			 reduced exports resulting from tariffs imposed as retaliation for United
 States tariff increases, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="HB2E2FB36687042FEA4A417A808E5E9D1" style="OLC"><section id="HC2E17B12468A49809D888E855A95F0BC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Assistance for Farmers Harmed by Tariffs on Exports Act</short-title></quote>.</text></section><section id="H345561386E5F4C9D89FF65DD6B63CFF4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HCC9F100CC0DF4F6184A88E56046D47BF"><enum>(1)</enum><text>In recognition that trade policy can result in disparate and disruptive changes to the economy, the trade adjustment assistance program under title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2251">19 U.S.C. 2251</external-xref> et seq.) was enacted to help workers adversely impacted by the trade policy decisions of the Federal Government.</text></paragraph><paragraph id="HF57B6DD5083F462DB8836347687743F0"><enum>(2)</enum><text>Federal trade statutes, including section 232 of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862</external-xref>), section 301 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2411">19 U.S.C. 2411</external-xref>), and potentially the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.), are being used aggressively to increase tariffs on selected imports.</text></paragraph><paragraph id="HF017478C6CCF46FA83BD22E4E37A70D9"><enum>(3)</enum><text>Foreign countries affected by such tariff increases have, as of the date of the enactment of this Act, already raised tariffs on United States agricultural exports or have indicated that they intend to respond by raising tariffs on such agricultural exports.</text></paragraph><paragraph id="HA89041DCD1234B03955414637180B3BC"><enum>(4)</enum><text display-inline="yes-display-inline">Increased tariffs on such agricultural exports threaten to cost United States agricultural producers global market share and reduce the income of producers in affected commodities.</text></paragraph><paragraph id="HD1E07A89A9EE483FA3A5950D89757E5E"><enum>(5)</enum><text display-inline="yes-display-inline">Farmers adversely impacted by the effects of increased tariffs on such agricultural exports deserve adjustment assistance.</text></paragraph></section><section id="HC3345BBA7E814DD6ACB815FEA0563111"><enum>3.</enum><header>Adjustment assistance for retaliatory tariff increases</header><text display-inline="no-display-inline">Section 292(c) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2401a">19 U.S.C. 2401a(c)</external-xref>) is amended—</text><paragraph id="HF7608F94D69743ACB6DB1F8D6F1028C6"><enum>(1)</enum><text>by striking paragraphs (2) and (3); and</text></paragraph><paragraph id="H647AE390F81C4C06853E42F18AE818C1"><enum>(2)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="HBF1740D485D44E378BDE52047FC4D5CE" style="OLC"><paragraph id="H014864EC06EC4DA4A282BC36980B8894"><enum>(2)</enum><text display-inline="yes-display-inline">either—</text><subparagraph id="HA1976DE330D346B892FDAFF4D08F3569"><enum>(A)</enum><text display-inline="yes-display-inline">the volume of imports of articles like, or directly competitive with, the agricultural commodity produced by the group in the marketing year with respect to which the group files the petition increased compared to the average volume of such imports during the 3 marketing years preceding such marketing year; or</text></subparagraph><subparagraph id="HE4998656C88C4C678ADF07BB256720EA"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HC5C7724E8EF74F00A5DA43B0674DC663"><enum>(i)</enum><text display-inline="yes-display-inline">the volume of exports of the agricultural commodity produced by the group in the marketing year with respect to which the group files the petition decreased compared to the average volume of such exports during the 3 marketing years preceding such marketing year; and</text></clause><clause id="H9654A734B89241DD8E5D89D99A7C4C4E" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the decrease in exports described in clause (i) resulted in whole or in part from duties imposed on such exports by a foreign country in response to duties imposed by the United States on imports from such country pursuant to action taken under the authority of—</text><subclause id="H86E383E76E8D413E859AF3CFFD403911"><enum>(I)</enum><text>section 232 of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862</external-xref>);</text></subclause><subclause id="H0D4E96AED61A41F3AE6D87D70DC45CB1"><enum>(II)</enum><text>section 301 of this Act (<external-xref legal-doc="usc" parsable-cite="usc/19/2411">19 U.S.C. 2411</external-xref>); or</text></subclause><subclause id="H9AB6FE1EAA2A4A999B46FEB07A0F9E90"><enum>(III)</enum><text>the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> et seq.); and</text></subclause></clause></subparagraph></paragraph><paragraph id="H925EDA63915347F2AA398811831B5D98"><enum>(3)</enum><text display-inline="yes-display-inline">the increase in imports described in paragraph (2)(A) or the decrease in exports described in paragraph (2)(B) contributed importantly to the decrease in the national average price, quantity of production, or value of production of, or cash receipts for, the agricultural commodity, as described in paragraph (1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
