			<section id="H7F0F04AAABA646F2B15CF5B9A49A0FD5"><enum>101.</enum><header>Authorization of the Maritime Administration</header>
 <subsection id="H18BADBEDC06E4C4BACC99E43F85EF37F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Department of Transportation for fiscal year 2020, to be available without fiscal year limitation if so provided in appropriations Acts, for programs associated with maintaining the United States Merchant Marine, the following amounts:</text>
 <paragraph id="H1B0A9E129F794ACB8D20AFD043E85AA3"><enum>(1)</enum><text>For expenses necessary for operations of the United States Merchant Marine Academy, $95,944,000, of which—</text>
 <subparagraph id="HF417359911B44CD6B117A412F9C2B50D"><enum>(A)</enum><text>$77,944,000 shall remain available until September 30, 2021 for Academy operations; and</text> </subparagraph><subparagraph id="HA520343BE59D41CEA7956808BF25E8D3"><enum>(B)</enum><text>$18,000,000 shall remain available until expended for capital asset management at the Academy.</text>
 </subparagraph></paragraph><paragraph id="H6628A88898E04CE2927BCAB5FD8336F0"><enum>(2)</enum><text>For expenses necessary to support the State maritime academies, $50,280,000, of which—</text> <subparagraph id="HE3DB69BCF656481A9C874CBFB64171E8"><enum>(A)</enum><text>$2,400,000 shall remain available until September 30, 2021, for the Student Incentive Program;</text>
 </subparagraph><subparagraph id="H9D7A222CD132436B81D4C4DE135120F2"><enum>(B)</enum><text display-inline="yes-display-inline">$6,000,000 shall remain available until expended for direct payments to such academies;</text> </subparagraph><subparagraph id="HD7A5AE56D6CC4695A139E20B85242776"><enum>(C)</enum><text>$30,080,000 shall remain available until expended for maintenance and repair of State maritime academy training vessels;</text>
 </subparagraph><subparagraph id="H8375697ED1144F4FA0E56931E370D6F0"><enum>(D)</enum><text display-inline="yes-display-inline">$3,800,000 shall remain available until expended for training ship fuel assistance; and</text> </subparagraph><subparagraph id="id206c83f9024a4607b8f0f1b2e15dd110"><enum>(E)</enum><text>$8,000,000 shall remain available until expended for offsetting the costs of training ship sharing.</text>
 </subparagraph></paragraph><paragraph id="H542D6A8E7F9D4A0CBD9A6DF590D5A3E7"><enum>(3)</enum><text>For expenses necessary to support the National Security Multi-Mission Vessel Program, $300,000,000, which shall remain available until expended.</text>
 </paragraph><paragraph id="H58D2C75A3E3146DFBCEFC49C9A8968F8"><enum>(4)</enum><text display-inline="yes-display-inline">For expenses necessary to support Maritime Administration operations and programs, $60,442,000, of which $5,000,000 shall remain available until expended for activities authorized under section 50307 of title 46, United States Code.</text>
 </paragraph><paragraph id="HB6DE10AC70664EDEA9DD6A6B8CFF58DE"><enum>(5)</enum><text>For expenses necessary to dispose of vessels in the National Defense Reserve Fleet, $5,000,000, which shall remain available until expended.</text>
 </paragraph><paragraph id="HA419EFBFA3B546CFA473329E3C950735"><enum>(6)</enum><text>For expenses necessary to maintain and preserve a United States flag Merchant Marine to serve the national security needs of the United States under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/531">chapter 531</external-xref> of title 46, United States Code, $300,000,000, which shall remain available until expended.</text>
 </paragraph><paragraph id="HA067AF78A65F4D339EE8D92B0781A9A1"><enum>(7)</enum><text>For expenses necessary for the loan guarantee program authorized under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/537">chapter 537</external-xref> of title 46, United States Code, $33,000,000, of which—</text>
 <subparagraph id="H0FE7B31C01CE492787B2DC4DA6E712A9"><enum>(A)</enum><text>$30,000,000 may be used for the cost (as defined in section 502(5) of the Federal Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a(5)</external-xref>) of loan guarantees under the program, which shall remain available until expended; and</text>
 </subparagraph><subparagraph id="H6D01290C39DC4FD2B6731DB48B2F57EC"><enum>(B)</enum><text>$3,000,000 may be used for administrative expenses relating to loan guarantee commitments under the program.</text>
 </subparagraph></paragraph><paragraph id="HFB9BD8F04C9B42B59E31208561801E55"><enum>(8)</enum><text display-inline="yes-display-inline">For expenses necessary to provide assistance to small shipyards and for maritime training programs under section 54101 of title 46, United States Code, $40,000,000, which shall remain available until expended.</text>
 </paragraph><paragraph id="id1520e1403a7c43deb0a0b6bff38d77c1"><enum>(9)</enum><text>For expenses necessary to implement the Port Operations, Research, and Technology Act, $600,000,000, except that no funds shall be used for a grant award to purchase fully automated cargo handling equipment that is remotely operated or remotely monitored with or without the exercise of human intervention or control, if the Secretary determines such equipment would result in a net loss of jobs that relate to the movement of goods through a port and its intermodal connections.</text>
					</paragraph></subsection></section><section id="idb9f1afdaf9a5428f8df01fa178b36cc3"><enum>102.</enum><header>Maritime Security Program</header>
 <subsection id="id25927e9d6091415dbd2c973c2bf9a4d4"><enum>(a)</enum><header>Award of operating agreements</header><text>Section 53103 of title 46, United States Code, is amended by striking <quote>2025</quote> each place it appears and inserting <quote>2035</quote>.</text> </subsection><subsection id="id1ef06899adfa4555aee47626440a0640"><enum>(b)</enum><header>Effectiveness of operating agreements</header><text>Section 53104(a) of title 46, United States Code, is amended by striking <quote>2025</quote> and inserting <quote>2035</quote>.</text>
 </subsection><subsection id="id2c9a133fcd0448a69eea31a45d3ebd89"><enum>(c)</enum><header>Payments</header><text>Section 53106(a)(1) of title 46, United States Code, is amended—</text> <paragraph id="id6f688cbdc99345b9a57d4046a6a455d4"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> after the semicolon;</text>
 </paragraph><paragraph id="id9b7a48f80c9d463bacdade1a2cb3b52b"><enum>(2)</enum><text>in subparagraph (C), by striking <quote>$3,700,000 for each of fiscal years 2022, 2023, 2024, and 2025.</quote> and inserting <quote>$5,233,463 for each of fiscal years 2022, 2023, 2024, and 2025; and</quote>; and</text> </paragraph><paragraph id="id5ac5b7da34a2438d8914ccc5c1707835"><enum>(3)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id1822a91fc18141699808cc5237d695d4" style="OLC">
 <subparagraph id="id731cb18bf6a84e6094a5586b1e54a0cf"><enum>(D)</enum><text>$5,233,463 for each of fiscal years 2026 through 2035.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="id96b33ec428a64e2292f9dd4de523b02e"><enum>(d)</enum><header>Authorization of appropriations</header><text>Section 53111 of title 46, United States Code, is amended—</text>
 <paragraph id="id9191f658f57f49dfb5c81d51e325b5bd"><enum>(1)</enum><text>in paragraph (2), by striking <quote>and</quote> after the semicolon;</text> </paragraph><paragraph id="idb6c1ebb27b00449db2b993eb43a6f182"><enum>(2)</enum><text>in paragraph (3), by striking <quote>$222,000,000 for each fiscal year thereafter through fiscal year 2025.</quote> and inserting <quote>$314,007,780 for each of fiscal years 2022, 2023, 2024, and 2025; and</quote>; and</text>
 </paragraph><paragraph id="id127aa55259cd4643a13d82184918cf81"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id039742e7b2ec45aeb691ed89328a98ba" style="OLC"> <paragraph id="ide1471efb88ae48519f2bc6f537e86fa9"><enum>(4)</enum><text>$314,007,780 for each of fiscal years 2026 through 2035.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="idfd6f77f08b4f40a9b5d62a4ac138b370"><enum>103.</enum><header>Department of Transportation Inspector General Report</header><text display-inline="no-display-inline">The Inspector General of the Department of Transportation shall—</text> <paragraph id="ide4dc4b54a58047678d63e9cb79362385"><enum>(1)</enum><text>not later than 180 days after the date of enactment of this Act, initiate an audit of the Maritime Administration’s actions to address the 27 recommendations for improvement identified by a National Academy of Public Administration panel in a November 2017 report; and</text>
 </paragraph><paragraph id="iddee40014a3fc4da8865de0b6ed3b07c5"><enum>(2)</enum><text>submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report containing the results of that audit once the audit is completed.</text>
 </paragraph></section><section id="id80d28e4948bc4df999c28efef72f77e4"><enum>104.</enum><header>Authority for MARAD to retain foreign student tuition reimbursement</header><text display-inline="no-display-inline">Section 51304 of title 46, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id4dbd0145b8ab455bbd36d04f675526ac" style="OLC"> <subsection id="id13397f5e3dfe416e8802903d0e8cec82"><enum>(e)</enum><header>Credit of reimbursement</header><text>Reimbursements under this section shall be credited to the Maritime Administration’s Operations and Training appropriation, to remain available until expended, for use only for those expenses related to the operations of the United States Merchant Marine Academy.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="id53c4f414f60545309d559cdd7e62f305"><enum>105.</enum><header>Appointment of candidates attending sponsored preparatory school</header><text display-inline="no-display-inline">Section 51303 of title 46, United States Code, is amended—</text> <paragraph id="idff73538ada9c4d0292fb4d037e8b8a74"><enum>(1)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id45169A3D88E94E6E91D011C5E4199BCE" style="OLC">
 <subsection id="id734156D003D94D6389C9FF83A9F863F6"><enum>(a)</enum><header>In General</header><text>The Secretary</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="id6a759d9ccef0493e9963698bfb27f6eb"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id89ddd312490a4f4baee3d660d0cf4692" style="OLC">
 <subsection id="id7dce418a714b4916a02d07b8fe3a9521"><enum>(b)</enum><header>Appointment of candidates selected for preparatory school sponsorship</header><text>The Secretary of Transportation may appoint each year as cadets at the United States Merchant Marine Academy not more than 40 qualified individuals sponsored by the Academy to attend preparatory school during the academic year prior to entrance in the Academy, and who have successfully met the terms and conditions of sponsorship set by the Academy.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" id="id924b1fb2f4e5467aa2381224481d2a57"><enum>106.</enum><header>Independent study on the United States Merchant Marine Academy</header>
 <subsection id="id17719140e9174c88aa2c1b248cd09e81"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall seek to enter into an agreement with the National Academy of Public Administration (referred to in this section as the <quote>Academy</quote>) to carry out the activities described in this section.</text>
 </subsection><subsection id="idf4dc527b7e9e479591207041c69781de"><enum>(b)</enum><header>Study elements</header><text>In accordance with the agreement described in subsection (a), the Academy shall conduct a study of the United States Merchant Marine Academy that consists of the following:</text>
 <paragraph id="id9655b1111d9a40d7a030514c7aca1e91"><enum>(1)</enum><text>A comprehensive assessment of the United States Merchant Marine Academy’s systems, training, facilities, infrastructure, information technology, and stakeholder engagement.</text>
 </paragraph><paragraph id="id77035e015d6a49a9a8f955aa5039f0b9"><enum>(2)</enum><text>Identification of needs and opportunities for modernization to help the United States Merchant Marine Academy keep pace with more modern campuses.</text>
 </paragraph><paragraph id="id3a470038cd0a4d5b82cb303f5b0e2f11"><enum>(3)</enum><text>Development of an action plan for the United States Merchant Marine Academy with specific recommendations for—</text>
 <subparagraph id="ide793b421501e459ebc1f1ad6bb2d3492"><enum>(A)</enum><text>improvements or updates relating to the opportunities described in paragraph (2); and</text> </subparagraph><subparagraph id="id4c791859985c460e8e1bf9bf34c9819f"><enum>(B)</enum><text>systemic changes needed to help the United States Merchant Marine Academy achieve its mission of inspiring and educating the next generation of the mariner workforce on a long-term basis.</text>
 </subparagraph></paragraph></subsection><subsection id="id30c63dd83d34481488331c8669eec793"><enum>(c)</enum><header>Deadline and report</header><text>Not later than 1 year after the date of the agreement described in subsection (a), the Academy shall prepare and submit to the Administrator of the Maritime Administration a report containing the action plan described in subsection (b)(3), including specific findings and recommendations.</text>
 </subsection></section><section id="id2EB7082825814782A739D26CD4A54812"><enum>107.</enum><header>Centers of excellence for domestic maritime workforce training and education</header><text display-inline="no-display-inline">Section 54102 of title 46, United States Code, is amended—</text> <paragraph id="id73308E2F4AB744C88B9985A9CD719098"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by inserting <quote>or subsection (d)</quote> after <quote>designated under subsection (a)</quote>; and</text>
 </paragraph><paragraph id="idE8DFDE4364C3443D892F17F89C1ACCCE"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idAF59B6FA4A8E461B9C724434A3E3809E" style="OLC"> <subsection id="idCCA66B5F8BC04E1D9A6858DE7745D9C2"><enum>(d)</enum><header>State Maritime Academy</header><text>The Secretary of Transportation shall designate each State maritime academy, as defined in section 51102(4) of this title, as a center of excellence under this section.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block>
				</paragraph></section><section id="id82c7d8c84bc14253ba4aebdbfe9440b7"><enum>108.</enum><header>Military to mariner</header>
 <subsection id="idff7c42860fb243b0b5899944dfdb3480"><enum>(a)</enum><header>Credentialing support</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Defense, the Secretary of Homeland Security, the Secretary of Commerce, and the Secretary of Health and Human Services, with respect to the applicable services in their respective departments, and in coordination with one another and with the United States Committee on the Marine Transportation System, shall, consistent with applicable law, identify all training and experience within the applicable service that may qualify for merchant mariner credentialing, and submit a list of all identified training and experience to the United States Coast Guard National Maritime Center for a determination of whether such training and experience counts for credentialing purposes.</text>
 </subsection><subsection commented="no" id="id558a4e50e3394489a905ee80d177da01"><enum>(b)</enum><header>Review of applicable service</header><text>The United States Coast Guard Commandant shall make a determination of whether training and experience counts for credentialing purposes, as described in subsection (a), not later than 6 months after the date on which the United States Coast Guard National Maritime Center receives a submission under subsection (a) identifying a training or experience and requesting such a determination.</text>
 </subsection><subsection id="idfd8793090cb9458a8fcda9bf6ff81f93"><enum>(c)</enum><header>Fees and services</header><text>The Secretary of Defense, the Secretary of Homeland Security, the Secretary of Commerce, and the Secretary of Health and Human Services shall—</text>
 <paragraph id="idb11fdb175fd4490da351708c38a65c98"><enum>(1)</enum><text>take all necessary and appropriate actions to provide for the waiver of fees through the National Maritime Center license evaluation, issuance, and examination for members of the uniformed services on active duty or separated members of the uniformed services, if a waiver is authorized and appropriate, and, if a waiver is not granted, take all necessary and appropriate actions to provide for the payment of fees for members of the uniformed services on active duty or separated members of the uniformed services by the applicable service to the fullest extent permitted by law;</text>
 </paragraph><paragraph id="id2781446cc6094ba8a71923a17b21f17a"><enum>(2)</enum><text>direct the applicable services to take all necessary and appropriate actions to pay for Transportation Worker Identification Credential cards for members of the uniformed services on active duty or separated members of the uniformed services pursuing or possessing a mariner credential;</text>
 </paragraph><paragraph id="idc83b5aca443e4735a52852a95cbbe931"><enum>(3)</enum><text>ensure that members of the applicable services who are to be discharged or released from active duty and who request certification or verification of sea service be provided such certification or verification no later than one month after discharge or release;</text>
 </paragraph><paragraph id="iddadb2b56a98b46819259a942802762bc"><enum>(4)</enum><text>ensure the applicable services have developed, or continue to operate, as appropriate, the online resource known as Credentialing Opportunities On-Line to support separating members of the uniformed services who are seeking information and assistance on merchant mariner credentialing; and</text>
 </paragraph><paragraph id="idcdb5554317d74d819b921755ca793fbf"><enum>(5)</enum><text>not later than 1 year after the date of enactment of this section, take all necessary and appropriate actions to apply service-related medical certifications to merchant mariner credential requirements.</text>
					</paragraph></subsection><subsection id="id557eea2e391d4c51b564ddab806e439e"><enum>(d)</enum><header>Advancing military to mariner within the employer agencies</header>
 <paragraph id="id84E245D15BEA4B90B582C9E7140DA697"><enum>(1)</enum><header>In general</header><text>The Secretary of Defense, the Secretary of Homeland Security, the Secretary of Commerce, and the Secretary of Health and Human Services shall have direct hiring authority to employ separated members of the uniformed services with valid merchant mariner licenses or sea service experience in support of United States national maritime needs, including the Army Corps of Engineers, U.S. Customs and Border Protection, and the National Oceanic and Atmospheric Administration.</text>
 </paragraph></subsection><subsection id="idEFA9739788F34D5BBF82EE05CA06A8E7"><enum>(e)</enum><header>Separated member of the uniformed services</header><text>In this section, the term <term>separated member of the uniformed services</term> means an individual who—</text> <paragraph id="id4DDB6254C1E5480EAD85FD56C74CAEE7"><enum>(1)</enum><text>is retiring or is retired as a member of the uniformed services;</text>
 </paragraph><paragraph id="id39BD684358E846A7A26620F6D4F8617A"><enum>(2)</enum><text>is voluntarily separating or voluntarily separated from the uniformed services at the end of enlistment or service obligation; or</text>
 </paragraph><paragraph id="id2F29EE2E96134C92B7F87ADEB731F6A4"><enum>(3)</enum><text>is administratively separating or has administratively separated from the uniformed services with an honorable or general discharge characterization.</text>
 </paragraph></subsection></section><section id="ide5e473b5c328462987aef1b3cbbc867f"><enum>109.</enum><header>Salvage recoveries of federally owned cargoes</header><text display-inline="no-display-inline">Section 57100 of title 46, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idC39FB314BAD34D66BE0D132DD3C229A0" style="OLC"> <subsection id="ida33af23a56384c23aff872da67462ec9"><enum>(h)</enum><header>Funds transfer authority related to the use of National Defense Reserve Fleet vessels and the provision of maritime-Related services</header> <paragraph id="iddd12e2aedc09423a90d2291a6653e3c0"><enum>(1)</enum><header>In General</header><text>When the Secretary of Transportation provides for the use of its vessels or maritime-related services and goods under a reimbursable agreement with a Federal entity, or State or local entity, authorized to receive goods and services from the Maritime Administration for programs, projects, activities, and expenses related to the National Defense Reserve Fleet or maritime-related services:</text>
 <subparagraph id="idf4c03b5fec18459c922c9050f2dd68ca"><enum>(A)</enum><text>Federal entities are authorized to transfer funds to the Secretary in advance of expenditure or upon providing the goods or services ordered, as determined by the Secretary.</text>
 </subparagraph><subparagraph id="id85b96965dfd1484da24761c9462529f3"><enum>(B)</enum><text>The Secretary shall determine all other terms and conditions under which such payments should be made and provide such goods and services using its existing or new contracts, including general agency agreements, memoranda of understanding, or similar agreements.</text>
							</subparagraph></paragraph><paragraph id="id52a1f4c1466442f991436da5c92dd3b1"><enum>(2)</enum><header>
			 Reimbursable agreement with a Federal entity</header>
 <subparagraph id="idE05079CB7BE04EC6AF807C50C1D7549C"><enum>(A)</enum><header>In General</header><text>The Maritime Administration is authorized to provide maritime-related services and goods under a reimbursable agreement with a Federal entity.</text>
 </subparagraph><subparagraph id="id3563fb2bf5504b4cbb1709327ebe36a0"><enum>(B)</enum><header>Maritime-related services defined</header><text>For the purposes of this subsection, maritime-related services includes the acquisition, procurement, operation, maintenance, preservation, sale, lease, charter, construction, reconstruction, or reconditioning (including outfitting and equipping incidental to construction, reconstruction, or reconditioning) of a merchant vessel or shipyard, ship site, terminal, pier, dock, warehouse, or other installation related to the maritime operations of a Federal entity.</text>
							</subparagraph></paragraph><paragraph id="id70369ad6fb4841b8aa90bc6034489b0e"><enum>(3)</enum><header>Salvaging cargoes</header>
 <subparagraph id="id9208291ADC214FF4B13DFA37B026922D"><enum>(A)</enum><header>In General</header><text>The Maritime Administration may provide services and purchase goods relating to the salvaging of cargoes aboard vessels in the custody or control of the Maritime Administration or its predecessor agencies and receive and retain reimbursement from Federal entities for all such costs as it may incur.</text>
 </subparagraph><subparagraph id="id6ac12229b3904743ab8f6beda954d063"><enum>(B)</enum><header>Reimbursement</header><text>Reimbursement as provided for in subparagraph (A) may come from—</text> <clause id="idA211E6156F194FE499EA5135349A8AD6"><enum>(i)</enum><text>the proceeds recovered from such salvage; or</text>
 </clause><clause id="id69b49d1c90074edaa061b43db25c0fbb"><enum>(ii)</enum><text>the Federal entity for which the Maritime Administration has or will provide such goods and services, depending on the agreement of the parties involved.</text>
 </clause></subparagraph></paragraph><paragraph id="id22a587b9e7ea495abd8fc60beb5b1955"><enum>(4)</enum><header>Amounts received</header><text>Amounts received as reimbursements under this subsection shall be credited to the fund or account that was used to cover the costs incurred by the Secretary or, if the period of availability of obligations for that appropriation has expired, to the appropriation of funds that is currently available to the Secretary for substantially the same purpose. Amounts so credited shall be merged with amounts in such fund or account and shall be available for the same purposes, and subject to the same conditions and limitations, as amounts in such fund or account.</text>
 </paragraph><paragraph id="idfc7c0105d0ae4435bef91b01659fe22b"><enum>(5)</enum><header>Advance Payments</header><text>Payments made in advance shall be for any part of the estimated cost as determined by the Secretary of Transportation. Adjustments to the amounts paid in advance shall be made as agreed to by the Secretary of Transportation and the head of the ordering agency or unit based on the actual cost of goods or services provided.</text>
 </paragraph><paragraph id="id11aa89b3e0b649fb80c396d1ceba41cf"><enum>(6)</enum><header>Bill or request for payment</header><text>A bill submitted or a request for payment is not subject to audit or certification in advance of payment.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="id70bea81b8fd1400595644f0f23f9d485"><enum>110.</enum><header>Salvage recoveries for subrogated ownership of vessels and cargoes</header><text display-inline="no-display-inline">Section 53909 of title 46, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id5975e7717b954e3186fe889144b0940d" style="OLC"> <subsection id="id598370df57274e0fbb825ff86eb17c6d"><enum>(e)</enum><header>Salvage agreements</header><text>Notwithstanding title XIV of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (<external-xref legal-doc="usc" parsable-cite="usc/10/113">10 U.S.C. 113</external-xref> note), the Secretary of Transportation is authorized to enter into marine salvage agreements for the recoveries, sale, and disposal of sunken or damaged vessels, cargoes, or properties owned or insured by or on behalf of the Maritime Administration, the United States Shipping Board, the U.S. Shipping Board Bureau, the United States Maritime Commission, or the War Shipping Administration.</text>
 </subsection><subsection id="id5e2e676160b94dadb71bfd09a339c8c6"><enum>(f)</enum><header>Recoveries</header><text>Notwithstanding other provisions of law, the net proceeds from salvage agreements entered into as authorized in subsection (e) shall remain available until expended and be distributed as follows for marine insurance-related salvages:</text>
 <paragraph id="id1f93689dcc1e43d2bc298b6261d91af1"><enum>(1)</enum><text>Fifty percent of the net funds recovered shall be deposited in the war risk revolving fund and shall be available for the purposes of the war risk revolving fund.</text>
 </paragraph><paragraph id="ida19091f6714549f490a26a6593561529"><enum>(2)</enum><text>Fifty percent of the net funds recovered shall be deposited in the Vessel Operations Revolving Fund as established by section 50301(a) of this title and shall be available until expended as follows:</text>
 <subparagraph id="id52dd9269dc324199878d001078106283"><enum>(A)</enum><text>Fifty percent shall be available to the Administrator of the Maritime Administration for such acquisition, maintenance, repair, reconditioning, or improvement of vessels in the National Defense Reserve Fleet as is authorized under other Federal law.</text>
 </subparagraph><subparagraph id="idc790e583324b4573abad3360ffc9ceec"><enum>(B)</enum><text>Twenty-five percent shall be available to the Administrator of the Maritime Administration for the payment or reimbursement of expenses incurred by or on behalf of State maritime academies or the United States Merchant Marine Academy for facility and training ship maintenance, repair, and modernization, and for the purchase of simulators and fuel.</text>
 </subparagraph><subparagraph id="id030b2605142e413b82b871a6247af6c0"><enum>(C)</enum><text>The remainder shall be distributed for maritime heritage preservation to the Department of the Interior for grants as authorized by section 308703 of title 54.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idbd135ba550774a94bb060f8222ec75d3"><enum>111.</enum><header>Port operations, research, and technology</header>
 <subsection id="id9df93d51-c0f8-41c8-98be-d0e1f1850908"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote><short-title>Ports Improvement Act</short-title></quote>.</text> </subsection><subsection id="idc58134c1-02f6-48b2-9c94-5ab3587c2d04"><enum>(b)</enum><header>Port and intermodal improvement program</header><text>Section 50302 of title 46, United States Code, is amended by striking subsection (c) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id03cd588e-ead7-442d-a337-ca3de40c3c1e" style="OLC">
						<subsection id="id2e296268-43c9-46e6-a17e-45b735e1556a"><enum>(c)</enum><header>Port and intermodal improvement program</header>
 <paragraph id="id38fd6cae-1dc2-4090-bedd-811e6a32bb78"><enum>(1)</enum><header>General authority</header><text>Subject to the availability of appropriations, the Secretary of Transportation shall make grants, on a competitive basis, to eligible applicants to assist in funding eligible projects for the purpose of improving the safety, efficiency, or reliability of the movement of goods through ports and intermodal connections to ports.</text>
 </paragraph><paragraph id="id49f9cf83-a1bf-427a-b189-92d721da4b3b"><enum>(2)</enum><header>Eligible applicant</header><text>The Secretary may make a grant under this subsection to the following:</text> <subparagraph id="id668e351c-26ea-42ae-ab33-d93013be2e8c"><enum>(A)</enum><text>A State.</text>
 </subparagraph><subparagraph id="id15a688da-66de-4e01-8409-ee95dfc13de7"><enum>(B)</enum><text>A political subdivision of a State or local government.</text> </subparagraph><subparagraph id="id6918eb5e-a9ab-467f-aef9-a6527003f080"><enum>(C)</enum><text>A public agency or publicly chartered authority established by 1 or more States.</text>
 </subparagraph><subparagraph id="id9a2eda23-60dc-4c0e-a176-2b823ab7c2fc"><enum>(D)</enum><text>A special purpose district with a transportation function.</text> </subparagraph><subparagraph id="idb489dccc635a4fd4ad92adcd7a88a8a3"><enum>(E)</enum><text>An Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>), without regard to capitalization), or a consortium of Indian Tribes.</text>
 </subparagraph><subparagraph id="ide5017470-1c73-4319-ac50-95c99f7ca457"><enum>(F)</enum><text>A multistate or multijurisdictional group of entities described in this subsection.</text> </subparagraph><subparagraph id="id0c7b7bf6-5106-4bb2-9ec0-48597873e252"><enum>(G)</enum><text>A lead entity described in subparagraph (A), (B), (C), (D), (E), or (F) jointly with a private entity or group of private entities.</text>
 </subparagraph></paragraph><paragraph id="id1fd191f5-0392-4981-9370-92e71a1b279b"><enum>(3)</enum><header>Eligible projects</header><text>The Secretary may make a grant under this subsection—</text> <subparagraph id="id91a872ec-cbc4-4cdf-a862-277cccde8e30"><enum>(A)</enum><text>for a project that—</text>
 <clause id="id2853910a-a8f3-47c2-ab97-d7d30c36d33b"><enum>(i)</enum><text>is either—</text> <subclause id="id7c38b6cf-ae5b-4d0c-8d44-6038fe1be754"><enum>(I)</enum><text>within the boundary of a port; or</text>
 </subclause><subclause id="id913bb1bb-76aa-474a-9d4f-20149fd600e6"><enum>(II)</enum><text>outside the boundary of a port, but is directly related to port operations or to an intermodal connection to a port; and</text>
 </subclause></clause><clause id="id655904a6-e63a-4cdd-ba10-16b7c6d5e39d"><enum>(ii)</enum><text>will be used to improve the safety, efficiency, or reliability of—</text> <subclause id="idb27d8a2e-829f-4543-a508-1c88318f2b4c"><enum>(I)</enum><text>the loading and unloading of goods at the port, such as for marine terminal equipment;</text>
 </subclause><subclause id="id50dc124b-9f2a-4240-a617-01f9f383f951"><enum>(II)</enum><text>the movement of goods into, out of, around, or within a port, such as for highway or rail infrastructure, intermodal facilities, freight intelligent transportation systems, and digital infrastructure systems;</text>
 </subclause><subclause id="id2D94C105F71043039C3761BD12225958"><enum>(III)</enum><text>environmental mitigation measures and operational improvements directly related to enhancing the efficiency of ports and intermodal connections to ports; or</text>
 </subclause><subclause commented="no" id="id02571b6c-d07c-45e7-985c-f3e0521ba39b"><enum>(IV)</enum><text>the movement of vessels in and out of the port facility by dredging a vessel berthing area or performing construction or maintenance dredging that is not part of a Federal channel or an access channel associated with a Federal channel; or</text>
 </subclause></clause></subparagraph><subparagraph id="id08c79cf1-8b4c-4498-8464-15ef6b1a58f4"><enum>(B)</enum><text>notwithstanding paragraph (6)(A)(v), to provide financial assistance to 1 or more projects under subparagraph (A) for development phase activities, including planning, feasibility analysis, revenue forecasting, environmental review, permitting, and preliminary engineering and design work.</text>
 </subparagraph></paragraph><paragraph id="iddadb9409-358a-41a1-87b3-a6e2388e8b1b"><enum>(4)</enum><header>Prohibited uses</header><text>A grant award under this subsection may not be used—</text> <subparagraph id="idb0d34f41-7dbc-4d0a-9c8d-dc4289dae161"><enum>(A)</enum><text>to finance or refinance the construction, reconstruction, reconditioning, or purchase of a vessel that is eligible for such assistance under chapter 537, unless the Secretary determines such vessel—</text>
 <clause id="id061a5179-5378-42ba-a762-21eca40714b5"><enum>(i)</enum><text>is necessary for a project described in paragraph (3)(A)(ii)(III) of this subsection; and</text> </clause><clause id="ida1165e3a-fa81-49d0-b76b-866cfea3d184"><enum>(ii)</enum><text>is not receiving assistance under chapter 537; or</text>
 </clause></subparagraph><subparagraph id="id1956aef9-d3b9-40a6-9d3f-a7db9368f679"><enum>(B)</enum><text>for any project within a small shipyard (as defined in section 54101).</text> </subparagraph></paragraph><paragraph id="id9a6d4719-ad80-4a2c-9eb2-7ec1991350c3"><enum>(5)</enum><header>Applications and process</header> <subparagraph id="idabf989e8-e613-4606-80db-012cd7b5d9fc"><enum>(A)</enum><header>Applications</header><text>To be eligible for a grant under this subsection, an eligible applicant shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary considers appropriate.</text>
 </subparagraph><subparagraph id="id377e5745-aeec-4f2c-ae24-a7ea1e96c6a7"><enum>(B)</enum><header>Solicitation process</header><text>Not later than 60 days after the date that amounts are made available for grants under this subsection for a fiscal year, the Secretary shall solicit grant applications for eligible projects in accordance with this subsection.</text>
								</subparagraph></paragraph><paragraph id="ida572ab7c-146b-4a17-8f59-b4f43ae45f34"><enum>(6)</enum><header>Project selection criteria</header>
 <subparagraph id="id569fa1ff-6ef6-4dd3-bcdd-2ed73b7a3b82"><enum>(A)</enum><header>In general</header><text>The Secretary may select a project described in paragraph (3) for funding under this subsection if the Secretary determines that—</text>
 <clause id="id5106af2c-a4f2-4d51-8849-f39e41baa3df"><enum>(i)</enum><text>the project improves the safety, efficiency, or reliability of the movement of goods through a port or intermodal connection to a port;</text>
 </clause><clause id="id9a68d34c-298b-467a-ad10-e1d74d4c6f4b"><enum>(ii)</enum><text>the project is cost effective;</text> </clause><clause id="idee968f52-2404-40f4-ae40-38faa4c66606"><enum>(iii)</enum><text>the eligible applicant has authority to carry out the project;</text>
 </clause><clause id="idacacf92e-1fea-445b-9566-ea9d21b3097e"><enum>(iv)</enum><text>the eligible applicant has sufficient funding available to meet the matching requirements under paragraph (8);</text>
 </clause><clause id="id3afa2343-af93-4897-90db-328ff5b2e5c0"><enum>(v)</enum><text>the project will be completed without unreasonable delay; and</text> </clause><clause id="id111f5ede-d992-470c-a510-d0ce9e6986e8"><enum>(vi)</enum><text>the project cannot be easily and efficiently completed without Federal funding or financial assistance available to the project sponsor.</text>
 </clause></subparagraph><subparagraph commented="no" id="id4809b04a-aea9-427c-8cb2-364fd702eb99"><enum>(B)</enum><header>Additional considerations</header><text>In selecting projects described in paragraph (3) for funding under this subsection, the Secretary shall give substantial weight to—</text>
 <clause commented="no" id="idef556572-efbf-452b-99ac-ddea886c8f38"><enum>(i)</enum><text>the utilization of non-Federal contributions; and</text> </clause><clause commented="no" id="id480432d3-2819-4df6-838b-b8347370a2a2"><enum>(ii)</enum><text>the net benefits of the funds awarded under this subsection, considering the cost-benefit analysis of the project, as applicable.</text>
 </clause></subparagraph><subparagraph id="ida939d0ed-86de-4edd-bc15-1c470bc93585"><enum>(C)</enum><header>Small projects</header><text>The Secretary may waive the cost-benefit analysis under subparagraph (A)(ii), and establish a simplified, alternative basis for determining whether a project is cost effective, for a small project described in paragraph (7)(B).</text>
								</subparagraph></paragraph><paragraph commented="no" id="id03278429-6726-4669-86db-740c82c0d106"><enum>(7)</enum><header>Allocation of funds</header>
 <subparagraph commented="no" id="id43cba1d7-497b-49bc-b0aa-ff1b136f5a7b"><enum>(A)</enum><header>Geographic distribution</header><text>Not more than 25 percent of the amounts made available for grants under this subsection for a fiscal year may be used to make grants for projects in any 1 State.</text>
 </subparagraph><subparagraph commented="no" id="id09eaa097-46ec-4873-9ca1-cc6e88780f85"><enum>(B)</enum><header>Small projects</header><text>The Secretary shall reserve 25 percent of the amounts made available for grants under this subsection each fiscal year to make grants for eligible projects described in paragraph (3)(A) that request the lesser of—</text>
 <clause commented="no" id="ide8f7d7f8-0efc-4cf1-a053-248b6daa254f"><enum>(i)</enum><text>10 percent of the amounts made available for grants under this subsection for a fiscal year; or</text> </clause><clause commented="no" id="id114a43cd-0718-4d0e-98f1-5f3a4a83f568"><enum>(ii)</enum><text>$11,000,000.</text>
 </clause></subparagraph><subparagraph commented="no" id="id24e2fa94-674e-42f0-85c5-ee8f35c4b329"><enum>(C)</enum><header>Dredging projects</header><text>Not more than 25 percent of the amounts made available for grants under this subsection for a fiscal year may be used to make grants for projects described in paragraph (3)(A)(ii)(III).</text>
 </subparagraph><subparagraph commented="no" id="idbb7029b7-c637-4fec-8fb1-2473e8dd51e1"><enum>(D)</enum><header>Development phase activities</header><text>Not more than 10 percent of the amounts made available for grants under this subsection for a fiscal year may be used to make grants for development phase activities under paragraph (3)(B).</text>
								</subparagraph><subparagraph commented="no" id="id5100B39983594A0E84F9BEB540B02C18"><enum>(E)</enum><header>Research harbors</header>
 <clause commented="no" id="id804A429D90054876900BEF3294D07D20"><enum>(i)</enum><header>In General</header><text>Of the funds that may be used under subparagraph (C), the Secretary shall consider reserving an amount equal to not more than 5 percent of the amounts made available for grants under this subsection to make grants for projects described in paragraph (3)(A)(ii)(III) for research harbors.</text>
 </clause><clause commented="no" id="idE58D9CA19FB949639EF4C9481EAE19CF"><enum>(ii)</enum><header>Applicants</header><text>Notwithstanding paragraph (2), the Secretary may allow entities not described in that paragraph to be eligible applicants for grants under this subparagraph.</text>
									</clause></subparagraph></paragraph><paragraph id="ide0e27e7a-7f2f-4fe4-b26e-1373ade686be"><enum>(8)</enum><header>Federal share of total project costs</header>
 <subparagraph id="id59a94b9c-0304-482f-82c5-85801f45a0c3"><enum>(A)</enum><header>Total project costs</header><text>To be eligible for a grant under this subsection, an eligible applicant shall submit to the Secretary an estimate of the total costs of a project under this subsection based on the best available information, including any available engineering studies, studies of economic feasibility, environmental analyses, and information on the expected use of equipment or facilities.</text>
								</subparagraph><subparagraph id="idadd7669a-c841-4b06-a297-cbd394691383"><enum>(B)</enum><header>Federal share</header>
 <clause id="idddfb0219-62a9-4a80-866a-5e7bc66f96c2"><enum>(i)</enum><header>In general</header><text>Except as provided in clauses (ii) and (iii), the Federal share of the total costs of a project under this subsection shall not exceed 80 percent.</text>
 </clause><clause id="idbb706928-4299-4c3c-939f-d1737403d523"><enum>(ii)</enum><header>Dredging projects</header><text>The Federal share of the total costs of a project described in paragraph (3)(A)(ii)(III) shall not exceed 50 percent.</text>
 </clause><clause id="ide6c1a205-27bf-4f2b-885d-64c272c07f6c"><enum>(iii)</enum><header>Rural areas</header><text>The Secretary may increase the Federal share of costs above 80 percent for a project located in a rural area.</text>
 </clause></subparagraph></paragraph><paragraph id="id39dbeba015444b0b9539a65a89e6a4d8"><enum>(9)</enum><header>Procedural safeguards</header><text>The Secretary shall issue guidelines to establish appropriate accounting, reporting, and review procedures to ensure that—</text>
 <subparagraph id="idfdaefb78370848af8a91acf15b543f28"><enum>(A)</enum><text>grant funds are used for the purposes for which those funds were made available;</text> </subparagraph><subparagraph id="id0d98512e5f6d4e7eb1f3362c853bea60"><enum>(B)</enum><text>each grantee properly accounts for all expenditures of grant funds; and</text>
 </subparagraph><subparagraph id="id279018d3371c4275b378e740bf710f79"><enum>(C)</enum><text>grant funds not used for such purposes and amounts not obligated or expended are returned.</text> </subparagraph></paragraph><paragraph id="id3101c99601064c4a90016d4439d711e0"><enum>(10)</enum><header>Conditions</header> <subparagraph id="id9e31d6797f4841448b5d659e0840b76a"><enum>(A)</enum><header>In general</header><text>The Secretary shall require as a condition of making a grant under this subsection that a grantee—</text>
 <clause id="id300f0cccf5ae4bb8b66cb14256d38390"><enum>(i)</enum><text>maintain such records as the Secretary considers necessary;</text> </clause><clause id="id2fb809c183404adc9102a5db1a2722d8"><enum>(ii)</enum><text>make the records described in clause (i) available for review and audit by the Secretary; and</text>
 </clause><clause id="idd6d02c1c357d4475a09b447f1f933668"><enum>(iii)</enum><text>periodically report to the Secretary such information as the Secretary considers necessary to assess progress.</text>
 </clause></subparagraph><subparagraph id="id392aa1b58f0746de87cea218d0031afb"><enum>(B)</enum><header>Labor</header><text>The Federal wage rate requirements of subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40 shall apply, in the same manner as such requirements apply to contracts subject to such subchapter, to—</text>
 <clause id="ide881bab3e5f744ee9283260d466ecba6"><enum>(i)</enum><text>each project for which a grant is provided under this subsection; and</text> </clause><clause id="ida952083ef53845179c41bf0a1b7d4143"><enum>(ii)</enum><text>all portions of a project described in clause (i), regardless of whether such a portion is funded using—</text>
 <subclause id="id241646ecac404309b24146296bac2709"><enum>(I)</enum><text>other Federal funds; or</text> </subclause><subclause id="id10ff7c230a08427e88a3c7ec2d4d869b"><enum>(II)</enum><text>non-Federal funds.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="id18c349d7-52a9-4e15-b4d6-e10640c00cbb"><enum>(11)</enum><header>Congressional notification</header>
 <subparagraph id="id57c9429f-1a3d-423f-a2c3-d9b1c67d481e"><enum>(A)</enum><header>Notification</header><text>Not less than 60 days before making a grant for a project under this subsection, the Secretary shall notify, in writing, the appropriate committees of Congress of the proposed grant.</text>
 </subparagraph><subparagraph id="id88ab50d7-ff35-474c-9c04-f8695e6d4395"><enum>(B)</enum><header>Contents</header><text>Each notification under subparagraph (A) shall include—</text> <clause id="id166cb21c-63ce-41ff-8e42-7c41a232cde3"><enum>(i)</enum><text>an evaluation of and justification for the project; and</text>
 </clause><clause id="id9024ddb4-12ea-46d5-8d67-e53a9c8b1f58"><enum>(ii)</enum><text>the amount of the proposed grant award.</text> </clause></subparagraph><subparagraph id="idefaee9dd-7a2f-4dcc-b51e-714ee7a1a9fe"><enum>(C)</enum><header>Congressional disapproval</header><text>The Secretary shall not make a grant or any other obligation or commitment to fund a project under this subsection if a joint resolution is enacted disapproving funding for the project before the last day of the 60-day period described in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="id0ed94440-341e-48c5-8ff5-983c594a81f7"><enum>(12)</enum><header>Limitation on statutory construction</header><text>Nothing in this subsection shall be construed to affect existing authorities to conduct port infrastructure programs in—</text>
 <subparagraph id="ida2f5dce9-253e-483b-a493-2a86c9c39108"><enum>(A)</enum><text>Hawaii, as authorized by section 9008 of the SAFETEA–LU Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>; 119 Stat. 1926);</text> </subparagraph><subparagraph id="ideb02a49e-21c4-411d-b78c-5624a25257a6"><enum>(B)</enum><text>Alaska, as authorized by section 10205 of the SAFETEA–LU Act (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>; 119 Stat. 1934); or</text>
 </subparagraph><subparagraph id="id877f6a99-64e5-491b-8d0c-d14dcc5a96de"><enum>(C)</enum><text>Guam, as authorized by section 3512 of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 (<external-xref legal-doc="usc" parsable-cite="usc/48/1421r">48 U.S.C. 1421r</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="id07d5f309-bf4f-4faa-ac5e-3a579bec9579"><enum>(13)</enum><header>Reports</header><text>The Secretary shall make available on the website of the Department of Transportation at the end of each fiscal year an annual report that lists each project for which a grant has been provided under this subsection during that fiscal year.</text>
							</paragraph><paragraph id="id883d1c3f-78a2-40c5-a4ee-d724da6d543a"><enum>(14)</enum><header>Administration</header>
 <subparagraph id="id848bff57-6ec3-43ed-9624-e477fa073409"><enum>(A)</enum><header>Administrative and oversight costs</header><text>The Secretary may retain not more than 2 percent of the amounts appropriated for each fiscal year under this subsection for the administrative and oversight costs incurred by the Secretary to carry out this subsection.</text>
								</subparagraph><subparagraph id="idf476ad73-a33d-4b38-81ab-485bbb67e88a"><enum>(B)</enum><header>Availability</header>
 <clause id="id715f66ed-e7a2-4a19-8361-dce5ca547ca8"><enum>(i)</enum><header>In general</header><text>Amounts appropriated for carrying out this subsection shall remain available until expended.</text> </clause><clause id="id98c8a158-036f-4053-b0fb-d432edab6957"><enum>(ii)</enum><header>Unexpended funds</header><text>Amounts awarded as a grant under this subsection that are not expended by the grantee during the 5-year period following the date of the award shall remain available to the Secretary for use for grants under this subsection in a subsequent fiscal year.</text>
 </clause></subparagraph></paragraph><paragraph id="idc3b2ad1c-fe08-467e-98db-63539ce07049"><enum>(15)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="ida60d7596-6efb-4fb1-af78-a70518a7c253"><enum>(A)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text>
 <clause id="id3ed09ce8-a309-4433-91e7-b20f29502dcf"><enum>(i)</enum><text>the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>; and</text> </clause><clause id="id4239d797-8a24-4d14-822b-a72f140f45e8"><enum>(ii)</enum><text>the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives.</committee-name></text>
 </clause></subparagraph><subparagraph id="id8843b28b-3a6a-4371-95fc-86d8c8287d4c"><enum>(B)</enum><header>Port</header><text>The term <term>port</term> includes—</text> <clause id="id1165984a-bd48-4dc3-be8e-a8ff874e4771"><enum>(i)</enum><text>a seaport; and</text>
 </clause><clause id="id3d6d2fce-289a-4dcf-8b48-5abe98394aa9"><enum>(ii)</enum><text>an inland waterways port.</text> </clause></subparagraph><subparagraph id="id763031d8-7546-4bcc-972a-005ad0d6ba64"><enum>(C)</enum><header>Project</header><text>The term <term>project</term> includes construction, reconstruction, environmental rehabilitation, acquisition of property, including land related to the project and improvements to the land, equipment acquisition, and operational improvements.</text>
 </subparagraph><subparagraph id="id24C971B1CE1E4DDDB439AF260D44493E"><enum>(D)</enum><header>Research harbor</header><text>The term <term>research harbor</term> includes a harbor that supports or will support a federally owned vessel operated by a State maritime academy (as defined in section 51102 of this title) or a non-Federal oceanographic research facility.</text>
 </subparagraph><subparagraph id="idac949003-2927-4163-a616-f8abf8de761f"><enum>(E)</enum><header>Rural area</header><text>The term <term>rural area</term> means an area that is outside an urbanized area.</text> </subparagraph></paragraph></subsection><subsection id="id026301e1-a010-4f58-a312-176ac6b7b521"><enum>(d)</enum><header>Additional authority of the Secretary</header><text>In carrying out this section, the Secretary may—</text>
 <paragraph id="id992c2e66-d406-4c0f-9fcd-c3b6114f329d"><enum>(1)</enum><text>receive funds from a Federal or non-Federal entity that has a specific agreement with the Secretary to further the purposes of this section;</text>
 </paragraph><paragraph id="idcbe55586-e4a3-4708-a899-797134a69574"><enum>(2)</enum><text>coordinate with other Federal agencies to expedite the process established under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) for the improvement of port facilities to improve the efficiency of the transportation system, to increase port security, or to provide greater access to port facilities;</text>
 </paragraph><paragraph id="id24aaa23c-f4ec-4f88-9bd7-3f17d662331c"><enum>(3)</enum><text>seek to coordinate all reviews or requirements with appropriate local, State, and Federal agencies; and</text>
 </paragraph><paragraph id="idacc029b6-a788-4c8e-b3af-5e507371001d"><enum>(4)</enum><text>in addition to any financial assistance provided under subsection (c), provide such technical assistance to port authorities or commissions or their subdivisions and agents as needed for project planning, design, and construction.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id66050514-c471-4a9b-a6bb-afecf799cd14"><enum>(c)</enum><header>Savings clause</header><text>A repeal made by subsection (b) of this section shall not affect amounts apportioned or allocated before the effective date of the repeal. Such apportioned or allocated funds shall continue to be subject to the requirements to which the funds were subject under section 50302(c) of title 46, United States Code, as in effect on the day before the date of enactment of this Act.</text>
				</subsection></section><section id="id63F70C13812F46B8A5343512B23B9C94"><enum>112.</enum><header>Strategic seaports</header>
				<subsection commented="no" id="id135336E9A2CA48688D557B00202FF8EB"><enum>(a)</enum><header>In general</header>
 <paragraph commented="no" id="idD9494E992B0A40A999D319372A37941F"><enum>(1)</enum><header>Program established</header><text>The Administrator of the Maritime Administration (referred to in this section as the <quote>Administrator</quote>) and the United States Transportation Command shall establish a strategic seaport infrastructure readiness development program to improve infrastructure at strategic seaports to ensure those strategic seaport facilities are in a state of good repair, have modern infrastructure, and have sufficient readiness to support operations on 48 hours notice.</text>
 </paragraph><paragraph commented="no" id="idB84E037D738C4214BAB6C32773D20984"><enum>(2)</enum><header>Strategic seaport</header><text>In this section, the term <term>strategic seaport</term> means a commercial seaport that is designated by the Commanding General of the Military Surface Deployment and Distribution Command as a strategic seaport that will support the deployment of United States forces during a military contingency or national emergency.</text>
 </paragraph></subsection><subsection commented="no" id="id6A783D21D0444C75A1176FA1F72F7E4D"><enum>(b)</enum><header>Authority of the administrator</header><text>In order to carry out any project under the strategic seaport infrastructure readiness development program established under subsection (a), the Administrator may—</text>
 <paragraph id="id9D0F597511084E6E828CF30F8ED94D2F"><enum>(1)</enum><text>receive funds provided for the project from the Department of Defense and non-Federal private entities that have a specific agreement or contract with the Administrator to further the purposes of this section;</text>
 </paragraph><paragraph id="id3FA515D632484FB0B13E58E0FEBE8D4D"><enum>(2)</enum><text>coordinate with other Federal agencies to harmonize efforts to comply with requirements and procedures established under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) in carrying out projects under the program, including projects to improve port facilities, improve the efficiency of the transportation system, increase port security, or provide greater access to port facilities;</text>
 </paragraph><paragraph id="id17FE81DC881042C59C7E8427F1763166"><enum>(3)</enum><text>seek to coordinate all reviews or requirements relating to the project with appropriate Federal, State, and local agencies; and</text>
 </paragraph><paragraph id="idC5341BCD5A424EB084A109EA38075C8D"><enum>(4)</enum><text>provide such technical assistance to port authorities or commissions or their subdivisions and agents as needed for project planning, design, and construction.</text>
					</paragraph></subsection><subsection id="id3D1EBBCA57A54E5D983B4D1F957063D7"><enum>(c)</enum><header>Strategic seaport infrastructure development fund</header>
 <paragraph id="id8AD54CB6C435452DB2F68044EED2720E"><enum>(1)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund to be known as the Strategic Seaport Readiness Infrastructure Development Fund, (referred to in this section as the <quote>Fund</quote>) consisting of such amounts as may be appropriated or credited to such Fund as provided in this section.</text>
 </paragraph><paragraph id="idCA3D7AE2F696486BADDB0244FCE15761"><enum>(2)</enum><header>Credits</header><text>There may be deposited into the Fund—</text> <subparagraph id="id79628458BB054DB4B6D42EF7F3352BA4"><enum>(A)</enum><text>funds from the Department of Defense and funds from non-Federal private entities that have agreements or contracts with the Administrator, which shall remain in the Fund until expended or refunded; and</text>
 </subparagraph><subparagraph id="idEEB7D83FDB054967B89043F5B02D2069"><enum>(B)</enum><text>such amounts as may be appropriated or transferred to the Fund.</text> </subparagraph></paragraph><paragraph id="id02716B3A25E94631A6128D3BBFBD58E8"><enum>(3)</enum><header>Transfers</header><text>Amounts appropriated or otherwise made available for any fiscal year for a strategic seaport may be transferred, at the option of the recipient of such amounts, to the Fund and may be administered by the Administrator as a component of a project under the program.</text>
 </paragraph></subsection><subsection id="idA56E7FC929F142149A7A5A55377FB970"><enum>(d)</enum><header>Use of funds</header><text>The Administrator, in conjunction with the United States Transportation Command, may use funds from the Fund to—</text>
 <paragraph id="idA1F6B27D22F245CC873052BC7DFC2CDE"><enum>(1)</enum><text>administer and carry out projects under the strategic seaport infrastructure readiness development program under this section, including projects to—</text>
 <subparagraph id="idB9D65301CD7D491082A1C677C5339027"><enum>(A)</enum><text>upgrade infrastructure resiliency of piers or wharfs or enhancing flexible lay-down areas for heavy lift, increase efficiency in the handling of Department of Defense intermodal cargo movements, enhance shoreside intermodal transportation infrastructure, or carry out other similar improvements designed to increase efficiency of Department of Defense readiness;</text>
 </subparagraph><subparagraph id="id2568E707B2164BE5A721127722A80800"><enum>(B)</enum><text>facilitate funding for training dedicated to enhancing interoperability between military and port terminal personnel, and testing and expanding operational areas to maximize strategic seaport capability and assets; and</text>
 </subparagraph><subparagraph id="id158C75F113C04BC9ACEFA2365E48235E"><enum>(C)</enum><text>provide cyber resiliency project funding dedicated to the installation of new cybersecurity infrastructure, or the enhancement of existing cybersecurity infrastructure, in order to ensure security of military operations at strategic seaports; and</text>
 </subparagraph></paragraph><paragraph id="idABAB25009A8544C392F525369B464EF0"><enum>(2)</enum><text>make refunds for projects under that program that will not be completed.</text> </paragraph></subsection></section><section id="id52aec9fe33b34a69a56c592e61b9fb64"><enum>113.</enum><header>Maritime technical assistance program</header><text display-inline="no-display-inline">Section 50307 of title 46, United States Code, is amended—</text>
 <paragraph id="id34A198261FFA4601A947B0B40D19BCA7"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>The Secretary of Transportation may engage in the environmental study</quote> and inserting <quote>The Maritime Administrator, on behalf of the Secretary of Transportation, shall engage in the study</quote>;</text> </paragraph><paragraph id="idFBEC65F5540A42688953C75BC8FBDF6A"><enum>(2)</enum><text>in subsection (b)—</text>
 <subparagraph id="id1191B83320C5496A919FFB971365D61D"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>may</quote> and inserting <quote>shall</quote>; and</text> </subparagraph><subparagraph id="id67FEABC79E5541428B4D935C1E22262F"><enum>(B)</enum><text>in paragraph (1)—</text>
 <clause id="idA4448242A1364E5EADACC24369DABC46"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>that are likely to achieve environmental improvements by</quote> and inserting <quote>to improve</quote>;</text> </clause><clause id="id6B23241D294E40C18861600CA391FDA2"><enum>(ii)</enum><text>by redesignating subparagraphs (A) through (C) as clauses (i) through (iii), respectively;</text>
 </clause><clause id="idC0CF792AAAD742F9AAEEFB8DC0F2D550"><enum>(iii)</enum><text>by inserting before clause (i), the following:</text> <quoted-block display-inline="no-display-inline" id="id9493E6C106EC4F4A8A52E8A29FB688D7" style="OLC"> <subparagraph id="idB245813551C14FB3B9DF832C2F73D108"><enum>(A)</enum><text>performance to meet United States Federal and international standards and guidelines, including—</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause><clause id="id010D0C45D73B4ECDA49357214B01E247"><enum>(iv)</enum><text>in clause (iii), as redesignated by clause (ii), by striking <quote>species; and</quote> and all that follows through the end of the subsection and inserting</text> <quoted-block display-inline="yes-display-inline" id="idBA676F04DEA640EDA72094880C720EFB" style="OLC"> <text>species, reducing propeller cavitation;</text><subparagraph id="id283C90E8F6D64358B538B288F2115944"><enum>(B)</enum><text>the efficiency and competitiveness of domestic maritime industries; and</text> </subparagraph><paragraph id="id54C0ADF3EAF94B9E9461948B19D69AA1"><enum>(2)</enum><text>coordinate with the Environmental Protection Agency, the Coast Guard, and other Federal, State, local, or tribal agencies, as appropriate.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block>
 </clause></subparagraph></paragraph><paragraph id="idDDC5BA9AFF034EEC88932456F395AC6D"><enum>(3)</enum><text>in subsection (c)(2), by striking <quote>benefits</quote> and inserting <quote>or other benefits to domestic maritime industries</quote>; and</text> </paragraph><paragraph id="idf79cc07a367442ca9bc40736076102d0"><enum>(4)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idc28e1aca3b1d42dc9a3bf64000f1a090" style="OLC">
 <subsection commented="no" id="ida2157093d7984d45b3ea6d6969c8695b"><enum>(e)</enum><header>Limitations on the use of funds</header><text>For the purposes of this program, no more than 3 percent of funds may be used for administrative purposes.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="idd272b2f2eede44d5ab9ea382ca16c03d"><enum>114.</enum><header>Requirement for small shipyard grantees</header><text display-inline="no-display-inline">Section 54101(d) of title 46, United States Code, is amended—</text> <paragraph id="id11591fcd891646a7b32588b5f722cb3f"><enum>(1)</enum><text>by striking <quote>Grants awarded</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDE805C0D30314984B3F5EA749B1E8963" style="OLC">
 <paragraph id="idC77E4680CEAF40BAA74745F4063DDA27"><enum>(1)</enum><header>In general</header><text>Grants awarded</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="id3ca44530f5524d71a15c500c9f4c1a3f"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id1F06BC26F3A34A1CB508EF83B279E279" style="OLC">
						<paragraph id="id1E0721C8155D4D8291E6665FA31DA942"><enum>(2)</enum><header>Buy  america</header>
 <subparagraph id="idca9dd916a95d4d819b8d6620fb3651d5"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), no funds may be obligated by the Administrator of the Maritime Administration under this section, unless each product and material purchased with those funds (including products and materials purchased by a grantee), and including any commercially available off-the-shelf item, is—</text>
 <clause id="iddbbcf14983944d52bd538ed0fe7dda5e"><enum>(i)</enum><text>an unmanufactured article, material, or supply that has been mined or produced in the United States; or</text>
 </clause><clause id="id22938c9457bc4e67aea5678558600442"><enum>(ii)</enum><text>a manufactured article, material, or supply that has been manufactured in the United States substantially all from articles, materials, or supplies mined, produced, or manufactured in the United States.</text>
								</clause></subparagraph><subparagraph id="iddaaca54e3db54ecd9246ae6a37ac7f1a"><enum>(B)</enum><header>Exceptions</header>
 <clause id="id92067F501C4E45C0AB1425648D133BB7"><enum>(i)</enum><header>In general</header><text>Notwithstanding subparagraph (A), the requirements of that subparagraph shall not apply with respect to a particular product or material if the Administrator determines—</text>
 <subclause id="idea0685fad8a84e32812cf7b5e0f866b0"><enum>(I)</enum><text>that the application of those requirements would be inconsistent with the public interest;</text> </subclause><subclause id="id146c031e1472443bba88c9794be99314"><enum>(II)</enum><text>that such product or material is not available in the United States in sufficient and reasonably available quantities, of a satisfactory quality, or on a timely basis; or</text>
 </subclause><subclause id="idd26467ac53b34dd08248bba4aa7708be"><enum>(III)</enum><text>that inclusion of a domestic product or material will increase the cost of that product or material by more than 25 percent, with respect to a certain contract between a grantee and that grantee's supplier.</text>
 </subclause></clause><clause id="idbe5d57533bb74b9785bad3c8bb176309"><enum>(ii)</enum><header>Federal register</header><text>A determination made by the Administrator under this subparagraph shall be published in the Federal Register.</text>
 </clause></subparagraph><subparagraph id="id6a17c93dfb364c35b4fc1213325271bf"><enum>(C)</enum><header>Definitions</header><text>ln this paragraph:</text> <clause id="id392bb381f7044ec2b765fa6d6beaff1d"><enum>(i)</enum><text>The term <term>commercially available off-the-shelf item</term> means—</text>
 <subclause id="id77785d1ea7154a2f98b3042d9a8bc8c1"><enum>(I)</enum><text>any item of supply (including construction material) that is—</text> <item id="idcd59c904502e4f42a9d361a38b55db27"><enum>(aa)</enum><text>a commercial item, as defined by section 2.101 of title 48, Code of Federal Regulations; and</text>
 </item><item id="id8a6783907d6f4c4fa6dd913c5023a263"><enum>(bb)</enum><text>sold in substantial quantities in the commercial marketplace; and</text> </item></subclause><subclause id="id1940c573fdee4f3d90f8e36d114b1de5"><enum>(II)</enum><text>does not include bulk cargo, as defined in section 40102(4) of this title, such as agricultural products and petroleum products.</text>
 </subclause></clause><clause id="idd6f11c0e7a444fe1afd4d1529824c012"><enum>(ii)</enum><text>The term <term>product or material</term> means an article, material, or supply brought to the site by the recipient for incorporation into the building, work, or project. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site.</text>
 </clause><clause id="id27c1399893134580a53b6ddcbf8d8ab1"><enum>(iii)</enum><text>The term <term>United States</term> includes the District of Columbia, the Commonwealth of Puerto Rico, the Northern Mariana Islands, Guam, American Samoa, and the Virgin Islands.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="idFF560725E9CF461B818B3336E2A48852"><enum>115.</enum><header>Improvement of National Oceanographic Partnership Program</header>
				<subsection id="idA7A85FC0036A40BAA32B2502D46C927F"><enum>(a)</enum><header>Additional means of achievement of goals of Program through
 oceanographic efforts</header><text display-inline="yes-display-inline">Section 8931(b)(2) of title 10, United States Code, is amended—</text> <paragraph id="idB8AC2D4D83EB4B2AB730A3C955FD0ADC"><enum>(1)</enum><text>in subparagraph (A)—</text>

							<subsection id="id204e359138c1437aa86561b27af345e9"><enum>(g)</enum><header>Contract and grant authority</header>
 <paragraph id="idD2315D7DD01049FD9DB7814603A08ACF"><enum>(1)</enum><header>In General</header><text>To carry out the purposes of the National Oceanographic Partnership Program, the Council shall have, in addition to other powers otherwise given it under this chapter, the following authorities:</text>
 <subparagraph id="id10dd04ec9d3d4c8ea9f9a611c965a494"><enum>(A)</enum><text>To authorize one or more of the departments or agencies represented on the Council to enter into contracts and make grants or cooperative agreements, and establish and manage new collaborative programs as considered appropriate, to address emerging science priorities using both donated and appropriated funds.</text>
 </subparagraph><subparagraph id="idfe44a913c03f4e23b21475dd2be5c780"><enum>(B)</enum><text>To authorize the program office under subsection (f), on behalf of the Council, to accept funds, including fines and penalties, from other Federal and State departments and agencies.</text>
 </subparagraph><subparagraph id="id9DBDD6FCC0F64B048BB289F2617B63D8"><enum>(C)</enum><text>To authorize the program office, on behalf of the Council, to award grants and enter into contracts for purposes of the National Oceanographic Partnership Program.</text>
 </subparagraph><subparagraph id="idbb3f5e5d85664adfb69a88e6c7582563"><enum>(D)</enum><text>To authorize the program office, on behalf of the Council, to solicit, accept and execute oceanographic research projects for purposes of the National Oceanographic Partnership Program that are funded by private grants, contracts, and donations.</text>
 </subparagraph><subparagraph id="idD7E3D66640A14BBE9701FBCBB4F068E5"><enum>(E)</enum><text>To transfer funds to other Federal and State departments and agencies in furtherance of the purposes of the National Oceanographic Partnership Program.</text>
 </subparagraph><subparagraph id="idE355DFA3A02E45BDA4D872E06B7419D7"><enum>(F)</enum><text>To authorize one or more of the departments or agencies represented on the Council to enter into contracts and make grants, for the purpose of implementing the National Oceanographic Partnership Program and carrying out the responsibilities of the Council.</text>
 </subparagraph><subparagraph id="id9D6C107FB94543EDAF91FA4FFE79AF97"><enum>(G)</enum><text>To use, with the consent of the head of the agency or entity concerned, on a non-reimbursable basis, the land, services, equipment, personnel, facilities, advice, and information provided by a Federal agency or entity, State, local government, Tribal government, territory, or possession, or any subdivisions thereof, or the District of Columbia as may be helpful in the performance of the duties of the Council.</text>
 </subparagraph></paragraph><paragraph id="idB63868BCF77F416FA63375996E4BD0D5"><enum>(2)</enum><header>Funds transferred</header><text>Funds identified for direct support of National Oceanographic Partnership Program grants are authorized for transfer between agencies and are exempt from section 1535 of title 31, United States Code (commonly known as the <quote>Economy Act of 1932</quote>).</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id55CCC1B1614144BCA5A8295FA5121411"><enum>(c)</enum><header>Ocean Research Advisory Panel</header><text>Section 8933(a)(4) of title 10, United States Code, is amended by striking <quote>State governments</quote> and inserting <quote>State and Tribal governments</quote>.</text> </subsection></section><section id="idE5E7DC8150C9436F9EB4C89F68F0832A"><enum>116.</enum><header>Improvements to the maritime guaranteed loan program</header> <subsection id="idEB60EE8679B54EA4B94ADC1815790077"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 53701 of title 46, United States Code, is amended—</text>

 </paragraph></subsection><subsection commented="no" id="id8c3ee2044ba44acba4f2f0dade544249"><enum>(b)</enum><header>Preferred lender</header><text>Section 53702(a) of title 46, United States Code, is amended—</text> <paragraph commented="no" id="idC112ED0199C8471CB79C7AA3D318CC87"><enum>(1)</enum><text>by striking <quote>The Secretary or Administrator, on terms the Secretary or Administrator may prescribe,</quote> and inserting the following:</text>

 </paragraph></subsection><subsection id="id3EE3D4AC676B4791BBB185E54D827952"><enum>(c)</enum><header>Application and Administration</header><text display-inline="yes-display-inline">Section 53703 of title 46, United States Code, is amended—</text> <paragraph id="id2CCDDA7C517946EB845965B7CFC0C390"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">procedures</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">and administration</header-in-text></quote>; and</text>
 </paragraph><paragraph id="idD5F20261944E4F028CACFA0C44A76610"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id746D404E286E4BB4ABCAB2B02A63D68B" style="OLC"> <subsection id="id994024BED75842EF823A55A8FEB26C21"><enum>(c)</enum><header>Independent analysis</header> <paragraph id="id332027CE0CBC484B8E2B517A4F833EF2"><enum>(1)</enum><header>In General</header><text>To assess and mitigate the risks due to factors associated with markets, technology, financial, or legal structures related to an application or guarantee under this chapter, the Secretary or Administrator may utilize third-party experts, including legal counsel, to—</text>
 <subparagraph id="id8DEB0C17FC5A45E3A4810A864BA67024"><enum>(A)</enum><text>process and review applications under this chapter, including conducting independent analysis and review of aspects of an application;</text>
 </subparagraph><subparagraph id="idE5AF506298D3404FB073AECF0C761B45"><enum>(B)</enum><text>represent the Secretary or Administrator in structuring and documenting the obligation guarantee;</text> </subparagraph><subparagraph id="idDA58A55266314536ACD0F0A650ED0C20"><enum>(C)</enum><text>analyze and review aspects of, structure, and document the obligation guarantee during the term of the guarantee;</text>
 </subparagraph><subparagraph id="id7f7cd8078a2c4ccab1d3c199da6d02ae"><enum>(D)</enum><text>recommend financial covenants or financial ratios to be met by the applicant during the time a guarantee under this chapter is outstanding that are—</text>
 <clause id="id25662573C0B7416B96B435330D555592"><enum>(i)</enum><text>based on the financial covenants or financial ratios, if any, that are then applicable to the obligor under private sector credit agreements; and</text>
 </clause><clause commented="no" id="id1B2E53A65CB04E8F9656318EAAAB77C7"><enum>(ii)</enum><text>in lieu of other financial covenants applicable to the obligor under this chapter with respect to requirements regarding long-term debt-to-equity, minimum working capital, or minimum amount of equity; and</text>
 </clause></subparagraph><subparagraph id="id1AB786BAC714410CB0F985E5F610E5FD"><enum>(E)</enum><text>represent the Secretary or Administrator to protect the security interests of the Government relating to an obligation guarantee.</text>
 </subparagraph></paragraph><paragraph id="id0086DFA1E213403F9ECC72D1723804FF"><enum>(2)</enum><header>Private sector expert</header><text>Independent analysis, review, and representation conducted under this subsection shall be performed by a private sector expert in the applicable field who is selected by the Secretary or Administrator.</text>
								</paragraph></subsection><subsection id="idDDBA558A70AD465B964989A8D70D0481"><enum>(d)</enum><header>Vessels of National Interest</header>
 <paragraph id="id676DF43490764B5B8F9895A101B53CD3"><enum>(1)</enum><header>Notice of funding</header><text>The Secretary or Administrator may post a notice in the Federal Register regarding the availability of funding for obligation guarantees under this chapter for the construction, reconstruction, or reconditioning of a Vessel of National Interest and include a timeline for the submission of applications for such vessels.</text>
								</paragraph><paragraph id="id35DBD30D76C34E4CBC35562E3CCB36D5"><enum>(2)</enum><header>Vessel characteristics</header>
 <subparagraph id="id7CFD0074B2A94A299FB2F5A58B5B865F"><enum>(A)</enum><header>In General</header><text>The Secretary or Administrator, in consultation with the Secretary of Defense, the Secretary of Homeland Security, or the heads of other Federal agencies, shall develop and publish a list of vessel types that would be considered Vessels of National Interest.</text>
 </subparagraph><subparagraph id="idFC49F27E2B1B4240A5597F5C9DE2230F"><enum>(B)</enum><header>Review</header><text>Such list shall be reviewed and revised every 4 years or as necessary, as determined by the Administrator.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id46ABEE45385E4E369FE3E45AE3B2D870"><enum>(d)</enum><header>Funding limits</header><text display-inline="yes-display-inline">Section 53704 of title 46, United States Code, is amended—</text> <paragraph id="id980B397701D049AEA4BDA3A74D1227B4"><enum>(1)</enum><text>in subsection (a)—</text>
 <subparagraph id="idA1542CFC8E8F4C2E8F9B9218600977E6"><enum>(A)</enum><text>by striking <quote>that amount</quote> and all the follows through <quote>$850,000,000</quote> and inserting <quote>that amount, $850,000,000</quote>; and</text> </subparagraph><subparagraph id="id49ECD943F9894B4B8F9311601B6D9DC3"><enum>(B)</enum><text>by striking <quote>facilities</quote> and all that follows through the end of the subsection and inserting <quote>facilities.</quote>; and</text>

				</subsection><subsection commented="no" id="id248587731c3e4b9882265e251fe338c1"><enum>(k)</enum><header>Congressional notification</header>
 <paragraph commented="no" id="id033bbbb0c2894630b99cfdc3de45cd7a"><enum>(1)</enum><header>Notification</header><text>Not less than 60 days before reorganizing or consolidating the activities or personnel covered under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/537">chapter 537</external-xref> of title 46, United States Code, the Secretary of Transportation shall notify, in writing, the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives of the proposed reorganization or consolidation.</text>
 </paragraph><paragraph commented="no" id="id788b8a06ac464b7ca066de3c7789148b"><enum>(2)</enum><header>Contents</header><text>Each notification under paragraph (1) shall include an evaluation of, and justification for, the reorganization or consolidation.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4e5f8a19-93b3-4aca-b813-31900ab8be57"><enum>(l)</enum><header>Clerical amendments</header>

				</subsection></section></title><title id="idA9CB98371EA64C0CB057F7651F476F1D" style="OLC"><enum>II</enum><header>Maritime SAFE Act</header>
			<section id="S1"><enum>201.</enum><header>Short title</header>
 <subsection id="id25926E84391A42A4810CF625157023DE"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This title may be cited as the <quote><short-title>Maritime Security and Fisheries Enforcement Act</short-title></quote> or the <quote><short-title>Maritime SAFE Act</short-title></quote>.</text>
 </subsection></section><section id="id99506190be764d68a32183533dc9692f"><enum>202.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="idb724c15e21ed4d7c900ee3988b1b7fe7"><enum>(1)</enum><header>AIS</header><text>The term <term>AIS</term> means Automatic Identification System (as defined in section 164.46 of title 33, Code of Federal Regulations, or a similar successor regulation).</text>
 </paragraph><paragraph id="id0c6c4ffa194f495f865621e3d5220f14"><enum>(2)</enum><header>Combined maritime forces</header><text>The term <term>Combined Maritime Forces</term> means the 33-nation naval partnership, originally established in February 2002, which promotes security, stability, and prosperity across approximately 3,200,000 square miles of international waters.</text>
				</paragraph><paragraph id="idEE55A6493B034E5BA4873DE6933BD46C"><enum>(3)</enum><header>Exclusive economic zone</header>
 <subparagraph id="iddb476e896b1c488694519600d4deb159"><enum>(A)</enum><header>In general</header><text>Unless otherwise specified by the President as being in the public interest in a writing published in the Federal Register, the term <term>exclusive economic zone</term> means—</text>
 <clause id="idFCCEA1DCF6F3444AA4418AD723E992D1"><enum>(i)</enum><text>the area within a zone established by a maritime boundary that has been established by a treaty in force or a treaty that is being provisionally applied by the United States; or</text>
 </clause><clause id="id31A3C6AEA179477AB3969FF2B722F3C1"><enum>(ii)</enum><text>in the absence of a treaty described in clause (i)—</text> <subclause id="id42D012C63A214778BA553CFE2DCEC9E5"><enum>(I)</enum><text>a zone, the outer boundary of which is 200 nautical miles from the baseline from which the breadth of the territorial sea is measured; or</text>
 </subclause><subclause id="idBA7A386EFF6F43EDB40425837EDFA6C8"><enum>(II)</enum><text>if the distance between the United States and another country is less than 400 nautical miles, a zone, the outer boundary of which is represented by a line equidistant between the United States and the other country.</text>
 </subclause></clause></subparagraph><subparagraph id="idbadfc429a7594506a2850ec5a24df158"><enum>(B)</enum><header>Inner boundary</header><text>Without affecting any Presidential Proclamation with regard to the establishment of the United States territorial sea or exclusive economic zone, the inner boundary of the exclusive economic zone is—</text>
 <clause id="id957f9b46c12f49749436c25259d94e4b"><enum>(i)</enum><text>in the case of coastal States, a line coterminous with the seaward boundary of each such State (as described in section 4 of the Submerged Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1312">43 U.S.C. 1312</external-xref>));</text>
 </clause><clause id="id2a57d9b178bd445fb6bd7e48eb3456f3"><enum>(ii)</enum><text>in the case of the Commonwealth of Puerto Rico, a line that is 3 marine leagues from the coastline of the Commonwealth of Puerto Rico;</text>
 </clause><clause id="id31fb0067b16244979a6cfd12dc1207a3"><enum>(iii)</enum><text>in the case of American Samoa, the United States Virgin Islands, and Guam, a line that is 3 geographic miles from the coastlines of American Samoa, the United States Virgin Islands, or Guam, respectively;</text>
 </clause><clause id="id6cbc9151c8ea49a5bb6e617ed4cb48b4"><enum>(iv)</enum><text>in the case of the Commonwealth of the Northern Mariana Islands—</text> <subclause id="id6decfdccc6ab4c02b6d17bb1c7e51e1a"><enum>(I)</enum><text>the coastline of the Commonwealth of the Northern Mariana Islands, until the Commonwealth of the Northern Mariana Islands is granted authority by the United States to regulate all fishing to a line seaward of its coastline; and</text>
 </subclause><subclause id="iddd441c744ea740159f06152c63c5ae58"><enum>(II)</enum><text>upon the United States grant of the authority described in subclause (I), the line established by such grant of authority; or</text>
 </subclause></clause><clause id="id03177c2fa0f148a588af02a4af535287"><enum>(v)</enum><text>for any possession of the United States not referred to in clause (ii), (iii), or (iv), the coastline of such possession.</text>
 </clause></subparagraph><subparagraph id="idfe10a5b93fd14c8c8cb3fc6e0072004f"><enum>(C)</enum><header>Rule of construction</header><text>Nothing in this paragraph may be construed to diminish the authority of the Department of Defense, the Department of the Interior, or any other Federal department or agency.</text>
 </subparagraph></paragraph><paragraph id="idc57420f9a4634aa9b53b21baa062a9a1"><enum>(4)</enum><header>Food security</header><text>The term <term>food security</term> means access to, and availability, utilization, and stability of, sufficient food to meet caloric and nutritional needs for an active and healthy life.</text>
 </paragraph><paragraph id="id2EFCB2931CAB4092A8D596698A80CCB2"><enum>(5)</enum><header>Global record of fishing vessels, refrigerated transport vessels, and supply vessels</header><text>The term <term>global record of fishing vessels, refrigerated transport vessels, and supply vessels</term> means the Food and Agriculture Organization of the United Nations’ initiative to rapidly make available certified data from state authorities about vessels and vessel related activities.</text>
 </paragraph><paragraph id="id616ED8947EDC437281903D5720A27AC5"><enum>(6)</enum><header>IUU fishing</header><text>The term <term>IUU fishing</term> means illegal fishing, unreported fishing, or unregulated fishing (as such terms are defined in paragraph 3 of the International Plan of Action to Prevent, Deter, and Eliminate Illegal, Unreported and Unregulated Fishing, adopted at the 24th Session of the Committee on Fisheries in Rome on March 2, 2001).</text>
 </paragraph><paragraph id="id9C65141F1F3D47569848C483FA5EDF47"><enum>(7)</enum><header>Port state measures agreement</header><text>The term <term>Port State Measures Agreement</term> means the Agreement on Port State Measures to Prevent, Deter, and Eliminate Illegal, Unreported, and Unregulated Fishing set forth by the Food and Agriculture Organization of the United Nations, done at Rome, Italy November 22, 2009, and entered into force June 5, 2016, which offers standards for reporting and inspecting fishing activities of foreign-flagged fishing vessels at port.</text>
 </paragraph><paragraph id="id519a8f275d904c6bba73c744d6e2d045"><enum>(8)</enum><header>Priority flag state</header><text>The term <term>priority flag state</term> means a country selected in accordance with section 222(b)(3)—</text> <subparagraph id="id33DA2AB02FD94ABFB5D3C3EDBA399A8F"><enum>(A)</enum><text>whereby the flagged vessels of which actively engage in, knowingly profit from, or are complicit in IUU fishing; and</text>
 </subparagraph><subparagraph id="idC1470C25B8CE4F4E90970919F858BC80"><enum>(B)</enum><text>that is willing, but lacks the capacity, to monitor or take effective enforcement action against its fleet.</text>
 </subparagraph></paragraph><paragraph id="id7fe973bceb8a483bb3eb5919b2ba6f68"><enum>(9)</enum><header>Priority region</header><text>The term <term>priority region</term> means a region selected in accordance with section 222(b)(2)—</text> <subparagraph id="id27D43ACFBC6E43DC936C3FE8C8CE4F54"><enum>(A)</enum><text>that is at high risk for IUU fishing activity or the entry of illegally caught seafood into the markets of countries in the region; and</text>
 </subparagraph><subparagraph id="idA5922984C685477198F49FEFB25865D3"><enum>(B)</enum><text>in which countries lack the capacity to fully address the illegal activity described in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="ida23a0db446cc4e1c80f57aa691a1131a"><enum>(10)</enum><header>Regional fisheries management organization</header><text>The term <term>Regional Fisheries Management Organization</term> means an intergovernmental fisheries organization or arrangement, as appropriate, that has the competence to establish conservation and management measures.</text>
 </paragraph><paragraph id="id92c824e6491a4678a2a085b8da6bd7a8"><enum>(11)</enum><header>Seafood</header><text>The term <term>seafood</term>—</text> <subparagraph id="id221ED9C7EAD0488DB5270A6C73C2622C"><enum>(A)</enum><text>means marine finfish, mollusks, crustaceans, and all other forms of marine animal and plant life, including those grown, produced, or reared through marine aquaculture operations or techniques; and</text>
 </subparagraph><subparagraph id="id69C9CC855FCB4CD09660F5859BF4BB6B"><enum>(B)</enum><text>does not include marine mammals or birds.</text> </subparagraph></paragraph><paragraph id="id37f7e8df252347678447a84f5f144dd4"><enum>(12)</enum><header>Seafood fraud</header><text>The term <term>seafood fraud</term> means the knowing mislabeling or misrepresentation of information regarding seafood or seafood products with the intent to deceive or defraud.</text>
 </paragraph><paragraph id="idca3d02c93ddf426d8b00d0cc6c22f31f"><enum>(13)</enum><header>Seafood traceability program</header><text>The term <term>seafood traceability program</term> means any program implemented by the National Oceanic and Atmospheric Administration (such as the Seafood Import Monitoring Program) that requires, with respect to seafood and seafood products imported into the United States—</text>
 <subparagraph id="id6C6CDF850AB4484B80F1056802816ECD"><enum>(A)</enum><text>permitting, data reporting, and recordkeeping to prevent illegal, unreported, unregulated, or misrepresented seafood from entering United States commerce; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6447EF4FA16A49999D63DF407891A6C3"><enum>(B)</enum><text>verifying the chain of custody of such seafood, from harvest to point of entry into the United States.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id755e823e11b4436caadb06ff6962f6fe"><enum>(14)</enum><header>Transnational organized illegal activity</header><text>The term <term>transnational organized illegal activity</term> means criminal activity conducted by self-perpetuating associations of individuals who operate transnationally for the purpose of obtaining power, influence, or monetary or commercial gains, wholly or in part by illegal means, while protecting their activities through a pattern of corruption or violence or through a transnational organizational structure and the exploitation of transnational commerce or communication mechanisms.</text>
 </paragraph><paragraph id="idacb91f0b0a99467f95484c351f10c6f9"><enum>(15)</enum><header>Transshipment</header><text>The term <term>transshipment</term> means the use of refrigerated vessels that—</text> <subparagraph id="idEE0C7FD0DC9847669F5729B758DC0D90"><enum>(A)</enum><text>collect catch from multiple fishing boats;</text>
 </subparagraph><subparagraph id="idE937008C081443ECB882057ACE5BFAD2"><enum>(B)</enum><text>carry the accumulated catches back to port; and</text> </subparagraph><subparagraph id="idDA66D15A389F4C9B94B74EAD31EE7F3D"><enum>(C)</enum><text>deliver supplies to fishing boats, which allows fishing vessels to remain at sea for extended periods without coming into port.</text>
 </subparagraph></paragraph></section><section id="id29d43c3a1248442b87e2915b6a3e2a76"><enum>203.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> <paragraph id="id2eed7aee83b84f4fb15a5d3d8ae2f574"><enum>(1)</enum><text>In a report titled, <quote>Global Implications of Illegal, Unreported, and Unregulated (IUU) Fishing</quote>, the Office of the Director of National Intelligence identified IUU fishing as—</text>
 <subparagraph id="id7E18A7E660E242CD98CB5D21712A8977"><enum>(A)</enum><text>a threat to the national security of the United States; and</text> </subparagraph><subparagraph id="idECA0A4908E484C93B9DCE65DF39D6B2B"><enum>(B)</enum><text>a challenge to peace and stability in regions of importance to the United States.</text>
 </subparagraph></paragraph><paragraph id="id2bc9015a33344bc88105fd5d693fb5fd"><enum>(2)</enum><text>Executive Order 13773 (82 Fed. Reg. 10691), issued on February 9, 2017, calls for a comprehensive approach by the Federal Government to combat crime syndicates, including transnational organized illegal activities that may be associated with IUU fishing.</text>
 </paragraph><paragraph id="idc3bc90f91da043e3a8eee6acc15c8cdd"><enum>(3)</enum><text>It is estimated that the value of IUU fishing may exceed $1,000,000,000 annually in unlawful or undocumented revenue and may sometimes be linked to transnational organized illegal activities, including weapons, drug, and human trafficking.</text>
 </paragraph><paragraph id="id2296c811d4f84dcbbcfc0189255769cd"><enum>(4)</enum><text>IUU fishing—</text> <subparagraph id="idB2E1B5C90F6F4B9583E50CC49BBB1E69"><enum>(A)</enum><text>undermines the business of legitimate workers in the seafood industry; and</text>
 </subparagraph><subparagraph id="idA5E0EBAF108A4AE38118D04D353564E1"><enum>(B)</enum><text>can create inaccurate population estimates for fish and other seafood species.</text>
 </subparagraph></paragraph><paragraph id="id07946994ed2247dc9ccb1d3eb24b5d08"><enum>(5)</enum><text>Marine fisheries employ millions of people worldwide, the livelihoods of whom can be negatively impacted by IUU fishing and associated transnational organized illegal activities.</text>
 </paragraph><paragraph id="id8a1f87abca1f464595d811ab5449b249"><enum>(6)</enum><text>IUU fishing vessels play a significant role in other forms of trafficking, particularly drug trafficking. The Department of Justice has documented numerous cases of illicit fishing ships involved in trafficking cocaine, heroin, and cannabis from South America to the United States.</text>
 </paragraph><paragraph id="idecd3b9c52e6940d5bcbd92ed84c43426"><enum>(7)</enum><text>By introducing cheaper, illegal products into the global market, IUU fishing undercuts the business and economic livelihoods of legitimate fishermen in the United States and around the world.</text>
 </paragraph><paragraph id="idc33bd118867e4b77b86d92413cce8730"><enum>(8)</enum><text>In the United States and around the world, seafood fraud undermines the economic viability of fisheries and deceives consumers about their purchasing choices.</text>
 </paragraph><paragraph id="idd8217857ff3e4327a36c71d51cd11e19"><enum>(9)</enum><text>Competition over seafood resources can lead to heightened tensions, conflict, and geostrategic instability in regions of importance to the United States.</text>
 </paragraph></section><section id="idd76534c2fa8942c1a81fbe12a588d11c"><enum>204.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this title are—</text> <paragraph id="id3594c44081d3440f931b774b32825c92"><enum>(1)</enum><text>to support a whole-of-government approach across the Federal Government to counter IUU fishing and related threats to maritime security;</text>
 </paragraph><paragraph id="id113935fff05946a49300b9b7712672e4"><enum>(2)</enum><text>to improve data sharing that enhances surveillance, enforcement, and prosecution against IUU fishing and related activities at a global level;</text>
 </paragraph><paragraph id="id4e612e87af0c44358c3632f02e4c27c2"><enum>(3)</enum><text>to support coordination and collaboration to counter IUU fishing and seafood fraud within priority regions;</text>
 </paragraph><paragraph id="id7c7595783d134434a75ff466c3673d4b"><enum>(4)</enum><text>to increase and improve global transparency and traceability across the seafood supply chain as—</text> <subparagraph id="id414E3B7EEC2344BFAD3D025E170EAEB5"><enum>(A)</enum><text>a deterrent to IUU fishing and seafood fraud; and</text>
 </subparagraph><subparagraph id="idDFA7D86F1E7B468B8A726CC5175BD084"><enum>(B)</enum><text>a tool for strengthening fisheries management and food security;</text> </subparagraph></paragraph><paragraph id="id4db6dd22a9d64a01a7c7f610b7dce746"><enum>(5)</enum><text>to improve global enforcement operations against IUU fishing through a whole-of-government approach by the United States; and</text>
 </paragraph><paragraph id="id446083657CA24850986B266F366D9DD3"><enum>(6)</enum><text>to prevent the use of IUU fishing as a financing source for transnational organized groups that undermine United States and global security interests.</text>
 </paragraph></section><section id="id93a48ca654c14ad286b06b8e5ef91cd2"><enum>205.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text> <paragraph id="id216505834b184a42872088ddb177ec5f"><enum>(1)</enum><text>to take action to curtail the global trade in seafood and seafood products derived from IUU fishing, including its links to forced labor and transnational organized illegal activity;</text>
 </paragraph><paragraph id="id4cbcb42db4304cf1b11af6e9efba062e"><enum>(2)</enum><text>to develop holistic diplomatic, military, law enforcement, economic, and capacity-building tools to counter IUU fishing;</text>
 </paragraph><paragraph id="id88f293ae280c4bb880199e4124a77481"><enum>(3)</enum><text>to provide technical and other forms of assistance to countries in priority regions and priority flag states to combat IUU fishing and seafood fraud, including assistance—</text>
 <subparagraph id="ide09ba006cfaa450480ff581a5978097e"><enum>(A)</enum><text>to increase local, national, and regional level capacities to counter IUU fishing through the engagement of law enforcement and security forces;</text>
 </subparagraph><subparagraph id="id97b68339367249ef8335efbbd44bf541"><enum>(B)</enum><text>to enhance port capacity and security, including through support to implement the Port State Measures Agreement;</text>
 </subparagraph><subparagraph id="id4000185c274f4a9281e2f83304e0016f"><enum>(C)</enum><text>to combat corruption and increase transparency and traceability in fisheries management and trade;</text> </subparagraph><subparagraph id="id594d89f1cfd9472c9e2c4e1ee5d48c30"><enum>(D)</enum><text>to enhance information sharing within and across governments and multilateral organizations through the development and use of agreed standards for information sharing; and</text>
 </subparagraph><subparagraph id="id0325D4F815D3407992F30E60EC5DF3D9"><enum>(E)</enum><text>to support effective, science-based fisheries management regimes that promote legal and safe fisheries and act as a deterrent to IUU fishing;</text>
 </subparagraph></paragraph><paragraph id="id6c7ee66094824df1b064c011e89c0301"><enum>(4)</enum><text>to promote global maritime security through improved capacity and technological assistance to support improved maritime domain awareness;</text>
 </paragraph><paragraph id="id7de202f2a2a04f9698791c1f0c1b68f1"><enum>(5)</enum><text>to engage with priority flag states to encourage the use of high quality vessel tracking technologies where existing enforcement tools are lacking;</text>
 </paragraph><paragraph id="id4428570e99884b51abfbf4fff1c8419f"><enum>(6)</enum><text>to engage with multilateral organizations working on fisheries issues, including Regional Fisheries Management Organizations and the Food and Agriculture Organization of the United Nations, to combat and deter IUU fishing;</text>
 </paragraph><paragraph id="id809275d85c5b4b379dc710b5eef0c94d"><enum>(7)</enum><text>to advance information sharing across governments and multilateral organizations in areas that cross multiple jurisdictions, through the development and use of an agreed standard for information sharing;</text>
 </paragraph><paragraph id="id38f28fb87fe046d6b9e5093b22dacaf0"><enum>(8)</enum><text>to continue to use existing and future trade agreements to combat IUU fishing;</text> </paragraph><paragraph id="id26f9986cef3c478b9761d17ed827ed2f"><enum>(9)</enum><text>to employ appropriate assets and resources of the United States Government in a coordinated manner to disrupt the illicit networks involved in IUU fishing;</text>
 </paragraph><paragraph id="ide84eba42082b4ddbb0d162e942e12e16"><enum>(10)</enum><text>to continue to declassify and make available, as appropriate and practicable, technologies developed by the United States Government that can be used to help counter IUU fishing;</text>
 </paragraph><paragraph id="id61ddbc21b43d4fe2b0ae35c15553b58a"><enum>(11)</enum><text>to recognize the ties of IUU fishing to transnational organized illegal activity, including human trafficking and illegal trade in narcotics and arms, and as applicable, to focus on illicit activity in a coordinated, cross-cutting manner;</text>
 </paragraph><paragraph id="id287e37ad1776438f8e7f0baa710d35b3"><enum>(12)</enum><text>to recognize and respond to poor working conditions, labor abuses, and other violent crimes in the fishing industry;</text>
 </paragraph><paragraph id="id7ef8b955eb5a4a979f98c1edf4a87ea8"><enum>(13)</enum><text>to increase and improve global transparency and traceability along the seafood supply chain as—</text> <subparagraph id="idF443091A39784238BC3BDB196FE739A5"><enum>(A)</enum><text>a deterrent to IUU fishing; and</text>
 </subparagraph><subparagraph id="idCFD6B08C886C41DB9B020F3248487BFC"><enum>(B)</enum><text>an approach for strengthening fisheries management and food security; and</text> </subparagraph></paragraph><paragraph id="id0f09e6dfe68c40a2bdbcfecdaa1ba23b"><enum>(14)</enum><text>to promote technological investment and innovation to combat IUU fishing.</text>
				</paragraph></section><subtitle id="idA3886E99D3F446FE8F3070F8C02E0F32" style="OLC"><enum>A</enum><header>Programs To combat IUU fishing and increase maritime security</header>
 <section id="idad3c18705f33434680532752104f53a8"><enum>211.</enum><header>Coordination with international organizations</header><text display-inline="no-display-inline">The Secretary of State, in conjunction with the Secretary of Commerce, shall coordinate with Regional Fisheries Management Organizations and the Food and Agriculture Organization of the United Nations, and may coordinate with other relevant international governmental or nongovernmental organizations, or the private sector, as appropriate, to enhance regional responses to IUU fishing and related transnational organized illegal activities.</text>
 </section><section id="id2ba52c8fb3d7447db9fcc81c8324df56"><enum>212.</enum><header>Engagement of diplomatic missions of the United States</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this title, each chief of mission (as defined in section 102 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3902">22 U.S.C. 3902</external-xref>)) to a relevant country in a priority region or to a priority flag state may, if the Secretary of State determines such action is appropriate—</text>
 <paragraph id="id38419403aa824edca92bda960a0bd647"><enum>(1)</enum><text>convene a working group, led by Department of State officials, to examine IUU fishing, which may include stakeholders such as—</text>
 <subparagraph id="id5020bd5688684e2282f8dff0aebbc6fc"><enum>(A)</enum><text>United States officials from relevant agencies participating in the interagency working group identified in section 221, foreign officials, nongovernmental organizations, the private sector, and representatives of local fishermen in the region; and</text>
 </subparagraph><subparagraph id="ide78cbab35a9c402a80db4c19954129b4"><enum>(B)</enum><text>experts on IUU fishing, law enforcement, criminal justice, transnational organized illegal activity, defense, intelligence, vessel movement monitoring, and international development operating in or with knowledge of the region; and</text>
 </subparagraph></paragraph><paragraph id="idf115d4a2e804406c9a340c2e89b102e7"><enum>(2)</enum><text>designate a counter-IUU Fishing Coordinator from among existing personnel at the mission if the chief of mission determines such action is appropriate.</text>
					</paragraph></section><section id="id665b9215a85148449e74830eb6141227"><enum>213.</enum><header>Assistance by Federal agencies to improve law enforcement within priority regions and priority flag
			 states</header>
 <subsection id="id071f2bb6c64c48a7bc618f83a9569260"><enum>(a)</enum><header>In general</header><text>The Secretary of State, in collaboration with the Secretary of Commerce and the Secretary of the department in which the Coast Guard is operating, shall provide assistance, as appropriate, in accordance with this section.</text>
 </subsection><subsection id="id11bca23c34d3416cb349bb13dbc21d8c"><enum>(b)</enum><header>Law enforcement training and coordination activities</header><text>The officials referred to in subsection (a) shall evaluate opportunities to provide assistance, as appropriate, to countries in priority regions and priority flag states to improve the effectiveness of IUU fishing enforcement, with clear and measurable targets and indicators of success, including—</text>
 <paragraph id="iddfe733af96024fc2a78488a12ecb9108"><enum>(1)</enum><text>by assessing and using existing resources, enforcement tools, and legal authorities to coordinate efforts to combat IUU fishing with efforts to combat other illegal trade, including weapons, drugs, and human trafficking;</text>
 </paragraph><paragraph id="idb6a385b7d28646deaa5f9e4a91ff5230"><enum>(2)</enum><text>by expanding existing IUU fishing enforcement training;</text> </paragraph><paragraph id="id93d99a8cf4524b30bf9c176f1e7f17cc"><enum>(3)</enum><text>by providing targeted, country- and region-specific training on combating IUU fishing;</text>
 </paragraph><paragraph id="id931bb03536054263a0d0b7212a4ee57d"><enum>(4)</enum><text>by supporting increased effectiveness and transparency of the fisheries enforcement sectors of the governments of such countries; and</text>
 </paragraph><paragraph id="idE328F1E9976041FABFF3C07FD3CED77B"><enum>(5)</enum><text>by supporting increased outreach to stakeholders in the affected communities as key partners in combating and prosecuting IUU fishing.</text>
 </paragraph></subsection><subsection id="id776457a022504b1c824a49905785ba14"><enum>(c)</enum><header>Port security assistance</header><text>The officials referred to in subsection (a) shall evaluate opportunities to provide assistance, as appropriate, to countries in priority regions and priority flag states to help those states implement programs related to port security and capacity for the purposes of preventing IUU fishing products from entering the global seafood market, including support for implementing the Port State Measures Agreement.</text>
 </subsection><subsection id="id153c1792a38143179e4593dd494c73d7"><enum>(d)</enum><header>Capacity building for investigations and prosecutions</header><text display-inline="yes-display-inline">The officials referred to in subsection (a), in collaboration with the governments of countries in priority regions and of priority flag states, shall evaluate opportunities to assist those countries in designing and implementing programs in such countries, as appropriate, to increase the capacity of IUU fishing enforcement and customs and border security officers to improve their ability—</text>
 <paragraph id="id2fa22cff5676489f93900d9404d2f36b"><enum>(1)</enum><text>to conduct effective investigations, including using law enforcement techniques such as undercover investigations and the development of informer networks and actionable intelligence;</text>
 </paragraph><paragraph id="idedcddb3d998f45f09fefc97dcf61a518"><enum>(2)</enum><text>to conduct vessel boardings and inspections at sea and associated enforcement actions;</text> </paragraph><paragraph id="id7b77508f56714c7d88bbef6d7ad0ffac"><enum>(3)</enum><text>to exercise existing shiprider agreements and to enter into and implement new shiprider agreements, as appropriate;</text>
 </paragraph><paragraph id="ide07251c1e2a14dce952e5c2c45e24892"><enum>(4)</enum><text>to conduct vessel inspections at port and associated enforcement actions;</text> </paragraph><paragraph id="ida1b41dd8da3e4f9f90b0339c6a1f6c40"><enum>(5)</enum><text>to assess technology needs and promote the use of technology to improve monitoring, enforcement, and prosecution of IUU fishing;</text>
 </paragraph><paragraph id="id2e5832a770134dbbb28e0a139302b067"><enum>(6)</enum><text>to conduct DNA-based and forensic identification of seafood used in trade;</text> </paragraph><paragraph id="id92d48f99de4740d1968e054d22b30f2b"><enum>(7)</enum><text>to conduct training on techniques, such as collecting electronic evidence and using computer forensics, for law enforcement personnel involved in complex investigations related to international matters, financial issues, and government corruption that include IUU fishing;</text>
 </paragraph><paragraph id="ida5df9cbf8eff40f7a9d5e4d521f1da72"><enum>(8)</enum><text>to assess financial flows and the use of financial institutions to launder profits related to IUU fishing;</text>
 </paragraph><paragraph id="idcad83977708e4dfc923028af37bb820e"><enum>(9)</enum><text>to conduct training on the legal mechanisms that can be used to prosecute those identified in the investigations as alleged perpetrators of IUU fishing and other associated crimes such as trafficking and forced labor; and</text>
 </paragraph><paragraph id="idA0329B413CC64C6992BA81874DBB746E"><enum>(10)</enum><text>to conduct training to raise awareness of the use of whistleblower information and ways to incentivize whistleblowers to come forward with original information related to IUU fishing.</text>
 </paragraph></subsection><subsection id="id00c63169c6504c7fbc9bc68d91ce221b"><enum>(e)</enum><header>Capacity building for information sharing</header><text>The officials referred to in subsection (a) shall evaluate opportunities to provide assistance, as appropriate, to key countries in priority regions and priority flag states in the form of training, equipment, and systems development to build capacity for information sharing related to maritime enforcement and port security.</text>
 </subsection><subsection id="ida6530001d1f84ed39dfc5a1a3191b068"><enum>(f)</enum><header>Coordination with other relevant agencies</header><text>The Secretary of State, in collaboration with the Secretary of the department in which the Coast Guard is operating and the Secretary of Commerce, shall coordinate with other relevant agencies, as appropriate, in accordance with this section.</text>
 </subsection></section><section id="id3a034fa8f4f14c1a9baef95fde825df4"><enum>214.</enum><header>Expansion of existing mechanisms to combat IUU fishing</header><text display-inline="no-display-inline">The Secretary of State, the Administrator of the United States Agency for International Development, the Secretary of the Department in which the Coast Guard is operating, the Secretary of Defense, the Secretary of Commerce, the Attorney General, and the heads of other appropriate Federal agencies shall assess opportunities to combat IUU fishing by expanding, as appropriate, the use of the following mechanisms:</text>
 <paragraph id="id17e31e6f16574d7f95f9bcc8f0b1eb17"><enum>(1)</enum><text>Including counter-IUU fishing in existing shiprider agreements in which the United States is a party.</text>
 </paragraph><paragraph id="id029aa24769e644899d8bea821035691e"><enum>(2)</enum><text>Entering into shiprider agreements that include counter-IUU fishing with priority flag states and countries in priority regions with which the United States does not already have such an agreement.</text>
 </paragraph><paragraph id="idb40a61772c194aadb61d64bcf7c9d5c0"><enum>(3)</enum><text>Including counter-IUU fishing as part of the mission of the Combined Maritime Forces.</text> </paragraph><paragraph id="ida39a1f41b8e540cbacb3fd68e97b9ae0"><enum>(4)</enum><text>Including counter-IUU fishing exercises in the annual at-sea exercises conducted by the Department of Defense, in coordination with the United States Coast Guard.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0C22B48FA96F43C982BE9697C9524D07"><enum>(5)</enum><text display-inline="yes-display-inline">Creating partnerships similar to the Oceania Maritime Security Initiative and the Africa Maritime Law Enforcement Partnership in other priority regions.</text>
 </paragraph></section><section id="id3364f57d7648482b9571b07e443beec9"><enum>215.</enum><header>Improvement of transparency and traceability programs</header><text display-inline="no-display-inline">The Secretary of State, the Administrator of the United States Agency for International Development, the Secretary of the Department in which the Coast Guard is operating, the Secretary of Commerce, and the heads of other Federal agencies, if merited, shall work, as appropriate, with priority flag states and key countries in priority regions—</text>
 <paragraph id="idc131bdbc932e46599efa097a2d39fde9"><enum>(1)</enum><text>to increase knowledge within such countries about the United States transparency and traceability standards for imports of seafood and seafood products;</text>
 </paragraph><paragraph id="ide5a56a1b2a1745beb26069c18e9bd0d6"><enum>(2)</enum><text>to improve the capacity of seafood industries within such countries through information sharing and training to meet the requirements of transparency and traceability standards for seafood and seafood product imports, including catch documentation and trade tracking programs adopted by relevant regional fisheries management organizations;</text>
 </paragraph><paragraph id="id3084cbcb1eb4486294079477ec8e98e5"><enum>(3)</enum><text>to improve the capacities of government, industry, and civil society groups to develop and implement comprehensive traceability systems that—</text>
 <subparagraph id="id8E3E2576D33748EAB5F0D75B32D2A913"><enum>(A)</enum><text>deter IUU fishing;</text> </subparagraph><subparagraph id="id83EF3CA13B4342AB989369DE214EB438"><enum>(B)</enum><text>strengthen fisheries management; and</text>
 </subparagraph><subparagraph id="idCDE0CE510B704DDEBDB8AF49A1F6FD8D"><enum>(C)</enum><text>enhance maritime domain awareness; and</text> </subparagraph></paragraph><paragraph id="id784353a9476844708b97e97b47433647"><enum>(4)</enum><text>to support the implementation of seafood traceability standards in such countries to prevent IUU fishing products from entering the global seafood market and assess capacity and training needs in those countries.</text>
 </paragraph></section><section id="id8FC87A7DF60D4F2AB30A4E38B336D229"><enum>216.</enum><header>Technology programs</header><text display-inline="no-display-inline">The Secretary of State, the Administrator of the United States Agency for International Development, the Secretary of the Department in which the Coast Guard is operating, the Secretary of Defense, the Secretary of Commerce, and the heads of other Federal agencies, as appropriate, shall pursue programs to expand the role of technology for combating IUU fishing, including by—</text>
 <paragraph id="idd43d486da7e54596a8870555937f78e3"><enum>(1)</enum><text>promoting the use of technology to combat IUU fishing;</text> </paragraph><paragraph id="id26d9827d8b904b9e8ca79c26d2658533"><enum>(2)</enum><text>assessing the technology needs, including vessel tracking technologies and data sharing, in priority regions and priority flag states;</text>
 </paragraph><paragraph id="idfe123c9444b240c085506a5d9cbad1ce"><enum>(3)</enum><text>engaging with priority flag states to encourage the mandated use of vessel tracking technologies, including vessel monitoring systems, AIS, or other vessel movement monitoring technologies on fishing vessels and transshipment vessels at all times, as appropriate, while at sea as a means to identify IUU fishing activities and the shipment of illegally caught fish products; and</text>
 </paragraph><paragraph id="ide2e63c4329c54d079c0808b178172769"><enum>(4)</enum><text>building partnerships with the private sector, including universities, nonprofit research organizations, the seafood industry, and the technology, transportation and logistics sectors, to leverage new and existing technologies and data analytics to address IUU fishing.</text>
 </paragraph></section><section id="id188263a26ce645e38619a0fc4252ba11"><enum>217.</enum><header>Information sharing</header><text display-inline="no-display-inline">The Director of National Intelligence, in conjunction with other agencies, as appropriate, shall develop an enterprise approach to appropriately share information and data within the United States Government or with other countries or nongovernmental organizations, or the private sector, as appropriate, on IUU fishing and other connected transnational organized illegal activity occurring in priority regions and elsewhere, including big data analytics and machine learning.</text>
				</section></subtitle><subtitle id="id3E1051A80196418CAE858E034F9D8F9F" style="OLC"><enum>B</enum><header>Establishment of interagency working group on IUU fishing</header>
				<section id="idd31bd1bbdf924acfa87ab7f210a4339f"><enum>221.</enum><header>Interagency Working Group on IUU Fishing</header>
 <subsection id="idc59a771e75c9464b828fa9a6942b6f2c"><enum>(a)</enum><header>In general</header><text>There is established a collaborative interagency working group on maritime security and IUU fishing (referred to in this title as the <quote>Working Group</quote>).</text>
 </subsection><subsection id="id2e0f4536917d42e899c2b69ec85bcb63"><enum>(b)</enum><header>Members</header><text>The members of the Working Group shall be composed of—</text> <paragraph id="idf4a2c7c09fec42e78e1384d2d344750e"><enum>(1)</enum><text>1 chair, who shall rotate between the Coast Guard, the Department of State, and the National Oceanographic and Atmospheric Administration on a 3-year term;</text>
 </paragraph><paragraph id="idCE5FD3406B5F476F81D96EDA00575722"><enum>(2)</enum><text>2 deputy chairs, who shall be appointed by their respective agency heads and shall be from a different Department than that of the chair, from—</text>
 <subparagraph id="id148F99A28BA64612AB0DE491D04C3781"><enum>(A)</enum><text>the Coast Guard;</text> </subparagraph><subparagraph id="id17B2389FC84441D89FD6395610A0D7D5"><enum>(B)</enum><text>the Department of State; and</text>
 </subparagraph><subparagraph id="idEC192A2A0A924AB8BAF8EB292C7B070F"><enum>(C)</enum><text>the National Oceanic and Atmospheric Administration;</text>
 </subparagraph></paragraph><paragraph id="id04540c13ceef4a23923f99e1e7a76ffc"><enum>(3)</enum><text>12 members, who shall be appointed by their respective agency heads, from—</text> <subparagraph id="id6a582e642e11433c9912b484d9df4a26"><enum>(A)</enum><text>the Department of Defense;</text>
 </subparagraph><subparagraph id="idcd45857ebabb4e24a82dc2d16bc35636"><enum>(B)</enum><text>the United States Navy;</text> </subparagraph><subparagraph id="idca5f93515db44bdab1a7474d7e62d4ac"><enum>(C)</enum><text>the United States Agency for International Development;</text>
 </subparagraph><subparagraph id="id52a8e2fe54274b59b641c72b6ba27782"><enum>(D)</enum><text>the United States Fish and Wildlife Service;</text> </subparagraph><subparagraph id="id09505481383b43c39cc3241ee3a84a94"><enum>(E)</enum><text>the Department of Justice;</text>
 </subparagraph><subparagraph id="id2b5639cd7a8644fc820af1a653747474"><enum>(F)</enum><text>the Department of the Treasury;</text> </subparagraph><subparagraph commented="no" id="idc2d8d4c7e5a545f58a90e09059516164"><enum>(G)</enum><text>U.S. Customs and Border Protection;</text>
 </subparagraph><subparagraph commented="no" id="idf8aa969cbd8946d38b32d39edc3c833d"><enum>(H)</enum><text>U.S. Immigration and Customs Enforcement;</text> </subparagraph><subparagraph id="id9278906d26624dcca314981e0f24d67f"><enum>(I)</enum><text>the Federal Trade Commission;</text>
 </subparagraph><subparagraph id="iddfeb51799b2c4061b5ce4e883bc59fab"><enum>(J)</enum><text>the National Institute of Food and Agriculture;</text> </subparagraph><subparagraph id="id4358f55c9bfa4ac0a3b0f0b2418144f2"><enum>(K)</enum><text>the Food and Drug Administration; and</text>
 </subparagraph><subparagraph id="ide274957fe9d541ba91d9a19c197f2623"><enum>(L)</enum><text>the Department of Labor;</text> </subparagraph></paragraph><paragraph id="id420d02fc736c4a73943e02ceb2d1d0ed"><enum>(4)</enum><text>1 or more members from the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)), who shall be appointed by the Director of National Intelligence; and</text>
 </paragraph><paragraph id="id3464F329792142A3AB56F23671FD8054"><enum>(5)</enum><text>5 members, who shall be appointed by the President, from—</text> <subparagraph id="idB8373C9E083D4DF6AD09D81AB3568EA8"><enum>(A)</enum><text>the National Security Council;</text>
 </subparagraph><subparagraph id="id48D492BB44594FA6A69DF750C7B49B66"><enum>(B)</enum><text>the Council on Environmental Quality;</text>
 </subparagraph><subparagraph id="idB45E93D4E58A4B8DB7151826BC856A51"><enum>(C)</enum><text>the Office of Management and Budget;</text> </subparagraph><subparagraph id="id23F0C91949C34FB7BD51DEBC338148C7"><enum>(D)</enum><text>the Office of Science and Technology Policy; and</text>
 </subparagraph><subparagraph id="id8499394EFB6D48E48984C52767BA8BD3"><enum>(E)</enum><text>the Office of the United States Trade Representative.</text>
 </subparagraph></paragraph></subsection><subsection id="idad6607f5c4524313912ce8cf00803d26"><enum>(c)</enum><header>Responsibilities</header><text>The Working Group shall ensure an integrated, Federal Governmentwide response to IUU fishing globally, including by—</text>
 <paragraph id="id43e4d19674d945a3b1d7be6b33e8681a"><enum>(1)</enum><text>improving the coordination of Federal agencies to identify, interdict, investigate, prosecute, and dismantle IUU fishing operations and organizations perpetrating and knowingly benefiting from IUU fishing;</text>
 </paragraph><paragraph id="id0a318cab2fba441faf9a7808e23b0d4a"><enum>(2)</enum><text>assessing areas for increased interagency information sharing on matters related to IUU fishing and related crimes;</text>
 </paragraph><paragraph id="id48f4febd36ee45a8b9b0a9f1d2562038"><enum>(3)</enum><text>establishing standards for information sharing related to maritime enforcement;</text> </paragraph><paragraph id="idf2731cf28ad046c487db52631c21aa6c"><enum>(4)</enum><text>developing a strategy to determine how military assets and intelligence can contribute to enforcement strategies to combat IUU fishing;</text>
 </paragraph><paragraph id="id63fed4d419ac4eb58ea327b9164a140e"><enum>(5)</enum><text>increasing maritime domain awareness relating to IUU fishing and related crimes and developing a strategy to leverage awareness for enhanced enforcement and prosecution actions against IUU fishing;</text>
 </paragraph><paragraph id="id9c2a2ef5630b4068974cb53baf2eca8a"><enum>(6)</enum><text>supporting the implementation of the Port State Measures Agreement in relevant countries and assessing the capacity and training needs in such countries;</text>
 </paragraph><paragraph id="idac819367078349aab8ad524c17054b88"><enum>(7)</enum><text>outlining a strategy to coordinate, increase, and use shiprider agreements between the Department of Defense or the Coast Guard and relevant countries;</text>
 </paragraph><paragraph id="id7cc41e7e86734092943139f792eea506"><enum>(8)</enum><text>enhancing cooperation with partner governments to combat IUU fishing;</text> </paragraph><paragraph id="idecb9962135084403bd2f796a20b3a979"><enum>(9)</enum><text>identifying opportunities for increased information sharing between Federal agencies and partner governments working to combat IUU fishing;</text>
 </paragraph><paragraph id="idfbcb311c9ed64283a061e668ba584ead"><enum>(10)</enum><text>consulting and coordinating with the seafood industry and nongovernmental stakeholders that work to combat IUU fishing;</text>
 </paragraph><paragraph id="id80eeef07046d4371aea7f0e0e7ea31ed"><enum>(11)</enum><text>supporting the work of collaborative international initiatives to make available certified data from state authorities about vessel and vessel-related activities related to IUU fishing;</text>
 </paragraph><paragraph id="idfa4c84b91ac84b19a4c5eb7de24d245f"><enum>(12)</enum><text>supporting the identification and certification procedures to address IUU fishing in accordance with the High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826d">16 U.S.C. 1826d</external-xref> et seq.); and</text>
 </paragraph><paragraph id="id4a54ab651b0d46cbbffbd51cf1cad875"><enum>(13)</enum><text>developing a strategy for raising domestic awareness of the issues relating to IUU fishing, including publishing annual reports summarizing nonsensitive information about the Working Group’s efforts to investigate, enforce, and prosecute groups and individuals engaging in IUU fishing.</text>
						</paragraph></subsection></section><section id="id5d9f33e2d3184d4e923501620120f6c9"><enum>222.</enum><header>Strategic plan</header>
 <subsection id="idcfa9ca74bb9e4c968c73539f7166a373"><enum>(a)</enum><header>Strategic plan</header><text>Not later than 2 years after the date of the enactment of this title, the Working Group, after consultation with the relevant stakeholders, shall submit to Congress a 5-year integrated strategic plan on combating IUU fishing and enhancing maritime security, including specific strategies with monitoring benchmarks for addressing IUU fishing in priority regions.</text>
					</subsection><subsection id="ideb2c02823d6243678516c9860716b36a"><enum>(b)</enum><header>Identification of priority regions and priority flag states</header>
 <paragraph id="iddd2b7fab1cbd47c6942dce1219f6d76d"><enum>(1)</enum><header>In general</header><text>The strategic plan submitted under subsection (a) shall identify priority regions and priority flag states to be the focus of assistance coordinated by the Working Group under section 221.</text>
 </paragraph><paragraph id="id00bbc74326094ab6b0181a62be352c2d"><enum>(2)</enum><header>Priority region selection criteria</header><text>In selecting priority regions under paragraph (1), the Working Group shall select regions that—</text> <subparagraph id="idAF7E8377EEBD48CA8BA33A395FBE50AB"><enum>(A)</enum><text>are at high risk for IUU fishing activity or the entry of illegally caught seafood into their markets; and</text>
 </subparagraph><subparagraph id="idE1A12BE4CE294DCDAAF18A8F7AB3E221"><enum>(B)</enum><text>lack the capacity to fully address the issues described in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="id4f65758c709146738db9bc3603bdf773"><enum>(3)</enum><header>Priority flag states selection criteria</header><text>In selecting priority flag states under paragraph (1), the Working Group shall select countries—</text> <subparagraph id="idBE10DB2B18D943C98F727D5CC7936644"><enum>(A)</enum><text>the flagged vessels of which actively engage in, knowingly profit from, or are complicit in IUU fishing; and</text>
 </subparagraph><subparagraph id="id816616940F944956A06CD620B878061C"><enum>(B)</enum><text>that lack the capacity to police their fleet.</text> </subparagraph></paragraph></subsection></section><section id="idb2659933d2af479785c86adb86e1c2d5"><enum>223.</enum><header>Reports</header><text display-inline="no-display-inline">Not later than 5 years after the submission of the 5-year integrated strategic plan under section 222, and every 5 years thereafter, the Working Group shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>, the <committee-name committee-id="">Committee on Natural Resources of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name> that contains—</text>
 <paragraph id="id2f91ad5442ca44e4a764e18a88325a1d"><enum>(1)</enum><text>a summary of global and regional trends in IUU fishing;</text> </paragraph><paragraph id="id8add6d909da04c7cb90870b517e78c1a"><enum>(2)</enum><text>an assessment of the extent of the convergence between transnational organized illegal activity, including human trafficking and forced labor, and IUU fishing;</text>
 </paragraph><paragraph id="id1a3211651ece41c8bf38c3d39ca3648e"><enum>(3)</enum><text>an assessment of the topics, data sources, and strategies that would benefit from increased information sharing and recommendations regarding harmonization of data collection and sharing;</text>
 </paragraph><paragraph id="idfb85bbd340304227ae1453ada74faf92"><enum>(4)</enum><text>an assessment of assets, including military assets and intelligence, which can be used for either enforcement operations or strategies to combat IUU fishing;</text>
 </paragraph><paragraph id="id1de368bd47d84154a28deba770fbca07"><enum>(5)</enum><text>summaries of the situational threats with respect to IUU fishing in priority regions and an assessment of the capacity of countries within such regions to respond to those threats;</text>
 </paragraph><paragraph id="idc98f167d89f34ca3b888062b4c33596e"><enum>(6)</enum><text>an assessment of the progress of countries in priority regions in responding to those threats as a result of assistance by the United States pursuant to the strategic plan developed under section 222, including—</text>
 <subparagraph id="id648e4c6b2b20487ab7779406367d71b1"><enum>(A)</enum><text>the identification of—</text> <clause id="id078952ff3a11407487e768e1653a235a"><enum>(i)</enum><text>relevant supply routes, ports of call, methods of landing and entering illegally caught product into legal supply chains, and financial institutions used in each country by participants engaging in IUU fishing; and</text>
 </clause><clause id="idd143f4371c3540bd8ee887676518fddb"><enum>(ii)</enum><text>indicators of IUU fishing that are related to money laundering;</text> </clause></subparagraph><subparagraph id="id6b20f9e33a0b4f25913405b83051fd67"><enum>(B)</enum><text>an assessment of the adherence of countries in priority regions to international treaties related to IUU fishing, including the Port State Measures Agreement;</text>
 </subparagraph><subparagraph id="id6502445d80a649c1b498f1efb66e8626"><enum>(C)</enum><text>an assessment of the implementation by countries in priority regions of seafood traceability or capacity to apply traceability to verify the legality of catch and strengthen fisheries management;</text>
 </subparagraph><subparagraph id="idc21f09d9602747e2a61ca5d1321a7dd6"><enum>(D)</enum><text>an assessment of the capacity of countries in priority regions to implement shiprider agreements;</text> </subparagraph><subparagraph id="id1f632b5c695c4434aad7088661f5a25e"><enum>(E)</enum><text>an assessment of the capacity of countries in priority regions to increase maritime domain awareness; and</text>
 </subparagraph><subparagraph id="id6967a861e3ba4f5798bb85704c5dc616"><enum>(F)</enum><text>an assessment of the capacity of governments of relevant countries in priority regions to sustain the programs for which the United States has provided assistance under this title;</text>
 </subparagraph></paragraph><paragraph id="id3e4b7620cdee442aab356172e167ff12"><enum>(7)</enum><text>an assessment of the capacity of priority flag states to track the movement of and police their fleet, prevent their flagged vessels from engaging in IUU fishing, and enforce applicable laws and regulations; and</text>
 </paragraph><paragraph id="ide3c73685e71e42108a3efdc1bbd2ae97"><enum>(8)</enum><text>an assessment of the extent of involvement in IUU fishing of organizations designated as foreign terrorist organizations under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>).</text>
					</paragraph></section><section id="idd1cfeaa6239e470aadce629b2d0d7960"><enum>224.</enum><header>Gulf of Mexico IUU Fishing Subworking Group</header>
 <subsection id="idb3ce0f08d0a74c38a93cbc2419a9eab5"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this title, the Administrator of the National Oceanic and Atmospheric Administration, in coordination with the Coast Guard and the Department of State, shall establish a subworking group to address IUU fishing in the exclusive economic zone of the United States in the Gulf of Mexico.</text>
 </subsection><subsection id="id0996693ebd7f4978899aea116299054f"><enum>(b)</enum><header>Functions</header><text>The subworking group established under subsection (a) shall identify—</text> <paragraph id="id696ddc42aa254bea8a1b6ce9f15f5fd0"><enum>(1)</enum><text>Federal actions taken and policies established during the 5-year period immediately preceding the date of the enactment of this title with respect to IUU fishing in the exclusive economic zone of the United States in the Gulf of Mexico, including such actions and policies related to—</text>
 <subparagraph id="id505e9b4fb31b4b409b416297a3eb317e"><enum>(A)</enum><text>the surveillance, interdiction, and prosecution of any foreign nationals engaged in such fishing; and</text>
 </subparagraph><subparagraph id="id2f5623646e9447e2a496c5c4fdd652d3"><enum>(B)</enum><text>the application of the provisions of the High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826d">16 U.S.C. 1826d</external-xref> et seq.) to any relevant nation, including the status of any past or ongoing consultations and certification procedures;</text>
 </subparagraph></paragraph><paragraph id="id0f25f0ce8592462e9617102fd9d7f91a"><enum>(2)</enum><text>actions and policies, in addition to the actions and policies described in paragraph (1), each of the Federal agencies described in subsection (a) can take, using existing resources, to combat IUU fishing in the exclusive economic zone of the United States in the Gulf of Mexico; and</text>
 </paragraph><paragraph id="idebf53b602d2347059bf3033499296493"><enum>(3)</enum><text>any additional authorities that could assist each such agency in more effectively addressing such IUU fishing.</text>
 </paragraph></subsection><subsection id="id8ae5f485b86f4a9480087aad40177b09"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the IUU Fishing Subworking Group is established under subsection (a), the group shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Natural Resources of the House of Representatives</committee-name> that contains—</text>
 <paragraph id="id5B512FFA06F6442DA78DE2BCB2F1D61F"><enum>(1)</enum><text>the findings identified pursuant to subsection (b); and</text> </paragraph><paragraph id="id63F6CFB473BF4D02824F6DC60E47F6FF"><enum>(2)</enum><text>a timeline for each of the Federal agencies described in subsection (a) to implement each action or policy identified pursuant to subsection (b)(2).</text>
						</paragraph></subsection></section></subtitle><subtitle id="idEFEB1DB320D5493B9C4DA22B27248223" style="OLC"><enum>C</enum><header>Authorization of appropriations</header>
 <section commented="no" display-inline="no-display-inline" id="id8FFDB1FB032948C996E3B11AFF41AE9C" section-type="subsequent-section"><enum>231.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out the activities required under this title.</text></section></subtitle></title></legis-body></bill>
