 loans.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H9F47EB19971345C6855A4C87D9B5CD7F" style="OLC"><section id="idEC93BBADD452481683210BCEA87FB95F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Joint Consolidation Loan Separation Act</short-title></quote>.</text></section><section id="HBB2783F601F64152B37D1FEEE1DED461"><enum>2.</enum><header>Separating joint consolidation loans</header><subsection id="H7C281D5D845C4F7B92470D65E3238582"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 455(g) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(g)</external-xref>) is amended—</text><paragraph id="H5FADA592DC7341488748549595061198"><enum>(1)</enum><text>by striking <quote>A borrower</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HCB572DE9646B45AAA857F4DBE0A4DF49" style="OLC"><paragraph id="H8BF8B367BE6D449A949A1ECC34C873CF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A borrower</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HD9D047F1DA18457BA28FFCC4B0593187"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HFF67562B86484F448ADFB1D6431289C6" style="OLC"><paragraph id="H59846418D0424E1991B7036A9DAA6C81"><enum>(2)</enum><header>Separating joint consolidation loans</header><subparagraph id="H2AD607B16B15452C9345BAE1C4588FD8"><enum>(A)</enum><header>In general</header><text>A married couple, or 2 individuals who were previously a married couple, and who received a joint consolidation loan as such married couple under subparagraph (C) of section 428C(a)(3) (as such subparagraph was in effect on or before June 30, 2006), may apply to the Secretary for each individual borrower in the married couple (or previously married couple) to receive a separate Federal Direct Consolidation Loan under this part—</text><clause id="H4F8EC941E7B14829AEF6BF56BB9B6CB8"><enum>(i)</enum><text>that shall be equal to the sum of—</text><subclause id="H1C6D30605ADA48CB9E156EF8B39432C1"><enum>(I)</enum><text>the unpaid principal and accrued unpaid interest of the percentage of the joint consolidation loan that, as of the day before such joint consolidation loan was made, was attributable to the loans of the individual borrower for whom such separate consolidation loan is being made; and</text></subclause><subclause id="HD1C0934917EE4E5697E4363D2A5BA0AD"><enum>(II)</enum><text>any other loans described in section 428C(a)(4) that such individual borrower selects for consolidation under this part;</text></subclause></clause><clause id="H3F7F2E28A6A248CCB579E2D6387ABEB2"><enum>(ii)</enum><text display-inline="yes-display-inline">the proceeds of which shall be paid by the Secretary to the holder or holders—</text><subclause id="HEA0DA337CAB945189C174EBB76511F85"><enum>(I)</enum><text display-inline="yes-display-inline">of the joint consolidation loan for the purpose of discharging the liability on the percentage of such joint consolidation loan described in clause (i)(I); and</text></subclause><subclause id="H9D6D2AD92728425DA8351F5BE3DC0436"><enum>(II)</enum><text>of the loans selected for consolidation under clause (i)(II) for the purpose of discharging the liability on such loans;</text></subclause></clause><clause id="H32A6B57A0A4C4F93B376E4833E520B00"><enum>(iii)</enum><text>that has the same rate of interest as the joint consolidation loan;</text></clause><clause id="H94C7FC3477E344D793C903B1695855E4"><enum>(iv)</enum><text display-inline="yes-display-inline">for which any payment made under section 455(m)(1)(A) on the joint consolidation loan during a period in which the individual borrower for whom such separate consolidation loan is being made was employed in a public service job described in section 455(m)(1)(B) shall be treated as if such payment were made on such separate consolidation loan; and</text></clause><clause id="HA5483B648CCC43F0873ED54C147BFD71"><enum>(v)</enum><text display-inline="yes-display-inline">for which any payment made under an income contingent repayment plan or an income-based repayment plan described in subparagraph (D) or (E) of section 455(d)(1), respectively, on the joint consolidation loan shall be treated as if such payment were made on such separate consolidation loan.</text></clause></subparagraph><subparagraph id="HA7B4191A47A842F89A89DE89F641B8CB"><enum>(B)</enum><header>Application for separate direct consolidation loan</header><clause id="H2DD4714C768348C9AB88CB85E38F2B23"><enum>(i)</enum><header>Joint application</header><text>Except as provided in clause (ii), to receive separate consolidation loans under subparagraph (A), both individual borrowers in a married couple (or previously married couple) shall jointly apply under subparagraph (A).</text></clause><clause id="H37EB3F6CB5FF43D1A4269FFF03F05CAE"><enum>(ii)</enum><header>Separate application</header><text display-inline="yes-display-inline">An individual borrower in a married couple (or previously married couple) may apply for a separate consolidation loan under subparagraph (A) separately and without regard to whether or when the other individual borrower in the married couple (or previously married couple) applies under subparagraph (A), in a case in which—</text><subclause id="H70F734163A0E4DF7B0DEA3A55B59B18A"><enum>(I)</enum><text display-inline="yes-display-inline">the individual borrower has experienced from the other individual borrower—</text><item id="HEF717AAF02C840589BB33B5F3C8B2533"><enum>(aa)</enum><text>domestic violence (as defined in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>)); or</text></item><item id="HB1CC168895F74D158D17C98B96DE6636"><enum>(bb)</enum><text>economic abuse (including behaviors that control such borrower’s ability to acquire, use, and maintain access to money, credit, or the joint financial obligations of both borrowers);</text></item></subclause><subclause id="HA2B5D1502F274F779FA409FE9773112F"><enum>(II)</enum><text display-inline="yes-display-inline">the individual borrower certifies, on a form approved by the Secretary, that such borrower is unable to reasonably reach or access the loan information of the other individual borrower; or</text></subclause><subclause id="HEF2941A3BC5D4906B2F17EF869AC834A"><enum>(III)</enum><text>the Secretary determines that authorizing each individual borrower to apply separately under subparagraph (A) would be in the best fiscal interests of the Federal Government.</text></subclause></clause></subparagraph><subparagraph commented="no" id="H89992E3A9D7145CA84BC6127C2EBD43E"><enum>(C)</enum><header>Borrower eligibility</header><text>Notwithstanding section 428C(a)(3)(A), the Secretary shall award a consolidation loan under this part to each borrower who—</text><clause id="H70300BBEC42149658EB7954967F0E22C"><enum>(i)</enum><text>applies for such loan under subparagraph (A); and</text></clause><clause id="H4C146535BC30461D9857C5340B03C9DF"><enum>(ii)</enum><text>meets the requirements of subparagraphs (A) and (B).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H41B0A2AFDD534FDDB614F3383C4725C1"><enum>(b)</enum><header>Conforming amendment</header><text>Section 428C(a)(3)(B)(i)(V) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-3">20 U.S.C. 1078–3(a)(3)(B)(i)(V)</external-xref>) is amended—</text><paragraph id="H909AB43133C04772AABEC7DFA8E71399"><enum>(1)</enum><text>in item (bb), by striking <quote>or</quote> after the semicolon;</text></paragraph><paragraph id="H3D99BDDC61CC49DBB3204042037AE60D"><enum>(2)</enum><text>in item (cc), by striking the period and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H4D855E86DDFA4DB39E25B4BE7AA38AD1"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H748E5A2FA954452BB0CBC1D28050F701" style="OLC"><item id="HBD490B3D32924B0CB5535F198BE14C72"><enum>(dd)</enum><text display-inline="yes-display-inline">for the purpose of separating a joint consolidation loan into 2 separate Federal Direct Consolidation Loans under section 455(g)(2).</text></item><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
