparagraph> 
<subparagraph id="H13ACF9EEC2FC421D99C090AD03BC6B59"><enum>(B)</enum><text>Maintain a set of written best practices about the management of such efforts and regarding providers of voice services’ participation in private-led efforts to trace back the origin of suspected unlawful robocalls.</text></subparagraph> <subparagraph id="H24FDB04D2C814997B3EF9617BBF8BC25"><enum>(C)</enum><text>Consistent with section 222(d)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/222">47 U.S.C. 222(d)(2)</external-xref>), any private-led efforts to trace back the origin of suspected unlawful robocalls conducted by the third party focus on <quote>fraudulent, abusive, or unlawful</quote> traffic.</text></subparagraph> 
<subparagraph id="H3787BF7B81D94BB8A246C814C8546A67"><enum>(D)</enum><text>File a notice with the Commission that the consortium intends to conduct private-led efforts to trace back in advance of such registration.</text></subparagraph></paragraph> <paragraph id="H7AA674D6BCA3473CAD417A4877BC6834"><enum>(2)</enum><header>Annual notice by the Commission seeking registrations</header><text>Not later than 120 days after the date of the enactment of this Act, and annually thereafter, the Commission shall issue a notice to the public seeking the registration described in paragraph (1).</text></paragraph></subsection> 
<subsection id="HF2C63E8C0CE04D218291F41BC1361EF7"><enum>(e)</enum><header>List of voice service providers</header><text>The Commission may publish a list of voice service providers and take appropriate enforcement action based on information obtained from the consortium about voice service providers that refuse to participate in private-led efforts to trace back the origin of suspected unlawful robocalls, and other information the Commission may collect about voice service providers that are found to originate or transmit substantial amounts of unlawful robocalls.</text></subsection> <subsection id="H6E71B672EC7B4EE3996E7481730CB8C8"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HF509039CBE4D425F82C3A869C98B251A"><enum>(1)</enum><header>Private-led effort to trace back</header><text>The term <quote>private-led effort to trace back</quote> means an effort made by the registered consortium of voice service providers to establish a methodology for determining the origin of a suspected unlawful robocall.</text></paragraph> <paragraph id="HA7155EDC27A14739A41B6FDEA2FECA8E"><enum>(2)</enum><header>Registered consortium</header><text>The term <quote>registered consortium</quote> means the consortium registered under subsection (d).</text></paragraph> 
<paragraph id="H851FB8A8637C4335993B5B8BA361988E"><enum>(3)</enum><header>Suspected unlawful robocall</header><text>The term <quote>suspected unlawful robocall</quote> means a call that the Commission or a voice service provider reasonably believes was made in violation of subsection (b) or (e) of section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>).</text></paragraph> <paragraph id="H2104FC9FCF18491E8897664F69CFC48C"><enum>(4)</enum><header>Voice service</header><text>The term <quote>voice service</quote>—</text> 
<subparagraph id="HB9A391A4B5D14F9BA58F03E892002947"><enum>(A)</enum><text>means any service that is interconnected with the public switched telephone network and that furnishes voice communications to an end user using resources from the North American Numbering Plan or any successor to the North American Numbering Plan adopted by the Commission under section 251(e)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/251">47 U.S.C. 251(e)(1)</external-xref>); and</text></subparagraph> <subparagraph id="H0287A470D74C47F2A29B9C404FD09000"><enum>(B)</enum><text>includes—</text> 
<clause id="HDC5683BC94B54D9A8DD9F119BFAA5F52"><enum>(i)</enum><text>transmissions from a telephone facsimile machine, computer, or other device to a telephone facsimile machine; and</text></clause> <clause id="H82DD1028309E4764BE404BAA96B9B2A5"><enum>(ii)</enum><text>without limitation, any service that enables real-time, two-way voice communications, including any service that requires internet protocol-compatible customer premises equipment (commonly known as <quote>CPE</quote>) and permits out-bound calling, whether or not the service is one-way or two-way voice over internet protocol.</text></clause></subparagraph></paragraph></subsection></section> 
<section id="HF7CABE54803A44B4AAEF7807C4360C5C"><enum>14.</enum><header>Hospital Robocall Protection Group</header> 
<subsection id="H2EACAFF0222F4E57924EB039A315EC95"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of the enactment of this Act, the Commission shall establish an advisory committee to be known as the <quote>Hospital Robocall Protection Group</quote>.</text></subsection> <subsection id="H01DF36EA91584EC4B20681FF18F253F4"><enum>(b)</enum><header>Membership</header><text>The Group shall be composed only of the following members:</text> 
<paragraph id="H39B74A4837F44B2EB487FA6FD09BA20D"><enum>(1)</enum><text>An equal number of representatives from each of the following:</text> <subparagraph id="H522E9EEF70CF469D8F7133EDD36325DE"><enum>(A)</enum><text>Voice service providers that serve hospitals.</text></subparagraph> 
<subparagraph id="H5C05AAA0EEBD45329E15386EF9F0601C"><enum>(B)</enum><text>Companies that focus on mitigating unlawful robocalls.</text></subparagraph> <subparagraph id="H2C5A112A07CC4190BED8A2E641D60757"><enum>(C)</enum><text>Consumer advocacy organizations.</text></subparagraph> 
<subparagraph id="HAA5DCD95964747259CE445C0B2D8D267"><enum>(D)</enum><text>Providers of one-way voice over internet protocol services described in subsection (e)(3)(B)(ii).</text></subparagraph> <subparagraph id="H219701CFDE6144BA861247D2887DDB32"><enum>(E)</enum><text>Hospitals.</text></subparagraph> 
<subparagraph id="H98FC14385B014724928AB45DBF8290BD"><enum>(F)</enum><text>State government officials focused on combating unlawful robocalls.</text></subparagraph></paragraph> <paragraph id="HD13CAC1F6D12427CB0A095C54B26BB6A"><enum>(2)</enum><text>One representative of the Commission.</text></paragraph> 
<paragraph id="H8788022188DB46EF981E3B60F119B33C"><enum>(3)</enum><text>One representative of the Federal Trade Commission.</text></paragraph></subsection> <subsection id="HEE329D1C9C0F41A09D4BF5029821F3B1"><enum>(c)</enum><header>Issuance of best practices</header><text>Not later than 180 days after the date on which the Group is established under subsection (a), the Group shall issue best practices regarding the following:</text> 
<paragraph id="HE6C010AFB32E4214AF051F2867CF9DE4"><enum>(1)</enum><text>How voice service providers can better combat unlawful robocalls made to hospitals.</text></paragraph> <paragraph id="H8AC783E13D2B41468A9153645E094BC0"><enum>(2)</enum><text>How hospitals can better protect themselves from such calls, including by using unlawful robocall mitigation techniques.</text></paragraph> 
<paragraph id="HF2520EA4FB6C4B7C90ED9CDDBC73E674"><enum>(3)</enum><text>How the Federal Government and State governments can help combat such calls.</text></paragraph></subsection> <subsection id="H1BBDF613037141B49F3280958F145197"><enum>(d)</enum><header>Proceeding by FCC</header><text>Not later than 180 days after the date on which the best practices are issued by the Group under subsection (c), the Commission shall conclude a proceeding to assess the extent to which the voluntary adoption of such best practices can be facilitated to protect hospitals and other institutions.</text></subsection> 
<subsection id="H2B1FE5D867E84AE0B1A9F552CB87FB7E"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H9C58FD69001E4FE0B83BF1324E68A269"><enum>(1)</enum><header>Group</header><text>The term <quote>Group</quote> means the Hospital Robocall Protection Group established under subsection (a).</text></paragraph> 
<paragraph id="H2284B5BB6B1446CEB016121118AE10A9"><enum>(2)</enum><header>State</header><text>The term <quote>State</quote> has the meaning given such term in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text></paragraph> <paragraph id="H88A3CE3609B2498CA72ADE0027D3C4B9"><enum>(3)</enum><header>Voice service</header><text>The term <quote>voice service</quote>—</text> 
<subparagraph id="H24480F8FD1654D58B205ADB478DE77DA"><enum>(A)</enum><text>means any service that is interconnected with the public switched telephone network and that furnishes voice communications to an end user using resources from the North American Numbering Plan or any successor to the North American Numbering Plan adopted by the Commission under section 251(e)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/251">47 U.S.C. 251(e)(1)</external-xref>); and</text></subparagraph> <subparagraph id="H2351B9F7A9CA4AC897A52E9D02D5E049"><enum>(B)</enum><text>includes—</text> 
<clause id="HEF5D643FC02248A8880010179EA6B292"><enum>(i)</enum><text>transmissions from a telephone facsimile machine, computer, or other device to a telephone facsimile machine; and</text></clause> <clause id="H150B3752950F486B98D6A836DC745AF5"><enum>(ii)</enum><text>without limitation, any service that enables real-time, two-way voice communications, including any service that requires internet protocol-compatible customer premises equipment (commonly known as <quote>CPE</quote>) and permits out-bound calling, whether or not the service is one-way or two-way voice over internet protocol.</text></clause></subparagraph></paragraph></subsection></section> 
<section id="H2A2774C1A1F4441FBBEA785C9BDE10AE"><enum>15.</enum><header>Separability Clause</header><text display-inline="no-display-inline">If any provision of this Act, the amendments made by this Act, or the application thereof to any person or circumstance is held invalid, the remainder of this Act, the amendments made by this Act, and the application of such provision to other persons or circumstances shall not be affected thereby.</text></section> </legis-body> </amendment-block> </amendment></engrossed-amendment-body><attestation><attestation-group><attestor display="no">Karen L.
