which was read twice, considered, read the third time, and passed</action-desc></action><legis-type>A BILL</legis-type><official-title>To make technical corrections to the computation of average pay under <external-xref legal-doc="public-law" parsable-cite="pl/110/279">Public Law 110–279</external-xref>. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="idE987BBCF3F7947FC9456525EA53B2C1D" section-type="section-one"><enum>1.</enum><header>Technical corrections to computation of average pay under <external-xref legal-doc="public-law" parsable-cite="pl/110/279">Public Law 110–279</external-xref></header><subsection id="idBFD4AE23FC524CCF804B932B4A7937E9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1(c)(2)(A) of <external-xref legal-doc="public-law" parsable-cite="pl/110/279">Public Law 110–279</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/2/2051">2 U.S.C. 2051(c)(2)(A)</external-xref>) is amended—</text><paragraph id="idB49AD5D619344DEC9FA2BA39B65C86D3"><enum>(1)</enum><text>by striking <quote>For purposes of</quote> and all that follows through <quote>(i) any period</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id9A4D72D7742A4A31A7C79081202AD1B1" style="OLC"><clause id="id349D81CA2403475486BE0D100D0681E2"><enum>(i)</enum><header>Treatment of service</header><text>For purposes of chapters 83, 84, and 87 of title 5, United States Code, any period</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="idE9EC31C0244743308FBFA254F0C7BE3D"><enum>(2)</enum><text>in clause (i), by striking <quote>; and</quote> and inserting a period; and</text></paragraph><paragraph id="id7F2976E753D74344B6C60F52A4FE4031"><enum>(3)</enum><text>in clause (ii)—</text><subparagraph id="id1778E312663E44FBB54E7AE2EE4832B6"><enum>(A)</enum><text>by inserting <quote><header-in-text level="clause" style="OLC">Treatment of pay</header-in-text>.—For purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/87">chapter 87</external-xref> of title 5, United States Code,</quote> before <quote>the rate of basic pay</quote>; and</text></subparagraph><subparagraph id="id8386AEE79B15404D89FFEA621584553A"><enum>(B)</enum><text>by striking <quote>the covered</quote> and inserting <quote>a covered</quote>.</text></subparagraph></paragraph></subsection><subsection id="idB3A002D3305D45E7B7B3A61CE9F80963"><enum>(b)</enum><header>Regulations</header><paragraph id="id70C9BE52752F476EBCA7B19929AD24EC"><enum>(1)</enum><header>In general</header><text>The Director of the Office of Personnel Management shall promulgate regulations to carry out this section.</text></paragraph><paragraph id="idAA84B067DC6948E5B790B868C5E2B920"><enum>(2)</enum><header>Effective date</header><text>The regulations promulgated under paragraph (1) shall take effect not later than 180 days after the date of enactment of this Act.</text></paragraph></subsection><subsection id="id94775F7B8262421FB18694D0EAE3C97F"><enum>(c)</enum><header>Applicability of amendments</header><paragraph id="id40E3D3CDA072417CB5718A718C1A7A96"><enum>(1)</enum><header>Definitions</header><text>In this subsection, the terms <term>contractor</term>, <term>covered individual</term>, and <term>food services contract</term> have the meanings given those terms in section 1(a) of <external-xref legal-doc="public-law" parsable-cite="pl/110/279">Public Law 110–279</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/2/2051">2 U.S.C. 2051(a)</external-xref>).</text></paragraph><paragraph id="id039D4EEDD7EF4C08AED270A2F2293CE8"><enum>(2)</enum><header>Applicability</header><text>The amendments made by this section shall apply with respect to—</text><subparagraph id="id8B75CB3A662746EBB0257F570B71E325"><enum>(A)</enum><text>a covered individual who separates from service as an employee of a contractor performing services under the food services contract before, on, or after the date of enactment of this Act; and</text></subparagraph><subparagraph id="id38944494255A42AAB465F5CEAB3A92E4"><enum>(B)</enum><text>each payment to a covered individual under chapter 83 or 84 of title 5, United States Code, made on or after the effective date of the regulations promulgated under subsection (b).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
