			 respect to levels of corruption by their governments and their efforts to
			 combat such corruption, and to assess United States assistance to
			 designated countries in order to advance anti-corruption efforts in those
			 countries and better serve United States taxpayers.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
 <section commented="no" display-inline="no-display-inline" id="idd7d9b46cff7d4b33b9e9ca66866162be" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph commented="no" display-inline="no-display-inline" id="idd2548d286ab940c291c6daa919d34e05"><enum>(1)</enum><text display-inline="yes-display-inline">it is in the foreign policy interest of the United States to help foreign countries promote good governance and combat public corruption;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4c33edb1b7d843f5854e5105741e17c4"><enum>(2)</enum><text display-inline="yes-display-inline">multiple Federal departments and agencies operate programs that promote good governance in foreign countries and enhance such countries’ ability to combat public corruption; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1ae79e8039914a31a7233d3269694ec7"><enum>(3)</enum><text display-inline="yes-display-inline">the Department of State should—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id8391B67B139B4C0DA6C19CB05513C577"><enum>(A)</enum><text display-inline="yes-display-inline">promote coordination among the Federal departments and agencies implementing programs to promote good governance and combat public corruption in foreign countries in order to improve effectiveness and efficiency; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id47bfcdd1375546158faf643741f98cfc"><enum>(B)</enum><text display-inline="yes-display-inline">identify areas in which United States efforts to help other countries promote good governance and combat public corruption could be enhanced.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="idbc847ea1cf5b40509cc49ec05f0b3064" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Annual assessment</header>
 <subsection commented="no" display-inline="no-display-inline" id="idec571d5aa3a9411186fd17df209a75cc"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each of the fiscal years 2020 through 2026, the Secretary of State shall assess the capacity and commitment of foreign governments to which the United States provides foreign assistance under the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151</external-xref> et seq.) or the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751</external-xref> et seq.) to combat public corruption. Each such assessment shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="ided812e62e78546229fd09798fb37b923"><enum>(1)</enum><text display-inline="yes-display-inline">utilize independent, third party indicators that measure transparency, accountability, and corruption in the public sector in such countries, including the extent to which public power is exercised for private gain, to identify those countries that are most vulnerable to public corruption;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id87ff2f49d7924f55b3f6f1ee372765bd"><enum>(2)</enum><text display-inline="yes-display-inline">consider, to the extent reliable information is available, whether the government of a country identified under paragraph (1)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id95539247c6c840969de86f8bbe611a9b"><enum>(A)</enum><text display-inline="yes-display-inline">has adopted measures to prevent public corruption, such as measures to inform and educate the public, including potential victims, about the causes and consequences of public corruption;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1a96d38e685548bba0281926d589e568"><enum>(B)</enum><text display-inline="yes-display-inline">has enacted laws and established government structures, policies, and practices that prohibit public corruption;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3e64f1bdbb8c48f9b28390c2d97c7125"><enum>(C)</enum><text display-inline="yes-display-inline">enforces such laws through a fair judicial process;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf446d8284dfa445e8751634bb626d038"><enum>(D)</enum><text display-inline="yes-display-inline">vigorously investigates, prosecutes, convicts, and sentences public officials who participate in or facilitate public corruption, including nationals of such country who are deployed in foreign military assignments, trade delegations abroad, or other similar missions who engage in or facilitate public corruption;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddf329a3d2119436f8a2fad8484b189a8"><enum>(E)</enum><text display-inline="yes-display-inline">prescribes appropriate punishment for serious, significant corruption that is commensurate with the punishment prescribed for serious crimes;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id869e2597272c4fb9b9cb15b4ccb66a68"><enum>(F)</enum><text display-inline="yes-display-inline">prescribes appropriate punishment for significant corruption that provides a sufficiently stringent deterrent and adequately reflects the nature of the offense;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0c662e95a70c4d06981e5b9ab2f3bb9a"><enum>(G)</enum><text display-inline="yes-display-inline">convicts and sentences persons responsible for such acts that take place wholly or partly within the country of such government, including, as appropriate, requiring the incarceration of individuals convicted of such acts;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc77c1e84f6834ab1809eb7886ac8cee9"><enum>(H)</enum><text display-inline="yes-display-inline">holds private sector representatives accountable for their role in public corruption; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id504ad56365214bb480a7b02ee51a5e16"><enum>(I)</enum><text display-inline="yes-display-inline">addresses threats for civil society to monitor anti-corruption efforts; and</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1e7c7299f0f849a380bee58ad2e47354"><enum>(3)</enum><text display-inline="yes-display-inline">further consider—</text> <subparagraph commented="no" display-inline="no-display-inline" id="iddfe7a419cd2d4c89a16370936ae3ee8c"><enum>(A)</enum><text display-inline="yes-display-inline">verifiable measures taken by the government of a country identified under paragraph (1) to prohibit government officials from participating in, facilitating, or condoning public corruption, including the investigation, prosecution, and conviction of such officials;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id70de7aaf3c874de8b31654fb704bc09c"><enum>(B)</enum><text display-inline="yes-display-inline">the extent to which such government provides access, or, as appropriate, makes adequate resources available, to civil society organizations and other institutions to combat public corruption, including reporting, investigating, and monitoring;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id57004cdaaf374633a83445f387c03cca"><enum>(C)</enum><text display-inline="yes-display-inline">the extent to which an independent judiciary or judicial body in such country is responsible for, and effectively capable of, deciding public corruption cases impartially, on the basis of facts and in accordance with law, without any improper restrictions, influences, inducements, pressures, threats, or interferences, whether direct or indirect, from any source or for any reason;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idde581394f38c45bc859699d46a7cec61"><enum>(D)</enum><text display-inline="yes-display-inline">the extent to which such government cooperates meaningfully with the United States to strengthen government and judicial institutions and the rule of law to prevent, prohibit, and punish public corruption;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2f14172973a84633a40c42446281ec7c"><enum>(E)</enum><text display-inline="yes-display-inline">the extent to which such government—</text> <clause commented="no" display-inline="no-display-inline" id="id498d582028104d84acd7005064e657b7"><enum>(i)</enum><text display-inline="yes-display-inline">is assisting in international investigations of transnational public corruption networks and in other cooperative efforts to combat serious, significant corruption, including cooperating with the governments of other countries to extradite corrupt actors;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id02360a9a688b4e2c8642a850a7d0797e"><enum>(ii)</enum><text display-inline="yes-display-inline">recognizes the rights of victims of public corruption, ensures their access to justice, and takes steps to prevent such victims from being further victimized or persecuted by corrupt actors, government officials, or others; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id58fb94a00dbf4a2e990f8cf4e0bf56fd"><enum>(iii)</enum><text display-inline="yes-display-inline">refrains from prosecuting legitimate victims of public corruption or whistleblowers due to such persons having assisted in exposing public corruption, and refrains from other discriminatory treatment of such persons; and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id222cafdefe8c4ba4973b56f1169d5910"><enum>(F)</enum><text display-inline="yes-display-inline">contain such other information relating to public corruption as the Secretary of State considers appropriate.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2b31e910ad0f438a86a6eaca82b591e8"><enum>(b)</enum><header display-inline="yes-display-inline">Identification</header><text display-inline="yes-display-inline">After conducting each assessment under subsection (a), the Secretary of State shall identify, of the countries described in subsection (a)(1)—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id6FEEAC3AA3034F888A5E632131C8184C"><enum>(1)</enum><text display-inline="yes-display-inline">which countries are meeting minimum standards to combat public corruption;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id657ef2f5d53b4212a51846e9362c577d"><enum>(2)</enum><text display-inline="yes-display-inline">which countries are not meeting such minimum standards, but are making significant efforts to do so; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb23031ecb0704212b8f8866aa36fb645"><enum>(3)</enum><text display-inline="yes-display-inline">which countries are not meeting such minimum standards and are not making significant efforts to do so.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd29a87e563bb46808cab36b2e705785c"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Except as provided in subsection (d), not later than 180 days after the date of the enactment of this Act, and annually thereafter through fiscal year 2026, the Secretary of State shall submit a report to the appropriate congressional committees, and make such report publicly available. Such report shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id7589E4D53C1B4FFC8E4808C5B2AAD06B"><enum>(1)</enum><text display-inline="yes-display-inline">identify the countries described in subsection (a)(1) and paragraphs (2) and (3) of subsection (b);</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDDE4E6471A1B412D8C4AEFEBA2FB419C"><enum>(2)</enum><text display-inline="yes-display-inline">describe the methodology and data utilized in the assessments under subsection (a); and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC9ACE3CC7A3248BE99C4A7BD1A8BB3CD"><enum>(3)</enum><text display-inline="yes-display-inline">identify the reasons for the identifications referred to in paragraph (1).</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd56fceb9b026425b863383e7dc638af8"><enum>(d)</enum><header display-inline="yes-display-inline">Briefing in lieu of report</header><text display-inline="yes-display-inline">The Secretary of State may waive the requirement to submit and make publicly available a written report under subsection (c) if the Secretary—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id4367f7d5c9c84b059a6fc1f0bf89ff1d"><enum>(1)</enum><text display-inline="yes-display-inline">determines that publication of such report would—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id4ac25ca2cb95431b8edd9c21ed9d17fd"><enum>(A)</enum><text display-inline="yes-display-inline">undermine existing United States anti-corruption efforts in 1 or more countries; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id80e2e9e42bbe4c1dbf0749f5dffc6691"><enum>(B)</enum><text display-inline="yes-display-inline">threaten the national interests of the United States; and</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcdb0bee58e5b4490a4054c2191ebac63"><enum>(2)</enum><text display-inline="yes-display-inline">provides a briefing to the appropriate congressional committees that—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id8FE1A06AD1774D468CC13F7642EFAD9F"><enum>(A)</enum><text display-inline="yes-display-inline">identifies the countries described in subsection (a)(1) and paragraphs (2) and (3) of subsection (b);</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12C1D97E724E4A8E9E4E949C70F2FD2B"><enum>(B)</enum><text display-inline="yes-display-inline">describes the methodology and data utilized in the assessment under subsection (a); and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC1836A006EC64FCE98FEE2E0ED33E8F4"><enum>(C)</enum><text display-inline="yes-display-inline">identifies the reasons for such identifications.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2798C79549D847C7A339A5EBCEC0086D"><enum>(e)</enum><header display-inline="yes-display-inline">Appropriate congressional committee defined</header><text display-inline="yes-display-inline">In this section, the term <term>appropriate congressional committees</term> means—</text> <paragraph commented="no" display-inline="no-display-inline" id="idBEFA88A7630244428ECE0060E1A8ED76"><enum>(1)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE9CE6C9EA95E4CAF8969DE7F3FBA1EC5"><enum>(2)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9268089DB69C40B5B976F7A5B72958E1"><enum>(3)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0DDA0B70AA8A41CE98712E7669C0E70E"><enum>(4)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>.</text> </paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ideb4be2eb4bfa47e8817f7d2643a40505" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Transparency and accountability</header><text display-inline="no-display-inline">For each country identified under paragraphs (2) and (3) of section 2(b), the Secretary of State, in coordination with the Administrator of the United States Agency for International Development, as appropriate, shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id744a2d356f024778b0e1efcee5678e47"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that a corruption risk assessment and mitigation strategy is included in the integrated country strategy for such country; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04c2da309f3a478a86e4e16cd2eeaa15"><enum>(2)</enum><text display-inline="yes-display-inline">utilize appropriate mechanisms to combat corruption in such countries, including by ensuring—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id62ccbef935aa4d2c9ebeace4e2896563"><enum>(A)</enum><text display-inline="yes-display-inline">the inclusion of anti-corruption clauses in contracts, grants, and cooperative agreements entered into by the Department of State or the United States Agency for International Development for or in such countries, which allow for the termination of such contracts, grants, or cooperative agreements, as the case may be, without penalty if credible indicators of public corruption are discovered;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id38e52ce8a5fc41b99011c7bcde2be90b"><enum>(B)</enum><text display-inline="yes-display-inline">the inclusion of appropriate clawback or flowdown clauses within the procurement instruments of the Department of State and the United States Agency for International Development that provide for the recovery of funds misappropriated through corruption;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida6f6ff19fe15437482a116009819b13b"><enum>(C)</enum><text display-inline="yes-display-inline">the appropriate disclosure to the United States Government, in confidential form, if necessary, of the beneficial ownership of contractors, subcontractors, grantees, cooperative agreement participants, and other organizations implementing programs on behalf of the Department of State or the United States Agency for International Development; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idca16225149fb405fa9531e7b39037e6b"><enum>(D)</enum><text display-inline="yes-display-inline">the establishment of mechanisms for investigating allegations of misappropriated resources and equipment.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id20a20e1f76fc4b6db1fad20bb998ebe5" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Designation of embassy anti-corruption points of contact</header>
 <subsection commented="no" display-inline="no-display-inline" id="id75afb3a272c6490db3053194a95dff56"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of State shall annually designate an anti-corruption point of contact at the United States diplomatic post to each country identified under paragraphs (2) and (3) of section 2(b), or which the Secretary otherwise determines is in need of such a point of contact. The point of contact shall be the chief of mission or the chief of mission's designee.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id34992e8537c84e01828a97d57489178e"><enum>(b)</enum><header display-inline="yes-display-inline">Responsibilities</header><text display-inline="yes-display-inline">Each anti-corruption point of contact designated under subsection (a) shall be responsible for coordinating and overseeing the implementation of a whole-of-government approach among the relevant Federal departments and agencies operating programs that—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id310BB578CACF41A38F3A2E9815D4DCCB"><enum>(1)</enum><text display-inline="yes-display-inline">promote good governance in foreign countries; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71DA5024CE3940349BC5E2D00E7A05FD"><enum>(2)</enum><text display-inline="yes-display-inline">enhance the ability of such countries—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id51D5ACA2379F4BE28A6B084AF642351D"><enum>(A)</enum><text display-inline="yes-display-inline">to combat public corruption; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0A37705FA7CC461DA8C8B6D7953E85BB"><enum>(B)</enum><text display-inline="yes-display-inline">to develop and implement corruption risk assessment tools and mitigation strategies.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida02c596e55774749aab1c080198fef5a"><enum>(c)</enum><header display-inline="yes-display-inline">Training</header><text display-inline="yes-display-inline">The Secretary of State shall implement appropriate training for anti-corruption points of contact designated under subsection (a).</text>
 </subsection></section><section id="id9BC3A0C2DC8F464AA3378E001F6CB5B6" section-type="subsequent-section"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="idc44ea88c85d44055acb96cdfcb2b3ed9"><enum>(1)</enum><header>Corrupt actor</header><text>The term <term>corrupt actor</term> means—</text>
 <subparagraph id="idf5319e6ad39b45649891e093b7cdb707"><enum>(A)</enum><text>any foreign person or entity that is a government official or government entity responsible for, or complicit in, an act of public corruption; and</text>
 </subparagraph><subparagraph id="idef95dbf250c446ecbfdec6d1b54c28da"><enum>(B)</enum><text>any company, in which a person or entity described in subparagraph (A) has a significant stake, which is responsible for, or complicit in, an act of public corruption.</text>
 </subparagraph></paragraph><paragraph id="idec7069a1499643d2a3b3efc85c95ee73"><enum>(2)</enum><header>Foreign assistance</header><text>The term <term>foreign assistance</term> means assistance made available under—</text> <subparagraph id="id6c76a2466e2843cea870b25716e034c2"><enum>(A)</enum><text>the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151</external-xref> et seq.); or</text>
 </subparagraph><subparagraph id="idec5c7fbc90de4c7ea421235a7fd81c9e"><enum>(B)</enum><text>the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751</external-xref> et seq.).</text> </subparagraph></paragraph><paragraph id="id96d711ecff2c4465939cc275da25a15a"><enum>(3)</enum><header>Grand corruption</header><text>The term <term>grand corruption</term> means public corruption committed at a high level of government that—</text>
 <subparagraph id="id3eea02c3035e4996af1039644602d5a3"><enum>(A)</enum><text>distorts policies or the central functioning of the country; and</text> </subparagraph><subparagraph id="ida29b72a49e6746f3968788d3312a2d49"><enum>(B)</enum><text>enables leaders to benefit at the expense of the public good.</text>
