			 sensitivity index products of the National Oceanic and Atmospheric
			 Administration for each coastal area of the Great Lakes, and for other
 purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Great Lakes Environmental Sensitivity Index Act of 2019</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id22f81a19-755a-4a21-8632-e8486a542a2e" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Update to environmental sensitivity index products of National Oceanic and Atmospheric Administration for Great Lakes</header><subsection commented="no" display-inline="no-display-inline" id="id5b792c0d-0d94-43a6-a70d-56a2774aa98d"><enum>(a)</enum><header display-inline="yes-display-inline">Update required for environmental sensitivity index products for Great Lakes</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Under Secretary for Oceans and Atmosphere shall commence updating the environmental sensitivity index products of the National Oceanic and Atmospheric Administration for each coastal area of the Great Lakes.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id94E21862D81E43D7BBA9969F123960EC"><enum>(b)</enum><header display-inline="yes-display-inline">Periodic updates for environmental sensitivity index products generally</header><text display-inline="yes-display-inline">Subject to the availability of appropriations and the priorities set forth in subsection (c), the Under Secretary shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id08DD51EBFF4B438CA6A6A3A72703147A"><enum>(1)</enum><text display-inline="yes-display-inline">periodically update the environmental sensitivity index products of the Administration; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1EFF91F25D724A1291B57DCF1B19B7B4"><enum>(2)</enum><text display-inline="yes-display-inline">endeavor to do so not less frequently than once every 7 years.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAC1E977AA2A9472DB8D62BFF643C5AA7"><enum>(c)</enum><header display-inline="yes-display-inline">Priorities</header><text display-inline="yes-display-inline">When prioritizing geographic areas to update environmental sensitivity index products, the Under Secretary shall consider—</text><paragraph commented="no" display-inline="no-display-inline" id="id2F5400F36D604555BD33404C80E2AA8E"><enum>(1)</enum><text display-inline="yes-display-inline">the age of existing environmental sensitivity index products for the areas;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2541E386252A454BABD954D993EF0287"><enum>(2)</enum><text display-inline="yes-display-inline">the occurrence of extreme events, be it natural or man-made, which have significantly altered the shoreline or ecosystem since the last update;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF41154A3161F46678B7A0AE29E7AE032"><enum>(3)</enum><text display-inline="yes-display-inline">the natural variability of shoreline and coastal environment; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id324DF4D53A7E4085A1F1E1B8F595532C"><enum>(4)</enum><text display-inline="yes-display-inline">the volume of vessel traffic and general vulnerability to spilled pollutants.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id743b8d33-20e8-4cf8-90b0-638f6baaa0dc"><enum>(d)</enum><header display-inline="yes-display-inline">Environmental sensitivity index product defined</header><text display-inline="yes-display-inline">In this section, the term <term>environmental sensitivity index product</term> means a map or similar tool that is utilized to identify sensitive shoreline, coastal or offshore, resources prior to an oil spill event in order to set baseline priorities for protection and plan cleanup strategies, typically including information relating to shoreline type, biological resources, and human use resources.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idE31227A73C4B4C77824D0B89EA694313"><enum>(e)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Amounts for activities under this section shall be derived from amounts otherwise authorized to be appropriated or made available for the Under Secretary.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20201112" chamber="Senate">Passed the Senate November 16, 2020.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
