	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure Traveler Act</short-title></quote>.</text>
 </section><section id="idC13A152C32494179B059F0ABB7AD04D3"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="id6AED2B792137499EB26560DCB8F42FB2"><enum>(1)</enum><header>Public agency</header><text>The term <term>public agency</term> means the Federal Government, a State government, a unit of local government, any combination of such government entities, or any department, agency, or instrumentality of any such government entity.</text>
 </paragraph><paragraph id="idB0DD7CB3985A43AAB9EC0666284F26DA"><enum>(2)</enum><header>Sponsoring agency</header><text>The term <term>sponsoring agency</term> means a government agency for which a security clearance is obtained, as determined by the Director of the National Background Investigations Bureau of the Office of Personnel Management.</text>
 </paragraph><paragraph id="id0c43fde4b5f04c608167773f5bed7cdc"><enum>(3)</enum><header>Public safety officer</header><text>The term <term>public safety officer</term> means a person serving as a law enforcement officer, as determined by the Attorney General.</text> </paragraph></section><section id="id3CA82DC8B4FA46EBBA82650F8374EB22"><enum>3.</enum><header>TSA PreCheck enrollment for individuals with active security clearance</header> <subsection id="idD238BAF1D7DA438E94FEA9BCB8B9C5E1"><enum>(a)</enum><header>Process</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Administrator of the Transportation Security Administration, in consultation with the Director of the National Background Investigations Bureau of the Office of Personnel Management and other appropriate departments and agencies of the Federal Government, shall establish a process to permit the verification of an active security clearance to enable enrollment in TSA PreCheck.</text>
 </subsection><subsection id="id49E5B6502372423ABA8E1F6FB2112A10"><enum>(b)</enum><header>Components</header><text>In establishing the process required under subsection (a), the Administrator shall ensure that—</text>
 <paragraph id="id650723c4921a45c080fe3e75dffae255"><enum>(1)</enum><text>eligible applicants for TSA PreCheck provide verification of active clearance through coordination with their sponsoring agency;</text>
 </paragraph><paragraph id="id004191A41B6E45AFADB2CF5745121E76"><enum>(2)</enum><text>active clearance is required at the time an application is submitted and at the time of its approval;</text>
 </paragraph><paragraph id="id438c4f95005f4fe29272eab5e60b3672"><enum>(3)</enum><text>interim security clearance is not accepted for purposes of paragraphs (1) and (2); and</text> </paragraph><paragraph id="idc61698fac81d40b7bffd44e775645584"><enum>(4)</enum><text>approved applicants are assigned a trusted traveler number.</text>
 </paragraph></subsection><subsection id="idd98b0bd395c54c6798d4f1b72b7f5ed0"><enum>(c)</enum><header>Eligible levels of clearance</header><text>An individual holding any of the following security clearances shall be eligible to participate in TSA PreCheck under the process established under subsection (a):</text>
 <paragraph id="ida63e5de54728454c8f2064f0e43b9503"><enum>(1)</enum><text>Secret.</text> </paragraph><paragraph id="id6f44dc99d2de4747842b63736ae68d02"><enum>(2)</enum><text>Top Secret, including Sensitive Compartmented Information.</text>
 </paragraph><paragraph id="ide8627918cbd14794ac556ec03c73d39d"><enum>(3)</enum><text>L Clearance.</text> </paragraph><paragraph id="idfc6a3c89b7fb49be8481f82ce3251260"><enum>(4)</enum><text>Q Clearance.</text>
 </paragraph><paragraph id="id002e42df175b482f8c91957e64ca8989"><enum>(5)</enum><text>Yankee White, all categories.</text> </paragraph></subsection><subsection id="idddc87aeed6cf492d9e2b934ac9b0aa6d"><enum>(d)</enum><header>Fees</header><text>Any individual who enrolls in TSA PreCheck through the process established under subsection (a) shall submit any fee required to cover the costs of participation in such program. Notwithstanding section 3302 of title 31, United States Code, such fee shall be retained and used by the Transportation Security Administration.</text>
			</subsection><subsection id="id53a7d42b31024ef6b7a86465de869d52"><enum>(e)</enum><header>Termination; renewal</header>
 <paragraph id="iddebfbd5a131a4e2a9481c5dcb8826c56"><enum>(1)</enum><header>Term</header><text>If an individual remains eligible for membership in TSA PreCheck under the requirements established by the Transportation Security Administration, his or her participation in TSA PreCheck will terminate on the date that is 5 years after the date on which such enrollment is approved unless it is renewed in accordance with applicable law.</text>
				</paragraph><paragraph id="id322e6764a29b46d1aa219121cce5b007"><enum>(2)</enum><header>Revocation</header>
 <subparagraph id="id54212AE65D0845A4BBD7E8D9435B8BCE"><enum>(A)</enum><header>In general</header><text>An individual’s participation in TSA PreCheck that was initiated through the process established under subsection (a) shall be terminated if the underlying security clearance is revoked, as determined by the sponsoring agency.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id904c4d450e1f455a98f798f181434e92"><enum>(B)</enum><header>Exceptions</header><text>Except as provided in subparagraph (A), an individual’s participation in TSA PreCheck that was initiated through the process established under subsection (a) may be revoked, at the discretion of the Administrator, if—</text>
 <clause commented="no" display-inline="no-display-inline" id="id2E0D5D3FD20142249FEBE20A3768BDD1"><enum>(i)</enum><text>the individual is determined to pose a threat to aviation or national security; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="idE174E69EE39C4FEFAE770ED75A5CBF7F"><enum>(ii)</enum><text>the underlying security clearance is inactivated as a result of a change of the individual’s employment or the end of an individual’s appointment in a particular position.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="id5569435a6180486ab90e5d8d02691787"><enum>4.</enum><header>TSA PreCheck enrollment for law enforcement officers</header>
 <subsection id="id11c409456be848a388f0673e410824a5"><enum>(a)</enum><header>Process</header><text>Not later than 180 days after the date of the enactment of this Act, the Administrator of the Transportation Security Administration, in consultation with the Attorney General, shall establish a process to permit the enrollment of certain law enforcement officers in TSA PreCheck.</text>
 </subsection><subsection id="ida2c5f4fcc34342c2acf4703fce2f6423"><enum>(b)</enum><header>Components</header><text>In establishing the process required under subsection (a), the Attorney General and the Administrator shall ensure that—</text>
 <paragraph id="idd78676ad6d6143f5909fbc8564925a36"><enum>(1)</enum><text>eligible applicants for TSA PreCheck provide verification of active employment through coordination with their sponsoring agency;</text>
 </paragraph><paragraph id="id98bed17e8ae341789013f703a88a2a51"><enum>(2)</enum><text>active employment in good standing is required—</text> <subparagraph id="id5043AAB9AE48452DA9E6C7BAF525DC8D"><enum>(A)</enum><text>at the time an application is submitted; and</text>
 </subparagraph><subparagraph id="id4040F3965393437C8AD0561043C4D9BD"><enum>(B)</enum><text>at the time an application is approved;</text> </subparagraph></paragraph><paragraph id="id3bc14d95301d444681903c7fc6c2d85d"><enum>(3)</enum><text>interim disciplinary status is not accepted for purposes of paragraphs (1) and (2); and</text>
 </paragraph><paragraph id="iddb0ca6800fad48c1ab5b6e9e4b2affb6"><enum>(4)</enum><text>approved applicants are assigned a trusted traveler number.</text> </paragraph></subsection><subsection id="id1e402625dd754ef0bf160f440192ec8b"><enum>(c)</enum><header>Eligible law enforcement officers</header><text>An individual shall be eligible to participate in TSA PreCheck under the process established under subsection (a) if he or she—</text>
 <paragraph id="id6bfb3c72716d40ebbc0340f1fa425ab7"><enum>(1)</enum><text>is a public safety officer for a public agency (including a court system) that receives Federal financial assistance;</text>
 </paragraph><paragraph id="idc6d3f1c8c74941e58ec771f290ea2e37"><enum>(2)</enum><text>is a law enforcement officer for a public agency; or</text> </paragraph><paragraph id="id0BC06A7B48004D4BB9043E802244CC01"><enum>(3)</enum><text>occupies another position, as deemed appropriate by the Attorney General and the Administrator.</text>
 </paragraph></subsection><subsection id="id0136c936e5b04c529783448b74c5ffd9"><enum>(d)</enum><header>Fees</header><text>Any individual who enrolls in TSA PreCheck through the process established under subsection (a) shall submit any fee required to cover the costs of participation in such program. Notwithstanding section 3302 of title 31, United States Code, such fee shall be retained and used by the Transportation Security Administration.</text>
			</subsection><subsection id="idd2cadc44fed840ee96c39d9f52c960ca"><enum>(e)</enum><header>Termination; renewal</header>
 <paragraph id="idb02e246c7707463d88f53666e7119dd2"><enum>(1)</enum><header>Term</header><text>If an individual remains eligible for membership in TSA PreCheck under the requirements established by the Transportation Security Administration, his or her participation in TSA PreCheck shall terminate on the date that is 5 years after the date on which such enrollment is approved unless such enrollment is renewed in accordance with applicable law.</text>
 </paragraph><paragraph id="id8c493251caff464b961d1c2910ffeeb4"><enum>(2)</enum><header>Revocation</header><text>An individual’s participation in TSA PreCheck that was initiated through the process established under subsection (a)—</text>
 <subparagraph id="id9E581CD7B9854F498FAECF63A980F8DE"><enum>(A)</enum><text>shall be revoked if the underlying employment is terminated or suspended, as determined by the sponsoring agency; and</text>
 </subparagraph><subparagraph id="id4C3A4505C96343648E8F53992E0391F4"><enum>(B)</enum><text>may be revoked, at the discretion of the Attorney General and the Administrator, based on the termination of the underlying employment if such termination is a result of—</text>
 <clause id="id08E855CF356043009FF8ECFDA475DDF8"><enum>(i)</enum><text>a voluntary change of the individual’s employment; or</text> </clause><clause id="idECF98E8A43CA4269A2BCF9E7B9C41C3C"><enum>(ii)</enum><text>the expiration of the term of service in a particular position to which an individual was appointed.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="id0c4820d07d0a41758dc4ee5f79659d1f"><enum>5.</enum><header>Report on expanded enrollment for trusted traveler programs</header>
 <subsection id="idB423912D21A042578D2846697B2CEB99"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of the enactment of this Act, the Commissioner of U.S. Customs and Border Protection and the Administrator of the Transportation Security Administration, in consultation with the Attorney General, the Director of the National Background Investigations Bureau of the Office of Personnel Management, and other appropriate departments and agencies of the Federal Government, shall submit a report to Congress on the feasibility of expanding the enrollment processes established under sections 3 and 4 to the Trusted Traveler Programs listed in subsection (b).</text>
 </subsection><subsection id="idD03B9349F1CA417F987462052B0ED51B"><enum>(b)</enum><header>Trusted Traveler Programs</header><text>The programs listed in this subsection are—</text> <paragraph id="id1711969794b94df497920f03f9232a03"><enum>(1)</enum><text>Global Entry;</text>
 </paragraph><paragraph id="id213983548a854c0a8461465add1c8004"><enum>(2)</enum><text>SENTRI;</text> </paragraph><paragraph id="id4105d0bbcb2e4e1298a2f6cbbe7470a1"><enum>(3)</enum><text>NEXUS; and</text>
 </paragraph><paragraph id="id7c4f87807bba4cf9b7fa8aa09afa3228"><enum>(4)</enum><text>any travel facilitation program that is similar to any of the programs listed in paragraphs (1) though (3) and has been designated by the Secretary of Homeland Security to be included in the report required under subsection (a).</text></paragraph></subsection></section></legis-body><endorsement><action-date>December 2, 2019</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
