 Supreme Court case law.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Due Process Protections Act </short-title></quote>.</text></section><section id="id9C44E9E1B7BF4440974A0404A3556913"><enum>2.</enum><header>Reminder of prosecutorial obligations</header><text display-inline="no-display-inline">Rule 5 of the Federal Rules of Criminal Procedure is amended—</text><paragraph id="id4F7F82CF0C624EECA61215B109BFB241"><enum>(1)</enum><text>by redesignating subsection (f) as subsection (g); and</text></paragraph><paragraph id="idFBAB538B9B8C40729912A43B14E85860"><enum>(2)</enum><text>by inserting after subsection (e) the following:</text><quoted-block display-inline="no-display-inline" id="idE21A8A21A29C4F5590EB181BC48A6A1A" style="OLC"><subsection id="id4F55404CBA4B428DA68A7151CAF92D3C"><enum>(f)</enum><header>Reminder of prosecutorial obligation</header><paragraph id="id7FD776267DDD44228269C6A05C616320"><enum>(1)</enum><header>In general</header><text>In all criminal proceedings, on the first scheduled court date when both prosecutor and defense counsel are present, the judge shall issue an oral and written order to prosecution and defense counsel that confirms the disclosure obligation of the prosecutor under Brady v. Maryland, 373 U.S. 83 (1963) and its progeny, and the possible consequences of violating such order under applicable law.</text></paragraph><paragraph id="idA8FF1B36C2514362990F326516F16E63"><enum>(2)</enum><header>Formation of order</header><text>Each judicial council in which a district court is located shall promulgate a model order for the purpose of paragraph (1) that the court may use as it determines is appropriate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
